A 22nd entrant into the 2020 Democratic Presidential nomination contest today offers an excuse to survey the landscape a bit, for a change, on today's BradCast as both the race and the planet continue to heat up. [Audio link to full show is posted below.]

Among the related stories we cover today regarding Dems fighting to shape their party's identity in hopes of both saving the climate and winning enough votes --- in the right places --- to prevail in next year's Presidential election against race-baiting criminal and presumptive Republican nominee Donald Trump...

  • Temperatures soared into the mid to upper 80's over the weekend at the edge of the Arctic Circle --- 20 to 30 degrees higher than normal --- while the Mauna Loa Observatory in Hawaii measured 415 parts per million of carbon dioxide in the atmosphere for the first time in human history. The two data points are related, as CO2 is the main man-made greenhouse gas driver of global warming, and as 19 of the hottest 20 years on record have all occurred since 2000. With CO2 levels having risen 50 percent since the Industrial Revolution and scientists concluding that unmitigated climate disaster is imminent unless immediate and drastic cuts to greenhouse emissions are made, what are the Democratic Presidential candidates prepared to do about it?;
  • At an event at Howard University sponsored by the Sunrise Movement to rally for the Green New Deal on Monday, Presidential candidate Joe Biden --- who was not at the event --- was booed by progressive attendees on several occasions following a recent Reuters report in which a campaign advisor suggested the former Veep is seeking a "middle ground" on climate change. Activist attendees at the rally, including Rep. Alexandria Ocasio-Cortez (D-NY) and Sen. Ed Markey (D-MA), who introduced the Green New Deal earlier this year, and Vermont Senator and Presidential candidate Bernie Sanders, all suggested there is no "middle ground" when it comes to the climate crisis humanity faces. They, and others, such as Washington state Governor and Presidential hopeful Jay Inslee --- who has made climate change the centerpiece of his campaign --- call for a large-scale national mobilization to defeat climate change and grow millions of well-paying jobs in the bargain. We share some clips from both AOC and Sanders at the event;
  • For his part, hours earlier at a campaign event in New Hampshire, Biden declared the Reuters report "dead wrong", citing his record, going back to 1986, as a champion for climate legislation. The current front-runner (according to recent polls) also promised a major speech later this month to outline his environmental priorities, which, thanks to efforts by progressives and their support for the popular goals of the Green New Deal, are likely to be more aggressive than they might have been before the pushback to his campaign's positioning as a "moderate" who is best suited to win over Trump voters among a very crowded Democratic field;
  • And, speaking of "centrist" candidates hoping to win over GOP voters, Montana's Governor Steve Bullock officially entered the Presidential race today, touting his record as a Democrat who has won three statewide elections in a so-called "red state" where Trump is said to have defeated Hillary Clinton by 20 points in 2016 --- the same day, and on the same ballot, when Bullock won his second term as Governor. Bullock has, in fact, championed a number of progressive policies in the state --- including the expansion of Medicaid under the ACA, support for marriage equality, protection of LGBTQ rights and has vetoed NRA-support gun bills. He has also been a champion for keeping corporate money out of politics in the wake of the U.S. Supreme Court's horrific 2009 Citizens United ruling. His climate policies, however, have been less than stellar, to say the least, as the chief executive of one of the nation's top fossil-fuel producing states. He is just one of at least four Presidential candidates, or would-be candidates, who many Democrats would prefer to see running for the Senate to help flip it "blue" in 2020;
  • But can any Democrat --- even those running as so-called "centrists" --- actually change the minds of previous Trump voters? Daily Kos' Markos Moulitsas argues it can't be done and is a waste of time and resources for Democrats who, he writes, must focus instead on winning "young voters, voters of color, and women," given that "No one will be changing their mind in the next year and a half." He offers some statistics to support his point, though I am not (yet) entirely persuaded by them;
  • Progressive Presidential candidate Elizabeth Warren, meanwhile, explained her reasons today for declining an invitation from Fox 'News' to appear on one of their town halls. Though Sanders and Minnesota's Amy Klobuchar have already done one --- and South Bend, Indiana Mayor Pete Buttigieg and New York Sen. Kirsten Gillibrand are scheduled to do one soon --- the Massachusetts Senator makes the case today that Fox is a "hate-for-profit racket" and she's unwilling to add to those profits with an appearance there. She does, however, welcome them to ask her questions at many of the other town halls she has participated in all over the country during her Presidential campaign since January, including many of them in GOP-dominated states "including WV, OH, GA, UT, TN, TX, CO, MS & AL". But, while Warren's stand on principle deserves much respect, is it a strategic mistake to miss the opportunity to reach out to many voters who might otherwise hear little more than Fox' fake news and GOP propaganda? Pompeo plunders Arctic for U.S.; Trump pardons war criminal murderer; White House blocks subpoenaed McGahn docs; Too much more...

Before we get to our Constitutional Crisis update on today's BradCast, we offer an update on our Climate Crisis, which the rogue Trump Administration has been busy exacerbating in the Arctic this week, to the horror of other Arctic nations. And, yes, our continuing national Gun Crisis returned to the headlines (did it ever leave?) with breaking news of another school shooting today in suburban Denver. [Audio link to show is posted below.]

Among the many stories covered on today's program...

  • Trump Sec. of State Mike Pompeo stunned fellow Arctic Council members in Finland on Monday, with a speech in which he appeared absolutely giddy about economic opportunities emerging from the quickly thawing Arctic. Without once mentioning the phrase "climate change" in his 2,400 word speech, Pompeo cited "opportunity and abundance" for those able to exploit previously frozen and untapped oil and mineral reserves in the otherwise pristine Arctic, not to mention "fisheries galore" and thawed "passageways" for travel and commerce that could turn the Arctic into a "21st century Panama Canal". The remarks, reportedly, came as a shock to other representatives of the Council's nations, there to discuss protection of the melting Arctic from political and economic threat.

    But on Tuesday, things got worse as the U.S. refused, for the first time, to sign a group agreement on challenges facing the Arctic due, according to Reuters, to discrepancies in the agreement over climate change wording, jeopardizing cooperation among participating countries as the Arctic continues to warm at nearly twice the pace as the rest of the planet;

  • Back in D.C., Donald Trump stunned the legal and military community with the Monday night pardon of a former U.S. Army lieutenant sentenced by a 2009 court marshal to 25 years in prison for the murder of an Iraqi civilian in 2008. Michael Behenna was granted Executive Clemency by Trump for the gruesome killing in which Behenna was found, according to military prosecutors, to have taken "the victim out into the desert in Iraq, stripped him naked, interrogated him while he had his Glock piston pointed at him, shot him in the head, shot him in the chest, killing him at that time," all outside of a combat zone and in defiance of both orders and the military code of justice. So, Trump has moved from sending political messages with the pardons of those who obstruct federal court orders, like the disgraced former Arizona Sheriff Joe Arpaio, to granting Executive Clemency to murderous war criminals. Got the message?;
  • Before we move on to today's Constitutional Crisis update, an interesting background development, as Attorney General William Barr's Justice Department announced over the weekend that it had arrested and charged a Virginia man who served as an FBI linguist on counts of "obstructing a federal investigation and making multiple false statements to FBI officials". Of course, Barr has been famously arguing of late --- in regard to President Trump --- that, since Special Counsel Robert Mueller did not find enough evidence of criminal cooperation between the Trump Campaign and Russia during his investigation into 2016 election interference, Trump could not possibly be guilty of obstructing that investigation. With no underlying crime, Barr's legally unsupportable theory goes, there can be no obstruction of the investigation into those crimes. In the case of the FBI's cunning linguist, however, obstruction charges were filed with no underlying crime, according to a former federal and state prosecutor;
  • In related news, there are now some 500 former federal prosecutors (actually, over 700 now, since checking after the show), both Republican and Democratic, who have signed onto an open letter declaring that, based on the evidence revealed by the redacted Mueller Report, Trump would have been charged with multiple counts of felony obstruction, had he been a private citizen;
  • Then, the latest news in the multiple Constitutional showdowns between the Administration and Congress, including Treasury Secretary Steven Mnuchin's refusal to answer the Ways and Means Committee's statutory demands for the IRS Commissioner to turn over several years of Trump's tax returns and Barr's refusal to respond to a lawful Congressional subpoena from the House Judiciary Committee to turn over Mueller's unredacted report and its underlying evidence. With a vote on contempt by the AG still scheduled for Wednesday in the Committee, it seems a good time to look back at the case made by House Republicans in 2012 for a contempt vote against President Obama's then-Attorney General Eric Holder, including speeches from a number of GOP lawmakers incensed at the time for the DoJ's failure to turn over subpoenaed documents, which they then described as unlawful disdain for both the rule of law and the Constitution. But that was then;
  • And, with both Mnuchin and Barr facing potential contempt citations, it was former White House Counsel Don McGahn's turn in the barrel today, as the White House stepped in to block his production of subpoenaed documents that he had long ago shared with the Special Counsel --- thus waiving the White House's opportunity at the time to invoke Executive Privilege to block the release of the documents now along with McGahn's testimony, according to largely every legal expert who doesn't work at the White House. (Though even some of those lawyers, according to WaPo, see the Administration's belated attempt to invoke the privilege now as legally dubious.) As that legal wrangle plays out, McGahn's next difficult decision will come on May 21, when he has been subpoenaed by the Judiciary Committee to appear for testimony as a witness to numerous incidents of criminal obstruction by the President as detailed in the Special Counsel's redacted report;
  • Finally, Desi Doyen joins us for the latest Green News Report focused on the alarming landmark study released by the U.N. this week finding that human develop, consumption and exploitation is now threatening the extinction of some 1 million plant and animal species, a report that was released before Pompeo even arrived in the Arctic this week to dance on --- and plunder --- its melting grave...

On today's BradCast: It's not enough that Trump has fired just about everyone in his failed Administration (or they quit), and has failed to fill the vacancies left behind, and that he has personally violated an unprecedented number of laws both before and after taking office, or that he's purging most of his top officials who work on immigration. No, it's even more distributing than that. [Audio file for today's show is posted below.]

Last week, the President of the United States said, with cameras rolling, that we "have to get rid of judges" just days before, reportedly, instructing Customs and Border Patrol agents to ignore the rule of law and simply block immigrants from exercising their right to claim asylum at the southern border once on U.S. territory. That, of course, would be a violation of both U.S. law and international treaties.

According to CNN's Jake Tapper, Trump instructed agents at the border in Calexico, California on Friday to tell immigrants the U.S. is "full" and "at capacity" and "if judges give you trouble, say, 'Sorry, judge, I can't do it. We don't have the room.'" If true, that would be an unlawful instruction from the President of the United States ordering a law enforcement officer to violate law and then to do so again once a federal judge has ordered otherwise. Real Presidents (at least Democratic ones) would be --- or should be --- impeached for such things. But we have the Republican Donald Trump as our President.

In other related Trump immigration meltdown news today...

  • More on why Dept. of Homeland Security Secretary Kirstjen Nielsen was pushed out by White House hardliners (after she reportedly refused to violate the law as Trump was demanding and also pushed back against Trump's order to close ports of entry at the border entirely);
  • Poor, disgraced, former KS Sec. of State, failed gubernatorial candidate and GOP "voter fraud" fraudster Kris Kobach --- recently floated to take over some immigration duties for the Trump Administration --- may be blocked from a Senate-confirmed post because, as Kansas' GOP U.S. Senator Pat Roberts told reporters today, Kobach is so toxic that apparently even the GOP-majority Senate "can't confirm him". Luckily, Republicans who used to pretend to hate Presidential "czars" have a very short memory, so there may be another way into the Administration for Kobach, the currently jobless Kansas conman;
  • As to judges, another one in federal court on Monday night temporarily blocked yet another key Trump immigration policy, at least for now. The federal courts are unlikely to like Trump's new one any better, I suspect.

Also today --- actually, right at the top of the show --- some listener mail in follow-up to my conversation on yesterday's program with the ACLU's Phil Aroneanu regarding the group's newly-launched Rights For All campaign which seeks to get 2020 candidates on record regarding several "thorny" issues regarding civil liberties and Constitutional rights. A number of listeners had some thoughts on my questions for Aroneanu regarding the potential political dangers of backing Democratic candidates into politically difficult policy positions as they attempt to unseat arguably the worst President --- from a civil liberties and Constitutional rights perspective --- our nation has ever had. We share and discuss a few of those listener emails today.

On today's BradCast: Donald Trump's D.C. swamp isn't getting any less swampy, but it all does make chants of "Lock her up!" over Hillary Clinton's personal email server appear quite quaint. [Audio link to show follows below.]

Among the many stories covered on today's program...

  • It's Election Day in a number of places today, including for a very important state Supreme Court seat in Wisconsin, where the results will have ramifications (for the state and nation) for the next decade. And voters are also at the polls near Pittsburgh, Pennsylvania today for a special election for that state's Senate in a contest which may serve as a bellwether before the 2020 elections. We'll have reported results and other analysis of that and others contests, no doubt, on tomorrow's program;
  • More disaster today near Houston, Texas where yet another deadly chemical fire broke out, killing one as of airtime, with two others airlifted to hospitals. Emergency officials issued shelter-in-place warnings to schools and residents within a 1-mile radius, advising residents to stay indoors, turn off all ventilation systems and seal all doors and windows. It's the second major toxic chemical plant explosion near Houston within as many weeks. Given the state's shameful history with chemical facilities --- and a dangerous, years-long lack of transparency, even for first responders --- the latest tragic incident is, sadly, not all that surprising;
  • Donald Trump's latest nominee to head the Dept. of Interior is near confirmation in the U.S. Senate after his confirmation hearing last week in the Energy and Natural Resources Committee. But David Bernhardt --- currently Deputy Secretary and Acting chief of the agency following the resignation of Trump's first disgraced and corrupt Secretary Ryan Zinke --- is a longtime, top lobbyist for the oil and gas industry and has been instrumental since arriving at the agency in 2017 in reversing loads of environmental regulations long opposed by the fossil fuel and chemical industry.

    In fact, as a recent investigative report by Reveal illustrated, at an executive meeting of the Independent Petroleum Association of America (IPAA), a top industry group, after Bernhardt was tapped to be the top Deputy at Interior in 2017, the hundred or so oil industry executives at the conference were caught on tape laughing and applauding after the IPAA's CEO bragged about Bernhardt as "the guy that actually headed up" their legal team challenging federal endangered species rules being "now the No. 2 at Interior," adding, "So that's worked out well." Now Bernhardt will be No. 1 at Interior.

    We share some of the audio from last week's Senate Committee hearing in which Bernhardt said he would decline to recuse himself from issues at Interior involving companies for whom he lobbied, because, he said, he'd be "basically handcuffed and not in the game for the American people if I am recusing myself" and prevented from unleashing his awesome "skillset" on behalf of "the American team". Bernhardt, of course, is just one of many deeply-conflicted swamp creatures now inhabiting Trump's "drained" swamp;

  • Speaking of which, a whistleblower with 18 years of experience in the White House Personnel Security Office, where she worked for Democratic and Republican administrations alike, has stepped forward to expose what she describes as at least 25 Trump appointees who failed security clearance checks, but were ultimately granted clearances anyway after intervention by more senior officials. According to Tricia Newbold's recent testimony to the U.S. House Oversight Committee, many Administration security clearances had been rejected for a number of reasons including "foreign influence, conflicts of interest, concerning personal conduct, financial problems, drug use, and criminal conduct."

    She testified that two currently-serving Senior Officials in the White House were granted clearances despite failing their background checks. Though the names of the officials whose security clearances were granted only after intervention were not specified, House Oversight Committee Chair Elijah Cummings has sought "adjudication summaries" from the White House for Trump's son-in-law Jared Kushner, his daughter Ivanka Trump, former National Security Advisor Michael Flynn, currently National Security Advisor John Bolton and a host of other top appointees.

    On Tuesday, the Committee voted to subpoena Carl Kline, Newbold's superior, believed to be behind a number of the questionable approvals. White House Press Secretary Sarah Huckabee-Sanders today described the Congressional oversight of the matter in partisan terms, bizarrely characterizing it on Fox "News" today as "sad and shameful" and, somehow, ironically enough, "dangerous" to national security;

  • That statement came just hours before court documents were released today revealing that the Secret Service arrested a Chinese national at Mar-a-Lago over the weekend, during the President's latest visit to his Palm Beach resort, with four cell phones, two Chinese passports, a hard drive, and a computer thumb-drive said to contain "malicious malware". Court documents describe the woman telling the Secret Service, after she had initially been allowed inside the resort, that she was sent there by a Chinese friend who instructed her to travel from Shanghai to make contact with a member of Trump's family. But, why worry about security checks for those family members, eh?;
  • Finally, Desi Doyen joins us for the latest Green News Report, with more on Bernhardt's enormous conflicts of interest, the White House's latest unprecedented scheme to jump start the stalled Keystone XL pipeline, more bad news for Trump's environmental rollbacks in federal court, and the Green New Deal has its first town hall discussion...

On today's BradCast: The "national emergency" may be fake, but the crisis on the U.S.-Mexico border is real and getting worse...and new Trump policies are doing the opposite of helping. [Audio link to full show is posted below.]

Last week, Donald Trump threatened to shutdown the border with Mexico entirely. Over the weekend, he announced he was ending aid programs to El Salvador, Guatemala and Honduras (which are not in Mexico, Fox "News"!) because, as he claimed, "they haven't done a thing for us." All of that, as an actual humanitarian crisis --- if not a pretend "National Emergency" --- grips a number of U.S. towns along the Mexico border, thanks to an unprecedented wave of migrant families and children coming, mostly, from Central American countries in strife.

We're joined today by THERESA CARDINAL BROWN, Director of Immigration and Cross-border Policy at the Bipartisan Policy Center to try and make sense of what is and isn't happening at the border right now, how Trump's policies are affecting it, and what Congress needs to do try to ease what she acknowledges is, indeed, a crisis, if not the "emergency" that Trump has declared in order to build his long promised wall.

Brown, a former policy advisor in the Office of the Commissioner of U.S. Customs and Border Protection during both the George W. Bush and Barack Obama Administrations, confirms that the influx of migrants streaming up from Central America is unprecedented and now overwhelming detention facilities and shelters built for previous waves of migrants --- such as the record number which flowed in during 2000, largely comprised of mostly men from Mexico who could be deported more quickly than the families now claiming asylum after crossing the border. (Brown notes that even a wall would not prevent such asylum claims, as it would be build on the U.S. side of the border, allowing asylum seeking immigrants to make their claim even before making it to the other side of the wall, since they are already on U.S. territory by that time.)

Brown suggests Trump's termination of U.S. aid for Central American would serve to make the problem worse, as much of those funds go to non-governmental organizations trying to improve the living conditions in countries under duress from poverty and violence. She also details the economic disaster that would likely accompany the closure of the Mexican border threatened by the President ("this may be a threat aimed at Mexico, but it would also significantly impact the United States"), and explains why "the wall will do absolutely nothing to address this current flow of people." That, she describes, as a problem due to U.S. Customs and Border Protection becoming "overstretched" because they do "not have facilities that are appropriate for anyone --- families or kids --- for the length of time they're having to be held there."

We must "address our asylum system. And that means, back to front, starting with the immigration courts" which are similarly overwhelmed and insufficiently funded, she argues, resulting in cases that stretch for years before asylum is determined one way or another. "Ultimately, what we need to do is deal with what's going on in the sending countries," she tells me. "What are the push factors that are driving migration? You have instability of government, you have people who don't feel that they have personal safety because there's impunity and corruption in their governments. They are threatened with gangs and violence and extreme poverty. What can we do to help in that situation? That's the longer term solution, but it needs to be also worked at the source. So we've got to look at this from multiple places."

Next up today, Trump's multiple losses in federal courts last week on several fronts where he's tried to undermine the Affordable Care Act ("Obamacare") may have been matched by his multiple losses in federal court last week on the environmental front, including a ruling from a federal Judge in Alaska late on Friday who determined that the Administration's reversal of Obama-era protections against off-shore oil drilling in the Arctic and parts of the Atlantic Oceans violate federal law. She has ordered some 128 million previously-protected acres that Trump's Admin has hoped to lease for drilling, once again off-limits to exploration and exploitation. The ruling is at least the fourth setback over the past two weeks for Trump environmental policy, where federal courts have blocked Trump agency rollbacks of nearly two dozen Obama-era conservation policies over the past two years.

Trump in trouble; Shutdown looms; Bevin brays in KY; NC9 primary do-over?; MI GOP power grab; Arctic collapsing...

Among the many messes covered on today's BradCast [Audio link to full show is posted below]...

  • Trump can't seem to find anyone who wants to be his new Chief of Staff. So, his son-in-law Jared Kushner now appears to be in the running;
  • Trump finally responded (on Fox "News", naturally) to Wednesday's news that his former personal lawyer and fixer Michael Cohen received a three year prison sentence after cooperating with federal investigators and pleading guilty to a number of felonies. The charges include an illegal 2016 hush-money payout scheme to women said to have had sexual affairs with Trump, which Cohen and the prosecutors describe as having been "directed" by Trump in violation of campaign finance laws. Trump now says it wasn't unlawful, but if it was, it was only a civil, not criminal violation --- and that he didn't do it in any case, but if he did, it was all Cohen's fault --- and that Cohen only pleaded guilty to it as a favor to federal prosecutors in order to "embarrass" Trump. Or something. Got it?;
  • Meanwhile, a federal government shutdown next week before Christmas is looking increasingly likely. After Trump's televised Oval Office tantrum with Nancy Pelosi and Chuck Schumer earlier this week over funding for his Border Wall, it's become apparent that Republicans in Congress currently have no plan to avoid a shutdown next week after Trump declared during the meeting that he would happily take the blame for such a shutdown. Even in the House, where Republicans still hold a large majority until January, they seem unable to pass a version of a spending bill that includes funding for the wall that Trump repeatedly promised Mexico would pay for;
  • In Kentucky, taking a page from Trump, Tea Party Republican Governor Matt Bevin released a bizarre video on Twitter Wednesday night, attacking the Louisville Courier-Journal for their new partnership with independent, non-profit investigative reporting outlet ProPublica. Bevin charges ProPublica is a "far-left" organization secretly funded by "George 'I Hate America' Soros" and, therefore, everyone should "disregard" the reporting from the Courier-Journal. ProPublica responded to the charges, and suggests a recent damning exposé by the paper finding Bevin hired an old friend for a top IT job in the state and gave him a $215,000 raise after less than a year, is just one of the reasons Bevin may be hoping Kentuckians stop reading the paper;
  • In North Carolina, the mess created by the GOP absentee ballot election fraud scandal in the state's 9th Congressional District continues. Republican lawmakers, on Wednesday, passed legislation that would allow the State Board of Elections to call not just a new general election for the U.S. House in NC9, but for a new primary as well, following evidence of absentee fraud in both elections this year by a GOP contractor hired by Mark Harris, the Republican candidate. Harris is said to have defeated incumbent Congressman Robert Pittenger by just over 800 votes in the May GOP primary and his Democratic opponent Dan McCready by just over 900 votes in the November midterm. State Republicans seem to now be conceding that both races were tainted with fraud by their candidate and will now require a do-over;
  • In Michigan, GOP lawmakers are scrambling to pass a measure in the lame duck session that would make it much harder for voters to place statewide initiatives on the ballot. That's just one of several ongoing efforts by Republicans in the state to strip power from voters and the Executive Branch before Democrats can be sworn in as Governor, Attorney General and Secretary of State next month.
