Today a judge found that Diebold has no right to not follow North Carolina state elections laws. If they are going to sell their systems in the state they must comply with the software escrow requirements. Diebold says they can’t meet those requirements because they use some third-party software and they cannot allow others to see that software; it’s not theirs legally. Diebold may now decide to pull out of the state. Does your state require source code escrow and is that requirement being fully enforced?…

Sounds like an effective way for other states to get rid of Diebold. Establish the same requirement and force them to leave town.
Typical corporate arrogance. Assuming rules are made for everyone else to follow.
That is good news. The prima donna Diebold needs to be overhauled or have its voting machine software thrown to the scrap heap.
The upcoming election does not look good for Diebold supported congress:
The full House is up for re-election in 2006 as are 33 Senate seats, including 15 Republicans and 19 Democrats. If six Republican seats are lost, Democrats win control. (link here).
Across the spectrum, republican candidacy is disfavored and in trouble.
Republicans are very vulnerable so Diebold may be getting desperate.
We have to watch this closely, because the only way the neoCons can win in ’06 is thru fraud.
Attorneys for Diebold argued the law would require them to submit software developed by third parties — most notably Microsoft, developer of the Windows operating system.
“If that’s what the statute requires, and the word ‘shall’ is used in the statute, how do you get around that?” Cashwell asked lawyers for Diebold.

1. Diebold greatly modifies it’s Windows CE operating system. In fact, convicted felon and embezzler, Jeffrey Dean was one person who did a great deal of modifying it.
2. Diebold has a manufacturing plant in Lexington, NC.
