On today's BradCast on KPFK/Pacifica Radio, we had a tremendous report from on the ground in West, TX, by RT America producer and reporter Ramon Galindo. He's been there since last Wednesday, having arrived on the scene just hours after the huge explosion at the West Fertilizer Company plant.

To date, 15 have been killed by the blast, including 12 first responders, with nearly 200 others injured. The explosion covered some 37 blocks and left a crater nearly 100 feet wide and 10 feet deep at the plant itself. Galindo offers the latest on how the tiny town of 2,600 is holding up, how they are dealing with concerns about governmental oversight of the plant (or lack thereof), and the continuing investigation into the mystery of what may have caused the disaster.

In an attempt to shed some light on the several other huge news events which received far less coverage than they would have otherwise, during last week's News Week from Hell, I also covered the new bi-partisan report on torture by the Bush Admin after 9/11 and the latest in the investigation of the attempted ricin attack on President Obama, Sen. Roger Wicker (R-MS) and a judge in Lee County, Mississippi.

Announcement follows Nevada state Senate approval of resolution to repeal longtime Constitutional marriage equality ban...

It was quite a moving show last night in the Nevada State Senate, as a Joint Resolution was passed that would repeal the Constitutional ban on marriage equality in that state, as passed by voters over a decade ago.

All of the state Senate's Democrats supported the resolution, and one Republican jumped onto the right side of history in a surprise last-minute move. One Democratic Senator even came out as gay during the floor proceedings.

The measure passed the Nevada Senate 12 to 9 and will now head to the Assembly. If successful there, it will face one more vote in both chambers in 2015 before appearing on the 2016 ballot for approval by voters who, according to recent polls there, are now believed to be in favor of lifting the ban. So, as MLK famously said, "The arc of the moral universe is long, but it bends toward justice."

Dramatic speeches on the floor during debate on the resolution led even jaded long-time Nevada report Jon Ralston, who covered the debate live via his Twitter feed, to observe: "Too often we who cover politics think of these people as automatons pressing a red or green button. Not tonight. Raw, emotional, human."

"Great to be not just a witness to history (or the beginning, at least), but to see politicians stripped down to who they are was something," he noted, before adding: "I feel sorry for reporters who weren't here to feel the electricity in this chamber."

But with Democrats across the country now seemingly falling over themselves to suddenly support marriage equality --- redefining the word "evolution" (or, perhaps, more accurately, attempting to redefine the word "flip-flop") --- even Republicans, at least Republicans in the Northeast, are also now showing signs of scrambling to get onto the right side of history as well.

Among the many items which would have otherwise been top stories --- some even meriting wall-to-wall cable news channel coverage --- during last week's Worst News Week Ever™, was the release of a landmark bi-partisan report on the use of torture by the U.S. following 9/11.

The Constitution Project's "Task Force on Detainee Treatment" is described as "an independent, bipartisan, blue-ribbon panel charged with examining the federal government’s policies and actions related to the capture, detention and treatment of suspected terrorists during the Clinton, Bush and Obama administrations."

It is headed up by former Congressmen Asa Hutchinson (R) and James R. Jones (D). Hutchinson also served as a top official in the George W. Bush Administration.

"In many respects," the introduction to the report explains, "this Task Force report is the examination of the treatment of suspected terrorists that official Washington has been reluctant to conduct."

As the New York Times' Scott Shane detailed in his barely noticed coverage last Tuesday (the day after the Boston Marathon bombing and the day before the deadly explosion at the West, TX fertilizer plant)...

A nonpartisan, independent review of interrogation and detention programs in the years after the Sept. 11, 2001, terrorist attacks concludes that "it is indisputable that the United States engaged in the practice of torture" and that the nation's highest officials bore ultimate responsibility for it.

The sweeping, 577-page report says that while brutality has occurred in every American war, there never before had been "the kind of considered and detailed discussions that occurred after 9/11 directly involving a president and his top advisers on the wisdom, propriety and legality of inflicting pain and torment on some detainees in our custody."

The use of torture, the report concludes, has "no justification" and "damaged the standing of our nation, reduced our capacity to convey moral censure when necessary and potentially increased the danger to U.S. military personnel taken captive." The task force found "no firm or persuasive evidence" that these interrogation methods produced valuable information that could not have been obtained by other means.

Mr. Hutchinson, who served in the Bush administration as chief of the Drug Enforcement Administration and under secretary of the Department of Homeland Security, said he "took convincing" on the torture issue. But after the panel's nearly two years of research, he said he had no doubts about what the United States did.

"This has not been an easy inquiry for me, because I know many of the players," Mr. Hutchinson said in an interview.

"I had not recognized the depths of torture in some cases," Mr. Jones said. "We lost our compass."

While the Constitution Project report covers mainly the Bush years, it is critical of some Obama administration policies, especially what it calls excessive secrecy. It says that keeping the details of rendition and torture from the public "cannot continue to be justified on the basis of national security" and urges the administration to stop citing state secrets to block lawsuits by former detainees.

We will reserve the option of returning to this matter in the near future in more detail. But, as we're still recovering, as you may be as well, from a horrible news hangover following last week's Week From Hell (during which Andy Daly tweeted accurately: "When an Elvis impersonator trying to kill the President is the least interesting news story of the week, you know some shit went down") we are going to go easy on this matter for the moment, and defer instead to the The Daily Show's coverage of this disturbing report...just to help take the edge off things for now. Steven F. Hayward and the 3rd anniversary of an historic failure...

Today is the three year anniversary of BP's Deepwater Horizon oil spill and manslaughter disaster. 11 men were killed and more than 200 million gallons of crude spilled into the Gulf in what would turn out to be the largest accidental oil spill in world history.

A remark on last week's Real Time with Bill Maher drew my attention back to the woeful "advocacy journalism" (I'm being kind there) of those on the Right who continue, even to this day, to perform public relations work for the fossil fuel industry under the guise of "journalism".

Maher cited an embarrassing quote from an article by Steven F. Hayward, published by the unapologetically-wrong-on-just-about-everything Weekly Standard (the "brain"-child of its also-unapologetically-wrong-on-just-about-everything editors William Kristol and Fred Barnes) which, for non-RW loon reporters, might have been a career-ender. Or, at least, for non-RW loon reporters, it might have led to the humblest of apologies and acknowledgment for having been so tragically wrong. No such apologies or contrition occur in RW Media "Expert" Land, unfortunately, where there is no inaccuracy too wrong and no prognostication so off base that it might cause shame or humility or, gasp, an invitation from its publishers to never write there again.

Just days before the explosion of BP's rig and the death of those workers (BP recently pleaded guilty to 11 counts of manslaughter, after which nobody from BP went to jail, naturally), Hayward wrote: "Few areas of national policy offer as bad a ratio of blather to substance as energy. It is a field where cliché, wishful thinking, and wince-inducing ignorance dominate the discourse."

"No matter how patiently or repeatedly the myths and realities of energy are explained," Hayward condescended, "we are nowhere near being able to replace God's gift of dirty, toxic fossil fuels with clean, renewable energy. "Liberals," he noted, "are the worst offenders," when it comes to this naive, misinformed wishful thinking.

Hayward, the sage and much-smarter-than-you Fellow from the American Enterprise Institute, went on to write in his article, published on April 16, 2010 [emphasis added]...

The two main reasons oil and other fossil fuels became environmentally incorrect in the 1970s—air pollution and risk of oil spills—are largely obsolete. Improvements in drilling technology have greatly reduced the risk of the kind of offshore spill that occurred off Santa Barbara in 1969. ... To fear oil spills from offshore rigs today is analogous to fearing air travel now because of prop plane crashes in the 1950s.

Just four days later, on April 20, 2010, the Deepwater Horizon exploded in the Gulf.

That's not all he was wrong about, of course. The same article article also offered the wisdom --- just two years prior to the hottest year in recorded history in the contiguous U.S. and the ninth hottest year on record globally --- that "the case for catastrophic global warming" was "in free fall"...

Likely-unconstitutional bills follow similar (failed) efforts in ME, IN...

Nearly a quarter century has passed since the U.S. Supreme Court, in Symm vs. United States, ruled that college students had a right to treat their dorms as their residence for voting purposes. It's a fact which Republicans seem to find very inconvenient --- especially given the fact that, in 2008, the youth vote, heaviest in precincts where college campuses are located, favored Barack Obama over John McCain by a two-to-one ratio. The numbers were similar against Mitt Romney in 2012.

Thus, in 2011, despite the fact that his investigation failed to establish a single instance of voter fraud by any student, Maine's Republican Secretary of State Charlie E. Summers sent an intimidating letter to lawfully registered student voters seeking to convince them to "cancel" their voter registration where they go to school.

"Back in February," of this year, writes Laura Conaway at Maddow Blog, "an Indiana Republican proposed revoking the right for students to register at their colleges. After college Democrats and Republicans in Indiana joined in pushing back, the sponsor promised to amend her bill so that it would be constitutional, by which she meant dropping the idea."

Not to be outdone, this month three North Carolina Republican State Senators have introduced the appropriately numbered S666, which would strip the right of the parents of students from claiming a personal state tax exemption, which ranges from $2,000 - $2,500, if the student lawfully uses their dorm as their residence for voting purposes.

A related bill, S667, deceptively titled the "Equalize Voter Rights" act, would also strip tax exemptions for parents whose student children fail to register their car at the same place they register to vote. According to WRAL, "That also could cut down on college student registration, since many students maintain their vehicle registration in their home counties."

As the state's Democratic House Minority leader notes, both bills "would raise taxes on middle-class families who are trying to put their children through college." But, apparently Republicans are now in favor of tax increases, at least in NC, as long at it might help curb the increase in the youth vote seen over the last several elections.

But what may be most troubling of all, is that it seems the esteemed GOP state Senators in NC must be entirely unaware of the provisions of the 24th Amendment which, long ago, outlawed all poll taxes.

So...funny thing. After yesterday's BradCast on KPFK, I drove the delightful Desi Doyen (of our Green News Report) out to The Young Turks' studio where she was scheduled to guest host once again last night. Two minutes or so before airtime, the third guest-host had yet to arrive. Guess who was drafted into last-minute duty?

Unshaven, jacket-free and prep-less, the show went on. With Desi, myself, and the great Jimmy Dore on board, it was an all-KPFK/Pacifica Radio episode of TYT, to boot!

On Wednesday's BradCast on KPFK/Pacifica Radio, I interviewed Brendan Cummings, senior counsel at the Center for Biological Diversity. He's fresh off his win in federal court where a U.S. Magistrate Judge found earlier this week that the Obama Administration violated federal law by not taking the effects of fracking into account in its environmental assessment before leasing areas of the Monterey Shale Formation in California to oil companies.

We discussed the case and its first-of-its-kind ruling, the impact it may (hopefully) have on similar fracking land leases elsewhere in the state and nation, and what the hell supposedly "liberal" Democrats like Barack Obama and CA Gov. Jerry Brown must be thinking.

I also covered this week's election fraud felony guilty pleas by a staffer for Newt Gingrich's 2012 Presidential campaign, the pending felony charges against a co-defendant and additional arrests that prosecutors say may be coming soon. All a part of Gingrich's failed attempt to qualify for the 2012 GOP Presidential primary in Virginia, and his unbelievable hypocrisy in downplaying fraud in his own campaign that was far worse than anything ACORN ever did (or, actually, didn't do.)

Finally, we had an extended Green News Report segment with Desi Doyen, to discuss, among other things, Rep. Joe Barton's amazing comments today, and the new attempt by Fox "News" to raise George Orwell from the grave by describing environmentalists as "climate deniers"...

This seems to me to be a potentially larger issue --- with broader national implications --- than it's currently being regarded as in the bulk of the corporate media.

I'm prepping to interview Brendan Cummings, the lead litigator in this case, later today on my KPFK/Pacifica Radio show. [That interview is now here...] Cummings argued the case on behalf of the Center for Biological Diversity which sued the Obama Administration along with the Sierra Club.

So, for now, here's how the matter is being reported this week by Virginia Hennessey of the Monterey County Herald [emphasis added]...

MONTEREY --- Nearly 20,000 acres of prime Central Coast farm and ranch land may be protected at least temporarily from oil and gas "fracking" due to a federal judge's "watershed" ruling.

Environmentalists and local representatives cheered the decision by U.S. Magistrate Judge Paul Grewal, who said federal land managers violated a key environmental law when they auctioned off the rights to drill for oil and gas on public lands in Monterey County, home to one of the largest deposits of shale oil in the nation.

Grewal faulted the Bureau of Land Management for not reviewing the potential impacts caused by fracking before accepting bids for the drilling rights, in accordance with the National Environmental Policy Act.

The judge did not say whether the leases themselves would be invalidated, but said he would decide their fate after the parties meet and send him a proposal next week.

"This important decision recognizes that fracking poses new, unique risks to California's air, water, and wildlife that government agencies can't ignore," said Brendan Cummings, senior counsel at the Center for Biological Diversity, who argued the case for the plaintiffs. "This is a watershed moment --- the first court opinion to find a federal lease sale invalid for failing to address the monumental dangers of fracking."

Environmentalists worry the technique can contaminate groundwater and pollute the air, as well as trigger seismic activity in the state's most earthquake prone area.

The affected leases sold in September 2011 include scenic stretches of southern Monterey County, where cattle ranchers and wine grape growers rely on tight water supplies to irrigate their pasturelands and vineyards. The area is also part of the historic range of the endangered California condor, whose global population was recently estimated at less than 400 birds.

The lawsuit alleged the bureau relied on inadequate 2006 studies to assess the environmental risks associated with increased oil and gas development. BLM maintained the leases would not necessarily involve fracking and new reviews were not necessary until requests were filed to drill on the leased property.

Rachel Maddow details how world's most profitable company pays almost nothing for continuing violations of federal law...

It's just the cost of doing business for the world's most profitable corporation. And that "cost" is barely a blip (that may be an overstatement) on their daily profit sheet.

As Rachel Maddow noted on Friday in the short report below, ExxonMobil is the nation's largest and most profitable corporation. It is larger than Walmart, Google, McDonald's, American Express and Goldman Sachs...combined.

And yet, the penalties they pay for violating federal safety laws leading to oil spills is almost nothing at all. For example, when Exxon was caught failing to inspect a portion of the Pegasus Pipeline --- the one fill with sticky, gooey, tar sands crude that we don't know how to clean up...the pipeline that ruptured last week in a suburban neighborhood in Mayflower, AR --- they were fined a grand total of $26,000.

That's a $26,000 fine out of the $122 million dollars in profit that Exxon makes in per day.

"There is nothing that Exxon fears from the federal government," Maddow notes. "They have so captured the parts of the government that are supposed to punish them when this sort of thing happens, that the pain that that sort of punishment could cause them, redounds to them, essentially, not at all."

Yes, it pays for companies like Exxon to violate the law with impunity, so it will be left to the people of Arkansas, as Maddow explains, to make the company pay any kind of real price for their crime...if they can...

Co-defendant facing 42 counts; 'Additional arrests' may be coming...

In January of 2012, just as the GOP Primary election cycle for President was getting under way, The BRAD BLOG reported exclusively that the office of the Virginia Attorney General had opened a criminal election fraud investigation into the failed effort by the campaign of Newt Gingrich to appear on the primary ballot in the Commonwealth.

Now, a woman hired by the campaign has "pleaded guilty to felony counts of fraud and perjury," according to a report just out tonight from Charlottesville's NBC affiliate WVIR.

31-year old Jennifer Derrebery reportedly worked for Gingrich's election contractor Stillwater LLC and, according to prosecutors, turned in campaign petitions with some 400 signatures in the failed attempt to collect the 10,000 needed for Gingrich's name to appear on the primary ballot last year. According to WVIR, nearly all of the signatures submitted by Derrebery were fake.

Prosecutors say she turned over stacks of signed and notarized forms to the Virginia Board of Elections containing roughly 400 signatures - nearly all of them fraudulent.

"We don't know what was going on, and we are pursuing charges for the people who did something wrong here in Augusta, on Mr. Gingrich's primary election," said Rupen Shah, assistant commonwealth's attorney.

Shah says there were similar problems in other parts of Virginia, where GOP candidates needed 10,000 valid petitioners to get on the ballot. Gingrich submitted more than that, but a quarter of the names could not be verified.

The report also notes that the "investigation is still active, and may result in additional arrests" and that Derrebery is cooperating with prosecutors and state police. WVIR says the "judge suspended all of her prison time". That is likely in exchange for her cooperation on the case. Her co-defendant, Adam Dustin Ward, faces a total of 42 criminal counts and will face a judge in June.

In late December of 2011, after Gingrich had failed to turn in enough valid signatures to qualify for the Virginia primary ballot, he was caught on video tape telling a supporter in Iowa that the reason for the failure was due to a campaign worker who created 1,500 fraudulent signatures.

"We turned in 11,100 --- we needed 10,000 --- 1,500 of them were by one guy who, frankly, committed fraud," Gingrich is seen and heard saying in video originally aired by CNN.

Clearly, the effort was by more than just "one guy," as Gingrich asserted at the time.

The former Speaker of the U.S. House of Representatives downplayed the incident, by explaining to the woman that the entire affair was "just a mistake," after they had "hired somebody who turned in false signatures."

In late January, an official at the Virginia State Board of Elections (SBE) described to described to The BRAD BLOG what had happened as "definitely an illegal act." He told us that the matter had been referred by the SBE to the office of VA's Attorney General Ken Cuccinelli (R). The Director of Communications for the office, Brian J. Gottstein, then confirmed to us that an investigation was "underway," though he could not disclose the details at that time...

What happens if we start with known public corruption cases and work backwards to the intersection with elections?

What you will find is kickbacks and bid-rigging schemes; at least two of these, in New Orleans and in Pennsylvania, connect back to Ciber, the Independent Testing Authority (ITA) that supposedly tested and then signed off on most of the U.S. voting machines currently in use in all fifty states, on behalf of the federal government.

You will learn of a now-admittedly corrupt government technology official who benefited from rigged bids, (courtesy of Ciber) who had placed, as one of his first priorities, setting up his very own Internet Voting system.

And when you look into money-laundering, the mechanism providing the juice for corruption, you'll find out about a strikingly odious situation: a New York City Democrat who bribed New York City Republicans to help him run for Mayor (as a Republican). The case has recently made news as at least 5 high-ranking elected and party officials were rounded up this week as part of a sweeping FBI sting in the Empire State.

"Trust" will never suffice when it comes to conducting elections. There can never be a place where counting votes in secret, or governmental snooping on how we voted, or hidden money behind campaigns, or hiding records on elections, can be accepted by the public, yet that is happening right now. In all fifty states.

Vendors who do business with the government do participate in bid-rigging and kickback schemes, and both politicians and government employees sometimes deprive the public of honest services, as we find in the New Orleans case involving Ciber, the company which signed off on almost every electronic voting system in use across the country today.

Political corruption spreads like cancer. It creates a neural system of one politician beholden to another. The public always needs to retain its right to know, to examine documents, and to see what's going on. Otherwise, who's gonna notice? Who's gonna tell?

Before we go skipping down the road trusting any politician to know what's best for us regarding our own right to see and authenticate elections...

Before we agree to some pie-in-the-sky idea that secret vote counting processes are safe because some company tested them...

Before we accept the idea that some legislators can pass a law telling us we have to cede over our right to know...

We need to understand that when it comes to elections, trust is childlike. It's wishful thinking. It's immature.

It's not how the world works, and we owe it to our children to remember that.
