On today's BradCast, we catch up with a grab bag of stuff, most of which doesn't have to do with Donald Trump's idiocy --- you're welcome --- but a lot of which has to do with what Americans need to do about him! [Audio link to full show is posted below.]

Among the many stories covered on today's program...

  • The front page of the New York Times now, officially, looks like a pre-2016 parody of what the Times might look like if Donald Trump were ever elected President;
  • Denmark still doesn't want to sell Greenland to the US. Why, after all, would its citizens want to give up "universal health care, free higher education, five weeks of annual paid vacation and 12 months of paid parental leave, subsidized childcare and more"? But the Premier of Greenland is, however, interested in buying the U.S.!;
  • Two-term WA state Governor Jay Inslee, the climate change candidate, drops out of the 2020 Presidential race, but accomplished quite a bit and will now run for a third term as WA Governor;
  • Former CO Governor John Hickenlooper, who dropped out of the Presidential contest a week or so ago, announces his run for U.S. Senate to take on vulnerable Republican Sen. Cory Gardner in an already very crowded field of Dems vying for the nomination. (But, ahem....hint, hint, O'Rourke, Castro and Bullock!);
  • And, on the Republican side of the aisle, "reformed" Tea Party Republican and former one-term House Rep. Joe Walsh appears set to announce plans to primary Trump from the right next year. If his recent, blistering NYTimes op-ed is any indication, in which he eviscerates Trump for, well, just about everything, he would be a welcome participant along with already-declared former MA Gov. Bill Weld and a few other potential GOP challengers that may be coming soon;
  • In more disturbing and much-less noticed news, 22 Texas towns have been simultaneously crippled by coordinated ransomware attacks that have shut down all computerized city services. The hackers are demanding some $2.5 million to restore services to the unidentified towns which may all have used the same private contractor for municipal IT services. The attack-via-contractor is reminiscent of the 2016 spearphishing attack on voter registration services vendor VR Systems as described in Robert Mueller's Special Counsel report. That attack appears to have resulted in penetration of voter registration databases in several Florida counties in 2016, and perhaps other states (such as North Carolina) serviced by the same private vendor.

    But, sadly, none of this has prevented states and counties around the country from moving swiftly to fully-computerized voting and tabulation systems, as well as computerized electronic pollbooks (all frequently serviced by a small group of private contractors) as we move toward the critical 2020 elections. If those any of those thousands of jurisdictions whose poling places now rely on such automated systems on Election Day --- often without paper backup for ballots or pollbooks --- were to be similarly crippled by a ransomware attack on or before Election Day, the result would be unimaginable chaos next year. But how likely is that, really? Why worry?;

  • Some voters in Georgia are, in fact, very worried, and justifiably so, about the state's newly certified, 100% unverifiable touchscreen voting systems now planned for first-time use in 2020. As we reported on the show a few days ago, those voters have invoked a little-known provision in GA's election code to demand a reexamination of the new systems which the state certified just weeks ago. The multipartisan voters charge Republican Sec. of State Brad Raffensberger violated state requirements in his initial certification, and failed to do any security testing at all. The Sec. of State's office now says the petitioners, who prefer state voters use verifiable hand-marked paper ballots systems, simply disagree with the "policy preferences" of the Georgia General Assembly and must pay the costs for the second examination themselves;
  • In similar-ish news here in Los Angeles County --- the nation's largest voting jurisdiction, which is also planning to move to new, 100% unverifiable computer touchscreen Ballot Marking Devices for the 2020 election --- the county's Registrar-Recorder/County Clerk Dean Logan is refusing to answer questions by voters on Twitter as to whether they will be allowed to vote on hand-marked paper ballots at the polling place this year. That has been a mandate by the CA Sec. of State for many years.

    Also, Logan has similarly failed to respond for several days to a generous offer by legendary Finnish cybsersecurity and voting systems expert Harri Hursti to examine the county's new, never-before-used-in-any-election BMD systems for security concerns. Hursti, the first to have hacked a Diebold voting system over a decade ago, runs the now-infamous annual Voting Village event at the DefCon hackers convention in Las Vegas --- where, year after year after year, enormous vulnerabilities are discovered in every voting system put before the attendees. Despite Hursti's offer, Logan has not responded to it via Twitter.

    Why has the previously communicative Logan gone so mum? He has been very outspoken on Twitter in the past, and still seems to have no problem citing L.A. Times stories about his new system there. (Perhaps because those stories shamefully fail to mention any of the many security and verifiability concerns about them, as cited by cybersecurity and voting systems experts.) Why is Logan, a long time, usually quite responsive and responsible election official no longer answering questions from his voters and media about such a huge sea-change in voting for some five million L.A. County voters?;

Guest: Plaintiff Marilyn Marks says landmark ruling finding Georgia's voting system unconstitutional is a victory for voters across the nation...

We've got some pretty huge and long-overdue breaking news today from a federal court in Atlanta. It's huge enough that we dumped what we were previously planning to cover to devote today's BradCast to the judge's new order in a case that we have been following now for years. [Audio link to show follows below.]

U.S. District Court Judge Amy Totenberg, in a 153-page ruling [PDF], finds that Georgia's 100% unverifiable Diebold touchscreen voting systems, in use in the state since 2002, are not fit for U.S. elections because they are "unsecure, unreliable and grossly outdated". They are so unsecure, in fact, that they violate the Constitutional right of voters to have their votes counted as cast.

"Georgia’s current voting equipment, software, election and voter databases are antiquated, seriously flawed and vulnerable to failure, breach, contamination and attack," Totenberg writes.

She excoriates the state Defendants --- former Republican Sec. of State, now Governor Brian Kemp and current Sec. of State Brad Raffensberger --- for lying about facts and evidence in the case (though she is only slightly more polite in her wording, by describing the "Defendants' inconsistent candor with the Court") and for dismissing the many long-proven security concerns about these systems as "fantasy" forwarded by Plaintiffs.

While Judge Totenberg will allow the old Diebold touchscreen Direct Recording Electronic (DRE) systems to be used one last time in Georgia's municipal and county elections this November, she makes it clear they may not be used again in 2020 or thereafter under any circumstances. She also offers several hints that the state's recently selected new touchscreen systems, now planned to replace the old ones, may also be found unconstitutional in further proceedings, leaving the clear preference of cybersecurity and voting systems experts --- hand-marked paper ballots --- as the only option likely to meet requirements for auditability and Constitutionality.

We're joined to explain all of these details and much more today on what is a clear, overdue --- if not (yet) total --- victory, by plaintiff MARILYN MARKS, Executive Director of the Coalition for Good Governance. She has been joining us on the show for a number of years now with updates on each important aspect of this broad and gruelingly long case since filing it about two years ago. Marks calls today's ruling a victory not just for Georgia voters, but for those in many states where similar systems are now used --- including some where newer, if still unverifiable, touchscreen systems are being planned for use in 2020.

"The court ruled that DREs are unconstitutional. And that anybody voting on these things should be worried about their vote," says Marks. "Of course, this doesn't relate just to Georgia. The words of this federal court will be heard around the United States. Hopefully this will have an impact on other jurisdictions" where, she hopes, they will take notice of the judge's words recommending hand-marked paper ballots.

Marks explains that Judge Totenberg does not appear much happier with the new system Georgia now plans to use in 2020, though was unable to offer a finding on it, yet, given that the state just finalized their decision last week. But, Totenberg offered warnings about those new touchscreen computer Ballot Marking Devices (BMDs) in several places in the ruling, such as when she warned: "The past may here be prologue anew — it may be 'like déjà vu all over again.'"

Indeed, Marks says her non-partisan organization plans to seek an injunction on use of Georgia's new, equally unverifiable touchscreen systems as well, and that Totenberg, perhaps with that in mind, has ordered that a number of counties run hand-marked paper ballot pilot elections this year in advance of next year's Presidential primary elections. "We will absolutely be launching a constitutional challenge against Ballot Marking Devices," she vowed.

"Surely they realize that the hand-writing is on the wall and they've got to quit fighting for unverifiable elections. I would think Georgia voters are going to get pretty sick and tired of this. Most of these guys are elected officials, so I think that they need to consider the political consequences if they want to continue to fight for unverifiable elections."

As to allowing the old, unconstitutional systems to be used one more time in the state's 2019 municipal elections, Marks advises: "While they can be used in November, they shouldn't be used in November. Those people on the ballot, those people voting in the municipalities, should demand right now --- right now is the time to do it --- that their county, their municipality go ahead and use hand-marked paper ballots. They've got the equipment for it [since they already use hand-marked ballot systems for absentee voting across the state] they've got the know-how, they ought to do it."

In one other key element of this case, as Marks explains, the Judge also ordered a review of the state's electronic pollbook systems which resulted in failure and chaos and disenfranchisement during last November's general elections. She has ordered that polling places must have paper backup pollbooks on hand in elections moving forward, to avoid the disenfranchisement of voters when electronic voter registration systems fail on Election Day or are manipulated by malign actors.

"Just like with any computerized voting component, it can be hacked," Marks tells me regarding the state's ES&S ExpressPoll registration computers used in the Peach State's precincts. "There can be errors. There can be mis-programming. And that's been occurring in Georgia. [Judge Totenberg] asked us to bring her evidence. We brought her hundreds of affidavits of people who were turned away at the polls who should not have been. We brought her evidence of software problems in the e-pollbook system. And therefore she said, 'Enough of this! Go fix the system!'"

She continued: "I get it as to why computerized [registration] records can be very helpful here, but let's use some common sense. And the judge has said have a paper backup so that if there is a question that needs to be adjudicated, use the official paper backup. And look it up right there, and don't run people away from the polls. Give them their ballot."

In fact, in her ruling, the judge cites "threats of contamination, dysfunction, and attacks on State and county voting systems, disparaged by the Secretary of State’s representatives...as a fantasy and still minimized as speculative" by the Defendants as recently as a hearing in the case this year. That, Totenberg notes, despite threats "identified in the most credible major national and state cybersecurity studies and official government reports." She even cites "real life" incidents that "played out with the United States’ July 2018 criminal indictment of a host of Russian intelligence agents for conspiracy to hack into the computers of various state and county boards of election and their vendors as well as agents' efforts during the 2016 election to identify election data system vulnerabilities through probing of county election websites in Georgia and two other states." All of which, writes Totenberg --- as Marks has long been arguing --- serves to "burden Georgia citizens' right to cast a vote that reliably will be counted."

As to the lies --- er..."inconsistent candor with the Court" --- Marks notes the Secretary of State's staff told "just absolutely black and white lies. They didn't mind lying to the court. And one has to wonder what is it that they are hiding that makes it worth lying to the court, and facing the potential consequences of lying to the court." She told me she intends to seek sanctions from the court for those lies in the days ahead.

So, yes, some big --- and very good --- news for a change today!

Guest: Heather Digby Parton on the former Special Counsel's testimony and what's next; Also: Everyone giving everyone else the finger...

Both Democrats and Republicans alike --- on Capitol Hill and in the media --- are trying to make sense of Wednesday's landmark testimony by former Special Counsel Robert Mueller and where things go from here. We do a bit of the same ourselves on today's BradCast. Though I hope we are a great deal more honest about it than Donald Trump and Fox "News", and less confusing than Fox' Ainsley Earhardt who announced this morning that Mueller's testimony "didn't change anything", before going on to tell viewers that "it changed everything". For full coverage and extended excerpts from Mueller's nearly seven hours of hearings before the U.S. House Judiciary and Intelligence Committees, see yesterday's special coverage show. For analysis and the fallout since the Republican former FBI Director confirmed the multiple and repeated felonious and impeachable crimes by the President of the United States detailed in his 448-page report [PDF], we're joined by the great HEATHER DIGBY PARTON of Salon and Hullabaloo today. As usual, we attempt to cut through the media drama and partisan positioning to get to the actual facts and important content that matters.

Among the issues discussed with Parton....

  • The fact that only Republicans are ever allowed to be Special Counsel/Prosecutors, no matter whether the President being investigated is a Democrat or a Republican;
  • Content of note from Wednesday's hearings that was both damning to Donald Trump and at risk of being lost amid frequently lousy corporate media coverage (and, wholly dishonest coverage from rightwing outlets);
  • The proper context for making "sense" of some of the conspiracies offered on Wednesday by Republicans, even as Trump's AG/fixer Bill Barr and other GOPers may have done harm lately to the prospects of their own conspiracy-based argument about the origins of what would eventually become the Mueller investigation;
  • How House Speaker Nancy Pelosi is still dropping the ball on impeachment in Congress, at least for now, and setting the country up for even more Presidential corruption in both the near and distant future in the bargain;
  • And, where all of this madness may and/or should go next.

"It seems obvious to me that we have a criminal in the White House. And an abuser, a corrupt leader, and a barbarian and an ignoramus," Parton explains, cutting to the chase. "He's an unfit President and he should be impeached. To me, this is obvious."

But, she goes on, in struggling to make sense of why impeachment proceedings have not already been triggered, "One of the reasons that the dial is not being moved is the way that the press is covering this. There was a lot of criticism, during and after the testimony, about the fact that they covered it like a sporting event. 'He didn't put on the best show', etc. etc. The theater criticism. This is a big problem because this is a complicated story. People are seeing it as a game, as this is a strategy, instead of what it really is --- which is a fundamental threat to our democracy.

"If Donald Trump gets away with this, if he gets off scot-free --- re-elected or not --- if he gets away with doing these things while in office, it has changed everything. The President is no longer accountable. If Donald Trump cannot be impeached, then nobody can be impeached. Impeachment no longer exists as a stop on a President like this. And that's very scary," warns Parton.

White House censors climate science; NC GOP lied to federal court about gerrymandering; FL Repubs solidify power by gutting state initiative process; Jon Stewart shames Congress for ignoring 9/11 victims...again...

We are far beyond politics and partisanship at this point. Our nation, and indeed our planet, is under threat from an entirely corrupt enterprise from top to bottom: the Republican Party. That doesn't mean that Democrats are wonderful. It means that the GOP may as well no longer exist as a political party. It is now no more than a wholly corrupt tool of corporate paymasters hoping to retain power and willing to take down an entire nation or planet with them in order to do it, if need be. [Audio link to full show is posted below.]

Among the stories covered on today's BradCast...

  • Like China or North Korea or the old Soviet Union, the Trump Administration is finally just censoring science. The White House, according to the Washington Post, blocked a State Department intelligence analyst from delivering the written version of his opening testimony to a Congressional meeting last week after severely censoring his spoken remarks as well. Objections from several different corrupt White House agencies prevented Rod Schoonover, of the State Department's Bureau of Intelligence and Research, from submitting his prepared testimony because it allegedly included just too much science from federal agencies such as NASA and NOAA, warning about the national security perils of unchecked climate change. In the oral version of his remarks, which he was allowed to deliver, he was forced to remove the words like "possibly catastrophic" from the phrase: "Absent extensive mitigating factors or events, we see few plausible future scenarios where significant --- possibly catastrophic --- harm does not arise from the compounded effects of climate change." Our climate crisis in frightening enough. What is happening now at the very top of our federal government makes it all the more terrifying;
  • On yesterday's program, we featured my exclusive interview with cybersecurity researcher Chris Vickery, who discovered hundreds of sensitive documents available for download on the Internet at the North Carolina State Board of Election's website, including "master passwords" for voting systems used in the state. We hope to have some followup on that story in coming days, but, in the meantime, North Carolina Republicans seems to be in competition with the nearby states of Georgia and Florida when it comes to who is able to be the most corrupt and willing to blatantly game elections for partisan advantage the most.

    Setting aside Vickery's disturbing report for now, and setting aside the DHS finally beginning a forensic probe of potential corruption (or even foreign penetration) of the state's voter registration system during the November 2016 Presidential election, and setting aside the GOP Absentee Ballot Fraud scandal that derailed last November's U.S. House election in the state's 9th Congressional District, the state GOP's multiple attempts to unlawfully use both racial and partisan gerrymandering in their successful effort to prevent Democrats from winning elections at both the state legislative and U.S. House level is breathtaking.

    But it has now been revealed to be even worse than previously known, thanks to new documents found on the hard drive of the RNC's late redistricting expert which reveal the state lied to a federal court in at least one of three different lawsuits against them for unlawful gerrymanders. We try, with the help of Daily Kos' Stephen Wolf, to break down the three different gerrymandering cases (two in federal court over racial and then partisan gerrymanders of U.S. House seats, and an ongoing case in state court over the gaming of legislative districts) to help expose how breathtakingly corrupt and dishonest state Republicans have become and the lengths to which they have been willing to go in recent years to try and cling to power. That, as statewide elections have now resulted in Democratic victories for the top executive offices such as Governor and Attorney General, and a 6 to 1 advantage for Democrats on the elected state Supreme Court.

    Nonetheless, with the several illegal gerrymanders, the GOP has been able to hold on to super-majorities in both chambers of the state legislature until last November, when court-ordered fairer districts were used for the first time. But the lie that has now been exposed thanks to the dead GOPer's hard drive allowed the party to enjoy an extra year of veto-proof control and a bevy of bills and ballot measures were adopted that likely never would have been had democracy actually existed in state legislative elections;

  • Speaking of corrupt Republican state lawmakers, Florida is working hard to keep up with NC. After their legislature recently passed a measure to gut a state Constitutional amendment adopted by nearly 65% of Florida voters last year to restore voting rights to most former felons in the state after completion of their sentences, the Sunshine State's new Governor, Ron DeSantis (who reportedly won election last year by less than one half of one percent of the vote), insisted lawmakers gut the entire statewide ballot initiative process to make it nearly impossible for citizen-led initiatives to end up on the ballot at all. The new measure, as the Tampa Bay Times describes it, "will solidify Republican control in Tallahassee by eliminating one of the last threats to their power: the ballot box." They report that the legislation will "stifle the last area outside of statewide Republican control in Florida," noting "Republicans have dominated the Legislature, Cabinet and governor’s mansion for the last 20 years, and every member of the state Supreme Court has now been appointed by Republicans";
  • But where state GOP lawmakers are wholly corrupt, those at the federal level, setting the tone, are putting them to shame. We set aside today's Constitutional Crisis and Impeachment Update to bring you Jon Stewart's full testimony to a Congressional committee this afternoon, instead. Most Republican lawmakers didn't even bother to show up, despite the fact that it was a House hearing on renewing the 9/11 Victims Compensation Fund which is said to be running out of money. The VCF covers health care costs of first responders such as police and firefighters who worked on and in the pile at Ground Zero on 9/11 and in the days that followed. Many of those victims have since died and are continuing to die due to long-term ailments related to breathing the air at Ground Zero. Shamefully, the GOP is, once again, fighting an extension of the program. Stewart blasts the lawmakers in moving, must-listen, sometimes tearful remarks that are alternately enraging and heartbreaking, citing "callous indifference and rank hypocrisy" of those who formerly used "Never Forget" as a political slogan supposedly in support of the same first responders who are now forced to show up on Capitol Hill to beg for healthcare as they fight for their very lives;
  • Finally, Desi Doyen joins us for our latest Green News Report on one of those troubling days when the GNR, of all things, is the lightest, fluffiest segment we seem to be able to muster...

Bad news CO2 landmark; Biden booed on climate, pushes back; MT's Bullock jumps into race as Dem Gov from 'red state'; Warren says no to 'hate-for-profit racket' Fox 'News'...

A 22nd entrant into the 2020 Democratic Presidential nomination contest today offers an excuse to survey the landscape a bit, for a change, on today's BradCast as both the race and the planet continue to heat up. [Audio link to full show is posted below.]

Among the related stories we cover today regarding Dems fighting to shape their party's identity in hopes of both saving the climate and winning enough votes --- in the right places --- to prevail in next year's Presidential election against race-baiting criminal and presumptive Republican nominee Donald Trump...

  • Temperatures soared into the mid to upper 80's over the weekend at the edge of the Arctic Circle --- 20 to 30 degrees higher than normal --- while the Mauna Loa Observatory in Hawaii measured 415 parts per million of carbon dioxide in the atmosphere for the first time in human history. The two data points are related, as CO2 is the main man-made greenhouse gas driver of global warming, and as 19 of the hottest 20 years on record have all occurred since 2000. With CO2 levels having risen 50 percent since the Industrial Revolution and scientists concluding that unmitigated climate disaster is imminent unless immediate and drastic cuts to greenhouse emissions are made, what are the Democratic Presidential candidates prepared to do about it?;
  • At an event at Howard University sponsored by the Sunrise Movement to rally for the Green New Deal on Monday, Presidential candidate Joe Biden --- who was not at the event --- was booed by progressive attendees on several occasions following a recent Reuters report in which a campaign advisor suggested the former Veep is seeking a "middle ground" on climate change. Activist attendees at the rally, including Rep. Alexandria Ocasio-Cortez (D-NY) and Sen. Ed Markey (D-MA), who introduced the Green New Deal earlier this year, and Vermont Senator and Presidential candidate Bernie Sanders, all suggested there is no "middle ground" when it comes to the climate crisis humanity faces. They, and others, such as Washington state Governor and Presidential hopeful Jay Inslee --- who has made climate change the centerpiece of his campaign --- call for a large-scale national mobilization to defeat climate change and grow millions of well-paying jobs in the bargain. We share some clips from both AOC and Sanders at the event;
  • For his part, hours earlier at a campaign event in New Hampshire, Biden declared the Reuters report "dead wrong", citing his record, going back to 1986, as a champion for climate legislation. The current front-runner (according to recent polls) also promised a major speech later this month to outline his environmental priorities, which, thanks to efforts by progressives and their support for the popular goals of the Green New Deal, are likely to be more aggressive than they might have been before the pushback to his campaign's positioning as a "moderate" who is best suited to win over Trump voters among a very crowded Democratic field;
  • And, speaking of "centrist" candidates hoping to win over GOP voters, Montana's Governor Steve Bullock officially entered the Presidential race today, touting his record as a Democrat who has won three statewide elections in a so-called "red state" where Trump is said to have defeated Hillary Clinton by 20 points in 2016 --- the same day, and on the same ballot, when Bullock won his second term as Governor. Bullock has, in fact, championed a number of progressive policies in the state --- including the expansion of Medicaid under the ACA, support for marriage equality, protection of LGBTQ rights and has vetoed NRA-support gun bills. He has also been a champion for keeping corporate money out of politics in the wake of the U.S. Supreme Court's horrific 2009 Citizens United ruling. His climate policies, however, have been less than stellar, to say the least, as the chief executive of one of the nation's top fossil-fuel producing states. He is just one of at least four Presidential candidates, or would-be candidates, who many Democrats would prefer to see running for the Senate to help flip it "blue" in 2020;
  • But can any Democrat --- even those running as so-called "centrists" --- actually change the minds of previous Trump voters? Daily Kos' Markos Moulitsas argues it can't be done and is a waste of time and resources for Democrats who, he writes, must focus instead on winning "young voters, voters of color, and women," given that "No one will be changing their mind in the next year and a half." He offers some statistics to support his point, though I am not (yet) entirely persuaded by them;
  • Progressive Presidential candidate Elizabeth Warren, meanwhile, explained her reasons today for declining an invitation from Fox 'News' to appear on one of their town halls. Though Sanders and Minnesota's Amy Klobuchar have already done one --- and South Bend, Indiana Mayor Pete Buttigieg and New York Sen. Kirsten Gillibrand are scheduled to do one soon --- the Massachusetts Senator makes the case today that Fox is a "hate-for-profit racket" and she's unwilling to add to those profits with an appearance there. She does, however, welcome them to ask her questions at many of the other town halls she has participated in all over the country during her Presidential campaign since January, including many of them in GOP-dominated states "including WV, OH, GA, UT, TN, TX, CO, MS & AL". But, while Warren's stand on principle deserves much respect, is it a strategic mistake to miss the opportunity to reach out to many voters who might otherwise hear little more than Fox' fake news and GOP propaganda? Pompeo plunders Arctic for U.S.; Trump pardons war criminal murderer; White House blocks subpoenaed McGahn docs; Too much more...

Before we get to our Constitutional Crisis update on today's BradCast, we offer an update on our Climate Crisis, which the rogue Trump Administration has been busy exacerbating in the Arctic this week, to the horror of other Arctic nations. And, yes, our continuing national Gun Crisis returned to the headlines (did it ever leave?) with breaking news of another school shooting today in suburban Denver. [Audio link to show is posted below.]

Among the many stories covered on today's program...

  • Trump Sec. of State Mike Pompeo stunned fellow Arctic Council members in Finland on Monday, with a speech in which he appeared absolutely giddy about economic opportunities emerging from the quickly thawing Arctic. Without once mentioning the phrase "climate change" in his 2,400 word speech, Pompeo cited "opportunity and abundance" for those able to exploit previously frozen and untapped oil and mineral reserves in the otherwise pristine Arctic, not to mention "fisheries galore" and thawed "passageways" for travel and commerce that could turn the Arctic into a "21st century Panama Canal". The remarks, reportedly, came as a shock to other representatives of the Council's nations, there to discuss protection of the melting Arctic from political and economic threat.

    But on Tuesday, things got worse as the U.S. refused, for the first time, to sign a group agreement on challenges facing the Arctic due, according to Reuters, to discrepancies in the agreement over climate change wording, jeopardizing cooperation among participating countries as the Arctic continues to warm at nearly twice the pace as the rest of the planet;

  • Back in D.C., Donald Trump stunned the legal and military community with the Monday night pardon of a former U.S. Army lieutenant sentenced by a 2009 court marshal to 25 years in prison for the murder of an Iraqi civilian in 2008. Michael Behenna was granted Executive Clemency by Trump for the gruesome killing in which Behenna was found, according to military prosecutors, to have taken "the victim out into the desert in Iraq, stripped him naked, interrogated him while he had his Glock piston pointed at him, shot him in the head, shot him in the chest, killing him at that time," all outside of a combat zone and in defiance of both orders and the military code of justice. So, Trump has moved from sending political messages with the pardons of those who obstruct federal court orders, like the disgraced former Arizona Sheriff Joe Arpaio, to granting Executive Clemency to murderous war criminals. Got the message?;
  • Before we move on to today's Constitutional Crisis update, an interesting background development, as Attorney General William Barr's Justice Department announced over the weekend that it had arrested and charged a Virginia man who served as an FBI linguist on counts of "obstructing a federal investigation and making multiple false statements to FBI officials". Of course, Barr has been famously arguing of late --- in regard to President Trump --- that, since Special Counsel Robert Mueller did not find enough evidence of criminal cooperation between the Trump Campaign and Russia during his investigation into 2016 election interference, Trump could not possibly be guilty of obstructing that investigation. With no underlying crime, Barr's legally unsupportable theory goes, there can be no obstruction of the investigation into those crimes. In the case of the FBI's cunning linguist, however, obstruction charges were filed with no underlying crime, according to a former federal and state prosecutor;
  • In related news, there are now some 500 former federal prosecutors (actually, over 700 now, since checking after the show), both Republican and Democratic, who have signed onto an open letter declaring that, based on the evidence revealed by the redacted Mueller Report, Trump would have been charged with multiple counts of felony obstruction, had he been a private citizen;
  • Then, the latest news in the multiple Constitutional showdowns between the Administration and Congress, including Treasury Secretary Steven Mnuchin's refusal to answer the Ways and Means Committee's statutory demands for the IRS Commissioner to turn over several years of Trump's tax returns and Barr's refusal to respond to a lawful Congressional subpoena from the House Judiciary Committee to turn over Mueller's unredacted report and its underlying evidence. With a vote on contempt by the AG still scheduled for Wednesday in the Committee, it seems a good time to look back at the case made by House Republicans in 2012 for a contempt vote against President Obama's then-Attorney General Eric Holder, including speeches from a number of GOP lawmakers incensed at the time for the DoJ's failure to turn over subpoenaed documents, which they then described as unlawful disdain for both the rule of law and the Constitution. But that was then;
  • And, with both Mnuchin and Barr facing potential contempt citations, it was former White House Counsel Don McGahn's turn in the barrel today, as the White House stepped in to block his production of subpoenaed documents that he had long ago shared with the Special Counsel --- thus waiving the White House's opportunity at the time to invoke Executive Privilege to block the release of the documents now along with McGahn's testimony, according to largely every legal expert who doesn't work at the White House. (Though even some of those lawyers, according to WaPo, see the Administration's belated attempt to invoke the privilege now as legally dubious.) As that legal wrangle plays out, McGahn's next difficult decision will come on May 21, when he has been subpoenaed by the Judiciary Committee to appear for testimony as a witness to numerous incidents of criminal obstruction by the President as detailed in the Special Counsel's redacted report;
  • Finally, Desi Doyen joins us for the latest Green News Report focused on the alarming landmark study released by the U.N. this week finding that human develop, consumption and exploitation is now threatening the extinction of some 1 million plant and animal species, a report that was released before Pompeo even arrived in the Arctic this week to dance on --- and plunder --- its melting grave...
