We've got a lot to catch up with on today's BradCast, after a weekend lost to recovery from our Moderna booster shots. [Audio link to full show is posted below this summary.]

First up, we discuss how things went following Friday boosters for both Desi and myself. For me, as after the second shot, not so good (though much better than actual COVID!) For Desi...it was pretty much business as usual beyond a bit of fatigue. Either way: Go get your shots! Also, just before air, California announced they are re-instituting a statewide mask mandate for indoor, public spaces amid another surge in COVID cases.

Next, 74 people are now confirmed dead in Kentucky alone, and more than a dozen were killed in four other Midwestern states on Friday night after a swarm of very late season tornadoes devastated an eight-state area, as unusually warm December air met with a cold front. Predictably, a climate change-fueled disaster ensued as the states, particularly Kentucky, now wrestle with mass power and water outages amid freezing temperatures for tens of thousands of residents while trying to sift through rubble and continue recovery efforts. Desi details the extreme weather's known connections to climate change and how (and if) corporate media are bothering to cite the causes for yet another deadly, intense, out-of-season extreme weather event.

Then, also breaking over the weekend, the release of a PowerPoint document called "Election Fraud, Foreign Interference & Options for JAN 6". It was obtained by the U.S. House Select Committee investigating January 6, from Donald Trump's former Chief of Staff Mark Meadows. The document was turned over to the Committee as part of a tranche of email and text message documents from Meadows before he decided he would stop cooperating with them. He will now almost certainly face federal criminal contempt charges, just as Trump's former aide Steve Bannon is now facing for also failing to answer lawful subpoenas from Congress.

This latest "smoking gun" document --- a 38-page version of which was circulated after the election last year, and a very similar 36-page version dated on Jan. 5 --- further cements the details behind the broad criminal conspiracy to steal the 2020 election from Joe Biden and the American people by Donald Trump and his minions. In this case, those cronies include the bulk of his Campaign staff and attorneys, much of his White House staff, members of the Dept. of Justice and a whole bunch of elected officials both in Congress and in the states.

We walk through a number of the evidence-free assertions made in the PowerPoint presentation which, according to Meadows, was to be shared with people "on the Hill" on January 5. Among those assertions, that China and Venezuela had "systematically gained control over our election system constituting a national security emergency," after "electronic voting machines were compromised."

Of course, there is zero evidence included in the document for those extraordinary claims. And those referencing Venezuela are known to be nonsense, since they are directly based on my own exclusive reporting at The BRAD BLOG from 2008 to 2010, which Team Trump subsequently lifted, twisted, mangled and bastardized to somehow support their false, easily-disproven and evidence-free narrative.

As to the "national security emergency" cited by the document, Trump was encouraged to declare one in order to then order ballots collected by the National Guard and U.S. Marshalls in all 50 states, to be counted by them once "invalid" and "fraudulent" ballots were somehow removed. Those same National Guard members, Meadows' documents also assert, according to the House Committee, were also to be tasked to "protect pro Trump people" on January 6 during the attack on the U.S. Capitol after Pence refused to go along with the plan to declare the Electoral College votes invalid. The last effort by Team Trump to steal the election was, as we all know, to hurl thousands of his gullible supporters at the Capitol itself in hopes of preventing the Constitutional certification of Joe Biden's legitimate election victory. The subsequent deadly attack was exactly what Bannon blatantly teased on his "War Room" podcast on January 5th. They were all in on it, including a bunch of members of Congress, as the Jan 6 Committee has recently been suggesting.

We explain much more detail on what is revealed by the ridiculous claims in the PowerPoint presentation on today's program, and how the guy --- retired U.S. Army Colonel Philip Waldron --- who reportedly circulated it among the dupes on the Right, actually met with Meadows at the White House as many as 10 times in the run-up to January 6th.

But the main point is this: Donald Trump and his minions employed a coordinated attempt to steal the 2020 Presidential election. It was not haphazard and it was not just low level operatives. And it was not, as media and many Dems still mis-describe it, an attempt to overturn or reverse or question or subvert the results. It was not an attempt to ferret out "voter fraud" or "election fraud". Donald Trump tried to STEAL the 2020 election and this was the "Rosetta Stone" road map for it. It would help the nation understand how close we came to losing what is left of our democracy entirely if it was described in those simple, basic and absolutely accurate terms.

What do about it? That will, no doubt, be the subject of future programs. But, at least today, hopefully, you will understand what happened and what didn't --- along with what they tried to do, and what they failed to do --- so we can all take action to make sure, somehow, something like this can never happen again...

Medicare Open Enrollment ended on Tuesday, but I learned that you can still make changes to your plan during a special period that runs from January to March. So, with that in mind, I'm sharing an interview I did on my show on Monday, the day before open enrollment ended.

But, first up today, some of today’s news headlines, including the Supreme Court's ruling on the Texas abortion ban case, S.B. 8; the threat posed to Ukraine by Russia; the UK court determining that Julian Assange may be extradited to the U.S. to stand trial; the successful vote to create a union shop at a Starbucks in Buffalo, New York and the decision by Kellogg's to replace striking workers at their Michigan factory with scabs (and an Internet scheme that has crashed that plan); how Big Pharma has raised prices far in excess of the current rate of inflation, and more.

Then...by now, you've probably been inundated with commercials about Medicare Advantage. Remember the old adage, if something seems too good to be true, it usually is? That applies to healthcare too. Not only is Medicare Advantage not what they present it to be, it is an instrument leading to the privatization of Medicare.

And from an article I read at Common Dreams last week, I learned that there's another Medicare privatization scheme that started under Trump and is still forging ahead during the Biden years, called Direct Contracting.

So today, I speak with DR. DIANE ARCHER of JustCareUSA.org, who truly explains all you need to know about traditional Medicare and gap insurance, Medicare Advantage, and the new Direct Contracting program. And as I mentioned during the interview, there's an explanation of what it takes to buy a Medicare gap policy after you've been in a Medicare Advantage program. Find that explainer here. But beware, it's not pretty!

For those of us still too young for Medicare, we're still in the open enrollment period for the ACA (or, Obamacare) through healthcare.gov or your state exchange. Biden's pandemic relief bill, the American Rescue Plan, that was passed soon after he tool office really brought down our costs. So if you go to the exchange, you can find good insurance at a very good price.

To be covered on Jan. 1, you must enroll by Dec. 15. Open enrollment runs through Jan. 15...

Yes, the walls are continuing to close in on our disgraced, twice-impeached, indescribably criminal previous President, as discussed in two encouraging news stories today. But much of his damage is already done, to a rightwing party that has become so whacked out and authoritarian that the rails they are now off of can no longer be seen. On the other hand, we've got more good news for labor, the economy and maybe even democracy under Joe Biden's Presidency on today's BradCast...whether the corporate media decides to notice such things or not. [Audio link to full program is posted at the end of this summary.]

Among the enormous grab bag of stories covered on today's program...

  • Lowest in 52 years: New weekly jobless claims come in at another record low today. And, while you might think such good news numbers, not seen since 1969, would be both cause of celebration and front page news alerts, that sort of thing only happens when such things occur while's there's a Republican in the White House, apparently.
  • Good news brewing for workers: A Starbucks shop in Buffalo, New York becomes the first of the coffee giant's corporate-owned stores to become unionized in the United States. As discussed with labor historian Nelson Lichtenstein on a recent BradCast, the company will spend untold millions to keep that from spreading to its tens of thousands of other stores where workers may finally be realizing the collective bargaining is good for everybody.
  • At least someone's doing something about it: Italy issues a record fine to e-commerce giant Amazon of more than a billion dollars for their monopolistic practices. Why doesn't the U.S. do the same thing? Perhaps it will with Joe Biden's new, anti-monopoly warriors setting up shop at the Federal Trade Commission and the anti-trust division at the Dept. of Justice.
  • Unsolved MAGA mysteries: Some of the wingnuts on pillow impresario and failed election fraud fraudster Mike Lindell's streaming disinformation channel think it must be a Big Government conspiracy causing rightwing anti-vax and anti-mask warriors to keeping contracting COVID and dying from it. We think there may be another explanation.
  • You decide: Authoritarian Fox "News" prime time star Laura Ingram can't figure out what Washington Post's Dana Milbank could possibly be referring to in calling for media to stand up for democracy right now. "Authoritarians? What are they even talking about?," Ingram puzzles. "Authoritarians? Who's that?!"
  • Show-Me shame: Missouri's embarrassing wingnut Attorney General and U.S. Senate hopeful Eric Schmitt embarrasses my old home state with a letter welcoming President Biden to the Show Me state for his "first visit as President to one of the 25 states that cast its electoral votes for President Trump in 2020" before, on official state AG letterhead, describing him as a "socialist" endangering "the livelihoods of tens of millions" by mandating vaccines or testing for many workers. For an AG, you'd think he'd be better at fact-checking. (Biden has actually visited seven other Trump states before arriving in MO.) But, it's Schmitt's recent Big Government mandate to local public health officials and school boards across the state to immediately end "all" public health orders --- for mask mandates, quarantines and more --- that has one of our listeners from the state (an elementary school teacher) so troubled. She also smartly wonders: "What happened to Republicans being the party of local control?"
  • I ❤ New York: As to those walls continuing to close in on the criminal former President, we've got two related pieces of good news today. In one, New York Attorney General Leticia James is reportedly calling Trump in for a deposition in her civil suit examining years of apparent tax and bank fraud by the Trump Organization.
  • I ❤ the D.C. Court of Appeal: In today's second Trump accountability story, the federal appeals court in D.C. has denied his appeal claiming "Executive Privilege" should block the release of a treasure trove of White House documents regarding his January 6th attack on the U.S. Capitol, as subpoenaed from the National Archives by the House Select Committee investigating the insurrection and approved by the current Commander-in-Chief (the only one who ACTUALLY is able to invoke Executive Privilege.)
  • 'Yes, Democracy is hard': Democracy is down but not out...yet. President Biden convened the first Summit for Democracy today, with more than 100 of the world's democratic nations invited to attend. We share part of his opening statement, wherein he acknowledges that democracy is on a "backward slide", even here in the U.S., but that its still well worth fighting for and definitely beats the alternative of autocracy, rising around the world, and even here at home.
  • State of emergency: Finally, Desi Doyen joins us for our latest Green News Report, covering Biden's new Executive Orders to achieve net zero emissions by 2050; Florida taking unprecedented steps to save beloved manatees; troubling news for New Englanders this winter; and a heads-up on a new, blockbuster Hollywood "comedy" aiming to underscore our climate change emergency in a very clever way...

The U.S. economy, of course, has been rigged for years. The pandemic, in the meantime, has now made that clearer than ever. Not that the corporate media is bothering to explain it to Americans. So, w try to do so on today's BradCast. [Audio link to full show is posted below this summary.]

But, first up, results from several, eagerly awaited new lab studies on the effectiveness of the mRNA vaccines from Pfizer and Moderna on the Omicron variant have been released over the past 24 hours. Two independent studies, one from South Africa and another from Sweden, along with a press release on findings of a study by Pfizer, all suggest that getting a booster shot as soon as possible is the best way to avoid severe illness both from Omicron and all of the other previously-known variants. We walk you through the details and explain the findings today.

The upshot: Two vaccine doses and natural immunity from COVID is way better against Omicron than just two vaccine doses. Two vaccine doses and a booster shot is as good or better than two doses and COVID. So, unless you want to try your luck by getting COVID to protect yourself against it, a booster shot, right now, is your very best best. That, as infections, hospitalizations and deaths are all beginning to sky-rocket again, as the nation is on the verge of 800,000 COVID deaths.

Next, we've been reporting for the past several weeks on the lousy job the corporate media have been doing in covering what is, overall, a surprisingly robust economic recovery in the first year of the Biden Administration, as the nation (and world) struggles to emerge from our nearly two-year pandemic.

One of the media's worst and most misleading points of coverage has been on the matter of inflation. And, while our regular, global supply chains have certainly become knotted up, leading to legitimate upward price pressures, much of the added costs for goods and services is now thanks to good old profiteering and price fixing by companies which have been enjoying record profits, even during the worst of the pandemic and subsequent supply chain snarls.

As our guest today, author and financial journalist DAVID DAYEN, Executive Editor of The American Prospect recently reported, "In a time of high inflation, you hear a lot about companies 'passing costs' on to customers. In order for companies to maintain their God-given right to earn a profit, they must raise prices to offset the cost of producing goods and getting them into peoples’ hands. And thanks mostly to the hidden risk, exposed by the pandemic, of neoliberal gospels like just-in-time logistics, deregulation, and offshoring, prices really are going up."

"But," he continues, "there’s something else mixed in with this latest bout of inflation. Companies aren’t just passing costs onto us. With corporations using inflation as a cover for raising their prices, you and I are passing profits onto companies."

Dayen, author of the new book Monopolized: Life in the Age of Corporate Power, details how companies are not only profiteering, price-fixing and colluding to do so, they're actually bragging about it, out loud, on corporate earnings calls. That is sending up both stock prices and profits up for hundreds of the most profitable public corporations, many of whom have monopolistically been allowed to corner their markets, giving consumers few, if any, cheaper alternatives for the products and services they sell. Companies that don't play ball --- like Target, which announced they would not be raising prices --- have been punished, in turn, by Wall Street for daring to do so.

"The problem is that we have a business climate today where people have locked in their customer base. Your customers can't escape, because we have a series of consolidated companies that have a stranglehold on market share, and we don't even know that it's happening. You stroll down a grocery aisle and you see hundreds of items, but you don't know that the same handful of companies have created all of them," Dayen explains today. "And that's why you have large companies like Proctor & Gamble and Unilever saying 'We know we can raise prices on people...and we don't have to worry about any kind of material reaction.'" The same is true, of course, with many other companies, such as the Big Oil cartel, which is raking in record profits as raw materials fall, but failing to reflect those falling costs at the pump.

So, what, if anything, can be done about it? Are Presidents and their Administrations actually able to take actions that might roll back the corporate profiteering? Yes, Dayen explains, at least some, both with the use of the bully pulpit --- which, in the model of JFK, Biden has begun to try and do --- and also with the use of existing anti-trust and anti-price-fixing laws that are still on the books today, if rarely enforced.

"It is price-fixing," Dayen tells me. "But we don't spend a whole lot of time on that anymore in America. It's still unlawful. It's still occasionally prosecuted. And now we do have a different regime at places like the Federal Trade Commission, and the anti-trust division at the Justice Department." He believes that several key, progressive Biden appointments at both may be able to "turn the tide" back against corporate mergers and unapologetic (and potentially unlawful) corporate greed. "There is certainly a faction within the White House that feels like this is a serious problem and that we have to do everything possible to stamp it out," he says, but "they're swimming upstream, as it were."

There is a lot on these points to discuss with Dayen today. As well, we also get his reaction to the announcement today that Biden is withdrawing his nomination of Saule Omarova as Comptroller of the Currency, a key banking regulator, after red-baiting by Republican Senators (she was born in the Soviet Union) and concerns from conservative Democrats that she might be too tough on big banks. He also offers his two cents on our complaints, of late, about the terrible job that corporate media are doing in covering both Joe Biden and the economy.

Finally, after months of pretend complaints by Republicans and Democratic Senator Joe Manchin that spending $1.75 trillion in paid-for taxpayer dollars to expand health care, education, child care, elder care, and fight climate change over the next ten years in the Build Back Better bill is just too much money to spend for a poor country like ours, the House on Tuesday night, in record time, passed its latest annual defense spending bill with a lopsided bi-partisan vote in favor (opposed largely only by progressive Democrats). It'll cost nearly one trillion dollar ($768 billion, $24 billion more than the Biden Administration even asked for) for one single year of military spending --- much of which will go to stuff we never use and/or literally blow up.

Priorities.

On today's BradCast, we've got trouble both at home and abroad. But what else is new? [Audio link to full program is posted at the end of this summary.]

As if our domestic problems aren't disturbing enough, a couple of roiling foreign policy issues are landing on Joe Biden's desk this week. The President met via video-conference on Tuesday with Russia President Vladimir Putin to discuss the troubling build-up of Russian forces near the border of eastern Ukraine, suggesting a full-scale invasion of the former Soviet bloc country could be imminent in coming weeks and months. Biden reportedly threatened serious economic consequences for Russia if that happens. For his part, Putin seeks a commitment from NATO that Ukraine will never be allowed to join the joint defense organization. That condition is said to be a non-starter for both Biden and our NATO allies.

Elsewhere, China is none too happy with Biden's decision to implement a "diplomatic boycott" of the upcoming Winter Olympics in Beijing. Though U.S. athletes will be allowed to attend, Administration officials will not, leading China to describe the move as an "outright political provocation" and vowing "firm countermeasures," whatever that might mean.

Meanwhile, here at home, we're still trying to clean up after Donald Trump's attempt to steal the 2020 election, while trying to prevent him and the Republicans from more successfully stealing future elections. It won't be easy.

Last week, following the two federal indictments of Steve Bannon for failing to answer lawful subpoenas issued by the U.S. House Select Committee investigating the January 6th attack on the Capitol, Trump's former Chief of Staff Mark Meadows agreed --- sort of --- to cooperate with the Committee in regards his own subpoenas. Today, he reportedly changed his mind and, in turn, may also now be looking at indictments in the days ahead, along with two years in prison. Apparently his boss, the disgraced, twice-impeached former President, doesn't want him talking to the Committee for some reason. Happily, Mike Pence's former Chief of Staff, reportedly --- along with hundreds of others --- are already doing so.

With at least some accountability now likely in the offing for Meadows --- even as Merrick Garland's Dept. of Justice has, to date, brought no accountability on its own to the former President and his criminal clan for an endless list of crimes that includes the attempt to steal 2020 --- the Department filed a new lawsuit against Texas on Monday. The litigation seeks to block the Lone Star State's new Congressional and legislative maps as violations of the Voting Rights Act. While Texas gained two new House seats following the 2020 Census, they have now added two new White-majority Congressional Districts and eliminated a Latino-controlled seat. That, despite the fact that 95% of the population growth in the state is thanks to Latinos and Blacks. The DoJ, in their press conference announcing the suit yesterday, noted this isn't the first time TX has attempted to racially gerrymander its maps for partisan advantage. Though it may be much more difficult to challenge them this time around with the gutting of the VRA by the U.S. Supreme Court in recent years and, of course, the Republicans having packed the Court's 6 to 3 majority.

But as the GOP prepares to win a majority of the House in 2022 with a minority of votes from Americans, the vagaries of both the U.S. Constitution and the Electoral Count Act (ECA) of 1887 may make it easier to steal the Presidential election in 2024 as well. Longtime Republican election attorney Ben Ginsberg --- who helped steal the 2000 election for George W. Bush but rejected Trump's attempts to steal 2020 --- is now pressing his own party to reform the ECA before it comes back to bite them in the future.

It was, in fact, confusion surrounding the incredibly poorly written ECA that Team Trump hoped to exploit to their advantage when they tried to coerce then Vice President Mike Pence to declare electoral votes in a number of swing-states to be invalid during the joint session of Congress to certify the electoral votes on January 6. He refused, but the usually pro forma Congressional certification of the Electoral College, as you know, was then interrupted by Trump's MAGA Mob insurrection, in his last desperate attempt to steal the election that he lost.

We were joined on this program, on January 4th, by election law scholar and democracy activist PAUL LEHTO who joined us to warn, at the time, of the dangers that awaited on January 6th, thanks in no small part to the confusing ECA and Team Trump's attempts to take advantage of that confusion. Lehto joins us again today to discuss Ginsberg's recommendations to reform the Act and whether such reforms --- even if they could ever be adopted by the current dysfunctionally divided Congress --- would help to avoid another attempted theft of the Electoral College by Trump...or anyone else.

"If Congress understood that all they are doing is tabulating votes --- their scope is very limited --- they wouldn't have these disagreements about whether the Vice President has a sweeping authority to do this," Lehto explains. "They would realize they're clerks. But because that's not an understanding that's out there like it ought to be, yet another major norm of democracy, you could say, is being completely violated. And that's why there are so many holes that can be manipulated in the ECA. Because people are looking for 'How can we game the system?'"

Lehto, whose warnings were prescient in November, December and January, warns today that while the ECA "ought to be amended...whenever you close a loophole, the action just moves to the loopholes that still exist. Amending the ECA all by itself isn't going to solve the problem. Because you have constitutional issues, you have issues of people being partisan when they really should be patriots and act like clerks counting ballots."

He also has a few thoughts on what would help make Presidential elections less fraught and easily exploited, which involves both transparency and some key changes to the Constitution. "I think maybe what Democrats don't fully give enough weight to is the fact that we have an ancient Constitution that did not provide a democratic means of selecting the President," he tells me. "So that feels anti-democratic and fraudulent to Democrats, but that's what the system was set up. So we need to amend the Constitution in order to have it line up with what our reasonable expectations are for living in a modern democracy."

Among the stories covered...

  • We hope to cover this more on an upcoming show, but on Monday, not long before air, the Dept. of Justice filed a federal lawsuit against Texas, hoping to block the Lone Star state's newly drawn and racially gerrymandered Congressional and state legislative districts under what is left of the Voting Rights Act. The state is adding two new Congressional districts following the 2020 Census, after gaining some 4 million new residents over the past decade. But, despite growth in the Latino and Black populations comprising 95% of the increase in voters, the state Republicans added two new majority White districts on their new maps, and removed yet another Latino-majority district.
  • Health officials over the past 24 to 48 hours, including Dr. Anthony Fauci, have been suggesting that early data on the coronavirus Omicron variant indicates that, while it appears to be much more transmissible than previous variants, it may be less lethal. Though that is the headline you may have seen from the media since the weekend, that doesn't actually tell the full story about what that could mean. We try to fill in at least some of the blanks for the moment before folks get too prematurely excited. In short, if you haven't received a booster yet, now is a great time to do so. And, if you haven't had your initial shots, 6 months ago would have been a great time to do so (but now will suffice.) AND, if you think that already having had COVID --- and, thus, now have antibodies that you believe will protect you --- now is a great time to think again about that. We explain in full on today's show.
  • Finally, we've been reporting --- somewhat anecdotally in recent weeks --- on the bizarre way that the corporate media have been misreporting on the largely robust, and at times record, growth in the economy under President Biden over the past year as the nation attempts to crawl out from under the pandemic. Millions of jobs have been created (more than during the entire Trump Presidency); unemployment has plummeted to 4.2% (falling a remarkable four tenths of a percent in November compared to October and a full two points since the beginning of the year, when experts said it would be 2025 before unemployment fell to 4.2% again); New weekly jobless claims the week before last were the lowest they have been since 1969; etc. Yet, oddly enough, Biden's approval ratings have been driven down in recent months, thanks, in no small part, to often wildly misleading media coverage that continues to lead with areas of perceived weakness in the economy. That, despite the fact that those perceived weaknesses are misleading and/or not weakness in the economy at all.

    Late last week, Washington Post's Dana Milbank wrote that he's noticed the same thing from his colleagues. He commissioned a study to find out if he was right and, as it turns out, he is. "After a honeymoon of slightly positive coverage in the first three months of the year, Biden’s press for the past four months has been as bad as --- and for a time worse than --- the coverage Trump received for the same four months of 2020."

    "Think about that," wrote Milbank. "In 2020, Trump presided over a worst-in-world pandemic response that caused hundreds of thousands of unnecessary deaths; held a superspreader event at the White House and got covid-19 himself; praised QAnon adherents; embraced violent white supremacists; waged a racist campaign against Black Lives Matter demonstrators; attempted to discredit mail-in voting; and refused to accept his defeat in a free and fair election, leading eventually to the violence of Jan. 6 and causing tens of millions to accept the 'big lie,' the worst of more than 30,000 he told in office....And yet Trump got press coverage as favorable as, or better than, Biden is getting today."

    Now, why would that be? We discuss and open up the phone lines today to listeners who call in with their own thoughts on why the so-called "liberal media" has been doing such a lousy, misleading job in covering Biden's Presidency to date...

Should Democrats draw extreme partisan gerrymanders in states they control the way Republicans are doing in states where they have control over redistricting maps? On today's BradCast we have a very animated debate on the issue, along with a discussion of the few other ways that fans of democracy may still try and save the republic from the GOP's unabashed authoritarian lurch toward minority rule. [Audio link to full show is posted below this summary.]

But, first up today, a few quick thoughts on the corporate media, yet again, wildly misreporting national economic news amid the very robust --- and, in many ways, record --- recovery, while the country attempts to come out from under its pandemic-induced recession. On Friday, new numbers from the U.S. Bureau of Labor and Statistics (BLS) declared that America's unemployment rate continue to tumble to just 4.2% --- a remarkable, nearly half point decline since just last month to virtually where it was pre-pandemic. Nonetheless, morning headlines focused instead on lower than expected new jobs created in November, which sent the stock markets tumbling once again. That, even though, over the past year, the BLS has substantially upwardly revised previously reported monthly jobs numbers every single month except for one. They've done so with numbers that are nearly double or more than the initially reported monthly BLS statistics, amounting to nearly 1 million more jobs in 2021 than initially reported.

While its unclear why initial BLS numbers are now so far off the mark. Historically, they always revise. But, this year, post-pandemic survey numbers have been wildly off for some reason. The consequences both politically and economically have been huge. The fact that the corporate media can't seem to account for that by now in their panicked reports with each new "disappointing" set of numbers --- which will almost certainly be revised up very soon --- remains disturbing. That, as media continue to misreport on inflation and downplay positive economic news such as the lowest number of new weekly jobless claims since 1969 just last week; the nearly 1 million new jobs created this year alone; and the 1.1 million jobs filled since just last month's BLS report, to name a few points that have received much less notice from the media...for some reason. If the media can't adjust for the misleading initial BLS reports themselves, perhaps Biden's Labor Dept. Secretary should help them.

THEN, as we've been documenting, Republican-controlled states around the nation continue to implement new, extremely partisan redistricting maps for U.S. House and state legislators following the 2020 census. With computer-drawn precision, these new maps will ensure GOP gains in 2022 --- and a Republican majority in the U.S. House --- even if America votes exactly as they did in 2020, when Democratic House candidates received nearly 5 million more votes than GOP candidates.

Two years ago, the GOP's stolen and packed U.S. Supreme Court declared they would not intercede in fights over partisan gerrymanders. So, how can Democrats push back against this anti-democracy putsch by Republicans hoping to secure minority rule in the House for the next decade (adding to already existing minority rule in the Senate and electoral college, as baked into the Constitution, and on the Supreme Court, thanks to Republicans gaming the system there in recent years)?

We're joined today for a lively discussion on exactly that by JOSHUA A. DOUGLAS, author and election law professor at University of Kentucky's J. David Rosenberg College of Law. Last week, he proffered at least one solution in an op-ed at Politico calling for litigation in state courts all over the country, now that SCOTUS has washed their hands of the matter, while Democratic obstructionists in the Senate (Manchin and Sinema) block the party's ability to reform the filibuster in order to ban partisan gerrymandering nationwide in the Freedom to Vote Act.

"It was thought to be that the House of Representatives would be 'the people's house', the body that would represent a majority of the people and be a check on some of these other institutions that might give outsized weight to the smaller states, the rural states --- in the pre-Civil War era, the states that were trying to protect slavery," Douglas explains today. "But now, with sophisticated computers and algorithms where we can predict with such accuracy how people are going to vote, the House has become completely out of whack, such that Democrats need to win a lot more than 50 percent plus 1 in order to gain a majority in that chamber."

With federal courts no longer an option for the time being, Douglas notes that almost all states have constitutions that, unlike the U.S. Constitution, grant citizens an affirmative, fundamental right to vote. Those provisions, declaring that elections must be "free" or "free and equal" or "free and open", can and should be exploited to challenge the parties in power currently drawing maps that deprive residents of those rights, he argues. "My argument is that state courts should robustly use these phrases to protect democracy, and to throw out maps that are so skewed that the maps don't represent a fair democracy, a fair majoritarian rule, but instead keep the party in power to stay in power, to entrench them in power, just because of the way the lines are drawn."

Douglas observes that, while more challenges are beginning to be filed along those lines in state courts in recent days, he "was a little surprised" that, at least until recently, there had been very few such challenges brought in state courts, despite legal foothold offered by many of those state constitutions. "If we're looking for a solution to a situation that is untenable for democracy, at least here's one where we've seen some success," he tells me. "Just a couple of years ago, both the Pennsylvania Supreme Court and the North Carolina Supreme Court relied on their state constitutions to strike down gerrymandering maps in those states. And other states' Supreme Courts have relied on their state constitutions for other democracy decisions, other issues involving the right to vote. So we have some precedent that is favorable to using these state constitutions robustly."

While I also support such challenges --- along with sharing Douglas' call for reforming the Senate filibuster to allow passage of federal legislation that would ban partisan gerrymanders in all 50 states --- I've also recently been forced to reluctantly change my position on partisan gerrymanders in states controlled by Democrats. I believe "blue" states should not unilaterally disarm. That, due to the threat to democracy itself now posed by the GOP gerrymandering scheme to "win" a House majority with a minority of votes in 2022 and then use that majority to steal the Presidential election in the House in 2024, as Douglas himself warns against in a separate op-ed this week at CNN.

Despite his assertion in his CNN piece that "we must treat the 2022 election as existential for the continued vitality of our democracy," noting that "American democracy barely survived 2020. The attacks on 2024 are already underway" and "Whether they succeed will depend on what we do right now," Douglas remains firmly opposed to tit-for-tat partisan gerrymandering by Democrats and explains why.

He and I have that out in a very lively debate to close out today's program...

Trump grifters turn on each other from 'Stop the Steal' world to Congress, as legal probs and death threats mount and laughter ensues...

The insanity detailed on today's BradCast is simply too insane to adequately summarize here. You may just have to tune in for this one. (Bring plenty of popcorn.) Suffice to say, the story about the self-replicating African robot frogs is probably the least bizarre or disturbing story we cover. [Audio link to full show is posted below this summary.]

Here's a quick collection of just some of the news stories from which today's program derives...or devolves, depending on how you wish to look at it...

  • Possibly insane "Stop the Steal" attorney L. Lin Wood declares "Stop the Steal" is a Deep State scam; releases phone calls with QAnon loon and confessed felon Michael Flynn (now caught on tape declaring QAnon to be a CIA scam) and with fake 2020 'audit' funder and former Overstock CEO Patrick Byrne, who believes failed "Kraken" lawsuit attorney Sidney Powell may have stolen as much as $70 million from the MAGA Mob for her phony, fraudulent 2020 lawsuits. Also, says Byrne, she's in love with him, gets drunk, and has tried to "bed" him in front of others.
  • The Dept. of Justice has also taken notice of Powell and has now, reportedly, convened a criminal grand jury to subpoena her "Defending the Republic" grift.
  • Wood and a bunch of other Trump lawyers are facing huge court sanctions for their phony 2020 fraud lawsuits are now trying to claim that Powell added their names to some of her "Kraken" lawsuits without their knowledge. (Don't believe them.)
  • Meanwhile, in Congress, things in Wingnut World are no less insane. The far-right House backbenchers are also turning on each other. Leading the charge over the cliff: CO's Lauren Boebert and GA's Marjorie Taylor Greene against fellow Republican and pro/anti-vaxxer Nancy Mace of SC as House Minority Leader Kevin McCarthy is a deer in the headlights while hoping to become House Speaker someday. Guest: Activist, author Kenny Bruno on 'DEFCON for Democracy'; Also: Fourth student dies after MI high school gun massacre...

On today's BradCast: It's a grim day in America. But it's one that every American should be paying very close attention to nonetheless. [Audio link to full show posted at the end of this summary.]

First up today, a fourth student, a 17-year old, has died following Tuesday's mass shooting by a 15-year old at Oxford High School in Michigan. The other three victims who were killed, as well as seven other students who remained in the hospital overnight after being shot, were all aged 14 to 17. The shooter used his father's new semi-automatic pistol purchased just last Friday to carry out the massacre. There were still seven more bullets in the weapon when he surrendered to authorities. But, that's "freedom" for ya in 2021 America, apparently.

On Wednesday morning, the Republicans' stolen and packed 6 to 3 U.S. Supreme Court majority met to consider removing the previously long-settled freedom for a woman to determine her own reproductive rights in all 50 states. The case heard at SCOTUS was Dobbs v. Jackson Women’s Health Organization, the last remaining abortion clinic in the state of Mississippi, where legislators have adopted a law that would ban all abortions in the state after 15 weeks of pregnancy. The measure was overturned in lower courts after being found a clear violation of the nearly 50-year old Roe v. Wade precedent set in 1973 and reaffirmed as settled law in 1992's Planned Parenthood v. Casey.

When MS filed their initial appeal at the Supreme Court they sought approval for their then-radical 15-week ban. It was only after last year's death of abortion rights champion, Justice Ruth Bader Ginsberg, and her subsequent replacement on the Court by the far-right Amy Coney Barret just eight days before the 2020 Presidential election, that the state decided to also ask the court to strike down Roe in its entirety.

Little, if anything, has changed legally since 1992 regarding the reproductive rights Constitutionally guaranteed by Roe and reaffirmed by Casey. But the make-up of the High Court itself has changed radically. Its majority has been stolen by Republicans who cancelled the filibuster in the Senate in order to pack three, hard-right Donald Trump appointees onto it. That fact, made clear by MS legislators themselves, led Justice Sonia Sotomayor to aptly ask the state's Republican Attorney General today: "Will this institution survive the stench that this creates in the public perception that the Constitution and its reading are just political acts?"

Good question. Of course, the answer is that those on the political Right don't actually care. As the twice federally indicted Steve Bannon recently noted on his War Room radio show/podcast, Republicans are only interested in "taking over" --- from school boards to the White House --- and whether or not their hardball methods result in "a Constitutional crisis," they really don't care. "We're a big and tough country and we can handle that," he preached to his followers.

To that end, Republican officials across the country are, right now, hoping to break American democracy itself, by installing loyalist Trump party apparatchik in key election administration positions, from precinct judges to county clerks to canvassing boards to Secretaries of State, as Washington Post reported in great detail on Monday. The Plot to Steal the 2024 Election is underway RIGHT NOW. Ignore these warnings at all of our peril.

We're joined today by longtime progressive activist and author KENNY BRUNO who offered a similarly chilling --- and even more direct --- warning at Truthout over the weekend, spelling out how Trump and the GOP have already "laid the groundwork for assuming the U.S. presidency regardless of the result of the 2024 election." He details today how "most of the conditions they would need to execute [their plan] is already in place."

"Often you see it covered, or you see various aspects covered, as if they were disparate things," Bruno explains, "like the treatment of Liz Cheney, the sham audit in Arizona, the repetition of the Big Lie, the new voter suppression laws in 19 states --- covered as if they are disparate things. But the simplest explanation is that they are all part of a plan," he charges, before spelling out exactly how that plan is meant to work between now and the certification of state electors on January 6, 2025.

To "undermine faith in elections" in order to steal a Presidential election, Bruno argues, "you would want radical state legislatures, especially in swing states. You would want a majority of states with a majority of loyal members of Congress. You would want to purge moderate representatives and election officials who might not go along with ending democracy, who might not play ball. You'd want a compliant Supreme Court. You'd want to intimidate the election officials who are left. I could go on...These are things that you need in place. If you look now at Trump and the GOP, most of those boxes are already checked. And they're part of a comprehensive plan."

What --- if anything --- can be done about it? Well, the options in response, as also spelled out by Bruno in his op-ed and on today's program, are not great. But knowing and understanding what is going on is a critical first step. While we have been warning and reporting on this stuff seemingly forever (for example, while the actual attempt to steal the 2020 election was underway in advance of the January 6th attack on the U.S. Capitol), it seems the warnings are not being adequately amplified by either corporate media or Democrats, as Bruno sees it.

He goes on to note that his originally suggested title for his Truthout piece was "DEFCON for Democracy," before the headline was somewhat softened by editors. "I think if you understand the threat to be that severe, then you have to take drastic action. Unless you're talking about it, and preparing people for drastic action, they're not going to understand why it's justified," cautions Bruno. "This is a real threat, it's a real plan. The evidence is that it's being carried out. And if you want to stop it, you might have to take some drastic action."

"I would love to be wrong about the whole thing, to be honest," he concedes. "I think the most important thing at the moment is to talk about it, to call it out. Because if you don't socialize people to the idea that this steal, subversion, gaming of the Electoral College is underway, they won't be ready to accept your actions to defend it."

As noted, it's a grim day and a grim show today, but one that we hope will be well worth your time to listen in full...
