With a long history of fossil fuel disasters up and down the California coastline, another one erupted over the weekend here in Southern California, as we discuss at the top of today's BradCast, along with the latest on the Congressional GOP Caucus threat to tank the U.S. economy by defaulting on trillions of dollars in debt they long ago agreed to incur.

First up, at least 126,000 gallons (approximately 3,000 barrels) of crude spilled into the ocean waters near Huntington Beach, California over the weekend, about 30 minutes south of Los Angeles. The full extent and cause of the damage is currently unknown as we went to air, but it includes a 13-square mile oil slick, dead birds and fish washing ashore, and sensitive ecological preserves along the coastline having been sullied by thick oil and tarballs.

The oil appears to have leaked from some part of a 17.5 mile pipeline which has extended, since the 1980s, from oil drilling and production platforms more than 3 miles offshore, in federal waters overseen by the U.S. Dept. of Interior. The pipeline is one of hundreds running up and down the oil rich CA coastline, where the state has banned new fossil fuel infrastructure, but where, as our guest notes today, the Trump Administration attempted to open up still more dangerous oil production over the past four years. The U.S. Coast Guard is now investigating whether a ship anchor dragging on the ocean floor may have caused the rupture.

We're joined on the program by LAURA DEEHAN, State Director of the non-profit Environment California, for the latest on the state's most recent fossil fuel disaster and what can and should be done about it moving forward.

"We need to get to the bottom of what's happened here," she tells us, adding: "I think our immediate concern is let's protect the wildlife, let's minimize the damage to our beaches and coastline as much as we can right now. But ultimately, of course, we're calling for a permanent end to this activity. Because clearly enough is enough."

Similar disasters have been killing wildlife and covering Southern California beaches in sticky, toxic tarballs for decades. The current spill has now shut down the tourism rich beaches of Huntington Beach, resulted in the cancellation of the third day of an air show on Sunday featuring the Blue Angeles and some 1.5 million spectators, and may similarly affect other beaches in the area from Long Beach to Newport Beach in Orange County in the coming days.

Deehan confirmed that the sensitive, 25-acre Talbert Marsh ecological reserve near Huntington Beach has now been sullied, threatening the lives of dozens of rare and endangered birds and other species. "We clearly need to end our dependence on oil to power our lives as fast as possible. So, we're calling for an end to drilling of the California coast," she explains. "Our coastline is too precious, it's too vulnerable, and we need to prevent anything like this from happening ever again."

So, who is to blame here? The private companies who run the platforms and pipelines (the Elly platform near where the leak occurred is run by a company named Beta Offshore, which is owned by another named Amplify Energy Corp.) Or is the state and/or federal government to blame? It took nearly 24 hours after residents smelled petroleum fumes and reported boats coming into docks with oiled hulls before a response was mounted and the pipeline, eventually, shut down. Dolphins and whales have reportedly been seen swimming through the oil slick ever since.

We discuss all of that and how the Biden Build Back Better agenda, supported by almost the entirety of the Congressional Democratic Caucus, might help to begin making all of these recurring disasters a thing of the past. Eventually. If Dems can overcome a handful of party obstructionists, which largely amount to two Senators, Joe Manchin from West Virginia coal country and Kyrsten Sinema of Arizona.

"When you think about the consequences of NOT ending our dependence on oil, I really think the costs to our society are so much greater," Deehan argues. "We can no longer afford to have these significant negative events, like a massive oil spill off our coast. There are economic impacts from that, too. The coastal communities, the people who want to be able to go surfing, the people who want to visit our Southern California beaches, the tourism industry, the fishing industry. All of these industries are going to lose a lot from this event."

As you might imagine, we'll be keeping our eye on that mess. But, next today, we head back to D.C. for the latest in the GOP's threat to tank the entire U.S. economy --- and the world's with it --- by obstructing Democratic efforts to lift the debt ceiling in order to continue paying off our already existing debt (including $8 trillion in deficit spending approved by Congress during the Trump Administration). The stakes are nothing less than the avoidance of a global fiscal calamity if the U.S. defaults on its debt for the first time in history, as of October 18. President Biden called out Republicans at the White House today for their brinkmanship, asking them to "get out of the way" if they won't help, and arguing that a "meteor is headed to crash into our economy" while the GOP plays "Russian Roulette" with it. Over the weekend, Democratic Senate Majority Whip Dick Durbin of Illinois called out Minority Leader Mitch McConnell for "playing games with a loaded weapon".

On today's BradCast: Over the weekend, House Speaker Nancy Pelosi warned her caucus in a "Dear Colleague" letter that "the next few days will be a time of intensity". She wasn't kidding. [Audio link to full show is posted below this summary.]

Today, we bring you up to date on the four different major pieces of legislation that Democrats must push through Congress, somehow, within the next few days. All four are incredibly important for different reasons, have slightly different deadlines, and slightly different obstacles to passage, each of those obstacles are difficult.

As of midnight Thursday (September 30), the government will shut down if a Continuing Resolution to keep it open is not passed in the Senate. That will end up costing taxpayers a lot of money and financial markets will take a hit, as we already saw today, with the Dow dropping more than 550 points and the S&P falling 2 percent. Of far greater danger to both the stability of the U.S. AND global economy, as of October 18, as Treasury Secretary Janet Yellen has now cautioned lawmakers, the government will run out of "extraordinary measures" to avoid defaulting on U.S. debt unless the ridiculous, statutory debt ceiling is raised or suspended by Congress. That would allow the government to continuing borrowing to pay for all the stuff that Congress has already committed to spending, such as the $8 trillion increase to the national debt that was run up with the approval of Republicans during the Trump Administration, for example. Without raising the debt limit, Yellen warned, we will face "catastrophic economic consequences".

Republicans in the Senate, however, are currently filibustering the bill that would solve both of those problems in one simple fell swoop, just because they can. They appear to want chaos, uncertainty and a potential meltdown of the global economy, even at the cost of a first-ever default on the good faith and credit of the U.S. government. How that destructive hostage taking ends before the imposing deadlines nobody currently seems to know.

The other two pieces of legislation that need to pass quickly comprise Joe Biden's progressive agenda, which he ran on, is wildly popular among the American people, and which Democrats can now enact into law without any Republican help. One is the $1.5 trillion bipartisan infrastructure package for stuff like roads and bridges. The other is the $3.5 trillion budget reconciliation bill known as the Build Back Better Act to expand health care, education, child care and take on climate change among a host of other critical stuff. The framework for the latter bill was approved by Democrats in both chambers on the basis that both bills would be passed together, appeasing both progressives and so-called "moderates". Together, the two bills make up the bulk of the Biden agenda which every Democrat in both chambers voted to support...at least until a small handful of "moderate" Dems in the House and two Dems in the Senate (Joe Manchin and Kyrsten Sinema), tried to break the deal recently and force a vote on the smaller bill while kicking the larger one down the road.

But a newly robust and emboldened Progressives Caucus in the House is having none of it, and has vowed to vote against the smaller bill if the larger one isn't passed along with it. The hold up on the larger one appears to largely be Manchin and Sinema who have been vague in their objections, other than to protest that $3.5 trillion is too much spend. That, despite the fact that Democrats and the President say the entire ten-year ($350 billion/year) bill is fully paid for by small tax increases on corporations and the wealthy. Biden describes the cost of the bill as "zero".

All of which has resulted in "a time of intensity" on Capitol Hill right now which we walk through today --- intensely --- even as Manchin refuses to come up with a number that he would accept, and as Sinema's vague objections are made somewhat clearer by a fund-raiser being held today for her by several business lobbies who oppose having their taxes raised (to a lower amount than they were before Trump), and as her position is now costing her dearly at the moment among both the Arizona state Democratic Party and Democratic voters across her state. Tune in. We'll explain all.

In less intense --- and actually encouraging --- progressive news OUTSIDE of D.C, the inflection point to electric vehicles may just about be here, if Ford's new announcement this week of a huge, $11 billion investment to build three battery factories and an electric truck plant (creating 11,000 jobs in the bargain) is any indication.

As we head into a week of what House Speaker Nancy Pelosi understated over the weekend as "a time of intensity", we cover that on today's BradCast along with a bit of postmortem mop-up following last week's spectacular fail by the dopey Cyber Ninjas in their Maricopa County, Arizona "audit" of the 2020 election. [Audio link to full show is posted below this summary.]

This week, Congress --- and the Democratic Party which is now, apparently, being forced to run it all by themselves --- is facing several precarious moment on a number of fronts. For a start Congress must pass a continuing resolution to keep the government operating after September 30th, when the current fiscal year ends. Even more importantly, to avoid a "financial calamity", they must pass a resolution to suspend or raise the statutory debt limit --- the amount of money the nation can borrow to pay for spending that has already been approved by Congress --- before the country defaults on its loans for the first time in history at some point in October.

Republicans in the U.S. Senate are blocking Democrats from doing either of those things at the moment, in what Pelosi describes as brinkmanship that is "irresponsible beyond words". That, after Democrats voted with Republicans time and again (three times during the Trump Administration alone) to suspend the debt ceiling in order to pay for much of the $8 trillion in debt that was run up with Republican approval over the past 4 years when Donald Trump was in the White House and they controlled Congress.

We explain the incredibly dangerous (and hypocritical) game that Mitch McConnell and the GOP are currently playing with the world economy, even as Democrats face their own internecine battles over how to pass final approval for the Biden Build Back Better agenda, including a bi-partisan $1.5 trillion bipartisan infrastructure bill and a $3.5 trillion budget reconciliation bill (which Dems can pass by themselves, if they can agree on it) to expand health care, child care, education and much more, including long-overdue action to address on climate emergency.

Next, BradCast listeners last week may know that we were the first in the nation to break the news that the phony, so-called "audit" of the 2020 Presidential and Senatorial election results in Maricopa (Phoenix), AZ by the partisan, conspiracy theorist Cyber Ninjas outfit ended up proving that the Dominion Voting Systems computer tabulators used to tally results in the state's largest county did so accurately. That, according to the Ninjas' own hand-count [PDF] of some 2.1 million ballots. In fact, in a spectacular and hilarious failure, the Ninjas count found the margins of victory for the Democrats in both Joe Biden's Presidential contest and Mark Kelly's Senatorial race, were actually larger than those certified by the County and state officials last year.

But, while the Ninjas tried (unsuccessfully) to bury that embarrassing finding, they also tried to flood the zone with smoke and mirrors about tens of thousands of ballots that they suggested were either illegal or fraudulent in their three-volume report on the audit, and a three-hour presentation last Friday to the GOP-controlled AZ state Senate. There too, they failed spectacularly with one outlet after another, including the Republican-majority Maricopa County Board of Supervisors, fact-checking, debunking and explaining the so-called "critical" claims made by the Ninjas.

It seems the Ninjas never bothered to check with any actual election administration professionals, else most of their concerns would likely have been explained to them.

We're joined today for a postmortem debrief by an insider to much of the past five months of "audit" clown show theater in Maricopa,. You know him as that "bamboo guy". We have known him for many years as the longtime progressive election transparency advocate JOHN BRAKEY of AUDIT-USA. Brakey joined us previously at the beginning of the "audit" for an insider view, and as it continued on for months past its initially planned three weeks, after comments of his taken out of context by a local reporter went viral, reporting that Brakey was looking for bamboo in the ballots, suggesting they were fraudulent and stuffed into the ballot box by China (as many in the MAGA set falsely claimed). In fact, as the later posted full context of his remarks reveals, Brakey was explaining what the Ninjas believed, not him, and that he was participating in the effort in hopes of "ungaslighting" the public about false and otherwise evidence-free claims being made by Trump supporters about the election results.

Brakey worked --- for free, while also refusing to sign the Ninjas' non-disclosure agreement --- with AZ's former Sec. of State, Ken Bennett, a Republican, who was tapped by the GOP state Senate to serve as their liaison to the "audit".

"The whole thing was a grift. Okay?," Brakey tells me today after the audits conclusion. "They didn't want people to know how screwed up they were. They're the best talkers but the worst producers. They pretend to know what they were talking about." But, as Brakey explains again today, they didn't have a clue what they were doing.

Among the many questions of mine that Brakey speaks to today:

• Were his efforts to "ungaslight" the public by working on the audit successful or was it a mistake on his part to lend his credibility?
• Does he believe the minds of any of the MAGA Mob were ultimately changed through this exercise?
• As a long time election transparency and integrity champion, was there anything that the Ninjas DID uncover that was actually troubling and needs to be addressed or corrected by election officials?
• Will the AZ "audit" make similar post-election reviews more or less likely elsewhere in the country?
• What is the AZ Senate hiding by failing to release thousands of public documents and communications between them and the Ninjas (including emails and texts from Brakey), as ordered by a state judge?
• And much more, including whether or not the Ninjas ever found that elusive "bamboo" in Maricopa County's 2.1 million hand-marked paper ballots!...

Now, even the Cyber Ninjas agree that Donald Trump lost, and by more than originally thought. The full, final, long-awaited report is set to be released on Friday in three different "volumes" in which they hope to bury the lede. But we've got the breaking skinny, exclusively reported for you on today's BradCast. [Audio link to full show is posted below this summary.]

According to a months-long, so-called "forensic audit" and hand-count of more than 2.1 million ballots in Maricopa County (Phoenix), Arizona from the 2020 election, not only did Joe Biden defeat Trump, as previously reported by the County and the state, the private partisan company hired by the GOP state Senate to carry out the exercise, found that Biden actually received more votes over Trump than originally reported.

Information obtained just minutes before airtime today, reveals that the months-long "audit" by the far-right, partisan, conspiracy-promoting Florida company named Cyber Ninjas, headed up by CEO Doug Logan, determined that Biden's vote total in the state's most populous county was actually larger, by about 100 votes, than the certified numbers, while Trump's total decreased by more than 200.

The certified results in Arizona determined that Biden defeated Trump by about 10,000 votes statewide, and by some 45,000 votes in Maricopa.

The Ninjas' "clown show" hand-count was paid for partially with Arizona taxpayer dollars, along with millions in private donations raised from duped Trump supporters who believed his claims that the election was somehow rigged in the state with the help of Dominion's voting and tabulation computers. The post-election review was carried out largely without public or media oversight, but it found numbers remarkably similar to those initially tallied by the County's Dominion tabulators, as previously reported by Maricopa County and certified by the state.

Similarly, the Ninjas' hand-count of the U.S. Senate race between Democrat Mark Kelly and then Republican Senator Martha McSally --- the only other statewide race won by Democrats last year --- found an increase in the margin of the Democrat over the Republican. In the Senate contest, both candidates lost a small number of votes compared to the County's certified computer tally, according to the numbers the Ninjas are set to report publicly on Friday. While Kelly lost fewer than 100 votes in the private hand-count, McSally lost more than 500.

The final report, scheduled for its long-awaited release tomorrow, will include three different volumes. Volume I is said to include the Ninjas' "Executive Summary & Recommendations". Their recommendations, as we have learned, are fairly standard recommendations for ways to improve local procedures, similar to recommendation often made by actual longtime Election Integrity advocates in previous elections in both Arizona and other states. The second volume of the report details "Operations and Methodology" claimed to have been used by the Ninjas. And the third, by far the largest and most detailed, is titled "Results Details".

It is not until the third volume of the report that the Ninjas finally get around to detailing the actual results of their hand-counts as compared to the County's tally. They almost precisely confirm the originally reported official results of both the 2020 Presidential and Senatorial races in Maricopa County. There still may be some changes made to the report before the final version is released on Friday.

I suspect we'll have more details on all of this in the coming days, since today's program began just minutes after we obtained a large amount of the data, which we work through on air.

What is clear, however, is that Republicans who were told that the election in Arizona was somehow manipulated, were lied to. From our review of the Ninja's information, there remains zero evidence of fraud that might have altered the ultimate results in either the county or the state. Nonetheless, based on the theatrical performance put on by the Ninjas beginning in April and continuing over the past five months, Republicans in states across the country are now planning similar, taxpayer funded exercises to review the results of the 2020 election. They may be as disappointed as the Ninjas and those who gave them their money.

If the Arizona findings are echoed elsewhere, the Republican Party is on the verge of wasting a whole lot more taxpayer money, along with millions in private donations that their "forensic audit" proponents are currently raising to fund those similar investigations.

Beyond that on today's program, we cover, in some detail, the Congressional GOP's dangerous threat to force a default on the good faith and credit of the U.S. Government. Senate Republicans are currently vowing to block an increase in the nation's allowable statutory debt limit before the U.S. runs out of borrowing power to cover bills for stuff approved by Congress (both Republicans and Democrats) long ago. That, as Republicans in the Senate also threaten to force a full government shutdown as the new fiscal year begins on October 1.

We've got a lot of detail on that shameful, reckless and under-reported mess today, as Republicans, once again, hold a nation hostage to their demands...even if, this time, they don't seem to actually be making any. They appear to simply be causing havoc and potentially costing the U.S. economy trillions, simply because they can.

CORRECTION 9/23/2021: In the article above, I initially misidentified Cyber Ninjas' CEO Doug Logan as Doug Jones, who, unlike Logan, is an actual voting system and cybersecurity expert. Another Doug Jones is the former Senator from Alabama. Also, while going through the just obtained information live on air, I misspoke at one point to say there were some 4 million ballots cast in Maricopa. In fact, as I noted elsewhere during the show, there were 2.1 million ballots cast in the County last November. I had misread, on the fly, some of the data showing 2.x million votes tabulated by the County originally and 2.x million tabulated by the Ninjas. I read that on the fly on air as 4 million votes total (incorrectly seeing those numbers as one row for Trump and the other for Biden, when they actually were for each of the two different tallies.) On today's BradCast: What we are witnessing right now in Washington D.C. is not just an exercise in how the sausage gets made...or doesn't. While it is that, it is also an extraordinarily perilous moment for the survival of the republic, as Democrats try to step up, in order to face down an insurrectionist GOP seemingly hell bent on taking the nation and the world down with them. Fortunately, our guest today --- who knows this landscape as well as anyone in the nation --- seems optimistic, despite the fraught dangers that lie ahead. The nightmare moment for Joe Biden, the Democrats and the nation, includes a Congressional Republican Party willing to default on the, until now, iron-clad good faith and credit of the U.S. economy, by refusing to vote to raise the ridiculous "debt ceiling" in order to borrow the money needed to pay for all the stuff that we (including Republicans!) have already committed to paying for, including trillions spent or given away during the Trump years.

It also includes several mighty internecine battles inside the Congressional Democratic caucus itself, as the so-called "moderate" and progressive wings of the big tent party attempt to navigate through landmines over the next several days and weeks to come to an agreement on Joe Biden's proposed $3.5 trillion Build Back Better social safety net programs (which, in addition to the expansion of health and child care, also includes a laundry list of long-overdue programs, such as our first major attempt to take on our climate emergency) and the critical Freedom to Vote Act, a sweeping election reform package to try and counter the massive voter suppression and election subversion efforts being adopted by GOP-controlled states in advance of 2022.

To pass the latter, Democrats will almost certainly need to reform the filibuster in some way, to allow passage with a simple majority of Senators. Sadly, there do not appear to be any Republicans left in Congress who are willing to support the right to vote and fair elections. These problems seem insurmountable for the moment, even as we've been fairly bullish on the Dems' ultimate ability to overcome the many hurdles they currently face.

Similarly bullish, it seems, is NORMAN ORNSTEIN [pictured above], longtime Congressional historian and political science PhD, who has spent the bulk of the last four decades studying politics, elections, and the US Congress at the right-leaning American Enterprise Institute, where he is now a senior fellow emeritus. He is also a contributing editor and columnist for The Atlantic and author of a host of books, including his latest, One Nation After Trump: A Guide for the Perplexed, the Disillusioned, the Desperate, and the Not-Yet Deported, with E. J. Dionne and Thomas E. Mann.

Last week, Ornstein and Norman Eisen, of the left-leaning Brookings Institution, published a Washington Post op-ed headlined "Seven reasons to think Senate Democrats will actually change the filibuster". It's based on a paper they published at the same time at Brookings, along with Mel Barnes and Jeffrey A. Mandell, titled "Filibuster reform is coming --- here's how".

Both pieces are surprisingly optimistic when it comes to what will have to happen --- and how West Virginia's Joe Manchin and Arizona's Kyrsten Sinema will have to play along --- in order to reform the filibuster to adopt the Freedom to Vote Act, before that freedom is all but foreclosed by GOP voter suppression and election subversion in next year's mid-terms and 2024's Presidential race.

"We're seeing more and more intense understanding on the part of Democrats in the Senate that the road to accomplishing significant goals, in a time frame that's short for Democrats, has to require some change in their rules," Ornstein tells me, explaining why he believes that even Manchin and Sinema will come around to understanding the existential necessity of countering "the over-the-top actions by --- it's not a party anymore --- the Republican cult, to try not just to obstruct votes and to suppress votes, but to intimidate election workers and overturn legitimate results."

He walks us through why he believes that both of those two currently obstructionist Democratic Senators will come around in the end, on both filibuster reform and the Dems' budget reconciliation bill, which can be adopted with a simple majority vote. "Joe Manchin, throughout his career, has been a transactional politician. You could do a bill that's, say, $2.2 or $2.5 trillion, that actually preserves all of your core priorities" by simply trimming the number of years those proposals will be in effect. And, he argues, it can be done "if not being revenue neutral," then in a way that "is a pretty trivial amount as a share of our Gross Domestic Product."

In the end, he believes Manchin will come along, and Sinema along with him. "I think it's dicey, but I also think it's doable," Ornstein argues.

Among other key points of our conversation today, we discuss how Nancy Pelosi can hold the vote on the smaller, bipartisan, $1.5 trillion infrastructure package that Democratic House "moderates" are demanding next week, but not send the bill to the President's desk until the larger reconciliation package supported by progressives is adopted in both chambers; and how (and if) Democrats will be able to overcome objections by the Senate Parliamentarian to include things like immigration reform in a budget reconciliation package, "awkwardly thrown in". All necessary, says Ornstein, "because of the goddamn filibuster! Because there's no other way to get it done with 50 votes. So you create this ungainly hodgepodge of things as a way to try to circumvent the rules, and the better way to deal with it is to change the damn rules!"

If these things don't happen, he warns, if Democrats fail to successfully navigate the many minefields to adopt both election reform and Biden's Build Back Better Agenda, we are in "deep, deep, deep trouble," he says. "I think we're done for, frankly, if they can't do both of these things."

Of course, in the next few days, we'll also have to somehow get over the debt ceiling cliff that Mitch McConnell and Senate Republicans are threatening to push the nation over. On that, Ornstein is less sanguine. "I'm actually more concerned about that, because we have a group of Republicans like [Governors] Ron DeSantis, Greg Abbott, Kristi Noem and Tate Reeves, and so many others who are willing to let hundreds of thousands of people die [from COVID] for their own political purposes. Can I believe that Mitch McConnell and his colleagues would let the nation go into default and cause the economy to go into huge upheaval? Sadly, yes."

There is also at least one extra treat in my interview with Ornstein today, however, for those who may remember the hilarious and shockingly prescient 1998 satirical novel by Al Franken, written prior to his career as a U.S. Senator, entitled Why Not Me?: The Inside Story of the Making and Unmaking of the Franken Presidency. Ornstein actually "co-stars" in the book as Franken's unlikely Campaign Manager before becoming his Presidential Chief of Staff. I'll not give any more of the book away, since I suspect it's still an hilarious read. But today, Ornstein shares the backstory of how that book came about, and how much more prescient it actually turned out to be than even I remembered!...

On today's BradCast: A very lively conversation with one of our favorite guests...about a very dark moment in our nation's history. [Audio link to full show is posted at bottom of this summary.]

Last week, on the final day of its term this year, the 6 Republican Justices on the GOP's stolen and packed U.S. Supreme Court majority, "turned back the clock on voting rights," according to UC Irvine election law professor Rick Hasen. A week after Justice Samuel Alito opinion for the majority in Brnovich v. DNC was published, Hasen is "angry" that "so much of the public does not realize what a hit American democracy has taken," as the ruling "reopens the door to a United States in which states can put up roadblocks to minority voting and engage in voter suppression with few legal consequences once a state has raised tenuous and unsupported concerns about the risk of voter fraud. It's exactly the opposite of what Congress intended."

We share Hasen's fury today. Not only about the activist Rightwing SCOTUS jurists legislating from the bench to wholly rewrite the intent of Congress, but also about them ignoring the couldn't-be-clearer, simple meaning of the plain text of the 15th Amendment. The entire thing is only two sentences long. The first declares "The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude." The second states that "The CONGRESS shall have the power to enforce this article by appropriate legislation." [Emphasis added for our six deceitful, dishonest SCOTUS Justices.]

Once again, the Supreme Court has chosen to simply ignore that second sentence in --- yet again --- gutting the Voting Rights Act, the appropriate legislation Congress wrote, and has amended to strengthen several times, in order to enforce the 15th Amendment, as literally directed by the Constitution. And, once again, the Roberts Court has put the lie to the bogus claim by the Right that the Republican appointees are "originalists" or "Constitutional textualists" who believe only in the literal, plain text meaning of Constitution as it was written. That is clearly, and always has been, a bald-faced lie.

We're joined today by the great MARK JOSEPH STERN, legal reporter at Slate, to discuss, at term's end, the outrage of the "mangled" Brnovich opinion, which now allows Arizona and other Republican controlled states to simply ignore the expressed intent of Congress' specific legislation barring voting laws that result in disproportionate disenfranchisement of minority voters and pretends that the Judiciary, not Congress, has the "power to enforce" the Constitution's 15th Amendment.

"You're dead right about the Fifteenth Amendment," Stern tells me. "And I do think it's worth noting that all of the Reconstruction amendments expressly empower Congress to enforce them. Because the framers of these amendments after the Civil War recognized that it was crucial not to just rely on the federal courts to protect rights, that Congress itself needed to play a leading role in the protection of Constitutional rights. And, particularly, the protection of political equality for people of all races."

"The conservative Justices [they're not "conservative", which we discuss as well!] have adopted this position not just of judicial supremacy but judicial arrogance, that the framers of the Reconstruction amendments couldn't possibly have intended to give Congress power to go beyond the Supreme Court's own interpretation of the Constitution.," Stern fumes. "This is a theme that we see from conservative justices over and over again --- where they say 'We're the ones who decide what counts as a right. We're the ones who decide what counts as legal and illegal, and Congress has nothing to say. Congress can only enforce our own rulings. What five of us say on this Supreme Court overrules what everyone says in Congress and the elected democratic branches. That has led to this twisted position where we don't see a lot of litigators actually speaking about the text of the 15th Amendment because the court has said, 'We sit at the top of the hierarchy, we get to decide, and all Congress can do is enforce our positions.'"

Stern also joins Hasen's (and my) anger in seeing SCOTUS blatantly ignore Congress's express intent for Section 2 of the VRA to prevent voting laws that result in the disenfranchisement of minorities. "What Justice Alito has done," Stern tells us, amounts to simply "making up" a new rule that is "totally fabricated" and "nowhere in the text" of either the law or the Constitution, in setting new "guideposts" for the use of the VRA's Section 2. "The law says very explicitly that any voting restrictions that results in disproportionate impact on racial minorities is illegal."

At the same time that the Court allowed Arizona's new voter suppression laws, Stern notes the irony of Chief Justice John Roberts, on the very same day in another "bitterly divided" 6 to 3 opinion (Americans for Prosperity Foundation v. Bonta), blocking the state of California's law that allowed its Attorney General to learn the name of "dark money" donors to non-profit groups in order to enforce state laws and limits. All of which, Stern observes, bodes very darkly for both what is to come in the next term of SCOTUS (major cases on guns, abortion and affirmative action are on the docket) and beyond --- not to mention any laws Democrats in Congress may pass (if they can ever reform the filibuster) to protect voting rights.

"In fact, I have been saying for a long time, unfortunately, that this Supreme Court will strike down large portions, if not all, of the For the People Act and the John Lewis Voting Rights Act," Stern warns. "Next term is winding up to be one of the most catastrophic terms for progressives, for the left, in history --- in the entire history of the country."

With that bright news, we also discuss the disappointment of 82-year old, Democratic-appointed Justice Stephen Breyer failing to announce his retirement last week as many hoped, so he could be replaced by a Democratic White House and Senate, while both still exist. And, yes, there is much more in our conversation today regarding SCOTUS at the end of its first term with three far-right activist jurists packed onto it by Senate Republicans who happily blocked a Democratic appointee to the Court for year, before unilaterally killing the Senate filibuster to seat all three of Trump's appointees.

Also today, remember all of those major corporations who pretended to express outrage after the January 6th insurrection and the passage of voter suppression laws around the country, vowing to halt corporate donations to members of Congress who voted against the certification of Joe Biden's decisive victory over Trump? Yeah, as we warned you months ago, most of them didn't actually mean it. Now we have much more proof...

On today's BradCast: The Republicans' stolen and packed U.S. Supreme Court handed down a bunch of new decisions today. New York's primaries elections were very interesting in both NYC and Buffalo on Tuesday. And Congressional Democrats vow to fight on for voting rights after Senate Republicans, as expected, used the filibuster to block debate on protecting voting rights. [Audio link to full show follows this summary.]

First, on yesterday's primaries in NY, the race for Mayor in New York City featured almost 15 candidates. But, under the city's new Ranked Choice Voting system, as we explained on yesterday's program, it could take weeks before we are told who the winner is. Whether voters will have confidence in those results --- after weeks of the virtually-impossible-to-oversee RCV counting (and recounting) system --- is anyone's guess. For the moment, a fairly conservative law-and-order candidate, Eric Adams, leads the pack in the ongoing first round of tallying, with about 32 points. He's followed by progressives Maya Wiley and Kathryn Garcia with 22 and 19.5% each, respectively. Andrew Yang is in fourth place with almost 12% of the vote. As none of the candidates received more than 50 percent, however, the Ranked Choice tallying will soon begin. When it ends, and who wins, is anybody's guess. Yes, even though Yang conceded after his 4th place finish, he could still end up winning under the confusing RCV process. And the winner of the Democratic primary is almost certain to be the next Mayor of NYC.

Meanwhile, up in Buffalo, New York's second largest city, India Walton, a 39 year-old African American socialist with no experience in political office, unseated the city's four-term Democratic Mayor Byron Brown in a huge upset. If she wins the general in November, Walton will be the first socialist mayor of a major city since 1960, after unseating an incumbent Buffalo Mayor for the first time since 1961. Brown, however, reportedly is considering a write-in campaign this fall against Walton, given that there will be no Republican for her to face on this year's ballot in the heavily Democratic city.

Down in D.C. on Tuesday, the Democratic majority in the U.S. Senate "won" the vote to proceed with debate on their sweeping elections, voting rights and campaign reform bill known as For the People, when all 50 Democrats stuck together to vote in favor. But they lost anyway, because Republicans, for their part, all voted against debating voting rights, even as state level GOP legislatures are adopting bills all across the country to restrict such rights. 60 votes would have been needed to overcome the Republican filibuster in the Senate, where Senators representing a tiny majority of Americans (about 20 percent, according to Ari Berman), have the ability to block any and all legislation offered by Democrats, whose 50 Senators represent some 43 million more Americans than those represented by the 50 Republicans in the upper chamber. Nonetheless, Majority Leader Schumer, President Biden and House Speaker Pelosi all vowed to fight on, with Pelosi announcing that Dems would "not be deterred"; Biden declaring "this fight is far from over"; and Schumer promising that Tuesday's vote "was the starting gun, not the finish line."

For any of that to be true, however, West Virginia's Joe Manchin and Arizona's Kyrsten Sinema, at the very least, would have to agree to change the rules for the Senate filibuster. Dems hope that voters may help convince them to do so over the Independence Day recess, given that For the People is supported by some 68% of American voters.

Next, we're joined by the always-great MARK JOSEPH STERN, legal reporter at Slate, to discuss, among other things, the decisions handed down today at SCOTUS, as the Court wraps up this year's term at the end of the week. Despite the 6 to 3 advantage for rightwingers on the Republicans' stolen and packed Supreme Court (because Republicans were more than willing to kill the filibuster in order to accomplish it!), Chief Justice John Roberts, once again, managed to produce largely consensus decisions on all but one of the opinions released today.

Among those opinions, as explained and analyzed by Stern, was a very troubling ruling that kneecaps union organizing rights across the country. That one, which Stern notes "is very over the top" and makes up "a completely new rule that did not exist before," was the one decided by the rightwingers' 6 to 3 vote. It continues the Roberts Court's relentless erosion of labor rights. But there were also reasonable decisions handed down on police powers to enter your home without a warrant and on a high school's punishment of a cheerleader who used the F-word on Snapchat over a weekend while she was in 9th grade. One other decision was also released today, allowing President Biden to replace Donald Trump's terrible director of the Federal Housing Finance Agency (FHFA), which oversees mortgage giants Fannie Mae and Freddie Mac.

"There's enough credit to go around here," says Stern, in response to my question about whether Roberts deserves credit for some of the narrow decisions that were able to overcome a bitterly divided Court without causing too much damage to longstanding rights and precedent. "I think Chief Justice John Roberts is in the driver's seat on some of these compromise decisions. But I think that, to some degree, Justices Kavanaugh and Barrett are willing to go along, and so are the liberal justices. I think a lot of these decisions involve compromise on both sides. Some of them include some bitter pills for the left or the right to swallow, but at the end of the day, six justices are trying their best to duck the big issues, and issue really small decisions that don't ruffle too many feathers."

The fallout so far this term, the first with the GOP's 6 to 3 advantage, was "not as terrible as it could be." Though, Stern cautions, "It's not over yet. There are still some major decisions coming down the pike. And no matter what happens, we've still got next term with guns and abortion, of course."

The biggest decision this term, however, may be whether or not 82-year old Justice Stephen Breyer is going to step down to allow President Biden to nominate someone younger to fill his seat while Democrats hold the majority in the Senate, or whether he's going to pull a Ruth Bader Ginsburg and wait to leave the Court, one way or another, after Republicans have regained a majority in the upper chamber. Given that the Senate's Republican leader Mitch McConnell has already indicated he is unlikely to ever allow a Democratic President to fill a Supreme Court vacancy while Republicans hold a majority, we both hope that Breyer will take McConnell at his word, and get out now while the getting is still good.

On today's BradCast, the fight for truth and justice continues from Palestine to Washington D.C. to Los Angeles, CA. [Audio link to full show is posted below summary.]

Just before airtime today, encouraging news broke that Israel and Hamas have agreed to a cease-fire after nearly two weeks of fighting that left at least 230 Palestinians (including at least 65 children) dead in Gaza, and 12 Israels (including two children) dead on the other side. The promised pause in hostilities comes after President Biden's long-overdue pressure on Israeli Prime Minister Benjamin Netanyahu, which came after pressure from Congressional Democrats on Biden.

Republicans in Congress, meanwhile, revealed once again this week the bad faith with which they are supposedly "working" with Democrats. After the top Democrat and Republican on the Homeland Security Committee in the House negotiated a deal for the structure of an evenly partisan divided, independent commission to examine the deadly January 6th insurrection at the U.S. Capitol, the GOP minority leaders in both the House and Senate whipped their own members to reject it. Nonetheless, the House passed the resolution to create the Jan. 6 Commission on Wednesday, after some stunning and dramatic debate, with 35 Republicans joining all of the Dems to adopt the Commission. The rest of the House GOPers scoffed at the attack on the Capitol and even at the U.S. Capitol Police themselves, the very law enforcement officials who risked life and limb to protect all Congressional members on that shameful, historic day. The measure must still overcome a Republican filibuster to be adopted in the Senate, where Mitch McConnell is opposing with lies about it being "unbalanced", in hopes of protecting his party, his counterpart in the House, Kevin McCarthy, and our disgraced former President who incited the riot.

Meanwhile, back here in California, we catch up with the GOP's ongoing recall attempt of progressive Democratic Governor Gavin Newsom, whose poll numbers are on the rise, as the rates of COVID infections, deaths and positive tests are now among the lowest --- if not THE lowest --- in the nation. The CA GOP, unable to win statewide elections anymore, unless they can fool voters during a low turnout recall election, had cited Newsom's handling of the pandemic and the state's homelessness crisis as reason to unseat the first term Governor in a recall election later this year.

As our guest today, retired attorney and longtime BRAD BLOG legal analyst ERNEST A. CANNING explained in a fascinating post this week, however, a federal judge may have recently buttressed Newsom's case when it comes to his efforts on the housing crisis in the Golden State as well.

Specifically, while noting the high marks given to the Governor in the judge's ruling in the case filed by the Los Angeles Alliance for Human Rights seeking federal intervention on the homelessness crisis in L.A. City and County, U.S. District Court Judge David Carter's 110-page decision cites the real reason for, as Canning described it, "the nightmare of homelessness at the heart of a place that dares to call itself the City of Angels."

Canning explains Judge Carter's "eye-opening" historical revelations as he detailed a century of systemic racism and corruption in Southern California that has directly resulted in the crisis which now disproportionately affects African-Americans. From "racially restrictive covenants, redlining and eminent domain" used by Los Angeles "to racially segregate neighborhoods" to "Ku Klux Klan violence [that] further targeted Black families who resided in majority white neighborhoods" to sea-side property taken "from Black families and turn[ed]...into a whites-only park," the judge offered an insightful and maddening history of the horrors that have come to haunt all of us --- or, certainly should --- here in Southern California.

"There were no African Americans," says Canning, where he went to school while growing up in SoCal in the 50s and 60s. "The thing that Judge Carter reveals is that that didn't happen by happenstance. Back in 1910, 36% of African Americans were living in racially-diverse neighborhoods, and they were homeowners. In steps, the KKK, enforcement of racially restrictive covenants, redlining, and eminent domain" changed all of that. "We're not talking about Georgia or any of the former Confederate states, we're talking about Southern California."

On today's BradCast: It's nice to see hundreds of companies and corporate executives coming out in favor of democracy and voting rights. If only they actually meant it. [Audio link to full show is posted below this summary.]

First up today, however, the Biden Administration announced a spate of new sanctions against Russian organizations and individuals in response to both the massive Solar Winds hack of top U.S. agencies, including including the Treasury, Justice, Energy and Homeland Security departments, as well as for what is described as interference in the 2020 election on behalf of Donald Trump.  At the same time, the Administration seems to be going out of their way to downplay the sweeping sanctions by suggesting that they are open to top level discussions to avoid further exacerbating growing tensions between the two nations.

But one of the 32 individuals sanctioned is of note today because the announcement from the U.S. Treasury Department refers to the 2016 election, charging that the individual, Konstanin Kilimnik shared proprietary polling information given to him by Trump's first campaign manager, Paul Manafort, directly with Russian Intelligence Services.  If true, that would be significant new information. Previous reports on Russia's involvement in the 2016 election from both Special Counsel Robert Mueller and the bipartisan Senate Intelligence Committee cite the information Manafort is said to have given to his former business associate Kilimnik, a Russian and Ukrainian political operative linked to Russian intelligence. But neither of those voluminous report goes so far as to say that the data was subsequently given directly to Russian intelligence services.  Those reports acknowledge they were not able to learn what came of it after it was handed over to Kilimnik. Today's announcement of the sanctions by the Treasury, however, notes: "During the 2016 U.S. presidential election campaign, Kilimnik provided the Russian Intelligence Services with sensitive information on polling and campaign strategy."

As national security website Just Security observes: "The Treasury Department’s new statement raises questions about why this information is coming out now and why the Special Counsel’s office did not have access to it during its investigation. Was it not available then or did it exist but was not provided to the Mueller team?"   So, does this mean the Biden Administration has uncovered details on manipulation of the 2016 election that was previously hidden or withheld by the Trump Administration?  It looks like the "Clean up on Aisle 45" will be continuing for quite some time. There is a LOT to clean up.

In not entirely unrelated news, hundreds of companies and corporate CEOs issued a full-size, two-page ad in the New York Times, Washington Post and other papers this week, with a short statement purporting to declare "WE STAND FOR DEMOCRACY," and noting: "We all should feel a responsibility to defend the right to vote and to oppose any discriminatory legislation or measures that restrict or prevent any eligible voter from having an equal and fair opportunity to cast a ballot."

Though the statement doesn't mention any specific states, it was issued in response to Republicans' recently enacted voters suppression law in Georgia and dozens of other states where similar restrictions on the franchise, in bills sponsored by GOP state lawmakers, are moving forward.  All of which is said to be in response to false claims by Trump and Republicans of massive fraud in 2020.  Georgia's new law, for example, makes it more difficult to vote by mail, limits the use of drop boxes, bans the distribution of food or water on long voting lines (which are all too typical in certain parts of the Peach State) and allows the partisan GOP state legislature to replace bipartisan County Election Boards with a single partisan person who will be able to unilaterally undermine elections or even overturn results.

While statements like the one issued this week in the two-page ad --- and, before it, by Atlanta-based companies such as Coca-Cola, Delta Airlines --- have resulted in good publicity for those signed onto them, they have also brought blowback from the right, leading Republicans (who pretend to abhor so-called "cancel culture") to demand boycotts of any company which stands up for voting rights.

I have railed in recent weeks about the absurdity of Republicans finally paying attention to concerns about new voter suppression laws only now that a number of corporations have come out in apparent opposition to such laws. Corporate entities, it seems, have far more sway with the GOP lawmakers who ignored weeks of complaints and protests about the new laws from actual voters before the GA law was passed.

But our guest today is seemingly even more cynical about these recent corporate declarations of fealty to democracy. We're joined today by MICHAEL HILTZIK, Pulitzer Prize-winning journalist and business columnist at the Los Angeles Times. He argued in his column this week that many of the "vague" declarations recently by large corporations are no substitute for actual action. He cites a host of companies, for example, which, following the January 6th U.S. Capitol insurrection, vowed to suspend donations to lawmakers who had voted to overturn the Electoral College results that same day. Despite those public pronouncements, he details one company after another --- from Jet Blue to AT&T to Toyota --- which, despite their previous public claims, have since given plenty of money to dozens of Republicans who voted against the certification of Biden's Electoral College victory.

In his column, he notes that while many companies and executives have come out in opposition of suppressive voting laws, almost none have gone on record to demand the passage of measures which would counteract them, such as the John Lewis Voting Rights Act or H.R. 1, the For the People Act.

"It's not that unusual for businesses to affiliate themselves on the side of the angels when they feel a lot of popular pressure to do so.  But once again the question is, what are they going to do about it?," Hiltzik tells me today. "Let's face facts. Many of the companies --- if not all of them --- that signed on to these statements, these honeyed words, had been assiduous supporters of the politicians who are now out there introducing and passing laws that restrict the voting franchise."

Criticizing their failure to speak out before Georgia's law was adopted, for example, he says, "They didn't really put their reputations on the line when they didn't think they had to.  And, as a result, we have a law in Georgia that's going to be very hard to repeal because the more these companies come out and say this is wrong, the more the rightwing legislators who passed it are doubling down, saying 'We're not going to kowtow to these liberal leftwing corporations'.  So they lost their chance. They're trying to recover. But I don't think they really deserve a lot of credence just by signing a statement."

Moreover, he explains, many of these very same companies have been opponents of democracy within their own corporate organizations. "What's really hypocritical is that these same companies that have said 'We believe in democracy, we believe in everybody having a vote' --- they've actually gone to the Securities and Exchange Commission and asked for, and received, a tightening of the rules that makes it even harder for small shareholders to get resolutions on the annual meeting agenda, and to actually get votes on the resolutions that they submit."

There is plenty of cynicism on today's show to go around. And it extends to our discussion of the need for campaign finance reform, and several neat GOP tricks that have long been used to prevent such long-overdue efforts to keep corporations out of our elections altogether.

On today's BradCast, our lonely fight to save what is left of our public airwaves continues, as mainstream media outlets continue to benefit from --- and therefore do not bother to report on --- the march toward full corporate ownership of what were once our prized and protected airwaves. But first up today, the breaking news on that nation's latest school shooting. Today it was in Knoxville, Tennessee.

Next, the vaccination of the nation continues apace, with about 36% of adult Americans now having received at least one shot. This week, many more states will open eligibility to all adults 16 years of age and older in advance of Joe Biden's national date for doing so in all 50 states next Monday (April 19). Here in Los Angeles, all adult residents will be eligible as of Tuesday. We offer a few tips for how to get an appointment quickly. (Specifically, Kaiser-Permanente appears to have tons of available appointments, for members and non-members alike, via their website at KP.org.)

While vaccinations are proceeding at an impressive pace, hitting another 24-hour record of 4.6 million shots on Saturday, the race to outpace the spread of variants continues. While much of the nation is plateauing in case numbers at high levels or even surging slightly upward, a number of states, particularly in the Northeast and upper Midwest are surging quite steeply. The most disturbing case at the moment, by far, is in Michigan, where its Democratic Governor Gretchen Whitmer has been begging the Biden Administration for a vaccine surge in response to a spike that is as bad there as it was last Fall. For reasons that aren't entirely clear, the Administration has offered additional vaccinators and test kits, but not additional vaccine as of now. The CDC Director said on Monday that what is needed in MI's case is not more vaccine, but lockdowns. However, one of the reasons the state is in such bad shape now is because Trump-incited rightwingers last year not only rebelled against Whitmer's mandatory lockdowns, but even hatched a plot to kidnap her after Trump tweeted to "Liberate Michigan!"

What happens in Michigan, unfortunately, won't stay in Michigan. Their surge will spread elsewhere unless someone figures out how to get it under control. Similarly, what happens in Georgia will absolutely not stay in Georgia, as Republican lawmakers across the country are continuing to push voter suppression measures akin to the suppressive law adopted by Republicans in the Peach State last month.

The corporate pushback against Georgia's anti-voting law and those in other states continues to grow. Over the weekend, 100 corporate executives held a Zoom meeting to discuss how they planned to respond. On Monday, the first major Hollywood production --- Will Smith's "Emancipation" film --- previously set to film in Georgia, announced they were pulling production from the state due to the new law. Other productions could follow suit, given that Georgia has become a bit of a filmmakers Mecca by offering generous tax breaks to Hollywood production teams.

In addition to the group of corporate execs planning their own actions against anti-democracy laws, a group of some 60 law firms is reportedly teaming up to take action as well. That said, it's pathetic that the citizenry has to rely on corporations to become angry enough that Republicans might pay attention to their concerns --- the same concerns that the GOP ignored when they came from the citizenry itself before Georgia adopted its new law. In today's America, the citizenry don't seem to matter. It's corporate dollars to (or withheld from) Republicans that appears to be our only chance of convincing desperate Republicans to block or rollback these onerous restrictions on access to the ballot box. We're happy to see companies jumping in, but its absurd that we need to rely on them to somehow save "democracy".

Speaking of the need to save democracy, we're then joined by media reform activist SUE WILSON of the Media Action Center. Late last year, she and former Republican FCC official Art Belendiuk joined us on the program to discuss actions they were taking to expose the fact that rightwing media behemoth Sinclair Broadcasting appeared to be blatantly violating FCC ownership rules by taking secret ownership of more than one television station in a number of major markets, using sham front companies to skirt federal scrutiny.

At the same time, as Wilson reports today at BradBlog.com, the FCC has been attempting to change its own media ownership rules to allow for more corporate consolidation by granting major broadcasters the right to own more than one TV station in any given market. The FCC's initial attempt to change the rule preventing companies from controlling all of the public airwaves in major markets was blocked by the 3rd Circuit U.S. Court of Appeals, which found that the FCC violated the Administrative Procedures Act in not carrying out proper studies to determine the effects of the rule change on broadcast outlets owned by women and minorities. SCOTUS heard the FCC's appeal in the case on January 19th (Trump's last full day in office). The Court handed down its decision in FCC v. Prometheus Radio Project on April 1, overturning the lower court to allow the FCC's new, relaxed ownership rule, even as Justice Kavanaugh, in his opinion for the unanimous Court, conceded that the record evidence relied on by the FCC was "sparse". But, he held on behalf of the Court, the rules in question, now changed by the FCC, "were no longer necessary to serve the agency's public interest goals."

As Wilson found, however, the reason the record was so sparse was because the FCC had carried out no studies of its own to determine the adverse effect of consolidation on minority owned business before formalizing their new rules. They relied instead on private organizations to present evidence as to why the consolidation would harm minority broadcasters. But private organizations did not have access to much of the FCC's public information, because the federal agency hasn't collected the information from stations around the country.

It all amounts to what Wilson describes as a Catch-22 that ill-serves the public, and further undermines our public airwaves, handing off even more control to corporate interests, rather than we, the people. "This is the worst decision that nobody knows about," Wilson tells me. And, of course, they don't know about it, because mainstream corporate broadcasters benefits from the rule change, so they haven't bothered to mention much about it to any of their listeners or viewers.

Wilson argues that Congress needs to take action, and asks listeners to contact their members of Congress. "We're finding that Republicans and Democrats are very interested in this [because] this is bad for our whole country."

Finally, we open up the phones for a few quick minutes today, to hear from listeners on both the FCC's latest boondoggle and with more thoughts on vaccination nation...

We have several fairly stunning plot twists to try and make sense of on today's BradCast, as Democrats hit a potential legislative jackpot in the U.S. Senate and Republicans pretend to turn against big business while actually turning against small government. Among the many stories covered on today's twisted up program...

• President Biden moves up the date for vaccine eligibility to all Americans by two weeks, announcing that everyone in the U.S., 16 and older, will be eligible to sign up for COVID-19 shots by April 19th. That, as the race against new, deadlier variants --- and the premature easing of safety restrictions --- continues.

• Florida's civil rights champion and 15-term Democratic Congressman Alcee Hastings passes away at age 84 after a battle with pancreatic cancer, further narrowing, for now, the Democrats' already-narrow majority in the U.S. House. That, as...

• Huge new legislative possibilities were opened for Democrats by the Senate Parliamentarian on Monday night. As we briefly explained last week (and in more detail on today's show), an obscure provision in the Budget Act of 1974 will allow Dems to "revise" their Budget Reconciliation bills, allowing them to pass new measures under arcane Senate rules that permit certain budget-related measures to be adopted by a simple majority vote. Democrats already knew they had two opportunities to do that this year --- and avoid the GOP filibuster against all of their proposals --- with budgets for fiscal year 2021 (since Republicans failed to pass one last year when they had control of the upper chamber) and for fiscal year 2022. Biden's COVID relief and stimulus bill, the $1.9 trillion American Rescue Plan, was adopted under the FY 2021 budget reconciliation provision and his $2.25 trillion infrastructure, jobs and climate proposal, the American Jobs Plan, was previously targeted for passage under FY 2022's budget reconciliation. But, after inquiry by Senate Majority Leader Chuck Schumer as to whether a little-known or used provision of the Budget Act would allow more such bills to be adopted as "revisions" to both of those budget reconciliation packages, the Senate Parliamentarian has reportedly given her okay. That means that the American Jobs Plan can be adopted as a "revision" to the 2021 budget, and a previously unimagined set of possibilities has suddenly emerged for the 2022 plan or even additional revisions to 2021. There are some caveats --- as we discuss --- but, as wonky as all of it sounds, it is wildly good news for Democrats.

• That good news for Dems is, of course, more bad news for a Republican Party drifting farther and farther away from both reality and their own supposedly long-held governing values --- at least the ones they pretended to have. Each passing day makes it clear that the GOP is adrift without any actual legislative agenda or principles at all. Senate Minority Leader Mitch McConnell, who has long championed unlimited (and even undisclosed) corporate money in elections and politics, issued a statement on Monday pretending to be outraged by dozens of corporations speaking out democracy and against the voter suppression bill adopted by Republicans in Georgia last week.

• But while Repubs in D.C. are trying on their new, "populist", "anti-corporate" costumes for a post-Trump era, GOPers in state legislatures across the country are still snuggling up with huge corporate interests in the fossil fuel industry to adopt legislation at the state level making it illegal for local towns and cities to ban the use of fossil fuels. Georgia is just the latest of dozens of states where this is happening right now. Among the states where efforts exactly like this are underway or already in place: Arizona, Arkansas, Colorado, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Louisiana Mississippi, Missouri, North Carolina, Ohio, Oklahoma, Pennsylvania, Texas, and Utah

  And, if you're keeping score at home, that means the adrift Republican Party now claims to oppose corporate free expression in politics (they don't really) and are against local government decision making (they always have been, at least when small, local governments disagree with the GOP's corporate paymasters). Told you everything was twisted today! Or, as Desi Doyen smartly observes at one point: "It's not logical. It's political."

• Finally, Desi's got our latest Green News Report, as failing infrastructure near Tampa, Florida is posing a huge, toxic crisis to local residents and wildlife; the Biden Administration pushes back against Republicans who pretend they don't know what infrastructure is; troubling new confirmation of climate change in Japan; and some very good news for a town with very bad air in Massachusetts...

If we can look both forward and back at the same time on The BradCast, so can the Biden Administration. (Hint, hint, Merrick Garland.) But the Administration is certainly looking forward today, and not a moment too soon, with the introduction of Joe Biden's $2 trillion American Jobs Act proposal. [Audio link to full show is posted below summary.]

But first, we look "back" at the continuing disaster left behind by the previous guy's lies about a "stolen" election. Two U.S. Capitol Police officers have now filed a lawsuit against Donald Trump for his incitement of the January 6th insurrection which, according to the complaint, has left both men struggling to cope with long term physical and psychological issues. The suit follows on the heels of two others filed by two different members of Congress, Reps. Bennie Thompson of Mississippi and Eric Swalwell of California.

In somewhat related "looking back" news today, the legal team representing Dominion Voting Systems is reportedly beefing up its team of defamation attorneys after filing $1.3 billion complaints earlier this year against Trump Attorneys Rudy Giuliani and Sidney Powell, MyPillow CEO Mike Lindell and, last Friday, a new $1.6 billion defamation suit against Fox "News". (That one follows on a separate $2.7 billion suit filed against Fox by another voting machine company, Smartmatic, which doesn't even do business in any of the states contested by Trump's MAGA Mob.) All of the Dominion suits allege the voting system company was defamed by evidence-free claims that their software somehow flipped votes from Trump to Biden. The new attorneys said to be joining Dominion's legal team buttress reporting that additional rightwing media outlets, such as NewsmaxTV and One America News, may soon be sued as well. Moreover, the Dominion legal team has suggested in several instances that they have not ruled out a suit against the Big Liar himself.

Then, we finally get to look forward today with the introduction of Biden's sweeping, much-anticipated infrastructure, jobs and climate proposal, now officially named the American Jobs Plan, echoing the name of his wildly popular and progressive $1.9 trillion American Rescue Plan, signed into law this month to speed relief and stimulus to Americans slammed by the COVID pandemic.

The new AJP proposal is a $2 trillion package, promising to create millions of good-paying jobs through massive and long-overdue public works projects to shore up the nation's crumbling roads, bridges, airports, water systems and electrical grid, while investing in efforts to remove lead pipes from homes and lead exposure in hundreds of thousands of schools.

Crucially, it would also invest hundreds of billions in electric vehicle manufacturing and charging stations, cap hundreds of thousands of uncapped fossil fuel wells, while ending fossil fuel industry subsidies and offering billions in renewable energy tax credits. It would also "build back better" by hardening much of our nation's infrastructure to better handle our worsening climate crisis. Much of the package would be paid for by an increase in corporate tax rates that reverse unpaid-for tax cuts by Trump and the GOP in 2017.

That, of course, is a very slim summary of the expansive proposal introduced on Wednesday in Pittsburgh by the President. But, why is it only a $2 trillion package when we had previously been told to expect a $3 or even $4 trillion proposal?

Our guest today, financial journalist, author and Executive Editor of The American Prospect, DAVID DAYEN reports that the proposal is being split into two separate packages. "This is the first half of apparently a two-part sequence," he explains. "This has most of the physical infrastructure investments. I would call this more of a public investment bill, rather than infrastructure bill. But this has the physical investments and then the second half is really the care infrastructure --- the care investments on health care, on paid family leave, on community colleges and things like that."

The plan is likely to change a great deal as it moves toward hopeful passage in Congress. Some Progressive Democrats feel it doesn't currently go far enough to meet the scale of the threat posed by climate change. Some conservative Dems are worried about spending too much money. And, of course, Republicans have no interest in passing any bills proposed by Democratic Presidents, no matter how much it will help their own constituents, even with projects they'd long supported.

"Spending of this type, which is public investment, pays for itself many, many times over," Dayen argues. "It does that just by the virtue of greater efficiency [and] averting risk. When we make all of these climate investments, we then have the opportunity to not have to spend hundreds of billions and trillions of dollars on damages from catastrophic weather events and things like that."

We discuss what it may take to get the broad Democratic caucus in Congress all on the same page, and the likelihood that many elements of the second part of the package may end up being combined with the first, in the event that Chuck Schumer's hopes of additional Budget Reconciliation packages this year (which allow passage with a simple majority vote, rather than needing to overcome a GOP filibuster), are blocked by the Senate Parliamentarian --- or, if Democrats become concerned that items planned for the second package may fall to the wayside if Biden's agenda loses steam on Capitol Hill.

On today's BradCast: More evidence that the rightwing billionaire Koch network really needs a better security plan. And Republicans really need a more popular agenda. [Audio link to show follows summary below.]

We now have still more audio that has leaked out of a super-secret Koch Network event. The latest is embarrassing yet again for them, as it reveals that even Republican voters want corrupting "dark money" out of politics. Sorry, Koch folks like Mitch McConnell and all of the other elected GOPers who owe their corrupt careers (and votes in Congress) to whatever it is that the Koch Network wants from them! Looks like they'll need to rely on out-and-out lies about what is actually in the Democrats' popular election and campaign finance reform bill known as H.R.1 (the For the People Act) in order to undermine it. But they've become very good at that sort of thing by now.

On Monday, The New Yorker's Jane Mayer published a story about audio she obtained from a super-secret conference call in which the guy running a Koch-backed effort to figure out how to message against H.R.1 concedes that even "conservative" voters appear to like the proposal, which includes disclosure requirements for donations larger than $10,000 to "dark money" non-profit groups like the dozens of "non-partisan" groups run and funded by billionaire donors to the Koch Network.

As Mayer reports: "The speakers on the call expressed alarm at the broad popularity of the bill's provision calling for more public disclosure about secret political donors. The participants conceded that the bill, which would stem the flow of dark money from such political donors as the billionaire oil magnate Charles Koch, was so popular that it wasn't worth trying to mount a public-advocacy campaign to shift opinion. Instead, a senior Koch operative said that opponents would be better off ignoring the will of American voters and trying to kill the bill in Congress."

The research director for a Koch-run advocacy group is heard explaining on the call, which reportedly included a partisan representative from McConnell's office, that when even "conservative" voters hear that the legislation "stops billionaires from buying elections," they support it. "Unfortunately," he tells the group somewhat sheepishly, "we've found that that is a winning message, for both the general public and also conservatives."

We share the full audio disclosed by Mayer on today's program. (And, since I referenced it it today, here's a link to my 2011 exposé of the Koch Brothers' super-secret billionaire confab at a resort near Vail, CO. The first, to my knowledge, to include audio from one of the group's meetings. The several-part exposé I published at Mother Jones and at The BRAD BLOG at the time included audio I obtained revealing the undisclosed keynote speech by NJ's then Gov. Chris Christie, as well as remarks from Charles Koch and others at the highly secured --- but not highly enough secured --- event.)

Also today, Axios reports that economists are very excited about the approximately $3 trillion infrastructure, jobs and, yes, climate plan that Joe Biden is set to roll out in Pittsburgh on Wednesday. He previewed a bit of that plan during his press conference last week. The plan, in theory, will create millions of new, high paying jobs repairing, improving and building roads, bridges, electrical grids and other infrastructure that has been dilapidating for years, while hardening it all for climate resilience in a dangerously warming world. The Koch Network and Congressional Republicans are likely to have a hard time messaging against that long-overdue proposal as well. But we'll find out as much after Biden introduces the plan tomorrow.

Then, a bit of a follow-up to my conversation with Caren Short, Senior Voting Rights Attorney at the Southern Poverty Law Center (SPLC) on Monday's show, about Georgia's sweeping new voter suppression bill. Yesterday, I had asked Short whether SPLC was planning to join either of the so-far two different lawsuits filed by civil rights groups just after the controversial GOP measure was passed by both houses in the state legislature and signed by Republican Gov. Brian Kemp last Thursday, all within a 7-hour time span. She told me the group was looking closely at the suits, but had made no decision yet. Today, SPLC touched base with the news announcing a third suit [PDF] now filed in federal court against the GA law. This one has been filed by the Southern Poverty Law Center, the ACLU, the NAACP Legal Defense and Education Fund and others on behalf of several Black, Latino and Muslim organizations in the Peach State.
