On today's BradCast, Democrats now have the votes needed to filibuster Trump's SCOTUS nominee and the President faces still more lawsuits against his climate, energy and environmental policies --- and his pretend attempt to revive coal jobs. [Audio link to show follows below.]

It's official, as of this afternoon. Democratic Senators have announced enough votes opposing Judge Neil Gorsuch, Trump's nominee for the U.S. Supreme Court seat stolen by Republicans, to successfully hold a filibuster and block the nominee in the U.S. Senate. 42 Dems are now on board (enough to prevent the 60 votes currently needed to end a filibuster.) So, it's now up to Senate Majority Leader Mitch McConnell (R-KY) and the rest of the Republicans to use the so-called "nuclear option" to do away with the filibuster rule for SCOTUS nominations all together. Just three Republican defections, however, would prevent the filibuster rule from being scuttled by majority vote.

In the meantime, the opposition to Trump's faltering attempts at policy making --- particularly policies meant to try and roll back Barack Obama's environment and climate legacy --- continue to face new legal challenges. Today, a number of state Attorneys General announced their intention to challenge the Administration's costly suspension of energy efficiency standards; last Thursday, environmental groups filed suit to block the State Department's approval of the controversial KeystoneXL pipeline; and, just one day after Trump's so-called "Energy Independence" executive order was signed on Tuesday, Earth Justice sued to overturn Trump's lifting of Obama's moratorium on new coal leases on public lands and a review of royalty rates paid under the program to the government by the dying coal industry (which, as we also discuss, now employs fewer workers than Arby's, car washes or even U.S. theme parks!)

Jenny Harbine, the lead attorney in Earth Justice's case [PDF] against the Administration, joins us to explain the new lawsuit, as well as the one the same group filed against the Obama Administration in 2014, which led to the moratorium in the first place.

"Trump made a lot of campaign promises to his cronies in the coal industry," she tells me. "But the President has a legal obligation, that courts have enforced for decades, to engage in rational decision-making, to make decisions that are based on science. And here it couldn't be clearer that the directive that came down from Trump [to lift the moratorium] last week, was based solely on politics, and not on science."

She explains how the policy not only "flies in the face of the reality we all face as a nation and a world on climate change," but also how Trump's various claims at attempting to help coal miners is as likely to ultimately harm them, by keeping the federal government from investing in investing and retraining workers for the now-unstoppable renewable energy future.

"Trump's short-sighted attempt to revive a dying coal industry through subsidized leasing" is little more than "an attempt, really, to line the pockets of coal industry executives" while causing "real harm to real people and communities that are depending on the federal government to look after our interests," Harbine explains, adding: "I fear that those workers will be left in the dust."

Finally today, bad news for 180,000 low-income Kansans hoping to receive health care under Republican rule in the state, and the L.A. Times Editorial Board issues a remarkable series of anti-Trump editorials...

On today's BradCast: Donald Trump's U.S. Supreme Court nominee faced questions all day in the U.S. Senate Judiciary Committee. But what the hell is Judge Neil Gorsuch even doing there at all? And doesn't normal coverage of the hearings do little more than normalize a decidedly abnormal situation? [Audio link to show follows below.]

Donald Trump's selection to fill the seat left vacant by the death of Justice Antonin Scalia more than a year ago, represents nothing less than a stolen seat on a stolen U.S. Supreme Court. If he is confirmed, Republicans are likely to be rewarded for their theft with a majority on the high court for another generation, following their unprecedented refusal to even hold hearings for Barack Obama's nominee for the seat, Judge Merrick Garland.

I've been wrestling with how to cover this week's hearings, which I consider to be illegitimate (and that is true even setting aside the disturbing matter of Trump as President!) Professor Peter M. Shane of Ohio State University's Moritz College of Law joins me to try and help make sense of the situation. His recent piece at the American Constitutional Society, cited by the New York Times today, details how neither Democrats nor corporate media, to date, seem to have figured out how to issue any kind of institutional penalty for the GOP's blatant, brazen and unheard of theft.

Shane explains that, historically, despite Republican assertions to the contrary, "there is no close precedent" in history for what the GOP has done here. "The reason that they didn't want Judge Garland to become Justice Garland was, of course, the fear that they would be losing what had been a secure 5-4 conservative majority on the court. But they also didn't want to give him a hearing because they knew, if they gave him a hearing, that Judge Garland would appear to be so thoughtful, so reasonable, so accomplished and balanced a person, that it would be politically much more difficult to vote 'no'. Nobody in the Senate is constitutionally obligated to vote in favor of Judge Garland, it would just be hard to explain why [they didn't.]"

So they stole the seat instead, by refusing to even hold a hearing, much less a vote. As to the Democrats' lack of an organized response, such as a promise to filibuster Judge Gorsuch (or any other Trump nominee other than Garland), despite the threat of the GOP doing away with the filibuster for SCOTUS nominees, Shane observes: "It seems to me that the Democrats very frequently anticipate the political defeat that lies ahead, and just keep their powder dry for a fight that never happens." He argues Dems are likely "worried about political blowback for being a fierce party of resistance," adding: "That's what the Republicans have been, increasingly, since 1980. If they've paid a penalty for it, I haven't noticed."

Also on today's program: While Congressional hearings have taken over the beginning of the week, House Republicans are making last minute changes to their scheme to replace the Affordable Care Act, by making it still crueler for millions of Americans (but with even more kickbacks for wealthy ones!) in hopes of wheeling and dealing for enough votes to squeek by with passage in the U.S. House, where they plan to ram the bill through for a full floor vote this week before tossing it to the Senate.

Finally: A majority of Americans are unable to name even a single SCOTUS Justice, and the tax-payer cost for Trump's constant weekend vacations could cover four federal programs for the arts, the elderly, the jobless and the homeless that his budget proposal hopes to slash entirely...

Today on The BradCast, the record-breaking March Blizzard of 2017 (sorry, Weather Channel, we won't call it "Stella"!), may be mostly gone from the Northeast, but a blizzard of disinformation remains in its wake. We do our best to shovel out a bit today with our favorite Republican meteorologist. [Audio link to show is posted below.]

I'm happy to be joined today by Paul Douglas, longtime Minnesota broadcast meteorologist, StarTribune columnist and co-author of Caring for Creation: The Evangelicals Guide to Climate Change and a Healthy Environment to respond to, among many other things, those on the right (led by Matt Drudge), charging that the blockbuster late-season winter storm that swept through the Midwest and Northeast, leaving record snowfall in its wake, was actually evidence that Donald Trump should "clear out [the] climate hysterics" from the National Weather Service.

While he's here, Douglas also explains the dangers of Donald Trump's proposed massive cuts to the Environmental Protection Agency (EPA) and the National Oceanic and Atmospheric Administration (NOAA) and other science, weather and climate-related federal agencies. NOAA, he says, whose satellites are relied upon as the "eyes" of the National Weather Service, is also "essential for the private sector, and for the military". Without those eyes, many of which are already beyond their expected lifespan, Douglas argues that the nation will be "more vulnerable" to all matter of threats.

Douglas also offers his thoughts on last week's comments by Trump's EPA Chief Scott Pruitt, claiming, in contradiction of well-established science, that the scientific evidence is lacking to prove that CO2 is the primary driver of man-made climate change. Douglas gives us a non-denier Republican perspective on the entire matter, noting that we "can't pollute our way to prosperity" and argues that "the final chapter is not written yet" when it comes to the GOP response to climate change. Somehow or another he remains "optimistic" that his party will come around to reality on that score...eventually. (I remain dubious.)

Guest: Jeff Hauser of CEPR's Revolving Door Project on Team Trump's successful and ongoing 'deconstruction of the administrative state'...

A few weeks ago, Donald Trump's top White House strategist Steve Bannon vowed to bring about the "deconstruction of the administrative state". On today's BradCast, it sure looks like he's getting what he and Trump set out for. [Audio link to show posted below.]

First up today, after a week of devastating analyses of the bill by GOP leadership and Trump to repeal the Affordable Care Act (ObamaCare) and replace it with the American Health Care Plan (the Republican plan), the non-partisan Congressional Budget Office (CBO) finally came out today with its estimate [PDF] of what the scheme will cost Americans in money and health care. And it isn't pretty.

Some 14 million Americans will go without health insurance in 2018 under the Republican scheme, according to the CBO's estimate, which they note is based on "the middle of the distribution of potential outcomes." Some 24 million Americans will go without by 2026, as compared to projections for the current law. Hardest hit, as a number of reports over the weekend have found: elderly and rural voters in areas where support for Donald Trump was highest in the 2016 election.

Then, as Trump prepares to announce his "historic" slashing of billions of dollars and tens of thousands of federal jobs from non-military programs, hundreds, if not thousands of key roles at Executive agencies across the federal government remain unfilled. Many agencies are currently gutted following the resignation and/or firings of Obama staffers, and top appointments remain vacant in the meantime (because Trump has failed to nominate people to fill the roles, much less see public Senate confirmation hearings for the appointees.)

In the meantime, hundreds of unknown campaign staffers with no government experience at all, and others who are longtime industry lobbyists, are still heading up his "beachhead" transition teams, effectively controlling dozens of federal agencies on behalf of the Trump Administration. Those findings come via an analysis by ProPublica, based on responses to public records requests

Jeff Hauser of the Revolving Door Project at the Center for Economic and Policy Research (CEPR), joins us to explain what that means, and the havoc these folks --- some just out of high school and college who had worked on the Trump campaign, others lobbyists for industries being overseen by the very federal agencies they now oversee --- are able to wreak on government and policy while barely even being noticed by media or Congress.

"The level of separation between industry and the government has gone from a thin veneer of separation to no separation whatsoever," Hauser warns, describing the situation as "an intentional breeding ground for corruption".

"The State Department is a topic of particular concern," he tells me. "They have only nominated the Secretary of State. That is the only nominee. So you've seen the Obama people all leave. You've seen the strata of the top professional career people pushed out. You've seen no names offered. So you have a complete vacuum at the top of the State Department, beneath Sec. of State Tillerson. And the only people with any authority are the people who can claim to be acting on behalf of the President via their status on the 'beachhead.'"

"I think people seem to be underestimating what a federal government that seems to be more focused on enriching Donald Trump, his family, and his closest allies, could do to the lives of normal people," he explains, charging that the entire operation appears to be little more, at this point, than an attempt at "wrecking the country for financial gain."

On today's BradCast, Trump took a serious thumping from a federal appeals court this week, but his other Executive Orders on immigration move forward nonetheless, resulting, for a start, in the heart-breaking deportation of an undocumented married mother of two young U.S. born children on Thursday. [Link to full audio posted below.]

Today we cover both Trump's embarassing smack-down by the 9th U.S. Circuit Court of Appeals late yesterday, and the real life effect of his extreme immigration policies. For the latter, we are joined by Maria Castro, a 23-year old organizer with People United for Justice. She was was arrested in Phoenix this week along with other supporters of 36-year old Guadalupe Garcia de Rayos, who was deported to Mexico on Thursday, after coming to the U.S. when she was 14 years old.

Castro, an American-born citizen, describes how she and her family find themselves in a similar situation with her own undocumented immigrant mother who originally came here 24 years ago on a legal visa, but is now at risk of deportation. She discusses her arrest and efforts to help Garcia de Rayos who had been dutifully meeting with officials from the federal Immigration and Customs Enforcement (ICE) agency every six months since her 2008 arrest during a raid at her workplace in Mesa, Arizona. Garcia de Rayos she was convicted of a 6th-degree felony for using a fraudulent Social Security number so she could work (and pay into benefits that she would likely never receive back.)

During our conversation, Castro, who successfully worked to defeat controversial Maricopa County (Phoenix) Sheriff Joe Arpaio last November, describes the mixed feelings of the community as he lost while Trump won. We also discuss the mood in the community among those now threatened by Trump's policies, how they plan to fight it (along with your support), and her criticism of Phoenix Mayor Greg Stanton, who has been outspoken against the Garcia de Rayos deportation, even while, Castro charges, helping to facilitate it in a number of ways.

"My mother is undocumented," Castro tells me, adding that even a jay-walking ticket could now result in her being sent away. "Anything could happen. Any type of interaction with law enforcement could lead to her deportation. She was deported (over a decade ago) and she fought her way back to us. I was 12 years old and my little sister was in kindergarten. We needed our mom, and she made it happen."

As to going public with her name on the record, she tells me: "I have faith in my community and in the resistance, and the work that we do. I feel that the more I lean on my community, the more people I have to support me, the better. For us, for me, what we need to do as a community and community organizers, is we need to start to come together. We can no longer sit in our homes and watch TV and share things on Facebook."

President calls for 'major investigation', but forgot to check with own appointees first. Plus: EPA climate science lockdown and listener calls...

On today's BradCast, Donald Trump called this morning for "a major investigation" into what he falsely claims to be 3 to 5 million illegal votes cast in the November 2016 election, "including those registered in two states". But Trump probably should have checked with his own top appointees before pointing fingers. [Audio link to show posted below.]

Of course, many Republicans will be all too happy to "investigate" Trump's "bogus" claims and use them, no matter what little fraud is revealed, in order to institute voting restrictions that have nothing to do with fraud, but may well keep those who tend to vote Democratic from being able to vote at all.

As discussed today, we've been covering these issues for more than a decade here at The BRAD BLOG and on The BradCast for a reason. Donald Trump is just one of them. We look at his repeatedly debunked claims, the discredited studies cited in support of them by his Press Secretary and the nascent effort by some Democratic members of Congress to push back.

On today's BradCast, U.S. media failed to report on the rise and dangers of Mussolini and Hitler with the gravity that was warranted in the 20s and 30s. Are they making similar mistakes today with the rise and elevation of Donald Trump to President of the United States? [Audio link to show is posted below.]

Media Matters' Matt Gertz joins me to today to argue Trump's bizarre press conference on Wednesday, his first since the November election (first since last July, actually), revealed more than a dozen "signs of how bad press treatment will be under Trump". At the presser, the day after the release of an unsubstantiated dossier charging personal and financial compromise with Russia, Trump refused questions from either CNN or BuzzFeed News, declaring them both to be "fake news" for breaking various elements of the story. Gertz suggests the way it played out illustrates that the media are both failing to push back against Trump, and are likely underestimating how bad things are likely to get for them (and all of us) once he becomes President.

"This was not something that came out of nowhere," Gertz tells me. "This was clearly the strategy going into the press conference: to attack Buzzfeed, to attack CNN, to tie the two of them together, and to suggest that all of their reporting was illegitimate."

"They're going to go on trying to de-legitimize the media, one by one, piece by piece, to make it impossible for anyone to try to get out critical news analysis about what his administration is doing. This was the first step, and it's going to keep getting worse," he warns. "Trump bragged on the campaign trail that he could stand in the middle of 5th Avenue and could shoot somebody and he wouldn't lose voters. Rhetorically speaking, that's what he basically did to [CNN's] Jim Acosta. He basically took him out in front of the entire press corps, humiliated him, pretty brutality, and other reporters just sort of moved along. They went on and they asked their questions, and they just kept going."

But were CNN and BuzzFeed wrong to report as they did in the first place? And do the media, in general, have only themselves to blame for the spot they're in at this point? Have they learned anything from last Wednesday, much last the past year? And is that Breitbart clown "reporter" Matt Boyle the new "Jeff Gannon"? We discuss all of that and much more during today's conversation.

Guest: Univ of Chicago's Daniel Nichanian on proactive, state-by-state measures that Democrats can and must take to expand voting rights...

On today's BradCast: Enough playing defense. It's time for Democrats to go on the offense, in states all across the country, to expand the franchise, in numerous ways, rather than simply defending against increasing Republican efforts to restrict voting rights. And where they won't, it's time for progressives to hold them accountable for it. [Audio link to show follows below.]

Today I'm joined by Daniel Nichanian, election expert and post-doctoral fellow in political science at the University of Chicago to discuss his "Voting Rights Manifesto: A State-by-State Plan to Defend Democracy", as recently published in Vox.com's "Big Ideas" series.

Nichanian explains where and how Democrats can and must take action, right now, even during the Trump years, to expand voting rights and access to the polls. Yes, it can (and must) be done in states across the country where Democrats still have control of legislatures and governorships. In many cases, as he describes, Dems don't even need to control both.

No need to wait for and hope that Congressional Republicans to restore the Voting Rights Act, which they probably will never actually do. There are many ways for Democrats to expand voter registration (such as automatic universal registration and other reforms), expand the pool of those eligible to vote (restoring millions of felons' voting rights, for example), ways to make it easier to vote (early voting and easier access to absentee voting), and many other tools to take a proactive stand in the new year.

"The Democratic Party has not been at the forefront of the voting rights issue in the past two years," Nichanian observes. "The issue has really come to a head since the wave of Republican takeovers of state houses in 2010 and 2014, when the Republican Party really prioritized, in state after state, putting in place a very ambitious and consistent agenda of its own to curtail voting rights. The extent to which the Republican Party has prioritized this issue, it keeps taking Democrats by surprise." But, he explains, "when the Democratic Party has power, in many places, they really don't get their act together to think about what has to be done on this issue, and actually get it done."

We discuss how Democrats can do so. We also try and hold them accountable for not having done so to date in so many places where they should have by now --- even in places like New York and California. I'm hoping the conversation, and Nichanian's piece at Vox, might give us all something positive to work for in the new year, even at the same time as progressives build the resistance against the destructive, anti-democratic agenda of Donald Trump and the GOP.

Also on today's show: Fox "News" wingnuts continue their climate change hoax; Democrats in North Carolina end up playing Charlie Brown to the state Republicans' Lucy --- again. And, finally, Desi Doyen joins us for our year-end Green News Report as Obama, on his way out the door, bans off-shore oil drilling in large parts of the Atlantic and the Arctic, and not a moment too soon. The Arctic has turned freakishly warm over the past two months of what is likely to be the warmest year ever recorded on the planet (for the third year in a row). She also has some good news as the year wraps up, however: A new poll finds that Trump's voters actually support regulations on the burning of carbon that causes global warming and, something that even Trump can't change, solar power is now the world's cheapest form of energy. Take that, Big Oil, Big Coal and 2016!...

A federal court victory for Jill Stein in Wisconsin; a federal court hearing in Pennsylvania; the fight to restart counting in Michigan; and the case for a recount in Florida. Yes, in Florida. But that's just the tip of the iceberg on today's very busy BradCast! [Audio link to complete show follows below.]

First up, some encouraging news from the New York Attorney General concerning his intentions to hold Donald Trump's nominees to head up the Environmental Protection Agency and Dept. of Labor accountable to the rule of law. Then, a bit more good news out WI today, where a federal court dismissed a Team Trump attempt to stop the ongoing Presidential "recount" in the state.

Meanwhile, a federal court in PA heard Jill Stein's case calling for a statewide count and forensic analysis of voting systems today. And, following the the hearing, in a press conference outside the courthouse, University of MI Computer Science and voting systems expert Prof. J. Alex Halderman explained again why such a study is necessary.

"Over the past ten years, we've found every one of the [voting and tabulation systems in the U.S.] susceptible to hacking. Doesn't matter whether they're plugged into the Internet directly or not," he said. "The evidence on the paper ballots, the evidence on the software in the machines --- that's what we're asking to examine. And that's the only way we're ever going to know for sure whether our votes were counted correctly or not in the 2016 Presidential election. We think that by looking at that evidence, which seems to me like just a common-sense security precaution, we can increase voter confidence, and help everyone know their that their votes really counted." Those comments come on the same day that the Obama Administration announced plans to release a report on charges that Russian hackers attempted to interfere in the 2016 U.S. election.

Then, we're joined by long time election integrity champion, Susan Pynchon, founder of Florida Fair Elections Coalition and a central character in HBO's Emmy-nominated 2006 documentary Hacking Democracy, joins us to discuss a lawsuit [PDF] filed late last week calling for a statewide hand-count of paper ballots in FL(!)

Pynchon explains the reasons why it was filed, which include not just the surprising result in the state's Presidential race, but also reports that a Florida-based corporate vendor by the name of VR Systems --- a company contracted by about a dozen states --- was reportedly hacked earlier this year. She says they provided "voter registration and other services in 64 of Florida's 67 counties. Voter databases, management and tracking of mail-in ballots, and election reporting services on election night." (And here is that Exhibit T [PDF] from the complaint that I referenced during the show, concerning troubling voter registration problems reported on Election Day in several Sunshine State counties, including Broward and Lee.)

Also, Pynchon details the high "invalid vote rate" ("votes that weren't actually counted --- undervotes, overvotes, and invalid write-in votes"), which she says is "more than double in this election than it was in 2008 and 2012. We need to take a close look at that because it's not normal. It's not typical of past elections." She goes on to describe how one county was also found to have "ordered duplicate sets of [security] seals," asking: "So how secure is that when you're sealing a ballot box with a seal that could then just be replaced with your duplicate set of seals?"

Coincidentally, part of Halderman's remarks from outside of the federal courthouse in Philadelphia this afternoon, which we play in full on the show today, referred to how easy it is to break into those voting machine security seals. He says they are "easy to remove in just a few seconds with a hairdryer or a screwdriver."

"You know, if you'd asked me this ten years ago, I would have said, well, maybe it sounds like science fiction, someone hacking into a country's national election by tampering with the voting machines," warns Halderman. "I think it's only a matter of time before this happens, if it hasn't happened already."

Finally today, an incredibly chilling missive was confirmed to have been sent to the U.S. Dept. of Energy from the Trump transition team, seeking the names and details of scientists and other employees there and at national laboratories involved in climate change and other related studies...

Meanwhile, down in North Carolina, where voters appear to have elected a liberal majority to the state Supreme Court and may have rejected their controversial Republican Governor's re-election bid by a slim margin, the Republican-majority state legislature has a scheme to overturn the will of the voters in both the gubernatorial contest and at the NC high court. Because that's how the GOP rolls (and Democrats don't).

Finally, Desi Doyen joins us for the latest Green News Report, with a slim ray or two of optimism, believe it or not, as Sen. Bernie Sanders offers a way for Obama to (permanently?) block the Dakota Access Pipeline from being built, and international U.N. climate negotiators vow to keep reducing greenhouse gas emissions, no matter how Trump plans to undermine efforts to curb global warming...
