Senate Democrats have the option to fight back against Trump's nominee to the GOP's stolen U.S. Supreme Court, or they can become collaborators and enablers of the Republican theft and be voted out of office in response. In 2016, Senate Republicans stole the U.S. Supreme Court by refusing to hold a hearing, much less a vote, on Barack Obama's centrist (arguably, too centrist) nominee Judge Merrick Garland following the death of Justice Antonin Scalia. Now that Donald Trump has announced his own nomination for the stolen seat, Judge Neil Gorsuch, history --- and democracy --- demands that Democrats filibuster any nominee other than Garland, even if it leads (as it will) to the "nuclear option" in which Senate Republicans do away the filibuster rule, as Trump has now called for.

We explain why all of this matters on today's show, detailing the GOP's extraordinarily dishonest and hypocritical action and rhetoric on this point from Republican Majority Leader Sen. Mitch McConnell, Sen. Orrin Hatch, Sen. John McCain and others.

Most importantly, we call for listeners to demand their U.S. Senators prevent the Court from being further stolen during Trump's Chaos Presidency. We strongly support Oregon Senator Jeff Merkley's call for exactly this, hope you do too, and hope you'll let your Senators know you will work and donate and vote against them if they fail to protect the Court.

On today's BradCast, the fallout and chaos continues following Donald Trump's reckless Executive Order banning travel from seven majority-Muslim countries and his firing of the Acting U.S. Attorney General who refused to enforce it, after announcing that she was unconvinced the order was lawful. [Audio link to show is posted below.]

But first today, the shooter alleged to have killed six and wounded 19 others at a mosque in Quebec City over the weekend is reported to be a white nationalist (and Trump supporter). Therefore, as with deadly climate change, Trump, Republicans and the corporate media can largely ignore the entire matter...as they largely have. That's particular disturbing in light of new reporting on the FBI's awareness of white supremacists and sympathizers inside the ranks of the nation's law enforcement agencies.

Then, when Sally Yates, the Acting U.S. AG was fired shortly after announcing her act of conscience on Monday night, Trump's White House described it as an act of "betrayal" to the Department. (She is sworn to defend and protect the U.S. Constitution, not the DoJ or the White House). Shortly thereafter, the White House also removed another top official at the Immigration and Customs Enforcement (ICE) agency, but without explanation. Yates' act was one that she, herself, might have predicted during her 2015 Senate Confirmation hearings, and largely did, while being questioned by Sen. Jeff Sessions (R-AL) who now happens to be Trump's nominee for U.S. Attorney General. We play some of the remarkable exchange between Sessions and Yates on today's show, which suggests that a) Sessions should come out in support of Yates (he won't) and b) Democrats should not vote on Sessions' nomination until he answers the very same questions he put to Yates in 2015, seeking to find out if she would, correctly, defy an unlawful, unconstitutional order from a President.

The entire mess is being referred to as the "Monday Night Massacre" by some, for its obvious echoes of Richard Nixon's infamous "Saturday Night Massacre" in 1973 at the height of the Watergate Scandal. Nixon's White House Counsel John Dean, for example, predicts today that "The way the Trump Presidency is beginning, it is safe to say it will end in calamity."

Calamity is already underway across much of the nation and at a number of other federal agencies reporting turmoil and despair following the wildly unpopular President's Friday order. But Democrats appear to be finding at least a partial spine and are now boycotting a Senate committee in order to hold up votes on Trump's nominees to head up the Treasury Department (Steven Mnuchin) and Health and Human Services (Rep. Tom Price), due to alleged financial improprieties and dishonest answers given to Congress about them by both men.

In the meantime, Speaker Paul Ryan and the House GOP remain 100% all-in with Trump, as are most Senate Republicans. So, unless Democrats can figure out how to hold the line (and the public can figure out how to force Dems to do so), the nation's near and long-term future remains perilous, as Donald Trump plans announces his nomination tonight to replace Antonin Scalia on the GOP's stolen U.S. Supreme Court...

On today's BradCast, Donald Trump called this morning for "a major investigation" into what he falsely claims to be 3 to 5 million illegal votes cast in the November 2016 election, "including those registered in two states". But Trump probably should have checked with his own top appointees before pointing fingers. [Audio link to show posted below.]

Of course, many Republicans will be all too happy to "investigate" Trump's "bogus" claims and use them, no matter what little fraud is revealed, in order to institute voting restrictions that have nothing to do with fraud, but may well keep those who tend to vote Democratic from being able to vote at all.

As discussed today, we've been covering these issues for more than a decade here at The BRAD BLOG and on The BradCast for a reason. Donald Trump is just one of them. We look at his repeatedly debunked claims, the discredited studies cited in support of them by his Press Secretary and the nascent effort by some Democratic members of Congress to push back.

Never mind his inauguration crowd size or his claims to be "a very big person when it comes to the environment", or even his false claims about "voter fraud". On today's BradCast, while it may be hard to imagine, and the corporate media may have yet to fully notice, Donald Trump's actions speak much louder than his obnoxious words and virtually non-stop stream of public lies. Don't be distracted by what Donald Trump says. Pay attention to what he does. To that end, while folks were debating his "alternative facts" on the crowd size at his inauguration, the new Administration was busy shutting down the Twitter accounts and ability for federal employees to communicate with the press and public at the Department of Interior, the National Park Service, the EPA and other federal agencies.

While claiming to be a champion for the environment this morning, he then signed an Executive Action to move forward with approval of the dirty and dangerous KeystoneXL and Dakota Access Pipelines by the afternoon.

While the new President continued to pretend that millions of illegal votes were cast in the 2016 election (even the New York Times called it a "Lie" in their headline!), he and his supporters fought successfully to stop the post-election "recounts" in all three states where evidence of such illegal votes --- if it actually existed (it doesn't) --- might have been revealed.

While the Administration claimed last week that their work wouldn't begin until Monday, their new Dept. of Justice leadership was taking action on Inauguration Day to undermine a long-standing lawsuit against Texas' unlawful Photo ID voting restrictions. Yes, Republican Trumpers understand the importance of voting laws and procedures --- even when it's not an election year. Do Democrats and progressives?

Julie Ebenstein, staff attorney at the ACLU Voting Rights Project, joins us to explain what exactly the Trump DoJ did on Friday in the Texas case and what it may signify for that case and others like it, what it all may mean for the future of the currently-gutted Voting Rights Act, and how the ACLU and other private plaintiffs plan to continue the fight for voting rights with or without the Trump Administration's DoJ on their side.

"There's certainly concern that DoJ will shift and no longer take the same positions that it's taken in the Texas and North Carolina cases --- and a lot of concern for future cases, for future protection of people's voting rights," Ebenstein tells me. "If the Department of Justice does not provide and enforce the same robust protections of the Voting Rights act, it's diluting the already scarce resources that are out there to challenge these laws." But, she vows, "we'll continue to do the work we've always done. There are certainly cases where private organizations like the ACLU will go forward without any Department of Justice involvement. We're going to keep doing what we do, no matter what we see coming."

On today's BradCast, a few of Donald Trump's nominees for top cabinet slots may be facing trouble, as Senate hearings continue this week in the U.S. Senate, preparations are finalized (and changed) for the Inauguration, and President Obama issues last minute pardons and commutations. [Audio link to full show is posted below.]

First today, as we go to air, breaking news on Obama's merciful commutation of the unprecedented 35-year prison sentence for U.S. Army whistleblower Chelsea Manning and a number of additional last-minute pardons and commutations.

Then, as Senate confirmation hearings resume today for Donald Trump's nominees, including for Education Secretary nominee Betsy DeVos and Interior Dept. Secretary nominee Rep. Ryan Zinke (R-MT), we look at concerns about both of them. Billionaire DeVos, for example, has given, quite literally, millions of dollars in donations to Republicans and GOP causes over the years, including tens of thousands to the GOP Senators set to vote on her nomination in the Health, Education, Labor and Pensions Committee today. And, in the Energy and Natural Resources Committee, Sen. Bernie Sanders pressed Zinke on whether or not he believes, like Trump, that climate change is "a hoax".

Then, we're joined by financial journalist and award-winning author David Dayen, to discuss several Trump nominees whose confirmations could now be in jeopardy, including the President-elect's picks to head up Health and Human Services (Rep. Tom Price), Labor (billionaire Andrew Puzder), Treasury (billionaire Steve Mnuchin) and Commerce (billionaire Wilbur Ross). We also discuss Dayen's recent big scoop at The Intercept on a memo detailing "widespread misconduct" (including fraud) at Mnuchin's mortgage bank OneWest and CA's then Democratic Attorney General, now U.S. Senator Kamala Harris' failure to further investigate or prosecute, despite recommendations from her own staff to do so.

Whether or not some of those nominations fall apart, Dayen notes a "supreme irony" in the both the election of Trump and the nominations of guys like Mnuchin and Ross, both profiteers of the "Great Foreclosure Machine".

"There was never any accountability for that. The Obama Administration famously kind of walked off the field in terms of prosecuting bankers and financial institution executives who instigated [the 2007 financial crisis]," argues Dayen. "And then who gets placed into power in the aftermath is the same people whose reputations have been rehabilitated effectively, who weren't given any sanctions for the actions that they took. And, in addition, the fact that there was no accountability created this sort of broken social fabric that helped lead to the rise of populist figures like Donald Trump in the first place."

"There are a lot of ways you can look at this," he tells me. "But there's no question that that failure to get the accountability that the American people wanted in the wake of the financial crisis played a role in the actions that occurred on Election Day 2016, and now those same people who profited off that neglect will be in charge."

Finally, as public pressure builds against some of those nominations, pressure has also led to a number of changes in plans for this week's Inauguration...

On today's BradCast, resignation and evidence of corruption continue to dog the wildly unpopular incoming Trump Administration just days before his Inauguration; And is Comcast/NBCUniversal doing the bidding of the Mormon Church in Utah? [Audio link to show follows below.]

As we barrel towards what is certain to be an incredibly bizarre (to say the least) Inauguration Day for the historically unpopular Donald Trump, the Obama Administration has reportedly transferred out another 10 Gitmo detainees to Oman. In the meantime, a senior Trump White House appointee (and former Fox "News" contributor) has already resigned after revelations of massive plagiarism, as new questions about financial improprieties continue to mount for a number of Trump cabinet nominees and for the Trump Campaign itself.

Then, we are joined by former GOP Presidential candidate and gay rights activist Fred Karger, to discuss his latest campaign against the Mormon Church, which he believes should lose their tax exempt status revoked by the IRS due to participation in a number of anti-gay political campaigns and other corruption. Karger is charging that Comcast/NBCUniversal has blocked the airing of his new TV ad for MormonTips.com, after the media behemoth had previously agreed to run the 30 second spots in the state of Utah.

"I know how the Mormon Church operates," Karger explains, describing his claim that the Church is behind Comcast nixing the spots. "They are all powerful, particularly in the state of Utah. It's a virtual theocracy. They exercise a tremendous amount of power."

"They don't like me," he notes. "I'm the guy that discovered their vast involvement in California's Prop 8 in 2008 to take away gay marriage. I got them investigated and prosecuted by [California's] ethics office because they only admitted to spending $2,078 on the campaign. Turns out it was hundreds of thousands of dollars they ended up reporting. Much more likely millions. So I've learned they are very dishonest, and they've have done things very secretively." He argues that they've used their muscle to convince Comcast (which, he says, "controls something like 90% of the [cable television] market in Utah") to kill the ads. "So they're using censorship to quash our free speech and I'm going to be fighting back against them."

Finally today: Is the Trump Administration planning to shut down the White House Press Room after taking office? Esquire reported over the weekend that the matter is under serious consideration and, in response, Trump's top officials are not denying it...though they do appear to be lying about their reasons for it...

On today's BradCast, the GOP "dogs" having finally caught up with the "reality" bus on ObamaCare and Iran and more. So, what will they do now? Also, free speech icon Larry Flynt joins us to blame the U.S. media for Donald Trump and much more. [Audio link to show follows below.]

First today, the DoJ Inspector General announces he will investigate the FBI and its Director James Comey concerning their controversial actions regarding Hillary Clinton's private email server in the run-up to last year's election and whether they ran afoul of long-established Justice Department guidelines.

Then, the head of the Office of Government Ethics blasts Donald Trump for failing to divest his business holdings. And, in the U.S. Senate, Trump's unprecedented conflicts of interest came into play during Sen. Elizabeth Warren (D-MA)'s questioning of super-genius Dr. Ben Carson, Trump's nominee (for some reason) to be Secretary of Housing and Urban Development.

Meanwhile, Trump's Secretary of Defense nominee, Gen. James Mattis, began his confirmation hearings today in the Senate, where he said he intends to honor the anti-nuclear agreement with Iran that the GOP pretends to hate. At the same time, Republicans in both the House and Senate are finally beginning to face reality on that and on the fact that their years of pretending the Affordable Care Act ("ObamaCare") was a disaster may now be a huge problem for them, as they have no actual plan to "repeal and replace" the program.

Finally, we're joined by Larry Flynt, longtime First Amendment champion and publisher of Hustler Magazine, to discuss his recent ad [PDF] in Variety which slammed the U.S. media, blamed them for the rise and Presidency of Trump, and called on them to "wake up!"

He tells me that while he's seen a lot during his decades of battles with Republicans like Ronald Reagan and George W. Bush, but "it's never been as bad as with Trump. Every time this guy opens his mouth, he tells a lie. I mean, that should not be tolerated by any member of the press."

Flynt also discusses what his $1 million bounty for incriminating video tape on Trump has uncovered so far, and why it's so difficult to actually damage him at this point. We also discuss, among other things, Hustler's consistent years of covering news in the magazine, in addition to porn, even when other media outlets have pulled their punches at various times when Republicans were in power. On today's BradCast, U.S. Senate confirmation hearings for Donald Trump's top Administration nominees are officially underway. They began today with Day 1 of hearings for controversial U.S. Attorney General nominee Sen. Jefferson Beauregard Sessions of Alabama. [Audio link to show posted below.]

In the days leading up to today's Sessions session, Democrats have blasted Senate Republican Majority Leader Mitch McConnell for reversing course on demands he had made for Obama nominees back in 2009, requiring that all background checks and vetting by the Office of Government Ethics be completed before hearings begin. Also, before today's hearing commenced, members of the Congressional Black Caucus requested time to give testimony on Sessions' extremely controversial civil rights record. Senate Judiciary Committee Chair Chuck Grassley (R-IA), however, while agreeing to allow the member testimony, broke with Senate tradition by only allowing it only after all of the other witness testimony has completed.

Nonetheless, hooks were baited and traps were set for what could lead to trouble for Sessions on several of these key issues in the days (and years) ahead, if his nomination is confirmed as expected...

On today's BradCast, Donald Trump's nominee for Secretary of State, ExxonMobil CEO Rex Tillerson, has filed papers to "divest" from the oil giant. But a closer look at his filings suggests he may not actually have cut all ties and interests in the profits of the only company he has ever worked for until now. [Audio link to show is posted below.]

First today, apparently it's still not "terrorism" when a non-ISIS American carries out a mass shooting, as was the case last Friday at the Fort Lauderdale International Airport. The alleged shooter, a veteran of the Iraq War and former National Guardsman, killed five and wounded six others, even as Republican Florida lawmakers press for more guns in airports and elsewhere.

Then, as many as eight of Trump nominee's are all set to come before U.S. Senate committees this week for confirmation hearings, pretty much all at the same time, and even before the U.S. Office of Government Ethics has even completed the background checks for many of them for the first time since the OGE was created. That, despite unprecedented corporate conflicts of interests for virtually all of the cabinet-level and top advisory positions being filled --- not to mention the first press conference in six months scheduled by Trump at the same time, along with the Majority Leader Mitch McConnell's plan plan to hold a budget "vote-a-rama" concurrently with all of the above.

One of the nominees set for truncated confirmation hearings this week is Exxon's Tillerson, who last week filed papers with the U.S. Security and Exchange Commission (SEC) explaining how he plans to divest from some $180 million in Exxon stock. While Tillerson's attorneys describe the scheme as a way to sever ties with the oil giant, Public Citizen's David Arkush finds a discrepancy in the legal filings that suggest Tillerson may still have reason for allegiance to Exxon, rather than the well-being of U.S foreign policy.

"In the agreement between Exxon and the trustee [set to keep Tillerson's holdings while he serves as Sec. of State]," Arkush finds wording "that would leave him with a clear incentive to still favor Exxon as Secretary of State."

"He has viewed the entire world through the lens of what's good for Exxon," Arkush explains after detailing the concerns with the SEC declarations. "A lot of people look at that record and are critical of the fact that he has no government experience and, technically, I guess, in a certain sense, no foreign policy experience. I don't think that's the issue. I think the issue is he does have experience...He has spent 41 years working at a single company that has a single motive, which is to make money by finding oil around the world, digging it up, and burning it." He goes on to optimistically warn: "We are headed toward utter disaster."
