First up: New polling shows Bernie Sanders surging in NH among Democrats and Gov. John Kasich --- yes, John Kasich --- surging to second place among Republicans in the state...if you believe those sorts of things. At the same time, during the GOP establishment's half-hearted search for an alternative to Cruz/Trump, the Republican Party appears to be plummeting in popularity during the course of the 2016 Primary cycle, even as actual Republican voters seem to be warming up to the idea of Trump as their party's nominee.
Then, a remarkable new study from Oxfam finds that the world's richest "62 people own the same wealth as half the world" (the planet's 3.5 billion poorest!) And, some of those 62 richest-people-on-the-planet --- like the Koch Brothers and the Walmart heirs --- are amongst the biggest spenders when it comes to attempts to buy our political system.
So, what can be done about that last part? Jon Schwarz, Senior Editor at The Intercept, joins me to discuss how, despite "eloquent" comments suggesting otherwise during his State of the Union address last week, President Obama could take executive action immediately, on his own, to help radically reduce the "dark money" in our electoral and political system.
"One thing that Obama absolutely can do, by himself, this afternoon, if he wants to, is sign an executive order placing requirements on federal contractors," Schwarz explains, describing other similar actions that the President has taken in the recent past concerning federal contracting. "He can do it and he's done it in the past. What he could do about money in politics now is issue an executive order saying that federal contractors have to disclose any dark money contributions that they're making."
"If he did that, that would cover about 70 percent of the biggest corporations," Schwarz tells me. "So, it would not force the disclosure of any and all dark money, but it would force disclosure of a great deal of that. And, as I say, he could do that this afternoon."
We discuss some of the reasons Obama has failed to do this, to date, despite his calls for campaign finance reform throughout his career and as recently as last week's SOTU --- even with so many calls from so many quarters to take this action. "Obama likes to say really great-sounding stuff about money in politics --- he's said it his whole Senate career, his whole Presidency --- but he's never done anything. It's really extraordinary."

It was a 'Rocky Mountain Mess' to many, but we try to make sense of CNBC's GOP Presidential Debate in Boulder, CO last night on today's BradCast anyway!
"Digby" has joined us for all of our post-debate coverage so far this year and offers smart insight yet again today. Tomasic shares his on-the-ground perspective after covering the goings on inside and outside of the Coors Event Center before, during and after yesterday's debate(s).
Was anything learned from either the 'Kiddie Table' or 'Main' debates? Is Jeb finally done for? Did Kasich's gambit work? Did Trump accidentally make sense again? Does Jindal have a magic wand he doesn't know about? Is Social Security really a scam?

On today's BradCast...the Republican Party may appear to be falling apart on one level --- because it is (and we cover quite a bit of their various disasters in advance of tonight's Republican Presidential debate in Boulder, CO today) --- but on another level, the GOP still controls not just both chambers of the U.S. Congress, but also the vast majority of statehouses and Governor's mansions across the country.
So, while the Democrats' Presidential prospects may be encouraging for them, are they actually in denial about their real problems? And/or is there another way out of their current morass?
Ian Millhiser, journalist, Constitutional law expert and author of the new book, Injustices: The Supreme Court's History of Comforting the Comfortable and Afflicting the Afflicted, joins us to discuss what may be the Democrats' best way out of the mess: The U.S. Supreme Court and as many as four vacancies that may occur on the bench during the next Presidency. "The Future Of The Democratic Party," he wrote recently, "Will Be Decided By The Supreme Court."
"A big reason why Democrats are so far underwater when it comes to state legislative races, when it comes to House races, is because of the Supreme Court," Millhiser tells me on today's show. "The Supreme Court has ordered the lower federal courts not to even look at partisan gerrymandering cases. They're not allowed to even consider them under existing Supreme Court doctrine."
Millhiser goes on to explain how the Court's recent rulings on voting rights have also made things far more difficult for Democrats. SCOTUS, he argues, "isn't enforcing the Constitution and at other times its mangling the Constitution."
"The situation Democrats find themselves in is due to a number of problems layered on top of each other, many of which are at the fault of the Supreme Court. Many of these problems could be solved if we had a Supreme Court that was prepared to give us fairer elections," he notes. With as many as four --- four --- seats potentially becoming vacant on the Court during the next Presidency, the party that controls the White House as of 2017 will have an enormous opportunity to affect what happens in this country for generations.
While both major parties often use the potential for Supreme Court vacancies to underscore the importance of controlling the White House, Millhiser explains the reasons --- and there are many --- why the 2016 election really is different from recent elections where that argument has been offered. "If the Supreme Court gets even more conservative," he warns, "then you're looking at an apocalypse for the Democratic Party."

First up, Kansas Sec. of State Kris Kobach (R) continues his years-long phony "voter fraud" crusade, but now he's been given more authority to cause even more damage to the fundamental right to vote! After years of blatantly lying about "voter fraud" in the state (which we document in detail), he has now been given prosecutorial authority by the state's Republican Governor to personally clean up his pretend scourge in Kansas.
His first act? Setting up a webpage to allow the public to report instances of fraud on the SoS website (since he's been unable to find any on his own during his five years in office since being elected to "Stop Voter Fraud!"). But, conveniently, he's left off the option for the public to report on Kansas' much more pressing problem: voter suppression --- especially by guys like Kobach, who, since taking office, has successfully blocked tens of thousands of legal Kansas voters from being able to vote in state elections.
Then, former FBI Special Agent, 9/11 whistleblower and TIME Magazine's 2002 Person of the Year, Coleen Rowley joins us to explain why Dylann Roof, the alleged Charleston, SC shooter and avowed racist, was charged with hate crimes this week, but not terrorism. What's the difference between terrorism and hate crimes? And does the SC shooting now prove (once again) that the term "terrorism" has become little more than meaningless propaganda?
The term "terrorism", Rowley tells me, is now "uniquely set for Muslims, or for Arab nations that we have had agendas with in the past. The media is primed for that message."
"The definitions have a propaganda value, but they are not clear, and they're not good for purposes of law enforcement at all because they're not even making sense. In fact, I think that's all they are serving now --- as propaganda," she explains, before citing one of her favorite quotes: "A poor man's war is terrorism. A rich man's terrorism is war."

On this week's BradCast on KPFK/Pacifica Radio (and many other fine affiliate stations), we talk to physicist, former Clinton Administration official and founding editor of ClimateProgress.org Joe Romm about Republican Sen. Mitch McConnell's "immoral" attempt to undermine the U.S. in international climate talk negotiations as the big U.N. treaty summit is set for Paris later this year.
Romm, who served as Chief Science Adviser for last year's Emmy-award winning Years of Living Dangerously series on Showtime, also breaks a bit of news on The BradCast by confirming that there will be a season two for the groundbreaking environmental documentary series. He promises that "it will be on a cable network that has a far greater reach" than Showtime, though he can't let us know which one yet.
PLUS: Rand Paul jumps into the 2016 GOP Presidential circus; Ohio's Republican Gov. John Kasich does the right thing (sort of) in vetoing a new GOP voter-suppression scheme in the state; Jeb Bush appears to have committed a felony in Florida; California's Democratic Lt. Gov. Gavin Newsom does the right thing before everybody else (again) in announcing support for full legalization of marijuana in the Golden State; and much more, including Desi Doyen with the latest Green News Report.
A provision added to Ohio's new transportation bill by Republican lawmakers would have made it more difficult --- and expensive --- for out-of-state students to vote in the Buckeye State. The scheme would have required anybody who registers to vote there to obtain an Ohio driver's license and register their car in the state (at a cost of at least $75) within 30 days, or risk losing their right to drive.
That provision, voting rights advocates warned, was likely to deter out-of-state students at Ohio colleges and universities from registering to vote there, despite a long-held U.S. Supreme Court determination that students may register to vote where they attend school.
The good news on this issue is that while Ohio's Republican Gov. John Kasich signed the transportation bill last week, he used a line-item veto to remove the offending provision. But more than a bit of potential confusion --- and the ability to deter student voters from exercising their right --- still looms...
