On today's BradCast: Some good reporting, some bad politics, and some accountability on the horizon. [Audio link to today's show follows below.]

Among the many stories worth your while covered on today's program...

  • Democratic House Speaker Nancy Pelosi seems to take impeachment "off the table", just as she did back in 2006 during the George W. Bush regime, asserting this time that, "Impeachment is so divisive to the country that unless there's something so compelling and overwhelming and bipartisan, I don't think we should go down that path, because it divides the country. And he's just not worth it." It was a mistake during the Bush era, and its a mistake now. Perhaps not a political one --- at least as she and many Democrats may see it --- but a mistake for the nation and its long term well-being. We discuss and explain why;
  • While he may (or may not) be safe from impeachment, Donald Trump's legal troubles are getting no better. New York state's recently elected Attorney General has now reportedly subpoenaed Duetsche Bank and other financial institutions related to a number of Trump projects where, according to recent testimony by his former personal lawyer Michael Cohen, Trump exaggerated his wealth on financial statements in order to fraudulently borrow money for real estate and other projects;
  • Speaking of subpoenas, federal investigators are now said to finally be investigating Republican election fraud in North Carolina, where a GOP absentee ballot fraud scheme resulted in the nullification of last November's U.S. House election --- and a new one now scheduled --- in the state's 9th Congressional District. The State Board of Elections had requested a federal probe following apparent GOP absentee fraud in the 2016 election, but Trump's U.S. Attorney in NC appears to have ignored the request, paving the way for the same fraud scheme to be repeated during 2018 cycle. McCrae Dowless, the contractor who carried out the fraud, as hired by GOP candidate Mark Harris, has already been indicted on state charges. But Harris, so far, has escaped accountability at both the state and federal levels. His campaign has now been subpoenaed by the feds. Stay tuned;
  • The Trump Administration evacuated the last of the remaining U.S. diplomats in Venezuela on Monday night, saying their presence in the country has become a "constraint" on U.S. policy there, whatever that may ominously mean. Top Trump officials have been threatening the administration of President Nicolas Maduro for several months since opposition leader Juan Guaido declared himself to be President of the nation in turmoil. Since late last week, power outages have crippled the country, with each side blaming the other and Maduro charging the U.S. has sabotaged the power grid with cyberattacks.

    But some excellent reporting by the New York Times over the weekend reveals, yet again, that many of the claims against Maduro being made by Trump Administration and supportive Republicans in Congress like Sen. Marco Rubio, are based on completely false information. On Sunday, the Times published a video report revealing that claims by Trump officials from National Security Advisor John Bolton to Sec. of State Mike Pompeo to Vice President Mike Pence and, yes, Rubio, charging that Maduro's forces set fire to aid trucks coming from Colombia are inaccurate. In fact, as the Times' unearthed video reveals, it was protesters in support of Guaido on the Colombian side of the border who caused the fires. This is just one more reason to be skeptical about Trump's intentions in the troubled South American nation (and media reports of same) as his own political fortunes worsen at home.

    And, in case you don't find Rubio wrong enough in his false claims about the aid trucks, just wait until you hear what the dumb cluck charged over the weekend regarding an explosion at the 'German Dam' in Bolivar State!;

So, a 30-year old, landmark nuclear arms agreement between the U.S. and Russia is now history. Just like that. And, beyond a few short hours of media coverage, it now seems all but forgotten. No big deal at all. Our guest on today's BradCast, however, strongly disagrees. [Audio link to full show is posted after this summary.]

But first, a few quick items to kick off the show, including...

  • The Trump Administration vows that Tuesday night's State of the Union address will be a call for unity and bipartisan cooperation, before the Second Stupidest Man on the Internet (yes, Trump) attacks Democratic Minority Leader Chuck Schumer for not winning enough seats in last year's midterm elections;
  • And federal prosecutors in New York file a subpoena seeking a massive amount of documents from Trump's 2017 Inauguration Committee, looking at virtually every aspect of the record $107 million raised, whether any of it unlawfully came from foreign sources, whether anything was unlawfully offered in exchange for donations, whether even more more was unlawfully paid directly by donors to vendors (and thus, unlawfully undisclosed to the FEC), and where all of that money (legalized bribes, in fact, a disgrace for all modern Presidents) actually went. It all amounts to more seemingly criminal chaos from anything Trump touches, from his inaugural committee, to the Trump Organization (his main private company), to the Trump Foundation (his phony, self-dealing slush-fund and "charity"), to Trump University (his fraudulent scam that settled several cases for $25 million just before he took office), to the Trump Campaign (facing myriad criminal probes and several convictions, guilty pleas and indictments), to the Trump Administration and everyone involved in it --- all being investigated by multiple state and federal probes at this point, at the very same time.

Then, we're joined by former Deputy Assistant Sec. of State for East Asian and Pacific affairs under President Obama, MICHAEL FUCHS, now a Senior Fellow at the Center for American Progress, to discuss the Trump Administration's announced withdrawal over the weekend from the 1987 Intermediate-Range Nuclear Forces (INF) agreement struck between Ronald Reagan and Mikhail Gorbachev. The historic pact had been the first to ban an entire class of nuclear weapons, ground-launched cruise missiles with a range between 310 and 3,400 miles.

With the Administration charging that Russia was in violation of the accord (which Fuchs confirms), Trump simply announced the U.S. pull-out, which was answered almost immediately by Russian President Vladimir Putin's own declaration in response that his country would now do the same. In the bargain, Fuchs explains, the U.S. has lost its ability under the agreement to inspect hundreds of nuclear missile sites and other weapons facilities.

What did we gain in return? Well, pretty much nothing, says Fuchs, who calls this "a very big deal", joining me in astonishment that coverage of this historic move to end such an important anti-nuclear proliferation treaty has all but disappeared from the corporate media within hours amidst continuing Trump-induced chaos. "In the age of Trump, nuclear weapons, climate change, things that could potentially end life on earth as we know it only merit fifteen minutes in the news cycle," Fuchs notes.

He goes on to detail what has been lost with the dissolution of "perhaps one of the biggest agreements ever reached as far as reducing the potential threat of nuclear weapons destroying us" and whether Trump's claims that this is all necessary to stand up against a supposedly growing military menace from China is actually true. We also discuss the real reasons that this "gift to Vladimir Putin" seems to have come about, how Trump's dangerous National Security Advisor John Bolton appears to oppose any and all international accords that tie the hands of the U.S. in any way, shape or form, and whether Trump's planned second summit with North Korean leader Kim Jong Un can possibly bear any realistic denuclearization fruit --- particularly on the heels of Trump again sending the message to the world that treaties between the U.S. and other nations are meant to be broken at the whim of an angry, brain-addled, and clueless President of the United States.

"The major problem here with throwing out this treaty is that, it is equivalent to basically throwing the baby out with the bathwater," Fuchs tells me. "Right now Russia is violating this treaty in a specific way, but a lot of the benefits of the treaty are still intact. Which includes the ability of the United States to actually conduct inspections and do verification of a number of different aspects of Russia's compliance with the treaty. By taking ourselves out of treaty, we are taking away our ability to inspect the other things that the Russians are doing here. And not only does that allow Russia to potentially start violating it even more, posing more danger to the United States, but it's giving a giant gift to Vladimir Putin."

It's been a very busy news weekend (as usual these days), so we try to catch up with at least some of it, along with calls from listeners on today's BradCast. But, more importantly, we're already busy trying to save the next election from disaster, thanks to a move by folks on the right and left to make election results virtually impossible to be overseen and verified. [Audio link to today's show is posted below.]

States and counties all across the country are finally beginning to move to new "upgraded" voting systems. In many cases, however --- in both Republican and Democratic-leaning jurisdictions alike --- officials are now disastrously preparing to move to touchscreen computer Ballot Marking Devices (BMDs) which are even less verifiable, in many cases, than systems currently in use!

In Georgia, a commission impaneled by Republican Brian Kemp, champion vote suppressor as former Sec. of State and now Governor-elect, is deciding whether to move from the state's 100% unverifiable Diebold touchscreen Direct Recording Electronic (DRE) voting machines to similarly 100% unverifiable touchscreen BMDs made by ES&S before the next election. Here in Los Angeles County, the nation's largest voting jurisdiction, the Registrar-Recorder/County Clerk has already announced plans to move to such an unverifiable system before the 2020 Presidential election, while (incorrectly) claiming that it produces a "verifiable paper ballot". BMD systems do not.

Proponents argue that touchscreen BMDs, which print out a computer-marked and barcoded "paper ballot" summary card of the voters vote, produce a "verifiable" record of the cast ballot. But, as Professor RICHARD DEMILLO of Georgia Tech and Verified Voting explains today, based on his recently published study, many voters (about half) do not bother to verify their computer-printed ballot summary cards before casting them to be tallied by a separate computer scanner. Of those who do, the study finds, they only glance at them for an average of 3.9 seconds before depositing them into the scanner (and that was during an election with some 18 races on the ballot!)

"Half of them don't look at the ballots at all," DeMillo tells me. "Those that do, give it by and large a cursory reading that wouldn't allow them to check it in any meaningful way."

Moreover, DeMillo's study finds, based on observation and testing at polling places earlier this year, most voters are unable to accurately verify --- just seconds after leaving the polling place --- whether an unvoted list of the races they just voted in accurately represents the races on the ballot they just cast! DeMillo --- a longtime computer security expert who formerly served as Hewlett-Packard's chief technology officer --- argues, the only way to ensure that ballots actually reflect the will of the voter is to use HAND-MARKED paper ballots, whether they are counted by hand or optical-scan systems.

"These are all problems we've created for ourselves" with some help from the private voting system vendors, he argues. "The only reason we're having this discussion is that someone decided that having an expensive pen to mark a ballot is more important than the transparency of the election process itself. As soon as you get rid of the Ballot Marking Devices, the universe goes back to normal, mathematics works out, we can conduct auditable elections in a much more verifiable way."

When I ask this longtime computer technologist and cryptography expert the best, most verifiable way to cast ballots, he answes directly: "Hand-marked paper ballots." His answer echoes that of longtime Livermore National Lab computer scientist and voting systems expert Dr. David Jefferson, who argued the same point during my interview with him in October.

Also today: What the federal court's questionable ruling in Texas on Friday finding the Affordable Care Act (Obamacare) unconstitutional, does (and doesn't) mean for all of us in 2019. The federal HealthCare.gov exchange's open enrollment period for 2019 ended over the weekend, but several states which run their own Obamacare markets, such as CA, CT, D.C., NY, MA, MN and RI, continue open enrollment through January.

Then, a thought or two from our own Desi Doyen on the long-overdue weekend announcement of the resignation of Trump's corrupt Interior Department Secretary Ryan Zinke.

On today's BradCast: Nobody said it was going to be easy. But the fight to vote in next Tuesday's crucial midterms continues, and beyond the House and Senate, there may be some very good news for Democrats in dozens of currently GOP-controlled states. [Audio link to show follows below.]

But first up: More trouble at the polls today reported out of Texas, where voter intimidation is said to be higher than seen in decades; In Georgia, where voters are still trying to overcome suppression in absentee Vote-by-Mail voting in DeKalb County (suburbs east of Atlanta) and with failing, unverifiable voting machines at all polling places across the state; And in Illinois, where voters are also reportedly encountering failures on DuPage County's similarly unverifiable touchscreen voting systems in the Chicago suburbs.

Meanwhile, there's been a fair amount of coverage of high profile gubernatorial races with Democratic takeover chances in Florida and Georgia (where Oprah is now lending a hand), and in a number of the similarly tight U.S. Senate races that will determine partisan control of the upper chamber in Congress for the next two years. But there has been far less national coverage of several other gubernatorial contests around the country where Democrats are also in very close "Toss Up" contests to take control of dozens of executive mansions.

These races are crucial not only between now and the next Presidential Election, but could well determine control of the U.S. House over the next decade. That's right. The way voters vote on Tuesday, November 6, 2018, may well help determine who is in charge of the U.S. House beginning in 2022, once redistricting takes place around the country following the 2020 Census --- and then for another ten years thereafter!

While Dems hope to win a majority in the House next week, control of Governorships by Democrats in a number of key swing states could help add anywhere from 15 to 30 more winnable seats in the U.S. House over the next decade, according to experts.

Political reporter DYLAN SCOTT of Vox.com joins us to detail which states will be most important to that decennial reapportionment and why state Governors are so crucial to the process.

"Republicans won a lot of governor seats in 2010," he explains. "That gave them a lot of control over redistricting in 2011. And even though in 2012, 2014 and 2016, the Democrats actually won more votes for their House candidates across the country, the maps were drawn as such that Republicans were still able to hold a majority for all of the last decade. I think the stakes should be pretty clear to people after what we've seen with GOP control across the country over the last ten years," Scott argues. But are they? We discuss.

Also, Scott breaks down what appears to be a host of very good opportunities for Democrats in more than a dozen states beyond Florida and Georgia, currently controlled by GOP Governors, including Michigan, Wisconsin, Ohio, Iowa, Kansas, New Mexico, Maine, Alaska and even South Dakota! We cover a lot of ground on this today --- along with the politics and polling involved --- and much of it should be very encouraging for Democrats.

Today on The BradCast: On the 47th anniversary of the Nixon White House creating its then-confidential "enemies list" featuring, among others, many members of the media, Donald Trump's intensifying attacks on the press have now resulted in a majority of Republicans (51%) believing that the press is the "enemy of the people" rather than "an important part of democracy", according to a new Quinnipiac poll finding just 36% of self-identified GOPers agree with the latter. [Audio link to show is posted below.]

(Though I've also got a few thoughts and, perhaps, a warning on today's show regarding what to make of polling of self-identified Republicans these days. I think it's very possible our polls may now be broken, as we discuss a bit today.)

In response to the repeated and worsening attacks on the press by the President of the United States, some 350 newspapers today issued editorials in support of press freedoms. We join them in calling for support of media outlets --- particularly local newspapers and independent outlets --- who are struggling to stay alive and, yet, are needed more now than ever. (Yes, we too welcome your support for the same reason.)

That, as evidence continues to come to light underscoring the lies told to the American people by Donald Trump and the GOP while selling their tax cuts for the rich and corporations to the American people. In fact, those tax cuts won't not "pay for themselves" (the federal deficit this year will now be close to $1 trillion, thanks to plummeting revenue to the government in the wake of the cuts to the wealthy and corporations), nor have they increased wages for members of the working class (who are now making less than they did before the cuts, thanks to inflation and pay that has remained largely stagnant for workers.)

Less than three months out from the crucial 2018 midterms, Trump's tariffs and trade wars are continuing to worsen their toll on workers as well. Factories are shutting down or moving jobs to Mexico and other "off shore" locations in order to survive new added costs of tariffs on imported manufacturing supplies from China and elsewhere.

And, speaking of con jobs by this President, a new report finds his planned military parade, scheduled just days after the upcoming midterm elections, is now estimated to cost taxpayers some $92 million. That is some $80 million higher than a report on the parade's estimated cost last month, which was "only" $12 million at the time. That lower price tag is almost as much as the cost of military exercises with South Korea that Trump cancelled after his recent summit with North Korea's Kim Jong Un because, at $14 million, they were "tremendously expensive" and, he tweeted, "we save a fortune" by not holding them. (Shortly after we got off air today, new reports suggest the military parade will now be postponed until 2019...if it's ever held at all.)

Also today, before we get to today's Green News Report', a brief tribute to the life and civil rights legacy of Aretha Franklin, the beloved "Queen of Soul", who died today at the age of 76.

Then, Desi Doyen joins us for our latest GNR, in which --- among many other stories --- Interior Dept. Secretary Ryan Zinke is revealed as a liar for promising, upon taking office, that public lands would not be sold off. In fact, as reported this week, his Department has now drawn up draft plans to do exactly that.

So, if you're keeping track this week, the President of the United States has called the press "the enemy of the people" and "very disgusting", while the head of his Interior Department has called mainstream environmental groups "terrorists". But it's Democrats, we are told, who are being uncivil in their response to this Administration.

Finally, a disturbing follow-up to today's GNR for people who eat food, after last week's $289 million jury award to a man with terminal cancer, after determining that Monsanto knowingly sold toxic RoundUp weed killer despite studies finding that it causes cancer. And, in related news, recently obtained internal EPA emails reveal that its disgraced and now former chief Scott Pruitt's staff were very concerned about formaldehyde used in a desk they were considering purchasing for his newly remodeled office, even as the agency blocked the release of a public report highlighting the dangers of the very same carcinogen in public drinking water...
