Never thought I'd miss the 2000s, but if this week is any indication of what's to come, can we please roll back the clock?

Hundreds of thousands died in Haiti. Detainees were revealed to have been murdered in American custody at Gitmo. Democracy died again in Diebold's Massachusetts. A faint hope for reviving the death of the public's airwaves dies yet again as Air America dies. And the U.S. Supreme Court commits mass murder of everbody and everything else that had still been left teetering.

Worse. Week. Ever.

As it happened, I was previously scheduled to be a guest on Peter B. Collins' podcast yesterday to discuss MA. Suffice to say, the conversation ended up a bit broader, and a great deal darker.

'We the People' lose, 'You the Corporations' Win...

"The court's ruling threatens to undermine the integrity of elected institutions across the nation," wrote Justice John Paul Stevens in his dissenting opinion on today's U.S. Supreme Court ruling in Citizens United v. the Federal Election Commission, which will overturn decades of established campaign finance law.

"Threatens to"? That could be the understatement of the century. But this is what comes of not counting election results. We can thank, among a long list of others, John Kerry for having rolled over in Ohio in 2004.

In a 5 to 4 decision today, by an activist U.S. Supreme Court that actually requested to make a decision to hear this matter, despite the fact that the original case brought to them had little to do with their larger, most destructive finding, has decided that corporations may give as much money as they wish to federal election campaigns.

This would be 'Game Over,' folks, for those who believe in "We the People," rather than "We the Corporations," unless a movement like the one launched today at MoveToAmend.org (on which we are an original signer) can gain traction. You can (and must) join the call by signing on at FreeSpeechForPeople.org as well.

Some key quotes from today's ruling, which pretty much encapsulate the entire horrifying story:

In the majority opinion of the court, Justice Kennedy writes: "The Court has recognized that First Amendment protection extends to corporations."

Concurring, Chief Justice Roberts wrote of his fear that if the decision had gone the other way, "First Amendment rights could be confined to individuals, subverting the vibrant public discourse that is at the foundation of our democracy."

...And Justice Scalia, equating corporate money with free speech wrote "We should celebrate rather than condemn the addition of this speech to the public debate."

In dissent, Justice Stevens wrote "While American democracy is imperfect, few outside the majority of this Court would have thought its flaws included a dearth of corporate money in politics."

We will, no doubt have more on this soon (currently buried in a number of other items and still on road). In the meantime, we're sure the "grass roots" Tea Baggers, outraged by corporate money special interests, will be infuriated by this decision, light up new protests in every town in every state in the union, and demand that our country be returned to "We the People" as the founders envisioned.

Election experts file public records requests; Pre-marked ballots reported in two 'at least' THREE towns...

[UPDATED SEVERAL TIMES with more info on the curious/disturbing issue of ballots reported as being handed out as pre-marked for Scott Brown. Allegations now of five different reports from "at least" three different jurisdictions. See bottom of article for continuing updates...]

Haven't heard too much from on the ground in Massachusetts this morning yet (happily), but that's not much of a surprise. The real questions come later, as we will all wonder whether or not the "results," whatever they are, as reported by Diebold and never counted by actual humans, have anything to do with the way voters actually voted.

In the meantime today, a group of election integrity experts, after having posted an "Orange Alert" yesterday about the serious e-voting concerns in today's election, have sent an open letter to Sec. of State Bill Galvin, along with a public records request [PDF], calling for the retention of all election materials, such as voted, spoiled, and unvoted ballots, as well as all of the easily-tampered-with memory cards and electronic databases, etc., to ensure they are all secured and available for inspection by the public after the close of polls.

Election integrity advocates Susan Pynchon, Shelia Parks, and John Brakey also put the entire sorry matter in stark terms, demonstrating how simple this all could have been in a very short piece at OpEd News asking why MA didn't simply just determine to count the ballots, by hand, in front of everyone at the polling place, especially given that it was a single race on the ballot with just three people on it...

Regardless of who wins, the opposing party will be flinging accusations of machine failures, uncounted votes, and fraud. There is only one race on this ballot. It would be easy to divide the ballots in each precinct into three separate piles and simply count the number of votes received by each candidate.

This is not going to happen, however. A simple measure --- hand-counting the votes as a check on the machines on election night, before there are questions about chain-of-custody of the ballots --- will not be done. The second question one has to ask is, "Why not?"

As to the ballots themselves, Greg Sargent at The Plum Line reports an odd situation: Two different voters, from two different towns, have both informed him that they were handed ballots that had Scott Brown's bubble already inked in when they went to vote. Here's the report from the second voter Sargent heard from...

A second voter — Julia Volynskaya, a 34-year-old social worker from Brighton — is now reporting the same experience.

“I was handed a ballot and when I went to fill it out I saw that the bubble next to Brown’s name was already filled in,” Volynskaya, who voted today in Brighton. Election workers, she added, promised her they “were going to look into how this happened.”

The two reports are too anecdotal at this point to make too much of them just yet, but it seems worth noting for the moment. May come in handy later.

A quick follow up, as I'll be on the road for most of today, on the mess I warned about on Friday concerning Tuesday's Special Election for the U.S. Senate in MA, the terrible optical-scan Diebold voting machines in use there, and the company with a dubious, criminal background which sells, services and programs them:

  • Over the weekend, I was briefly interviewed by Joan Brunwasser of OpEd News and Citizens for Election Reform about it all. That interview is now published here...
  • A coalition of election integrity experts have issued an "Orange Alert" about the concerns for tomorrow's election, calling on MA Sec. of State Bill Gavin to take effective action to protect secure chain of custody for ballots, voting machines, tabulators, memory cards, unvoted ballots and all other related materials, and calling on the candidates to NOT CONCEDE until all votes are actually counted accurately and transparently.

'Election Verification Exit Poll' analysis show tallies of 'Marriage Equality Ban' off by 7.5%, as high as 17.7% in some L.A. precincts...

In the November 2008 election, the tabulation of votes for California's Proposition 8 --- the controversial ballot measure which resulted in the repeal of marriage equality by, for the first time, amending the state's constitution to deny the rights of Californians --- was "probably corrupted".

That's the finding of a newly released study issued by a coalition of election integrity organizations, as based on their analysis of an Election Verification Exit Poll conducted in Los Angeles on the day of the 2008 general election. "An investigation is warranted," the study concludes, into the evidence which suggests a likelihood that either "fraud or gross errors" occurred in the tabulation of that specific ballot measure.

The complete 49-page study has now been released on a new website, WasProp8Straight.org.

The poll was conducted on Election Day by Election Defense Alliance, Protect California Ballots, and ElectionIntegrity.org and was designed and researched with the help of at least one well known exit pollster, Ken Warren of St. Louis University's The Warren Poll, for the express purpose of measuring the accuracy of the reported vote count. It functioned beautifully in general, by confirming the results of most of the issues and races on the ballot. On Proposition 4, for example, which concerned a similar hot-button issue --- parental notification for abortion --- polling results and official election results matched within 2%, well within the expected margin of error.

However, for Proposition 8 only, the official results varied from the Election Verification Exit Poll by an average of 7.75% in the 19 precincts polled. In some cases, the discrepancy was as high as 17.7%. That is, of course, far outside of the margin of expected error and certainly worthy of further investigation by officials.

The creators of the poll, along with the analysts of the results and the authors of the study, seem to have gone out of their way to preempt the usual reasons for questioning and/or dismissing the methodology and findings of such polls. Straight-party ticket voters have long been getting screwed by touch-screen voting systems, whether they knew it or not, in election after election, as the systems have failed in various ways in states around the country for years.

But, for a modicum of good news on that front, finally, last week a panel of federal judges in Dallas County, TX, have responded to a lawsuit from the Texas Democratic Party --- who finally bothered to notice the problem --- by halting the use of such systems until corrective action of some sort can be taken. As the Dallas Morning News reported the county's E&S iVotronic touch-screen voting systems have now been decertified for the moment, leading the chair of the Texas Democratic Party to declare a "victory," even as he went on to demonstrate he still seems somewhat unaware of the overall problems of voting at all on such systems...

Anti-trust probes also said underway in 14 states...

On Thursday we reported that Florida's AG office was investigating the recent acquisition of Diebold's voting machine unit by its larger/largest "competitor," ES&S, for possible violations of anti-trust statutes in the state. Today, the New York Post reports that the U.S. Dept. of Justice is also actively investigating the same thing --- along with 14 states in total --- and may "file a suit to unwind the deal" next month...

The Department of Justice could vote down an already-completed merger of the two biggest makers of voting machines.

The Justice Department, Florida and 13 other states have opened investigations into the September marriage between Election Systems & Software and Diebold's Premier Election Solutions, which played a controversial role in the 2004 presidential election, according to a source with direct knowledge of the process.

Sen. Chuck Schumer (D-NY) is planning to hold hearings on the matter next month, the source said.

Even though the merger gave ES&S a whopping 70 percent of the voting-machine market share, the $5 million deal was too small to require government approval.

Now, the Justice Department is looking into the matter and next month could file a suit to unwind the deal, the source said.

Though the Post story seems to be based on a single, unnamed "source," they also note that "A Diebold spokesman confirmed the Ohio ATM maker was cooperating with a Justice Department investigation."

And while there are other "Justice Department investigation[s]" that Diebold is also cooperating with --- as The BRAD BLOG noted early this year, when the company's Chief Financial Officer was forced to stop down: "[Diebold has been] been facing a class-action securities fraud lawsuit from shareholders since 2005; under SEC investigation since 2006; and under DoJ investigation since 2007; and admitted overstating '07 earnings in early 2008" --- Reuters coverage of the story offers more direct confirmation of the DoJ probe of this particular matter. "Diebold spokesman Michael Jacobsen said in an email that the company was cooperating with the Justice Department review of the sale," they report tonight.

BlackBoxVoting.org's Bev Harris deserves much credit here, both for helping to get the anti-trust ball moving when the merger was first announced in September, as we reported at the time, but also for providing the DoJ a great deal of information, statistics, financial and legal analysis demonstrating the monopolistic nature of the sale, and the harm it presents to our already in-tatters system of election in the U.S.. Demon coupling will result in company counting 92% of Sunshine State votes, at least 70% nation wide...

TALLAHASSEE --- Florida Attorney General Bill McCollum is conducting an anti-trust investigation of a voting-machine company merger that would create a near-monopoly over the levers of democracy in Florida and much of the United States.

McCollum's office has issued at least six subpoenas covering every major voting-machine company as part of a civil investigation of Election Systems & Software's $5 million acquisition of Diebold Inc.'s elections division --- a merger that would give a private company too much power over the machines used to cast votes, voting-rights groups say.

``Our office engaged in this issue because anti-competitive behavior can seriously harm consumers,'' McCollum said in a written statement. ``Competitive behavior encourages the best products be available to consumers, including technology, particularly in a market as sensitive as the voting systems market.''

Under the state's 1980 anti-trust law, McCollum could persuade a court to levy fines against ES&S or prevent the company from operating in Florida. By next year, the company is expected to be the exclusive provider of voting machines and services in 65 of the 67 counties in Florida, the nation's most important swing state.

That means, under the acquisition announced Sept. 2, ES&S will provide election services to 92 percent of Florida's 11.2 million voters.

More broadly, ES&S's purchase of the competitor company gives it control of the voting machines in nearly 70 percent of the nation's precincts, according to a federal lawsuit in Delaware filed by a rival company, Hart Intercivic. The U.S. Department of Justice is conducting its own inquiry.

ES&S, of course, told the Herald/Times that their acquisition of Diebold "will result in better products and services for all customers and voters alike." And, if you believe that, we've got an unhackable voting machine to sell you....

Federal body tasked with overseeing U.S. certification of e-voting systems appoints scammer Edwin Smith, VP of e-voting companies Sequoia, Dominion, Hart-Intercivic...

Incredible. This would be the equivalent of appointing the sitting Vice President of Exxon Mobil to an EPA advisory committee, but Ed Smith has now been appointed to the disastrous U.S. Election Assistance Commission's (EAC's) Technical Guidelines Development Committee as one of their new "Technical and Scientific Experts."

From the EAC's email announcement on Friday (posted in full at end of article):

Edwin B. Smith, III, vice president of compliance and certification at Dominion Voting Systems. Before joining Dominion Voting Systems, Mr. Smith was vice president of manufacturing, compliance, quality and certification at Sequoia Voting Systems. He also served as the operations manager at Hart InterCivic and the senior director of operations at K*TEC Electronics. He holds a Master of Business Administration from the University of Phoenix and a Bachelor of Science in engineering technology from Texas A&M.

So Smith went from voting machine company Hart Intercivic to voting machine company Sequoia Voting Systems and is now at voting machine company Dominion Voting Systems, where he is a VP, selling e-voting systems to jurisdictions around the country that receive federal money doled out by the EAC. And now he'll also sit on an advisory board at the EAC helping to advise which one of those companies sees their systems certified for use in U.S. elections by the EAC. Just amazing.

But that's not even half the story of why this is just incredible, and another huge black eye for the EAC. (How many eyes do they have left to blacken at this point?) My new article at NY's 'Gouverneur Times' details months of 'urgent,' but ignored, warnings from election experts...

My latest special to the Right-leaning Gouverneur Times of Upstate NY details multiple "urgent" warnings that state and federal officials received over the last year from multiple election advocacy groups concerning the dangers and pitfalls of the state's e-voting pilot program which came crashing down on voters during the recent NY-23 Special Election for the U.S. House.

They were warned, over and over and over again, about the dangers of using uncertified e-voting systems in real live elections, yet, despite the concerns expressed by experts about using real voters "as guinea pigs," it appears officials took no action in response.

An update to the reports of an e-voting 'virus,' and other failures, in New York's recent Special Election for the U.S. House...

John Conklin, the Director of Public Information for New York State's Board of Elections has now issued a statement in response to the Gouverneur Times' article by Nathan Barker last week, alleging a "VIRUS in the VOTING MACHINES" [caps in original headline] which, the paper says, "tainted the results" of the recent Special Election for the U.S. House in NY's 23rd Congressional district.

We responded to Barker's detailed article ourselves over the weekend at some length, noting both the accurate and inaccurate information and assertions included in the online publication's coverage.

Conklin's response has drawn two responses in turn from the Gouverneur Times, as the right-leaning publication appears to have joined in the fight for election integrity, at least on behalf of their favored Conservative Party candidate whose apparent election loss has indeed been "tainted" by the very same concerns about which The BRAD BLOG has been warning for years. We're happy to see their new-found concerns, even as Republican partisans in political alignment with the Times have been ignoring and/or disparaging similar reports for years following elections in which Democrats have been the apparent victims of similarly failed voting systems...

Recent allegations from the Right of malware on voting machines in New York's November Special Election may be overblown, but the long-overdue general concerns are right on point...

On Thursday, Nathan Barker of upstate New York's Gouverneur Times --- a far-Right online publication (featuring columns by the likes of Michelle Malkin, Oliver North, Chuck Norris, and all the rest of the wingnutters) --- filed a lengthy, and somewhat breathless, report alleging a computer virus had infected several of the new e-voting systems in first-time use during the November 7th Special Election in NY's 23rd Congressional district between Democratic candidate Bill Owens, Conservative Party candidate Doug Hoffman, and Republican Dede Scozzafava (who dropped out of the race just prior to Election Day and threw her support to the Democrat).

Barker charged that a "VIRUS in the VOTING MACHINES" [his caps] resulted in "tainted results," "casting doubt on the accuracy of counts retrieved from any of the machines" used in the election.

Owens was reported to have won the election by a small margin on Election Night --- made smaller as errors were discovered during the post-election canvass --- before being hastily sworn in to the U.S. House just a few days later, in time to provide a crucial Democratic vote in favor of the health care insurance reform bill.

Barker's detailed report clearly offers a hard-right undertone, obviously in support of the Conservative Party candidate Hoffman. The article also advances several unsubstantiated conspiracy theories and features a number of out-and-out inaccuracies as well. A number of the piece's key allegations, though important, are also disputed by election officials, and at least one lead member of New York's election integrity community --- which is, itself, split between supporters of the new optical-scan e-voting systems and those calling for the retention of the Empire State's long-used mechanical lever voting machines.

Nonetheless, Barker raises a number of significant points and important concerns, about which The BRAD BLOG has been warning for years, often in the face of derision, notably from the same Rightwing circles crying foul now, who had previously dismissed such concerns as those of 'tin-foil hat wearing, sore losers and conspiracy theorists' despite actual hard evidence and scientifically-sound details proffered about such concerns.

It's somewhat amusing to see some on the Right, now that they have concerns about a close election, suddenly find religion on the very issues they'd derided as nonsense so stridently in the past. It's very tempting to either disregard them now entirely, or torture them mercilessly on that point. But we'll try to take the high road here since their central concerns, now that they've finally arrived and no matter how long overdue, have been ones that we've shared for years, whether or not they might have stood to adversely affect Democrats, Republicans or independents.

The bottom line is that whether a computer virus, malicious or otherwise, affected the results of the NY-23 Special Election or not --- we've seen no actual evidence that it did, and state officials offer a differing explanation for the e-voting system failures that did occur --- it certainly could have. The direct threat to democracy inherent in the concerns expressed by Barker (whether substantiated or not), underscore the foolishness of using such secret vote-counting systems at all. In New York --- where voters, in real elections, are essentially being forced to serve as beta testers of these new, federally-uncertified systems, made by a company with a long track-record of failure, lies, obfuscation, near-bankruptcy, secretive foreign ownership, election disaster after disaster, and dissembling to the media, as well as federal, state and local officials --- the foolishness is all the more apparent, unnecessary, unfortunate and a clear and present threat to democracy itself...

Court rejects Republican attempt to avoid statutory requirement for verifiable elections results in 2010...

In 2008, election integrity advocates in Tennessee won a hard and long-fought victory as the state legislature finally passed, on a bi-partisan basis, the Tennessee Voter Confidence Act (TVCA) requiring the state's wholly unverifiable touch-screen voting machines to be replaced with precinct-based optical-scan paper balloting in time for the crucial 2010 general election.

But in November of 2008, as the state was still using its completely faith-based electronic voting systems, it somehow managed to buck the national trend as the only state in the nation to see legislative gains for the Republican Party which managed to win a majority in the statehouse in the bargain. Ever since, the GOP majority, along with the Republican Secretary of State and Election Director, have been fighting against implementation of that paper ballot law.

A move in the legislature to delay the law until 2012 was narrowly defeated --- by a single vote --- earlier this year, but the state's Republican apparatchiks have continued attempts to forestall following the rule of law.

Late this week, however, a Nashville judge issued a ruling in a case brought by Common Cause seeking to force Secretary of State Tre Hargett to immediately implement the law he's so far refused to act on...
