On today's BradCast: Another reminder that the nation's elections officials remain woefully unprepared for and under-informed about threats to this year's crucial mid-term elections, and clear examples of where our governmental institutions currently work to combat blatant corruption by top officials (Missouri) and where they don't (D.C.).

First up, an election night cyberattack in Knox County, Tennessee's local primaries on Tuesday should have officials there (and elsewhere) far more concerned than they appear to be. We discuss why this latest attack echoes similar incidents we've seen previously (including at the end of election night during the 2004 Presidential election in Ohio), why such attacks are likely to become more frequent, and how election and cyber-security officials continue to woefully underestimate and misunderstand the very real dangers to our elections when they (falsely) tell the public, as they are doing in Knox County this week, that their computerized voting, registration and tabulation systems are "never connected to the Internet, so can't be hacked." They are wrong.

Next, Missouri's Republican governor Eric Greitens is now facing three different felony charges, two separate court trials, and the GOP-majority state legislature has now overwhelmingly decided to call a special session to consider impeachment. Greitens maintains his innocence in both a sexual blackmail scandal and campaign finance scandal. We explain why the extraordinary historical moment --- despite the Show-Me State's Governor refusal to resign, echoing Donald Trump in calling the well-documented evidence against him the result of a "witch hunt" by prosecutors (and his own party?) --- is actually, at least so far, an example of how the system is supposed to work.

Contrast that to the quickly devolving mess in D.C. today, where Republicans in the House and Senate who ought to be demanding accountability from a corrupt President, are looking the other way and/or undermining prosecutors, and where prosecutors seem to (falsely) suggest they cannot indict a sitting President, no matter the evidence of serious crimes. That, even as whatever credibility this Administration may have once had, has now disintegrated so much amidst Trump's latest flip-flops on a number of scandals, that even one top Fox "News" anchor unloaded on the President on Thursday, with an astonishing smack down of Trump lies, which ends: "I guess you’re too busy draining the swamp to ever stop and smell the stink you’re creating. That’s your stink. Mr. President, that’s your swamp." When you've lost Neil Cavuto...

Finally, Desi Doyen joins us with an update on the evacuations, earthquakes and new eruptions near Hawaii's Kilauea volcano and on the state's recent deluge (50 inches in 24 hours!) of global warming-related rain. As well as another explosion, massive fire and evacuations --- the third within the past month --- at a fossil fuel-related processing plant, this time in Louisiana...

On today's BradCast: Rudy Giuliani works his magic as he settles in as the newest attorney on Donald Trump's personal legal defense team --- and it appears to have exploded spectacularly. And Ohio's Sec. of State and two largest counties are slapped with an election transparency lawsuit just days before next Tuesday's primary in the Buckeye State. [Audio link to show is posted below.]

First up: On Wednesday night, the former NYC Mayor stunned Sean Hannity of Fox "News" when he told him on air that Trump reimbursed his embattled "fixer" and personal lawyer Michael Cohen for the $130,000 in hush money paid to Stormy Daniels just days before the 2016 Presidential election. The payment, which Trump had long denied making himself, was meant to cover up an alleged affair Trump had with the porn star. Then, on Thursday morning, Giuliani dug the hole deeper by making clear, once again on Fox "News", that the payment was meant to protect Trump's candidacy.

All of which means that Trump is likely in even more --- and perhaps even criminal --- trouble, regarding serious campaign finance violations which Giuliani seems to have thought he was helping Trump avoid. We discuss and try to clarify the President's newly revealed legal peril on that front today, even as Trump (or his attorneys) took to Twitter to reverse his own previous denials by admitting that he did, in fact, reimburse Cohen for the payments to Daniels.

As Politico's Jack Shafer wryly tweeted today: "Having Giuliani in the mix is almost like having a second Trump."

Then, as we try to stay focused amidst all the noise, we're joined by election transparency expert JOHN BRAKEY and longtime election attorney CHRIS SAUTTER, both of Americans United for Democracy, Integrity and Transparency in Elections (AUDIT USA) about their lawsuit just filed in Ohio in advance of the state's 2018 mid-term primary next Tuesday.

The suit echoes a similar one filed last December in Alabama before that state's much-watched U.S. Senate Special Election between Democrat Doug Jones and Republican Roy Moore. (That suit was successful in a lower court, before the state's woeful Sec. of State John Merrill convinced their Supreme Court to stay the ruling at the last minute.) The new complaint seeks to force Ohio's Secretary of State Jon Husted and its two most-populous counties, Cuyahoga (Cleveland) and Franklin (Columbus), to retain digital ballot images created by the counties' computer scanners as hand-marked paper ballots are initially scanned during tabulation.

Those images, as Brakey explains, allow the public to safely examine the accuracy of election results without disturbing the original paper ballots and, according to Sautter (and several court rulings in other states), complies with federal election law requiring the retention of all election materials for 22 months after federal elections.

The pair detail why preventing the destruction of the images in question is at the center of the multi-partisan suit filed in Ohio, and why they plan to continue pressing election officials in Ohio and in many other states and counties around the country to ensure that digital ballot scanners are set to retain all such images for public oversight after Election Day.

Finally, Desi Doyen joins us for the latest Green News Report with still more bad news for corrupt EPA chief Scott Pruitt and for the planet itself, but also with a bit of good news for NYC, Hawaii, and even one of China's major cities...

Congress acquiesces after second US attack on war-torn sovereign nation; Also: Hannity revealed as secret Cohen client; Callers ring in...

On today's BradCast: Bill Maher quipped Friday night that the U.S. attack, with France and Britain, on Syria was code-named "Operation Desert Stormy", an attempt by Donald Trump to force his legal and ethical nightmares off the front pages. It didn't work. [Audio link to show follows below.]

On Sunday night, fired FBI Director James Comey described Trump as "morally unfit" for the Presidency in a prime-time ABC News interview, and on Monday, just before air today, Sean Hannity of Fox "News" was revealed in federal court to be a secret client of Trump's hush money payoff "fixer" Michael Cohen, and Cohen and Trump's motion to review documents seized in the raid on Cohen's office and residences last week was denied (for now) by the federal judge.

Nonetheless, before it's forgotten entirely in the fog of Trump Scandal, we focus mostly today on the fact that the pre-dawn bombing of Damascus by US and its allies, said to be in response to an alleged chemical attack by Syrian President Bashar al-Assad against his own people a week earlier in Douma, was done without any actual hard evidence of a chemical attack or who was actually responsible for it. Trump's Secretary of Defense James Mattis admitted as much during Congressional hearings just one day before more than 100 cruise missiles were unleashed on supposedly chemical weapons-related facilities in Damascus. (No proof was offered to buttress the claim about those facilities either.)

Moreover, there is absolutely no legal authority whatsoever for Trump's attack --- either domestically or internationally --- despite various claims to the contrary. Shamefully, most of Congress, both Republicans and Democrats alike, have so far failed to demand accountability for the unconstitutional use of military force (even after threatening President Obama with impeachment when he wanted to launch a similar attack in response to an alleged Syrian chemical attack in 2013).

For his part, the hapless Trump, who mercilessly derided Obama for calling for Syrian airstrikes in 2013, took to Twitter on Saturday to echo George W. Bush's infamous appearance on a U.S. Aircraft Carrier in 2003 after the ill-fated invasion of Iraq, to declare "Mission Accomplished" in Syria.

Friday's unlawful US attack, as we also discuss today, is believed to have cost some $200 million. That could have paid for the replacement of all of Flint, MI's lead water pipes some four times over, as new studies reveal that reading proficiency levels for third-graders in Flint has plummeted in the wake of the lead drinking water contamination crisis. That continuing crisis came about after MI's Gov. Rick Snyder (R), following his election in 2010, ordered an Emergency Manager takeover of the city and a subsequent change to its water supply.

As one caller observed today, some poisoned children, like those in Syria apparently, seem to be a larger concern for the Trump Administration than others...no matter the evidence or lack thereof...

On today's BradCast: It is "a very dangerous time", as longtime White House reporter and historian Paul Brandus may have understated last night. "Objectively speaking," he observed in a "difficult to write" tweet, he has "never seen, or known of, a President as unhinged and unstable as" Donald Trump appeared during remarks at the White House before his Monday meeting with his military team.

On Monday evening, following FBI raids on the office and residences of his personal attorney Michael Cohen, President Trump lashed out at law enforcement, calling the court-approved searches "disgraceful", "an attack on our country", and falsely claimed that the search warrant approved by a federal judge and the U.S. Attorney's office in Manhattan, amounted to a "break in". Trump's remarks also included musings about the possibility of firing Special Counsel Robert Mueller, whose office is said to have shared information with the U.S. Attorney in the Southern District of New York, leading to yesterday's raids.

Trump's friend, attorney and business partner Cohen is currently embroiled in the scandal involving a $130,000 hush money payoff to porn star Stormy Daniels, made just days before the 2016 election. The lawful raid, however, which may involve far more serious crimes, comes at a particularly precarious moment.

On Tuesday --- one day after Trump's new and extraordinarily hawkish National Security Advisor John Bolton's first day on the job --- longtime White House Homeland Security Advisor, Tom Bossert, was abruptly fired. His dismissal came after Bossert, while making clear that all options were on the table, had argued in favor of Trump's recent position on Syria over the weekend, in opposition to increased U.S. military action in the war-torn nation. But, after a recent chemical attack in the Syrian town of Douma, Trump has now cancelled a scheduled trip to Latin America and appears to be readying military action against the sovereign nation --- a close ally of both Russia and Iran --- even without authorization from Congress. Such action would likely, at a minimum, mirror the missile attack Trump unleashed on a Syrian airbase last year, which both Congressional Republicans and Democrats lauded at the time, even though Republicans had threatened President Obama with the possibility of impeachment when he considered doing the very same thing during his term in office. This time, however, the action could be much larger, more deadly, and far more dangerous for the region and the U.S.

At the same time, nobody seems to be certain as to exactly why Cohen was raided in the first place. Speculation ranges from the Stormy Daniels affair, to bank and wire fraud, to alleged schemes and payouts from Ukrainian and Russian oligarchs, to Cohen's taxi business in New York.

We're joined today by the great HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo blog, to try and make sense of all of the above. Wish us luck. "It's like there's this unharmonic convergence happening with all this news," she tells me. "I don't know what it is, but it's not good."

"In this situation, when you've got Syria there and Trump under the gun, feeling Robert Mueller breathing down his neck, this is something that a guy like Bolton --- if he is smart enough to suss that out about Trump, and I have a suspicion that he might be --- he could be feeding that into Trump and we're going to see some kind of --- what do they call it these days? --- 'kinetic violence'. That's another word for war," she says.

We've got a lot to discuss about all of this on today's show with 'Digby', including what is likely to happen if (when) Trump moves to fire Mueller, as well as how this entire long national nightmare may finally end.

On today's BradCast: A lot of breaking news, accompanied by some actual Donald Trump 'fire and fury' today and callers who ring in on all of it. [Audio link to show is posted below.]

Among the stories covered on today's program...

  • The legal offices and residences of Donald Trump's personal friend, business partner, attorney and "fixer" Michael Cohen were raided by the U.S. Attorney in Manhattan today just before airtime. Cohen's attorney claims some of the information used to obtain the warrant came from Robert Mueller's Special Counsel probe. Cohen has recently come under legal scrutiny for his part in a $130,000 payment to porn star Stormy Daniels to keep an affair between her and Trump quiet just before the 2016 election. Trump is said to be furious, and described the investigation as "disgraceful" and "an attack on our country" after news of the FBI raid on Cohen's office became public on Monday.
  • That comes after a longtime tenant died in a massive four-alarm blaze on the 50th floor of Trump Tower in Manhattan over the weekend, following Trump having reportedly spent years fighting against requirements for mandatory fire sprinklers on the residential floors of his namesake tower and headquarters of the Trump Organization.
  • Also today, some good news (and bad) for voters. In Maryland, the state's Republican Governor allowed a bill for automatic voter registration to becoome law without his signature.
  • California announced it has now had 100,000 16- and 17-year olds pre-register to vote, after a 2016 state law was enacted to allow for early registration by teens. A flurry of those pre-registrations, according to CA Sec. of State Alex Padilla, have reportedly come in the wake of the 'March for Our Lives' activism by the students of Marjory Stoneman Douglas High School in Parkland, Florida, following the February gun massacre at their school.
  • And, speaking of elections and the Sunshine State, Republican Gov. Rick Scott announced his candidacy for the U.S. Senate on Monday, in his long-expected bid to unseat incumbent Democratic Senator Bill Nelson. The race is expected to be one of the most expensive U.S. Senate races in the nation's history.
  • Scott's announcement comes just days after he appealed a ruling by a federal judge ordering him to reform the state's procedures for restoring voting rights to some 1.5 million former felons. Scott has slow-walked the clemency process for years, since taking office, leaving some 10% of the state's voting-age population (and nearly a quarter of the state's African Americans) off the rolls and unable to participate in elections in the closely divided swing-state.

Lots of breaking news on today's BradCast, and a look at the real reasons the Trump Administration has now added a new question on citizenship to the 2020 U.S. Census. But, don't worry. It all ends with a song! [Audio link to today's show follows below.]

First up: the never-ending Executive Branch shakeup continues as Trump fires embattled Veterans Affairs Secretary David Shulkin and announces his intention to replace him with White House physician Ronny Jackson.

Then, Trump's never-ending legal woes continue to quickly mount and worsen on several fronts beyond the Special Counsel probe (where he is still having trouble finding attorneys willing to represent him, after his latest lead attorney quit last week.) Porn star Stormy Daniel's has now added a defamation charge against Trump business partner and lawyer Michael Cohen, to her civil suit against the President, and is now seeking to depose both Cohen and the President under oath.

That, on the same day a federal judge in D.C. allowed a case filed by Maryland and the District of Columbia against Trump to move forward based on claims that the President's continued ownership of the Trump International Hotel in D.C. violates the Emoluments Clause of the U.S. Constitution, barring gifts from states and foreign nations.

Up in Wisconsin, in the meantime, the GOP received its second rebuke from a state court in less than a week, for attempting to avoid calling Special Elections for two vacant seats in the state Senate. Gov. Scott Walker was ordered a second time by the court on Tuesday to call those elections immediately. Republicans in the state legislature, however, were hoping to convene a special session in order to change the law which Walker was found to have violated, as they try to avoid calling the elections in two GOP districts they fear they may lose to Democrats. (An appeals court, later on Wednesday, has now also rejected a motion to overturn the initial ruling.)

Then, we're joined by Mother Jones' Senior Reporter ARI BERMAN to discuss the GOP's war on judges who find against them, and the Commerce Dept. Secretary Wilbur Ross' approval this week of a new, last-minute, untested question on citizenship, to be added, by request of the Dept. of Justice, to the 2020 U.S. Census.

Critics, including the last five directors of the U.S. Census Bureau among others, charge the question will unlawfully depress responses to the Constitutionally-mandated decennial survey of all U.S. residents (whether they are citizens or not), as Berman reports in his new feature article for MoJo.

The DoJ, Commerce and White House all falsely claim that the new question is "necessary for the Department of Justice to protect voters [and] comply with the Voting Rights Act". Berman, author of the recently published Give us the Ballot, the landmark book on the history of the VRA and the long struggle for voting rights in the U.S., scoffs at those claims and details what he sees as the real reasons for the change, and the decade-long effect on the nation that it will have if it is not blocked by the courts. California has already sued to block the question from being included, and more than a dozen other states and advocacy groups are expected to file complaints as well.

On the GOP's war on courts following adverse rulings against them in Wisconsin, Pennsylvania and North Carolina, Berman says: "There's a very disturbing trend going on. When Republicans don't like court rulings that constrain their power, they try to nullify those rulings...What I think is so noteworthy about this is that everyone always says how much of an outlier Donald Trump is within the Republican Party. But if you just look at what Republicans are doing, in Wisconsin or North Carolina or Pennsylvania, they're following the Trump playbook, which is if you don't like a law, just ignore it."

On the Census controversy, he tells me: "We are seeing the rigging and corruption of one of the most important, mandated tasks in our Constitution...If you decide to rig the Census, then you've essentially rigged everything that follows" for the next decade. He adds: "The bigger picture here is that a failed Census is going to hurt everybody."

On today's BradCast: The allegation made by adult film actress Stormy Daniels that someone associated with Donald Trump physically threatened her, appears to track quite well with decades of similar allegations made by those who Trump, at one point, believed to have cross him. [Audio link to today's show follows below.]

During her 60 Minutes interview with Anderson Cooper on Sunday night, adult film actress Stephanie Clifford, a.k.a. Stormy Daniels, claimed she was physically threatened in 2011 in a Las Vegas parking lot, in front of her young daughter, by someone warning her to not to speak publicly about the sexual tryst she says she had with Donald Trump back in 2006. Immediately after the interview aired, an attorney for Michael Cohen (Trump's personal lawyer, fixer, and business partner) sent a "cease and desist" letter to Daniels' attorney, demanding she retract the "false and defamatory" claims made on the program, charging that Cohen "was responsible" in some way for the alleged threat. The attorney charged that Daniels' claims accusing Cohen "of criminal conduct" were "false", "libel[ous]" and "defamatory".

The only problem: Daniels didn't actually tie Cohen to the story about the thug who, she says, threatened her in 2011!

Cohen formed the LLC created to pay $130,000 in hush money to Daniels just weeks before the 2016 Presidential election, though he says he did not do so on behalf of Trump or the Trump Organization, that he was never reimbursed for the payment (which would be a violation of federal campaign finance law, if it was meant to help Trump win the election as Paul S. Ryan of Common Cause told us in January, just after he filed his complaints with the FEC and DoJ), and that, in any event, the tryst between Trump and Daniels never happened at all.

But, whether Daniels' tied Cohen to the alleged 2001 threat or not, it's hardly the first time the Trump Organization --- and Donald Trump specifically --- has been accused of physical threats against his perceived adversaries.

We're joined today by BuzzFeed investigative journalist and renowned "FOIA terrorist" JASON LEOPOLD to discuss three different incidents, revealed via Freedom of Information Act (FOIA) request documents he obtained from the FBI and other law enforcement agencies last year, detailing physical threats said to have been made against Trump business associates in the 80s, 90s and 2000s.

The details of the three different alleged incidents are chilling, including one terrifying and profane phone threat to an attorney, made on the day Trump's Casino business declared bankruptcy, from a payphone outside the Ed Sullivan Theater on the very same day that Trump was appearing on The Late Show with David Letterman, which is shot there. As Leopold explains, the incidents which he reported on exclusively last year at BuzzFeed, came immediately to mind upon hearing Daniels recount her own frightening tale on 60 Minutes.

Then, we open up the phone lines to hear from listeners on all of the above, as well as a number of other stories that we also cover on today's program, including: Saturday's massive March for Our Lives rallies for gun safety reform, as led by the students of Parkland, Florida's Marjory Stoneman Douglas High School and supported by Pope Francis; the Trump Administration's announcement that they plan to expel 60 Russian diplomats in response to the poisoning of a former Russian intelligence agent in Britain; and the Sunday announcement that, despite reports to the contrary last week, Fox "News" wingnut attorneys Joe diGenova and his wife Victoria Toensing will not, in fact, be joining Trump's personal defense team responding the investigation of Special Counsel Robert Mueller after all (precisely as predicted by Friday's guest on The BradCast, Marcy Wheeler!)...

Election results and voting probs from the Lone Star state's first-in-the-nation primaries; Also: Chaos continues at Trump White House, Florida lawmakers enact gun safety measures following Parkland massacre...

On today's BradCast: You may not have noticed with everything else going on, but, on Tuesday, Texas held the first primaries of the crucial 2018 mid-terms elections. We have the reported results, including the largest Democratic primary turnout in the Lone Star state in decades (though the GOP turnout was still larger.) [Audio link to show follows below.]

Women and progressives appear to have performed very well on the Democratic side. Though, given the huge number of candidates in many of the Democratic U.S. House primaries, many of those contests will now go to run-offs on May 22nd. Wealthy self-funders, Trump supporters and more conservative Democrats didn't do quite as well. And a number of voters across the state were disenfranchised, as usual, and forced deal with failing electronic voting systems and polling places that were recently moved. (Even as the corporate media downplayed problems, as usual.) We dive into all the details.

Also today, the chaos continues at Donald Trump's White House and we do our best to keep up with the latest developments, including a finding by the Office of Special Counsel that senior White House counselor and former Campaign chair Kellyanne Conway violated the federal Hatch Act (and why that matters); Donald Trump may be backing off his hard-line and ill-considered, pledge to issue broad tariffs on imported steel and aluminum, following critiques from friends and foes alike and his top economic advisor Gary Cohn stepping down in response; Porn-star Stormy Daniels is suing Donald Trump over hush money paid to her before the 2016 election; And the Trump Administration is suing the state of California over immigration issues.

Finally, as we head off air today, breaking news out of the the Florida legislature, which has now adopted a number of gun safety reforms opposed by the NRA, including raising the minimum age for the purchase of semi-automatic rifles and a three-day waiting period for all gun purchases. The measure --- passed in no small part due to the persistent advocacy of the students of Marjory Stoneman Douglas High School following the massacre there last month --- now heads to the desk of the NRA's A+ rated Governor Rick Scott...

Another school shooting leaves at least 17 dead in S. Florida as corporate 'dark money' continues to undermine our nation; Also: Still more stormy weather for the White House...

Once again on today's BradCast, we must lead with breaking details of yet another mass shooting. This time, at a high school in South Florida where, by the end of today's show, authorities report that 17 had been killed, with a 19-year old former student in custody. [Audio link to show is posted below.]

The horrific tragedy at Marjory Stoneman Douglas High School in Parkland, FL led Sen. Chris Murphy (D-CT) to take to the Senate floor to note, yet again, that these this "epidemic of mass slaughter...happen nowhere else other than the United States of America", where Republican officials, controlled by the funding of the massacre-enabling National Rifle Association, refuse to take even the slightest action, year after year, massacre after massacre, to try and curb the nation's gun violence epidemic.

Murphy, who represented Newtown, Connecticut as a U.S. House member during the 2012 Sandy Hook Massacre, where 20 elementary school children and 6 adults were killed by a 20-year old with an assault weapon, notes that the South Florida shooting was the 19th school shooting since the beginning of this year, which is not even two months old.

The Republican Party is, in fact, controlled from top to bottom by big money corporate donors. And, where many Democrats are similarly enthrall to corporate donations, at least a number of the leading Presidential hopefuls are finally beginning to swear off of corporate "dark money" PAC donations. As we have argued for years --- and do so again today, in light of this latest tragedy, get money out of politics, particularly anonymous "dark money" from corporate PACs like the NRA, and most of our nation's problems, including the 'American Carnage' from our worsening gun violence epidemic, can finally be dealt with.

We cover a number of stories today that underscore that necessity. In one, House of Delegates candidate Lissa Lucas in West Virginia is physically dragged off the floor during a Public Comment period on new fracking legislation, because she dared to list the donations from the fossil fuel industry received by the Delegates who were preparing to vote on the bill.

In another, Republicans in the Arizona statehouse are moving a bill forward that would bar cities from requiring that "dark money" donations be disclosed. The state legislation comes after the City Council in Tempe voted unanimously for a ballot initiative that, if approved by local voters, would require such disclosure. Voting on that local transparency measure began on Wednesday, even as the state government moved to nullify its effect.

And, speaking of money in GOP politics, new disclosures from Donald Trump's personal attorney Michael Cohen suggest he used his own personal money to buy the silence of porn star Stormy Daniels regarding an alleged affair she had with Donald Trump. A statement from Cohen, first reported by the New York Times, seems to suggest the $130,000 paid to Daniels, just weeks before the 2016 Presidential election and days after the infamous "Access Hollywood" tape was released, came "out of his own pocket".

But a closer look at his statement reveals he may not have admitted any such thing. In the meantime, attorney Paul S. Ryan of Common Cause, who filed complaints with both the Federal Election Commission and the Dept. of Justice in January (he discussed the complaints on The BradCast at the time), stands by his belief that the payout was an unlawful, unreported, in-kind campaign donation.

After yet another exhausting and harrowing week in Donald Trump's America, as the Doomsday Clock inches closer to midnight, we try to lighten things up a bit, at least comparatively, on today's BradCast --- even if it's not always easy. [Audio link to show follows below.]

Among the many stories covered on today's program...

  • A few words about Donald Trump's reported attempt to fire Special Counsel Robert Mueller last June before chickening out, which the President describes today as "fake news";
  • Republicans are now, literally, trying to block democracy by preventing elections from happening at all. Gov. Scott Walker in Wisconsin and the GOP-controlled Alabama state legislature provide just the two latest examples;
  • Kansas' failed Governor Sam Brownback has, apparently, failed up, with an appointment by the Trump Administration, confirmed this past week by the U.S. Senate, after Vice President Mike Pence was brought in to break the tie vote in Brownback's favor;
  • Speaking of failures in the state of Kansas, their Secretary of State Kris Kobach, a long-time GOP "voter fraud" fraudster and now candidate for Governor, enjoys still more shame and ignominy this week, as it was discovered that he exposed private information, including the last four digits of social security numbers for thousands of state officials and employees --- including his own! --- on an unprotected Internet page;
  • The Guggenheim Museum declines to loan a valuable Vincent van Gogh painting to Donald and Melania Trump for use in their White House residence, but offers a solid gold alternative that seems perfect for the first family;
  • And, speaking of the first family, Trump's recently reported hatred of sharks --- revealed by adult film actress Stormy Daniels in the wake of revelations of her alleged affair with Donald Trump and $130,000 hush-money payoff just before the 2016 election --- has resulted in an outpouring of donations to shark charities across the nation and the world! See? Donald Trump can do some good in this world after all!

Guest: Paul S. Ryan of Common Cause; Also: KY school shooting, Trump supporter threatens CNN, Dems' tough decision as next shutdown nears...

Did Donald Trump or the Trump Campaign or the Trump Organization violate federal law in a hush money payoff to a porn star? On today's BradCast, we speak with the lawyer from a good-government group that has now filed complaints with the Federal Elections Commission and Dept. of Justice to that end, which he describes as "a very obvious and very clear violation of federal campaign finance law." [Audio link to full show is posted below.]

But first up today, the latest news on the latest school shooting, this time in rural Kentucky, where 12 students were shot, two of them killed, after a 15-year old student unleashed a barrage of gunfire at Marshall County High School just before classes were set to begin on Tuesday morning. It was the first fatal school shooting of 2018, though reportedly the 9th since the first of the year, and 283rd since 2013. In related news, a 19-year old apparent Trump supporter was arrested after repeatedly threatening CNN's Atlanta headquarters earlier this month on the heels of the President's continued targeting of the news network as "fake news".

Then, we discuss some of the newly reported details outlining how it is that Senate Democrats caved on Monday in their government shutdown standoff with Trump and Republicans in regard to protecting some 800,000 "Dreamers" from deportation, including evidence to strongly suggest we are quickly heading towards another shutdown and/or cave in just over two weeks time when the stop-gap spending measure passed on Monday night runs out.

Next, we're joined by PAUL S. RYAN, Vice President of Policy & Litigation at Common Cause, to discuss the two complaints filed on Monday with the FEC [PDF] and with the DoJ [PDF] regarding the payoff made via a shell company set up by Trump's attorney Michael Cohen, allegedly to buy the silence of adult film actress Stephanie Clifford (aka Stormy Daniels) just before the 2016 Presidential election. Trump is alleged to have had an affair, according to the Wall Street Journal, with Clifford/Daniels in 2006, shortly after his wife Melania had given birth to their son.

Ryan and Common Causes' complaints contend that the $130,000 payout appears to have been an unlawful, unreported in-kind donation to the Trump campaign, funded either by the Trump Organization, another person or corporation or Trump himself which, in any of those cases, would be a violation of the Federal Elections Campaign Act (FECA). The longtime campaign finance attorney explains the law in question and handicaps the odds of whether the FEC or DoJ will take action in response.

"At a minimum here," Ryan tells me, detailing who may be culpable, "we seem to be looking at a campaign finance disclosure violation --- because the Trump Campaign Committee didn't report any of this --- and, unless the money came from Trump's own pocket, then we're also talking about a contribution violation, as well."

While the question of who put up the $130k is still unknown, he argues that there is no legitimate way to argue that the payout --- given its timing, shortly after the Access Hollywood "grab 'em by the pussy" tape came out, and the multiple allegations of sexual misconduct from nearly 20 women --- was not meant to influence the election by keeping Daniels from talking to the press. "The timing, with the imminent threat by Stormy Daniels that she was going public with her story, to me, makes this clearly stand as a payment that was all about the election and keeping her quiet up to and until the election."

In related matters, Ryan also offers a few quick takes in response to some questions I had on several other recent news events from the past 24 hours or so, including whether the Trump Administration violated the law with their partisan outgoing voice message on the White House comment line during the shutdown over the weekend; whether any laws were violated by a Monday night dinner meeting on what are said to have been "important issues facing our country", between several Republican Senators, members of Trump's cabinet and U.S. Supreme Court Justice Neil Gorsuch; and whether Republicans in Pennsylvania have a leg to stand on in their promise to make a federal case out of a Monday ruling by the state Supreme Court ordering the GOP-controlled state legislature to immediately redraw the state's U.S. House district maps, in time for the 2018 primaries, after the maps were found to have been illegally gerrymandered under Pennsylvania's Constitution to discriminate against non-Republican voters.
