UPDATE FROM BRAD: Thanks for getting this up quickly, David! Was a quick piece tonight (made it back from a frantic trip back from San Diego just two minutes after my appointed time), but I'm pleased to be in the good company of Avi Rubin and Rep. Rush Holt in the Lou Dobbs report. I'm told they'll be using more of me tomorrow. We'll see. Ironically, I live about 3 blocks from the CNN building in Los Angeles and they've never called me in before...until I was several hours away in San Diego. No rest for the weary.

...But about to rush back to Los Angeles to get to the CNN building for an interview with the Lou Dobbs folks. If I can get there in time!

I should be on tonight's Lou Dobbs Tonight tonight at 6pm ET (3pm PT) and perhaps tomorrow night's show as well. Or so I'm told.

Had hoped to catch up a bit here about the Busby/Bilbray events last night and Tuesday, but it looks like that's going to have to wait again in order for me to race back up north to get to the interview on time...yeesh...

Will also be on Mike Malloy's national Air America program tonight as Guest Hosted by Laura Flanders. We were last on air with Laura when she came down to Crawford, TX to simulcast with us on The BRAD SHOW from Camp Casey last summer.

Apologies to those of you waiting for email responses and other interesting blog items here. Looks like I'll have to be off the grid again for a bunch of hours in a row...So Open Thread here as ya like!

CNN Notices That Wireless Personal Digital Assistants Could Wreak Havoc on Voting Machines...

Just in from tonight's Busby/Bilbray Democracy Shindig in Oceanside. A great event with a lively turnout (including our old buddy Jim Lampley in da house.) As promised after last night's LA event, more as soon as I can catch my breath.

Until then, here's last night's Lou Dobbs, which I think was terrific. Be sure to watch it (or read it, transcript below the fold) until the end. Lou is gettin' angrier by the day...

I posted the results of the "Quick Poll" this morning before leaving Los Angeles. In case you missed it, the question was "Do you believe that e-voting machines should be disallowed until their integrity can be assured?" The results... YES: 97%, NO 3%.

Could America finally be coming to its senses?

Too exhausted to comment on this tonight with much detail, so please be my guest and "be the blog" for us here in comments. I will point out, however, that it's nice to see folks finally discussing the threat of Palm Pilots and other PDA's (personal digital assistants, as opposed to Progressive Democrats of America) and their wireless capacity posing a threat to these stupid systems as well. Kitty Pilgrim broaches the topic in this report from Tuesday which covered the release that day of the new NYU Brennan Center report on E-Voting security. We orginally discussed the alarming possibility of a voter with a PDA when we ran an exposé on the wireless Infrared (IrDA) port we photographed on one of the older paperless Diebold touch-screen systems.

Must hit the road shortly to take the Democracy Train down to San Diego for tonight's Emergency Townhall on the Busby/Bilbray election results fiasco. If you're anywhere near San Diego or Oceanside please come out tonight! We had a great time last night in Los Angeles!

More on all of these as soon as I can catch my breath. The fine lower-cased blogger, skippy the bush kangaroo, was amongst those in attendance last night (as was Joseph Cannon of Cannonfire) and so I'll defer for the moment to skippy's coverage (since I don't have time for any of my own right). Skippy got a coupla small points slighly wrong, but I suspect he'll update since I let him know. As BRAD BLOG readers realize, unlike with AP and NY Times accuracy counts for bloggers.

Lou Dobbs report last night on the Brennan Center's year-in-the-making report on 120 threats to E-Voting Security was fan-damn-tastic. When I can catch my breath, I hope to get it, along with the video, posted in full. And more thoughts on that Brennan Center report. But for now, by way of teaser, Dobbs started it this way: "More evidence tonight that an increasing number of elections in this country can be outright stolen. And no one would ever know. It's incredible."

Last, but most certainly not least, Washington Post covered the Brennan Center report themselves this morning. They highlighted the very message we've been trying to convey to Francine Busby, the voters in San Diego and across the nation over the last three weeks. The WaPo article begins this way...

A Single Person Could Swing an Election

To determine what it would take to hack a U.S. election, a team of cybersecurity experts turned to a fictional battleground state called Pennasota and a fictional gubernatorial race between Tom Jefferson and Johnny Adams. It's the year 2007, and the state uses electronic voting machines.

Jefferson was forecast to win the race by about 80,000 votes, or 2.3 percent of the vote. Adams's conspirators thought, "How easily can we manipulate the election results?"

The experts thought about all the ways to do it. And they concluded in a report issued yesterday that it would take only one person, with a sophisticated technical knowledge and timely access to the software that runs the voting machines, to change the outcome...

E-Voting 'Poses a Real Danger to Integrity of National, State and Local Elections' According to Study (No, Really?!)

A long awaited study of electronic voting machine security by computer scientists and security experts has been released this morning by the Brennan Center of Justice at the NYU School of Law.

Given preparations for tonight and tomorrow's "Emergency Townhall" events on the Busby/Bilbray mess (I'll be emceeing and "keynoting"), I've yet to be able to read the long report any more than cursorily, so I'm forced to defer for now to USA Today's coverage of it from this morning...

Analysis finds e-voting machines vulnerable

WASHINGTON — Most of the electronic voting machines widely adopted since the disputed 2000 presidential election "pose a real danger to the integrity of national, state and local elections," a report out Tuesday concludes.

There are more than 120 security threats to the three most commonly purchased electronic voting systems, the study by the Brennan Center for Justice says. For what it calls the most comprehensive review of its kind, the New York City-based non-partisan think tank convened a task force of election officials, computer scientists and security experts to study e-voting vulnerabilities.
...
Among the findings:

• Using corrupt software to switch votes from one candidate to another is the easiest way to attack all three systems. A would-be hacker would have to overcome many hurdles to do this, the report says, but none "is insurmountable."

• The most vulnerable voting machines use wireless components open to attack by "virtually any member of the public with some knowledge and a personal digital assistant." Only New York, Minnesota and California ban wireless components.

• Even electronic systems that use voter-verified paper records are subject to attack unless they are regularly audited.

• Most states have not implemented election procedures or countermeasures to detect software attacks.

Why the Busby/Bilbray Election Matters (or Should) to the Entire Nation...
(HINT: It's not about Busby or Bilbray or San Diego or even California!)

My reporting here, and the concerns expressed about the Busby/Bilbray election results as announced, have little or nothing to do with Francine Busby or Brian Bilbray or even, in particular, the June 6th U.S. House special run-off election in California's 50th congressional district.

It has only a tiny bit more to do with San Diego. And only slightly more than that to do with California.

It has everything, however, to do with democracy. Across the entire country. As opposed to any one race in any one area.

If I've not been clear on that until now, please allow me to set the record straight.

The concerns I've reported --- and will continue to report --- over the blatant disregard for the rule of law and clear illegalities endorsed and encouraged by the SD County Registrar of Voters, Mikel Haas, and apparently approved at this point by California's Secretary of State Bruce McPherson, have everything to do with the future viability of democracy in this country in general, and a perhaps naive hope that there's a chance in hell that taking action now will help to salvage a shred of legitimacy for this November's election.

That can only happen if action is taken now, however, directly in regard to the Busby/Bilbray election results as announced.

As far as I can see it, what happens in regard to Busby/Bilbray will be America's last, best, and only hope of affecting any real election reform prior to the November 7th general election. That's why, for me, this has become "Line in the Sand" time.

Never, in the two-and-a-half year history of The BRAD BLOG have I set aside almost everything else in order to cover and raise attention to a single story --- to the exclusion of almost every other story --- for such a long period of time as I have done since the original coverage of this matter the day after the June 6th election.

Since then, I've stated many times in both written and spoken words that I don't actually give a damn who won the Busby/Bilbray race and that I didn't even much bother to follow any of it prior to Election Day. I've got no dog in the hunt and only care that the person who actually received the most votes is the one that was declared the winner. At this point, there is absolutely no way of knowing who actually won.

The fact of the matter is that just two or three months after both the federal certification oversight body (NASED) and California's own Secretary of State issued emergency "security mitigation requirements" in light of newly discovered and massive vulnerabilities in Diebold's voting systems, those security requirements were entirely tossed out the window when all of the machines were sent home with poll workers for overnights in the days and weeks prior to the election. In doing so, the machines themselves were effectively rendered illegal and uncertified for use in any California election, and at the federal level as well.

Unless something is done, the same thing is about to happen in elections across this entire country.

(NOTE: Lou Dobbs will be covering this issue on CNN tonight I am told. Including interviews with some of the poll worker sources we gave them after originally reported on them here at BRAD BLOG.)

I'd have hoped that more media, candidates, individuals and even Election Reform organizations would have come to understand the national significance of what all the sturm and drang here has actually been about. If they haven't, that's likely my failing. So I'll try again to make both myself and the stakes here crystal clear...

What happens here and now --- in regard to this race and its results as announced --- will send a signal to elections administrators across the country. The signal will be one of two...

LA County's System, for example, Was Apparently Approved for Use at the Fed Level by a Former Waitress/Bartender!

There is, for good reason, much concern and a lack of confidence in the process for federal qualification/certification of voting systems. Independent Test Authorities (ITA), who test the systems against federal standards, are not really 'independent' because they are paid to do testing by the vendors who also provide the test parameters. They look where they are told to look and go no further than that.

The next step in the process is review of the ITA test and the voting system by a panel of 'experts' called the Voting Systems Board Technical Committee. This committee is under the auspices of the National Association of State Elections Directors (NASED). One might think that this part of the process would be free and clear of any reason for concern. One would be wrong...

Lou Dobbs has now done at least eight reports over the last two weeks on the grave danger to American democracy as posed by Electronic Voting. We've had a tough time keeping up with them all.

We've yet to hear anybody so far refer to Dobbs as a "Lefty" or a "Moonbat" or a "Conspiracy Theorist" or a "Sore Loser" or suggest that he wears a "tinfoil hat". Just a coincidence, we guess.

Here's two of his reports that we've only gotten to post finally today. One is on un-recountable paperless elections and the other focuses on Democrat Cathy Cox (Georgia's SoS and Diebold champion) and her extreme conflict of interest in running her own unverifiable election now that she's the Gubernatorial nominee. Will Dobbs be running a similar report on Ohio's J. Kenneth Blackwell's similar conflict of interest? We'll hope so.

Please note: It seems Diebold is no longer returning Lou's calls for comments. Go figure.

Rightwing Roger Hedgecock (occasional fill-in for Rush Limbaugh!) in 'Complete Agreement' About Concerns over Diebold Voting Machines Used in the Special Election!

Wow...Given what I know about San Diego's KOGO radio host, Roger Hedgecock --- a frequent fill-in for Rush Limbaugh, by the way --- I would have predicted a firefight between us concerning my arguments questioning the validity of the Busby/Bilbray U.S. House special election in California's 50th congressional district on June 6th.

You know, the one were the highly-hackable Diebold voting machines were sent home with poll workers for days prior to the election in defiance of both state and federal rules and laws, rendering them illegal and uncertified for use in the election.

Well, slap my bottom and call me Spanky!...Guess what? I just got off the air with him, and Hedgecock and I were in complete agreement! He may even turn up at next week's "Emergency Townhall" meeting on this which is currently being organized (details soon).

The full afternoon drive-time appearance, about 15 minutes, is linked below if you'd like to listen. But to give you a flavor, here's how it ended...

Visit Brad Friedman at BradBlog.com...and, again, a very liberal leftwing guy, but I think he's on to something in this case. In fact I know he is. And that is, that we now have allowed a system of counting our votes to be presented to us as a system that does it accurately, when it has manifestly been proven that it can be monkeyed with...and the results tampered!

It seems to me if we have any bedrock notion in this country it ought to be that the votes ought to be fully and fairly counted.

I just think that's...wow...if we can't agree on that one, this country's farther down the division road then I think we are.

Were it not for other fairly unforgivable transgressions in the past in other areas politically, I might have otherwise given Roger the too-rarely bestowed BRAD BLOG "Intellectually Honest Conservative Award." If he decides, however, to show up and bring along a few thousand folks with him for next week's "Emergency Townhall" event in San Diego (details soon) --- as I've invited him to do --- I might even consider a "provisional" awarding of the highly coveted prize!

Law Guarantees VVPAT, Hand Audits, and Durable Paper Ballots
New Law Now Only Requires Governor's Signature

Late last night the Arizona Legislature took the steps necessary to pass legislation that will guarantee the voters in the state have more transparency and auditability in their elections. The bill passed the House of Representatives 51-0 then immediately went to the Senate who passed it 25-3.

I received an email that originated from Arizona state Representative Ted Downing last night that says:

Dear Fellow Patriots,

SB1557 passed the House of Representatives with a 51-0 vote! Then, it immediately passed the Senate 25 to 3! It is now on its way to our Good Governor’s desk. As planned, it includes the Paton Amendment that I helped draft (see Star description below). Karen Osborn, the Maricopa County Elections Director calls this one of the most significant election reform bills in decades.
This election reform bill is the result of three years of working with the Pima County Democratic Party and the great work of Dr. Tom Ryan, Bill Risner, Esq., our current and former Pima County Democratic Party Chairs, and many, many more dedicated individuals. I want to specially thank each and every one of you for your dedication, your hard work, and your support in working for election integrity.

Now focus on the Governor to make certain that she signs it right away. I am confident she will. It will become law upon her signature, since it contains an emergency provision. We still must await Department of Justice approval which should be expedited because of the emergency provision. At that point, hand counts will no longer be illegal and we will have a first-level audit of the election system. This is, however, just the beginning.

Politics is a team effort. As hard as it may be for many to accept, the East-Mesa Republican Senator Karen Johnson merits thank you emails, (kjohnson@azleg.gov), as does Karen Osborne, kosborne@risc.maricopa.gov (602) 506-7960, and yes, Brad Nelson, brad.nelson@pima.gov (520) 631-3939. Even Rep. Russell Pearce (rpearce@azleg.gov) should be thanked, yes, that’s right and I know its hard, but he fought to assure that our elections are fair. We will continue to disagree on almost every other issue, but he wants a fair count.

I hope each PC will take the time next year to come up to visit the Legislature and witness your legislature at work. Those of you who have tell me that it is not what they imagined.

You are true patriots for protecting our system of government just as those brave men and women did at the founding of this great nation. Thank you and bless you.

Busby/Bilbray 'Emergency Townhalls' and Some RFK Jr. E-Voting Litigation to Come...

As readers have likely noticed, the Busby/Bilbray issue has sucked me into its vortex (or vice versa?) for the moment. Necessarily. I'll hope BRAD BLOG readers with interests in other non-Busby/Bilbray items will understand, forgive and realize that it's just me here for the most part at this time, though David Edwards and John Gideon are able to jump in with other items as their time allows.

Further, I believe the Busby/Bilbray issue merits the attention currently being given to it, both on the blog and behind the scenes, since it has ramifications for every election in this country come November (after which it will be too late to do anything about what needs to be done now concerning the security of unsecure electronic voting machines).

With that then, two small points for now about which I'll have more details in the days ahead..."Emergency Townhall Meetings" are now being organized to deal with these issues both in Los Angeles and San Diego. In LA, there will be such an event with myself, and several other speakers (details soon) on Tuesday the 27th at 8pm @ the Venice United Methodist Church. In SD on Wednesday the 28th, there will be another event, specific time/location to come shortly. A press conference may be held in conjuction in San Diego next week as well. As mentioned, details forthcoming on all of the above. If you're anywhere in the area, I hope you will turn out. It matters.

Also, yes, as some have asked, I can confirm the item now posted at RAW STORY wherein Bobby Kennedy is quoted as saying in an interview: "I would say that very soon we'll be announcing lawsuits against some of the individuals and companies involved."

Such litigation is, in fact, in the works and has been for some time. Beyond that, it would be imprudent of me to give any further details at this time for a number of reasons. But you've now got still more to look forward to.

Beyond that, feel free to use this as an Open Thread to discuss any or all of the above...or anything else about which I haven't had time to do any reporting over this past week....

EDITOR'S NOTE: Jeeni Criscenzo is now the Democratic nominee running against incumbent Republican Rep. Darryl Issa for the U.S. House seat in California's 49th congressional district. In her guest blog below, she speaks about some of the horrendous outrages and other disastrous election administration she witnessed in San Diego County's Election on June 6th. She was a primary candidate that day, the same day as the now-questionable Busby/Bilbray race which was run on easily-hacked Diebold voting machines sent home overnight with poll workers prior to the election. Those "sleepovers" are in direct contravention of both state and federal laws and regulations implimented specifically in regard to Diebold voting systems. Thus, ignoring those rules and laws rendering them illegal for use in that election.

Criscenzo's district is split across both San Diego County and Riverside County (who also have their own share of problems with their County Registrar of Voters), so her election was run on the same presumed-corrupted machines as those used in the Busby/Bilbray race.

I spoke with her at some length last night, and I'm happy to see that, unlike so many Democratic candidates --- including Busby --- she is now more than willing to stand up and raise hell about these very clear outrages. While I have several concerns about her short-term suggested solution of using Absentee Ballots to fight back against the rise of the machines, her perspective is a unique one which deserves to be heard. She makes many points about which I wholeheartedly agree. I'll let you (and her) discuss any concerns in comments here.

No matter the nuanced quibbles, I'd urge you to support candidates like Criscenzo who are willing to speak out loudly and clearly about what the hell is going on here as we all work to find possible solutions to the ongoing and rapid crumbling of our current electoral system. Want Voting Integrity - Just Mail It!

There has been a lot of talk since the California elections last week about the integrity of the vote count, particularly in the run-off election in the 50th District between Francine Busby and Brian Bilbray. It's not surprising that Busby's supporters are dubious of the results: polls showed Busby ahead by 3 to 7 points in the days before the election. An apparent Bilbray win is explained away as the result of a last minute blunder by Busby. If you plan to fix an election where the candidate you want to win is behind in the polls, you need to create a reason for the sudden change on election day, and there it was - Voila! - a last minute slip-of-the-tongue blasted throughout the country by the lock-step right-wing media.

As a candidate who won by a landslide (I was unopposed for the Democratic nomination for Congress, CA District 49), I'm in the fortunate position of being able to look into the election process in San Diego without being called a sore loser.

I made some troubling discoveries on Election Day when I visited 37 precincts in Oceanside as a roving poll monitor (or as Carol Hilton, my friend and monitoring partner, dubbed us --- "Poll Cats"). So last Friday, I visited the Registrar of Voters office to ask questions and to see for myself how the count was being handled....

Was it Stolen? 'Only Answer is Yes,' says Schakowsky who Claims DCCC to Announce Steps Soon to Avoid 'Repeat Performance'
EXCLUSIVE: Complete Text of Prepared Remarks from today's 'Take Back America' Conference...

I just got off the phone with Congresswoman Jan Schakowsky (D-IL) who reportedly wowed 'em a few hours ago during her speech (posted in full below) on the closing afternoon of the "Take Back America" conference being held in Washington D.C.

In her remarks, Schakowsky apologized for "not taking seriously enough the allegations that the 2004 election was stolen." She now feels it was, and claims that the Democratic Congressional Campaign Committee (DCCC) will be launching an initiative. From today's speech:

I apologize for not taking seriously enough the allegations that the 2004 election was stolen. After reading Bobby Kennedy's article in Rolling Stone, "Was the 2004 Election Stolen?", I am convinced that the only answer is yes. He documents how 357,000 Ohio voters, the vast majority Democrats, "were prevented from casting ballots or did not have their votes counted...more than enough to shift the results." Watch for the DCCC to take some very public steps in the near future to ward off a repeat performance. In the meantime, there needs to be a citizens' effort starting now to assess the machines, the ballots, the registration process within each and every election jurisdiction in each and every swing district and state, in the case of Senate races. Where the situation looks perilous, go to the media, raise a stink, demand changes. This is a great project for the many of you who have been diligently working to guarantee fair and accurate elections.

Raise a stink? Can do. So can you! Sign Velvet Revolution's petition declaring "No Confidence" in the Busby/Bilbray race!
