By Brad Friedman on 7/6/2020 6:15pm PT

Donald Trump celebrated the national 4th of July holiday weekend by using the backdrop of our national monuments to try and "gaslight" the nation again on coronavirus while hoping to spark a race war to jump-start his flagging re-election effort. So, how did your Independence Day weekend go? But, first up on today's BradCast...[Audio link to show is posted below summary]...

A number of countries around the world have now all but defeated the COVID-19 virus within their borders. In the U.S., on the other hand, thanks to our failed/non-existent national strategy, new infections and hospitalizations continue to explode, hitting new records for each of the past 27 days. That, as Trump and his White House continue to hope that by ignoring the pandemic, it will simply go away or that Americans will simply "grow numb to the escalating death toll" by Election Day. Good luck with that.

His own FDA Commissioner didn't have the courage over the weekend to contradict Trump's false claim at the White House on July 4 that, for 99% of people who contract the virus, it's "totally harmless". Iowa Sen. Jodi Ernst (R), who described President Obama's eradication of the Ebola epidemic in the U.S. with just two deaths as "failed leadership", didn't have the courage to describe Trump's leadership as "failed", despite nearly 3 million confirmed cases now in the U.S. and more than 130,000 deaths from COVID-19. Ernst is up for re-election in the Hawkeye State in just four months. Hopefully voters will keep her cowardice and its deadly consequences in mind.

Former Trump National Security Advisor Tom Bossert, however, came much closer to telling the truth to the American people on Sunday, by warning that "We are in trouble." And that if the virus continues on its current trajectory in the U.S., "we could top 500k US deaths this year." Good luck ignoring or becoming numb to that.

In U.S. Supreme Court news on Monday, the Justices on the Republicans' stolen Court released two interesting opinions on Monday. In a 6 to 3 ruling, the Supremes struck down a statutory exemption written into the Telephone Consumer Protection Act of 1991 that allows for the federal government to make otherwise banned robocalls on cellphones. The court found that exemption unconstitutional, but allowed the rest of the law to stand in what could be a good omen for a challenge coming up next year at the High Court to the Affordable Care Act (Obamacare). And, in a unanimous decision today, SCOTUS found that states may bar so-called "faithless electors" from casting votes at the Electoral College that contradict the popular will of state voters. We'll discuss more about both opinions on tomorrow's BradCast.

Today, however (amid a tribute to the late great Ennio Marricone) we're left to make sense of Trump's astonishing, aggressive, political, campaign-style rallies held on the 3rd and 4th of July at Mount Rushmore and at the White House in which he, according to our guest today, HEATHER DIGBY PARTON of Salon and Hullabaloo, all but ignored the deadly coronavirus pandemic, along with its accompanying economic disaster, to offer "angry declarations of war against fellow Americans on the day the country celebrates freedom and independence."

By declaring war on what he described in the shadow of our nation's founders as "far-left fascism" and a "merciless campaign to wipe out our history, defame our heroes, erase our values, and indoctrinate our children" by "unleash[ing] a wave of violent crime in our cities," Parton concedes that at least he's being transparent. "If nothing else, I think we can see what the contours of the next four months of the Presidential campaign are going to be," she tells us, "and how he and his people have decided that they are going to deal with the real crises that are manifesting themselves in the country --- the obvious one is COVID-19 and the rapid spread of it throughout the country, and the other is the ongoing protest of unarmed black men being killed by police and systemic racism in general." That, as we discuss, instead of offering actual Presidential leadership during the most deadly pandemic in more than a century which might have otherwise assured his re-election.

Parton also offers her thoughts on last week's mind-blowing allegations that Russian military intelligence paid bounties to members of the Taliban in exchange for dead U.S. troops in Afghanistan while Trump has done absolutely nothing in response, and the too-overlooked story from Carl Bernstein late last week in which former Senior White House officials, from Trump's former SecDef, Sec. of State, Chief of Staff, two National Security Advisors and others confirm that Trump was "uninformed" and "delusional" during phone calls with world leaders; never got better at it over the years; was sycophantic in dealing with adversarial autocrats; and "near-sadistic" in his treatment of U.S. allies, especially the female leaders of the U.K. and Germany who he called "stupid" during at least one of the phone calls.

That conversation and few listener calls round out the hour, as we are now exactly 120 days from Election Day, November 3rd...not that anyone's counting...

Guest host Nicole Sandler with the CA Congressman on his new book, 'Endgame', and a different look at the 4th of July...
By Nicole Sandler on 7/3/2020 5:05pm PT

It's NICOLE SANDLER, back in to guest host another edition of the BradCast. This weekend is the 4th of July holiday, but this year many of us are looking at it in a different way, seeing the rest of American history that's not usually remembered or recognized on "Independence Day." [Audio link to full show is posted below.]

I opened the show with a bit of wishful-thinking humor-- an "apology" from Donald J. Trump for his mishandling of the coronavirus crisis. It's courtesy of Liz Plank and The Recount. Just click here to watch the magic.

My guest today is REP. ERIC SWALWELL of California's 15th District, who has a new book, Endgame: Inside the Impeachment of Donald J. Trump. Since he's working from home, we even got a quick visit from his daughter who they call Cricket!

At the end, I shared a missive that I found on, of all places, Facebook. Typical of the venue, I have no idea who wrote it. But it's one of the few items I copied and pasted and shared. It's for white people who still don't understand why "all lives matter" is not a reasonable response to Black Lives Matter. This is the part of American history and Independence Day I think we need to spend a little more time on this 4th of July.

In the simplest terms:

400 years ago white people brought black people over here and enslaved them. And sold them. And treated them as less than human. For 250 years. While white men built the country and created its laws and its systems of government. While 10, 15 generations of white families got to grow and flourish and make choices that could make their lives better.

And then 150 years ago white people "freed" black people from slavery. But then angry white people created laws that made it impossible for them to vote. Or to own land. Or to have the same rights as white people. And even erected monuments glorifying people who actively had fought to keep them enslaved. All while another 5, 10 generations of white families got to grow and accumulate wealth and gain land and get an education.

And then 60 years ago we made it "legal" for black people to vote, and to be "free" from discrimination. But angry white people still fought to keep schools segregated. And closed off neighborhoods to white people only. And made it harder for black people to get bank loans, or get quality education or health care, or to (gasp) marry a white person. All while another 2-3 generations of white families got to grow and pass their wealth down to their children and their children's children.

And then we entered an age where we had the technology to make PUBLIC the things that were already happening in private-- the beatings, the stop and frisk laws, the unequal distribution of justice, the police brutality (police began in America as slave patrols designed to catch runaway slaves).

And only now, after 400+ years and 20+ generations of a white head start, are we STARTING to truly have a dialogue about what it means to be black.

White privilege doesn't mean you haven't suffered or fought or worked hard. It doesn't mean white people are responsible for the sins of our ancestors. It doesn’t mean you can’t be proud of who you are. But it DOES mean that we need to acknowledge that the system our ancestors created is built FOR white people. It DOES mean that we aren't disadvantaged because of the color of our skin and it DOES mean that we owe it to our neighbors-- of all colors-- to acknowledge that and work to make our world more equitable.

BLACK LIVES MATTER

Guest host Nicole Sandler with Jeff Sharlet on the cult and former CIA officer Jack Rice on the bounties...
By Nicole Sandler on 7/2/2020 5:26pm PT

It's NICOLE SANDLER, guest hosting another edition of The BradCast, and we have a busy show today.

My first guest is author, professor and journalist JEFF SHARLET (author of The Family: The Secret Fundamentalism at the Heart of American Power). He went to a bunch of Trump rallies so you don't have to. Sharlet explains what he learned in Vanity Fair's "He's the Chosen One to Run America: Inside the Cult of Trump, His Rallies Are Church and He Is the Gospel."

We also check in with my old friend and radio colleague, JACK RICE. He's a former CIA officer who I wanted to speak with about the Russia bounty for dead American soldiers in Afghanistan. He has a unique perspective on the story.

Jack is also a criminal defense attorney who lives in Minneapolis, about 10 blocks from where George Floyd was killed. And he's representing someone who was arrested for pulling down a statue of Columbus.

Which leads us to an op-ed that appeared in the Sunday NY Times, written by a poet named Caroline Randall Williams. I ended the show with a reading of her devastating words that everyone should read titled "You Want a Confederate Monument? My Body Is a Confederate Monument."

Guest host Nicole Sandler w/ Elie Mystal on SCOTUS, DOJ corruption...
By Nicole Sandler on 7/1/2020 4:17pm PT

It's NICOLE SANDLER, your faithful guest host filling in for Brad and Desi today on the BradCast.

Our Justice Department is horribly corrupt with an Attorney General who really has taken on the role of Donald Trump's 'Roy Cohn'. We're also at the official end of this term of the Supreme Court. I couldn't think of anyone I'd rather speak to about both of these issues other than ELIE MYSTAL, the informative and always-entertaining justice correspondent for The Nation magazine.

Of course with all the madness in our world, we begin with the latest news...From the coronavirus --- the number of new cases of COVID-19 in the United States has gone up 80% in the past two weeks, adding to the country's record of confirmed cases, which is the worst in the world. Dr. Anthony Fauci, the nation’s leading infectious disease expert, warned on Tuesday that the United States could see more than a doubling of current tallies of new cases every 24 hours --- with 100,00 new cases each day a definite possibility.

Then there's the bombshell report on the Russians paying bounties on American lives to Taliban aligned fighters in Afghanistan. For the doubters out there, the NY Times is following the money, reporting "American officials intercepted electronic data showing large financial transfers from a bank account controlled by Russia's military intelligence agency --- the GRU --- to a Taliban-linked account, evidence that supported their conclusion that Russia covertly offered bounties for killing U.S. and coalition troops in Afghanistan."

And we run down the U.S. Supreme Court cases that were announced over the past week, and let you know which ones we're still waiting on.

There's certainly no shortage of news as we head into the 4th of July holiday!...

Also: Carl Reiner, RIP...
By Brad Friedman on 6/30/2020 6:34pm PT

In case you need something to celebrate this July 4th, it will be just 200 days exactly from that date until Donald Trump will no longer be the President of the United States next January! ... Presuming he is not able to somehow steal a second term anyway. Let's not let him. Therefore, go celebrate Independence Day in advance this Saturday on July 4th!

In the meantime, as we work our way towards that glorious day, a few related news items of note on today's BradCast [Audio link to full show follows summary below]...

  • Wyoming Republicans are beating themselves up over...well, apparently being Republicans. Literally! A fist-fight broke out over the weekend at the Wyoming Republican Party state convention in Gillette, as the party's extremist and less extremist factions duke it out, with one County Party chair who wielded an ax-handle and a pistol, versus another drunk County Party chair who ended up unconscious and in need of surgery as the whole debacle is investigated by local police. Grab your popcorn, because it's as insane as it sounds. We've got the blow-by-blow details!;
  • As to the battle between the Democratic Party's progressive and conservative wings, that appears to be playing out a bit more peacefully, at the ballot box instead. AP has now called a winner in Kentucky's Democratic U.S. Senate Primary a week after it was held. The delay was due to absentee ballot counting in two of the state's largest and most diverse counties, Jefferson (Louisville) and Fayette (Lexington). Neither released any results from the state's June 23 primaries until today. If the reported results are accurate, it appears that party establishment-supported former fighter pilot Amy McGrath will be the Democratic nominee to take on GOP Senate Majority Leader Mitch McConnell this November. She is said to have narrowly edged out progressive African-American state legislator Charles Booker, who surged to mount a serious challenge to McGrath and her large campaign war chest at the end of the campaign during protests for racial justice in the state. In the end, if the computer-tallied results are accurate, Booker's late surge --- as a Sanders/Warren/AOC-endorsed supporter of Medicare for All and the Green New Deal --- came up just short of the votes needed to defeat the front-runner who had been the presumptive nominee since being recruited by Senate Minority Leader Chuck Schumer last summer. We'll see if McGrath also has what it takes to take down McConnell this fall. That, according to recent polling, will be no easy feat in a state that went for Trump by 30 points in 2016. But it will be well worth the effort in trying;
  • The National Republican Committee, the Trump Campaign and several sitting GOP Congressmembers are now filed a federal lawsuit in Pennsylvania, claiming that their use of secure absentee ballot drop-off boxes somehow violates the U.S. Constitution, even though absentee voting was approved last year by the state's GOP-majority legislature and the use of drop-off boxes is a recommended best practice by vote-by-mail experts and the federal government alike;
  • We'll see if the Republicans' federal lawsuit in PA has any better chances for success than a similar attempt by the GOP and Trump Campaign to sue California in an effort to prevent absentee ballots being mailed to all active registered voters. That initiative was mandated by Gov. Gavin Newsom's recent Executive Order in the wake of the COVID-19 pandemic, and in a subsequent Republican-supported bill passed by the state legislature and signed by the Governor;
  • And here's that article I referenced by Ernie Canning on the other Dept. of Justice whistleblower who testified in the U.S. House Judiciary Committee last week about Bill Barr's abuse of the DoJ's Antitrust division to harass California and automakers who are working with the state (to the consternation of Donald Trump) and legal cannabis companies (perhaps to prevent the division from being able to probe real antitrust issues and anti-competitive monopolies in the banking, Big Tech, and telecom sectors.);
  • Then, we've got a brief and heart-felt tribute to the legendary and much-beloved Carl Reiner --- creator of the Dick Van Dyke Show, the 2000 Year Old Man with Mel Brooks and much more --- who passed away today at the age of 98. From nothin'.;
  • Finally, Desi Doyen joins us for the latest Green News Report with news on a fracking giant filing for bankruptcy, SCOTUS signing a death warrant for endangered species and new data finding that millions of U.S. homes, far more than previously thoughts, are now at risk of flooding thanks to climate change...

CLICK TO LISTEN OR DOWNLOAD SHOW!...

PLEASE NOTE: Desi and I are checking out for a few days of MUCH needed down time before the holiday. Nicole Sandler will be filling in for us until we see ya next Monday! Until then, please stay safe, healthy and don't forget to celebrate independence from the Trump Presidency in just 200 days as of July 4th!

Guest: Slate's SCOTUS reporter Mark Joseph Stern on the 'canny legal' maneuverings of the Chief Justice; Also: MS votes to dump Confederate flag; Trump Campaign removed social distancing stickers before Tulsa Death Rally; COVID-19 now ravaging all but two states...
By Brad Friedman on 6/29/2020 7:04pm PT

As life in the U.S. continues to get grimmer, we find a few much-needed points of light during today's BradCast! [Audio link to full show is posted below.]

First up, the GOP-controlled Mississippi state legislature finally voted overwhelmingly on Sunday to remove the offensive Confederate flag symbol from their own state flag. Both the Governor and Lt. Governor support the move and the bill will be signed. Yes, the ongoing uprising against systemic racism in the U.S. continues to bring about long-overdue positive change! Also, there was (mostly) good news in a long-awaited abortion case at the U.S. Supreme Court today, but we'll get there in a second.

Before that, we've been arguing in recent days that Donald Trump should eventually be brought up on charges for what amounts to mass murder in his purposefully and criminally delinquent and negligent handling of the COVID crisis. More evidence of that affirmative endangerment of the public was reported over the weekend by the Washington Post, which obtained video evidence that the Trump Campaign, just hours before his June 20 campaign rally in Oklahoma, removed thousands of social distancing stickers placed on seats at Tulsa's BOK Center venue by its management. As the city's health director pleaded with the campaign to postpone the rally amid spiking infections rates, and local residents and business owners went all the way to the state's Supreme Court to try and block it, the Trump Campaign was purposely making it less safe for rally attendees. The infection rate in Tulsa has continued to spike since Trump's under-attended Death Rally (where he had falsely bragged in advance that there wouldn't be "an empty seat"), as infection rates now continue to rise in at least 36 states after the largest single day increase across the nation on Friday.

Florida, Texas and Arizona, with Republican Governors who were among the first to reopen, are now seeing among the largest growth in infections and hospitalizations in the country. That, despite Republican Gov. Ron DeSantis' hubris-filled attacks on the media just weeks ago following an initial lack of new confirmed cases after reopening for Memorial Day and a now-embarrassing rant from Sean Hannity on Fox 'News' claiming that FL and NY "got it right", states like NY got it wrong (NY's infection rate was just 6% of Florida's on Friday) and that "the mob and the media....owe Gov. DeSantis a huge apology." Well, that didn't age well.

Then back to a bit more good(ish) news as the U.S. Supreme Court's Chief Justice John Roberts, for the third time in as many weeks, joined the Court's liberal wing on yet another major case --- well, mostly. It was enough, at least, to strike down an extremist anti-abortion measure in Louisiana, in any case. Had the attempt by state Republicans to insert Big Government in-between a woman and her doctor been upheld by the Court, it would have left the entire state of 4.6 million with just one single doctor legally allowed to perform the still-Constitutionally protected medical procedure.

We're joined today by one of our favorite SCOTUS corespondents, MARK JOSEPH STERN of Slate, to explain today's 4 to 1 to 4 opinion which resulted in the end of the state law requiring abortion doctors to unnecessarily obtain difficult-to-receive hospital admitting privileges. While abortion rights activists are breathing a sign of relief today, Stern explains, they likely won't have long to enjoy it. The Court with a stolen Republican Majority still appears hell bent on rolling back Roe v. Wade, he says.

While Roberts, in his own concurring opinion [PDF], effectively joined the liberals again today in striking down the Louisiana law --- again, maddening the right-wingers in the bargain --- he "is a very canny legal strategist, who still quite obviously opposes the Constitutional right to an abortion," Stern warns. In fact, what Roberts opinion today did was "leave us with a state of abortion jurisprudence that sort of rewinds the clock back to maybe 1992. Whereas, for the past four years, at least in theory, we have had a more robust protection of Constitutional rights."

With Roberts' new opinion, Stern reports, abortion rights proponents have actually lost some ground, even while the second "admitting privileges" law to find its way to the Court in four years was again struck down --- just like the previous virtually identical one out of Texas in 2016 (which Roberts then voted to uphold.)

The Chief Justice also voted recently with the Court's Democratic appointees to ban LGBTQ employment discrimination and in striking down Trump's rollback of DACA protections for hundreds of thousands of immigrant children who were brought here by their parents. So, why has Roberts seemingly become a "liberal squish" on three important landmark cases this session? Stern argues that he hasn't at all. Another ruling today regarding the Consumer Financial Protection Bureau (CFPB) in which the Court's rightwing 5 to 4 majority dreamed up new (non-existent) Constitutional powers for the Presidency, and a SCOTUS decision over the weekend to block absentee voting for all voters --- not just those 65 and older --- in Texas, in the middle of a pandemic, and in clear violation of the 26th Amendment, is just more evidence that the Republicans' stolen SCOTUS majority is still anything but "liberal", even after these three recent surprise opinions on LGBTQ rights, DACA and abortion.

Stern also offers his thoughts on whether Roberts would be voting as he has been of late if Justice Anthony Kennedy was still on the Court as its swing vote, and whether all of this suggests that the Court should now be expanded in response to theft of what should have been an actual liberal majority by now...

The OTHER Department whistleblower's astonishing testimony of gross misconduct by Trump's corrupt U.S. Attorney General
UPDATE 7/2/20: Barr Impeachment Inquiry Resolution introduced...
By Ernest A. Canning on 6/29/2020 11:05am PT

Last Wednesday, the mainstream media paid scant attention to the damning testimony provided to the House Judiciary Committee by John W. Elias, a career attorney at the Department of Justice (DOJ). Elias revealed astonishing details on the corrupt manner in which Attorney General William Barr and the "political leadership" of the DOJ's Antitrust Division abused our antitrust laws; corruptly ordering career staff to open unwarranted but burdensome, politically-motivated antitrust investigations.

It's not that Elias' testimony was unimportant. His words were simply drowned out by the testimony provided by other witnesses about other Barr/DOJ misconduct, and by a separate, but related event. The combined effect of the other testimony provided to the the Judiciary panel and the separate news event was nothing short of jaw-dropping.

Still, Elias' previously unthinkable allegations were, in fact, no less so...

Guest: Attorney Ron Fein of Free Speech for People; Also: Court nixes Trump 'national emergency' wall funding; TX, FL forced to re-close businesses as COVID spikes, Trump, Pence continuing lying about it...
By Brad Friedman on 6/26/2020 7:10pm PT

On today's BradCast: Why does Indiana's Secretary of State Connie Lawson believe her emails with other Secretaries of State, and potentially voting system vendors, should be exempt from disclosure via public records requests? She is claiming her discussions about those systems with members of the private National Association of Secretaries of State (and any private vendors they may discuss or hear from) should somehow be protected due to exemptions for trade secrets and national security that cannot be exposed to the public. A judge in Indiana, however, seems to believes she is wrong. [Audio link to full show is posted below summary.]

But, first up today, a few items of breaking news amid our ongoing dystopian American nightmare...

  • A federal appeals court panel agreed today with a lower court judge that Donald Trump violated the law when he commandeered $2.5 billion in tax-payer dollars appropriated by Congress for the military in order to build his wall under the phony guise of a "national emergency". That, after Congress had specifically refused to allocate such funds. Bill Barr's corrupt Dept. of Justice will likely be appealing that one all the way up to the GOP's stolen U.S. Supreme Court if necessary;
  • As we have been warning for weeks (months?), the coronavirus pandemic is getting worse, not better, in the U.S. In particular, as we've demonstrated, many of the hardest hit regions where infection rates, ICU usage and deaths are skyrocketing are places where Republican politicians have been successful in joining our maniacal conman President in pretending the virus would simply go away if we just reopened our doors for business. That strategy has failed miserably and tragically. So much so, that the very Trumpy Republican Governors in two of the hardest hit states, Florida and Texas --- which were among the first to prematurely reopen --- were forced to re-close bars, restaurants and other businesses today as infections rates surge to record numbers in their states, and as ICU beds in some locations are quickly filling to capacity;
  • That, at the same time Vice President Mike Pence, who heads up the White House Coronavirus Task Force (remember them?), held their first press briefing in weeks to continue the Administration's attempted gaslighting of America to declare "very encouraging news" in the case numbers which are going straight up now in a majority of U.S. states;
  • Today's grim record COVID-19 numbers come just days after our failed President lied to his supporters at his latest maskless Death Rally inside a Phoenix church on Tuesday that "it's going away". It's not. It's getting worse. That was the same day in which internal White House task force documents, according to an NBC News exclusive, told both Trump and Pence that new case numbers in Phoenix --- which "had the highest number of new cases among the 10 metropolitan regions where the week-over-week change in infection rates spiked the most" --- was up some 150 percent over the past week. And, yes, infection rates, hospitalizations and deaths rates are rising as well, according to the White House's own numbers. That is not, despite the lies from both Trump and Pence, caused simply by "more testing".

With unabashed criminals like this now running our country --- and hopefully facing charges of criminal negligence if not mass murder someday soon --- we turn back to our "last firewall": our electoral system. There, we've got a bit of good news today, as Indiana Judge Heather Welch has rejected most of the claims made by the state's Sec. of State Connie Lawson (formerly a member of Trump's failed and phony "voter fraud" commission) to try and obscure her emails with members of the National Association of Secretaries of State (NASS).

The judge's ruling stems from a lawful request filed under Indiana's public records act. The suit, filed on behalf of the National Election Defense Council (NEDC) by Free Speech for People (FSFP), seeks those records in which Lawson was discussing voting systems with fellow Secretaries around the nation, NASS staffers, and, very likely, according to our guest today, private voting system vendors who wine, dine and lobby our nation's elections officials. In turn, those officials buy the unsecure, overly-expensive, error-prone computer voting and tabulation systems from the companies, and then parrot their talking points when the systems fail or when the public seeks to learn how they actually work (or don't.)

We're joined today by FSFP Legal Director RON FEIN to explain the court's recent ruling [PDF] in which the Judge rejected most of Lawson's claims to things like copyright and trade secret exemptions for her official Sec. of State emails. The judge is also demanding to privately review in her chambers those emails about which Lawson is claiming statutory exemption on the basis that disclosing those emails to the public would pose "a reasonable likelihood of threatening public safety by exposing a vulnerability to terrorist attack."

Lawson [pictured above with her newly purchased unverifiable computer voting systems] served as President of NASS from 2017 to 2018. She falsely testified [PDF] in 2017 before the U.S. Senate Intelligence Committee, during its probe of Russian interference in the 2016 election, that America's "voting machines are not connected to the Internet or networked in any way." That claim has been proven to be an out and out lie, over and over and again.

Nonetheless, if true, what possible "vulnerability to terrorist attack" could Lawson be referring to? Fein offers his thoughts, and explains why the judge's ruling that "access to public records is an important statutory right," is already a victory in this little known, but potentially very important case.

"The fact that the Indiana Secretary of State has fought so hard to keep these materials private suggests that at least some of them have something that's embarrassing that they don't want the public to see," Fein tells me, suggesting that, "In some cases, the [voting system] companies are either outright bribing or engaging in extremely unethical practices with election officials."

"One of the most essential elements of democracy is a free and fair election. And the free and fair election requires that it be secure and trustworthy...And we have misinformation out there about the security of these systems. When that misinformation is being spread by election officials whose job is supposed to be to spread accurate information and, if anything, tamp down misinformation, then it means that we have a crisis of legitimacy in the election," Fein explains. "What we're hoping through this public records access lawsuit is that, if we can shine a light on the processes by which election officials end up as vehicles for misinformation about the security and reliability of our election systems, then that will provide an opening for reform."

Please tune in for the full conversation, as we cover quite a bit of ground. And, just for the record, Lawson also misled the Senate Intelligence Committee when she insisted under oath that "no votes were changed in 2016." In fact, nobody actually knows one way or another, because nobody ever bothered to check.

Finally today, after yet another hellish week in Trump's America, we close with a smile and a song "celebrating" his under-attended Death Rally last weekend in Tulsa...

COVID-19 surging in U.S. at record rates as hard evidence confirms that yes, Trump told his 'people' to 'slow the testing down, please'...
By Brad Friedman on 6/25/2020 6:45pm PT

Seriously, at some point American officials will need to be prosecuted for mass murder for their criminal delinquency and deceit in dealing with the coronavirus pandemic, which has, so far, in just four months, cost the lives of more than 122,000 Americans. Those prosecutions should begin (if not end) with the man currently serving as President of the United States. That is particularly true in the wake of his criminal admission at his Death Rally in Tulsa last week, when he admitted that he told his "people...slow the testing down, please!" The White House later said Donald Trump was just joking, but when asked if he was kidding, he publicly admitted otherwise. "I don't kid," he said, "let me just tell you, let me make it clear." And we now have hard evidence on today's BradCast to prove that, perhaps for the first time, he was finally telling the truth. [Audio link to full show is posted below.]

On Wednesday, confirmed new coronavirus cases in the U.S. set a single day record of more than 38,000. At the same time, hospitalizations are rapidly increasing in a number of states around the country, including states such as Florida, Texas, Arizona and Oklahoma, where denialist Republican Governors reopened for business far too quickly, in direct contradiction to almost all health experts.

As states like New York, New Jersey and Connecticut --- hit hardest and earliest at the beginning of the pandemic --- have seen case numbers and hospitalizations plummet, they've instituted quarantine restrictions on travelers from some of the currently hardest hit states. As of Wednesday, the list included Alabama, Arkansas, Arizona, Florida, North Carolina, South Carolina, Utah and Texas.

When asked what he would say to the leaders of some of those states, including Florida, whose Republican Gov. Ron DeSantis had issued a quarantine on travelers from the NY metro area early in the pandemic (while failing to mandate appropriate restrictions in his own state), New York's Democratic Governor Andrew Cuomo said today: "You played politics with this virus and you lost. You told the people of your state and you told the people of this country, White House, don't worry about it. Just open up, go about your business, this is all Democratic hyperbole. Oh, really? Now you see 27 states with the numbers going up. You see the death projections going up. You see the economy going down. It was never politics, it was always science. And they were in denial."

Well, many of them are still in denial. And not just denial, but taking purposeful, affirmative efforts to lie to their people about COVID-19 numbers in their own states. The expert who ran Florida's once-lauded COVID-19 tracking website, but was fired because, she says, she refused to manipulate the data, sent out a warning this week. She charges that officials have been "instructed this week to change the numbers and begin slowly deleting deaths and cases so it looks like Florida is improving next week in the leadup to July 4."

In West Virginia, the state's Republican Gov. Jim Justice, a billionaire coal baron, has forced out the commissioner of the state's public health bureau because he didn't like the numbers she was reporting, as cases rise in at least 11 counties. He had previously lauded her at regular COVID-19 press briefings where she spoke. She was not at his latest briefing on Wednesday and released a statement upon her forced resignation that night, urging state officials "to stay true to the science".

Meanwhile, as the head of the U.S. Centers for Disease Control and Prevention (CDC), conceded that the infection rate in the U.S. is likely 10 times higher than the number of cases currently reported (that's 23 million probably infections, instead of the official 2.3 million reported as of today), states like Texas are seeing not just increased cases, but spiking hospitalizations, which have doubled over the past week. In Houston, ICU beds were 97 percent full by Wednesday. (In Florida, Gov. Ron DeSantis has barred hospitals from reporting those numbers anymore.) Even Republican Gov. Greg Abbott is now warning of the state's "massive outbreak", while still failing to mandate masking or even allowing local officials in Houston or anywhere else to do so on their own.

And yet, with all of that, Donald Trump really has told his "people" to "slow the testing down." Talking Points Memo's Josh Kovensky has been documenting the refusal by the Dept. of Health and Human Services (HHS) and the Federal Emergency Management Agency (FEMA) to approve extensions for federally funded testing at 13 sites across five states, including Texas. Where more than 40 such sites were once funded by the federal government across the country, only 13 sites remain, and they have been told by the Trump Administration that those resources will end on June 30th, despite desperate requests from officials in Texas, Illinois and Pennsylvania for the much-needed aid to continue.

That's just a taste of today's program, which raises the very serious question: Should these people be held accountable for the thousands --- perhaps tens of thousands --- of American citizens who are likely to die, thanks to their purposeful efforts to ignore science and health officials for purely brazen political purposes?

The deadly denial about the coronavirus is a fast-motion mirror of the Republican denial, for brazen political purposes, regarding climate change. Today we close with some accountability and/or attempts at accountability on that front in our latest Green News Report, in which Minnesota's Attorney General has now filed a consumer fraud lawsuit against Exxon, Koch, and the American Petroleum Institute, citing, by way of just one example, a "proprietary" document from Exxon warning about the dangers of "CO2 concentrations in the atmosphere...due to fossil fuel combustion" that "will cause a warming of the earth's surface" and "dramatic environmental effects before the year 2050." That prescient, on-the-money document is dated October 16, 1979, before Exxon went on to spend millions of dollars over decades to misinform the public that climate change due to the burning of fossil fuels was little more than a hoax. Desi Doyen joins us for that attempted accountability and a bit more that has actually succeeded in a refreshingly encouraging GNR today. And it comes not a moment too soon...

Guest: Howie Klein of 'Down With Tyranny' on Tuesday results; Also: DoJ corruption spreads to Judiciary in Flynn case; DoJ whistleblowers in Congress; All eyes on 'last firewall' of November election...
By Brad Friedman on 6/24/2020 6:36pm PT

Given the disturbing news out of a D.C. Appeals Court today in the Michael Flynn case, we begin today's BradCast with a few words of warning about what is likely to come between now and November 3rd (and even beyond), and how we all must now collectively approach that day in order to save this Republic. This is not a test. This is the real thing. And, as our darkest hour gets darker still --- and it will --- we must stay focused on the only thing that offers hope right now, the only thing that matters: making very real changes at the White House and Congress this November.

After that serious-as-a-heart-attack public service announcement/warning, we break down just why the surprise ruling by two Republican appointees to the U.S. Court of Appeals in D.C. today --- in response to an unprecedented motion by Donald Trump's former National Security Advisor and confessed federal felon Michael Flynn --- is so damning, dangerous and unprecedented.

The three-judge panel's majority ruling [PDF], ordering Flynn's case to be dismissed --- as Trump demanded and as corrupt Attorney General Bill Barr facilitated in opposition to the career prosecutors who successfully obtained Flynn's guilty plea (twice, before two different judges) --- was written by Judge Neomi Rao, a former White House staffer who Trump recently appointed as a federal appeals court judge. The entire matter is about as corrupt as it can get, but it may not be over yet. The full D.C. Circuit Court of Appeals may decide to rehear Flynn's unprecedented motion, given "the question of exceptional importance" raised by the matter, as allowed by law. The lower U.S. District Court was not even allowed to hold a hearing on the Dept. of Justice's Motion to Dismiss their own case before Flynn filed for a writ of mandamus to force U.S. District Court Judge Emmett Sullivan to approve the DoJ's motion before it was even heard.

As Judge Robert Wilkins, the lone Democratic-appointed judge on the three-judge appellate panel wrote in his dissent, his colleagues "grievously" overstepped their judicial powers with their order. If the surprising ruling holds, it will, as BRAD BLOG legal analyst Ernie Canning wrote last week, mean that the court has become "complicit in the President's corruption of the rule of law," which is "tantamount to an abandonment of the Judiciary's constitutional function to act as a check against Executive Branch abuses of power."

At the same time as that stunning order was issued by the D.C. Court of Appeals panel, two DoJ whistleblowers were testifying about similar cases of corruption at the Department by senior political appointees working at the behest of Barr and Trump in the case of Roger Stone, another Trump crony found guilty of lying to federal officials (just as Flynn had admitted he did as well) in relation to the Robert Mueller Special Counsel probe into Russian inference in the 2016 election. We share some of today's disturbing testimony by Aaron Zelinsky, one of the career prosecutors who refused to sign off on the DoJ's attempt to reduce the sentencing recommendation for Stone, Trump's pal and longtime dirty-tricksters (found guilty here on all seven counts), despite what he described as "heavy pressure from the highest levels of the Department of Justice," including senior political appointees who, he alleged, were "afraid of the President."

"It’s very important that we recognize what’s happening now," warned Donald Ayer, another witness at today's hearing and a former Deputy Attorney General under George W. Bush. "What’s happening now is much worse than what happened in Watergate --- much worse. It’s across-the-board. It’s a systematic effort to undo the checks that were put in place in Watergate and others that existed in the Constitution. And we need to do something about it."

The corruption of the Flynn and Stone prosecutions are now so far off the rails from what the U.S. Department of Justice is supposed to stand for that it is difficult to fully express how much dark trouble this now portends for our nation. Thus, we have one hope left --- our last firewall against full-blown authoritarianism in this country --- this year's critical general elections. To that end, there were primaries held on Tuesday in Kentucky, New York and Virginia along with a few other key races elsewhere. We're joined today by longtime progressive political blogger and Congressional campaign expert HOWIE KLEIN of Down With Tyranny to discuss a number of election results from Tuesday in New York and Kentucky which appear to suggest some very good news for progressives. We say "appear" because several of those elections are currently reported to be very close and, due to the coronavirus (which had its single biggest day of new infections in the U.S. on Wednesday), it will take some time for officials to tally the unprecedented number of absentee mail-in ballots cast. We run through several of the key races with Klein (he details many more here today) why they matter, and how a number of them they are likely to scare the hell out of the establishment on both the Left and Right.

"There were wins and losses," Klein tells me. "It wasn't like the progressives wiped out the [Democratic] conservatives. But thank goodness it didn't go the other way. So yes, it was a good night for progressive Democrats."

Also worth a quick mention today: The 24-year old Republican dude named Madison Cawthorn, who defeated the Trump-endorsed candidate in the GOP runoff to become the nominee to fill former Congressman turned White House Chief of Staff Mark Meadows' seat in North Carolina. And ALL of the electronic pollbooks in Virginia Beach, Virginia's 100 precincts failed on Tuesday...

State legislature codifies Governor's Executive Order, Voting Rights Groups' Motion to Intervene upends Republican 'voter fraud' allegations...
UPDATE 7/10/20: After voluntarily dismissing its lawsuit, GOP falsely declares victory...
By Ernest A. Canning on 6/24/2020 10:35am PT

In a recent article, we described the GOP's legal challenge to the Executive Order issued by California's Democratic Governor Gavin Newsom --- directing CA election officials to timely submit vote-by-mail (VBM) ballots to every active registered CA voter for the November general election --- as "dubious", at best.

We noted that the GOP plaintiffs lacked standing to sue in federal court because Republicans cannot show they suffered a legally cognizable injury. We also noted that the GOP's core legal challenge --- that the Elections Clause to the U.S. Constitution only permits state legislatures, not Governors, to set the time and manner of conducting federal elections --- was at odds with settled Supreme Court case law and that legislative approval for the Governor's pandemic-related emergency Executive Order can be found within the provisions of the CA Emergency Services Act.

Last week AB-860 was passed by the state legislature (even with support from Republicans) to codify Newsom's Executive Order by specifically providing that VBM ballots be timely sent to every active registered voter in the state, even if the voter did not request one. It was signed into law this week by the Governor, rendering the GOP's core legal argument moot.

The new law will not only mandate a dismissal of the GOP legal filing but also eliminate the need for the court to grant the Motion to Intervene [PDF] that was recently filed by several voting rights organizations opposing the challenge by a number of Republican groups, including the California Republican Party.

CA Common Cause, League of Women Voters of CA and the Community Coalition seek to be added as Party Defendants in order to counter the GOP's effort to compel in-person voting --- a GOP effort that, if successful, would dangerously and unnecessarily expose the state's electorate to the risk of contracting a deadly virus, COVID-19. The portion of those organizations' motion, which demolishes the GOP's VBM "voter fraud" lies, however, warrants verbatim coverage...

[Republicans'] allegations echo long-debunked claims that associate mail-in ballots with voter fraud. In reality, mail vote fraud is virtually non-existent. Millions of Americans vote by mail --- one in four voters did so in the last two federal elections. Yet an exhaustive investigation found only 491 instances of mail vote fraud committed between 2000 and 2012, a period in which billions of votes were cast.

UPDATE 7/10/20: After U.S. District Court Judge Morrison England, Jr. dismissed the GOP's frivolous legal challenge following a Republican filing of a voluntary Notice of Dismissal, GOP Chairwoman Rona McDaniel falsely proclaimed that the Republican Party "scored a major victory against Gov. Gavin Newsom's illegal executive order." She attempted to bolster this falsehood with another lie --- that, before the GOP filed its legal challenge to VBM in CA, "Democrats planned to automatically send ballots to inactive voters, including people who have moved or died."

As we observed in a 6/5/20 update to an article that had covered the "dubious" GOP legal challenge, the Office of CA Secretary of State Alex Padilla stated that, pursuant to the Executive Order which Padilla and Gov. Newsom issued, VBM ballots would only be mailed to "active" registered voters.

"Only active registered voters will be mailed a vote-by-mail ballot. That is and has been the practice in California," Padilla's spokesman Sam Mahood said. Under California's Elections Code, Mahood added, "'voters with an inactive voter registration status do not receive elections materials.' That includes vote-by-mail ballots."

The only change to CA Election Law as it existed at the time the Executive Order was issued was the elimination of the requirement that voters first request a VBM ballot before one would be mailed to an
active" registered voter. Thus, at best Rona and the GOP had erected a straw man; erroneously claiming that the Executive Order required submission of VBM ballots to "inactive" voters.
