Today on The BradCast I'm joined by investigative journalist Steve Horn of DeSmogBlog to discuss his new article investigating the federal judges who oversaw the case that allowed the southern leg of the Keystone XL pipeline to move forward.

That KXL southern leg is now operational, despite the unusual way in which the Army Corps of Engineers seems to have helped TransCanada, the pipeline's owners, avoid the normal type of environmental review process that has otherwise been in place for similar projects since the 1970s. Horn's investigation looks into the question of whether two federal judges actually stood to profit from their rulings, whether they should have recused themselves from the cases in question, and how "a game of Orwellian rhetoric" allowed the Administration to approve the project without standard environmental scrutiny.

The process "happened behind closed doors," Horn tells me, creating a "horrible precedent" in the bargain. "Basically it happened without public hearings. That was the entire premise of the lawsuit." That suit, however, brought by the Sierra Club, was ultimately rejected with the help of two federal judges --- U.S. District Court Judge David Lynn Russell and 10th U.S. Circuit Court of Appeals Bobby Ray Baldock (both Reagan nominees) --- who Horn finds, each stood to gain financially from the pipeline being built.

Horn describes the Southern portion of the KXL pipeline as "extremely important", as "it connects to the rest of the Keystone pipeline system," allowing for "the highest amounts of oil in recorded history now flowing from the Midwest to the Gulf Coast." He charges that a disturbing precedent has now been set that allows Big Oil "to usurp long-standing [environmental] processes."

Horn also raises a very interesting possibility concerning Obama's upcoming trip to The Arctic --- the first such visit by a sitting President --- amid his Administration's recent final approval for Shell Oil to begin drilling off shore there.

On today's BradCast, we start where we left off on yesterday's show, regarding Thursday's amazingly corrupt and disturbing ruling in favor of Scott Walker and his cronies --- by the amazingly corrupt Wisconsin Supreme Court --- and how, if Republicans have their way, that ruling may soon enough become the law of the land for the entire nation.

As our producer Desi Doyen noted on today's show: "This is your early warning system." Ignore at your peril. Then it was on to a couple of quick items and updates, including dumb Confederate flag wavers in Oklahoma and Maine's even dumber Governor Paul LePage.

From there, we head to North Carolina, where "the most extreme anti-voter bill passed by any state since the Jim Crow Era", as we initially described it when it was passed by state Republicans back in 2013, is finally now facing trial against the NAACP, the ACLU, the DoJ and other democracy and voting rights advocates.

We are joined by The Nation's author/journalist Ari Berman, who was in the federal courtroom in Winston-Salem, NC this week as the trial finally got under way. The results of this trial are likely to head all the way to the U.S. Supreme Court, one way or another, and may well determine the future of voting rights in this country. The new voting restrictions were passed in 2013, just days after the U.S. Supreme Court demolished the provision of the Voting Rights Act that otherwise, says Berman, would have kept this law --- which is "already disenfranchising voters" --- from even taking effect.

"That's such a clear case study to me that the Supreme Court was wrong when it said that the special protections of the Voting Rights act weren't needed." Berman goes on to explain why he believes NC, a state which had made astounding progress in voting rights over the previous decade, has now become the new Selma, Alabama, where the bloody fight for voting rights led directly to passage of the federal Voting Rights Act in 1965.

"In North Carolina, they had seemingly everything," Berman tells me. "They had all these voting reforms --- early voting, same day registration, pre-registration for 16 &17 year olds. And it was all taken away or reduced" when the GOP took over both the state legislature and Governor's mansion for the first time since Reconstruction in 2013.

"What Selma in the 1960s and what North Carolina in the 2013-2015 era shows is how far these conservative white Southerners will go to protect political power. There aren't billy clubs. There aren't literacy tests. But they're saying this is how black turnout increased --- North Carolina went from 48th in voter turnout in the late 80s, to 11th in voter turnout in 2012 --- Republicans there basically said we're gonna tamp this turnout down."

And now it's left to the courts to find out if those rights, once granted, can be taken away by political whim --- and if NC, and other states with a history of racial discrimination in elections, will be forced once again to face preclearance from the federal government before they can enforce any new voting restrictions.

Berman has a lot of insight on all of this. His new book, Give Us the Ballot: The Modern Struggle for Voting Rights in America, will be published next month to coincide with the 50th Anniversary of passage of the VRA. As I note during the show, the book is an exhaustively researched and heart-wrenching documentation of the uniquely American and harrowing tale of the fight to vote in this country --- and the outrageously long and continuing effort to block it. That fight continues, sadly, to this day. Go buy his book!

Good news and bad today on The BradCast. As is too often the case, mostly bad.

We get the good news out of the way early. Namely, the overwhelming approval by voters for a Constitutional amendment for marriage equality in the very Catholic nation of Ireland over the weekend. The mandate was loud and clear and, thanks to publicly hand-counted, hand-marked paper ballots in Ireland, unmistakable.

Then, horrific, deadly flooding in Texas and Oklahoma on the heels of a years-long drought there. Mashable.com's Science Editor Andrew Freedman joins us to discuss the ongoing disaster and the influence of climate change on events like this --- which we seem to be seeing more and more of...just as climate scientists have been warning for decades.

Also today, a report on our own weekend encounter with private security guards at the scene of the Santa Barbara, CA oil spill after the rupture of a crude pipeline owned by a company named Plains All American.

An update on charges now filed against Doug Hughes, the postal worker who landed his gyrocopter on the lawn of the U.S. Capitol in April to deliver a message about the need for campaign finance reform (our full interview with Hughes from back in April is right here).

Well, that was cowardly. But I suppose it's better than hearing the cases and churning out another twisted, activist justification for discrimination.

Rather than hear appeals from cases in Utah, Indiana, Oklahoma, Virginia and Wisconsin where marriage equality bans were struck down, the U.S. Supreme Court shocked court watchers today by deciding to avoid the issue of marriage equality as a Constitutional right entirely for the time being. Effectively, that means the lower-court rulings stand in each of those states, so freedom, liberty and the conservative Constitutional value of equal justice for all wins the day in each of them.

Evan Wolfson, founder and president of Freedom to Marry, a national organization dedicated to the fight for equality in all fifty states, said after today's Supreme Court punt: "This decision by the Court is a huge step forward --- and a clear green light for full-speed ahead --- but it needlessly postpones the national resolution that together we've been working so hard for. Freedom to Marry is committed to finishing the job."

Couples in six other states where the Circuit Court of Appeals' decisions will likely also apply include Colorado, Kansas, North Carolina, South Carolina, West Virginia and Wyoming.

With the addition of those 11 states, the list of states where marriage equality for all will soon be recognized will jump to 30, continuing to beg the question of which state will disgrace the Union as the very last one to allow equality, in this measure, for all of its citizens.
