And a Concession in New Mexico...Despite Our Own Personal Best Efforts...
By Brad Friedman on 11/22/2006 1:54pm PT

Of course, we've been covering Christine Jennings's (D) refusal to concede and her stand in favor of the voters in the FL-13 fiasco. And though we haven't mentioned it lately, vote-rigging whistleblower Clint Curtis (D), rather than conceding, is convening a group of volunteers to verify the reported "results" of his race against the corrupt Tom Feeney (R) in FL-24.

But several other House candidates, from North Carolina to Ohio (but not New Mexico), are still fighting to assure the voice of the voters is accurately heard...

Second Member of State-Convened Investigative Panel Charged With Having 'Vested Interested' in Demonstrating That the Failed ES&S Touch-Screen Voting Systems 'Functioned Properly'...
By Brad Friedman on 11/22/2006 1:19pm PT

Sarasota's Herald-Tribune has emerged as the bible of local, and in-depth, coverage in the FL-13 undervote fiasco. Today, however, the Orlando Sentinel published the results of an audit of "records of 17,846 touch-screen ballots that included no vote in the tightly contested 13th District congressional race to determine whom voters selected in other major races." They find that those ballots strongly favored the Democrats:

The group of nearly 18,000 voters that registered no choice in Sarasota's disputed congressional election solidly backed Democratic candidates in all five of Florida's statewide races, an Orlando Sentinel analysis of ballot data shows.

Among these voters, even the weakest Democrat --- agriculture-commissioner candidate Eric Copeland --- outpaced a much-better-known Republican incumbent by 551 votes.

The trend, which continues up the ticket to the race for governor and U.S. Senate, suggests that if votes were truly cast and lost --- as Democrat Christine Jennings maintains --- they were votes that likely cost her the congressional election.

The Herald-Tribune editorial board today correctly writes that "Jennings Should Not Concede" as they argue there is "too much room for doubt about election's true outcome."

And finally, for the moment, one of the groups involved in the voter lawsuit --- which calls for an investigation and a revote in the election where 18,000 votes went "missing" with the margin between the two leading candidates at just below 400 votes --- charges that the state-convened audit committee is cooked (no suprise, this is Florida after all). In a news release sent to us moments ago, and posted in full below, People for the American Way reports that committee member David Drury, the man responsible for certifying voting machines for the state of Florida, clearly has "a vested interest in finding that the [paperless ES&S touchscreen machines used in FL-13, which] he certified functioned properly." Additionally, the PFAW release points out, Drury is also responsible for approving the shipment and "illegal distribution" of uncertified voting machines to the state of Florida.

Oh, and Sarasota County's Supervisor of Elections, Kathy Dent, has still not resigned. Just thought we'd mention that.

The complete PFAW press release follows in full below...

Complaint and Press Release from Election Integrity Groups Posted Here in Full
PLUS VIDEO: Republican Election Supervisor Dent Failed to Take Corrective Action Before the Election, While Democrat Jennings --- and Her REPUBLICAN(!) Attorney --- Stand Very Tall...
By Brad Friedman on 11/21/2006 1:51pm PT
"The voters of Sarasota and of the entire country deserve answers about what went wrong with this voting system. This is not about Democrats, this is not about Republicans. It's about fixing a voting system that appears to be broken.

I believe we all feel strongly that our next representative to the U.S. Congress should be chosen by the will of the people and not by a problem in the voting machines.

I am committed to seeing that the will of the voters is carried out in this election of 2006. I will not rest until the intended votes are counted and every person's vote is counted and reflected accurately."

-- Christine Jennings (D), Press Conference, Sarasota Florida, 11/21/06

Details follow below the fold on the voters' lawsuit filed today calling for an investigation and full re-vote in the FL-13 U.S. House race between Christine Jennings (D) and Vern Buchanan (R). There are currently 363 votes between the two of them, with more than 18,000 votes unaccounted for on the paperless ES&S touch-screen systems used in Sarasota County. We'd give more of a recap of our story so far, but the press release from the four non-partisan groups who filed the case --- Voter Action, Electronic Frontier Foundation, ACLU, and People for the American Way (Florida) --- does a great job in summarizing the issues. We recommend you give it a read.

For our complete FL-13 coverage, you may click here for all of our stories to date, in reverse order.

UPDATE: The full complaint is now available for download here [PDF].

One point, however, to make clear, especially in light of the many calls for Sarasota County Supervisor of Elections, Kathy Dent, to take responsbility for the disastrous administration of this election by resigning immediately: the press release notes that the legal complaint charges "misconduct by election officials" and "evidence that legal votes were rejected in sufficient numbers to place in doubt the outcome of the election.":

The voters’ lawsuit cites misconduct of election officials, including the failure of Sarasota Supervisor of Elections Kathy Dent, to adequately investigate, identify or report equipment malfunctions, software malfunctions, or ballot layout errors in the ES&S iVotronic touch screen voting machines, even after receiving numerous complaints about the machines from voters and poll workers during the two week period of early voting.

Indeed, Dent knew about the problem well before Election Day, according to her statement on this video, and yet clearly failed to take appropriate remedial steps before 18,000+ votes were lost to the ether in her paperless ES&S touch-screen voting machines.

By the way, the Democratic candidate Jennings held a press conference herself yesterday (video here) --- along with her Republican(!) attorney --- and answered to Buchanan's obnoxious press conference held earlier in the day (we covered that here.)

As far as we're concerned, Jennings, in making her pledge that she "will not rest until the intended votes are counted and every person's vote is counted and reflected accurately" --- along with her courage in not allowing herself to be pushed around by the anti-democratic thuggery of her opponent --- has shown herself to be the model of what every candidate ought to look and sound like in the wake of such a horrendously administered election, in which the ability to determine the will of the people has been so clearly subverted.

The press release from the groups filing a lawsuit on behalf of Florida's voters follows in full...

ALSO: Non-Partisan Election Integrity Groups To Sue for Revote in U.S. House Race, Announce Press Conference (News Release Posted Here in Full)
By Brad Friedman on 11/20/2006 3:12pm PT

Below are screenshots from the much-discussed first two pages of the Sarasota, Florida, ballot as seen on the paperless ES&S touch-screens on November 7th, 2006. Some 18,000 voters did not register a vote in the 13th Congressional district race between Christine Jennings and Vern Buchanan. Or, at least, the ES&S voting machines failed to register their vote in any case.

When we first received these screenshots, it took us three or four times scrolling through them before we could even find the Jennings/Buchanan race. But see below and decide for yourselves.

Several non-partisan Election Integrity groups will be filing suit tomorrow in Florida to call for a re-vote in the election. The public-interest watchdog groups claim that voters were disenfranchised by the thousands in the race due to poor ballot design and a faulty voting system. A press conference tomorrow has been scheduled for Tuesday at 1pm ET on the steps of the Sarasota County Courthouse (the news release announcing the presser is posted in full at the end of this article).

A lawsuit contesting the results and calling for a new election was filed this morning by Jennings and, as The BRAD BLOG reported earlier today, Buchanan held a press conference this morning in which he called on Jennings to "stop listening" to the Election Integrity groups which he says "have hijacked the election." (Full video, transcript here.)

Buchanan's call for Jennings to concede comes despite the 18,000 lost votes and the microscopic 367 vote margin between the two of them as reported in the now-officially certified results.

Full-sized screenshots of the complete ballot can be downloaded here [PDF, 7.5mb]. Screenshots of the first two pages, resized to fit on The BRAD BLOG --- where the Jennings/Buchanan race can be seen spilling over to the second page of the "ballot," above the more clearly defined "STATE" races follow...

Transcript, Video of Buchanan's Morning Press Conference After Florida Certifies Race with 369 Vote Margin...
By Brad Friedman on 11/20/2006 1:57pm PT

UPDATE: Screenshots from the paperless ES&S voting systems, showing the controversial placement of the Jennings/Buchanan race on the ballot in Sarasota County only, are now posted EXCLUSIVELY here.

In a press conference this morning, Vern Buchanan (R) called on Christine Jennings (D) to concede in the race for the U.S. House in Florida's 13th Congressional district. In a process right out of the Bush/Cheney 2000 Florida Election debacle, the state of Florida certified the race today despite a 369 vote difference between the two and more than 18,000 still-unexplained "undervotes" registered on the paperless ES&S touch-screen voting machines used in Sarasota County.

A video of Buchanan's press conference is here. A complete transcript of his obnoxious statement follows at the end of this article.

We've stayed out of the "politics" in this race up until now, arguing only that the voters of FL-13 should have their voice heard despite overwhelming evidence of voting machine malfunction. However, given Buchanan's regrettable despicable attack on Jennings in his news conference this morning and, even more so, his attack on the non-partisan groups currently fighting for electoral integrity in the race, we've little choice but to point out the emergence of Buchanan as yet another democracy hater in Florida following the Bush/Cheney 2000 playbook almost to the reprehensible letter.

Putting his own self-interest before that of the public's, Buchanan called on Jennings "to put the interest of the public before her own self-interest," and called on his Democratic opponent --- ironcially fighting for the old seat of outgoing Katherine Harris --- to concede.

Buchanan characterized the contest filed today in court by Jennings (as we reported yesterday would be "coming soon") as "baseless litigation" and said that it's time for her to "stop listening to high-priced lawyers and out of town special interest groups who have hijacked the process to advance their own agenda."

Hijacked the process to advance their own agenda?!

Candidate, as well as Non-Partisan Groups, Lining up for Legal Action, Demanding Investigation, Re-Vote, Accountability
Election Supervisor Kathy Dent --- Directly Responsible for the Mess --- Has Yet to Resign...
By Brad Friedman on 11/19/2006 3:28pm PT

The BRAD BLOG has learned that several lawsuits are likely to be launched this week in the Sarasota, Florida, election meltdown where some 18,000 votes failed to register on the county's paperless ES&S touch-screen voting systems on November 7th. Fewer than 400 votes currently divide candidates Vern Buchanan (R) and Christine Jennings (D), who are vying to fill disgraced former Sec. of State Katherine Harris's U.S. House seat in Florida's 13th congressional district.

A number of sources have confirmed to The BRAD BLOG that Jennings's legal team --- who previously filed court papers to impound voting machines and data for a possible investigation --- are preparing to file legal action to challenge the legitimacy of the race, perhaps as soon as this week.

As well, non-partisan legal election watchdog VoterAction.org has announced they will be filing suit this week along with People for the American Way Foundation, the ACLU of Florida, the Electronic Frontier Foundation, and Common Cause. Velvet Revolution.us (of which The BRAD BLOG is a co-founder) is also joining in support of the action. A plea to citizens by Voter Action, seeking help in funding the lawsuit, follows in full at the end of this article.

This graf, from Voter Action's announcement, is of particular note in light of our own previous call for the resignation of Sarasota's atrocious Supervisor of Elections, Kathy Dent --- the person responsible, perhaps more than any other, for leading her constituents into this otherwise avoidable debacle [emphasis in original]:

This is an unparalleled opportunity to shed light on the continuing election crisis that plagues Florida, to expose the problems inherent in electronic voting systems, and to demonstrate the harm that can be caused by elections officials with a pro-vendor and anti-voter bias.

Sarasota's Herald-Tribune has been doing a very good job of covering the mess since it happened (if not prior to its occurring when something might actually have been done to avoid it).

Today, Herald-Trib columnist Rich Brooks joins the drumbeat of those calling for a full re-vote, writing this weekend: "[I]t's clear that a special election is needed to ensure a fair process. That's preferable to sending the wrong representative to Washington."

In an article on the many phone calls received from Sarasota voters detailing their experiences in trying to vote in the 13th District race, the Herald-Tribune reports today:

The vast majority of voters interviewed by the Herald-Tribune reported one of two major problems.

Either they couldn't find the District 13 race as they scrolled through their voting screens (about 36 percent) or their votes for either candidate did not initially register on the ballot summary page (more than 62 percent).
...
[M]any of the voters interviewed bristled at the notion that they were somehow careless or clueless and thus missed the race. Most of them --- ranging in age from 19 to 91 --- were keenly interested in the race and were familiar with touch-screen technology.
...
The most prevalent problem callers reported encountering happened when they touched a candidate's name, only to find that their vote hadn't registered on the ballot review page

Clearly, had Dent simply chosen a voting technology that would have allowed voters to express their intent on a paper ballot, this mess could never have occurred. Dent has gone out of her way for years to ensure that Sarasota voters would have no way of avoiding the problem they now face. Hopefully the courts will offer a way for the voters to express their actual intent in this important House election.

And the most important hope of all: That this election underscores everything that is wrong with E-Voting in our country and that we must do away (at the very least) with touch-screen voting systems...with or without a "paper trail."

Voter Action's announcement of their intended legal action and a plea for support follows in full...

MadCow Morning News Exposé on How Things Went South Down in Florida's 13th Congressional District...
By Brad Friedman on 11/17/2006 4:35pm PT

In a nifty and well-sourced bit of investigative journalism that makes The BRAD BLOG's muckracking heart go pitter-patter, an outfit known as Madcow Morning News (we wish they were called Washington Post) filed a peach of an exposé last Wednesday on Sarasota County's Supervisor of Elections Kathy Dent, and Gary L. Greenhalgh, the ES&S voting machine company Vice-President with the questionable past, who appears to have serviced her.

The detailed reporting underscores our previous call for Dent to resign in light of her egregious failures in Florida's 13th district U.S. House race, where the voters are still paying the price. Please do yourself a favor and read the report in full.

Here's a few Dent money shots:

Ironically, while lobbying Sarasota County Commissioners in a successful campaign to spend millions on new touch screen electronic voting machines in 2001, one of Dent's primary arguments was that the new machines would lower the rate of uncounted votes, which then stood at barely one percent, versus the 13% undervote in the election last week.

"I do think we're going to see those numbers drop," Dent told Commissioners. "We're looking more for accuracy and the confidence that the voters have in the system."

And this ironic plum from Greelhalgh --- whom Madcow reports as regularly being in perilously close proximity to those convicted of bribery and other kickbacks to elections officials --- from back in 1985:

"The problem with computer-assisted voting systems is that they centralize the opportunity for fraud," Greenhalgh said, in a July 29, 1985 story in the New York Times.

"There is a massive potential for problems."

Reported the Times: "Mr. Greenhalgh said that while lever-type voting machines could have their counts rigged only machine by machine, counting votes by computer was done at one central site in most counties."

BRAD BLOG: New Mexico's 1st Congressional District Should Be Re-Counted by Hand in Full!
By Brad Friedman on 11/17/2006 3:50pm PT

We hate to rely on such questionable fringe sources as Associated Press, but for lack of time today, we'll point to their coverage of the remaining "handful of close contests for the House" which are still undecided.

The races that AP describes as "still in dispute" are in NM, NC, FL, and two in OH (naturally).

In addition to the completely obvious and resignation-worthy mess in the FL-13 race, The BRAD BLOG would draw particular attention to the less-discussed contest in New Mexico's 1st Congressional district. We've been plowing through first-hand accounts sent our way detailing the disasterous state of conditions in the counting rooms out there where there's a very close race between incumbent Rep. Heather Wilson (R) and her opponent Patricia Madrid (D).

Based on the exceedingly detailed reports we've read so far of the (ahem) less-than-optimal-or-accurate initial tally of votes (yes, Bernalillo County, we're talking to you), we'd suggest any recount of that race must be done as a complete hand count of all ballots in order to assure the final result actually resembles the intention of New Mexico's voters.

But we just may be radical that way.

The BRAD BLOG Joins the Call and Demands Supervisor of Elections Kathy Dent and Other Florida Officials Resign Immediately in Wake of Anti-Democracy Debacle...
Enough is Enough. [UPDATE: Three More Groups Join Call for Revote, Investigation]
By Brad Friedman on 11/16/2006 3:26pm PT

More and more Election Integrity advocates and groups are now joining the drumbeat calling for a complete re-vote on paper ballots in the mess that has become U.S. House race in Florida's 13th congressional district in Sarasota. The BRAD BLOG also calls for a complete paper-based revote as the only way to ensure the voter's voice will be heard.

There are fewer than 400 votes separating Vern Buchanan (R) and Christine Jennings (D) in the race to fill (ironically enough) former SoS Katherine Harris's seat. And yet, a full 18,000 votes have gone missing, recorded as undervotes on the paperless ES&S touch-screen systems that failed during the election.

The People for the American Way Florida have issued a press release (posted in full at the end of this article) calling for a complete re-vote, as well as expressing their criticism of the Jeb Bush Administration appointment of a rabid Bush-partisan and paper "trail" opponent to head an audit to figure out what went wrong.

The National Voting Rights Institute yesterday called for a full re-vote as well, saying in their press release, "Public confidence in the vote-counting process is a bedrock principle of any democracy. In Florida's 13th Congressional District, it is clear that only a revote with the option of hand-recorded paper ballots will ensure that voters in that district can trust that their votes will be properly counted."

Common Cause has similarly called for an investigation into what happened in FL-13 and said the vote should not be certified as is. As well, their announcement calls for the immediate passage of Rep. Rush Holt's (D-NJ) HR550 election reform legislation, which is currently supported by some 220 bi-partisan House members. Unfortunately, HR550 would not have guaranteed the problems in FL-13 would have been avoided, as it only calls for paper records as opposed to the much needed paper ballot required for every vote cast. So-called paper "trails" on the touch-screen systems down in Florida would not have avoided the problem we're now facing and, in fact, would likely have exacerbated them by giving voters and elections officials a false sense of security. Paper "trails" on touch-screen DRE machines are not reliable or accurate, they fail consistently, can be gamed quite easily, and frequently cannot be actually verified by the voters.

Finally, Election Integrity organization VelvetRevolution.us (of which The BRAD BLOG is co-founder) goes further still in both calling for a full paper-based re-vote as well as demanding the resignation of failed Sarasota Supervisor of Elections, Kathy Dent.

Dent failed the voters in Flordia's 13th district and across the entire county, by fighting to ensure they would not have any means of avoiding such problems when she insisted on untested, inaccurate electronic touch-screen systems without paper ballots --- or even paper trails that could have been used to mitigate a disaster such as the one now facing her.

She should resign immediately, along with Secretary of State Sue M. Cobb and the other officials directly responsible for this debacle.

The full press release from People For the American Way Florida follows below...

UPDATE 5:00pm Three more groups, Voter Action, ACLU, and Electronic Frontier Foundation, also now announce their call for a re-vote and investigation. Their press release follows in full below now as well...

Will Other Elections Officials Across Country Have Decency to Do Same?
By Brad Friedman on 11/14/2006 6:09pm PT

In what ought to be the first of a wave of resignations by Elections Officials across the country who have utterly failed the very voters they are supposed to be serving, one of three commissioners of the Denver Board of Elections has resigned today in the wake of the city's e-voting meltdown last Tuesday. He has apparently shown a measure of grace and responsibility far too rare in most Elections Officials...

Denver Clerk and Recorder Wayne Vaden resigned today amid chaos in the Denver Election Commission which he oversees.

Citing his belief "that accountability is the underpinning of honorable public service," Vaden said he was resigning from a "personal disappointment over my efforts" with the commission.
...
The resignation came exactly one week after a disastrous election in which absentee and provisional ballots still haven't been counted. Computer glitches caused voters to wait in line up to three hours. Many complained they were unable to wait that long and thus were unable to vote.

[Denver Mayor John] Hickenlooper acknowledged Vaden's frustrations, adding that Vaden's acceptance of responsibility without blaming others "is a reflection of his strong character and commitment to Denver."
...
Vaden, as clerk, was one of three election commissioners overseeing the voting process for Denver's 350,000 registered voters. The two other commissioners, Sandy Adams and Susan Rogers, are elected.

Of course, apparently the Washington Post --- who editorialized on Sunday that "the system worked" --- doesn't read the Denver Post, so they don't know about Denver's "disastrous election." Or they simply don't care.

We've come to expect such failures from the country's national media, but the larger question now remains: will other failed Election Administrators have the decency to do what Mr. Vaden did?...

Legal Resources Being Gathered by National Party to Challenge Close Elections Where Dems Currently Trail
Other Candidates, Citing Concerns About Voting Machine Failures, Also Refusing to Concede Until All Votes Can Be Verified...
By Brad Friedman on 11/14/2006 3:22pm PT

Just off the phone from a DNC insider --- very much in a position to know --- who says the following races are being considered, as of this afternoon, to still be very much in play by the DNC (* = Incumbent, Results shown latest reported by state websites as available):

NC-8: Larry Kissel (D) 60,016 / Robin Hayes (R)* 60,481
CT-2: Joe Courtney (D) 121,321 / Rob Simmons (R)* 121,151
FL-13: Christine Jennings (D) 118,739 / Vern Buchanan (R) 119,116
NM-1: Patricia A. Madrid (D) 103,376 / Heather Wilson (R)* 104,863
OH-15: Mary Jo Kilroy (D) 98,100 / Deborah Pryce (R)* 101,636
OH-2: Victoria Wulson (D) 112,952 / Jean Schmidt (R)* 115,817

The source believes that all of the above races, each of them currently very, very close, are winnable and the feeling is that they "could easily win three of those six."

In each --- except for CT-2, where Courtney is leading --- the Democratic candidate is currently trailing in the reported results as absentee, provisional, and paper ballots are still be canvassed. As well, challenges and recounts are underway in some of those races (we hope to have more detail shortly here on a couple of those races).

(UPDATE: Several readers have written to ask if other races beyond those mentioned above --- such as the U.S. House race in Washington state's 8th Congressional district between Democrat Darcy Burner and Republican Dave Reichert --- are now off the table as far as the DNC is concerned. The races reported above are the only ones named explicitly to us by the DNC sources. However, two different sources there have confirmed that they are largely driven by the folks on the ground in the states, and would urge that noise be made locally --- and loudly enough that higher-ups might hear it at the DNC --- in order to gain more attention from the national party to other such races still of concern.)

The source also adds that the DNC is considering whether or not to ask for contributions from the public to a legal fund to assure they will have the funds needed to provide full legal resources to thoroughly challenge each of those races.

As well, The BRAD BLOG has also learned the DNC is still keeping their eyes on the Colorado Secretary of State race between Ken Gordon (D) and Mike Coffman (R), given the problems revealed in Colorado's disasterous certification procedures for voting machines prior to the election, and their massive meltdowns on Election Day in Denver and elsewhere which caused thousands of voters to be turned away from the polls due to machine malfunction.

AP is reporting today that Coffman's lead is beginning to look insurmountable, though given the fact that Gordon's numbers in Denver alone outpace Coffman's by some 70 to 30 percent, the fact that Denver voters, specifically, were disenfranchised at such an alarming rate due to equipment failure on Election Day, certainly "exemplifies," as the source put it, the need for Election Reform across the country and the importance of Secretary of State races.

The six U.S. House races named above, of course, are just the federal races that the DNC considers "still in play," but there are innumerable local races and initiatives being challenged around the country, as another DNC source told The BRAD BLOG this morning. As well, there are a number of Congressional races where the candidates have, honorably, refused to concede until every vote is counted and accounted for.

Clint Curtis, the vote-rigging whistleblower who ran against Tom Feeney, the man he claims asked him to create vote-rigging software in 2000 (as The BRAD BLOG originally broke back in 2004 and whose story we've been following closely ever since) has issued a press release this morning saying that he will not concede in the race until every vote is accounted for.

"The right to vote and to have that vote counted accurately is the very foundation of our democracy, and I owe it to the voters in my district and the state of Florida to continue to push for accurate, honest elections," Curtis said in the news release. He points out that as a candidate, he "now has the legal standing to pursue an investigation into the anomalies," which he claims were reported during his race.

"I can accept that the citizens across the state of Florida were out of step with the rest of the country," added Curtis, "as long as we know that this election truly reflects their intent." The Florida Secretary of State's website currently shows Feeney leading Curtis 58 to 42 percent.

In California's 50th Congressional district, Francine Busby (D) has still refused to concede in her race against Brian Bilbray (R) in which she reportedly trails 54 to 43 percent. We applaud Busby's refusal to concede given the outrageously bad administration of the election across the entire San Diego County as overseen by Registrar Mikel Haas, one of the country's worst.

A Zogby poll taken on Election Day (and shortly thereafter) shows an unexplained 6 point disparity with the final results as we reported last week.

As reported earlier today, Haas's resignation was called for on Election Night by San Diego County Democratic Party Chair Jess Durfee after voters were disenfranchised across the county when Diebold touch-screen systems failed to work and not enough paper ballots were made available for voters. Many of those voters ended up voting on Spanish language paper ballots after English ballots had run out by 9am on Election Day; others simply gave up and went home or to work without being able to cast a vote at all.

We echo Durfee's call for Haas to step down immediately. San Diegans deserve honest and accurate elections in which the voters may have confidence in the reported results. Haas has, disgracefully, provided none of the above during his irresponsible tenure.

We originally reported that the Democratic candidate was trailing in the reported results in each of the six DNC-named races. In fact, Democratic candidate Joe Courtney in the CT-2 race is currently ahead in the results as reported so far. We've corrected the original misstatement in the article above. Further, AP is now reporting Courtney as the winner after a final canvassing of the ballots.

After State Denials, Says It's 'Obviously Something We Need to Look Into, And Very Quickly'
The Ghost of Katherine Harris' Old Seat Continues to Haunt Florida's 13th Congressional District Race...
By Brad Friedman on 11/12/2006 3:15pm PT

After the state's initial denial that there were any problems in Florida's 13th Congressional District U.S. House race, even Jeb is now admitting there may be problems "worth investigating." From AP...

Gov. Jeb Bush said Friday the unusually high number of voters who didn't choose a candidate in a congressional race in Sarasota County was worth investigating, and said the state has "the law in place to do it right."

"This is obviously something we need to look into, and very quickly," Bush said as state elections officials prepared to oversee an expected recount next week in the 13th District race between Republican Vern Buchanan and Democrat Christine Jennings.

Jennings was behind in the initial count by 373 votes and was pressing for answers about why more than 18,000 voters didn't register a selection in the race, but did make choices in other contests. That rate was much higher than what the district's other counties registered in the same congressional race.

State elections officials planned an audit of the Sarasota County's election system after the recount, which is expected to occur next week.

Paperless iVotronic Touch-screen Systems Report Unprecedented Voter Turnout in one AR County, Thousands of Undervotes in U.S. House, Attorney General Race in Four FL Counties
Zero Votes Recorded on ES&S System for Mayoral Candidate in Small Town
By Brad Friedman on 11/12/2006 8:35am PT

Orlando Sentinel's coverage on Friday began with these incredible words [emphasis ours]:

Touch-screen-voting machines in at least four Florida counties recorded unusually high percentages of ballots with no votes in Tuesday's election --- a sign that new electronic-ballot machines may not be as foolproof as hoped.

"Not as foolproof as hoped"?!

Just who exactly are the fools they're referring to there?

Electronic voting machines made by ES&S, the largest supplier of voting systems in the country, failed across the country on Election Day. We're beginning to see more and more of the results of the failures from those machines --- as "foolproof," apparently, as the Titanic was "unsinkable."

An unprecedented 83% voter turnout has been reported from ES&S iVotronic paperless touch-screen systems in Benton County, Arkansas, after the Election Commission reviewed it's balloting when it was found that tabulated votes were being dropped from the system as new votes were being entered into it on Tuesday night.

The results: More votes than citizens in several areas of Benton County and an overall turnout described as "eye-popping" by a University of Arkansas political science professor who pointed to Idaho's 63% turnout as having made news for a midterm election record. Idaho's got nothing on Benton County, apparently.

Four different Florida counties are reporting enormous undervote rates on the same type of ES&S iVotronic paperless touch-screen systems in at least one key U.S. House race and in their election for State Attorney General.

And in one small town, ES&S voting machines are reporting zero votes for a mayoral candidate who swears that, yes, he really did vote for himself!

In Arkansas, the Morning News reported on Friday...

Says Will Do 'Forensic Reconstruction' to Determine 'If Election is Supported by Actual Voters'
By Jim Cirile on 11/7/2006 10:27pm PT

Guest Blogged by Jim Cirile

As of midnight EST, MSNBC reported that with 90% of the vote in, Tom Feeney was projected to win FL-24 57%-43%.

As loyal BRAD BLOG readers know, Feeney, one of CREW's 20 Most Corrupt Congressmen, was being challenged for his congressional seat by election fraud whistle-blower Clint Curtis, who alleges Feeney asked software designer Curtis to design vote-rigging software.

Curtis just got off the phone with BRAD BLOG'S Brad Friedman, broadcasting live in the Election Meltdown-apalooza. Curtis says he "apparently lost 57-43%" based on MSNBC results with 90% of the vote in --- but notes that there were "oddities" --- for example in some districts there were more Republican votes than there are registered Republicans. Of course, some Dems or independents could have voted for Feeney, but statistically, that is highly unlikely.

Curtis says "We have a lot of feet we'll be putting on the ground," and he will now do a "forensic reconstruction" to find out "if the actual election is supported by actual voters." Imagine that!

Note that there are STILL no numbers being reported from Seminole County per the FL Sec. State website (as of 12:06 PM EST).

In short, Curtis is not conceding. We say BRAVO! If he lost fair and square, that's fine, we will all accept that. It's the "fair and square" part we are just a bit uncertain of. Who was it who once said "Trust Yet Verify"? Why, it was Ronald Reagan. Wise man occasionally, it turns out. Stay tuned for more news from FL-24. It's likely this story may continue for awhile. And that, friends, is a good thing.

UPDATE: 2:20 AM Eastern time with 99% reporting:

District 24
Tom Feeney (R) 122,938 58%
Clint Curtis (D) 89,158 42%

Trouble With Machines in Indiana, Florida, Ohio, Illinois
And we're just getting started...More here soon...
By Brad Friedman on 11/7/2006 11:23am PT

We're gonna have trouble keeping up today. So 'be the media' in comments here where you can. But here we go...

We're getting reports of trouble and machine breakdowns from all over the country. Places where Emergency Paper Ballots are not available (despite our many pleas for weeks) and voters are being turned away or told to come back later...From USA Today...

•In Indiana's Marion County, about 175 of 914 precincts turned to paper because poll workers didn't know how to run the machines, said Marion County Clerk Doris Ann Sadler.

• Election officials in Delaware County, Ind., planned to seek a court order to extend voting after an apparent computer error prevented voters from casting ballots in 75 precincts. Delaware County Clerk Karen Wenger said the cards that activate the machines were programmed incorrectly. "We are working with precincts one-by-one over the telephone to get the problem fixed," Wenger said.

• Illinois officials were swamped with calls from voters complaining that poll workers did not know how to operate new electronic equipment

• In Ohio, some machines wouldn't function."We got five machines — one of them's got to work," said Willette Scullank, a troubleshooter from the Cuyahoga County, Ohio, elections board.

• In Florida, voting was briefly delayed at four districts because of either mixed up ballots or electronic activators being unintentionally wiped out, according to Mary Cooney, spokeswoman for the Broward County Supervisor of Elections. Voters were forced to use paper ballots after an electronic machine broke in the Jacksonville suburb of Orange Park.
