On today's BradCast, one of the most amazing candidate meltdowns ever seen (or, in this case, heard) and how the Speaker of the House hopes to look the other way in the event that he wins anyway. But that's just the tip of today's news iceberg(s). [Audio link to show posted below.]

In one of the most remarkable Election Eve unravelings ever by a U.S. candidate for...pretty much anything, Republican U.S. House candidate Greg Gianforte melted down on the eve of what should have been an easy victory in his statewide Special Election for Montana's only U.S. House seat against Democratic candidate Rob Quist. Instead, in an incident caught on stunning audio tape and witnessed by Fox "News" reporters, Gianforte "body slammed" a Guardian reporter, has been charged with assault, and saw his newspaper endorsements rescinded on the night before voters went to the polls on Thursday.

But many voters already cast their vote by absentee ballot by time of the Wednesday incident, and House Speaker Paul Ryan suggests he'll accept whatever results are reported from the election. That, as I explain today, conveniently ignores Congress's Article 1, Section 5 Constitutional right (and duty) to determine who is actually seated in the House of Representatives. It's a right they have exercised on a number of other controversial elections in the past, so surely Ryan is familiar with that. But, of course, we'll soon see (hopefully) who voters in Montana have decided they want for their only Representative in the U.S. House.

At the same time, it was another enormous news day in which Donald Trump's second attempted travel ban Executive Order was blocked, yet again, this time by the full U.S. 4th Circuit of Appeals. His Attorney General Jeff Sessions has announced he will appeal the case to the GOP's stolen U.S. Supreme Court.

Also today, yet another embarrassment for the Trump Administration, which was publicly taken to task by British Prime Minister Theresa May for leaking British intelligence to media regarding the UK's Manchester Bombing investigation. The leaks not only invoked the wrath of (and temporarily stopped intelligence sharing from) the United States' closest ally, but it was hardly the only highly sensitive information recently and inappropriately disclosed to friend and foe alike by Trump and/or his Administration in recent days.

And, in a (related) news item we didn't get to yesterday, after disclosing the whereabouts of two U.S. nuclear submarines, it appears Trump actually praised Philippines President Rodrigo Duterte during a recent phone call for the "unbelievable...great job" he has done on that nation's drug epidemic --- in which thousands of people have been murdered in a brutal extrajudicial campaign carried out by Duterte's police force.

Finally, Desi Doyen joins us with a jam-packed Green News Report, before still more news breaks at the buzzer, reportedly finding Trump's top adviser and son-in-law Jared Kushner 'under FBI scrutiny' in the Bureau's ongoing Trump/Russia probe...

Guest: Dave Johnson of People's Action/Campaign for America's Future...

On today's BradCast: Republicans continue to pretend we don't face a gun violence epidemic in the U.S., that human-caused climate change isn't happening and that massive tax cuts help, rather harm, the economy and the middle class. They may need to pretend harder. [Audio link to full show is posted below.]

First up today, a number of multiple victim shootings that played out across America --- from San Diego to Topeka to Dallas --- in the past 24 hours, but received very little media coverage, for some strange reason. At the same time, on Saturday, hundreds of thousands turned out across the country for the People's Climate March --- nearly 200,000 of them in sweltering 90 degree heat (in late April!) in Washington D.C. alone. The latest mass demonstration against the Trump Administration's attempts to deny science and cut funding to climate-related programs came just hours after Trump's EPA began the removal of climate change-related facts and scientific data from its website.

And, all of that happened as Donald Trump's Presidency hit its first 100 days, a period marked by, among other things, a failure to pass any of the legislative goals announced during his campaign. In hopes of distracting from that failure to date, Trump's Treasury Secretary Steve Mnuchin (pictured above) released a hastily compiled one-page outline for what the White House describes as "The Biggest Individual And Business Tax Cut In American History."

But, as critics from the right, left and center, including my guest today, Dave Johnson, a Senior Fellow at the progressive Campaign for America's Future notes in response to Trump's proposal, bigger isn't necessarily better. In this case, the proposed cuts would actually hurt poor and middle-class Americans, Johnson explains, while defunding the very things that help boost the economy, serving as a huge gift to the very wealthy, and blowing a massive hole in the federal deficit to boot.

Johnson explains the "smokescreen of bamboozlement [and] propaganda" by Republicans for decades on these issues which, he argues, citing similar cuts and claims from Ronald Reagan to George W. Bush, have never "paid for themselves" as the Trump Administration is claiming once again. "How many times have they done this and the results have not come through?," Johnson rails, describing how even the Congressional Research Service, when asked by Republicans to create a report in 2012 looking back at tax cut data all the way back to 1945, found that "cutting taxes does not boost the economy."

Moreover, he notes, "corporate profits are at the highest ever right now," making it hard to justify Trump's proposed corporate tax cuts (from 39.5% to 15%) as anything more than an economic boost to a small handful of very wealthy investors. Cutting taxes, he argues, is meant for little more than enriching the already very rich and "forc[ing] cuts in government by forcing a crisis in budgeting."

"Democracy doesn't have an advertising agency, but all of these anti-government people do," Johnson tells me, in response to my questions about how GOPers are still able to continue arguing for something that has proven time and again to be little more than a myth, albeit one that many Americans still seem to fall for. We also discuss whether or not Congressional "Tea Party" Republicans will actually approve such a huge increase in the federal deficit, or if, as with attempts at health care reform, they, not Democrats, will be the real obstacle.

Finally today, more firings and fall-out announced at the Fox 'News' Channel, in response to the myriad and systemic sexual harassment complaints against its now-former creator Roger Ailes and its now-former top star Bill O'Reilly...

On today's BradCast, Trump and the GOP trip over themselves in their mad rush to his 100th day as President, while Americans plan to hit the streets yet again in protest, this time in a Saturday demonstration on behalf of Planet Earth. [Audio link to show follows below.]

Amidst the Trump Administration's panic to try and un-embarrass themselves about their historic lack of accomplishments before this weekend's "100 Day" benchmark, things only seem to be getting worse for them. Among their latest embarrassments: A new DHS program launched by the Administration to supposedly help victims of crimes purportedly committed by immigrants goes awry in several different ways; the new scramble to pass an updated health care bill in the House to replace the Affordable Care Act ("ObamaCare") has put some Republicans in an untenable position once again, and risks undermining a separate plan to avoid another government shutdown this weekend; the Pentagon confirms that Trump's former National Security Adviser Michael Flynn is under an Inspector General's investigation for allegedly failing to obtain permission for payments from foreign sources; and Sean Spicer confirms the Administration didn't even bother to run a security background check on Flynn before naming him as NSA. (So much for "extreme vetting".)

But, on Saturday, the 100th Day of his Presidency, another embarrassment awaits as thousands plan to hit the streets yet again, this time for the People's Climate March, just days after Trump signed an Executive Order attempting, for the first time in U.S. history, to reverse national monument declarations made by three former Presidents. Among the public lands Trump hopes to remove protection for, to allow oil, gas and mineral extraction: the Bears Ear National Monument in Utah, a million acres "sacred to Native Americans and home to tens of thousands of archaeological sites, including ancient cliff dwellings."

Marta Segura of the Climate Law Institute at the Center for Biological Diversity's Climate Law Institute (whose modest mission is "Saving Life on Earth"), and a member of the steering committee for Los Angeles' version of this weekend's march, joins us to discuss all of that and more.

On Trump's attempt to reverse public lands declarations, Segura charges: "The agenda of the Trump Administration is to strengthen the fossil fuel industry and to give them access to lands that have not been explored for fossil fuels, and which they suspect there will be a lot of opportunity to make a lot of people, and a lot of the refineries, very rich, very fast."

"He's claiming that the government has had a 'land grab' on these lands across the nation, and has taken control without the consent of the people," she tells me. "He's misusing that term. He's basically trying to control these lands so that he can benefit the industries. The people are the ones that are benefiting from these public lands right now. That's the definition of public lands."

Speaking about this weekend's climate march and why it's separate from last weekend's March for Science, she explains why organizers in L.A. chose to hold their version of the People's Climate March near the site of a planned Tesoro Oil refinery expansion in Wilmington, near a densly populated residential area on the coast. If the expansion is allowed, she says, it would result in the "the largest refinery in the Western region. And it will be expanding at a time when we really need reductions in greenhouse gases."

"This march," Segura tells me before finishing on a hopeful note, "is for the representation and lifting voices of front-line communities who are disproportionately impacted by the greenhouse gases and pollution."

I couldn't help but burst out laughing while reading White House Press Secretary Sean Spicer's description of U.S. District Court Judge William H. Orrick's late Tuesday decision partially blocking a Presidential Executive Order on funding to so-called "sanctuary cities" as an "egregious overreach by a single, unelected district judge."

(All federal judges are nominated by a President and confirmed by the Senate. None are "elected.")

Not to be outdone by his Press Secretary, Trump via Twitter described the ruling to enjoin the enforcement provision of his January 25 Executive Order as "ridiculous."

In that Executive Order, Trump threatened to withhold and/or recapture all federal funds and grants from any local jurisdiction that did not assist the federal government in its newly aggressive efforts to deport undocumented immigrants.

Trump vowed to appeal all the way to the Supreme Court.

Hilarious!

In the forty (40) years that have passed since I was first admitted to the California State Bar, I can scarcely recall a more one-sided "contested" case --- one in which I actually felt sorry for the Justice Department attorney who had been assigned to defend this indefensible Executive Order...

With special elections for the U.S. House under way (yesterday in Kansas, next week in Georgia, for a start), new voting restrictions being put in place by Republicans in Iowa, and a federal court slapping down Texas Republican's voting laws as racially discriminatory yet again, it looks like we're fully back on the democracy beat for today's BradCast.

First up, Republicans reportedly won Tuesday's special election for a vacant U.S. House seat in deep "red" Kansas, but it wasn't easy for them. The progressive Democratic candidate James Thompson was able to secure a 20+ point swing against the Republican Ron Estes in KS-04 from Donald Trump's landslide victory in the district just months ago. But should national Democrats have done more to support their candidate in what had previously been regarded as an unwinnable seat for Dems? And can the results fairly be seen an encouraging bellwether for next week's special election for the U.S. House in Georgia, in another Republican (if less so) district?

In the meantime, the GOP continues their efforts to keep Democratic-leaning voters from being able to vote at all. In Iowa, as internal emails from his own deputy reveal, the GOP Sec. of State recently cited misleading "voter fraud" evidence in support of new voting restrictions. And Republicans in the state legislature eye spending some $650,000 in support of it, while planning cuts to social programs, like those meant to protect Buckeye State kids.

But, in Texas, a federal court this week, for a second time, has found the state's Photo ID voting restriction to have been purposely discriminatory against racial minorities. Will Texas finally be forced to kill their racial discriminatory voting law entirely? And, of more note, now that intentional discrimination by the state Republicans has been found yet again, will the federal courts force Texas to obtain federal approval for any new voting laws, as per Section 5 of the Voting Rights Act?

Attorney Ernest A. Canning, who has been covering the Texas case, and others related, for years at The BRAD BLOG, joins us to explain this week's "huge" ruling from the U.S. District Court concerning what he describes as the state's "zombie voter suppression bill" that never dies, no matter how many times it's struck down as unlawful by federal courts and the DoJ. Also, what does this latest ruling portend for the future of this law and others like it, at both the federal Court of Appeals and the (now stolen) U.S. Supreme Court? We discuss.

Finally, Desi Doyen joins us with the latest Green News Report with some more disturbing news about Trump's EPA, but some very encouraging news on California's historic drought...

Guest: Howie Klein of 'Down With Tyranny' on surprisingly good odds for progressives in KS, GA, MT, CA; Also: Tons of breaking news today...

On today's BradCast: A ton of breaking (and largely distressing) news, before largely encouraging review of four upcoming U.S. House special elections that may offer a bit of an antidote to some of that distressing news, at least for Democrats and progressives. [Audio link to show follows below.]

Today's show both opens and closes with a ton of breaking news, including, for a start: Another school shooting, which appears to be a murder-suicide, in San Bernardino, CA (the same town where 14 were killed in a mass shooting in late 2015); The white supremacist Charleston church shooter is sentenced to 9 consecutive life sentences in state court after being sentenced earlier this year to execution in federal court; Stolen U.S. Supreme Court "Justice" Neil Gorsuch is sworn in, as President Trump thanks Senate Majority leader Mitch McConnell for the theft; War planes take off from the very same air base said to have been bombed by Trump last Friday, and U.S. war ships head toward the Korean Peninsula for a possible confrontation with nuclear-armed North Korea; and Trump huddles with the Koch Brothers at Mar-a-lago as special elections to fill Republican U.S. House vacancies left by Administration appointees get underway in Kansas, Georgia and Montana (and in Los Angeles, where there is a Democratic vacancy).

We're joined today by the great Howie Klein, progressive champion and founder of DownWithTyranny.com for an overview of all four upcoming U.S. House races and the surprising (if still long-shot) possibilities of Democratic pickups in the three otherwise very Republican districts. Klein breaks down the likelihood for Dem victories in each district, describes the candidates who are running, and why it is that both the Republican and Democratic parties seem to have been underestimating the possibility of several of those seats "going blue" in the first federal elections of the Trump Era.

Among the upcoming U.S. House races, Klein notes that in CA-34, leading candidate Jimmy Gomez is a very progressive Dem running against another Dem who, he charges, is actually a Republican who changed his party affiliation for this race; in KS-4 (which votes on Tuesday, 4/11), Klein tells me that a week ago he'd have said the Dem candidate, James Thompson, had no chance in the deeply "red" district. But now that national GOPers are suddenly pouring panic money and other resources into the race, he thinks it's still long odds, but possible that Republican Ron Estes could face an upset in the home district of Koch Industries. In GA-6, he details, progressives have very high hopes for 30-year old Jon Ossoff who is running way ahead of a split GOP field in a "Jungle Primary" compromised of some 18 candidates in the first round of voting set for 4/18, where any candidate who gets 50%+1 could win the whole thing outright; And, finally, we review Montana's at-large U.S. Congressional race which, he says, could also be vulnerable to the populist Democratic candidate now running in a Republican state that has shown itself able elect Democrats to statewide seats in the very recent past.

Klein spares no criticism, however, for a number of Democratic organizations, like the Kansas Democratic Party which, he says, "should be ashamed of themselves" for failing to spend money on the House race. "They haven't had a candidate this strong running for that seat ever, and they haven't had an opportunity like this as long I can remember. They should be all over this, and they're not."

"These are dark, deep 'red' districts, and normally there would be no Democrats having any chance. But because of Trump's policies, because of that crackpot healthcare bill --- TrumpCare or whatever it was --- because of that, Republicans are discouraged and thinking, 'I'm not even going to go vote'. Or other Republicans are thinking, 'You know what? I'll vote for the Democrat!,'" Klein tells me. We'll soon see if he's right. But, of course, we'll also have to presume that Georgia's 15-year old, 100% unverifiable touch-screen voting systems weren't manipulated by (or since) a recent "massive" hack of its voter database.

And finally, as we head off air today, breaking news about the resignation and criminal booking of Alabama's Republican Governor Robert Bentley in the face of impeachment charges and...as if that's all not enough...a U.S. District Judge in Texas once again finds that state Republicans deliberately discriminated against racial minorities with their controversial Photo ID voting law...

Guest: Media reformer Sue Wilson; Also: The GOP's stolen SCOTUS lie...

On today's BradCast: With Republicans in the U.S. Senate on the verge of completing their brazen and historically unprecedented theft of the U.S. Supreme Court majority for a generation --- and still grimmer news elsewhere around the world --- we're happy to cover an inspiring David v. Goliath story about a media activist who took on a major media conglomerate (and the FCC) and seems to have won! At least mostly. [Audio link to show follows below.]

Former award-winning broadcast journalist turned media reformer Sue Wilson of Media Action Center joins us today to detail an encouraging ending to what began ten years ago as an unspeakably tragic story. After the death of a listener, following a stunt contest on Entercom Communication's KDND 107.9 "The End" in Sacramento, and a trial finding the company liable for that death, Wilson decided to file a Petition to Deny renewal of the company's license with the FCC for its 50,000 watt powerhouse frequency.

The FCC has not revoked any corporate license to use our public airwaves in the federal agency's memory. What happened next, however, was detailed over the weekend by Dan Morain at the Sacramento Bee, by Wilson herself today at The BRAD BLOG, and, in person on today's BradCast, where she details the difficulties she had in finding any of the larger, more established media reform organizations or attorneys willing to join her effort.

This story is a remarkably encouraging (and timely) reminder that, yes, one person actually can make a difference by taking on both corporate giants and intransigent federal agencies --- and win! But, as importantly, it's also an important reminder that those for-profit corporations entrusted with controlling our public airwaves, still have a legal responsibility to use those airwaves in the public interest.

How I took on a major media conglomerate for abusing our public airwaves and challenged the FCC to do its job --- and (mostly) won...

Over the weekend, Dan Morain, editorial page editor at Sacramento Bee, wrote an article about what I've been working on, and writing about here at The BRAD BLOG and elsewhere, for many years now.

Morain's article starts this way:

From her home outside the no-stoplight settlement of Fiddletown, Sue Wilson tilted at a corporate windmill, and a funny thing happened.

Sue from Fiddletown won, on our behalf. You can hear the sound of that victory at the end of the FM radio dial in Sacramento. Where there once was commercial pop music, hooting deejays and stupid radio stunts, there’s static.

"We the People own the air waves," she said, and repeats: "We the People."

It's a very nice article, that begins with a tragic story. That story, however, now has at least a somewhat encouraging ending for, yes, We the People.

Guest: Computer science and e-voting systems expert Barbara Simons...

On today's BradCast, a story out of Georgia serves as a jarring reminder that we'd better not wait until 2018 to be concerned about the integrity and public oversight of our electronically tabulated elections. Also, the political blame game is underway regarding the Republicans' planned use of the "nuclear option" in the U.S. Senate. [Audio link to show posted at bottom of article.]

Early last month, someone reportedly hacked into the voting records database at Kennesaw State University's Center for Election Systems, which is contracted to maintain and program all of Georgia's 100% unverifiable touch-screen Diebold voting systems and electronic poll books. The state still uses the same unverifiable 2002 voting systems that, as we reported more than a decade ago, were hacked in a minute's time by researchers at Princeton University, where they were able to implant a virus that could pass itself from machine to machine and flip the results of an election with little or no possibility of detection.

The recent hack at Georgia's KSU, which the Atlanta Journal-Constitution described at the time as possibly compromising some 7.5 million voter records, resulted in a quiet FBI investigation, and comes as special elections are about to be held in a number of states to fill U.S. House seats vacated by Republican members of Congress tapped to serve in the Trump Administration.

One of those special elections is in Georgia on April 18, where the contest to fill GOP Rep. Tom Price's seat in CD-6 (he's now Trump's Secretary of Health and Human Services) is drawing both national attention and a lot of money from both Democrats and Republicans. With a suprisingly popular 30-year old Democrat, Jon Ossoff, poised to potentially upset a splintered GOP field in the otherwise solidly Republican district, the race is being regarded as a potential bellwether for the 2018 elections.

Longtime computer scientist and voting systems expert Barbara Simons of VerifiedVoting.org joins me today to explain the ongoing concerns about the still-mysterious Georgia hack, Verified Voting's effort to get answers about it from GA's Republican Sec. of State Brian Kemp; the group's request to have him to offer paper ballots to voters in the wake of the reported "massive data breach"; and this weekend's similarly cryptic news that the FBI has now concluded its investigation.

As we discuss what we know, and don't, about the GA hack, Simons, co-author of Broken Ballots: Will Your Vote Count? and a member of the U.S. Election Assistance Commission's Board of Advisers since 2008, tells me that "it's a national scandal" that the state is still using those unverifiable systems for all elections.

Simons had also joined a number of renowned voting systems experts to plea with the Hillary Clinton campaign last year to seek a public hand-count of the Presidential election in several states, given questions about the exceedingly close race and the surprising results in a number of them. When Clinton declined to file for that common sense oversight, Green Party candidate Jill Stein responded affirmatively to the same plea. Nonetheless, as we also discuss today, hand-counts in Wisconsin, Michigan and Pennsylvania were largely blocked, thanks to efforts by Team Trump, state Republicans and even some Democrats.

We discuss all of that, the years-long effort to institute legislative safeguards against electronic voting and computerized tabulation systems; and why even paper ballots tallied by computers leave the public uncertain about the accurate results of elections. "Paper ballots in and of themselves are not sufficient. That lesson was very clear from the 2016 election," she tells me, as I ask about what I see as the need to publicly hand-count hand-marked paper ballots on election night in order to restore public confidence and oversight of results. "The problem is we have some very bad laws," she responds, offering her thoughts on legislative changes that are needed, short of ditching the computers entirely, in order to respond to what she sees as "a national security issue" in our elections.
