We're still having trouble, of late, keeping up with all the chicanery, dirty tricks and skullduggery now rolling across the country. So here, once again is our very quick take on just some of the most noteworthy items over the past few days that you'll want to keep in mind as we creep towards Election Day next Tuesday...

CBS Radio Affiliate in PA Inaccurate Says Photo ID Needed To Vote: "CBS Pittsburgh radio station KDKA...is running an ad claiming that voters will need photo identification to go to the polls on November 6th, despite the fact that while voters may be asked to show ID, it is not required to vote. The ad aired on October 26," despite the fact that it's been almost a month since the PA courts determined that no Photo ID will be necessary to vote this year in the Keystone State. The ad says: "The Voter ID law was just recently signed by the governor ... You're not going to be allowed to vote unless you present an acceptable photo identification. Get to a PennDOT licensing center and get a photo ID at the drivers' license center." The ad is completely inaccurate.

Broward County, FL Early Votes Disappearing?: Just one of the many reasons we advise against early voting, unless it's absolutely necessary: "An analysis of the unofficial totals by early voting location on the Broward Supervisor of Elections website from Saturday, compared to the tallies posted on Sunday, shows that in one location, the E. Pat Larkins Community Center, located on Martin Luther King Blvd. in Pompano Beach, the revised totals showed 1,003 fewer votes. The initial tally reported from the polling place in the heavily black neighborhood showed 2,945 votes, but the revised tally was 1,401. Across the 17 Broward polling locations, 15 saw their vote totals revised, mostly by minute amounts of between 1 and 7 votes. But the three more significant changes, including the addition of 398 votes in Tamarac (a racially mixed community) and adding 99 votes to the totals from Pompano Beach City Hall, whose demographic is majority white." ... Political consultant David Brown, who is working for three Broward candidates, "said that when he inquired about the numbers, he was told by the elections office that the changes had resulted from a 'computer glitch.'"

Loophole in FL Law May Disenfranchise Absentee Voters: Not sure this is necessarily in the "War on Democracy" category, but Michael C. Herron and Daniel A. Smith have found a very interesting, if troubling, quirk in FL law that could result in legal voters being disenfranchised if they cast their absentee ballot and then move to a different county and re-register there before Election Day. Best to read their take to fully appreciate it, though it makes us wonder how many other states around the country have a similar loophole in their absentee ballot and registration laws and how many voters could actually be affected by such a loophole.

Romney Campaign Training WI Poll Watchers to Lie: "One blatant falsehood occurs on page 5 of the training packet, which informed poll watchers that any 'person [who] has been convicted of treason, a felony, or bribery' isn't eligible to vote. This is not true." ... "The training also encouraged volunteers to deceive election workers and the public about who they were associated with. On page 3 of the packet, Romney poll workers were instructed to hide their affiliation with the campaign and told to sign in at the polls as a 'concerned citizen' instead." After the story was published, "the Romney campaign's schedule of poll watcher trainings was changed to private."

Update: Romney Poll Watchers also being mis-trained in Iowa, being told that Photo ID is required to vote there. It isn't.

Keep an Eye on Colorado: So recommends Bev Harris of Black Box Voting, and for very good reason. Not only is CO a key battleground this year, said to be a virtual tie in most of the polls, but "Colorado election integrity and transparency is now officially out the window, with a series of corruption protection rules and new laws." Among those laws? Ballots that can be tied back to the voter; A new law that makes ballots and other election materials no longer public records, at least not before 45 days after an election; Extreme Tea Party Rightwing Sec. of State Scott Gessler's new rules that "remove requirements for continuous video surveillance" under the guise of "cost-saving"; the reduction in the number of so-called tamper-evident seals on voting machines; and more...

GOP Says Votes Flipping From Romney to Obama on Touch-screens in 6 States [PDF]: We've only seen a few reports of this, but don't necessarily doubt it. While, historically, most touch-screen votes flip away from Ds, we've seen reports of them flipping to Ds on a few occasions as well. Either way, these systems are 100% unverifiable (with or without a so-called paper trail print out, as some have) and should never be used in any American election. The GOP has sent their letter to Secretaries of State in NV, OH, KS, MO and CO, and the Executive Dir. of the Election Board in NC. Three of those folks are Ds, three are Rs. The letter requests that they "Make arrangements for additional technicians on Election Day in case of increased calibration problems." Of course, when machines flip votes, they should be taken out of service, not re-calibrated when they are in "Election Mode" and most sensitive to manipulation. The letter also foolishly asks for signs to be posted warning voters to "double-check that the voting machine properly recorded their vote", which is, with these sorts of machines, scientifically impossible.

Legal Voters With Library Cards Forced to Vote Provisionally in Shelby County (Memphis), TN: "A Shelby County election official said voters who are showing up at polls with only a Memphis library card as their photo identification are being given provisional ballots. ... Shelby County Election Commission Chairman Robert Meyers said Monday that he's working to find out how many voters have been given provisional ballots after showing their Memphis library card during early voting ahead of the November 6 election. ... The state Court of Appeals ruled [last] Thursday that a new law requiring voters to show photo ID at the polls is constitutional but also said the library card qualifies as a government-issued photo ID. State election officials filed an appeal with the state Supreme Court on Friday, arguing that the Memphis library ID should not be allowed because it wasn't issued by state government." This Thursday, the Supremes decided that library cards may be used as voting ID, but will review the case in full after the election.

Funder of Those Voter Suppression Billboards in WI and OH Identified: Last week, we told you about those "Voter Fraud" billboards placed throughout minority neighborhoods in OH in WI, by an unnamed family foundation, and that Clear Channel finally agreed to take them down. This week, the folks at theGrio and One Wisconsin Now figured out who paid for them. You'll be shocked to learn it was a Rightwing hedge fund manager who says he was only try to perform a "public service because voter fraud - whether by Republicans or Democrats - undermines our democratic process." He failed to explain why his "public service" billboards only appeared in minority neighborhoods.

One Wisconsin Now notes that "In 2010, [Reince] Priebus [who is from Wisconsin, but is now the RNC Chairman] was cited by name, in an aborted voter caging plot targeting minorities and college students involving the Republican Party of Wisconsin, Americans for Prosperity and Wisconsin's Tea Party leaders, including documents that referenced 'billboards' as part of the scheme multiple times. ... That this anti-American garbage is turning up in other states now that Priebus is running the RNC is of no surprise to us in Wisconsin given his career of scheming to deny legal voters their right to the franchise."

With just 5 days to go until the nation holds its next Presidential Election, power remains out in large swaths of the Eastern Seaboard, according to Google Maps' special Hurricane Sandy power outage map.

The outages persist in a number of states which force the majority of their voters to use 100% unverifiable electronic voting machines to cast their votes at the polls on Election Day. If power is out at the polling place on Election Day in those states, voters may not be able to cast their vote at all.

As we warned before Sandy barreled ashore earlier this week, the ability of voters to vote at all --- presuming polling places are not flooded and voters are able to get to them --- is imperiled by states such as Virginia, Pennsylvania, West Virginia, Maryland, New Jersey, North Carolina and even Ohio, all of which force all, or some of their voters to vote on systems which simply do not work if they do not have power.

While most of those states require a small percentage of emergency paper ballots be made available at the precincts, that number is unlikely to be enough in the event that voting machines are unavailable all day at the polls on November 6th. Moreover, battery backups on the electronic touch-screen systems are unreliable at best and, even when working, can only be counted on for a small number of hours.

In Pennsylvania, for example, as noted yesterday by the Pittsburgh Post-Gazette, "In case of power loss, local election officials are encouraged to keep enough paper ballots on hand for 20 and 25 percent of their registered voters."

While the PA Dept. of State claimed in the same report that voting machines can run on backup batteries "about six hours," a Lehigh County, PA election official offers a more realistic assessment, noting their touch-screen system backup batteries last just 2 and a half hours at best.

The BRAD BLOG has long warned that power loss on Election Day is just another, among a myriad of reasons why forcing voters to use such systems is insane and extraordinarily disrespectful to the electorate in such jurisdictions. Other reasons why these type of voting systems should never be used: They are 100% unverifiable in every case (whether they include a so-called "Voter Verifiable Paper Audit Trail" or not, as some do) and computer scientists and security experts have long warned, in virtually every instance where these type of systems have been examined over the past decade, that they are both prone to failure and easily manipulated, by both election insiders and hackers alike, in ways that are unlikely to ever be detected.

At The Nation today, Ari Berman notes that "Thanks to a wave of new voting restrictions passed by Republicans, the 2012 election was already shaping up to be pretty chaotic before the arrival of Hurricane Sandy, which left 8.2 million households without power in 15 states and the District of Columbia."

He then goes on to detail some of the worst hotspots for concern...

It's that time of year. I've been doing a lot of talking lately, on a bunch of media outlets. That means I haven't been able to write and report here as much as I might like of late. In any case, below is one of those appearances, from earlier today, on RT America with anchor Kristine Frazao, in reference to a Christian Science Monitor article from last Friday, by Mark Clayton, accurately headlined: "Could e-voting machines in Election 2012 be hacked? Yes."

It's nice to see stories we reported here at The BRAD BLOG as long as six years ago, many of them exclusively, finally covered in mainstream media outlets, as the CS Monitor piece does. It's also fun to see them quoting the term "sleepover" --- in regard to vulnerable voting machines being sent home with poll workers for days or weeks before Election Day --- a phrase that this blog has been credited with coining about six years ago as well.

I realize that sounds sarcastic, but I don't actually mean it that way. If it all leads to more public discussion and awareness of these concerns, even six years late and six days before a Presidential Election, when it is, by and large, too late to do a damned thing about any of it before the election, I'll take it --- no matter how late it comes...

Sequoia touch-screen systems, found vulnerable to failure and undetectable manipulation, to be used again in 13 states...

President Barack Obama may have voted for Mitt Romney yesterday when he cast his Early Vote at the Martin Luther King Community Center in Chicago's 4th Ward. Nobody knows for sure. Even him.

He cast his vote on a 100% unverifiable touch-screen e-voting system made by Sequoia Voting Systems (which is now owned by a Canadian firm named Dominion Voting.) It is scientifically impossible to ever know if his vote was recorded accurately, as per his itent, or not on that type of voting system.

"I can't tell you who I voted for," the President joked, as noted by our colleague Mark Crispin Miller in a short blog item today wryly headlined "Obama votes for Romney". The President's joke may not have been nearly as funny as he had intended it.

We confirmed with the Chicago Board of Elections that Early Voters in the Windy City must do so on the oft-failed, incredibly-vulnerable, and easily-hacked (see below for details) Sequoia AVC Edge touch-screen voting system which is still used according to VerifiedVoting.org's database for Early, Disabled-Accessible or Standard polling place voting in some 234 jurisdictions across all or part of some 13 states, including Arizona, California, Colorado, Florida, Illinois, Louisiana, Missouri, New Jersey, Nevada, Pennsylvania, Virginia, Washington and Wisconsin.

On Election Day, the Board's Communication Director told The BRAD BLOG, voters are allowed to vote on their choice of either paper ballots (also tallied by Sequoia's incredibly faulty computer tabulators --- the same ones which announced losing candidates as "winners" in 3 different elections in Palm Beach County, FL earlier this year) or Sequoia's 100% unverifiable AVC Edge touch-screens.

The Intellectual Property of those Sequoia systems is still a proprietary trade secret owned by a Venezuelan firm named Smartmatic, which has been tied to the country's long-time President Hugo Chavez. That point was lied about by Sequoia's then CEO Jack Blaine when he was asked directly about it by a Chicago Alderman some years ago, as The BRAD BLOG detailed exclusively back in 2008.

Sequoia has since been purchased by the Canadian firm Dominion Voting, which also subsequently lied about the company's Intellectual Property being owned by the Chavez-tied company when they announced their takeover of Sequoia in 2010. Dominion confirmed as much when we called them on it after their announcement. And, yes, we are still the only ones to have reported that as well.

A few other quick points of note which should deeply concern every voter in the nation --- of any party, or none at all --- about the 100% unverifiable Sequoia touch-screen voting systems that the President foolishly entrusted yesterday to accurately record his vote...

Once again, as they're coming in too fast for us to fully dig in to most of these, but you should know about them, so here's our quick round-up, for now, of the latest...

Maricopa County, AZ Gives Wrong Election Date to Hispanic Voters. Again.: The largest county in AZ, the one with Phoenix in it, admitted last week that materials for Hispanic voters had incorrectly given the date of the November 6 election as November 8. They said it was a small error that didn't affect a lot of voters. This week, a spokesperson for the Maricopa County Elections Department admits that they did it again: "Yvonne Reed confirms to ABC15 that bookmarks distributed by the elections department incorrectly listed the date of the general election in Spanish as November 8. The flip side of the bookmark correctly lists the date in English as November 6. Reed tells ABC15 the bookmarks were distributed at the three election counters throughout Maricopa County and that the department has no way of knowing exactly how many people received the bookmarks."

13,000 La Porte County, IN Voters Wrongly Purged by GOP Officials: "Back in 2011, some 800 voters were supposed to be purged from the La Porte County voter registration system. Instead, more than 13,000 got the boot and now the voter registration office is scrambling to get them online before Nov. 6." La Porte Dems are calling for a federal investigation. Over at DailyKos, blogger Dan Briggs explains how it happened.

Fake Voter Purge Letters Sent to Florida Voters: The phony letters have shown up in 23 counties, so far, warning voters they have 15 days to show up at the local Supervisor of Elections office and prove their citizenship, or they'll be removed from the rolls. Unlike the very real letters sent in FL Gov. Rick Scott and Sec. of State Ken Detzner's failed "non-citizen" voter purge earlier this year, these letters are forgeries meant to look real. "The letters mimic notices that local election officials did send out to voters this past spring and summer when the state began a process of trying to purge the voter rolls of noncitizens who were illegally registered to vote. The original process, which identified 2,600 voters as noncitizens, was fraught with problems and incorrectly targeted hundreds of naturalized citizens. ... [FL State Dept. Spokesman Chris] Cate said that the department was still collecting information and has notified all the election supervisors of the problem. He urged Florida voters who receive anything similar to contact election officials immediately." On Wednesday, the FBI joined in the investigation.

As we've yet to see a copy of the fake letter or email warning about it sent to FL's county Supervisors of Elections on Monday posted online, we've posted both of them here, since we received a copy from a source earlier this week.

Touch-Screen Vote-flipping in VA: And so it begins again. Expect many more of these in the days ahead, as usual, particularly in states like VA which continue to have so little respect for voters that most are forced to cast their votes on 100% unverifiable touch-screen systems. An email sent to Fairfax County, VA Democrats on Wednesday warns: "We have received several reports of touch screen voting machines switching the names on the ballot before the vote is cast." It goes on to advise voters who experience the problem to "Stop and alert the Election Officer - don't vote on that machine; Record the number of the voting machine; Record the name and phone number of the voter affected" and then to notify the local Democratic office immediately. We'd also add you should notify the Sec. of State, the local media and call 866-OUR-VOTE if this should happen to you.

The Fairfax Dems also offer this very sage advice: "Also, we encourage voters to use paper ballots (optical scan machine) where available." But good luck finding paper ballots in VA. (If you can still vote absentee there, please do, but deliver the paper ballot in person on Election Day, if possible!)

When touch-screen machines flip votes, they should be taken out of service immediately and quarantined. Unfortunately, most election officials allow technicians to try and re-calibrate the machines while they are in "Election Mode" and most vulnerable to manipulation. It's insane. We've been saying the same thing for years now, but few election officials seem to give a damn.

Kochs team up with religious groups to target voters: Our friend journalist Zach Roberts, part of Greg Palast's intrepid team, obtained audio recordings from a fundraiser at a Focus on the Family-related group in Alaska where the man who runs the Rightwing outfit there boasted of their new affiliation with the Koch Brothers, the million-dollar voter targeting database they'd acquired from them, and the fact that, in the wake of Citizens United, political and religious groups may now work together more seamlessly than ever. Said the Alaska Family Council and Alaska Family Action President Jim Minnery at the event: "And so, the organization Alaska Family Action has the same board; I'm still the person in charge of that organization. We literally have to switch the light switch off and on when [laughter from crowd] we have a board meeting, because we have to be a separate nonprofit corporation according to IRS regulations." Also in attendance at the event: former Alaska Lt. Gov. Loren Leman (R) and Alaskan Gov. Sean Parnell (R). Roberts also reports that "Thirty-eight states with 'family healthy councils' across the country are in the midst of forming action groups and working with the Koch brothers' Themis database to target voters." Minnery also told the crowd, when explaining how the Kochs pitched the database to him: "So, they introduced this project to us by basically saying, 'Listen, we know more about you guys than you could ever hope to know, but the good side is, we're going to be able to use this for the glory of God and to get conservatives in power'".

Davidson County (Nashville), TN Poll Workers Being Trained to Turn Away Voters?: "'Poll workers have been trained by the election commission to judge them (voters) by how they sound and how they look to determine their citizenship,' explained Eben Cathy of the Tennessee Immigrant & Refugee Rights Coalition. Cathy's claims are based on a Powerpoint slide shown to poll workers who were trained in Davidson County earlier this month. On the slide, one bullet point states that only US Citizens who are Tennessee residents may vote. Below that are the words 'naturalized citizenship require reading, writing, speaking basic English.'"

Davidson County is also the place where the Republican official in charge of the Board of Elections once told us to our face that "paper ballots are the greatest hoax ever perpetrated on the American people." Funny. Sen. James Inhofe (R-OK) keeps saying it's Global Warming. These guys should have more meetings.

TX AG Threatens to Arrest U.N. Observers: We previously told you that U.N. monitors from the Organization for Security and Cooperation in Europe [OSCE] were planning to observe this year's election, following a request last March by the NAACP and other groups who were (justifiably) concerned about voter suppression. Texas AG Greg Abbot has another idea: "'The OSCE representatives are not authorized by Texas law to enter a polling place. It may be a criminal offense for OSCE's representatives to maintain a presence within 100 feet of a polling place's entrance,' he said. 'Failure to comply with these requirements could subject the OSCE's representatives to criminal prosecution for violating state law.'" --- Um, "may be"? Isn't he the AG? The OSCE responded Wednesday in a letter to Sec. of State Hillary Clinton: "'The United States, like all countries in the OSCE, has an obligation to invite ODIHR observers to observe its elections,' it said. 'The threat of criminal sanctions against OSCE/ODIHR observers is unacceptable.'"

Either way, the U.S. Dept. of Justice is also planning to observe in Texas this year...Unless Abbot thinks they have no right to be there either. Why so worried about people observing at the polls? Got something you don't want them to see, cowboy?

VA County Registrar Incredible Dishonest or Just Stupid: The Washington Post joins the ranks of us "conspiracy theorists" by reporting on concerns about Mitt Romney's business associates and major supporters and their takeover of Hart Intercivic, the nation's third largest voting machine company. But it was the last line of the piece we found the most amusing: "Falls Church [,VA] registrar David Bjerke said that he was aware of the discussion surrounding Hart but that he regarded the system as completely secure. 'There’s no way for the count to be manipulated,' he said."

What a Bjerke.

A few questions for the popular pundit that may help better educate both him and the nation's electorate...

This morning, NBC News' top election expert, Chuck Todd, tweeted the following...

Todd was responding, no doubt, to the many folks who have been justifiably concerned of late, since it was discovered that a bunch of Bain Capital investors, led by Mitt Romney's son Tagg, via a company called H.I.G. Capital (believed to stand for Hart Intercivic Group) took over control of Hart Intercivic, the nation's third largest voting machine company, in 2011.

The Austin-based Hart company, according to VerifiedVoting.org's database, supplies electronic voting machines and paper ballot tabulators that will be used to tally votes in the Presidential Election this year in all or parts of California, Colorado, Hawaii, Illinois, Indiana, Kentucky, Ohio, Oklahoma, Oregon, Pennsylvania, Texas, Virginia and Washington.

I offered my point of view about those concerns earlier this month, explaining that it was not just the private ownership of Hart's machines by Romney backers which voters should be concerned about, but the private ownership of the similar systems in all fifty states that will once again be used to tabulate the results of this year's Presidential Election with little --- and very often zero --- possibility of oversight by the public or even by election officials.

Todd does an extraordinary disservice to the electorate with Tweets like the one above, and I'd be happy to come on his daily MSNBC show any time to explain why, as I have told him via Twitter in response to the above.

As Todd has not responded in kind, and to expand upon my response to Todd there, I'd like to ask him these few respectful questions...

Late last month, Gerry Bello and Bob Fitrakis at FreePress.org broke the story of the Mitt Romney/Bain Capital investment team involved in H.I.G. Capital which, in July of 2011, completed a "strategic investment" to take over a fair share of the Austin-based e-voting machine company Hart Intercivic.

"Several tanker trucks full of political ink have been spilled on Mitt Romney's tenure as a vulture capitalist at Bain Capital," Bello and Fitrakis wrote. "A more important story, however, is the fact that Bain alumni, now raising big money as Romney bundlers are also in the electronic voting machine business. This appears to be a repeat of the infamous former CEO of Diebold Wally O'Dell, who raised money for Bush while his company supplied voting machines and election management software in the 2004 election."

Lee Fang at The Nation recently confirmed the FreePress reporting in a story of his own on the "crony capitalism" of Tagg Romney, whose father's money and high-profile connections present a number of troubling corporate conflicts of interest should Mitt Romney become President. The Daily Dolt also followed up with a very well-documented article on the H.I.G. group, their connections to Bain, and their takeover of Hart Intercivic.

Hart's announcement of the deal describes H.I.G.'s role as as "co-investors", though the financial services firm which brokered the deal described it in their own announcement as a full-fledged acquisition: "Hart Intercivic was acquired by HIG Capital late last week. The deal caps off a 2+ year relationship with Hart! Congrats to both Hart and the HIG team….its going to be a great partnership!"

Also this week, in a video that has gone a bit viral, The David Pakman Show expressed understandable concerns about Romney's close business partners having this type of corporate control over a large e-voting company whose, extremely vulnerable and insecure [PDF] --- and often 100% unverifiable --- voting and tabulation systems are now used, according to VerifiedVoting.org's database, in all or parts of California, Colorado, Hawaii, Illinois, Indiana, Kentucky, Ohio, Oklahoma, Oregon, Pennsylvania, Texas, Virginia and Washington. When the story initially broke, I spoke about it on the radio with Fitrakis, but didn't comment on it at The BRAD BLOG for a number of reasons. One being the time we've been spending, during the same period, consumed by the continuing breaking story of the RNC/Romney consultant Nathan Sproul and his companies at the center of the national GOP Voter Registration Fraud Scandal which we've been covering in detail since it first broke several weeks ago. Secondly, and not to downplay this story, because it's a very good and important one, the fact is that, though the names of the corporate titans and companies are different, it is essentially the same story that we have been telling here, over and over again --- and warning about with hair afire --- at The BRAD BLOG for nearly a decade.

Moreover, I've been on the road all this week for a conference, with much less time online than usual. But since so many folks have picked up on the Romney/Bain/H.I.G./Hart Intercivic stories and have sent email and Twitter queries to me about it, allow me to very quickly share a few thoughts, on this, some of which I sent to a reporter who also raised this issue with me late this week...

'The Art of the Steal'...

I was first interviewed by Anastasia Churkina of RT America, the English language Russian-sponsored cable and satellite news outlet in the U.S., about the failed e-voting systems in this country (and the failed U.S. corporate media as well) back before the 2008 election.

Here we are, four years later, and Churkina has put together another report or RT, for which I was interviewed again, on the same e-voting and e-tabulation concerns. Four years later and things are arguably no better in the U.S. than they were then, except that now we all know even more about the dangers of the oft-failed, easily-manipulated systems which tally votes in all 50 states --- while still having done almost nothing about it. Her new report ran Friday on RT, and afterwards I was interviewed live, via Skype, about it on their Evening News program.

As I noted earlier this week, when running CBS4 Miami's excellent first-in-a-series investigative report on the issue, focus on the serious concerns about computer tabulation failure and malfeasance have been largely lost this year, once again, amidst the continuing (and necessary) focus on rampant GOP voter suppression efforts. So it's nice to see at least a few outlets keeping their eye on this particular ball, even if it always comes way too late --- just weeks before the election --- to do much about it, other than to raise a bit of needed awareness.

I actually feel sorry for Pat Kerby, the Republican delegate to the Republican National Convention from Nevada who attempted to add an amendment calling for paper ballots --- so nobody would have to trust in the "voter machine fairy" --- at the RNC's Platform Committee on Tuesday.

The poor fellow seemed to want the right thing, but by the time other members of the Committee amended the amendment, several times over, the original was completely gutted in favor of electronic computer tallies with no actual way to verify the accuracy of those tallies.

It seems the good-natured Kerby never knew what hit him, as he generously supported each change to his amendment, deferring to others who appeared to know more about voting, like fellow committee member Kansas Sec. of State Kris Kobach (responsible for the state's polling place Photo ID restrictions to help curb non-existent polling place voter fraud in Kansas, as well as serving as the author of Arizona's infamous anti-immigrant "Papers Please" law, most of which was found unconstitutional by the U.S. Supreme Court recently.)

It was a good idea, but Kerby wasn't clear on the exact language he needed to use and that opened up the door for others on the committee --- who have more confidence in unverifiable electronic voting machines than in paper ballots --- to completely gut the original amendment, compared to the one originally introduced during the proceedings.

Kerby's initial amendment read as follows:

We recognize that paper ballots are the best way to insure [sic] a fair election. "Let ambition counter ambition," as Madison said. When all parties have representatives observing the counting of ballots in a transparent process, integrity is assured. We strongly suggest that all electronic voting systems have a printed paper ballot so that preliminary electronic results can be verified by a hard count of paper ballots.

While (most) electronic voting systems don't print "paper ballots" in general --- they print so-called "Voter-Verifiable Paper Audit Trails" (VVPATs) which may or may not reflect the actual intent of the voter, may or may not be verified by the voter as accurate, and are not actually counted by anyone, in any case (the internally recorded electronic results are used instead) --- it seems as if Kerby had the right idea, in general. At least as he offered a perfect description of his reasons for wanting to add include the amendment in the party's platform...

Or, 'Still Whistling Past Democracy's Graveyard'...

In case you're wondering, it's not just The BRAD BLOG trying to warn folks on the Right, Left and everywhere in between of the pending disasters of our oft-failed, almost always wholly-unverified and quickly disappearing system of once-overseeable, theoretically-democratic system of electoral self-governance.

As Steven Rosenfeld, veteran journalist of the 2004 Ohio mess, writes this week at Alternet in "Not Again! How Our Voting System Is Ripe For Theft and Meltdown in 2012" [emphasis added]:

"We need good technology and we need good laws," said Barbara Simons. The retired IBM computer scientist and nationally known expert on voting technology is co-author of a new book, Broken Ballots: Will Your Vote Count? which details America's history of voting machinery and election administration, and concludes that many states have neither good technology nor good vote count rules.

"We are running elections in this country as if we are still in the 19th century," she said. "The results are announced and there is no verification. At minimum, we should be doing manual post-election ballot audits for all major elections whether or not the results are close, because there even could be a major problem with an election with a wide margin."

Rosenfeld covers a lot of ground in his piece, so you should read it in full.

That said, as much ground as he covers, he and the experts he quotes still manage to understate the concerns, while failing to define what, in nearly a decade on this beat we have found, so far, to be the only apparent solution: Hand-marked paper ballots counted publicly, by hand, on Election Night, at the precinct, in front of all parties, observers and video cameras, with decentralized results posted at those precincts, before ballots are allowed to move anywhere.

You have been warned. Again.

Now back to your bickering about off-shore bank accounts and "socialism", or whatever it is you feel your time is better spent on between now and November 6.

Breaking from today's Irish Times...

In a final vote of no confidence, Ireland’s ill-fated e-voting machines are finally headed to the scrap heap.

An Offaly-based firm, KMK Metals Recycling, was declared the Government’s preferred bidder out of seven tenders.

The company paid a mere €70,267 for the machines – a steal when one considers the €55 million they have cost the State to date. The price paid also works out at just half the annual €140,000 cost of storing them.

Minister for the Environment Phil Hogan said he was “glad to bring this sorry episode to a conclusion on behalf of the taxpayer”.

“From the outset, this project was ill-conceived and poorly delivered by my political predecessors and as a result it has cost the taxpayer €55 million.

“While this is a scandalous waste of public money, I am happy to say that we will not incur any further costs in the disposal of the machines,” he said.

To help put those costs in perspective, 55 million Euro --- the cost of the systems to the state of Ireland to date --- is about $69.5 million.

In this country, the U.S. wasted almost $4 billion (with a "b"), via the Help American Vote Act (HAVA) of 2002, on the very same type of worthless, unreliable, easily hacked machines that the Irish are smart enough to get rid of entirely...

Is that even plausible?...

Earlier today, we highlighted Rachel Maddow's latest report on the "GOP War on Voting" which, among many other important things, referenced the ridiculously close results from Ohio's GOP Presidential Primary last Tuesday as currently reported, and the fact that there are still a bunch of untallied votes there even today for some unknown reason. Her point in noting the slim margin is to underscore the very serious effect that new Republican voter-suppression laws are likely to have on not just the Presidential race this year, but also on State and local races as well.

But one of the items she does not note about Ohio's reported tally, and which I've been trying to get more information on since Tuesday night, is some of the actual reported numbers out of the U.S. House Primary race between progressive Reps. Marcy Kaptur and Dennis Kucinich. Their Congressional Districts were combined by the recent Republican redistricting there, so they were forced to face off in last Tuesday Democratic primary.

Kaptur reportedly won the race, according to the numbers posted on the Ohio Sec. of State's website. Those results, summarizing the numbers in each of the five districts which now make up Ohio's new 9th Congressional District, include these reported results out of Lucas County (Toledo):

Now Toledo is Kaptur's current district, so it might make sense for her to win a lopsided victory there. Kucinich reportedly won handily in his own Cuyahoga County district of Cleveland by a 72.5% to 24% margin.

But really? 94% to 3.7% over Kucinich in Lucas County? 22,269 votes to just 870 votes? Those are Saddam Hussein-like numbers. Are they even plausible? I've been trying to learn more and would certainly welcome any input from folks who know the politics in that area of the state better than I do. If there is a perfectly reasonable explanation for those results, I'm certainly open to hearing it.

Unfortunately, all Lucas County voters are forced to vote on 100% unverifiable Diebold touch-screen voting machines on Election Day. So whatever the numbers really should have been will ultimately remain unknown, as it's strictly impossible to determine if even one vote, ever cast on any such voting machine, for any candidate or initiative on any ballot, in any election, has ever been recorded accurately as per any voter's intent.

Some 20 to 30% of voters across the nation will still be forced --- shamefully, even after all that we now know about these oft-failed, easily-hacked machines --- to cast their ballots on the very same and other similarly 100% unverifiable voting systems on Election Day during the 2012 Presidential Election.

Computer expert: 'Secure Internet Voting' is a bit like the phrase 'safe cigarettes'...

Brad Friedman has often compared the task of Election Integrity (EI) advocates to a game of Whac-A-Mole. One moment they expose an "it's the machines transparency, stupid" moment when the 100% unverifiable ES&S iVotronic touchscreens announced that the unemployed and virtually unknown Alvin Greene had somehow defeated the respected circuit judge and former state legislator Vic Rawl in the 2010 South Carolina Senate Democratic Primary. The next moment we learned that DC officials had planned a live experiment to use "an untested and unverifiable Internet Voting scheme on real voters, in a real election…" --- an experiment that Friedman described as "insane."

More than 16 months after that disastrous experiment came to a crashing halt following a spectacular hack, as initially reported by The BRAD BLOG, the PBS News Hour produced a short documentary, Internet Voting: Will Democracy or Hackers Win? (see video below), which touched upon the D.C. Internet Voting Hack.

The now-legendary hack was carried out by a team of white-hat hackers, led by Univ. of MI Computer Science Prof. J. Alex Halderman. Within hours after D.C.'s 2010 Internet Voting scheme was opened to the world for a hack test (just days before it was scheduled to go live for the real thing), Halderman and his team of U. of M. students found and exploited a vulnerability which gave his group almost total control of the server software, allowing them to rewrite every single ballot and even take over command of the security cameras inside the D.C. server room. Team Halderman not only acquired the ability to change votes and install the Univ. of MI fight song to be played at the end of every vote cast, but discovered and thwarted an intrusion attempt by Chinese and Iranian computers.

Disturbingly, the new PBS documentary also reveals that, despite the spectacular failure and warnings from virtually every computer science and security expert, election and Pentagon officials are still pressing forward with what MIT Prof. of Electrical Engineering and Computer Science Ronald L. Rivest describes, as seen in the short PBS report, as an "oxytopian" solution. "'Secure Internet voting,'" Rivest charges, "is a bit like the phrase 'safe cigarettes'"...

There are at least a dozen things in this story out of Indiana that make my head wanna explode. I don't have time to really detail any of them in depth for the moment, so check it out in full if you're inclined and might like your head to explode too.

But one graf in the piece is begging me to highlight it.

The story, as I say, is about Indiana where, apparently, votes cast during the Early Voting period are considered to be Absentee Votes for some reason. Voting during the Early Voting period takes place on 100% unverifiable touch-screen voting machines (head, explode) in Indiana at Vote Centers. State law requires that Absentee Votes be identifiable --- in other words, that they can be tied to the person who cast them --- so that if a voter should die between the time they cast his/her vote and Election Day, officials are able to go in and remove the vote (kapow).

That is done --- with the Early/Absentee Votes cast on touch-screen machines --- by including an ID Number on each ballot which, some might accurately point out, robs the voter of a secret vote in the bargain (boom).

That's the background for the story. But then comes this remarkable comment, included as part of the explanation of what happens when/if a person dies before Election Day and their ballot must be removed [emphasis added]:

"There are checks and balances. The bipartisan [election] board would tell the vendor to cancel a number," [Wayne County Clerk Jo Ann] Stewart said. "The clerk can't individually go in and cancel a vote. I don't have the password. Only the vendor has it to protect the integrity of the election."

KABOOM!

My suggestion for a new Indiana state motto: "In Vendors We Trust".

What could possibly go wrong?

The voting systems in use for the nation's first three all-important electoral contests in the 2012 primary --- from Iowa to New Hampshire to Saturday's South Carolina Primary --- go from pretty great to intolerably horrible. And then comes Florida, which deserves its very own special category, thereafter.

The "First-in-the-Nation" caucuses in Iowa allowed voters to vote on hand-marked paper ballots, counted by hand in front of the public at the caucus site, with results announced to everyone right then and there before being called in to GOP headquarters and before ballots were move anywhere. The wonderfully transparent system allowed for Republican voters by the Iowa GOP (which they hypocritically fight against allowing for everybody else in other states, and even in their own during general elections) is just about as close as we general get in this country to Democracy's Gold Standard. It's also what allowed reporting errors to be discovered and confirmed by the public after an election with some 122,000 votes counted transparently within an hour or so of polls closing, leading to almost nobody charging "fraud" even though just 34 votes are said to separate first and second place in the certified results of the impossibly, and historically, close election.

As of the "First-in-the-Nation" primary in New Hampshire, however, election transparency for voters and their ability to oversee their own elections began to disappear. While a lucky 10% of voters enjoyed hand-marked, publicly hand-counted paper ballots, the rest of the state's voters were allowed to vote on hand-marked paper ballots, but forced to tolerate secret tabulation on oft-failed, easily-manipulated Diebold optical-scan systems programmed by a company (LHS) with a history of criminal behavior and convictions. The results from those 90% of Granite State voters may have been tallied accurately by the Diebold op-scanners or, as seen in the disastrous 2008 Presidential Primary, not. Since NH doesn't bother to actually check to see if their machines tallied the hand-marked paper ballots correctly, we're unlikely to ever know if they did --- barring a recount request where, by then, the secure chain of custody of the paper ballots would be uncertain (to put it mildly.)

And now we come to the "First-in-the-South" Republican primary in South Carolina, where all evidence of how voters vote disappears entirely as the voters will be forced across the entire state to vote on easily-manipulated, oft-failed, 100% unverifiable touch-screen voting systems made by the nation's largest voting machine company, ES&S. When the machine-reported results are announced tomorrow night they will either be accurate or not. Either way, there will never be a way for anybody to know one way or the other as there will be nothing to prove how voters voted and nothing to "recount", even if anybody wanted to.

Appropriately enough, perhaps, Saturday's primary in the Palmetto State will offer 100% "faith-based" voting, since it will be scientifically impossible to prove that even a single vote for any candidate on the ballot has been recorded accurately by the ES&S iVotronic touch-screens as per any voter's intent. Known what we mean, Alvin Greene?...
