On today's BradCast: As the White House implosion continues at the end of one of its most chaotic weeks to date, Trump declares a trade war! [Audio link to show is posted below.]

Well, huge tariffs on imported steel and aluminum, anyway, (those are taxes on the American people, Mr. President), which will almost certainly lead to international trade wars with friend and foes alike, raise the cost of many consumer goods and, yes, kill American jobs.

The proposed tariff scheme has already led to an internal White House war with Trump's lead economic advisor threatening to resign if they are implemented, Congressional Republicans furious about the plan, close allies such as Canada and the EU threatening to retaliate against the U.S., the entirety of the fossil fuel industry (from oil to natural gas to coal) declaring that jobs will be lost and prices will rise, and even Trump's own Defense Secretary advising that the measure, which President Chaos is hoping to pull off on "national security" grounds, will have a "negative impact on our key allies". Other than that, the idea is going over very well.

At the same time, there was another school shooting by a 19-year old on Friday, this time at Central Michigan University; Texas sees huge early voting turnout in advance of Tuesday's 2018 mid-term primary elections (even beating turnout for the 2016 Presidential primaries!); New polling finds the Affordable Care Act (Obamacare) and Medicaid with record high approval ratings; and the state of Georgia is finally moving away from their 14-year old 100% unverifiable Diebold touch-screen voting systems...to new, similarly unverifiable computer-printed "paper ballot" systems.

(The GA legislature is moving a measure forward to fund new "Ballot Marking Devices" or "BMDs", which are, essentially, very expensive computerized "electronic pencils" that allow voters to use a touch-screen to print out a non-human readable barcode on a piece of paper, which is then tallied by a computer scanner. Or, the computer may print human-readable vote selections on paper which may or may not actually be verified by the voter to reflect their intent before being tallied by a computer. After an election, it'll be impossible to know if any of those so-called ballot cards actually reflect voter intent. That's why election integrity advocates oppose the new "bad to worse" scheme quickly moving forward in GA!)

Then, Desi Doyen joins us for the latest Green News Report as Trump's EPA chief Scott Pruitt cites the bible as his excuse for polluting the planet and killing children with fossil fuel exploitation and dangerous chemicals. (Hope Pope Francis doesn't find out!)

On today's BradCast: Democrats appear confident that they are heading toward a "Blue Wave" election in the 2018 mid-terms. Then again, they were also confident they'd soundly defeat Donald Trump for the Presidency in 2016. And the progressive/establishment rift that developed during the party's 2016 primary has, apparently, not gone away. [Audio link for show follows below.]

But first up today, the President's son-in-law and top adviser, Jared Kushner has reportedly lost his Top Secret/SCI-level security clearance, along with a bunch of other White House staffers, after failing to receive a permanent security clearance in the more-than-a-year since he's been serving.

Next, with one disturbing sex (and hypocrisy) scandal after another plaguing Republican candidates for office (as well as the President of the United States), we add several more such scandals to the list today. Among them, a GOP U.S. House candidate in Pennsylvania whose husband says she threatened to kill him in a drunken rage. That, after the woman was revealed to have had an affair with married GOP Congressman Tim Murphy in a neighboring PA district. After text messages revealed he advised her to get an abortion, he eventually resigned from the House last year.

Then there's the Republican candidate for Illinois' state Legislature who is said to have asked the party's leading state Attorney General candidate recently whether she was a "lesbo", before repeatedly using the n-word in front of the woman who happens to be a Harvard Law grad and former Miss America, as well as an African-American.

And, let's not forget the minister in Arizona running in the GOP primary today for the Special Election to take the disgraced GOP Rep. Trent Franks' vacated seat. After the far right Franks resigned from Congress last year following his own sexual misconduct allegations, former AZ State Senator and family values minister Steve Montenegro led the pack of some 18 GOPers vying for the nomination in the very right-wing Congressional district west of Phoenix --- at least until salacious text messages with a legislative staffer were surfaced just days ago.

So, yes, the Republicans have a lot of problems with their candidates of late, but Democrats are having a lot of problems with each other. The turmoil between the party's aging conservative establishment wing and its growing progressive wing have now begun to rear its ugly head again, after the intraparty rift that grew out of the 2016 Presidential primary between Hillary Clinton and Bernie Sanders.

Late last week the conservative Democratic Congressional Campaign Committee (DCCC) unleashed a remarkable attack against Laura Moser, one of the more progressive Democratic candidates, among eight, vying for the party's nomination in next Tuesday's U.S. House primary contest in the Texas' 7th Congressional District near Houston. And, over the weekend, the delegates at the annual California Democratic Party convention failed to endorse 4-term U.S. Senator Dianne Feinstein in her reelection bid, where she is being challenged by progressive state Senate leader Kevin de León. De León received 54% of the delegate votes to Feinstein's 37%. Neither reached the 60% required for an official state party endorsement.

We're joined today to discuss all of this from the Democratic side --- as the primary season finally gets officially underway --- by progressive advocate and Congressional elections expert HOWIE KLEIN, creator of the Down With Tyranny! blog and co-founder of the BlueAmericaPAC, which supports progressive candidates with small personal donations.

Klein (whose BlueAmericaPAC supports a different progressive in the race, Dr. Jason Westin) explains the DCCC's stunning attack on Moser in Texas late last week, while warning that there are many more such attacks to come against progressive candidates this year by the conservative DCCC. "They always, 100% of the time, support conservatives from the Republican wing of the Democratic Party," he charges. "That's what they do. They always try to undercut progressives."

"They're not more likely to win. The only time they can win is in a wave election," Klein argues, while responding to the DCCC's defense that they are only favoring candidates more likely to defeat Republicans this November. "The problem with these DCCC candidates is that they can't hold the seats. They get defeated in the next midterm. And that happens over and over and over again, and the DCCC can't understand that."

Klein also speaks to what he sees as both the reason for and solution to the DCCC's right-wing bent --- (for which he blames Democratic Congressional leader Nancy Pelosi who "used to be a progressive") --- and whether bitterly divided Democratic voters will find a way to come together this year once the primaries are over, in order to retake majorities in one or both houses of Congress.

He describes the current rift as an in "important ideological fight," and claims, "It's not a split between Bernie people and Hillary people in any way. It's an ideological battle of people who believe in what Franklin and Eleanor Roosevelt believed in, as opposed to people who are conservative Democrats who are frightened and afraid of innovation."

Speaking of which, Klein then offers his thoughts on why California's progressive Democrats are turning on the conservative Feinstein this year and how that may effect the 84-year old Senator's hopes of winning a 5th term in November. Related to that point, we also discuss the unpredictable "top two" primary system now used in California, where candidates from all parties run at the same time against each other, before the top two vote-getters --- from either the same or different parties --- then go on to compete head-to-head in November's general election...

On today's BradCast, students are mad as hell, for a lot of very good reasons, and now they are taking things into their own hands, not a moment too soon, by threatening to vote. Where Republicans appear to have little interest in helping them, Democrats certainly can and should, but they'll need to step up with a clear, progressive agenda to do exactly that in advance of the 2018 mid-terms. First up today, there was another Special Election on Tuesday in another deep "red" district, this time in rural Kentucky, where Democrats picked up their 37th "red-to-blue" state legislative flip since the 2016 Presidential election. The GOP believes the "odd" circumstances around this particularly election make it an outlier (the Republican preacher who held the seat killed himself in December, following allegations of sexual misconduct with a 17-year old), and show little concern that Democrat Linda Belcher reportedly defeated her Republican opponent by some 36 points in a district that went to Trump in 2016 by 49 points. (That's a huge 86 point swing towards the Democrats, for those keeping score at home!)

Meanwhile, high school students across the country walked out of class on Wednesday to hit the streets in a call for gun safety legislation following last week's school shooting massacre in Parkland, Florida. Students from Marjory Stoneman Douglas High School pressed lawmakers at the Florida statehouse in Tallahassee, where Republicans quickly voted to shelve the possibility for any major gun reform before the end of the legislation session early early next month. At the nation's capitol in D.C., among other places, students also marched and promised to vote out legislators who clung to support from the NRA while rejecting calls to reform our nation's permissive and deadly gun laws.

But while Democrats, in this environment, would seem well positioned to take over the U.S. House in this year's mid-terms, a recent series of Dem-sponsored focus groups reportedly finds voters complaining that while "Republicans have the wrong agenda, Democrats have no agenda."

We're joined today by ERIC LEVITZ, Associate Editor of the Daily Intelligencer blog at New York Magazine, to discuss that problem, by way of his recent article highlighting a new research paper [PDF] from the Levy Economics Institute at Bard College. The authors of the report found that, rather than blow a $1.5 trillion hole in the national debt with tax cuts for corporations and the wealthy, as recently passed by the Republican Party, we could have completely wiped out every penny of the nation's collective and sky-rocketing student debt for the same or less cost. And that money, as Levitz reports, would have "benefited all Americans by increasing economic growth and lowering unemployment" by allowing young Americans to purchase new homes, cars and make other investments which would also help to raise middle-class wages.

Levitz describes the student loan debt as a real "crisis", which has spiraled wildly out of control since the 1990s. "You've got 44 million people saddled with these debts, and that's limiting their ability to participate in the economy. All of these wages that would be going into local businesses, and circulating throughout the economy, and creating markets and stimulating demand is going to either private lenders or actually the government," he argues, charging that the government could "just completely eliminate all that debt, which just so happens to be roughly the same price as the GOP tax cuts."

In another crazy idea cited by Levitz, the federal government could offer free tuition to public colleges and universities for the same cost we currently spend on grants and tax breaks for students, without saddling them with debt for decades. That's right, it would cost the federal government zero dollars to make tuition free at our public colleges and universities.

Isn't it time Democratic officials and candidates told voters what they are for, instead of only how much they are against Donald Trump and the Republican Party, by spelling out a clear, forward-thinking progressive agenda for the future? Just asking for a friend.

On that, however, Levitz does see some reason for some optimism in the spate of 2020 Democratic Presidential hopefuls who are finally embracing progressive ideals like healthcare-for-all legislation and even vowing to reject "dark money" from corporate PACs. (Oh, and here's Levitz' excellent article about Donald Trump's obscenely hypocritical plan to have Big Government tell poor people what they can eat, which I only had time to quickly reference on today's show.)

Finally today, a bit more encouraging news on the gun legislation front, as a Parkland father who lost his daughter in the shooting last week faces off at the White House with Donald Trump, and as a major GOP donor says he will not give one more penny to any politicians who fail to support a ban on military-style assault weapons...

• In a surprise reversal, some good news to start off, as Donald Trump's EPA Administrator Scott Pruitt puts the brakes on a huge, dangerous, proposed Canadian mining project in Alaska's pristine Bristol Bay watershed;
• In a weekend interview, Trump once again made clear he knows nothing at all about climate science (beyond what they told him about it on Fox "News) and doesn't care to learn. Desi Doyen joins us to correct at least some of the misinformation offered by the President of the United States' embarrassing comments to Piers Morgan;
• Former Colorado Republican Party Chair and rightwing radio host Steve Curtis (pictured above) was found guilty of forgery and voter fraud in the 2016 Presidential election last year, after claiming on air, just before the election, that only Democrats commit voter fraud and they should be prevented from voting at all. On Friday, he was sentenced to four years of probation and community service, even as he claims he didn't know that voting his ex-wife's absentee ballot was unlawful. ("He knew exactly what he was doing," the prosecutor argued during the trial's closing arguments. "He received it in the mail, opened it, voted, signed it, sealed it back up and sent it in." All in his wife's name. She had moved out 11 months earlier.)
• We then contrast the white Republican Curtis' lenient sentence for voter fraud to that of a Mexican national who came here as an infant, has long been a permanent US resident with four U.S. citizen children, but was sentenced last year to 8 years in federal prison and likely deportation thereafter for unlawfully voting. She thought she was allowed to do so as a permanent US resident;
• On the encouraging side of election and voting rights news today, however, the North Carolina Supreme Court on Friday sided with the state's new Democratic governor, and effectively reversed a years-long effort by the state's Republican legislature to roll back many voting rights in the key swing-state.

And, with all of that, we then open our phone lines to all sorts of interesting listener calls, including one caller (one of our favorites) who argues that progressives should mount write-in campaigns to take on corporatist Dems, (we debate whether doing that or primarying such Dems is the smarter route to take), and another right-wing caller who pretends to have no idea how Photo ID voting restrictions suppress the legal votes of minorities --- or he simply doesn't care. (He also revealed himself to be a climate change denier, what a surprise, as the call turned quickly South)...

On today's BradCast, we're still fighting for the right to vote and to have that vote counted, 60 years after MLK's "Give Us the Ballot" speech, 50 years after the passage of the hard-won Voting Rights Act, 4 years after the U.S. Supreme Court gutted it, and one day after what my guest today describes as a "really wicked decision" by the Court on Thursday to set aside a landmark ruling on gerrymandering that was meant to finally correct a grave injustice to voters in 2018. [Audio link to full show follows below.]

With Republicans in the U.S. House, on Thursday, having passed a short-term stopgap spending bill to keep the U.S. Government from shutting down beginning on Friday night at midnight, Republicans in the U.S. Senate are still racing to figure out how to overcome a filibuster of the same bill. The measure includes support for kids that rely on the currently-expired Children's Healthcare Insurance Program (CHIP), but leaves some 800,000 kids of immigrants who came here with their parents still facing deportation as early as March, after Trump ended Obama's Deferred Action for Childhood Arrivals (DACA) program. So, once again, rather than simply including a fix to DACA, Republicans are using children as human shields to try and force Democrats to vote with them for a short-term bill to avoid a shutdown of the federal government. It would be the first such shutdown in U.S. history while the House, Senate and White House are all controlled by the same party.

Sick of this sort of BS? If so, you can theoretically do something about it this year at the ballot box. But the GOP's stolen U.S. Supreme Court isn't making it easy. On Thursday, SCOTUS stayed a landmark ruling by a lower federal court panel that had ordered North Carolina to immediately redraw the state's U.S. House district maps, since the Republican majority legislature admitted that they, unconstitutionally, drew them to ensure a Republican advantage. Though it's largely a 50/50 state, NC Republicans hold 10 seats in the U.S. House to the Democrats' 3.

That's just one of the ways that Republicans hope to keep cheating voters this year in order to hang on to power as the mid-terms approach. Another way was through Trump's discredited and now disbanded "Presidential Advisory Commission on Election Integrity", run by the GOP "voter fraud" fraudster and Kansas Sec. of State Kris Kobach. He had hoped to use the Commission to make it harder (for certain people) to vote, but he faced yet another embarrassment in court this week. When Kobach's Commission was originally shut down a week or two ago, there was a cry from voting rights advocates for a national committee to study and call out the real scourge of American democracy: voter suppression.

That call may have been answered this week with the formation of the non-partisan National Commission for Voter Justice, co-chaired by my guest today, BARBARA ARNWINE, former longtime Executive Director of the Lawyer's Committee for Civil Rights Under Law and now President and Founder of the Transformative Justice Coalition. Arnwine explains the new Commission's mission, responds to the "wicked" SCOTUS ruling on NC maps and other recent voting rights issues, and details many of the threats to democracy that must be overcome in 2018, more than sixty years after, as she and John Nichols note at The Nation this week, Martin Luther King, Jr. delivered his landmark "Give Us the Ballot" address on the steps of the Lincoln Memorial in 1957.

"We gotta remember, we are looking at the Roberts Court. This is a man who made his life ambition the evisceration and the weakening of the Voting Rights Act. In fact, if he had had his way, there wouldn't be a Voting Rights Act, as he wrote many, many years ago," Arnwine says in response to the SCOTUS stay on the NC redistricting ruling and a similar one in Texas. "They are fine with these kinds of schemes --- gerrymandering and other devices and tactics that deny people the right to vote --- because they believe in their hearts that the result is fair, it's a result that they want, and it's a result that puts people into power that they favor. And that's wrong."

"We believe that democracy should be for every single voter. That's why we created the National Commission for Voter Justice, because every voter should have the right to be able to vote and to have their vote counted," the animated Arnwine explains. "Democracy should always be about a competition of ideas, a competition of the best candidates, and then the people make their choices. Politicians should never pick who their constituents are. The constituents should pick the politicians. We are in a reverse democracy right now."

It has, sadly, been that way for a while. I recalled today, while prepping for the show, that Arnwine and I were on a National Public Radio show back in 2008, facing off against the notorious GOP "voter fraud" fraudster Hans von Spakovsky, who, I suspect, was very used to getting away with his lies before that show. I also recall Arnwine's testimony to the Baker/Carter Commission on Voting Rights which was a panel created by Republican Party vote suppressors in 2005 to push for Photo ID voting restrictions. In comparison to the Trump/Kobach Commission, however, that panel was blue ribbon! The fight for democracy is never ending, it seems.

"Democracy is never permanent. It requires vigilance. It requires engagement. It requires organizations to monitor, to advocate for it," Arnwine tells me. "But it shouldn't be as bad as it is in the United States. That's the problem. The problem is that even with the fact that you've got to constantly seek it, it shouldn't be this bad. We should not have millions upon millions of voters finding themselves blocked from the polling booth. We shouldn't have three-hour lines. We shouldn't have machinery that everybody knows is worthless."

"But that's why the National Commission for Voter Justice is going to be coming to every area where we can," she says. "We're going to have over 20 hearings around the country, so that we can hear directly from voters what they are encountering, what their experiences are and, more importantly, what some of the solutions are, helping people to advocate for those changes."

Among the stories covered on today's extremely busy program...

• Late updates on the devastating mud-flows that have, so far, resulted in the deaths of 17 in Southern California's Santa Barbara County, just north of Los Angeles, following a massive rainfall this week in the area just burned by the largest fire in state history;
• A federal judge has temporarily blocked Donald Trump's attempt to lift the DACA program, which has protected some 800,000 children of immigrants who came here with their parents through no fault of their own;
• Just days after announcing their intention to open 90% of U.S. coastline to off-shore drilling, Trump's Dept. of Interior chief Ryan Zinke reverses course, but only for the state of Florida, in what appears to be a political (and unlawful) favor to Florida's Governor Rick Scott, who Trump is supporting in a run for the U.S. Senate;

In election and voting news today...

• Just minutes before Virginia's House of Delegates convened its new legislative session today, Democrat Shelly Simonds conceded her 94th District race against Republican David Yancey without seeking the second "recount" she is entitled to by state law. The first "recount" resulted in a declared "tie" vote and a random drawing, following a very questionable ballot [JPG] counted for the Republican after the initial "recount" had handed the victory to Simonds by a single vote. (She could still ask for a recount as late as the 17th, if she and the Democratic Party wise up and changes their minds. Republicans absolutely would have demanded such a count had the random drawing gone the other way. They would also have prevented her from being seated until that count was completed. Moreover, I share some disturbing comments from a conversation about all of this with the Voter Registrar who oversaw the election in Newport News, VA.)
• In the 28th District race for Virginia's House, an appeals court denied the Democrats emergency motion for a new election today, after the Republican was declared the winner by 73 votes even though 147 voters were given the wrong ballot on Election Day last November. (With both of those Dems out, the GOP majority in the VA House has shrunk from 66-34 last session, to just 51-49 as of today, despite Democrats winning 55% of the vote statewide in the Republican gerrymandered state);
• In North Carolina, a federal court panel issued a landmark and blistering ruling on Tuesday night, finding state Republicans had blatantly gerrymandered the swing-state's U.S. House Districts on a partisan bases to ensure a 10 to 3 majority for themselves, in what the panel found to be a violation of the Constitution's Equal Protection Clause. The court ordered new Congressional maps to be drawn up immediately, in the next two weeks, in time for the 2018 primaries. But Republicans vow to appeal the ruling to the U.S. Supreme Court, which is currently deciding a separate but very similar case on partisan gerrymandering of state legislative districts by Wisconsin Republicans.
• And today, a divided (and stolen by the GOP) U.S. Supreme Court heard oral argument in a case challenging Ohio Secretary of State John Husted's scheme to purge voter rolls after voters have gone just two years without voting in a federal election, in what Democrats and voting rights advocates argue is a violation of the National Voter Registration Act (NVRA).

Finally today...

• Trump's Energy Secretary and former Texas Governor Rick Perry sees his scheme to extend the life of coal and nuclear plants under the false guise of "grid resiliency" go up in smoke after all of the appointees on the Federal Energy Regulatory Commission (FERC), most of whom were appointed by Trump, unanimously reject the plan, which was seen as a payoff to a coal baron benefactor of both Perry and Trump. A former Trump Campaign official, however, sees a far more insidious (and laughable) conspiracy.

On today's BradCast, I’m happy to sit in for Brad again with a holiday offering and a former Vice President of the United States. [Audio link posted below.]

As the latest blob of crap --- the new tax law --- floats out of Congress and the White House, how about a change of pace: a little hope? Not fairy-tale and pixie-dust hope, but realistic ideas for tackling former VICE PRESIDENT AL GORE tells me is the biggest challenge ever to face the human race: global warming, aka climate change.

The former Veep is also founder and chair of The Climate Reality Project. Eleven years after the original Inconvenient Truth film and book comes his latest, An Inconvenient Sequel: Truth to Power. I spent an hour on stage with Gore for my own show, In Deep with Angie Coiro, talking about both the book and its companion documentary.

It seems the right note to strike here on The BradCast as well, when everything is pretty damned bleak. Gore is a walking lesson in how to realistically assess our situation, then push forward with what can be changed. As he says, change can take longer than you expect, then suddenly come faster (and better) than you hoped.

According to my guest on today's BradCast, last minute GOP maneuvering on the U.S. Senate versions of the tax bill, in hopes of buying off holdouts within their own caucus, definitively proves that so-called 'trickle-down' economic theory doesn't actually work --- and that Republicans know it. [Audio link to show follows below.]

But first up on today's show, U.S. House Minority Leader Nancy Pelosi (D-CA) calls for long-serving Democratic Rep. John Conyers of Michigan to resign in the wake of sexual misconduct allegations by a series of women, and long-serving Republican Rep. Joe Barton of Texas announces he will not run for re-election, after admitting to sexual misconduct with a series of women.

Those are just two of a flood of powerful men in politics, entertainment and journalism to be called out of late. However, how many women are still facing sexual assault and harassment from men who aren't as high-profile and, therefore, not being exposed by the mainstream media? And, how many others, even powerful ones like President Donald Trump and, perhaps, Alabama's Republican U.S. Senate nominee Roy Moore --- whose poll numbers are back up over Democrat Doug Jones in advance of the Dec. 12th U.S. Senate special election, even after multiple allegations of sexual assault with under-aged girls --- still get away without any accountability at all? We discuss.

Then, while Republicans claim their massive $1.5 trillion tax cut scheme for corporations and the wealthy (and tax increases for most everyone else) will magically pay for itself, history and all independent analysis suggest otherwise. So does evidence from large corporations, most of which indicates that companies have no plans to use their expected windfall profits from tax cuts to increase employment or raise worker wages.

With that in mind, in order to get the massive tax measure passed at all, some Republicans in the U.S. Senate are demanding a 'trigger' in the legislation that would automatically kick in to reverse some of the tax cuts if the GOP and Trump Administration's rosy scenarios that tax cuts pay for themselves do not actually come to pass.

We're joined today by financial journalist DAVID DAYEN who explains why such a trigger is the GOP's worst idea yet for their already terrible scheme. "You could let monkeys bang on typewriters for several millennia and not come up with an idea as profoundly stupid," he reports at The Nation this week.

The result, he tells me, would be that taxes would potentially be automatically increased and/or spending reduced, at the worse possible moment for doing so. "Austerity in the midst of an economic slowdown is economic suicide. It would intentionally destabilize the economy if it slowed down. It would turn recessions into depression," he warns. "I cannot stress enough how stupid this idea is."

He also notes how opposition to such a trigger from so-called "conservatives"-- other members of the Senate, as well as right-wing advocacy groups like the Koch Brothers' Americans for Prosperity, Grover Norquist’s Americans for Tax Reform and the US Chamber of Commerce --- "gives the game away" that 'trickle-down', and this bill as a whole, are all "all a scam"...and Republicans know it.

Please tune in for another very insightful conversation with Dayen, revealing just how hypocritical, dangerous and misleading the entire scam is, how much it will cost the American people in real terms, whether the GOP and Trump will be able to get it passed at all, and how the American electorate are likely to react if so, in 2018 and beyond.

Finally, a quick reminder that Open Enrollment for the Affordable Care Act ('ObamaCare') at Healthcare.gov is still under way until December 15th in most states and, while sign-up numbers have been very high so far this year, they are very low as a percentage compared to last year, since Trump has cut the period for enrollment in half from previous years.

On today's BradCast: The bloodbath for Republicans in Tuesday's off-year elections and a great idea for how Democratic states can take action against real bloodbaths immediately by helping victims of gun violence with a tax against the industry that works around both the 2nd Amendment and federal immunity from lawsuits granted by Congress. [Audio link to show follows below.]

One year to the day after Donald Trump was named the winner of the Presidency in 2016 (while losing the national vote by 3 million), we review what appears to be the remarkable 'blue tidal wave' that swept across much of the country in Tuesday's contests in about one-third of the states. From big races to small, from high office to city councils and boards of education, voters turned out in impressive numbers and Democratic candidates reportedly performed very well in the bargain wherever they ran.

Democratic candidate Ralph Northam walloped the Trump-supported GOP candidate Ed Gillespie by some 9 points for Governor in Virginia, a clear rebuke to both the President and the racially-based scare campaign both he and Gillespie ran on. Democrats also won for Lt. Governor (only the second African-American to win statewide since the Civil War) and for Attorney General. In perhaps the biggest surprise in the state, voters also turned out at least 15 Republicans from the state's House of Delegates which, depending on some challenges and "recounts", may result in a stunning Democratic takeover of the state's lower chamber that had a 66 to 34 GOP majority before last night. (VA also moved from 100% unverifiable touch-screen voting systems to optically-scanned hand-marked paper ballots this year. So, at least there will be something to count in "recounts" there this year.) Minorities of all sorts --- including the first openly transgender candidate who replaced a homophobic hard right incumbent --- won in the VA House, where Dems out-voted the GOP by more than 200,000 votes. Nonetheless, thanks to Republican gerrymandering, they may still end up in a slim minority there.

Dems also took over the gubernatorial mansion in NJ from the wildly unpopular Chris Christie and won re-election for mayor in NYC by a landslide. African-American candidates won mayoral victories for the first time in cities from North Carolina to South Carolina to Georgia to Montana to Minnesota. Topeka, KS picked up its first Hispanic mayor and Hoboken, NJ now has its first Sikh mayor. And, in Maine, voters overwhelmingly approved the expansion of Medicaid under the Affordable Care Act, which will result in health care for some 80,000 Mainers if the dumbest Governor in the nation, Paul LePage, stops blocking it. (It is also likely to inspire similar ballot initiatives in 2018 in other states where Republicans are denying federally-funded health care to their own residents.) It also appears that the last Republican-controlled legislature on the West Coast, the Washington state Senate, has fallen to Democratic-control, creating a "Blue Wall" of states in the West from Canada to Mexico. So it was a good day for Dems, and seemingly a very troubling omen for Trump and the GOP in 2018.

Meanwhile, it's been just days since 26 were massacred and 20 others shot by a man with a semi-automatic rifle in Sutherland Springs, TX. But Republicans have already made clear they intend to take no legislative action in response. Our guest today, however, legal reporter MARK JOSEPH STERN of Slate, has a fantastic idea that Democratic-controlled states could implement almost immediately. It's one that works around the NRA's 2nd Amendment challenges, as well as the outrageous federal "Protection of Lawful Commerce in Arms Act" (PLCAA) of 2005, which largely granted total immunity to gun manufacturers and dealers from lawsuits filed by victims.

"PLCAA is an entirely unique law. There is literally nothing else like it in the federal code," Sterns explains. "This law literally erased hundreds of years of laws and statutes, and jury verdicts, and forced all states to comply with this federal statute that basically prevents anybody from successfully suing a gun manufacturer or a gun seller, and gives them complete immunity to be as negligent as they want."

Stern's idea, as he explains, would result in help for victims of gun violence (more than 300 per day across the country) and their families, who often face bankruptcy after such incidents, as gun violence costs some $2.8 billion each year in health care costs alone. The measure would also force the gun industry to finally pay up for at least a small part of the unspeakable damage, pain, suffering and injury that they help to inflict every day on Americans.

State's "need to propose a special tax on the income of gun manufacturers and gun sellers that is high without being exorbitant. Tax their profits at every stage. They make a huge amount of money, so this would not burden them. This would not shutter manufacturers. But it would force them to pay a lot more, millions more, every year in taxes. What the legislature needs to do is take this extra revenue and place it in a fund that is explicitly designated to be paid out to victims of gun violence. When people are shot, and it is not at all their fault, they should be able to draw money from this fund to pay for their medical expenses and other care. There should be no cap, no limit on it. And no one would be able to raise a Constitutional objection. This is perfectly compliant with the Second Amendment and PLCAA."

Listen to today's show and please see Stern's excellent piece at Slate this week as well. Then get your state legislators busy! Many already have similar funds for victims of all sorts, like those harmed by the vaccine industry. This, Stern argues, should be a no-brainer for states like California and, perhaps now, even Virginia.
