On today's BradCast, Maine's Republican Governor Paul LePage is melting down. [Audio link posted below.]

We've been reporting on the two-term, 'Tea Party' dimwit for years, describing him variously as both the nation's dumbest Governor and the worst in history. But now, at the seeming climax of a months-long saga concerning racist comments by LePage, a threatening and obscene voicemail he recently left for a Democratic state lawmaker, comments about shooting that lawmaker in the head and, this week, an apparent emergency intervention by GOP state legislators, the possibility of resignation --- or, perhaps, mental breakdown --- is seeming likelier by the minute.

We cover that insane story today, how this loon became a two-term Governor in the first place in an otherwise not-insane state (hint: you can thank third party challengers), and how, even after all of the years of LePage's various embarrassments, Donald Trump has said this month that he'd be delighted to consider the Maine Governor for a role in his White House cabinet!

It's a very 'green' show on The BradCast today, on a number of levels, from marijuana policy to the Green Party Presidential candidate's position on environmental issues, to another rather disturbing Green News Report.

But first up today, some news about 'third-party' Presidential candidate troubles getting on the ballot and being kept out of Presidential debates, and a Republican governor who has now vetoed a law that would have added millions of voters to the rolls in his state.

Then, Michael Collins, Deputy Director for the Drug Policy Alliance's Office of National Affairs in Washington D.C., joins us to discuss the recent announcement by the U.S. Drug Enforcement Agency (DEA) that it will not reclassify marijuana from its current 'Schedule I' narcotic status --- which, like heroin means that it's classified as having "no accepted medical use" --- despite some 25 states which currently allow its sale and use for either medicinal or recreational purposes.

Collins explains what that classification actually means and how rescheduling it as a Schedule II drug wouldn't have been much more than a "symbolic victory" for proponents, particularly "in terms of prosecutions --- people getting arrested, the racial disparities we see because of the war on marijuana --- that would not have disappeared had the DEA rescheduled marijuana."

He goes on to describe the DEA as a "rogue agency", "rotten to the core", and long working against President Obama's "steps to unwind the war on drugs". "They're still fighting the drug war of Ronald Reagan and Richard Nixon," he tells me, in opposition to the advocacy of a number of elected Democratic (and even Republican) officials in Congress who were furious at the federal agency's decision.

"I think the DEA gets its science from the same people as climate change denialists," Collins quips. "To say that marijuana has no recognized medicinal value contradicts decades of scientific research and is a huge slap in the face to the thousands of people who use medical marijuana every day to alleviate their illnesses."

It's not all bad news, however. Collins notes that the DEA has announced they will allow an expansion of federal marijuana research facilities, ending what had been a monopoly, with just one facility in Mississippi, and that states are moving forward nonetheless, with expansive pot initiatives on the ballot in at least six states (California, Arizona, Maine, Nevada and Massachusetts) this November. "The question isn't 'Should we legalize marijuana?', but more 'When should we legalize marijuana?' The end is nigh," he tells me.

On today's BradCast [full audio linked below], Bernie Sanders and Ted Cruz defied 'conventional wisdom' to win more delegates than front-runners Hillary Clinton and Donald Trump in their respective parties over "Super Saturday" weekend; Louisiana's Primary reveals another serious and troubling long-term failure of the U.S. Electoral System; and two Michiganders join us for analysis of Sunday's unprecedented Democratic Debate in Flint, MI, amidst that city's ongoing toxic water crisis caused by the state's Republican Governor.

First up: Did you know that both Sanders and Cruz won more delegates than their opponents in the four different nominating contests held over the weekend? If you watch or read little more than the corporate mainstream media, that might now have been apparent. Did you also know that one of those contests, Louisiana's Primary, forced Election Day voters across the state to vote on 100% unverifiable touch-screen systems that The BRAD BLOG revealed a full ten years ago, each have a little yellow button on the back that allow voters to vote as many times as they wish until physically restrained from doing so?

Though we broke that story exclusively here back in 2006, and they were decertified for use out here in California shortly thereafter, the same flawed and hackable voting machines (Oh, hello, Pac-Man!) are still, shamefully, in use elsewhere around the country. They are being used on Election Day across states like Louisiana and swingstate Nevada, and will be used once again next week in the City of Chicago for the big and crucial Illinois primary on March 15 --- and, of course, in the general election this November.

Then, we're joined by Michiganders Connor Coyne, novelist and father from Flint, and Marcy Wheeler, journalist from Grand Rapids, to discuss the extraordinary debate on Sunday between Sanders and Clinton held by CNN from Flint, MI, as that city continues to battle the lead water crisis caused by Gov. Rick Snyder's implementation of the state's tyrannical 'Emergency Manager' law.

As Coyne, who joined us earlier this year to discuss the national media's failure to adequately focus on the scourge of that law, explains in his reaction to Sunday's Flint debate: "The problems that this city is facing, including the water crisis --- and the water crisis is the most urgent example --- but certainly not limited to it, are beyond the capacity of local leadership to address. We need federal aid in order to stabilize the city."

Says Wheeler: "Even within the state there are increasing numbers of Republicans who admit that, ultimately, this is [Snyder's] screwup. He promised competence, and delivered poison."

Did the debate adequately address the concerns of Flint voters specifically and Michiganders, more broadly, in advance of Tuesday's big Presidential Primary there? Who better addressed the Flint crisis from the perspective of our two Michigan guests? Did Bernie Sanders really "oppose the auto-industry bailout" as Hillary Clinton charged during the debate? And, should voters be concerned about the federal investigation into Clinton's private email servers as both Trump and Sanders' supporters have been charging?

On today's BradCast we cover a number of important new rulings on a number of important cases around the country --- and most of those rulings are actually very good news!

I'm joined by Desi Doyen and The BRAD BLOG's legal analyst Ernest A. Canning to discuss several of them (after a blessedly short few minutes on Trump and Fox 'News' at the top --- you're welcome!), including:

• The matter of the nation's dumbest Governor, Maine's Paul LePage (R), who tried, but failed, to properly veto some 65 pieces of legislation passed by his state legislature. The verdict is now back from the state Supreme Court, to whom LePage had appealed to help fix his epic failure. Suffice to say, LePage remains the nation's dumbest Governor.

• A Colorado state appellate court has now ruled on the case of a local baker who says he really doesn't mind serving gay people in his shop at all...unless they want to buy a cake to celebrate their wedding. Should he be allowed to refuse service based on a so-called religious belief?

• The Connecticut Supreme Court rules on the constitutionality of the state's death penalty after the legislature passed a law banning its use...on everybody except the 11 prisoners who were already sentenced to die before the state's moratorium was passed.

• A U.S. Appeals Court rules on whether Idaho's "Ag-Gag" law, barring journalists and whistleblowers from video taping abuses at factory farms, feed lots and slaughter houses, etc.,. violates the Constitution's First Amendment and whether those who violate that law can be thrown in jail, as the law mandates!

• A U.S. Appeals Court in Texas has ruled against the state Republicans' disenfranchising Photo ID voting restriction, finding it a violation of the Voting Rights Act. But will the state GOP be successful in appealing and/or forestalling that ruling until after next year's elections?

On today's BradCast, we start where we left off on yesterday's show, regarding Thursday's amazingly corrupt and disturbing ruling in favor of Scott Walker and his cronies --- by the amazingly corrupt Wisconsin Supreme Court --- and how, if Republicans have their way, that ruling may soon enough become the law of the land for the entire nation.

As our producer Desi Doyen noted on today's show: "This is your early warning system." Ignore at your peril. Then it was on to a couple of quick items and updates, including dumb Confederate flag wavers in Oklahoma and Maine's even dumber Governor Paul LePage.

From there, we head to North Carolina, where "the most extreme anti-voter bill passed by any state since the Jim Crow Era", as we initially described it when it was passed by state Republicans back in 2013, is finally now facing trial against the NAACP, the ACLU, the DoJ and other democracy and voting rights advocates.

We are joined by The Nation's author/journalist Ari Berman, who was in the federal courtroom in Winston-Salem, NC this week as the trial finally got under way. The results of this trial are likely to head all the way to the U.S. Supreme Court, one way or another, and may well determine the future of voting rights in this country. The new voting restrictions were passed in 2013, just days after the U.S. Supreme Court demolished the provision of the Voting Rights Act that otherwise, says Berman, would have kept this law --- which is "already disenfranchising voters" --- from even taking effect.

"That's such a clear case study to me that the Supreme Court was wrong when it said that the special protections of the Voting Rights act weren't needed." Berman goes on to explain why he believes NC, a state which had made astounding progress in voting rights over the previous decade, has now become the new Selma, Alabama, where the bloody fight for voting rights led directly to passage of the federal Voting Rights Act in 1965.

"In North Carolina, they had seemingly everything," Berman tells me. "They had all these voting reforms --- early voting, same day registration, pre-registration for 16 &17 year olds. And it was all taken away or reduced" when the GOP took over both the state legislature and Governor's mansion for the first time since Reconstruction in 2013.

"What Selma in the 1960s and what North Carolina in the 2013-2015 era shows is how far these conservative white Southerners will go to protect political power. There aren't billy clubs. There aren't literacy tests. But they're saying this is how black turnout increased --- North Carolina went from 48th in voter turnout in the late 80s, to 11th in voter turnout in 2012 --- Republicans there basically said we're gonna tamp this turnout down."

And now it's left to the courts to find out if those rights, once granted, can be taken away by political whim --- and if NC, and other states with a history of racial discrimination in elections, will be forced once again to face preclearance from the federal government before they can enforce any new voting restrictions.

Berman has a lot of insight on all of this. His new book, Give Us the Ballot: The Modern Struggle for Voting Rights in America, will be published next month to coincide with the 50th Anniversary of passage of the VRA. As I note during the show, the book is an exhaustively researched and heart-wrenching documentation of the uniquely American and harrowing tale of the fight to vote in this country --- and the outrageously long and continuing effort to block it. That fight continues, sadly, to this day. Go buy his book!

We were live at the KPFK/Pacifica Radio studios in Los Angeles for today's BradCast and had the opportunity to open up the phones for a lot of great listener calls.

But, first, we covered today's disturbing, near-simultaneous collapse of computer systems at the New York Stock Exchange, the Wall Street Journal and United Airlines, and what we might (but won't) learn from it.

Then, it's onto the nation's dumbest Governor (perhaps in U.S. history) and the unbelievably dumb thing he's finally done now...

Come and listen to a story 'bout a Governor named LePage,
A total dumbass (and sometimes filled with rage).
They said the state of Maine is the state he oughta run,
But wait until you hear what their Guv has gone and done...

But while LePage may be indescribably stupid, at least he's not running for President (yet) --- unlike Wisconsin's Gov. Scott Walker who is not only running, but currently has a very good chance of winning the Republican nomination. And he's as insidiously sneaky and dangerous as Governors get.

We were back live today for the first BradCast on KPFK/Pacifica Radio since the holidays.

First up, a few incomplete words on the breaking news of today's horrific terror attacks at the satirical Charlie Hebdo newspaper in Paris.

Then, BRAD BLOG's legal analyst Ernest A. Canning joined us to discuss his own father's detention and torture (including water-boarding) under the Japanese Kempetai at the notorious Shanghai Bridge House during WWII. After the war, his father, James Robert Canning, testified against his captors [PDF] at the Hong Kong War Crimes Trials, where some members of the Japanese Imperial Army received life sentences --- and, some, the death penalty --- for many of the same crimes against humanity carried out by the U.S. in the wake of the 9/11 attacks [PDF], as Ernie wrote about here recently.

Then, we cover what we hope might be the last report of the 2014 election, the (good news on several accounts) solution to the great Maine Ballot Mystery!

Finally, as ever, Desi Doyen joins us for the latest Green News Report to quickly cover all that happened in the green news world while we were off for holiday break at the end of the warmest year for the planet in recorded history...

I'm already on the road for the holidays this week, but pulled over long enough for a quick appearance on Thom Hartmann's radio show to update a couple of the late-contested results from the November 4th elections, including Maine's amazing "phantom ballots" mystery and Oregon's GMO labeling Measure 92 "recount"...

P.S. Without a proper break over the summer this year, and then continuing non-stop since the elections, I must say I'm not nearly an accomplished enough writer to properly describe how fried I am right about now.

As mentioned, I'm on the road and will continue to be until after the New Year. I need to complete some deadlines for articles elsewhere, knock out a few radio shows, and figure out how The BRAD BLOG can survive as we move forward into our 12th(!) year in January. But between now and then, I'm going to try to force myself to take some down time, at least from blogging, if possible, for a few weeks. We'll see if I'm successful. I'm usually not. (I suspect I may, at the very least, be popping up on Twitter. So be sure to follow both @TheBradBlog and @GreenNewsReport there in the meantime if you're not already.)

So, while there may be a few things rolling here, if things are quieter than usual for a while, all of that would be why...




Mind-boggling response to BRAD BLOG: 'No correction warranted'...

A few weeks ago, Francis Barry, whose bio identifies him as having "previously served as Director of Public Affairs and Chief Speechwriter for New York City Mayor Michael R. Bloomberg," had a piece published by Bloomberg View (the op-ed arm of the Bloomberg News outlet), portending to examine whether Photo ID voting laws had an adverse effect on turnout this year.

Specifically, as the very first paragraph of his piece explained, Barry claims to have been looking at whether "voter identification laws suppress turnout" since, as he opined in the same graf, "Liberals" argue "not all citizens have the type of ID that many states now require at the polls."

The piece, headlined "Quit Blaming Low Turnout on Voter ID", went out of its way to make the case that such laws had nothing to do with turnout this year, as some states with such laws even saw higher turnout than others without them. While one could attempt to make such an argument, in this case, unfortunately, Barry used extraordinarily deceptive data and moving goal posts in order to do so, as detailed in the emails (posted below) between me, him and one of his editors.

The main trick he employed was an apples to oranges comparison of turnout rates in "21 states that had a competitive gubernatorial or Senate race", where, he misleadingly claimed, "Fourteen of the 21 states had a voter ID requirement in place, while seven didn't".

But here's the thing. Barry deceptively swapped the type of very specific Photo ID laws cited in his first paragraph, with very non-restrictive ID laws that are in use without objection in many states.

When I explained all of this in detail to him and his editors via email (all posted below), the response I received back was, as I noted, "mind-boggling, to be frank"...

Hand-counting vindicated, voter intent served in dramatic twist...

In the tiny seaside town of Long Island, Maine --- and for the national media that followed it --- it was an inscrutable mystery fit for Murder She Wrote's Jessica Fletcher. Except that it wasn't murder at the heart of this mystery, it was a potentially 'stolen' election, which, upon additional investigation, has now been 'unstolen', with the state Senate candidate rightfully elected by the people of Maine's District 25 finally set to take her seat in the state legislature after another dramatic turn of events this week.

We recently detailed the fascinating story of 21 "phantom ballots", all cast for Republican state Senate candidate Cathleen Manchester, which, when reportedly "discovered" during a November 18th recount of the very close Maine Senate race, ended up flipping the results from the slim victory Democratic candidate Catherine Breen thought she had achieved on Election Night to a "win" for her GOP opponent.

The tantalizing mystery in the town of Long Island included 171 ballots tallied by hand there on the night of the November 4th election and the same number of voters confirmed to have voted in the town's official Voter Manifest, either by absentee ballot or at the tiny town's only polling place.

Like the public hand-count of all the town's ballots at the end of Election Night, Long Island's only polling place was overseen all day by its Town Clerk Brenda Singo (who, over the past week or so, had strangely, yet repeatedly refused to answer what we thought were fairly simple, straightforward queries from The BRAD BLOG about the town's precinct-based Election Night hand-count and the chain of custody process thereafter for its hand-marked paper ballots.)

During the recount of paper ballots in the seven towns comprising Maine's Senate District 25, however, a funny thing happened. 21 "new" ballots showed up in Long Island, all for the Republican Manchester, resulting in her being certified as the "winner" of the recount overseen by the Secretary of State's office and the Democratic Breen's subsequent contest of the recount results falling to the Republican-majority state Senate to be investigated and ultimately decided there.

Before the Special Committee, comprised of four Republicans and three Democrats, could convene, the outcome didn't look good for the Democrats. The GOP majority "provisionally seated" Manchester, despite strenuous objections from state Dems.

The resolution of the mystery on Tuesday, however --- which resulted in one state official declaring "I'd eat my hat if I had one" --- has flipped the final results back to the Democrat once again, cleared the Town Clerk Singo and other election officials of further suspicion and, as we noted in our original report, underscored once again the undeniable fact that hand counting hand-marked paper ballots at the precinct on Election Night is the most reliable and publicly overseeable way of assuring that election results actually reflect the true intent of the voters...

• After a bit of breaking news on yet another failure to indict a white cop who killed a black man (in NYC), it's a quick (if disturbing) update on the continuing election recount mystery in Maine.

• The U.S. House race in Arizona's 2nd Congressional District (Rep. Gabby Giffords old seat) is headed to a "recount", as the state plans to "recount" ballots on the same faulty electronic optical-scan computers that tallied them in the first place. Pima County, AZ election law attorney Bill Risner joins us to discuss his lawsuit [PDF] against the state's plan for the "recount".

Dr. Michael Mann, Penn State University climate scientist and author of The Hockey Stick and the Climate Wars: Dispatches from the Front Lines responds to the disturbing climate change-related story line on a recent episode of Aaron Sorkin's The Newsroom on HBO as we separate scary climate fact from even scarier climate fiction. Mann also comments on the seemingly very encouraging news out of Germany this week, suggesting that fossil fuel companies are seeing "the writing on the wall". The good news: The guy who created the infamous "Hockey Stick Graph" is actually the optimistic one, for a change!

• Finally --- as relevant as ever this week --- it's the 50th anniversary of the "Free Speech Movement" kicked off by activist Mario Savio's inspiring speech at the UC Berkeley sit-in in 1964 ("There's a time when the operation of the machine becomes so odious, makes you so sick at heart that you can't take part! You can't even passively take part! And you've got to put your bodies upon the gears and upon the wheels, upon the levers, upon all the apparatus") and the 30th anniversary of the world's worst industrial disaster at the Union Carbide plant in India in 1984. We commemorate both.
