The New York Times described Trump's SOTU on Tuesday as "veer[ing] between two moods --- combative and conciliatory." Democratic minority leader Chuck Schumer described it as "sort of like Dr. Jekyll and Mr. Hyde, and the excitement and the enthusiasm was all in the Mr. Hyde parts."

A majority of Americans who watched it, however, approved of the Trump's remarks, at least according to early polling weighted towards self-identified Republicans and right-leaning independents.

Our two excellent guests today, award-winning opinion journalist HEATHER DIGBY PARTON of Salon and Hullabaloo, and author and political media critic ERIC BOEHLERT formerly of ShareBlue and Media Matters, now a contributor for Daily Kos, join us to make sense of both parts (all parts?) of Trump's at-times disjointed, at-times collegial, and at-times aggressive remarks as they veered conversely between out-and-out lies to something more closely resembling facts but shamefully lacking in context.

Did Trump meet the bar set for him by his own White House aides who'd promised new calls for "unity" and "bi-partisan cooperation" in his speech? Is Trump capable or even interested in that?

"These State of the Unions are typically the least awful thing Trump does in any given week," Boehlert observes, "because it's a prepared speech, it's poorly written, he delivers it poorly. But there are moments where he does appeal to independents. And then he goes back to the crazies."

Says Parton: "If the idea was to unify the Republicans, then yes, it obviously worked. By their measure, I think they probably did what they wanted to do. ... [But] there is no President in American history who is less authentic-sounding than Donald Trump when he's calling for unity and bipartisanship. And they know it."

On today's BradCast, should Virginia's Democratic Governor Ralph Northam resign after his 1984 medical school yearbook was revealed late last week to have featured a photo of a man in blackface standing next to a man in a KKK costume? Don't answer that too quickly. Or, at least listen to today's show first. [Audio link to show follows below.]

After apologizing on Friday night for the appearance of the photo --- calling it "clearly racist and offensive", but failing to specify which of the pictured two men he actually was --- the Governor said at a bizarre Saturday press conference that he was neither man and that he had never even seen the photograph before, since he hadn't purchased that year's yearbook. He says the photograph hit him "like a ton of bricks" on Friday night. However, he told the media that he did remember an instance around the same time when he darkened his face to dress up as Michael Jackson for a dance contest. He said he remembered the contest outfit very specifically, discussing it publicly for the first time on Saturday, while insisting that he never recalls dressing up in either minstrel show blackface or as a Klansman, as depicted in the mystery photograph.

One of the two African-Americans in the same medical school class that graduated with Northam told AP the explanation is plausible, as he didn't purchase the yearbook either and found the racist photo on Northam's page to be out of character. Despite Northam's record of working closely with the African-American community and still being a member of a predominately black church in the town where he grew up, top Democrats from Virginia to D.C. and beyond continued their loud calls on Sunday for him to step down and allow his Lt. Gov. Justin Fairfax --- an African-American Democrat --- to replace him.

But should he? And should he be shunned for something that may have never happened? Or, if it did, happened 35 years ago and appears completely inconsistent with his record since then? The answers to those questions are both "absolutely yes" and "no, not so fast", as we discuss with callers today, focusing on Northam's remarks at the strange, yet seemingly earnest Saturday presser in which he stated that acquiescing to calls to step down would allow him to "spare myself from the difficult path that lies ahead," adding: "I could avoid an honest conversation about harmful actions from my past. I cannot in good conscience choose the path that would be easier for me."

We endeavor to have a least part of that "honest conversation" with tons of callers on today's program, including some discussion about key civil rights figures (from Lincoln to Justice Hugo Black to LBJ) whose own histories of racism arguably allowed them to lead on a number of landmark civil rights issues from Emancipation to Brown v. Board of Education to the Civil Rights of 1964 and Voting Rights Act of 1965.

Also today: While I was happy to see MSNBC, on Friday night, highlight a Super Bowl ad buy in Georgia markets by former Democratic gubernatorial candidate Stacey Abrams' voting rights group Fair Fight, calling for "hand-counted paper ballots," the news outlet's Rachel Maddow Show maddeningly cut the :30 commercial off when reporting the story, just before the crucial line calling for "hand-marked paper ballots"! (Made, in the spot, by Republican Commissioner of Habersham County, GA Natalie Crawford, by the way.) Maddening. Especially since, unless the voters rise up to protect overseeable elections and stop them, the state of Georgia, along with counties in key states like Ohio, Pennsylvania, and Texas --- not to mention Los Angeles County and neighboring Ventura County! --- are all now planning moves to expensive, unauditable touchscreen Ballot Marking Devices (BMDs) before the 2020 Presidential election. Those systems print out computer-marked and barcoded paper ballots which are 100% unverifiable after an election has ended.

Add MSNBC's failure there to a list of disappointments over the weekend from the mess in Virginia to the loss of the L.A. Rams at the Super Bowl...

On today's BradCast: Some encouraging news for democracy (at least in Georgia), some predictable lies from the Senate Majority leader, a gentle rebuke for Trump from both parties, and a call for intervention from the Senate Minority Leader, among other things.

Just some of the many stories covered on today's program...

• Georgia Democrat and potential U.S. Senate candidate Stacey Abrams, who will be giving the Democratic response to the State of the Union Address on Tuesday, is set to run a television ad during Sunday's Super Bowl in Atlanta with a north Georgia Republican County Commissioner calling for HAND-MARKED paper ballots in the state!
  
  The ad is sponsored by Abrams' non-partisan voting rights organization Fair Fight, formed after Abrams is said to have very narrowly lost her contest to become the nation's first African-American female governor last November to Republican Secretary of State and champion vote suppressor Brian Kemp. Both he and his GOP successor are now calling for the state's 100% unverifiable touchscreen voting systems to be replaced with new, very expensive and also 100% unverifiable touchscreen systems that produce computer-marked, human-unreadable barcoded ballot summary cards, rather than hand-marked paper ballots which computer science and voting systems experts all agree [PDF] to be the most secure, auditable and overseeable way to carry out elections;

• In the U.S. Senate, Republican Majority Leader Mitch McConnell offered a huge lie about the Democrats' "For the People Act" (HR-1), recently introduced in the U.S. House to call for a series of major election reforms. Among the many provisions in the measure --- such as universal automatic voter registration, expanded early voting, ending partisan gerrymandering and yes, ensuring a HAND-MARKED paper ballot for every voter --- it also seeks to declare Election Day as a federal holiday. Naturally, McConnell lied about what the bill calls for on that point, and absurdly describes the measure as a "Democrat power-grab". We respond;

• Also in the U.S. Senate, Democratic Minority Leader Chuck Schumer sent a letter to Trump's Director of National Intelligence Dan Coats calling for him and the other Administration Intelligence Chiefs to "stage an intervention" with the Commander-in-Chief, after Donald Trump described his own top intel officials on Wednesday as "wrong", "naive" and needing to "go back to school!" on a host of foreign policy issues. Trump's remarks came in response to the Intelligence Community's new annual "Worldwide Threat Assessment" PDF. The report, and Senate testimony from the chiefs about it on Tuesday, argues that Trump is essentially wrong on everything from North Korea, to Iran, to ISIS to Syria and Afghanistan, and on his claims about an imagined "national emergency" at the U.S. -Mexico board.

• But if Schumer really wants to "stage an intervention" with this President, his Democrats in the Senate and House could be calling for an immediate Impeachment inquiry. As detailed by Ernest Canning at BradBlog.com this week, the Nixon impeachment process reveals that it is both unnecessary and, arguably, unwise for Dems to wait for a report from the Special Counsel investigation before exercising their Constitutional duty;

• Also today, Republicans and about half of Senate Democrats passed an amendment that (gently) rebukes the President by calling for U.S. troops to remain in both Syria and Afghanistan, in contrast to Trump's recent military directives;

• An upside to the recent federal government shutdown? A beach in Northern California that had been closed will remain closed, because elephant seals have taken it over;

• And, finally, Desi Doyen joins us for the latest Green News Report, with updates on the record bone-chilling --- and deadly --- Polar Vortex cold snap in the Midwest and Northeast, evidence that Trump's intervention in Venezuela is, of course, all about oil, and some good news out of Germany which is now on its way to quitting coal entirely...

No, we're still not done with the 2018 elections on The BradCast, even as we begin to turn towards the hell that awaits in 2020...because someone's got to. We've got several follow-up stories today, and some new ones. All of them maddening for those of us who believe in fair and overseeable public elections. [Audio link to today's show is posted below.]

First today, an update to a story we covered in detail yesterday. Florida's new Republican Governor Ron DeSantis recently suspended the elected Palm Beach County Supervisor of Elections, Susan Bucher, falsely charging the 10-year elections official --- one of the most knowledgeable and respected in the nation --- with "incompetence". Her suspension followed on another by Rick Scott, the previous Republican Governor, of the Supervisor of Elections in Broward County. In both cases, the officials in two of the most Democratic counties in the closely-divided swing-state have now been replaced with Republicans in advance of 2020. These are extraordinary partisan power grabs.

While Bucher had vowed last week to fight her suspension, about an hour after we got off air yesterday she decided to resign rather than challenge her case to the partisan GOP-controlled Florida state Senate, her only option under state law. Here's the full statement [PDF] on her decision to resign that Bucher sent me earlier today.

An outrageous decision by Republicans in Iowa's state legislature on Monday illustrates a similar concern in the Hawkeye State. There, Republicans in the state House of Representatives won a party-line vote to reject 29 absentee ballots cast in an Iowa state House race last November that was reportedly won by the Republican candidate by just 9 votes out of more than 14,000 cast. The unopened ballots in question were missing a postmark --- the Postal Service acknowledges they don't always postmark absentee ballots --- but had barcodes on the envelopes confirming that the ballots were sent and received by the Post Office in time to be included in the tally. Nonetheless, GOP state lawmakers refused to open the ballots and include them in the count, denying the voters their right to vote and ensuring the 9 vote "victory" by the incumbent Republican Rep. Michael Bergan, The Democratic candidate who filed the election challenge, Kayla Koether, says she's considering a lawsuit with some of the voters in response.

Speaking of rejected challenges, we're joined once again today by MARILYN MARKS of the Coalition for Good Governance for several maddening updates to at least two election cases that her organization has filed in Georgia. One, which we initially covered with her when it was filed last year, is an election contest to the results of November's Lt. Governor's race. That contest featured an inexplicably huge undervote rate, but only in that race (not in any other races much farther down the ballot) and only on the state's 100% unverifiable touchscreen voting systems (the undervote rate was as expected, in line with other contests, on hand-marked paper ballots sent via mail or at the polls during early voting in the some race.)

That contest, however, was recently dismissed in an remarkable ruling by Cobb County Judge Adele Grubbs. She found the plaintiffs offered no evidence that votes were cast illegally or that legal votes were rejected, after refusing to allow discovery that would have permitted an expert forensic investigation of the state's unverifiable, easily-hacked, oft-failed touchscreen voting systems. Marks' organization is now appealing Grubbs' ruling to the state Supreme Court and is hopeful the higher court will allow the discovery investigation that was denied, but that voting systems experts say is warranted.

Marks says the Secretary of State's office refused access the systems and the judge "forced us to go trial without the first shred of discovery, which is our legal right to have. She also denied our right to a jury trial. So the state and the court has nailed the doors shut to make sure that we don't get to find out what is behind this clear machine misprogramming, defect, malfunction, whatever it is."

At the same time, Marks has also been leading the charge in an uphill battle against former GOP Sec. of State, now Governor Brian Kemp and his Republican successor Brad Raffensberger to replace the state's unverifiable touchscreen voting systems with hand-marked paper ballots. Computer scientists and voting systems experts strongly recommend such systems [PDF], along with voters in the Peach State who have spoken out loudly and clearly in favor of hand-marked paper ballots.

And yet, the private voting system vendor lobbyists, elections officials and elected state Republicans continue to call for newly designed and expensive unverifiable touchscreen systems which produce a barcoded ballot summary card instead of a verifiable record of voter intent. It's impossible to carry out legitimate post-election audits of computer-marked ballot summaries. Nonetheless, jurisdictions around the nation --- counties in Pennsylvania, Ohio, Texas and even Los Angeles County, not to mention the the entire state of Georgia --- may soon be voting on such unauditable, unverifiable systems in the 2020 Presidential election, unless they can be stopped.

"There is just no reason that such machines should be legal in this country, given what we know now about the dangers of electronic voting," Marks tells me, while noting that computer Ballot Marking Devices (BMDs) cost about three times as much as hand-marked paper ballots systems. "There's too much money involved, and therefore a lot of people are not looking at what's best for the state. I'll just say it that way. Too many people have probably received too many favors."

"Unfortunately, for some of the decision-makers, having an unauditable system is a feature, not a bug," she opines, while remaining hopeful that "people are catching on" that a barcoded ballot system is not the same as a verifiable hand-marked paper ballot system, despite how elections officials are misleading voters around the country.

On today's BradCast, it's another one of those impossible Mondays catching up with a weekend full of news in the Trump Era, and the seemingly impossible fight on behalf of voters who seek actually verifiable election results (which require HAND-MARKED paper ballots, according to a new letter from two dozen computer science, security and voting system experts.) [Audio link to show posted at end of article.]

Before we get to our guest today on that crucial issue which threatens elections oversight from Georgia to Los Angeles, a bunch of news and quick headlines from across the country. Among those headlines...

Winter weather crippled much of nation over the weekend and into the beginning of this week, from heavy rains and flash floods in recently fire-ravaged California, to monster snowfall in the Midwest, to icy conditions in the East. The latter succeeded in shutting down even parts of the federal government in D.C. that weren't already closed due to Donald Trump's continuing partial federal government shutdown --- now the longest in U.S. history --- to demand $5.7 billion for his promised, pointless and ill-considered southern border wall.

Decidedly not shutdown in D.C. this week are disturbing new revelations, as reported by New York Times late Friday, that the FBI had opened a counterintelligence probe of the President of the United States in 2017, to determine whether Trump was either a witting or unwitting agent of Russia. That, as Trump's Attorney General nominee William Barr, on Monday, released his prepared opening remarks in advance of his confirmation hearings this week in the U.S. Senate Judiciary Committee. Despite his previous criticism of Special Counsel Robert Mueller's probe and his argument that Presidents cannot be investigated for certain things, Barr now says the Special Counsel investigation should be allowed to finish and its report should be made public.

In California, the state's largest private utility company, Pacific Gas and Electric (PG&E), announced their intention to seek bankruptcy protection in light of tens of billions of dollars in potential legal liability for maintenance failures that helped spark a number of the historic and deadly fires that crippled the state during last year's record wildfire season. And, in Los Angeles, some 35,000 teachers at the nation's second-largest school district walked out, striking to demand higher pay and smaller class sizes.

Next, we turn to some election news, with New York state, one of the most restrictive in the nation when it comes to voting access, finally moving to update its system with a package of bills this week that include early voting, vote-by-mail, same-day voter registration and other long-overdue reforms.

In Georgia, meanwhile, two dozen of the nation's top Computer Security and Voting Systems experts issued a critical landmark letter [PDF] last week to the state's Secure, Accessible and Fair Elections (SAFE) Commission, essentially begging the panel, convened by former Republican Sec. of State and incoming Governor Brian Kemp, to not move the state's voting system from 100 percent unverifiable touchscreen Direct Record Electronic (DRE) systems to similarly unverifiable touchscreen Ballot Marking Devices (BMD), which print out a computer-marked and barcoded summary of voters' ballots. They call instead for hand-marked paper ballots, which they describe as "the best method for recording votes in public elections."

The letter notes that BMD systems are more expensive than hand-marked paper ballot systems but, more importantly, cannot be audited after an election to determine whether the results reflect the actual intent of voters. Despite the scientists crucial recommendation last week, and every comment --- other than from election officials and private voting system vendor lobbyists --- made by the public at last week's SAFE Commission hearing, Kemp's panel shamefully voted to recommend BMDs to state lawmakers.

But, while that virtually inexplicable action moves ahead in the Peach State under Republican rule, the nation's largest voting jurisdiction, Los Angeles County, under Democratic rule, has already decided to move to a pricey and similarly unverifiable touchscreen BMD system before the 2020 Presidential election!

We're joined today by MARILYN MARKS, a national leader in the fight for HAND-MARKED paper ballot systems. She heads up the non-partisan Coalition for Good Governance --- which filed several landmark lawsuits last year against Georgia's current unverifiable voting systems and in hopes of preventing their new ones.

"The point is a very, very simple point that the SAFE Commission --- and apparently L.A. --- pretends that they are missing," argues Marks. "They all talk about how they want elections that can be audited. Well, when you use these Ballot Marking Devices, the election cannot be audited, because the source document [the computer-marked, barcoded ballot] is not an original transaction. It cannot be audited. Therefore you cannot audit the results."

Making matters worse, even if every single voter manages to correctly verify the computer-printed, human-readable summary of voter selections, "what's actually cast and the actual official vote is a barcode. Now, none of us can read barcodes. I don't know what vote I'm actually casting. I am casting a barcode, but what in the world does that barcode actually say? That, to me, is a Constitutional violation."

We discuss that and the many other dangers of BMD systems being implement across the country --- with little or no pushback in places like L.A. --- as well as the differences between the proposed new systems from private vendors in GA and the publicly-owned one already coming to L.A. County. In short, despite a number of explanations offered to us by the County's Registrar-Recorder/County Clerk Dean Logan (shared on today's program) Marks argues there is little, if any, difference in the lack of verifiability and auditablity of such voting systems.

It's been a very busy news weekend (as usual these days), so we try to catch up with at least some of it, along with calls from listeners on today's BradCast. But, more importantly, we're already busy trying to save the next election from disaster, thanks to a move by folks on the right and left to make election results virtually impossible to be overseen and verified. [Audio link to today's show is posted below.]

States and counties all across the country are finally beginning to move to new "upgraded" voting systems. In many cases, however --- in both Republican and Democratic-leaning jurisdictions alike --- officials are now disastrously preparing to move to touchscreen computer Ballot Marking Devices (BMDs) which are even less verifiable, in many cases, than systems currently in use!

In Georgia, a commission impaneled by Republican Brian Kemp, champion vote suppressor as former Sec. of State and now Governor-elect, is deciding whether to move from the state's 100% unverifiable Diebold touchscreen Direct Recording Electronic (DRE) voting machines to similarly 100% unverifiable touchscreen BMDs made by ES&S before the next election. Here in Los Angeles County, the nation's largest voting jurisdiction, the Registrar-Recorder/County Clerk has already announced plans to move to such an unverifiable system before the 2020 Presidential election, while (incorrectly) claiming that it produces a "verifiable paper ballot". BMD systems do not.

Proponents argue that touchscreen BMDs, which print out a computer-marked and barcoded "paper ballot" summary card of the voters vote, produce a "verifiable" record of the cast ballot. But, as Professor RICHARD DEMILLO of Georgia Tech and Verified Voting explains today, based on his recently published study, many voters (about half) do not bother to verify their computer-printed ballot summary cards before casting them to be tallied by a separate computer scanner. Of those who do, the study finds, they only glance at them for an average of 3.9 seconds before depositing them into the scanner (and that was during an election with some 18 races on the ballot!)

"Half of them don't look at the ballots at all," DeMillo tells me. "Those that do, give it by and large a cursory reading that wouldn't allow them to check it in any meaningful way."

Moreover, DeMillo's study finds, based on observation and testing at polling places earlier this year, most voters are unable to accurately verify --- just seconds after leaving the polling place --- whether an unvoted list of the races they just voted in accurately represents the races on the ballot they just cast! DeMillo --- a longtime computer security expert who formerly served as Hewlett-Packard's chief technology officer --- argues, the only way to ensure that ballots actually reflect the will of the voter is to use HAND-MARKED paper ballots, whether they are counted by hand or optical-scan systems.

"These are all problems we've created for ourselves" with some help from the private voting system vendors, he argues. "The only reason we're having this discussion is that someone decided that having an expensive pen to mark a ballot is more important than the transparency of the election process itself. As soon as you get rid of the Ballot Marking Devices, the universe goes back to normal, mathematics works out, we can conduct auditable elections in a much more verifiable way."

When I ask this longtime computer technologist and cryptography expert the best, most verifiable way to cast ballots, he answes directly: "Hand-marked paper ballots." His answer echoes that of longtime Livermore National Lab computer scientist and voting systems expert Dr. David Jefferson, who argued the same point during my interview with him in October.

Also today: What the federal court's questionable ruling in Texas on Friday finding the Affordable Care Act (Obamacare) unconstitutional, does (and doesn't) mean for all of us in 2019. The federal HealthCare.gov exchange's open enrollment period for 2019 ended over the weekend, but several states which run their own Obamacare markets, such as CA, CT, D.C., NY, MA, MN and RI, continue open enrollment through January.

Given many of the stories covered on today's BradCast, it's beginning to feel more and more each day like the GOP is a party in its death throes. Of course, rumors of that death have been greatly exaggerated in the past. [Audio link to show follows below]

Among the many stories covered on today's program...

• The stock market was closed today in observance of a national day of mourning declared for President George H.W. Bush, whose funeral ceremony was held on Wednesday at the National Cathedral in D.C. The market closures may prove to have been a good thing, given that the Dow plummeted some 800 points on Tuesday after it became clear that Donald Trump and his Administration had lied over the weekend regarding a deal with China to avoid more tariffs on Chinese imports. During a Twitter rant that helped send the markets plunging, Trump appeared to reveal once again that he has no idea what tariffs actually are. He seems to believe they involve foreign countries paying money to the U.S., rather than an actual tax on American consumers. Is it conceivable that he really does not understand this by now? Or is he just continuing to play his supporters for chumps? We discuss;

• In Georgia's runoff election for Secretary of State on Tuesday, Republican Brad Raffensperger has declared himself the winner over Democrat John Barrow, in a race that will have serious repercussions for the 2020 Presidential election in the trending-"blue" southern state, where voter suppression and 100% unverifiable touchscreen voting systems created havoc in the 2018 Gubernatorial race said to have been won by GOP Sec. of State Brian Kemp. Raffensperger has called for new 100% touchscreen systems that create unverifiable computer-marked/barcoded ballot summary cards. Barrow, who is waiting for late absentee ballots to actually be tallied, has called for the only system of voting that is actually verifiable by the public after an election: hand-marked paper ballots.

  At the same time, the state's largest newspaper, the Atlanta Journal Constitution, has finally noticed the wildly anomalous undervote rate from the November 6th general election in the Lt. Governor's race, as only seen in the unverifiable touchscreen results, not on the vote-by-mail paper absentee ballots. Last week, we discussed these concerns with plaintiff Marilyn Marks of the non-partisan Coalition for Good Governance. Two weeks ago, Marks filed an election lawsuit contesting the results of the Lt. Governor's race. She and other plaintiffs are seeking a first-of-its-kind post-election forensic audit of the state's voting systems in light of the seemingly inexplicable undervote numbers;

• But there was some good news from Tuesday's runoffs as well. In Little Rock, Arkansas, where, six decades after angry white mobs protested the integration of nine black students at the Little Rock Central High School in 1957, the town will now have its very first elected African-American mayor!;

• In North Carolina, new details continue to emerge from the intensifying GOP absentee ballot election fraud scandal which has prevented the certification of Republican Mark Harris' purported 905-vote "win" over Democrat Dan McCready in the 9th District U.S. House race. A second woman has now come forward to allege that she was paid to unlawfully collect absentee ballots by McCrae Dowless, a former felon contracted by Harris in Bladen Country and, as discussed today, by the Bladen County Sheriff Jim McVicker. The GOP Sheriff has deleted his campaign webpage on Facebook and refuses to comment after he was found to have paid thousands of dollars to Dowless along with Harris.

  A top Democrat in the U.S. House has now suggested that "Republican operatives stole" the House seat and cites the silence from the Trump Administration about it. "LOCK THEM UP," quipped new House Democratic Caucus chair Hakeem Jeffries (D-NY) on Tuesday. Rep. Seth Moulton (D-MA) has now called for a new election and, on Wednesday, he was joined in that call by the editorial board of The Charlotte Observer, the state's largest newspaper.

  (For my part, I'm just happy that at least some in the media reporting on this have finally noticed they were previously misreporting on it as a "voter fraud", rather than election fraud, scandal, even though voters are accused of having done nothing wrong here. In fact, they are the ones who appear to have been defrauded in this matter by GOP insiders! Happily, the Washington Post removed three references to "voter fraud" in one of their stories after my complaints last week.)

  All of that, even as Republicans in the state's legislature continue to jam through a polling place Photo ID voting restriction during the lame duck period before they lose their supermajority in the upcoming new session, along with their ability to override a veto from the state's Democratic Governor. The Photo ID measure, which they've been trying to adopt for years, claiming it necessary to prevent "voter fraud", did not, until today, apply to absentee voting --- where actual fraud clearly exists;

• Finally today, speaking of lame ducks, the GOP-gerrymandered and controlled state legislature in Wisconsin worked, literally, all night to jam through a bill aimed at stealing power from incoming Democratic Governor Tony Evers, incoming Democratic Attorney General Josh Kaul and from the state's voters who elected Democrats for every statewide office in November. Adopted by party line votes in both chambers as the sun rose today after another all-night session, Republicans hope GOP Gov. Scott Walker will sign the measure before leaving office after the first of the year. Walker, who was rejected by voters last month, has said he planned to do so.

  As we discussed on yesterday's program, the outrageous GOP power grab in WI mirrors a similar coup by the NC legislature in 2016 after a Democrat was elected as Governor in that state. Republican lawmakers in Michigan are also considering similarly desperate measures before Democrats take over as Governor and Sec. of State in that state next month. All in all, the desperate power grabs by GOPers around the country do not suggest a healthy party but, rather, one that may well be revealing its political death throes.

On today's BradCast: The GOP's utter contempt for democracy and voters is now on full display in several states where things did not go well for the party during the November midterms, and nowhere more so than Wisconsin. [Audio link to show follows below.]

In states where Democratic candidates did well in last month's midterms, leading to a loss of control by Republican lawmakers, there is now a desperate and brazen scramble in lame duck legislative sessions to pass laws in hopes of robbing power from incoming Democrats before they can be seated. In Michigan, for example, where Dems won statewide races for Governor and Secretary of State and voters overwhelmingly adopted ballot initiatives to expand voting rights, GOPers are jamming through last-minute legislation to prevent the Election Day registration that voters had adopted.

In North Carolina, the Republican-controlled state legislature is ramming through a Photo ID restriction law before they lose their Super-Majority to override Democratic Governor Roy Cooper's vetoes. That action is particularly hypocritical as the state is in the midst of a massive absentee ballot election fraud scandal, apparently perpetrated by a GOP contractor and former felon hired by Republican Mark Harris in his race against Democrat Dan McCready for the U.S. House seat in the state's 9th district. Republicans claim that Photo ID voting restrictions at the polling place are necessary to prevent fraud --- of which there is little or none by voters --- even while calling for Harris to be certified by the state despite clear evidence of serious absentee ballot fraud on behalf of the Republican candidate. We've got more new details on that ongoing probe today, which has prevented Harris' reported win --- by just 905 votes out of more than 280,000 tallied --- from being certified by the state Board of Elections.

But it is Wisconsin today where the GOP is attempting perhaps the most audacious power grab in the nation this year. As Republican Gov. Scott Walker was voted out in November in favor of Democrat Tony Evers, the GOP is attempting to usurp the powers of the incoming Governor, along with Democratic Attorney General-elect Josh Kaul, on a litany of issues before they can be sworn in. The new provisions, never mentioned by Republicans during the campaign, were introduced suddenly in a massive 144-page bill unveiled late last Friday night in a special legislative lame duck session called before Walker is finally out.

Despite Democrats having won every statewide contest on the ballot in Wisconsin's 2018 midterms, Republicans were able to retain control of the wildly gerrymandered State Assembly. They received just 45 percent of the vote overall, but will nonetheless control 63 of 99 seats in the Assembly. This week, they are using that ill-gotten legislative muscle to swipe the incoming Governor and AG's powers. They hope to block the Democrats' campaign promises to expand healthcare and ease suppressive voting restrictions (which arguably resulted in enough voter disenfranchisement to narrowly give the state to Donald Trump in 2016). Republicans are also attempting to restrict early voting in 2020 in hopes of avoiding losses similar to those suffered by GOPers in 2018. The unprecedented Republican power grab has led to protests at the state capital in Madison this week of the type not seen since shortly after Walker took power in 2011 and immediately worked with the Republican legislature to strip collective bargaining rights from public union members.

We're joined today by OneWisconsinNow's ANALIESE EICHER --- a plaintiff in the 2016 federal case which struck down the WI GOP's previous attempt to curtail early voting --- to detail the outrageous and unprecedented #WIGOPPowerGrab being strong-armed through the state legislature tonight.

"What we're seeing here is the obliteration of the separation of powers," Eicher tells me. "We know that when Republicans don't like the results, they seek to change the rules and to change how things operate. With Democrats sweeping six statewide elections here in Wisconsin, the only option for the Republicans to maintain what they thought was their really, really great unilateral control of the State of Wisconsin is to make changes."

"We're seeing everything from limiting local governments' abilities to do work on their roads, limiting their abilities to pay a prevailing wage, changing the makeup and composition of boards and commissions in Wisconsin, so that the legislature has equal or more power than the Governor in regards to appointments. We're seeing change's to people's abilities to get healthcare and receive benefits," she says.

"We're seeing changes to the Attorney General's office, as to whether the Attorney General can leave a lawsuit or join a lawsuit," she explains, referring to Kaul's vow to remove WI from the federal lawsuit by several GOP-controlled states challenging the Constitutionality of ObamaCare and its protections for people with pre-existing conditions. "This extraordinary session bill severely limits his ability to essentially do what he campaigned on, and what people voted for him to do."

As one Democrat noted during hearings today in Madison, the action being taken by the legislature "will invalidate the results of the will of the people and shows direct contempt for the voters". But, of course, that is the whole idea, since Republicans now clearly hate democracy. Eicher argues Republicans "want to stay in power, no matter what the cost" and suggests "voters are not responding well to what's happening in this extraordinary session." She believes they will pay a price for this in 2020.

On today's BradCast: The complicated death of a U.S. President during the Trump-era and fresh updates on several midterm election count controversies, fiascos and fraud investigations. [Audio link to show follows below.]

First up: George H.W. Bush, the 41st President of the United States died on Friday. Remarkably enough, there was a question as to whether Donald Trump, the 45th President of the United States would attend his memorial service, given his obnoxious attacks on the Bush family in recent years, as recently as this past summer. Reportedly, Trump will attend, even after making Bush Sr. the butt of campaign rally jokes just months ago. We review parts of Bush Sr.'s legacy today --- without either dancing on his grave or lionizing --- particularly on the environment, while leaving the more unsavory parts of that legacy to callers who ring in with their own thoughts on "41".

Also today, updates on several recent stories we've been closely following of late, including a state House District contest in Alaska that was tied after the initial tally and then "recounted" on Friday, with control of the entire state legislature hanging in the balance. The state's "recount" of hand-marked paper ballots was carried out by hand late last week, and also ended in a tie, until one previously untallied ballot was added after finding that it had been wrongly excluded from the count. That one vote was enough to hand the election to Republicans and, with it, the full reigns of state government to the GOP which now controls the state House, Senate and Governor's mansion. We explain.

In another follow-up from Friday's show, a lawsuit filed by the Democratic Party in Georgia was settled late last week to allow more time for absentee ballots to be received in Tuesday's crucial midterm runoff elections was resolved in favor of voters. With the state's next Secretary of State on the line in the runoff, scores of counties had waited until just one week before Election Day to mail out absentee ballots, requiring that they be returned by Election Day on December 4th. An agreement with the state now allows such ballots to be tallied, as Democrats had sought, so long as they are post-marked by Election Day and arrive up to three days afterward.

Finally today, still more new details on the growing GOP election fraud scandal in North Carolina, which has kept a reported 905-vote Republican U.S. House "win" from being certified by the State Board of Elections. New details have emerged on the rather stunning criminal record of GOP contractor McCrae Dowless [pictured above right], who was hired to run an absentee ballot campaign in NC's 9th Congressional District in Bladen County on behalf of GOP candidate Mark Harris. Analyses of absentee ballots both returned and, mysteriously, not returned, reveal inexplicable irregularities in both the 2018 GOP primary and the general election. In both cases there are now more and more indications of a massive absentee ballot fraud scheme that may have affected the final results.

The controversy and likely criminal investigations come after evidence from the 2016 election suggested Dowless ran a similar absentee scam in that election as well. Dowless, according to police records, spent time in jail from an outrageous life insurance fraud scheme in the 1990s. So, naturally, he was hired by the GOP to work on their elections in 2016 and 2018. We discuss some of those stunning new details in a state where Republicans, ironically enough, have been claiming for years that new restrictions are needed at the polling place in order to deter fraud by Democrats!...

Every. Single. Vote. Matters. Or, at least it's supposed to. On today's BradCast we've got a bevy of stories, almost a month after the midterm elections, to prove it. Also, a rightwing broadcast media behemoth --- the nation's largest single owner of local television stations --- faces new blowback for offensive, anti-immigrant commentary they forced their local news outlets to carry. [Audio link to today's jam-packed show is posted below.]

First today, in Kentucky, where nearly half a dozen state House races were determined by half a dozen votes or less, a Republican incumbent has now filed a contest in House District 13 after reportedly losing to his Democratic challenger by just one single vote. No matter how that challenge ends, and it may take a while, Republicans will still hold super-majority control in the Bluegrass State.

But, in Alaska --- which, incidentally, was struck by a major earthquake today --- one single still-uncounted "mystery ballot" in one single state House race may determine control of the entire body for the next two years. We explain.

Meanwhile, in Georgia (the nation's apparent new headquarters for mass voter suppression) the midterms aren't over yet either, with two statewide runoffs set for Tuesday in the Secretary of State and Public Service Commissioners race. But, on Thursday, the state Democratic Party sued the state to allow absentee mail ballots postmarked by Election Day to be counted. Their complaint charges that many counties in the state failed to timely send out requested vote-by-mail ballots until just one week before next week's December 4th runoff. That, they say, will not allow enough time for many voters to receive their ballots and mail them back to the county by Election Day, when state law says they are due.

Dems note that overseas and military votes are tallied, as long as they are postmarked by Election Day and arrive no later than three days after the election. They want the same rules applied to all absentee by mail voters, thanks to the Secretary of State and Counties' delay in sending out tens of thousands of ballots. The GA Sec. of State's office, incredibly, blames the delays on Democrats for trying to ensure all votes were tallied from the November 6th general election! [Post-air update!: GA agrees to count ballots that arrive by December 7th, if post-marked by Election Day!]

In North Carolina, the U.S. House election mystery in the 9th Congressional District has now fairly clearly become a GOP election fraud case. We've got new details today, based on affidavits from voters in Bladen County who describe an unlawful scheme, apparently by a GOP contractor for the Republican candidate, to collect absentee ballots and either alter them before delivery to the County or not deliver them at all. This follows on the surprise State Board of Election decision on Tuesday to not certify the NC-9 race, as previously expected, between Republican Mark Harris and Democrat Dan McCready. Until the new revelations of apparent election fraud, Harris had reportedly won the race by just 905 votes out of more than 280,000 cast. However, as recent analyses have revealed, Harris apparently received a virtually impossible number of absentee by mail votes in Bladen County. On Friday, the NC State Board of Elections decided to delay action until after a a hearing to review evidence in the matter on 6 December 21. They have the authority to, among other things, order a completely new election in the Congressional District.

Finally today, in a widely-reported skirmish at the U.S. southern border with Mexico near San Diego last weekend, U.S. officials fired tear gas into Mexico, sending many women and children migrants from Central American running for the lives. 42 arrests were made by U.S. Customs and Border officials, but AP reports this week that none of the migrants detained will actually be charged with any crimes!

Nonetheless, in the wake of the U.S. use of tear gas on asylum seekers, former Trump staffer Boris Epshteyn, who is now Sinclair Broadcast Group's Chief Political Analyst, offered a commentary in response which local news outlets at hundreds of Sinclair-owned television stations around the country were told to run. Epshteyn's offensive "must-run" commentary charges that migrants were "attempting to storm" the U.S. border in an "attempted invasion of our country. Period." The commentary, as usual, echoed the politics and rhetoric of Epshteyn's far-right nationalist fear-mongering former boss who had sent thousands of U.S. military troops to the border in the days before the midterm elections to, purportedly, help propel the so-called "invasion" by men, women and children fleeing violence and poverty in Central America by foot.

We're joined today by PAM VOGEL of Media Matters who has been documenting Sinclair's abuse of our public airwaves at otherwise-trusted local media outlets, which are now required to carry Epshteyn's "must-run" commentaries as often as five times a week. While Sinclair initially distanced themselves from their own Chief Political Analyst in a "tepid response" after public outrage emerged following Epshteyn's offensive "invasion" commentary, the company has since come out in his support, turning their efforts to false attacks on Media Matters instead. Vogel details the shameful story and how Sinclair could --- and indeed may --- face license renewal problems from the FCC for their abuse of our public airwaves with biased, false and far-right propaganda on their nearly two-hundred television stations across the nation.

On today's BradCast: Another U.S. House race flips (unexpectedly) from "red" to "blue" as California continues to bother to count ballots, and two lawsuits are filed in Georgia following the November 6th midterm elections, including one that seeks to overturn a major statewide race due to a seemingly inexplicable failure of the state's touchscreen voting machines. [Audio link to full posted at bottom of article.]

First up: Shortly after we got off air on Monday, AP and a host of other news outlets began retracting their previous calls for the incumbent Republican Rep. David Valadao in California's 21st Congressional District election after Democrat T.J. Cox took the lead for the first time since vote-counting began on the night of the November 6th midterms. Cox is now reportedly up by just 436 votes over Valadao with more than 110,000 tallied so far, in a district easily won by the Republican with a wide margin in 2016. If Cox' lead holds, as appears likely, the Democratic midterm "blue wave" is now on track to pick up a full 40 seats in the U.S. House this January.

In the meantime, Stacey Abrams, the Democratic gubernatorial candidate in Georgia gave up her hopes of defeating Republican Secretary of State and champion vote suppressor Brian Kemp over a week ago. But today, her new organization, Fair Fight Georgia, filed a federal lawsuit against the state over suppressive tactics and for paper ballots for all voters in future elections. She was then hectored by CNN's Jake Tapper about whether she believed Kemp's victory as Governor-elect was "legitimate". (It wasn't, as she suggests in her answers.)

While Abrams' complaint does not seek to overturn the Governor's race in Georgia, a separate lawsuit was filed on Friday -- the last day possible for a 2018 election contest in the state --- by the Coalition for Good Governance seeking to toss out the results of the Lieutenant Governor's contest. The central basis for the suit is the virtually inexplicable residual vote count (ballots where no vote was recorded) in the race. The anomaly occurs only in the Lt. Governor race, and only on votes cast via the state's 100% unverifiable touch-screen voting systems. Residual vote counts are as expected from hand-marked paper absentee and provisional ballots in the same race.

We're joined by plaintiff MARILYN MARKS, the Coalition's Executive Director, who explains how the undervote rate for Lieutenant Governor is far higher --- almost twice the rate --- than in contests that were much lower on the ballot, such as for Agriculture or Insurance Commissioner. The residual vote rate was also much higher than it was in the Lt. Governor's race during the 2014 election, when it was roughly along the lines of all the other races on the ballot that year.

"There was no meaningful drop-off at all if we just look at paper ballots. If you look at the mail-in ballots and provisional ballots, there was virtually no drop-off," Marks says. "So what this tells us is that the undervote is related only to the machine. Now please explain that!"

Marks, who says her group has obtained affidavits from voters who charge that a problem with the touchscreens prevented them from voting in the Lt. Governor's race, describes the potential explanations for this anomaly and suggests the suit may lead to an unprecedented forensic examination of Georgia's easily-hacked, oft-failed, unverifiable, Diebold touchscreen voting machines. Moreover, she notes, thanks to an earlier suit filed in federal court before the election, seeking to replace the state's touchscreens with hand-marked paper ballot systems --- the judge found the Diebold touchscreens unverifiable and dangerously insecure, but allowed their use for one more election anyway --- will be very helpful in illuminating the concerns outlined by the new complaint.

"There were innumerable reports of voters who didn't have this race show up on their electronic ballot," she tells me. "Some people in fact did find it on their review screen. For many voters, apparently, that's the first time they saw the Lt. Gov. race. In many cases, apparently, when they got to the review screen, staring at it, trying to get ready to make a correction --- without even touching the screen --- it automatically cast the vote and the message came up 'Thank you for voting, your vote was cast.'"

The state recently certified Republican Geoff Duncan as the winner over Democrat Sarah Riggs Amico by nearly 3.5 points in the race for Lt. Governor. In Georgia, the state's second highest executive official also serves as President of the state Senate, determining which initiatives are to be taken up for debate and possible passage by state lawmakers. Marks, a Republican who runs the non-partisan organization, also details her concerns that evidence of programming failure or manipulation from November 6th may have been destroyed, in apparent violation of Georgia's own election rules, when the machines were recently reprogrammed for the state's December 4th runoff elections for Secretary of State and Public Service Commissioner.

"They are absolutely violating their own law," says Marks. "Not only did we need those machines preserved for our court case --- the [separate] election security case that's in federal court --- but also we certainly need them in this new case that challenges the election results for the Lt. Governor's race. [We] said to the Sec. of State: 'Your rule, your own election code, says they cannot touch these machines, the internal memory, for one month if there is no election contest pending. Now there is an election contest pending. Obviously they are needed as evidence and the Secretary is continuing to take the position that over-writing the data, uploading new ballot programming for the Dec. 4th runoff, and putting these machines in unsecured voting places somehow does not make the internal memory data at risk."

On the topic of the GA SoS runoff next week, Marks also notes that the Democratic candidate John Barrow is strongly in favor of hand-marked paper ballots, where the Republican, Brad Raffensperger, is calling for unverifiable computer-marked/barcoded ballots instead.

All of these matters, including Abrams own lawsuit filed today, offer a chance for us to discuss the necessity of challenging insecure, non-overseeable voting systems before elections rather than after, which Democrats, she charges, failed to do this year in Georgia.

On today's BradCast, we fly through a mountain of incoming stories (with the help of a great guest!) as the news gods seem to be unleashing a tidal wave in advance of the Thanksgiving Day holiday. [Audio link posted below. Buckle up before clicking.]

Among the ridiculous number of stories covered today...

• Five are dead after three shootings in three different states over the past 24 hours;
• Despite warning of an "invasion" on the U.S. southern border by a migrant caravan from Central America prior to the midterm elections, now that the elections are done, the Trump Administration is reportedly withdrawing more than 5,000 military troops they had deployed to the border just weeks ago;
• The President's daughter and senior adviser Ivanka Trump reportedly sent hundreds of government related emails via a private email server over the course of 2017 in the months following her father's election in which he repeatedly called for his opponent, Hillary Clinton, to be "locked up" for doing the same thing. Ivanka's husband, Jared Kushner, also a senior adviser to Trump, reportedly used the same private server for government-related communications.

On the election results front...

• Republican Rep. Will Hurd has reportedly squeaked out a victory over Democratic challenger Gina Ortiz Jones in Texas' 23rd Congressional District. The contest was among a handful of still-undecided races;
• At the same time, Democrat Ben McAdams appears to have pulled back into the lead over GOP Rep. Mia Love in Utah's 4th Congressional District, where it now appears McAdams will be the victor by fewer than 700 votes out of some 270,000 tallied, flipping yet another U.S. House seat from "red" to "blue". The final margin is reportedly 0.258%, just above the 0.25% that would have allowed Love to request a recount in the otherwise ruby "red" state.
• When the few remaining undecided U.S. House seats are called, Democrats appear on track to have picked up an extraordinary 39 seats in their "blue wave".
• One of the three still-undecided House races is in Georgia, where this year's Libertarian candidate for Sec. of State has now endorsed Democratic candidate John Barrow in the upcoming December 4th runoff against Republican Brad Raffensperger to replace GA's vote suppressing Sec. of State, now Governor-elect Brian Kemp;
• In Wisconsin, Democrats won every single statewide race on November 6th, including Governor (unseating Scott Walker) and U.S. Senate. They also outvoted Republicans in State Assembly races by 8 percentage points, 54 to 46 percent. Nonetheless, thanks to the GOP's extreme partisan gerrymandering in the Badger State, Republicans will hold 63 seats to the Democrats' 36 in the new Assembly;

The great (and newly wed!) MARK JOSEPH STERN, legal journalist at Slate, joins us to discuss how voters pushed back against gerrymandering this year by approving ballot initiatives --- and other measures --- in several states on November 6th, in an attempt to restore fair(er) elections in the wake of the U.S. Supreme Court opting to not strike down partisan gerrymanders as unconstitutional in states such as Wisconsin and North Carolina earlier this year. Among the many other issues we fly through with Stern today, on which he offers his as-always cogent legal insight...

• Ivanka and Hillary's email issues (Stern hopes a Democratic House investigation will result in real reform to the "arguably improper" if not unlawful use of private email by officials like Trump and Clinton, though not in the opportunistic political fashion that GOPers previously dealt with the issue);
• Trump's appointment of GOP operative Matthew Whitaker as Acting Attorney General (which Stern describes as blatantly "illegal" and, he believes, very likely to be struck down by the Courts). He also describes the DoJ's legal defense of the maneuver as "laughable";
• A federal court on Monday night blocked the Trump Administration's new regulation denying asylum claims by immigrants who fail to present themselves at a port of entry (Stern explains the judge found the Administration's new rule to be in strict violation of federal laws, and predicts that even Chief Justice John Roberts, based on similar rulings he made against the Obama Administration, will be forced to agree when the case reaches SCOTUS);
• The decision by a Trump-appointed federal judge to order the White House to restore press credentials to CNN's Jim Acosta (Stern is impressed with the Trump judge's anti-Trump ruling, I remain a bit more skeptical);
• And how (and why) Trump's controversial new Justice Brett Kavanaugh has, so far, laid low by not yet fuly tossing in with the Court's nihilist right-wing caucus.

On today's BradCast: More races were called and more candidates conceded over the weekend, as the counting from the midterm elections gets still closer to finally wrapping up, and as voter suppression by GOPers in two key states worked their magic. [Audio link to show follow below.]

But, first up today, the latest on the horrific California wildfires, with nearly 1,000 still said to be missing in the enormous Camp Fire in Northern California, where 77 were confirmed to have been killed as of airtime. Donald Trump toured the region over the weekend, referred to Paradise --- the town which was leveled shortly after the inferno broke out on November 8th --- as "Pleasure", and otherwise made something up, apparently out of whole cloth, about Finland raking their forest floors to prevent such disasters. Desi Doyen joins us for actual facts that apparently the President of the United States doesn't have access to, and to warn about what effect the rains predicted for this week over the Thanksgiving holiday may have on the blazes and their dangerous aftermaths.

Next, it's back to the continuing tally and fight to count votes from the November 6th midterm elections, as the last of the still-undecided races begin to get wrapped up, and several races get called by media over the weekend. In Florida, Republican Governor Rick Scott's years of disenfranchising some 1.7 million former felons (500,000 of them African American) paid off. The Sunshine State's incumbent Democratic Sen. Bill Nelson finally conceded to Scott after a partial hand-count in the state --- where more than 8 million paper ballots were tallied (either correctly or incorrectly, who knows?) by computer scanners --- resulting in a 0.12 percent edge (10,033 votes) for the termed out Republican Governor in the U.S. Senate election. Similarly, Democrat Andrew Gillum officially conceded to Republican Ron DeSantis in the Governor's race, after final computer tallies showed him losing by just 0.41 percent

The losses for Dems in Florida come on the heels of Democrat Stacey Abrams' loss to Republican Sec. of State and master vote suppressor Brian Kemp in the Georgia Governor's race late on Friday. Broad criticism of Kemp's massive voter suppression over the past eight years continued over the weekend, in what is unlikely to ever be viewed as a legitimate election.

Meanwhile, a runoff in the Secretary of State election in Georgia is now scheduled for December 4th and, in Arizona, Democrat Katie Hobbs has been named as that state's next Secretary of State, after media had inaccurately called it for the Republican candidate on election night. The Sec. of State position in both GA and AZ will play a crucial role in those two key swing-states in advance of the 2020 Presidential election.

Also over the weekend, the last of the California U.S. House races was called, with first time candidate, Democrat Gil Cisneros, defeating Republican Young Kim to turn the last of Orange County's once-impenetrably Republican House seats "blue". Dems now control every U.S. House seat in what had long been a GOP bastion, flipping four of them in just one election. They also now control every statewide elected position and enjoy a super-majority in both houses of the state legislature, all without partisan gerrymandering in the state where an independent commission draws state and federal districts.

Dems now hold a remarkable 45 to 8 advantage in California's U.S. House delegation, and have picked up at least 37 seats nationwide in the midterms. Just four more races are undecided (in NY, UT and GA) as of airtime.

And, as discussed today, a Special Election for the U.S. Senate in Mississippi in coming up on November 27th, with Republican Sen. Cindy Hyde-Smith heavily favored in her contest against Democrat Mike Espy. However, Hyde-Smith has recently been caught on video-tape making several troubling "jokes" about public hangings and voter suppression --- in a state with a long and disturbing history of both.

Finally today, we open up the phone lines to listeners on all of the above and much more, as we discuss what Democrats did right and wrong in the 2018 midterms, and what they might be wise to focus on once they officially take control of the U.S. House majority in January...

It was another very busy day on today's BradCast, as news breaks out of Georgia and California --- and seemingly everywhere else --- though we finally found at least a moment to take some stock of the midterm elections and what they portend, nearly two weeks after Election Day. [Audio link to show follows below.]

Before we get to elections and politics, however, there are horrifying new numbers today out of the ongoing, climate change-fueled wildfires in California. Officials now say that more 60 are known to have been killed, but on Thursday evening they also raised the number of those still unaccounted for amid the record Camp Fire in Northern California to a staggering and gut-wrenching 631. [Update: Just before posting this here, officials in Northern California increased the death toll, announcing 71 dead with more than an unfathomable 1,000 now said to be unaccounted for!]

Then, a Trump-appointed federal judge orders the White House to immediately restore press credentials to CNN White House Correspondent Jim Acosta.

Next, another midterm election victory is called by AP and others for Democrats in what had long been solidly Republican Orange County in California. Katie Porter, an unapologetically progressive Elizabeth Warren protégé, is now said to have defeated incumbent Republican Rep. Mimi Walters in the heart of what was once known as "Reagan Country", in the state's 45th Congressional district. Walters had easily won reelection by a huge 17% margin just two years ago, but now becomes the third of Orange County's four U.S. House members to see their seat flipped to a Democrat. The fourth seat, in CA's 39th Congressional district, is very likely to be called for Democrat Gil Cisneros over Young Kim any day now.

As of air time, Dems have reportedly picked up a net gain of 36 seats for their new House majority, though that number may still climb to 38 or even 39 seats as votes are tallied in the last of the undecided House races.

Meanwhile, in Florida today, statewide "hand counts" --- or what suffices for them in the Sunshine State --- continued on a ridiculously abbreviated schedule through Sunday in the state's U.S. Senate race between incumbent Democratic Sen. Bill Nelson and GOP Gov. Rick Scott, who is said to lead by 0.41%, or just over 12,000 votes out more than 8 million cast.

The partial "hand count" in the Senate race moves forward after full "machine recounts" in three of the state's largest and most Democratic-leaning counties were rejected by Scott's Sec. of State. In Palm Beach, the County's old computer scanners could not physically tally fast enough to meet the Thursday 3pm deadline at the end of just five days. In Hillsborough County, the second machine count differed from the original count by more than 800 ballots, so the first count will be used (whether it's right or wrong, nobody knows.) And in Broward County, state officials rejected their new count because it was uploaded to the Sec. of State's office two minutes after the 3pm deadline. Seriously.

As a source in Palm Beach told me earlier today about the impossible timelines instituted by state Republicans: "These deadlines they codified into law set up big counties to fail. How a county like ours (population 1.3 million) has the same deadline as a county like Liberty County (population 8400) is beyond me. Five days isn't enough, a week isn't enough, two weeks isn't enough. This is done by design. Why? The biggest counties are blue counties and they don't want those votes counted. It's not complicated."

And, in Georgia, Democratic gubernatorial candidate Stacey Abrams announced that her Republican opponent Brian Kemp would be the winner of their very close and contested election, thanks in no small part to the extraordinary voter suppression he has implemented over the past eight years during his tenure as Secretary of State.

"Let's be clear: This is not a speech of concession because concession means to acknowledge an action is right, true or proper," Abrams said in a speech to supporters, while denouncing Kemp's outrageous record as the state's chief election official. "As a woman of conscience and faith, I cannot concede that."

At the same time, she also announced she is forming a new organization --- Fair Fight Georgia --- that will sue Kemp and the state for "gross mismanagement" of the election as she declared "the law currently allows no further viable remedy" to overcome what many now see as a stolen election in the Peach State.

Finally, we're joined by the great HEATHER DIGBY PARTON of Salon and Hullabaloo, to try and help us make sense of these past two tumultuous weeks since the midterms. We discuss the Dems' extraordinary (and under-appreciated) "Blue Wave", how it has clearly served to throw Trump into a dark emotional spiral while exposing him yet again as a con-man, even to many of his supporters, and how some Democrats appear to be taking the rightwing Fox "News" bait in hoping to block Nancy Pelosi's likely return as House Speaker and leader of the Congressional Democratic caucus in January...
