As the headlines report, yesterday Judge Reggie Walton, U.S. District Court of D.C., sentenced I. Lewis “Scooter” Libby to 30 months in prison and fined him $250,000 following Libby’s conviction on four counts of perjury, obstruction of justice and lying to a grand jury in the Valerie Plame CIA leak case. In the crowded courtroom where I sat were the defense and prosecution teams; a front row of prominent Libby supporters including lobbyist and former DOJ spokesperson Barbara Comstock, Republican commentator/advisor Mary Matalin, Republican polemicist/attorney Victoria Toensing; Libby’s wife and friends; and full pews of press and spectators.

Defense attorney William Jeffress brought out some new items at the sentencing hearing: 1) CIA public affairs officer Bill Harlow had a “conversation” with Bob Novak that “didn’t come in” at the trial; 2) back in 1998 Valerie Plame was brought back to the United States, Jeffress asserted, because it was “feared her cover had been blown”; and 3) Mr. Wilson had conversations with “almost total strangers” in which he revealed his wife’s employment. Actually, that last item has been suggested before by the ‘noise machine’ (David Brock’s phrase).

If the past is any guide, we shall see these items again in coming weeks/months; the question is whether they will be recycled by the echo chamber or outsourced to the MSM. (Former WH staffer David Gergen said on NBC News last night that the president will be under HUGE pressure to pardon Libby, thus applying pressure). Will Bob Woodward divulge behind-the-scenes discussions about these items, like sinus medicine in a time-release capsule, over the next six or eight months or in a book published around the time Libby’s appeal is argued?

The appeal will follow next week’s hearing on bail. For now, the question immediately before the court is how soon Libby should go to prison....

Comey testifies --- and the logic of the process of elimination begins to set in. Even the congressional GOP may have to acknowledge that the Department of Justice was not the instigator in those weirdly self-destructive, unprecedented firings of several mostly Republican US Attorneys, mid-term, during a Republican administration. That was the impression I got while sitting in the hearing room this morning at the U.S. Capitol.

Former Deputy Attorney General James B. Comey testified at a hearing before the House Judiciary Committee’s Subcommittee on Commercial and Administrative Law this morning. Spending no time or ink on a prepared statement, Comey, who had been subpoenaed by the Committee, devoted approximately two hours to answering questions from the mostly Democratic members present. The hearing, which most GOP members skipped, was chaired by Linda Sanchez (D-CA).

As Judiciary Chairman John Conyers (D-MI) said in opening, “What we don’t know is who actually placed the names of the US Attorneys on the firing lists.”

Comey plugged up one hole: it was not he.

Unlike Attorney General Alberto Gonzales at a previous hearing, Comey did not testify under oath (a staffer for the Subcommittee explains that anyone who testifies to Congress is subject to penalty for perjury). Comey did, however, speak clearly and unequivocally. He said in answer to questions that, as Deputy Attorney General, he was the supervisor directly above the US Attorneys, and in response to key questions from Democratic members, Comey stated flatly that...

Today I sat in on the Senate Judiciary Committee hearing, “Department of Justice Oversight,” part of which Brad posted about, earlier. The solo witness was Attorney General Alberto Gonzales, covering some by-now familiar ground in the matter of those questionable firings of US Attorneys in seven of 93 districts. In spite of some repetitive questioning, primarily by Charles Schumer (D-NY), the day was actually enlightening.

First, the hearing further indicated the direct White House connection suggested earlier by Brad. Gonzales is still in a position where he cannot speak freely about Bush, even if he wanted to do so. But even Gonzales’ measured and cautious answers to questions were revealing. Senator Patrick Leahy (D-VT), chair of Judiciary, led off by asking whether Gonzales had had any conversations about the US Attorneys with White House senior advisor Karl Rove. Answer: yes, in fall 2006 Gonzales had a conversation with Rove about USAs, regarding “voter fraud” in three districts – New Mexico, Milwaukee, and Philadelphia....

On Tuesday, April 3, 2007 the Washington Post finally got around to publishing a front-page article, “How Bogus Letter Became a Case for War,” on the bogus Niger/uranium/Iraq story underlying those infamous “16 words” in Bush’s 2003 State of the Union speech.

The Post subtitle is “Intelligence Failures Surrounded Inquiry on Iraq-Niger Uranium Claim.” A more accurate subtitle would have read, “Intelligence Community Caved to Bush-Cheney Pressure.”

Has the Washington Post been fooled (again) by high-level ‘leakers’? It sure looks that way.

On Tuesday, March 20, the Post ran a front-page article on the DOJ-U.S. Attorneys scandal that led off:

U.S. Attorney Patrick J. Fitzgerald was ranked among prosecutors who had ‘not distinguished themselves’ on a Justice Department chart sent to the White House in March 2005, when he was in the midst of leading the CIA leak investigation...

The item was sourced to unnamed “administration officials” who gave it to two WaPo reporters “yesterday.”

This juicy lede graf was followed up:

The ranking placed Fitzgerald below "strong U.S. attorneys..." but above "weak U.S. attorneys who...chafed against Administration initiatives, etc.," according to Justice documents.

The major problem with this story? It’s not true. The Department of Justice never 'ranked' U.S. Attorney Fitzgerald negatively or as 'undistinguished.' According to sworn testimony by D. Kyle Sampson, today in the Senate Judiciary Committee, Fitzgerald was rated 'very strong' internally in the DOJ.

So who fed the Post that story? And why did they run it without pinning it down first?...

"We don't have a law that would make war profiteering specifically a federal crime," Sen. Leahy (D-VT) said in this morning's efficient hearing conducted by the Senate Judiciary Committee, so he is introducing one.

The Senate Judiciary Committee is busy these days --- what with the scandal over White House manipulations of the prosecutorial function of the Department of Justice, the continuing scandals of war profiteering in the "war on terror," and other oversight matters, the Committee is in jeopardy of being overstretched. In fact, it already is overstretched.

The room was full for this morning's hearing, which I attended, on "Combating War Profiteering," but, as with last week's House Oversight Comittee hearings with Valerie Plame et al, this one was also scantly attended by GOP'ers. Of Republicans, only the co-chair of the committee Arlen Specter (R-PA) and --- to do him justice --- Sen. Tom Coburn (R-OK) graced the hearing with their presence. The co-chair could do no less, and indeed did little, though I noticed that both he and Leahy alluded to their past jobs as prosecutors, from which it can safely be inferred that they too think the current manipulations of US Attorneys --- prosecutors --- by the DOJ look very bad...

Republican Commentators Misstate Chronology, Facts

After sitting in on the Libby trial every other day and posting about it on BRAD BLOG, I had intended not to write further about the matter barring new developments. Unfortunately, the rightwing spin machine has launched a new campaign of misstatements that sound intentional.

So much for respecting authority, upholding the law, and appreciating honest hard work: now that a conscientious jury has rendered a verdict of guilty on four of five counts of perjury and obstructing justice for I. Lewis "Scooter" Libby, the GOP noise machine is vilifying the prosecution and smarmily denying any wrongdoing, any at all, in the CIA leak.

So much for conservatism.

Well, bad sports are bad sports, anywhere on the political spectrum. Still, the brazen willingness of commentators subsidized by Rupert Murdoch or the Bradley Foundation to falsify every significant fact in the Libby matter, usually without having sat even one day in court for the trial, is pretty much typical of their work ethic and intellectual rigor.

Sunday morning’s talk shows were representative. George F. Will and Torie Clarke on ABC’s This Week with George Stephanopoulos downplayed the CIA leak matter by saying the whole thing “all arose from one column” (Will), a column not very important at that (Clarke).

The right wing is trying hard to keep this one alive. But trial evidence and testimony have revealed that the attempt to “leak” – actually, plant – Mrs. Wilson's name with the media began BEFORE Wilson’s column was published.

Wonder why GOP supporters of George W. Bush find that so uninteresting....

I sat in on this morning's mark-up session in the House, and the results, so far, are very encouraging...

“Postmortem” isn’t really the right term here, since Libby’s defense team promptly announced that it will file motions for a new trial and, if those are denied, will appeal the verdict. Also, nobody died. At least in the trial itself.

But I do want to wind up with one final post on the Libby trial before going on to other matters including Sibel Edmonds. Instead of going to my notes and the documentation, this time I’ll stick with that much-abused and exploited faculty of memory invoked in the trial. (BTW, memory is always selective. That’s why we have the word “memory,” to distinguish that which we can remember from that which we cannot.)...

Testimony in the Libby trial from CIA briefer Craig Schmall, who had the unenviable task of getting up in the wee small hours to brief Vice President Cheney and Lewis "Scooter" Libby from Summer 2002 through the end of May 2004, establishes that the tables of contents of the CIA briefing binders for that period “still exist.”

As Schmall states clearly on the record, when he sent the briefing binders to shredder and burn bag, he kept the topic headings – where, not stated. But somewhere in the Executive, at this moment, rest stacks of Tables of Contents with at least a short-title indication of what Cheney, Libby and others, including Rumsfeld, were briefed on, for any given date.

Presumably Schmall isn’t the only intelligence briefer who kept these things, either. His trial testimony and exhibits refer to two previous briefers, one unnamed, for Cheney and Libby.

At this point it would be ludicrous for the administration to try to keep those tables of contents secret by claiming “national security.” There would be far more potential damage to domestic security in leaving a giant secret stash of blackmail material around...

With the jury still out, here in D.C., I had time to look through some court documents in the Libby case and came across an aspect of the "yellowcake" saga which has not yet been reported to my knowledge. I have emailed the Office of the Vice President (OVP) for a comment on this matter and will report back when, and if, I hear from them.

The documents filed in USA v. Libby reveal an arresting short chronology within that longer saga of the bogus Iraq-Niger uranium item, the Wilson trip to Niger and the outing of CIA agent Valerie Plame Wilson.

An apparently related document may shed new light on the publicly-known points reported so far...

What Were They REALLY After?

In today’s Washington Post ombudsman column, “Covert Question, Open Controversy,” Deborah Howell says, “Wilson's New York Times op-ed piece, critical of the Bush administration's use of intelligence, set off a chain of events that led to the disclosure of Plame's job.”

But information and testimony revealed during the course of the Libby Trial indicates that it wasn't Wilson's op-ed piece that set the off the chain of events leading to their disclosure of the CIA WMD analyst and her covert network. The Bush administration began its campaign to discredit Valerie Plame/Wilson at least a month prior to the release of her husband's article.

I can’t criticize Howell for her focus on the op-ed as the ball that got the campaign rolling. I, and most of the media, having been basically taking the same line in previous postings on this topic. Most of the writers on the CIA leak have been doing the same. Joseph Wilson’s book, The Politics of Truth: A Diplomat's Memoir: Inside the Lies that Led to War and Betrayed My Wife's CIA Identity, takes the same tack: that the outing of CIA analyst Valerie Plame, Wilson’s wife, was retaliation for Wilson’s July 6, 2003, op-ed column, “What I Didn’t Find in Africa.”

But when Wilson wrote his book, he did not have access to behind-the-scenes discussions about his wife now revealed through the perjury and obstruction trial of I. Lewis "Scooter" Libby, Vice President Cheney’s former chief of staff. Retaliation there was, in spades, but testimony and documents in the Libby trial demonstrate, unrefuted, that administration discussion of Mrs. Wilson began several weeks before Wilson’s column appeared.

The reasons why are still unclear, and the prosecution was not permitted to delve into ramifications of the leak. But that the administration was already targeting both Wilson and his wife, Valerie --- overseeing a crucial intelligence network monitoring WMD activity in the middle east --- is now beyond question.

So why, beyond Wilson's op-ed, was the Bush Administration previously so intent on discrediting one of its own CIA assets?...

The vengefully insignificant are hoping to rampage
Two and a half days of jury deliberations, and they're already coming out of the woodwork

Conventional wisdom is that when a jury spends much time deliberating, it will find a defendant not guilty. After two and a half days deliberating, the jury in the Libby trial went home today for the weekend.

So the rightwing noise machine thinks it smells blood and is starting some early gloating. Here, for example, is Rush Limbaugh --- premature but already tasteless: “So Fitzpatrick is sweating it out. Fitzrussert sweating it out. Fitzmatthews is sweating it out. Nobody knows what it means that the jury has yet to come back. Fitzsulzberger at the New York Times is probably sweating this out just a little bit.”

I don’t have time to rebut the kind of dishonesty that would connect the excellent and dedicated Special Prosecutor in the Libby trial, Patrick Fitzgerald, with NBC and the New York Times. I heard closing arguments in the trial last Tuesday and have not changed my own opinion that the prosecution rebuttal by Fitzgerald was awesome. Phenomenal. ...

Administration coordinated a PR firing squad, put together ad hoc PR hit on the Wilsons
The collateral damage was to classified, objective WMD analysis at the CIA...

At this writing, the jury is out in the perjury and obstruction of justice trial of I. Lewis Libby, former chief of staff for Vice President Cheney. When I left the courthouse this afternoon, Judge Reggie Walton was attending a memorial service, with the jury still deliberating for the second day.

I can make no prediction as to the trial outcome. However, in the interim some media outlets are pushing or falling into an insidious line that the Libby case is either too difficult and obscure to understand, or too trivial to bother with. Setting aside the allegations against Libby individually, this line is dangerous, partly because it is so blatantly the reverse of accurate. The CIA leak matter itself is actually very simple.

The Bush Administration, its Loyal Supporters and Now Even the Washington Post Help Spread the Demonstrably Misleading Canard
But Why?

One of the pettiest distortions connected with the CIA leak matter is simple: the flat-footed, bogus claim that Ambassador Joseph Wilson said he was ‘sent’ to Africa by Vice President Cheney.

Wilson did not make the assertion, but White House operatives and their media/think-tank allies continue, even today, to forward the fiction that he did.

This claim – that Wilson went around saying Cheney sent him to Niger – has been recycled by the rightwing echo chamber every time the radar screens registered some political fallout from the CIA leak case (many examples shown below). It has also arisen during testimony in the Libby trial.

However, the MSM (except Fox) have not parroted the same claim – with the interesting exception of NBC, mainly Chris Matthews.

Regrettably, this bogus claim is again given space in Sunday's Washington Post, in an article by the hard Bush partisan and former Reagan Justice Department attorney, Victoria Toensing, called “Trial in Error.”
