On today's BradCast, the Super Bowl victory for the Philadelphia Eagles on Sunday was fantastic, but the victory for all of Pennsylvania (and, indeed, voters across the entire nation) on Monday was even better! [Audio link to show follows below.]

U.S. Supreme Court Justice Samuel Alito rejected Pennsylvania Republicans' request to block, overturn, deny, or delay the state Supreme Court's recent order to redraw all U.S. House districts in the key swing-state immediately and in time for the upcoming 2018 mid-term elections. The state's highest court found two weeks ago that the GOP-controlled state legislature had unlawfully gerrymandered the Keystone State's U.S. House maps following the 2010 census in such a way that the GOP ended up with 13 seats to the Democrats' 5, despite Democratic registration and voting far out-pacing Republicans statewide.

The PA GOP's request for SCOTUS to intercede in a state constitutional matter was denied on Monday. That is also very good news for the country, as discussed on today's show.

But the SCOTUS decision has yet to stop the state GOP from refusing to follow state court orders on the matter. Moreover, while the state GOP is demanding that its state Supremes overturn their own ruling, new reporting over the weekend reveals that a Republican state Supreme Court Justices who voted against the order to redraw U.S. House district maps, received several undisclosed donations --- including a huge one from the state Senate President Pro Tempore, as well as from two Republican U.S. House members effected by the ruling --- when she ran for a 10-year term last year. The donations were given to her after the challenge in the gerrymandering case had already been filed, yet her campaign now admits she failed to disclose those donations until they were revealed over the weekend.

Then, we move on to a number of late developments in the failing attempt by the chair of the U.S. House Intelligence Committee, Rep. Devin Nunes (R-CA), to undermine Special Counsel Robert Mueller's investigation of Team Trump, by using specious claims about the self-generated GOP House Intel Committee memo released on Friday. Both Nunes and Trump (and other Republicans) had claimed the memo supposedly reveals some sort of partisan bias in the FBI/DoJ and now Special Counsel probe. One GOPer even went so far as to claim the memo revealed "evidence of treason". (It doesn't. Not by a long shot.)

In fact, as we detail today, even statements by other Republican members on the same committee --- including Trey "Benghazi" Gowdy --- over the weekend, seriously undermine the claims made by Nunes and Trump himself over the weekend and again on Monday.

And, as we detailed at length on Friday's show, Nunes --- who now claims that former Trump Campaign advisor and suspected Russian intelligence asset Carter Page's rights were somehow violated by the procedure used by the FBI to obtain a warrant to eavesdrop on his communications --- showed no such concerns about the FISA law used to obtain that warrant when he voted in favor of extending it and expanding it for 6 more years just weeks ago. Trump also signed that extension.

Oh, and the Dow had its worse day since 2011 and largest all-time point drop today.

GOP just extended surveillance law they now decry; Trump policies terrorizing public, infuriating judges; Also: Diebold 'jackpotting'!...

On today's BradCast: That mighty "thud" you heard on Friday morning? It may have been the release by Donald Trump and U.S. House Republicans of their long-awaited, much-ballyhooed, self-generated memo, which they promised would expose "worse than Watergate" crimes and wildly biased partisan "witch hunt" activities by the FBI and DoJ as part of their investigation into whether Team Trump worked with Russia to undermine the 2016 Presidential election. It did none of those things. But it does expose them as hypocrites when it comes to U.S. surveillance policies. [Audio link to show posted below.]

The three-and-half page memo was released on Friday despite the strenuous objections of Democrats and Trump appointees at the FBI and DoJ who shared "grave concerns about material omissions of fact that fundamentally impact the memo's accuracy" before its release. Trump didn't care. The document, made of partial, cherry-picked facts, is meant to suggest the FBI inappropriately obtained a secret warrant (and three renewals for it) from the Foreign Intelligence Surveillance Court (FISC) to spy on Carter Page in late 2016. Page was a Trump campaign volunteer who had long been on the radar of the intelligence community after being cited in intercepts from Russian intelligence agents discussing him as an asset as early as 2013.

The newly declassified memo is the work of U.S. House Intelligence Committee Chair Devin Nunes (R-CA) and his staff, who may or may not have worked with the White House itself on the effort, but it ultimately appears to do little to bolster their argument that Republican Robert Mueller's Special Counsel probe is in some way compromised by Democratic partisans. (Even Shepard Smith of Fox "News" seems to agree.)

It does, however, underscore concerns about the manner in which Foreign Intelligence Surveillance Act warrants are obtained in the secret FISA Court, where there is no adversarial opposition to the secret case offered by the Government. All of which begs the question as to why Nunes himself voted just two weeks ago against FISA reforms advocated by civil libertarians on the Right and Left, and in favor of extending and expanding the controversial surveillance law for another 6 years. It also begs the question as to why Trump signed that FISA extension without reforms to the process that he and Nunes are now claiming to be so troubled by. Again, that was all just two weeks ago! [My conversation on that matter on this show, two weeks ago with former DoJ attorney Elizabeth Goitein --- after Nunes and the House passed the bill, and just before Trump signed it --- is right here.]

Then, as the cable news channels continue to devote nearly 24/7 to political intrigue and food fights, a reminder that a fish rots from the head down. To that end, the petty cruelty of Donald Trump is permeating its way into executive branch agencies, polices and behavior with nowhere near the media sunlight it deserves. We cover a number of the under-reported recent stories of how his cruel, hard-line immigration policies are ripping families apart and hurting real people, right now, and at least one federal judge who drew a hard line in the sand this week against at least one aspect of those policies.

Finally, as promised earlier this week, a disturbing story about Diebold, the makers of ATMs and (formerly) of computer voting, registration and tabulation systems, and a newly-issued warning that their ATMs are being hacked to spit out cash in a scheme called "jackpotting". But while the security built into their machines that contain thousands of dollars of actual cash may not be great, you needn't worry about the security of their systems used to cast and count our votes in at least one-third of the country this year in our upcoming 2018 midterm elections, right? After all, neither Trump nor Nunes nor the rest of the Congressional Republicans appear to be too concerned about it, so why should you be?...

After yet another exhausting and harrowing week in Donald Trump's America, as the Doomsday Clock inches closer to midnight, we try to lighten things up a bit, at least comparatively, on today's BradCast --- even if it's not always easy. [Audio link to show follows below.]

Among the many stories covered on today's program...

  • A few words about Donald Trump's reported attempt to fire Special Counsel Robert Mueller last June before chickening out, which the President describes today as "fake news";
  • Republicans are now, literally, trying to block democracy by preventing elections from happening at all. Gov. Scott Walker in Wisconsin and the GOP-controlled Alabama state legislature provide just the two latest examples;
  • Kansas' failed Governor Sam Brownback has, apparently, failed up, with an appointment by the Trump Administration, confirmed this past week by the U.S. Senate, after Vice President Mike Pence was brought in to break the tie vote in Brownback's favor;
  • Speaking of failures in the state of Kansas, their Secretary of State Kris Kobach, a long-time GOP "voter fraud" fraudster and now candidate for Governor, enjoys still more shame and ignominy this week, as it was discovered that he exposed private information, including the last four digits of social security numbers for thousands of state officials and employees --- including his own! --- on an unprotected Internet page;
  • The Guggenheim Museum declines to loan a valuable Vincent van Gogh painting to Donald and Melania Trump for use in their White House residence, but offers a solid gold alternative that seems perfect for the first family;
  • And, speaking of the first family, Trump's recently reported hatred of sharks --- revealed by adult film actress Stormy Daniels in the wake of revelations of her alleged affair with Donald Trump and $130,000 hush-money payoff just before the 2016 election --- has resulted in an outpouring of donations to shark charities across the nation and the world! See? Donald Trump can do some good in this world after all!

In wake of President's reported 'shithole countries' comment, the GOP's toxic, racist policies are laid bare in the U.S. and across the globe...

On today's BradCast: Buckle up, and maybe take a few pre-emptive antibiotics just for safety. [Audio link to show follows below.]

We begin with a few responses to the racist President of the United States Donald Trump's reported description of Haiti, El Salvador and Africa nations as "shithole countries". As a measure of just how appalling the comments were, we actually declare George W. Bush no longer the "Worst President Ever", before turning to outraged responses from right-wingers Glenn Beck and Frank Luntz, of all people, to help underscore both how offensive and, frankly, inaccurate Trump's comments were.

But, as several have noted, while Trump's remarks are disturbing, the fact that his racism is embodied within his policies --- on immigration, policing, and much more, including voting and elections --- is far more troubling. That racism and dishonesty was on display in the sham Presidential Commission created by Trump, supposedly to root out the millions of illegal votes he falsely claims were cast against him when he lost the popular vote by millions to Hillary Clinton in 2016.

But his bogus Commission, headed up by disgraced GOP "voter fraud" fraudster and Kansas Secretary of State Kris Kobach, was abruptly shut down last week after facing an onslaught of legal challenges and finding none of the supposed voter fraud they had set out to highlight. After the Commission's ignominious closure, Kobach claimed he would be advising the Dept. of Homeland Security who, he said, would be taking the Commission's data and preliminary findings to continue the investigation. While worrying a number of voting rights advocates, those claims too have so far proven to be false, according to statements from DHS and legal documents filed by the DoJ in response to lawsuits.

Meanwhile, Trump's poisonous racism and failed Presidency is having ripple effects across the globe, and not just with those nations he is said to have described as "shitholes". The U.N. and the Vatican have now condemned his remarks, he has been forced to cancel a planned trip to Great Britain (which, naturally, he has lied about) and, following the recent resignation of the U.S. Ambassador to Panama who says he can no longer justify serving under this Administration, Trump's newly appointed Ambassador to the Netherlands, Pete Hoekstra, has been mercilessly called out by the Dutch in recent days for multiple lies.

Hoekstra, a former Republican Congressman from Michigan and immigrant from the Netherlands, had recently denied having made wholly discredited racist charges, in 2015, claiming Muslim immigrants were burning Dutch politicians to death and creating so-called "no-go zones" in the Netherlands. After he charged a Dutch journalist with reporting "fake news" for asking him about his fully-documented and video-taped false claims (and then claiming in the same interview he hadn't charged the journalist with reporting "fake news") the new Ambassador's first press conference this week in The Hague did not go well, to say the least. On Friday, Hoekstra was finally forced to admit his 2015 comments were wrong, though his shame appears to not yet be over.

All of which underscores that while Donald Trump may be the highest profile symptom of a very sick Republican Party, he is but a small part of a very widely spread disease that has poisoned his party and has made America anything but "great again" in the eyes of the world...

On today's BradCast: Who's actually running this disastrous Administration? And why don't they give a damn about terrorism when it's at the hands of white, domestic, neo-Nazis? That question may answer itself. But what's the excuse for Congress and media? [Audio link to full show at end of article.]

First up, today in the U.S. House, Republicans, with the help of a number of Democrats, voted to approve the re-authorization of a sweeping surveillance law --- Section 702 of the FISA Amendments Act --- that results in the phone calls and emails of millions of Americans being scooped up for review without cause or court warrant. Civil libertarians on both the Right and Left have been hoping, for years, to end or radically limit the dragnet measure which they say violates Constitutional rights to privacy and against unwarranted search and seizure.

Though the White House has been lobbying for this re-authorization, which must still be approved in the U.S. Senate, a tweet this morning by Donald Trump, while watching Fox "News", harshly criticized the measure. Following that tweet, two hours later, after a call from House Speaker Paul Ryan (R-WI) and chaos in the House GOP caucus in response to the tweet, the President took to Twitter again, this time in support of the measure, which he clearly knows nothing about.

Only his later description of Haiti and African nations as "shithole countries", as reportedly uttered during bi-partisan immigration negotiations today with lawmakers, moved the nation's media on to the next Trump embarrassment of the day.

In the meantime, as Trump and Congressional Republicans pretend to be concerned about terrorism and putting "America first", a major terrorism case brought by the Dept. of Justice just before Christmas has gone almost entirely unnoticed by the media, after the DoJ itself failed to even issue a statement on the recent arrest. Why? The obvious reason is that it involves a white supremacist neo-Nazi from Missouri (as opposed to someone with a middle-eastern sounding name) who had amassed an arsenal of deadly weapons in hopes of allegedly "killing black people". But there are several other reasons why the case has largely failed to become much more than a blip on the corporate media and cable news radar, much less be mentioned by either the DoJ or tweeted about by Donald Trump.

We're joined by HuffPost's senior justice reporter RYAN REILLY to discuss the matter today. Reilly has been investigating the disturbing lack of coverage of a case which includes an Amtrak train stopped by the accused 26-year old right-winger, Taylor Michael Wilson, in the dead of night in the middle of rural Nebraska several months ago, before he was arrested, then released on bail for several weeks, before finally being charged on a number of federal terrorism counts before Christmas.

"When I didn't see the story pop up until Friday, I was like wait, how did I miss this? What's going on? Federal prosecutors are charging a white supremacist with terrorism?," Reilly says, explaining why the case in which Wilson was originally charged with "criminal mischief" went unnoticed by media and unreported by law enforcement officials, who are usually eager to get publicity for terrorism cases.

"The broader issue is that it's a demonstration, an illustration of exactly how differently the Justice Department apparatus, and the national security apparatus of the US Government, treats domestic terrorism in comparison to anything that remotely has a sniff of anything related to Islamic terrorism," Reilly tells me. The reasons, for that, above and beyond strictly racism (which is certainly a large part of this), may be more complicated than you think, both statutorily and Constitutionally. None of those reasons, as we also discuss, necessarily excuse the media's apparent lack of interest in such cases, despite the fact that domestic terror remains a far greater threat to Americans than the threat posed by those claiming an association with international terror groups.

Finally today, Desi Doyen joins us for the latest Green News Report on the tragic climate disaster unfolding in Southern California which has, so far, taken 17 lives in the past several days; the Trump Administration's about-face on its recently announced expansion of off-shore drilling (but only for one politically important state); and an important lawsuit filed this week by New York City, along with the promise of divestiture, against major oil companies. The suit could prove to be a serious blow against the fossil fuel industry, and is said to have been filed in response to billions of dollars in climate change-related damages after years of those companies hiding their own scientific knowledge of climate change from the public...

On today's BradCast: Enough with the so-called "forgotten Trump voters"! What of the forgotten Democrats and progressives who far outnumber them? Where are all of those profiles in the MSM? We pick up that ball a bit today. [Audio link to show follows below.]

But first, just some of the news breaking today: North and South Korea are now talking again, and have struck an agreement that will result in North Korea participating in the winter Olympic Games that begin next month in South Korea. They also appear to be planning for talks in the near future on the militarization of the North/South border and other related matters, even as the Trump Administration continues to send very mixed signals about negotiations that might include the U.S.

Meanwhile, back here at home, the far right-wing "news" site Breitbart has fired its far right-wing Executive Chairman Steve Bannon following comments he made about Trump's son Don Jr. in Michael Wolff's Fire and Fury book. Bannon was previously fired by the White House as Trump's top political strategist. And, speaking of the GOP's continuing internecine Trump Era War, the disgraced, far right-wing 85-year old Joe Arpaio, controversial former Maricopa County, AZ Sheriff found guilty of contempt of court last year before being pardoned by Trump shortly thereafter, says he will run for the GOP nomination for U.S. Senate this year, in a bid to replace outgoing Republican Sen. Jeff Flake.

Then, amidst seemingly endless sympathetic corporate media profiles of supposedly "forgotten" Trump voters in rural America, what of the majority of American voters who didn't vote for Trump, even in so-called "Trump Country"? We're joined today by sustainable family farmer JOHN GILBERT [pictured above] of Gibralter Farms, who, with his wife and extended family, has been farming and ranching on land maintained by his family since the 1890s.

Gilbert was briefly mentioned in a Washingont Post profile at year's end of another nearby farmer in Hardin County, Iowa --- part of the paper's long series of stories so-called on "THE FORGOTTEN: The issues at the heart of Trump's America" --- who remains an ardent and seemingly confused Trump supporter, angry with the way she believes the Obama Administration and its Environmental Protection Agency were enforcing too many rules that made her work difficult or costly. While Trump has begun to reverse many of those Obama Era regulations, such as the controversial Waters of the United States (WOTUS) rule, Gilbert believes we need more, not fewer regulations to remain good stewards of the land, so that "humanity stays alive".

He says the "big lie" about WOTUS was that, in fact, "most farming activity was exempted. I think it's also clear that that was an issue that was ginned up almost entirely by the Farm Bureau as a way to scare farmers, and I think farmers were duped into opposing that."

The 68-year old Gilbert explains how many of his fellow farmers, in Iowa and elsewhere, have been misled by the American Farm Bureau --- a lobbying group which he says largely represent the interests of "Big Ag" --- about both that and the so-called "death tax", while the Republican party and its media outlets have been helping to spread the group's disinformation for many years. "Politicians and Republicans have called it the 'death tax' for a long time," he tells me, "and always say 'Oh, it's hard on farmers.' Well, there's almost never been a farmer who has ever been affected enough by it that they had to do like they claim and sell the farm. These are all just manufactured fear tactics."

He also comments on Trump's at times bewildering appearance on Monday at the Bureau's national convention in Nashville, and discusses the principals of sustainable agriculture, for which he and his wife recently won the 2017 Sustainable Agriculture Achievement Award from the Practical Farmers of Iowa.

"The whole issue of sustainability stems from a basic acceptance of the fact that there is not enough in this world for everybody to have all they want, whether it's enough water, enough food, enough energy, enough power, enough room. There's not enough. That means that we have to share, I guess, for lack of a better word," he tells me. "The one thing that has kept humanity above the animals over all these years is the ability to control our greed...And if you don't control greed, then you use up too many resources today and don't have any left for the future."

"Agriculture, in itself, is strictly the process by which humanity stays a live," he tells me. "We in agriculture do a lot of things, but basically we're trying to keep humanity alive. The question that we don't know is how long 'forever' is. And if we're going to keep humanity alive essentially forever, we have to make sure that we have the resources available to our descendants thousands of years from now --- to continue to support humanity. When you put those two things together, you end up with a system of farming that is much more aligned with natural systems. You tend to use principles of nature rather than the test tube or the chemical companies, or the big expert input suppliers who tend to be more interested in making money off of what you do than you making money."

On today's BradCast, the GOP has made an industry out of protecting their power and their Presidents, from Richard Nixon right up through Donald Trump. And neither the Democrats nor the corporate media seem to have figured out how to counter the Right's radical transformation of the American political landscape over the past 40+ years. [Audio link to full show is posted below.]

But first today, a bit of voting and election news: A federal judge on Friday, just before the Christmas holiday, found in favor of Maine's Democratic Sec. of State Matt Dunlap after he was forced to sue Donald Trump's so-called "Election Integrity" Commission headed up by Vice President Mike Pence and Kansas' Republican Sec. of State --- and infamous GOP "voter fraud" fraudster --- Kris Kobach. Dunlap had sued because, even though he is on the Commission itself, Kobach and the other rightwing fraudsters on it had been withholding documents and keeping Dunlap completely out of the decision making process. While that was a loss for the Government, a separate lawsuit against the Commission, filed by the Electronic Privacy Information Center (EPIC), was rejected by a federal Appeals Court on Tuesday, on the basis that the group did not have standing to sue.

Also today, an update on the November 7th, 94th District Virginia House of Delegates race where Democrat Shelly Simonds appeared to have unseated Republican David Yancey by one single vote, until one of the Republican election official judges decided, the day after a "recount" was completed last week, that a previously discarded over-vote ballot [JPG] was actually a vote for the Republican after all. A three-judge court panel of GOP-appointed judges agreed, which meant the race was tied and the winner would be determined --- along with the balance of control of the Virginia House, which had been controlled by the GOP for decades --- by a random draw. That draw, scheduled for Wednesday, was postponed late on Tuesday by the state's Election Commission at Simonds request, while she challenges the three-judge panel's ruling in court.

Then, with the calls intensifying from the Fox "News" rightwing for Trump to fire Special Counsel Robert Mueller, are Democrats doing enough to counter the Constitutional Crisis that would likely ensue if he did so? For that matter, how have we arrived at a moment in American history when an investigation by a Republican Special Prosecutor into the firing of a Republican FBI Director by a Republican President can be considered a partisan Democratic witch hunt?!

JON SCHWARZ of The Intercept joins us to discuss the historical chain of events, connecting the dots of lawless GOP Presidential administrations from (at least) Richard Nixon up through Donald Trump, to illustrate exactly how we got here. In his recent historical essay, he details a fairly direct line of actions taken by the right during and after Nixon, right up through the present, that has largely prevented real accountability for lawless Republican Presidents, while both the Democrats and the corporate media have continued to pull their punches for various reasons.

"The history of Watergate has been completely rewritten in the past 45 years," Schwarz explains. "The reality is that it just barely succeeded. All of the investigations, all of the obvious, blatant wrongdoing by Nixon was just barely enough to get him out of office. Under other circumstances --- if the Republicans had controlled Congress, if they'd had Fox News then, if they'd had decades of appointing people to the courts --- it's very likely that Nixon would have stayed in office, and people would remember it as just a minor blip."

As is, he tells me, Nixon still escaped accountability for the worst of his crimes including collusion with a foreign power which resulted in the deaths of thousands of Americans, and an untold number of others in Indochina. "It's kind of shocking how this has been completely kept out of history."

Nonetheless, during his administration, a young Nixon staffer by the name of Roger Ailes came up with "A Plan for Putting the GOP on TV News," which would eventually become Fox "News", while a separate if related scheme by a future Supreme Court Justice that became known as the "Powell Memo", helped to restructure the federal judiciary and paved the way for the corporate takeover of our electoral and political system. "It describes exactly what has happened for the last forty, forty-five years," Schwarz notes. "They laid out a plan and they executed it, and it worked."

And now, we live in a world where only Republicans allowed to be appointed to investigate Presidents, whether they are Republicans or Democrats, and only Republicans have ever been appointed as FBI Directors, even by Democratic Presidents. And, despite that, we now hear the ever-increasing drumbeat charging that Mueller's investigation is a "partisan Democratic witch hunt", leaving Dems fighting among themselves as to whether they should push for impeachment, and the media pulling punches when reporting on GOP Administrations.

"If Hillary Clinton were President and had done the things that Donald Trump has done," Schwarz argues, "everyone knows she would have already been impeached 97 times."

Over the weekend before Christmas there were several noteworthy federal court rulings against the Trump Administration. Among them, one blocked a plan by Trump's Housing and Urban Development (HUD) agency to overturn an Obama Administration rule meant to help low-income Americans obtain affordable housing as of January 1, 2018. The judge ruled Trump's HUD overturned Obama's new rule arbitrarily, with no supportable reason for doing so, which is unlawful. Another federal court over the holiday weekend partially lifted parts of Trump's third attempt at banning travelers and refugees from several Muslim-majority countries. The Administration claimed they were doing so for national security purposes. The judge determined that national security was actually threatened by the ban itself.

Then, in related-ish matters, we're joined by the great HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo to discuss many aspects of the Trump Administration and the GOP's long "War on Truth".

As the President pretended, on Tuesday, to be "back to work" --- before playing another round of golf on his 85th day of staying at one of his own branded properties during his Presidency --- we discuss a number of the ongoing hoaxes played by him and fellow Republicans on the American people, beginning with the absurd, Fox "News"-created "War on Christmas".

"I can't even believe I have to say this," Parton tells me with no small amount of exasperation, but "how far have we come that we are actually at a point that we have to prove that there was no 'War on Christmas'?" Good question, since it seems a non-trivial number of Trump supporters actually believe there was/is such a war. That said, as she further observes, it's become very difficult to know who really believes what anymore and who is playing whom at the end of a remarkably "disorienting" (to say the least) first year of Trump's Presidency.

"If you go over to Fox News, or you look at any of the rightwing media, or talk radio, of course, it's no longer that we're just arguing over stuff," she says, "they're in a completely different dimension than we are. The arguments they are having are not arguments that are taking place in our world. They're not arguing with real people. We're not existing on the same level of reality."

While the "War on Christmas" is a pretend reality, the "War for Truth," on the other hand, is "definitely raging," she argues. Among the many truths and frauds we seek to highlight during our conversation today: we discuss the GOP tax bill and whether voters will be moved by it to vote Republican in 2018 as the GOP seems to think; whether media (and Democrats) will stop falling for the mostly phony "economic concerns" of many Trump voters ("It was not based on economics, it was based on resentment," she argues); whether Democrats should or will take the bait being offered by Republican Senate Majority Leader Mitch McConnell to work across the aisle next year as both he and Trump now claim to want after a year of shutting Dems out of the Congressional process entirely; whether Truth Warrior Al Franken should have resigned from the U.S. Senate amid sexual misconduct claims; and what "Digby" finds herself most surprised by as Trump wraps up his intolerably long first year in office...

On today's BradCast: Disturbing news for Americans and free speech before Christmas, but great news for huge corporations enjoying record profits already. [Audio link to show follows below.]

First up, yet another media mega-merger is announced as Disney says they will purchase much of Rupert Murdoch's 21st Century Fox in a $52 billion dollar deal, even as Trump and the Congressional GOP push to give them all huge tax breaks --- at the expense of the poor and middle class. Republicans are hoping for final passage of their tax bill before Christmas and before presumptive Sen.-elect Doug Jones (D-AL) can be seated and further reduce the GOP's slim U.S. Senate majority.

On the upside today, one of Trump's wildly inappropriate industry shills nominated to the EPA has reportedly withdrawn, as have two wholly unqualified nominees for lifetime judgeship appointments to the federal bench.

Then, as expected on Thursday, Trump's Republican-led Federal Communications Commission (FCC), voted 3 to 2 along party lines to kill "Net Neutrality" rules for Internet Service Providers like AT&T, Verizon, Charter and Comcast. That, despite a letter from 18 state Attorneys General who asked the Commission to delay the vote until after a legitimate public comment period. The previous one, they charge, was manipulated by as many as 2,000,000 comments that New York's Attorney General Eric Schneiderman has found found to have been faked.

Nonetheless, right-wing FCC Commissioner and former Verizon attorney Ajit Pai did not delay the vote, and the Commission voted to kill the rules that had long prevented ISP's from blocking or slowing down certain websites or apps, or charging more for access to them. Longtime media reform activist SUE WILSON joins us today and describes the latest actions by the FCC as little more than a move toward the end of free speech on the Internet.

She argues that the move to kill Net Neutrality echoes the efforts to pass the Telecommunications Act of 1996, which was also sold by proponents at the time as a boon for competition and innovation that would result in more free speech over our public airwaves. Instead, the public radio waves have become the nearly exclusive domain of corporate right-wing political speech and propaganda in the 20 years since the measure was signed by President Bill Clinton.

"They made a lot of promises, when they consolidated radio, that we would end up with a much more diverse speech for everybody," Wilson explains. "Anybody who listens to radio knows that it's almost impossible to find a show like The BradCast on the air because it is now dominated by pro-Republican, conservative --- no, 'alt-right' --- speech, to the exclusion of all others. They flat-out lied to us, and guess what? That's what they're doing today."

A similar future may soon be in store for the Internet, unless promised lawsuits or Congressional legislation is able to block or reverse today's shamefully under-reported and disturbing turn of events.

"The claim that the Federal Communications Commission Republicans are making is that we need to give more money to broadband services so that they can invest in rural areas," says Wilson. "However, if you look at the Securities and Exchange [Commission] documents, which these corporations have to fill out --- under penalty of prosecution if they lie --- the six CEOs of publicly-traded broadband companies are telling their investors that the FCC's current Net Neutrality rules have not in any way impacted their investment strategies. Again, we're looking at the Federal Communications Commission, as headed by Ajit Pai, just making things up out of whole cloth."

On today's BradCast: It's astonishing how many GOP policies, practices and nominees must be pushed through by force, scheming, lying and the breaking of norms and traditions. If any of the stuff they are pushing was actually popular and sought by voters, it doesn't seem like the strong-arm tactics would be necessary. But... [Audio link to show follows below.]

  • Nebraska law disallows state officials from considering Thursday's massive Keystone Pipeline tarsands oil spill in South Dakota in their upcoming decision on permits to build the even larger and more dangerous KeystoneXL Pipeline expansion in Nebraska;
  • Things are getting ugly in the U.S. Senate Finance Committee as the GOP attempts to ram through massive, unpopular tax cuts for the rich before the Thanksgiving break;
  • Even Fox "News" now finds Alabama's GOP U.S. Senate nominee Roy Moore to be in trouble with voters before the December 12 special election, following growing allegations of sexual assault on minors;
  • The U.S. Senate Judiciary Chair does away with 100-year old "blue slip" tradition in order to ram through more of Trump's lifetime appointments to the federal bench;
  • Those appointees, a new analysis finds, are almost exclusively white and male;
  • They're also "not qualified", dishonest and racist, as investigative journalists have recently discovered;
  • So are Trump's appointees to other areas of the federal government, more of whom were forced to resign in disgrace this week;
  • In other "Filling the Swamp" news, Trump continues to spin the revolving door with Big Pharma exec nominated to head Health and Human Services (HHS), a Big Coal exec gets rammed through the Senate to head the office of Mining Safety and Health Administration (MSHA), but one wildly inappropriate appointee to the Environmental Protection Agency (EPA) may actually get blocked...by Senate Republicans! What are the odds? Well, we'll believe it when --- and if --- we actually see it...

Callers ring in on the controversies plaguing AL's U.S. Senate nominee...

On today's BradCast, we were live today on our flagship station in Los Angeles, after the latest round of fund drives at KPFK/Pacific Radio, and had lots to discuss with callers in the wake of the Roy Moore mess and new developments and allegations. [Audio link to show is posted below.]

Another accuser stepped forward on Monday, charging that Alabama's Republican nominee for the U.S. Senate Special Election, sexually assaulted her when she was a minor, while he was serving as District Attorney in the state. And, even prior to today's new allegations, the news for the GOP Senate was becoming increasingly grim by the hour following the Washington Post's explosive exposé of charges by four different women against Moore published late last week.

A new poll shows Moore's Democratic opponent, former U.S. Attorney Doug Jones, is now up over the controversial GOP candidate by 4 points, just weeks before the December 12th election, in the wake of the initial allegations that Moore sexually pursued four teenagers, one as young as 14 years old, in the late 70s and 80s.

Three Republican U.S. Senators rescinded their endorsements for Moore over the weekend and, on Monday, Senate Majority Leader Mitch McConnell called on him to step aside --- without using the "if true" qualification he'd used previously --- saying that he now believed the women who had accused Moore. McConnel also added he is now seeking a write-in candidate willing to run, since it's too late to remove Moore from the ballot. Sen. Cory Gardner (R-CO) head of the Senate Republicans' campaign committee, called on the Senate to expel the controversial far Rightwing "conservative" "Christian" if he wins. But some Republicans are now calling on Alabama's Governor and legislature to cancel the Special Election to fill the seat vacated by Attorney General Jeff Sessions all together. (Good luck in federal court if they decide to take such an unprecedented move to cancel an election, because it looks like they may lose.)

And, of course, all of that was before yet another woman stepped forward on Monday to say that she was "attacked" by Moore as "a child". The new accuser says she feared Moore was going to rape her when she was 16 and she had to physically fight him off in his car, after she'd received a ride home from Moore, a regular patron at the restaurant where she worked as a waitress while he was a prosecutor in his 30s.

Meanwhile, Moore and his wife both claim the charges against him are all part of a "witch hunt" by media, the Republican establishment and the Democratic party and have said they plan to sue the Washington Post which reported the initial allegations last week.

We cover all of those late details, and then open the phone lines to callers today, to ring in on all of the above and much more!...

And even some real news about some fake news...

On today's BradCast, our fight against fake news --- and helping the electorate to understand which news is real and which news is fake --- continues! [Audio link to today's real show is posted below.]

Alabama's Republican U.S. Senate nominee Roy Moore continues to deny Thursday's explosive and detailed investigative report from the Washington Post, charging that when the controversial far rightwing religious zealot was a 32-year old Assistant District Attorney he sexually molested a 14-year old girl. She, like three other teens he also is said to have pursued around the same time, have all gone on record, by name, with their claims.

Despite those blockbuster charges detailed by some 30 sources in WaPo's coverage, and (somewhat cowardly) calls from Republican U.S. Senators for Moore to drop out of the upcoming U.S. Senate Special Election against Democratic candidate and former U.S. Attorney Doug Jones on December 12, most GOP officials in the state of Alabama still appear, embarrassingly enough, to support Moore. Some refuse to believe the allegations at all and others don't seem to care, even if the charges are true and amount to a sex crime against a minor. One statewide elected official (AL State Auditor Jim Ziegler) went so far as to cite the bible in support of the alleged pedophilia, and another elected official (AL State Rep. Ed Henry) actually called (twice) for charges to be brought against the victims themselves.

Nonetheless, despite ongoing "conventional wisdom" that a Democrat couldn't possibly win an Alabama U.S. Senate seat, new polling taken the day the story broke shows the race between Moore and Jones is now in a dead heat. And that's data from before, as the pollster notes, the news about Moore "had a chance to fully sink in."

Then, Donald Trump's so-called "Election Integrity" Commission headed up by top GOP "voter fraud" fraudster and KS Sec. of State Kris Kobach continues to face huge problems. After eight lawsuits have previously been filed against the sham commission, on Thursday, a ninth was filed. That one by one of the Democratic Commissioners on the panel itself!

Finally today, a number of totally fake news stories (about Tuesday's election and Hillary Clinton among other things) became popular via social media this week. We debunk several of them with the help of the Associated Press fact-checkers, included several items of fake news about the American economy and trade with Japan that the President of the United States himself spread during his ongoing Asian tour.

On the climate front, something is definitely happening. As of air time, three were killed in Ireland --- yes, Ireland --- from what, over the weekend, had been a Category 3 hurricane named Ophelia. It is the farthest east and north that a major Atlantic hurricane has ever been recorded. We also explain why the storm turned the blue Irish sky into an eerie orange as it came ashore.

In California, at least 40 are dead with nearly 200 still missing as of airtime and some 5,700 houses and commercial structures completely incinerated after more than a week of record wildfires have ravaged Northern California's wine country and other areas. The blazes follow California's record drought, then wettest winter ever, followed by its warmest summer ever --- all symptoms of the global warming which helped fuel the conditions that thousands of fire officials are still battling across the state. Donald Trump made his first public remarks about the deadly CA fires today, over a week since they broke out, when pressed at a hastily convened White House press conference (with hostage Mitch McConnell at his side.)

In related news over the weekend, an oil rig platform blew up in Lake Pontchartrain north of New Orleans, injuring seven (three critically), with one worker still missing. And the US-armed and trained Iraqi army faced off against the US-armed and trained independent Kurdish army in battles over oil fields in Northern Iraq. The US arms industry is, no doubt, rejoicing in the wake of Trump's increasingly chaotic and incoherent foreign policy, even as Iraq's Prime Minister had just days earlier described a possible military confrontation with the Kurds as "fake news". (Sound familiar?)

Then we're joined by the one and only HEATHER 'DIGBY' PARTON of Salon and Digby's Hullabaloo blog to discuss whether something is actually happening inside the White House and among Republicans in Congress as Trump's Fox "News"-fueled (read: largely fact-free) versions of both foreign and domestic policy have begun to catch up with him, and as his fury is reportedly increasing with his failure to enact any substantive legislative policies nearly nine months into his Presidency.

"This is like a cry for help that's coming from inside the White House," she tells me, citing numerous reports from dozens of sources, "that the man is losing it." But, she warns, if "cowardly" Democrats in Congress are waiting for their Republican counterparts to actually do something about it, they may be waiting a while. She descries the GOP as "the worst-of-all-possible-worlds cowardly. 'Sure, let's threaten nuclear war, let's have the entire world look down on us, let's have all soft power by the United States be completely destroyed because, you know, I might lose my seat and that's just too much.' I mean, these people are really, really cowardly."

Also over the weekend, Trump spoke at the far-right Family Research Council's so-called "Values Voter Summit" in D.C., where the "alt-right" has apparently merged with the "religious right". It was as insane as you might expect, but the question Parton speaks to is why Trump's so-called "religious right" base still buys the immoral nonsense and lies he keeps selling them.

"The idea that these Christians are seeing him as some godly creature who somehow has a biblical world view," she muses incredulously, "this is not what I had ever thought, growing up, was the standard Christian world view. They're not living in that world."

Finally, speaking of "fake news", Trump himself unleashed some remarkably fake news regarding the Affordable Care Act (ACA or "ObamaCare"), by blatantly lying about it before a cabinet meeting today at the White House when he asserted to the gathered media: "Obamacare is finished. It's dead. It's gone. You shouldn't even mention it. It's gone. There is no such thing as Obamacare any more."

Despite Trump's unforgivable lie, the ACA is still very much federal law. Open Enrollment for 2018 begins at HealthCare.gov, where tens of millions have signed up for and received access to health care and federal subsidies to help cover its costs, on November 1...

In less than 24 hours, Trump aggressively unleashes fresh havoc on the American health care system and foreign policy with Iran...

On today's BradCast: At the end of another hectic (and deadly) week in our now Dysfunctional States of America, Donald Trump has decided to turn his self-loathing and rage over his own failing Presidency into chaos unleashed on the citizens of the nation and the world. [Audio link to show follows below.]

Just hours after his Executive Order on Thursday, issued in hopes of paving the way for worse health care policies to be sold to Americans, the White House announced it would no longer pay subsidies to health insurance companies meant to help cover out-of-pocket medical expenses for low-income citizens. Over the Summer, after months of Trump threatening to cut off the so-called Cost Sharing Reduction (CSR) payments defined by the Affordable Care Act ('ObamaCare'), the non-partisan Congressional Budget Office (CBO) found that doing so would raise premiums by 20%, result in lost health care for 1 million in 2018, and increase the federal deficit by nearly $200 billion over the next decade.

So, of course Trump did it anyway.

The matter now moves to the federal courts, where state Attorneys General have announced they will file suit (along with the insurance companies who will likely do so as well, since they are still legally required to give customers the discounts, whether Trump reimburses them or not) and to Congress, which could pass legislation to mandate the payments be made. We explain what it all means, what Republican lawmakers may do next, and who will be most harmed by the President's attempted murder of the Affordable Care Act, as he tries to hoax his own gullible voters into believing it was a 'suicide'.

On Friday, Trump similarly injected even more chaos into U.S. foreign policy by falsely declaring that the seven-nation agreement that prevents Iran from creating nuclear weapons was not in the U.S. interest and that they had violated "the spirit" of the deal. In order to do so, he offered a litany of straight-from-Fox-"News" propaganda about Iran and the deal that would likely embarrass even those from the George W. Bush Administration who falsely sold the case for war in Iraq claiming that they were developing weapons of mass destruction.

That issue, on whether to officially end the long-sought pact --- which all other parties (Germany, France, Britain, China and Russia) all agree has been working well --- will also now goes to our broken Congress to determine its fate.

But, it's a Congress with Republicans like Rep. Scott Perry (PA) who accused CNN of "making up" the still-ongoing humanitarian crisis in Puerto Rico.

Amidst all of this, one leading Democrat, for what its worth, has an "urgent" idea that might end up saving the world if the otherwise impotent elected members of Congress can ever come to terms with the dysfunction they've sown and the monster they've given rise to: Take away his nuclear button. Immediately.

On today's BradCast, Here come more hurricanes, political and otherwise. [Audio link to show is posted below.]

Hurricane Maria, on a similar path to the devastating Hurricane Irma just over a week ago, has now strengthened to a deadly Category 4 before its projected landfall on many of the same Caribbean islands still reeling from Irma. But Maria is hardly the only storm swirling right now in the Atlantic and the Pacific (including Jose, Norma, Lee and Otis!).

Then, while Republicans and so-called "conservatives" last week pretended to be furious about the suggestion that Trump was working out an agreement with Democrats to protect some 800,000 kids of undocumented immigrants --- previously protected by DACA until Trump reversed it --- from deportation, in exchange for non-Border Wall border security, it turns out they're not all that angry after all. Evidence to support that argument --- along with the GOP's stated intention to balloon the national debt with massive new tax cuts and military spending --- underscores, yet again, that Republicans, like their President, have no real ideology, other than saying and doing what they believe is necessary to stay in power.

Yes, even anti-immigration zealot Rep. Steve King (R-IA) who claimed, after the deal between Dems and Trump was made public last week, that Trump's base was "blown up, destroyed, irreparable, and disillusioned beyond repair," said over the weekend that he was "gonna stick with President Trump".

Speaking of a lack of "convictions" (pun intended there), we're then joined by former Asst. U.S. Attorney RANDALL D. ELIASON, now a blogger and professor of law at George Washington University, to explain the ongoing corruption trial of sitting U.S. Senator Bob Menendez (D-NJ). Given the recent constraints the U.S. Supreme Court has placed on charges of bribery and public corruption by officials (see SCOTUS' dismissal last year of the guilty convictions against Republican Virginia Gov. Bob McDonnell and the limits on quid pro quo political bribery detailed by Citizens United and related rulings), can prosecutors successfully make charges stick against Menendez, who is charged with a number of felony counts relating to taking a huge amount of "gifts" from a physician friend, allegedly in exchange for "official acts" by the Senator.

"It's basically an exchange for these luxury trips, and jet trips, and pretty large political donations over the years, that Senator Menendez was working on these various things on Dr. Melgen's behalf," according to federal prosecutors, explains Eliason. "What the government has to prove is that there was a corrupt link between the two, that it was because of the gifts that the Senator was doing this."

Eliason, who headed up the Public Corruption/Government Fraud section at the U.S. Attorney's District of Columbia office for many years, walks us through the legal weeds of the case, which has received shockingly little attention in the corporate media, as storms --- both political and climatic --- have sucked up a lot of press attention in recent weeks.

And, though the investigation into Menendez was begun under Obama (on the heels of a completely fake news story, published by a Rightwing "news" outlet), are there any lessons we may take from this prosecution as it relates to potential charges being investigated against Team Trump? As it turns out, there are, as the always-insightful Eliason details today.

Finally, Trump's Homeland Security Advisor H.R. McMaster claimed over the weekend that Trump might be willing to rejoin the Paris Climate Agreement, but only if the there were better terms for the U.S. Our own Desi Doyen has a thought or two in response to that claim...
