On today's BradCast: The boondoggles continue --- from the Pentagon to the U.S. House and American elections --- as we can't look ahead to the new year without the continuing unresolved muck from this year. [Audio link to full show is posted below.]

When Democrats take the majority in the new Congress after the first of the year, one of their first orders of business will be determining who actually is allowed to be seated following the November 2018 midterm elections. There could be as many as three (and possibly more) seats challenged in the 116th Congress, thanks to the burgeoning GOP absentee ballot election fraud scandal in North Carolina, an admission by a newly-elected Florida Republican that he "may have" violated federal campaign finance laws, and a lengthy hand-count process in Maine's first-ever Ranked Choice Voting election for a U.S. House seat.

In NC's 9th Congressional District, Mark Harris --- the GOP candidate whose uncertified 905-vote "victory" is now being probed by state and federal officials after the emergence of evidence of absentee ballot fraud by a GOP contractor Harris hired in both the primary and general elections --- has said he'd agree to a new election, but only if evidence surfaces that the fraud in question would have changed the final results. That's a much higher bar than called for by state law, which allows the State Board of Election to take any necessary actions to "assure that an election is determined without taint of fraud or corruption."

In FL, Ross Spano, the Republican who is said to have won the race in the state's 15th Congressional District, now admits he received nearly $200,000 in personal loans for his campaign from two friends, in violation of the $2,700 per person federal contribution limit. One of those friends, despite having no official government role, is today reported to be helping to select Spano's Congressional hires. In both the NC and FL cases, it's not just Democrats crying foul. Tthe Republicans who were defeated in the primaries by Harris and Spano are also joining the public outcries.

In ME, a "recount" request by ousted Republican Rep. Bruce Poliquin in the 2nd Congressional District could result in a vacant seat for a while, as a hand-count of the complicated RCV counting process --- initially carried out after the election by a computer algorithm --- is a lengthy and onerous one that could stretch beyond January 3, when the new Congress is sworn in.

In non-election related news today, Donald Trump will reportedly call for an unprecedented $750 billion budget next year for the Pentagon after his previous increases to military spending. That, despite his description of Defense Department spending last week as "crazy" and previous vows to cut DoD's budget by 5 percent. The Administration's proposal for $750 billion is reported to be a "negotiating tactic" to ensure the $733 billion requested by the Pentagon, which is a far cry from the $700 billion Trump had called for previously and a substantial bump from the "crazy" $716 billion allocated for the current fiscal year.

We're joined today by investigative journalist DAVE LINDORFF to discuss the decades-long "accounting fraud" being carried out by the Pentagon, as detailed in his new exclusive exposé for The Nation. Citing whistleblowers, Inspector General's reports and a recent admission by the private accounting firm Ernst & Young that the Pentagon's books were so poorly documented that they simply cannot be audited, Lindorff explains how the DoD continues to seek --- and receive --- more tax-payer dollars year-after-year, even without needing or spending all they received in previous years. Rather than returning unpsent funds to the federal Treasury, DoD accounting gimmicks ("nippering" and "plugs") ensure endlessly increasing budgets and payments to Defense Contractors. The unchecked spending --- which amounts to trillions of dollars --- also helps to ensures that services Americans may actually need and want --- like healthcare, education and maintenance for infrastructure --- continue to be on the chopping block every fiscal year, even as Defense spending now accounts for 54 cents out of every federal tax-payer dollar collected.

"What the Pentagon does is they ask for more money than they need. They don't spend it all, and then they tuck away what isn't spent in ways that it won't be found --- violating the Constitution, by the way --- then that unspent money becomes a slush fund that's available to use however they want," Lindorff tells me.

"They've known about this stonewalling by the Pentagon for 26 years, which includes a lot of Democratic Congresses. Nobody has ever called them to the carpet on this," he charges. Despite Inspector General reports detailing the gimmicks and unaccounted for budget holes, "Nobody has been prosecuted for this. Nobody has been fired for this....If it's signed off on by the proper authority in the chain of command then it's 'supported' whether or not there's evidentiary material to back it."

Lindorff also argues that, with one recent exception, Democrats --- including progressives from Bernie Sanders to Beto O'Rourke --- have been largely silent on what he describes as a massive account fraud.

Finally today, Rep. Adam Schiff (D-CA), who will chair the U.S. House Intelligence Committee after Dems take over Congress next year, argued over the weekend that new filings from federal prosecutors on Friday suggest "There’s a very real prospect that on the day Donald Trump leaves office, the Justice Department may indict him" and "that he may be the first President in quite some time to face the real prospect of jail time." Schiff was referencing, among other things, details from a sentencing memo filed by federal prosecutors in New York on Friday charging that Trump "directed" a criminal conspiracy with his former attorney Michael Cohen to pay hush money to two women with whom Trump had affairs, in order to effect election results in violation of federal campaign finance laws...

No, Iraq hasn't (yet) announced plans to invade North Carolina to help spread democracy. But, on today's BradCast, it's starting to look like it might not be a bad idea. [Audio link to show is posted below.]

Just before air today, Dan McCready, the Democratic candidate in NC's 9th Congressional District U.S. House race tainted by evidence of GOP absentee ballot election fraud, withdrew his concession offered last month. McCready charges that Republican Mark Harris "bankrolled criminal activity" in the district in the hiring of contractor McCrae Dowless who appears to have gamed absentee ballots in Bladen and perhaps Robeson Counties, resulting in the 905-vote margin by which Harris had previously been thought to have won.

At the same time, NC-9's incumbent Republican Rep. Robert Pittenger, who Harris reportedly defeated in the primary last May, tells Washington Post that his concerns about fraud during that race --- when he lost to Harris by just 828 votes (more than half of them absentee ballots from Bladen) --- were shared with both state and national GOP officials at the time. Nonetheless, despite years-long claims of concern about fraud leading to passage of often unconstitutional GOP laws that restrict the ability of many Democratic-leaning voters to cast ballots, Republicans took no action after the primary. In fact, similar concerns about absentee ballot fraud by the same contractor surfaced after the 2016 election in the state as well.

The Charlotte Observer has now called for the 2018 election in NC-9 to be started over, from scratch, beginning with the primary. "Evidence demands it," their editorial board opined this week. We've got a whole bunch of late-breaking news related to the burgeoning NC-9 election fraud scandal today (along with my completely irresponsible prediction about how this entire thing ends).

Also, in related news, a newly emerging election fraud scandal in New York, where Republican and Independence Party leaders have now been charged with forging signatures on nominating petitions in order to boost chances for GOP candidates. (If that sounds familiar, it's because Republicans, apparently --- including very high-profile ones --- do that quite a bit.)

Meanwhile, GOP lawmakers in Wisconsin and Michigan this week continued their efforts to undermine the will of the midterm voters in the wake of disastrous performances in the November elections. In Wisconsin, where the GOP-gerrymandered legislature on Wednesday adopted unprecedented measures during an extraordinary lame duck session to remove power from the Governor, the Attorney General and voters in advance of Democratic Governor-elect Tony Evers and AG-elect Josh Kaul taking office next month, state lawmakers also confirmed 82 appointees of outgoing Republican Governor Scott Walker to state positions in one single day. Several of the positions had reportedly been vacant for as long as a year, and more than 30 of the new appointees have had no public hearing whatsoever in the state Senate. That power grab is particularly hypocritical for Walker, who warned his Democratic predecessor in 2010 to avoid all new appointments in the final two months of his term.

In Michigan, GOP lawmakers have proven similarly disdainful of voters during the lame duck session. Earlier this year, they adopted two voter-initiated ballot measures concerning increases to the state's minimum wage and paid sick leave for workers in order to prevent the proposals from appearing on the November ballot. But, this week, during the lame duck period before Democrat Gretchen Whitmer can be sworn in, Republican lawmakers gutted the measures they had just adopted in September. They would not have been able to do that had they been voted on by voters. The controversial --- and perhaps unconstitutional --- effort was given the green light by outgoing Republican AG Bill Schuette, who lost his bid for Governor in November to Whitmer.

On today's BradCast: Even as final results are still being determined from this year's midterms, the Democratic Caucus in the U.S. House prepared for its new majority with leadership votes on Wednesday, including on Rep. Nancy Pelosi's bid to retake her previous role as Speaker of the House. Also, three weeks after the November 6th election and Tuesday's runoff for the U.S. Senate in Mississippi, more Houses races are called and one race, believed to have been won by a Republican, offers a new mystery in the state of North Carolina. In MS, Republican Sen. Cindy Hyde-Smith reportedly won Tuesday's runoff against Democrat Mike Espy, as expected, but by a far narrower margin than previously expected in the deep "red" state, after she made a number of disturbing, racialized comments throughout the campaign. Trump won the state by 18 points in 2016. Hyde-Smith won by eight points. A ten-point shift towards Democrats. Nonetheless, the GOP win in MS results in an overall pickup of 2 seats for Republicans in the U.S. Senate this January.

The U.S. House, however, is a very different story. Today, AP finally called the still-undecided contest in New York's 22nd Congressional District for Democrat Anthony Brindisi over incumbent (and very Trumpy) Republican Rep. Claudia Tenney. The Dem flip comes in another "red" district where Trump had won in 2016 by 16 points. That brings the Democratic Party's pickups to 39 among AP's "called" races, with one more contest leaning Dem in California and another leaning GOP in New York state.

But, in North Carolina, where all 13 U.S. House races were expected to be certified by a routine vote of the State Election Board on Tuesday, a Democratic member refused to do so, citing "unfortunate activities" in one part of the state's 9th Congressional District, where Republican Mark Harris is said to have defeated Democrat Dan McCready by just 905 votes. After a two-hour session behind closed doors, the Board finally voted unanimously to certify all but the 9th District race for now. We've got a number of details on what may be behind this wildly unusual and still-unfolding mystery, which seems to center on Bladen County, in the eastern part of the district.

"I’m very familiar with the unfortunate activities that have happened in my part of the state," Democratic SBE vice-chair Joshua Malcolm announced during the meeting before the Board went into closed session. "And I am not going to turn a blind eye to what took place to the best of my understanding, which has been ongoing for a number of years, and which has been repeatedly referred to the United States attorney and the district attorneys to clean up. Those things have not taken place."

We'll keep an eye on that one. But, with Democrats now likely to end up with at least a 40 member majority in the U.S. House after having officially won by the overall largest popular vote margin in history for any party, the battle over party leadership and direction played out today with a vote by the Democratic Caucus in favor of Nancy Pelosi to be their nominee for the next U.S. House Speaker. She reportedly received 32 votes against her, however, which would be more than enough to block her return to Speaker when the full House votes in January.

I'm joined today by progressive journalist, author and activist NORMAN SOLOMON of RootsAction.org to discuss the challenge to Pelosi --- largely by less progressive members of her own party --- and how progressives will need to pressure the Democratic Congressional leadership from the bottom up when they take control in January. Solomon, who helped pen both a Democratic "autopsy" after the disastrous 2016 election, and a follow-up to it just before the November midterms, explains today how both newly elected Democrats and the voters who put them there will need to step up over the next two years to support wildly popular progressive reforms on everything from the minimum wage to healthcare and tax policy, if mistakes made by Democrats (with some of the same leadership) in years past is to be avoided.

"It's all about constituent power," says Solomon. "At RootsAction.org we are dedicated to mobilizing to make sure that more and more progressive constituents make their senators and representatives fully aware that they are being watched closely, and there are such things as primary challenges."

He argues that "the party has changed partly" over these past two years, though "not profoundly." Where it has changed, where Dems have rejected unpopular corporatist establishment positions, "its been because of a lot of these on-the-ground progressives".

Still, Solomon warns against complacency. "When they get Democrats in charge, there's more of a tendency among a lot of progressives to think, 'Well, the worst is over. The emergency is gone.' In fact, whether it's climate change, or perpetual war, or the rich continuing to get richer, these problems are festering. Yes, worse under Republicans, but for us to sit back in any way and not continue to organize and pressure is to leave Congress to its natural setting. It's sort of 'The Call of the Corporate Wild' that they're immersed in," he tells me. "The only way to counter that is that we have to mobilize no matter who is in power, to fight back against Wall Street."

It was another very busy day on today's BradCast, as news breaks out of Georgia and California --- and seemingly everywhere else --- though we finally found at least a moment to take some stock of the midterm elections and what they portend, nearly two weeks after Election Day. [Audio link to show follows below.]

Before we get to elections and politics, however, there are horrifying new numbers today out of the ongoing, climate change-fueled wildfires in California. Officials now say that more 60 are known to have been killed, but on Thursday evening they also raised the number of those still unaccounted for amid the record Camp Fire in Northern California to a staggering and gut-wrenching 631. [Update: Just before posting this here, officials in Northern California increased the death toll, announcing 71 dead with more than an unfathomable 1,000 now said to be unaccounted for!]

Then, a Trump-appointed federal judge orders the White House to immediately restore press credentials to CNN White House Correspondent Jim Acosta.

Next, another midterm election victory is called by AP and others for Democrats in what had long been solidly Republican Orange County in California. Katie Porter, an unapologetically progressive Elizabeth Warren protégé, is now said to have defeated incumbent Republican Rep. Mimi Walters in the heart of what was once known as "Reagan Country", in the state's 45th Congressional district. Walters had easily won reelection by a huge 17% margin just two years ago, but now becomes the third of Orange County's four U.S. House members to see their seat flipped to a Democrat. The fourth seat, in CA's 39th Congressional district, is very likely to be called for Democrat Gil Cisneros over Young Kim any day now.

As of air time, Dems have reportedly picked up a net gain of 36 seats for their new House majority, though that number may still climb to 38 or even 39 seats as votes are tallied in the last of the undecided House races.

Meanwhile, in Florida today, statewide "hand counts" --- or what suffices for them in the Sunshine State --- continued on a ridiculously abbreviated schedule through Sunday in the state's U.S. Senate race between incumbent Democratic Sen. Bill Nelson and GOP Gov. Rick Scott, who is said to lead by 0.41%, or just over 12,000 votes out more than 8 million cast.

The partial "hand count" in the Senate race moves forward after full "machine recounts" in three of the state's largest and most Democratic-leaning counties were rejected by Scott's Sec. of State. In Palm Beach, the County's old computer scanners could not physically tally fast enough to meet the Thursday 3pm deadline at the end of just five days. In Hillsborough County, the second machine count differed from the original count by more than 800 ballots, so the first count will be used (whether it's right or wrong, nobody knows.) And in Broward County, state officials rejected their new count because it was uploaded to the Sec. of State's office two minutes after the 3pm deadline. Seriously.

As a source in Palm Beach told me earlier today about the impossible timelines instituted by state Republicans: "These deadlines they codified into law set up big counties to fail. How a county like ours (population 1.3 million) has the same deadline as a county like Liberty County (population 8400) is beyond me. Five days isn't enough, a week isn't enough, two weeks isn't enough. This is done by design. Why? The biggest counties are blue counties and they don't want those votes counted. It's not complicated."

And, in Georgia, Democratic gubernatorial candidate Stacey Abrams announced that her Republican opponent Brian Kemp would be the winner of their very close and contested election, thanks in no small part to the extraordinary voter suppression he has implemented over the past eight years during his tenure as Secretary of State.

"Let's be clear: This is not a speech of concession because concession means to acknowledge an action is right, true or proper," Abrams said in a speech to supporters, while denouncing Kemp's outrageous record as the state's chief election official. "As a woman of conscience and faith, I cannot concede that."

At the same time, she also announced she is forming a new organization --- Fair Fight Georgia --- that will sue Kemp and the state for "gross mismanagement" of the election as she declared "the law currently allows no further viable remedy" to overcome what many now see as a stolen election in the Peach State.

We discuss the Dems' extraordinary (and under-appreciated) "Blue Wave", how it has clearly served to throw Trump into a dark emotional spiral while exposing him yet again as a con-man, even to many of his supporters, and how some Democrats appear to be taking the rightwing Fox "News" bait in hoping to block Nancy Pelosi's likely return as House Speaker and leader of the Congressional Democratic caucus in January...

Each offer helpful, non-pollyannaish advice on keeping our current moment in the appropriate perspective. That, while the struggle for justice and to somehow save the U.S. Supreme Court from an onslaught of GOP/Trump hypocrisy, extremism, lies, cynicism, and far-right schemes to roll back decades of hard-fought civil, voting, human and reproductive rights, will demand persistence and steady, determined courage in the days ahead.

Nonetheless, both pessimism and despair are counterproductive to progress. So I hope today's program helps us all (including me!) to stay a bit more hopeful, optimistic and healthy, during these seemingly ever-darkening hours.

Also providing a bit of hope and inspiration today, some more news from Tuesday's primary elections, in which an extraordinary progressive 28-year old Latina from The Bronx unseated a 10-term Democratic member of the U.S. House Leadership establishment in New York's Democratic primary, despite being outspent 15 to 1; A record third LGBT person this year has now won a Democratic nomination for Governor, this time in Colorado; And Oklahoma voters unseated a host of Republicans in the state House and Senate who voted against recent tax increases to fund education following a two-week long teacher walk-out and years of slashed funding to pay for massive corporate tax cuts; And, as if that's not enough good news from supposedly "conservative" Oklahoma, voters also approved a citizen-sponsored statewide ballot initiative for medical marijuana, in defiance of GOP elected officials and a well-funded campaign against it. We join Steven Colbert's celebration on that today.

On today's BradCast: Bill Maher quipped Friday night that the U.S. attack, with France and Britain, on Syria was code-named "Operation Desert Stormy", an attempt by Donald Trump to force his legal and ethical nightmares off the front pages. It didn't work. [Audio link to show follows below.]

On Sunday night, fired FBI Director James Comey described Trump as "morally unfit" for the Presidency in a prime-time ABC News interview, and on Monday, just before air today, Sean Hannity of Fox "News" was revealed in federal court to be a secret client of Trump's hush money payoff "fixer" Michael Cohen, and Cohen and Trump's motion to review documents seized in the raid on Cohen's office and residences last week was denied (for now) by the federal judge.

Nonetheless, before it's forgotten entirely in the fog of Trump Scandal, we focus mostly today on the fact that the pre-dawn bombing of Damascus by US and its allies, said to be in response to an alleged chemical attack by Syrian President Bashar al-Assad against his own people a week earlier in Douma, was done without any actual hard evidence of a chemical attack or who was actually responsible for it. Trump's Secretary of Defense James Mattis admitted as much during Congressional hearings just one day before more than 100 cruise missiles were unleashed on supposedly chemical weapons-related facilities in Damascus. (No proof was offered to buttress the claim about those facilities either.)

Moreover, there is absolutely no legal authority whatsoever for Trump's attack --- either domestically or internationally --- despite various claims to the contrary. Shamefully, most of Congress, both Republicans and Democrats alike, have so far failed to demand accountability for the unconstitutional use of military force (even after threatening President Obama with impeachment when he wanted to launch a similar attack in response to an alleged Syrian chemical attack in 2013).

For his part, the hapless Trump, who mercilessly derided Obama for calling for Syrian airstrikes in 2013, took to Twitter on Saturday to echo George W. Bush's infamous appearance on a U.S. Aircraft Carrier in 2003 after the ill-fated invasion of Iraq, to declare "Mission Accomplished" in Syria.

Friday's unlawful US attack, as we also discuss today, is believed to have cost some $200 million. That could have paid for the replacement of all of Flint, MI's lead water pipes some four times over, as new studies reveal that reading proficiency levels for third-graders in Flint has plummeted in the wake of the lead drinking water contamination crisis. That continuing crisis came about after MI's Gov. Rick Snyder (R), following his election in 2010, ordered an Emergency Manager takeover of the city and a subsequent change to its water supply.

As one caller observed today, some poisoned children, like those in Syria apparently, seem to be a larger concern for the Trump Administration than others...no matter the evidence or lack thereof...

But, while Democratic turnout was way up, progressive candidates on the 'blue' team did less well than hoped, according to the reported results. And, once again, there was another computer vote-counting disaster in a deep 'red' Illinois county. [Audio link to full show is posted below.]

After an update on what Texas law enforcement officials hope will have been the dramatic late-night conclusion to the three-week long bombing spree in Austin (carried out, as it turns out, by a white domestic rightwinger), we tackle the results, fallout and concerns about the computer tabulation systems from Tuesday's primary. We're joined first today by longtime election integrity champ and government watchdog JEAN KACZMAREK, who is now, officially, the Democratic nominee for County Clerk in DuPage County, IL, where the computer tallies of hand-marked paper ballots just happened to collapse on Tuesday night.

Kaczmarek explains what is believed to have gone wrong, leading election officials in the county to halt all tallies in the very Republican county last night, until some 256 precinct-based optical-scan computers could be collected and brought back from the precincts to the County headquarters.

The failure, apparently, is being chalked up to "ender cards" that were said to be on paper stock too thick to run through the scanners, despite being supplied by a vendor the county had relied on for many years to print up ballots for use with their Diebold optical-scan systems first purchased in 2002. "Ender cards" are run through the scanners at the close of polls, to then allow the printing of results tapes before the scanners' sensitive memory cards are removed and returned to county headquarters for final tallying. The monumental failure, coincidentally, came on the same day voters were asked in ballot referendum about combining the County Election Commission with the County Clerk's office (as most counties already do in the state), and as the county was premiering its new, fancy election night results website.

County officials claim the system was "rigorously" tested before Election Day, even though they failed on Tuesday. "My guess is the ender cards won't be a problem in November," says Kaczmarek. That might be the one thing that they do really well in November. There seems to always be some type of problem going on in DuPage on Election Night."

Then, we're joined next by HOWIE KLEIN of Down With Tyranny to discuss the tough day for progressive Democrats in the Land of Lincoln, where a number of conservative establishment (and even far-right) Democrats were able to edge out their more progressive challengers. We discuss, among other races yesterday, the gubernatorial primary contests, which have resulted in a race that will now feature two billionaires going head-to-head this fall, and the much-watched and highly contentious U.S. House race in the 3rd Congressional District where rightwing Democratic Rep. Dan Lipinski is reported to have barely defeated progressive candidate Marie Newman, who had been strongly endorsed by Klein's BlueAmericaPAC.

"Well, he's not a 'full-on Republican'," Klein says about Lipinski, countering one of Newman's claims during the campaign. "But he does tend to vote with Republicans on key, crucial issues. For example, he was one of the Democrats to vote against Obamacare. He literally votes against equality for gay people. He is so anti-choice that the Republican anti-choice organization, the Susan B. Anthony List, not only supported him, they spent $150,000 supporting him. This is a very, very serious, rightwing candidate and rightwing groups know that, and they gave him a lot of support."

There were, however, some bright spots for progressives on Tuesday in IL, which we discuss as well. Along with all of that, Klein also tells me why Congressional leadership chose to put their support behind the incumbent, anti-choice, anti-gay, anti-Obamacare Lipinski, rather than Newman, and how it may be difficult to keep Donald Trump from congratulating the actual Nazi who will be running against Lipinski this fall.

As if all of that isn't enough, we even have some conversation about the Talking Heads' David Byrne, whose new solo album has debuted at #1, and who Klein represented for years while a top Hollywood record executive, before ditching that life for the glamor and big bucks of independent progressive political blogging...

On today's BradCast: Democrats appear confident that they are heading toward a "Blue Wave" election in the 2018 mid-terms. Then again, they were also confident they'd soundly defeat Donald Trump for the Presidency in 2016. And the progressive/establishment rift that developed during the party's 2016 primary has, apparently, not gone away. [Audio link for show follows below.]

But first up today, the President's son-in-law and top adviser, Jared Kushner has reportedly lost his Top Secret/SCI-level security clearance, along with a bunch of other White House staffers, after failing to receive a permanent security clearance in the more-than-a-year since he's been serving.

Next, with one disturbing sex (and hypocrisy) scandal after another plaguing Republican candidates for office (as well as the President of the United States), we add several more such scandals to the list today. Among them, a GOP U.S. House candidate in Pennsylvania whose husband says she threatened to kill him in a drunken rage. That, after the woman was revealed to have had an affair with married GOP Congressman Tim Murphy in a neighboring PA district. After text messages revealed he advised her to get an abortion, he eventually resigned from the House last year.

Then there's the Republican candidate for Illinois' state Legislature who is said to have asked the party's leading state Attorney General candidate recently whether she was a "lesbo", before repeatedly using the n-word in front of the woman who happens to be a Harvard Law grad and former Miss America, as well as an African-American.

And, let's not forget the minister in Arizona running in the GOP primary today for the Special Election to take the disgraced GOP Rep. Trent Franks' vacated seat. After the far right Franks resigned from Congress last year following his own sexual misconduct allegations, former AZ State Senator and family values minister Steve Montenegro led the pack of some 18 GOPers vying for the nomination in the very right-wing Congressional district west of Phoenix --- at least until salacious text messages with a legislative staffer were surfaced just days ago.

So, yes, the Republicans have a lot of problems with their candidates of late, but Democrats are having a lot of problems with each other. The turmoil between the party's aging conservative establishment wing and its growing progressive wing have now begun to rear its ugly head again, after the intraparty rift that grew out of the 2016 Presidential primary between Hillary Clinton and Bernie Sanders.

Late last week the conservative Democratic Congressional Campaign Committee (DCCC) unleashed a remarkable attack against Laura Moser, one of the more progressive Democratic candidates, among eight, vying for the party's nomination in next Tuesday's U.S. House primary contest in the Texas' 7th Congressional District near Houston. And, over the weekend, the delegates at the annual California Democratic Party convention failed to endorse 4-term U.S. Senator Dianne Feinstein in her reelection bid, where she is being challenged by progressive state Senate leader Kevin de León. De León received 54% of the delegate votes to Feinstein's 37%. Neither reached the 60% required for an official state party endorsement.

We're joined today to discuss all of this from the Democratic side --- as the primary season finally gets officially underway --- by progressive advocate and Congressional elections expert HOWIE KLEIN, creator of the Down With Tyranny! blog and co-founder of the BlueAmericaPAC, which supports progressive candidates with small personal donations.

Klein (whose BlueAmericaPAC supports a different progressive in the race, Dr. Jason Westin) explains the DCCC's stunning attack on Moser in Texas late last week, while warning that there are many more such attacks to come against progressive candidates this year by the conservative DCCC. "They always, 100% of the time, support conservatives from the Republican wing of the Democratic Party," he charges. "That's what they do. They always try to undercut progressives."

"They're not more likely to win. The only time they can win is in a wave election," Klein argues, while responding to the DCCC's defense that they are only favoring candidates more likely to defeat Republicans this November. "The problem with these DCCC candidates is that they can't hold the seats. They get defeated in the next midterm. And that happens over and over and over again, and the DCCC can't understand that."

Klein also speaks to what he sees as both the reason for and solution to the DCCC's right-wing bent --- (for which he blames Democratic Congressional leader Nancy Pelosi who "used to be a progressive") --- and whether bitterly divided Democratic voters will find a way to come together this year once the primaries are over, in order to retake majorities in one or both houses of Congress.

He describes the current rift as an in "important ideological fight," and claims, "It's not a split between Bernie people and Hillary people in any way. It's an ideological battle of people who believe in what Franklin and Eleanor Roosevelt believed in, as opposed to people who are conservative Democrats who are frightened and afraid of innovation."

Speaking of which, Klein then offers his thoughts on why California's progressive Democrats are turning on the conservative Feinstein this year and how that may effect the 84-year old Senator's hopes of winning a 5th term in November. Related to that point, we also discuss the unpredictable "top two" primary system now used in California, where candidates from all parties run at the same time against each other, before the top two vote-getters --- from either the same or different parties --- then go on to compete head-to-head in November's general election...

On today's BradCast: As Congress struggles to pass a spending bill and avoid another government shutdown, the White House was busy on Thursday fending off much-deserved criticism for allowing an alleged wife abuser to serve as a top Oval Office official for the past year, despite failing background and security checks over that time. White House Staff Secretary Rob Porter finally resigned on Wednesday, but not before Donald Trump's Chief of Staff John Kelly fought hard to keep him on board and wildly sang his praises, even after reportedly being told long ago that Porter's two former wives had both accused him of physical and emotional abuse, which they had notified the FBI about as early as January of 2017.

It wasn't until a graphic photo of one of the women with a black eye --- which she says she told the FBI that Porter had caused when he punched her while on a vacation --- was published, that the White House finally got around to backing off the praises they had been singing for him. That, even while Porter had been handling the nation's most classified information along with Kelly, despite being unable to obtain a full security clearance, thanks to his violent and abusive background.

We cover many of the developing details in that grotesque story, including some of the remarkable (and shameful) reaction to it today.

Then, the 2018 Affordable Care Act enrollment numbers are finally in and suggest that Americans, even in states won by Trump in 2016, sure do like ObamaCare!

Nonetheless, the White House and Republican states are still doing all they can to take health coverage away from Americans, particularly those that need it most. Several GOP states have now applied for waivers to allow them to put lifetime limits on the use of Medicaid for the first time in the history of the crucial social safety net program.

On today's BradCast: Several encouraging election-related news items for Democrats and others in the fact-based community, but still more troubling news for American immigrants and their families as DACA recipients are left out of a new Senate deal to keep the government open. [Audio link to show posted at end of article.]

We start with some of the good news for Democrats, as yet another special election on Tuesday has resulted in yet another state legislative seat flipped from "red" to "blue". This time it was a special election for the Missouri House in a district where Trump is said to have won by 28 points in 2016. The stunning victory continues a tidal wave of Republican seats picked up by Democrats since Donald Trump took office last year. There is less good news for Republicans, however, as a holocaust denier and actual member of the American Nazi party is now set to become the GOP's nominee for the U.S. House in Illinois' 3rd Congressional district this fall.

Meanwhile, U.S. Senate leaders Mitch McConnell (R-KY) and Chuck Schumer (D-NY) announced a breakthrough agreement on Wednesday to keep the federal government funded and open in advance of Thursday night's shutdown deadline. The deal, if adopted by both chambers of Congress, would increase both military and domestic spending by some $300 billion, includes additional disaster relief to states rebuilding after last year's hurricanes, funds community health centers for several years, and increases the debt ceiling to avoid a government default, as lost revenue following the GOP's $1.5 trillion tax cut last year means federal borrowing must be increased sooner than previously expected.

The deal, however, does not include protections for "Dreamers", those who immigrated here with their parents years ago, who now face the possibility of mass deportation as early as March 5, after Trump reversed the Obama-era DACA program that had previously protected them. Some progressives and self-identified conservatives in the U.S. House oppose the Senate plan, including House Minority Leader Nancy Pelosi (D-CA) who took to the House floor today for a record 8-hour marathon speech to highlight the DACA issue and contributions made by hundreds of thousands of "Dreamers" who have lived here most of their lives.

Pelosi says she opposes the Senate bill and called on House Speaker Paul Ryan (R-WI) to promise a vote on immigration issues, as McConnell has in the Senate. Freedom Caucus Republicans in the House also claim to be upset by the bill, thanks to its additional new government spending. So, it remains to be seen if today's breakthrough package will make it to the President's desk before the midnight Thursday deadline or not. Either way, it doesn't appear that a fix to DACA will be included, assuring more continued uncertainty for some 800,000 previously protected Dreamers who could soon face deportation.

We're joined today by JESSICA HANSON, attorney at the National Immigration Law Center, to discuss how a recent federal court ruling, temporarily blocking some of Trump's attempted DACA reversal, may effect his March 5 deadline for legislation to protect "Dreamers", as well as the rise of white nativism in the GOP, including Trump and his Chief of Staff John Kelly.

Hanson explains the "temporary reprieve" by a federal court ruling in California that has allowed "individuals who have had DACA previously to renew their DACA grant." But, she says, while NILC recommends such renewals, even where some may have already expired, she notes that those who never had DACA protection are still out in the cold, at the moment, as "the government took the unusual step of seeking to skip the 9th Circuit and instead appeal directly to the Supreme Court" in the ruling.

In response to recent remarks from Kelly, alleging that those not covered by DACA were "too lazy to get off their asses" and that he "doubts very much" Trump will extend the program beyond March 5, Hanson charges: "Those remarks reflect an ongoing, deep, white nativist sentiment with this administration that has shown itself over and over again."

We also discuss a number of other related issues, including Trump's lies about our legal immigration policies, such as the Diversity Lottery and Family Reunification programs that he is now trying to restrict and ties to a DACA deal ("The President has been completely misrepresenting these programs," explains Hanson, who describes it as yet another effort "to make America white again"), and concerns about millions of other American immigrants already being terrorized by detention, deportation and separation from their families, business and lives under Trump's radical anti-immigrant policies.

She joins NILC in decrying today's Senate deal, charging that "it is inexcusable that the Senate leadership has agreed to put immigrant issues aside" and explains that "the mainstream media could do a lot more to lift up these stories" about abuses by Trump's immigration enforcement agencies like ICE and CBP, "because a lot of people don't realize it's happening [and] have no idea that this is going on."

Finally, we finish up with a bit more encouraging election news for those still interested in facts and reality and science, as a record number of scientists are now lined up to run for office in 2018, on the state, local and federal level, in response to the Trump Administration and GOP's increasingly anti-science policies and positions...

On today's BradCast: Trying to make sense of the Senate Democrats' decision on Monday to vote in favor of re-opening the federal government, following Friday's vote that resulted in a short shutdown over the weekend. Democrats in the U.S. Senate appear to have folded in their demand that Republicans protect 800,000 "Dreamers" in a short-term spending bill. In the bargain, they voted to re-open the federal Government on Monday, after a nearly identical bill was blocked from passage on Friday, resulting in a two-day shutdown of the federal government. The difference between Monday's vote and Friday's? A three week Continuing Resolution to fund the government, instead of a four week extension, and a promise (of sorts) from Senate Majority Leader Mitch McConnell to allow a vote on a measure to protect those 800,000 children of immigrants brought here years ago through no fault of their own, but who are now facing deportation beginning on March 5, following Donald Trump ending the Obama-era Deferred Action for Childhood Arrivals (DACA) program.

On today's show we discuss the politics around all of this, whether Democrats were right to give in for now, despite polls suggesting the public by and large blamed Republicans for the standoff, the angry progressives and immigration advocates who are furious about it, and whether there's a chance in hell that Republicans will allow a real fix to DACA without being forced to do so through a full and extended government shutdown.

We take calls from listeners today on all of that, on the huge and absurdly under-covered Women's Marches held over the weekend in hundreds of cities, where anywhere from 1.3 to 2.1 million turned out --- not that you would know it from the lack of media coverage.

Also on today's show: A natural gas rig explodes in Oklahoma and Pennsylvania's Supreme Court orders the Republican-controlled state legislature to redraw gerrymandered U.S. House maps in time for the 2018 primaries which begin in weeks in the Keystone State. The PA ruling follows similar ones by courts in Wisconsin, Texas, North Carolina, Florida and elsewhere, finding Republicans unconstitutionally discriminated against non-Republican voters in U.S. House and state legislative maps drawn after the 2010 census. Most of the rulings in those states, to date, have been delayed by the Republican's stolen U.S. Supreme Court, likely allowing the worst of the gerrymandering to continue into the crucial 2018 mid-term elections...

On today's BradCast, Republicans have returned to form, via government by hostage taking. Vote our way or the kids get it it! [Audio link to show follows below.]

The chaos in Congress, as Republicans race to come up with a plan to avoid a Government shutdown this weekend, echoes what happened just last week as they they tried to pass a reauthorization and extension of the FISA Amendment Act in the U.S. House. Though GOP leadership and the White House had long lobbied for the reauthorization, Donald Trump unleashed chaos when he tweeted against his own bill. That legislation, which allows for warrantless surveillance of emails and phone calls by all Americans, ultimately passed after Paul Ryan called the President to explain it, and enough Democrats came on board to help them in the House. (It passed today, again with the help of Democrats in the Senate, and now heads to Trump's desk to be signed.)

On Thursday, as Congressional Republicans attempted to pass a short-term spending bill to keep the government open --- after a long-term deal was plunged into chaos when Trump refused a deal that included immigrants from "shithole countries" --- Trump did it again. He tweeted against a GOP stopgap plan which includes reauthorization of the Children's Health Insurance Program (CHIP). The reauthorization, which both helps sick kids and saves the government billions of dollars, was included by Republicans in hopes of enticing Democrats to help them avoid a full government shutdown as of midnight Friday. Most Dems don't seem to be buying it --- despite Ryan, once again, calling the White House to get Trump back on board --- as they appear unwilling to help Republicans out of this jam without the inclusion of a fix to the Deferred Action on Childhood Arrivals (DACA) program.

Republicans refuse to include a fix to DACA, the Obama-era protection against deportation of some 800,000 children of immigrants, which Trump reversed, in their short-term measure. Dems say they won't support such a bill unless DACA is included. In other words, the children helped by both CHIP and DACA are now being held as hostages by the Republican Party. The measure squeaked by tonight in the U.S. House, but passage in the Senate, where 60 votes are needed to overcome a filibuster, is far from certain.

Then, after Donald Trump's fake "Fake News" awards face plant on Wednesday night, we have a few real "Fake News" awards to offer, based on actual facts, as we reach the end of Trump's agonizingly long first year in office this weekend.

Finally, Desi Doyen joins us for the latest Green News Report, with bad news out of China, good news out of the Detroit Auto Show (and even from McDonald's), and some late breaking news from NOAA and NASA on the record heat of 2017, as man-made global warming continues apace in the new year...

On today's BradCast: Donald Trump and his Great American Shitshow continues today, though he has now received a very helpful hand from Congressional Democrats, for reasons that may beggar the imagination. [Audio link to show is posted below.]

First up today, a quick word on the allegations regarding $130k in hush money said, by the Wall Street Journal, to have been paid by Donald Trump to a porn star just before the 2016 election, reportedly to hide a sexual liaison during his marriage with the now-First Lady, and on the sordid sex and blackmail scandal now roiling Missouri's new "family values" Republican governor, Eric Greitens. In normal times, of course, both stories would be huge news everywhere and we'd be discussing impeachment and/or resignation of both men. These days, however, each scandal is barely breaking the national news radar.

Then, more encouraging election news for Democrats this week in Tuesday's special elections around the country, with Dems flipping another long-held Republican seat in a deeply "red' area, this time in the Wisconsin State Senate. The results seem to be freaking out the state's controversial GOP Governor Scott Walker in advance of his own re-election contest later this year and signals a possible Dem takeover of the state Senate in advance of 2020 redistricting!

Next, Congress is on the verge of reauthorizing a warrantless mass surveillance program that civil libertarians on the right and left have long opposed and characterize as a blatant violation of the U.S. Constitution's 4th Amendment privacy protections against unwarranted search and seizure. Last week, after Trump made it clear he had no idea what Section 702 of the FISA Amendments Act actually was --- despite his administrations' long time lobbying of Congress to reauthorize and, indeed, expand it, it for another 6 years --- Republicans in the U.S. House passed it with the help of several Democrats (including House Minority Leader Nancy Pelosi).

This week in the U.S. Senate, a bi-partisan group lead by Senators Rand Paul (R-KY) and Ron Wyden (D-OR) fell one vote shy of blocking the measure through a filibuster. So it now appears the legislation will clear both houses and sent to Trump for his signature.

We're joined today by ELIZABETH GOITEIN, former Dept. of Justice attorney, now co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice, to explain Section 702, the efforts to lobby against its reauthorization, and why it is that many Congressional Democrats are willing to join Republicans in granting the Trump Administration's NSA, DHS, FBI, DOJ, CIA, etc., extraordinary new powers to secretly spy on every American citizen's phone calls and emails without warrant, due diligence or even probable cause.

While the legislation was "driven primarily by Republican leadership," she says, there were "enough Tea Party style Republicans who have really rallied in support of greater privacy protections" that some marginal reforms were added. Though, she explains, they aren't really reforms at all, and the entire dangerous package could not have moved forward had Dems stuck together in opposition.

"It's a failure of Democratic leadership," Goitein tells me. "At the last minute, [Senate Minority Leader] Chuck Schumer said he would vote no on cloture [to end the filibuster] --- but he hedged that and said, 'Amendments should be in order and we should have the chance to look at amendments, but the bill itself is not that bad, it makes improvements to the law'. Which is not true. It actually takes the law backwards. Minority Leader Pelosi in the House did even more damage...coming out in support of the bill and opposing the amendment that would have made these improvement. And then a whole bunch of Democrats went along with her."

Goitein argues "there was a full court press by intelligence officials" to pass this measure. So, even Trump's cluelessness about it was unable to prevent it from moving forward, even as it allows for the emails of two American citizens speaking to each other --- with no foreign target in the mix --- to be indexed, searched and read by the FBI without an order from any court. She explains the horrible details in depth on today's show, and why it has been so difficult to challenge this provision in a court of law.

Finally, nearly every member of the bipartisan National Park Service Advisory Board has resigned en masse this week, citing the Interior Department and its Secretary Ryan Zinke's failure to hold any meetings with the board, as required by law, during the entire first year of Trump's Presidency. The Administration's response to the mass resignation today is almost as disturbing, if not more so, than the resignation itself.

On today's BradCast: Who's actually running this disastrous Administration? And why don't they give a damn about terrorism when it's at the hands of white, domestic, neo-Nazis? That question may answer itself. But what's the excuse for Congress and media? [Audio link to full show at end of article.]

First up, today in the U.S. House, Republicans, with the help of a number of Democrats, voted to approve the re-authorization of a sweeping surveillance law --- Section 702 of the FISA Amendments Act --- that results in the phone calls and emails of millions of Americans being scooped up for review without cause or court warrant. Civil libertarians on both the Right and Left have been hoping, for years, to end or radically limit the dragnet measure which they say violates Constitutional rights to privacy and against unwarranted search and seizure.

Though the White House has been lobbying for this re-authorization, which must still be approved in the U.S. Senate, a tweet this morning by Donald Trump, while watching Fox "News", harshly criticized the measure. Following that tweet, two hours later, after a call from House Speaker Paul Ryan (R-WI) and chaos in the House GOP caucus in response to the tweet, the President took to Twitter again, this time in support of the measure, which he clearly knows nothing about.

Only his later description of Haiti and African nations as "shithole countries", as reportedly uttered during bi-partisan immigration negotiations today with lawmakers, moved the nation's media on to the next Trump embarrassment of the day.

In the meantime, as Trump and Congressional Republicans pretend to be concerned about terrorism and putting "America first", a major terrorism case brought by the Dept. of Justice just before Christmas has gone almost entirely unnoticed by the media, after the DoJ itself failed to even issue a statement on the recent arrest. Why? The obvious reason is that it involves a white supremacist neo-Nazi from Missouri (as opposed to someone with a middle-eastern sounding name) who had amassed an arsenal of deadly weapons in hopes of allegedly "killing black people". But there are several other reasons why the case has largely failed to become much more than a blip on the corporate media and cable news radar, much less be mentioned by either the DoJ or tweeted about by Donald Trump.

We're joined by HuffPost's senior justice reporter RYAN REILLY to discuss the matter today. Reilly has been investigating the disturbing lack of coverage of a case which includes an Amtrak train stopped by the accused 26-year old right-winger, Taylor Michael Wilson, in the dead of night in the middle of rural Nebraska several months ago, before he was arrested, then released on bail for several weeks, before finally being charged on a number of federal terrorism counts before Christmas.

"When I didn't see the story pop up until Friday, I was like wait, how did I miss this? What's going on? Federal prosecutors are charging a white supremacist with terrorism?," Reilly says, explaining why the case in which Wilson was originally charged with "criminal mischief" went unnoticed by media and unreported by law enforcement officials, who are usually eager to get publicity for terrorism cases.

"The broader issue is that it's a demonstration, an illustration of exactly how differently the Justice Department apparatus, and the national security apparatus of the US Government, treats domestic terrorism in comparison to anything that remotely has a sniff of anything related to Islamic terrorism," Reilly tells me. The reasons, for that, above and beyond strictly racism (which is certainly a large part of this), may be more complicated than you think, both statutorily and Constitutionally. None of those reasons, as we also discuss, necessarily excuse the media's apparent lack of interest in such cases, despite the fact that domestic terror remains a far greater threat to Americans than the threat posed by those claiming an association with international terror groups.

Finally today, Desi Doyen joins us for the latest Green News Report on the tragic climate disaster unfolding in Southern California which has, so far, taken 17 lives in the past several days; the Trump Administration's about-face on its recently announced expansion of off-shore drilling (but only for one politically important state); and an important lawsuit filed this week by New York City, along with the promise of divestiture, against major oil companies. The suit could prove to be a serious blow against the fossil fuel industry, and is said to have been filed in response to billions of dollars in climate change-related damages after years of those companies hiding their own scientific knowledge of climate change from the public...
