Today on The BradCast, we continue our focus on next Tuesday's critical midterm elections by picking things up, somewhat, from our conversation on yesterday's program. [Audio link to full show is posted below.]

We were joined yesterday by longtime election and voting system expert Eddie Perez to discuss, among other things, what he has been writing about as the "manufactured chaos" that Republicans are creating to wreak havoc in the 2022 elections.

Today, we dive into broader details of that organized, manufactured chaos program that is emerging as a national strategy by the GOP to create enough havoc around the country to allow them a patina of "evidence" with which to challenge results of election outcomes they don't like.

A number of seemingly disparate efforts are actually now emerging as of a piece with a national strategy that you (and the Democrats and the media) need to know about before it all comes crashing down at once amid chaotic smoke and mirrors on Election Day and thereafter.

This is clearly an effort that echoes the less coordinated post-election chaos of 2020. Many of the same players are involved, including corrupt Trump attorneys John Eastman and Cleta Mitchell, as well as his convicted former aide Steve Bannon, the laughable billionaire pillow guy Mike Lindell, not to mention those in the far-right political media set to help execute the strategy as if it is legitimate, from Tucker Carlson on down.

The hope, as Josh Kovensky outlines at TPM today, is to sow the seeds of enough chaos to be able to create court cases and "thousands of sworn affidavits" (sound familiar?) to "credibly" point to (false) claims of "fraud" in virtually any election around the country next week, if and when they don't win it. "The chaos is the point," he writes.

We pull many of these threads together on today's program. One example is the seemingly isolated case of the campaign manager for Maryland's white nationalist Republican candidate for Attorney General who directed supporters at a rally last weekend to vote next Tuesday "as late in the day as possible," explaining that, "If everyone could stand in long, long lines at 6 o’clock, that would actually help us."

Then there are the door-to-door canvassers --- organized in part by folks like Eastman, Bannon, Lindell, Mitchell and others --- who, according to a Reuters report today, have been active in at least 23 states. They are dressing as if they are government officials --- sometimes armed and with badges --- intimidating voters with questions about who lives in their house, what their voting record is, etc. They appear to be collecting information to use to challenge voters on Election Day at the polls and/or in the post-election period, as required to create enough chaos to offer the appearance of fraud and/or uncertainty in the legitimacy of election results. And, yes, Fox "News" and the rest will be standing by to report all of these false accusations as if they are real.

Forewarned is forearmed, as they say. It's important that you --- not to mention the Democratic Party and everyone at legitimate media outlets --- understand what is going on before the fog of chaotic election war overwhelms all of us beginning next Tuesday.

In a not unrelated story today, we noted yesterday that AP has found more than 100 election lawsuits have already been brought this year related to the 2022 elections. Most have been filed by Republicans in efforts to make voting more difficult. We detailed several of those cases yesterday (in Pennsylvania, Arizona and Nevada). Today we discuss one filed in Illinois that seeks to invalidate lawful absentee ballots that are cast on or before Election Day but do not arrive until afterward, in the two week period allowed by state law. A Republican Congressman is suing to block the counting of those votes, even though they are lawfully cast ballots that could include tens of thousands cast by members of the U.S. military stationed overseas. The complaint was originally filed in May of this year. But the Trump-appointed federal judge overseeing the case has yet to rule on it, for some reason, with Election Day less than a week away. Chaos in waiting.

  • A judge has appointed an independent monitor to oversee Trump Organization finances in the civil fraud suit filed by NY A.G. Letitia James against Trump, his company and his three oldest kids.
  • The NY criminal tax fraud case against the Trump Organization is now under way.
  • Top Trump aide Kash Patel has been granted immunity to testify against him before a federal grand jury probing the documents Trump stole upon leaving the White House.
  • Trump settled the lawsuit against him for ordering his security goons to beat up protesters in front of Trump Tower in 2015, as jury selection was underway in the case.

We've been discussing for weeks (months, actually) on The BradCast how critical the November 8 midterm elections are to American democracy itself. I've even referred to it as the most critical midterms since the Civil War. Until recently, however, I had no idea how on the money that comparison actually is. [Audio link to full show follows this summary.]

In five states this year --- from so-called "red" states like Alabama, Louisiana and Tennessee to the theoretically liberal bastions of Oregon and Vermont --- slavery itself will be on the ballot. Seriously. Or, at least "involuntary servitude". What's the difference between that and slavery? Even our guest today, an expert on such issues, has trouble discerning that.

The U.S. Constitution's 13th Amendment, adopted in 1865 to end slavery, reads [emphasis added]: "Neither slavery nor involuntary servitude, except as punishment for a crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."

In other words, slavery was abolished --- except for prisoners, who may be forced into involuntary servitude as part of their punishment. It's a not-accidental loophole, you'll be shocked to learn, that has been disproportionately exercised historically against Black Americans.

In 2020, however, several Democratic members of Congress introduced a resolution to begin amending that part of the 13th Amendment. But changing the U.S. Constitution is a heavy lift that requires passage by two-thirds of each chamber of Congress and approval by three-fourths of the states. In the meantime, there are the exact same or very similar references to involuntary servitude --- or even slavery itself --- still present in a number of state Constitutions and/or statutes. And, this year, there are ballot initiatives in the five states mentioned above to finally change or remove those references entirely.

So, yeah. Ending slavery, at least in some state constitutions, at least for prisoners, is actually on this year's ballot as well.

We're joined today for insight by THEEDA MURPHY, Co-Director of the No Exceptions Prison Collective, a non-profit, grassroots initiative based in Nashville, TN, dedicated to, among other things, aboloshing slavery!

"Any type of forced labor is slavery. Period. And should not exist in the United States in 2022," Murphy explains, stating what one would think should be obvious. Surprisingly, it isn't. There are elected officials --- both Democratic and Republican --- who have offered various reasons to oppose such initiatives to rewrite the 13th Amendment and the state-based provisions which echo it. Most of their reasons have to do with assuring that cheap prison labor can continue, a $500 billion industry where the average pay is $1/hour. (Though that is, somehow, not considered slavery!)

Over the past two elections, in 2018 and 2020, three states, Colorado, Nebraska and Utah, adopted measures to ban involuntary servitude. A recent effort here in California failed to make it onto the ballot this year. But the hope of advocates like Murphy is that, with reform at the state level, interest may grow in a federal Constitutional amendment that finally ends what is known as the "Punishment Clause" or the "Exception Clause'. But there are other reasons to adopt such measures as well.

States where similar changes have been made, explains Murphy, "are beginning to have these discussions about what does it mean to now have people that cannot be treated like property, that the state no longer owns, and what that means for every aspect of a person who is incarcerated. Can you deny them healthcare? What kind of food do you feed them? Do you charge them for their clothes? Those are the kinds of questions that begin to be answered, or to be asked, because people are no longer property."

Murphy says that in her home-state of Tennessee, internal polling shows both Democrats and Republicans are "united" on the ballot measure this year. "Nobody is FOR slavery," she quips. "Nobody at least will come out and SAY they're for it."

Hey! Maybe we found at least one issue that doesn't divide Americans? We'll find out after next Tuesday.

In other noteworthy news today...

  • After nearly four years of House Democrats attempting to exercise the federal law that mandates the IRS "shall furnish" the tax returns of any taxpayer to the heads of several Congressional committees upon request, Donald Trump is running out of legal (and illegal) options to block the Democratic-controlled House Ways and Means Committee from reviewing his tax documents. But, after the federal appeals court in D.C. unanimously said last week that the IRS must turn them over, Trump filed an emergency appeal to his stolen, packed and corrupted Supreme Court. Today, Chief Justice John Roberts placed a temporary administrative hold on the lower court's order, buying Trump at least 10 days while the House responds to the disgraced former President's motion. But now, every day counts, with the possibility of Democrats losing their majority at the beginning of next year, when Republicans will almost certainly drop the House request. The clock is ticking.
  • In somewhat brighter related news, after a similar administrative hold by the corrupt Justice Clarence Thomas last week, the Supremes have decided that Trump ally Sen. Lindsey Graham (R-SC) must sit for a deposition with the Special Grand Jury created by Fulton County, Georgia District Attorney Fani Willis, in her investigation of the Trump-led conspiracy to steal the 2020 election in the Peach State. SCOTUS, however, has left open some doors for Graham to return to district court if he believes any of the questions he's asked violate his right to not answer questions related to his legislative activity as a Senator under the Constitution's Speech and Debate Clause.
  • Finally, Desi Doyen joins us for our latest Green News Report, with a bit of bona fide good news --- in several different stories, in fact --- to wrap up today's program...

While voters were at the polls for primary elections in six states (Arizona, Kansas, Ohio, Michigan, Missouri and Washington) on Tuesday, we take the moment to turn to foreign affairs for a hot minute on today's BradCast.

Happily, few problems were reported for voters at the polls in those six states --- at least that we could find so far today --- beyond another predictable failure of electronic poll books, this time across Mohave County, AZ, for about six hours when polls opened. More issues may reveal themselves before tomorrow, or thereafter, of course. Meanwhile, there are a whole bunch of far-right, Trump-backed, 2020 election deniers on the ballot today, with several running for critical offices such as Governor, Sec. of State and the U.S. Senate. All of which, if those candidates win on Tuesday and again this November, could cause very serious problems for democracy itself in 2024. We'll pick all of that up on tomorrow's show, with whatever noteworthy reported results may be available by then.

But today, we had the opportunity circle back to Russia's ongoing war with it's sovereign neighbor Ukraine, now entering it's sixth horrific month following Russia's invasion on February 24. If you follow most Western media, Ukraine's military is making valiant if deadly headway in pushing back at over-extended and exhausted Russian troops in the South, while Russia presses its offensive in the East.

If you follow Kremlin-controlled media, this is a war special military operation that can never be won by Ukraine, and continues to threaten expansion into a global conflict, including the use of nuclear weapons, as Russia takes great pains to note --- on an alarmingly regular basis.

But, it's not only Russian-controlled media suggesting the war is ultimately unwinnable for Ukraine. A number of foreign policy-centered Western media outlets and think-tanks have long argued similarly in a push for peace talks and a ceasefire in the now war-torn nation of Ukraine.

There was some good news this week, in that an agreement brokered by Turkey and the U.N. between the two warring nations last month has resulted in ships carrying Ukrainian grain finally able to leave port to deliver food around the world. Russian ships will also be allowed to do so through safe corridors established amid mined waters in the Black Sea. If the agreement holds, millions of tons of grain and other agricultural products will finally be able to flow from "the breadbasket of Europe" to help ease rising global food prices and the threat of hunger and political instability in developing nations.

The first ship to leave port on Monday was "loaded with two commodities in short supply: corn and hope," as U.N. Secretary-General Antonio Guterres described it. Beyond that, there is not much to be hopeful about in the protracted conflict.

Writing at The National Interest over the weekend, veteran foreign policy experts and former U.S. National Security officials Steven Simon and Jonathon Stevenson made the case for diplomacy. They called on the U.S. to help encourage a negotiated settlement by making clear to Ukraine that "Neither side can fulfill its maximal war aims" and they must find opportunities for peace talks and, if possible, a cessation of hostilities, despite Vladimir Putin's apparent disinclination to negotiate.

"It is well and good for the United States and its NATO allies to keep arming Ukraine. But it is also time to encourage both sides to start exploring possibilities for a political solution before escalation puts diplomacy even farther from reach," the pair conclude. "And unless the United States and NATO condition military assistance on Ukraine’s constructive political engagement, they will lack the leverage to work effectively towards a stable objective."

But is such a demand appropriate or even possible under the current conditions in the war torn nation? Isn't it up to Ukraine --- which has lost so much in blood, treasure and sovereign territory --- not the U.S. or NATO, to decide when and if Ukraine is ready to negotiate an end to the war?

Those are just some of the difficult and nuanced questions we discuss with our guest today, GEORGE BEEBE, Director of Grand Strategy (yes, I know, an ominous sounding title!) at the Quincy Institute for Responsible Statecraft, one of our go-to think-tanks for smart, no-nonsense foreign policy solutions.

Beebe's is the author of 2019's The Russia Trap: How Our Shadow War with Russia Could Spiral into Nuclear Catastrophe. He served over two decades in the U.S. government as an intelligence analyst, diplomat, and policy advisor, including as director of the CIA’s Russia analysis and as an advisor on Russia to Vice President Dick Cheney. (Yes, we discuss both of those ominous matters --- his work with the CIA and for Cheney --- as well!)

Among the questions and issues Beebe speaks to today: His concern that there is no real exit plan for our current strategy, not unlike the lack of a U.S. plan when we launched the Iraq War in 2003; Is it true that there is no way for Ukraine to "win" this war? That the only way is via diplomacy?; Should it be up to the U.S. and NATO, who are supplying much-needed armaments to help Ukraine defend itself, to decide when Ukraine should negotiate towards a settlement? Or should that remain Ukraine's sole decision?; Does Russia even have an interest in negotiations?; What should we learn from their repeated reminders that a continuation of the war could lead to a potentially nuclear expansion?; And, since it's actually a somewhat related matter, what does Beebe make of House Speaker Nancy Pelosi's controversial visit on Tuesday to Taiwan, and what effect is that likely to have on the Russia/Ukraine conflict?

"This is a very complex issue," Beebe tells me on the matter of the United States' own culpability in the matter. "Most foreign policy issues don't have single factor origins. They're usually the result of a confluence of different forces. What's happened in Russia's invasion of Ukraine is that it is the culmination of a series of developments, missteps on the part of a lot of different players over time, that all contributed to the situation that we're facing today."

"That doesn't excuse the Russians and it doesn't excuse Putin from making the choice to invade Ukraine. I think he is fully responsible for that choice, regardless of what preceded it. It didn't have to happen," he argues. But "Russia certainly has what I regard as understandable security concerns...That doesn't mean that the invasion was justified [or] that the manner in which this operation was carried out was at all justifiable."

"But I also would not say that Putin simply woke up in February and said, 'Hey, I would like to invade Ukraine.' There was a lot that went into shaping that decision, and I think a lot of blame on both the Russian and the Western sides."

As you can tell, there is much to discuss and try to make sense of with the Director of Grand Strategy at the Quincy Institute today. I hope you'll tune in for it!

Guest: Howie Klein of 'Down With Tyranny'; Also: Several important (and mostly good) updates on some stories we've recently covered closely...

It's another three-hour show packed into about 57 minutes on today's BradCast, as we catch up with a lot of primary election coverage that we previously postponed due to all the mass shootings, and a bunch of late updates on several critical stories we've been closely following of late. [Audio link to full show follows after this summary.]

First, before our always-lively guest today, those updates...

  • SB 1480, the Internet and Fax voting bill shamefully supported by Democrats in the California state legislature has now passed in the state Senate and heads to the Assembly. We recently discussed with longtime Internet voting expert Dr. David Jefferson why the bill is such an outrageously terrible idea. And we urge you once again to stop by Scrutineers.org/California to learn how (and why) you can help stop it before it becomes law and makes its way into the other 49 states!
  • In a more encouraging update to a story we've recently been covering in detail, a three-judge federal appeals court panel (including judges nominated by Biden, Obama and Trump) have overturned the ridiculous ruling by a Trump-appointed lower court judge who found that a federal Amnesty Act for many Confederates in 1872 somehow gave amnesty to January 6th insurrectionists running for office 150 years later. This was part of a challenge led by Free Speech for People (FSFP) to the ballot eligibility of North Carolina's first-term Rep. Madison Cawthorn, under the U.S. Constitution's "Insurrectionist Disqualification Clause" (14th Amendment, Section 3). Though Cawthorn lost his recent primary race for reelection, the appeals court found the case was not moot, because Cawthorn's contest has not yet been officially certified. This is the second federal court to find that the clause may still be used to challenge insurrectionist running for office. FSFP called the ruling a "major victory", warning that other candidates, including Donald Trump, if he runs in 2024, will not be shielded "from the consequences of their actions" when seeking eligibility for the ballot during Constitutional challenges at the state level.
  • And, in another story of ballot disqualification at the state level that we covered in detail earlier this week, the Michigan Board of State Canvassers on Thursday officially disqualified 5 of 10 Republican candidates seeking the GOP Gubernatorial nomination there --- including the two leading candidates --- after finding that they collectively turned in some 68,000 fraudulent petition signatures in hopes of qualifying for this year's August 2nd primary ballot. All of the GOP candidates falsely claim that Donald Trump only lost the state of MI through massive election fraud by Democrats, before their campaigns apparently went out and committed actual massive election fraud in hopes of qualifying to run. Several of the rejected candidates vow to appeal the decisions and blame the state for their own failure to vet signatures and those they hired to collect them.
  • On Thursday, we detailed the story of the "Hiroshima of botched elections," as described by longtime Election Integrity advocate Sherry Healy, that has been playing out since the May 17 primary election for U.S. House in Clackamas County, Oregon. A disastrous ballot printing snafu --- and the way the disastrous Clackamas County Clerk handled it --- has prevented the finalization of several races, including one that was closely watched in Oregon's 5th Congressional district, pitting progressive Democratic challenger Jamie McLeod-Skinner against very conservative Democratic incumbent Rep. Kurt Schrader. On Friday, AP finally called the race for McLeod-Skinner as counting continues in that race. But, if it holds, it's seen a huge victory for grassroots progressives in unseating a sitting, rightwing House Dem (who had been supported by House leadership).
  • And finally, before getting to our guest today, on Thursday, a New York appeals court panel rejected a plea by Donald Trump, as well as Ivanka and Don Jr., to avoid sitting for a deposition in state Attorney General Letitia James' bank, insurance and tax fraud investigation of the former President and his company. On Friday, the news got even better. A federal appears court rejected the Trumps' attempt to nix the investigation entirely.

NEXT, we're joined by our old friend HOWIE KLEIN, the great progressive House candidate expert, longtime proprietor of the Down With Tyranny blog, and co-founder of BlueAmericaPAC, to discuss primary victories (and losses)for progressive Democrats in the 10 states that have held their primaries so far this year. Also, for a preview of Super Duper Tuesday midterm primaries coming up in seven states on June 7th, including here in California (where Howie has some tips for voters in both state and key Los Angeles races.)

On today's BradCast: More shameful GOP responses to America's continuing mass shooting epidemic; one step closer to some accountability for our corrupt former President; the Republican Party's shameful response to a very close primary election in Pennsylvania; and an unmitigated election disaster for voters continues to hold up a critical U.S. House race two weeks after Oregon's midterm primaries. [Audio link to full show is posted below this summary.]

Among the stories covered on today's program...

  • This week in Uvalde, Texas, 19 fourth graders and two teachers were murdered after the shooter at Robb Elementary School had no problem purchasing two semi-automatic rifles and hundreds of rounds of ammo just days after his 18th birthday this month. The state's Republican Gov. Greg Abbott --- who is up for reelection this November --- declared after the massacre that the problem was mental illness and Texas must "do a better job with mental health." But last month, Abbott slashed $221 million from the department overseeing mental health programs in the state which, according to a new study, ranked 50th last year for access to mental health care. That, after Abbott signed bill after bill making it easier for Texans to buy, carry and kill as many people as possible, with high-powered, military-style weapons. (Did I mention that Abbott is up for reelection this November?)
  • It's not only Texas Republicans working hard to make it as easy as possible to kill fellow Americans. Just days after back-to-back-to-back mass shootings in America, Senate Republicans on Thursday blocked a bill in the U.S. Senate meant to help to prevent domestic terrorism. The measure was already adopted by Democrats in the House. Not one single Republican Senator voted in favor. (Several of them will be on the ballot this November.)
  • In somewhat brighter news, a federal judge on Wednesday rejected a lawsuit by gun manufacturers, distributors and retailers which had attempted to block New York's new law allowing those in the firearms industry to be sued by the state, cities and individuals for endangering the public's safety and health. NY Attorney General Letitia James said the judge's ruling offers "a moment of light and hope" following the American carnage of the past two weeks. The trade group representing the domestic terrorism industry, The National Shooting Sports Foundation (NSSF), vowed to appeal.
  • In more good NY/Letitia James-related news, a four-judge state appeals court panel today upheld a lower court ruling that Donald Trump and his children Ivanka and Don Jr. must sit for a deposition in James' civil investigation examining the Trumps' "fraudulent" valuation of properties in bank, tax and insurance filings. The Trumps claimed their comments under oath could be used against them in a parallel criminal investigation by the Manhattan District Attorney into many of the same issues. The court agreed. But noted that that's why the Fifth Amendment right against self-incrimination exists. If the Trumps want, they may invoke it during their depositions, in the same "disgraceful" way, according to Trump, that "only mobsters" use it. Some difficult choices await in the very near future for our disgraced former President.
  • In Pennsylvania, nearly two weeks ago, Trump-endorsed celebrity TV doctor Mehmet Oz and former hedge-fund CEO Dave McCormick battled to a virtual tie for the GOP U.S. Senate nomination. The winner will run against Democratic nominee, Lt. Gov. John Fetterman. As of today, Oz leads McCormick by fewer than 1,000 votes out of more than 1.3 million cast in the Keystone State's GOP primary. This week, McCormick sued in federal court to assure that all legal ballots are counted, including mail-in ballots that arrived on time but have a missing or incorrect date on the secrecy envelope. Another court recently ruled such ballots are valid and must be tallied. The RNC and Pennsylvania Republican Party, however, are intervening against McCormick to prevent those lawful, valid ballots from being tallied in the U.S. Senate primary and are attacking their own candidate, McCormick, for daring to enfranchise all Republican voters. On Wednesday, the state announced there will be an automatic statewide recount in the race, with about one-tenth of one percentage point currently separating the two leading candidates in the unofficial results. The official winner should be named by June 9.
  • Another midterm primary election held on the same day in Oregon, on May 17, has far worse problems. The closely watched U.S. House race in the state's 5th Congressional District between grassroots-supported Democrat Jamie McLeod-Skinner and conservative Democratic Rep. Kurt Schrader caused much excitement on Election Night, when McLeod-Skinner appeared on her way to unseating the incumbent Congressman. Then, with about 68% of the vote in, pretty much all of the counting stopped and hasn't moved much, if at all, since then.

    What happened? We're joined today by one of Oregon's longtime Election Integrity activists SHERRY HEALY --- co-founder of the California Election Protection Network, and, more recently, the Chair of the Oregon Democratic Party's Election Integrity caucus --- to explain the disaster in Clackamas County, OR which has held up the tally.

    As she details, a printing problem on the barcodes (used to identify party and precinct) on tens of thousands of the County's vote-by-mail ballots means they cannot be run through the computerized tabulation system. But, rather than count those ballots publicly by hand, the County's longtime beleaguered County Clerk, Sherry Hall (pictured above), decided that those tens of thousands of otherwise valid ballots should be "remade" by hand --- duplicated by election officials --- on separate ballot sheets so they can then be running through the optical scanners for tabulation.

    "This county clerk has a long history of bungled elections," Healy explains. "But this is the Hiroshima of botched elections." Healy details how Hall failed to adequately test the ballots for this problem after receiving them from the printer before sending them out to voters. Moreover, the decision to remake tens of thousands of ballots, rather than simply count them by hand, "imperils" the entire election, she charges.

    Healy calls Hall's decision "absurd" and "insane," explaining that a simple hand-count "would take less time and be more efficient and accurate" than recreating "in excess of 66,000" ballots.

    Hall, a Trump supporter elected to the job back in the Tea Party days about a decade ago, has a long history of problems in her office. Way back in 2012 we reported on an election official in Clackamas who was indicted on six felonies and two misdemeanors after she was found to have secretly filled in unvoted races for Republican candidates on incoming mail-in ballots.

    When Hall announced that the printing error on the ballots made them unscannable, she claimed that it was new deadlines adopted by the state legislature for the receipt of incoming mail ballots that would hold up her county's tally, as opposed to her own failure to test ballots before sending them out. More recently, she denied that she gave permission for a Schrader campaign observer to enter the counting room an hour early, before observers from the McLeod-Skinner campaign had arrived. Then security camera footage was obtained through a public records request revealing she had lied about that.

    It's unknown when the tabulation in Clackamas will finally be complete. The 5th Congressional District primaries on both the Democratic and Republican side remain uncalled, with just over 70% tallied in each almost two weeks after Election Day. (More have come in since air time today.) For now, McLeod-Skinner remains almost 15 points ahead of Schrader. But that could change. In the meantime, there are a whole lot of lessons to be learned from this entire mess, as we discuss with Healy today. (And, yes, Hall is also up for reelection this November.)

What's the difference between a white supremacist mass murderer in Buffalo, NY and a GOP candidate for the U.S. Senate? Well, in terms of their racist rhetoric not a heck of a lot, it seems. That and many more reasons to both pay close attention and be skeptical of "conventional wisdom" regarding this November's critical midterm elections on today's BradCast, as American Democracy v. Violent Strongman Authoritarianism is most definitely on the ballot in every state this year. [Audio link to full show follows this summary.]

Among the stories underscoring all of that on today's program...

  • A number of the attorneys who helped Donald Trump try to steal the 2020 election have had their law licenses suspended or are facing permanent disbarment. One attorney who has yet to be held accountable in any way, however, is Sen. Ted Cruz, who volunteered to represent Trump in two different bogus election challenges before the U.S. Supreme Court; knowingly spread false claims of fraud; and then voted against certification of Joe Biden's Electoral College victory even after Trump's deadly insurrection at the U.S. Capitol. A bipartisan group is now hoping to change that. This week, they filed a complaint with the State Bar of Texas, seeking an investigation into possible disbarment for the sleazy Texas Senator/still-licensed attorney.
  • Speaking of sleazy still-licensed Texas attorneys, the state's chief law enforcement officer, Attorney General Ken Paxton now says he has been sued by the Texas State Bar for misconduct. Paxton has already been charged with several securities fraud felonies; is being investigated by the FBI for abuse of power and bribery after a federal criminal complaint by eight of his top former deputies; and brought a laughable case to the U.S. Supreme Court seeking to toss the 2020 election results in four states that were not Texas. It is for his help in trying to steal the election for Trump at SCOTUS that has resulted in the state Bar's lawsuit against him. Paxton is running for re-election anyway. On Tuesday he's in a runoff election with the state's Land Commissioner George P. Bush (the very Trumpy son of Jeb and nephew of the guy who made "one of the biggest Freudian slips of all time" at Southern Methodist University yesterday.) No sooner did Paxton get sued by the state bar then he turned around and opened an investigation into the Texas Bar Foundation for "facilitating mass influx of illegal aliens" --- ya know, the stuff that racist "great replacement" conspiracy theories are made of.
  • And speaking of the racist "great replacement" conspiracy theory, as repeatedly cited by the white supremacist domestic terrorist who murdered 10 and wounded 3 others in a Buffalo supermarket in a predominantly black neighborhood last weekend, a whole bunch of Republicans running for the U.S. Senate this year have been using nearly identical rhetoric to that racist murderer for a very long time. The once-fringe, now mainstream rightwing theory claims that Democrats are hoping to replace white American voters with immigrants, Jews and people of color to control the electorate with one-party rule. Or something. And, in the wake of Trump's embrace of white nationalism as President, AP highlighted a bevvy of mainstream GOP Senate candidates this year --- either running for reelection or for the party's nomination --- whose rhetoric on immigration directly echoes the same baseless, racist fear-mongering. Their list includes Blake Masters in Arizona; A.G. Eric Schmitt and disgraced former Gov. Eric Greitens in Missouri; GOP Senate nominee J.D. Vance in Ohio; and two-term U.S. Senator Ron Johnson of Wisconsin. The full list of elected and hopeful GOP officials who also espouse rhetoric shared by rightwing domestic terrorists is obviously much, much longer.
  • And speaking of domestic terrorists, the U.S. House passed the Domestic Terrorism Prevention Act (again) on Wednesday. All Democrats voted for it. Every Republican, except for retiring Illinois Rep. Adam Kinzinger, voted against it. Democrats vow to bring it up in the Senate next week. It may be a heavy lift over the undemocratic 60-vote filibuster threshold in the upper chamber. Too bad it wasn't called the Domestic Terrorism by Non-White People Prevention Act. It might have easily passed in both chambers, as most legislation related to terrorism that doesn't target white supremacists tends to.
  • And, speaking of extremism, on Thursday, the Oklahoma legislature passed a new law that, if signed by the Governor, would ban nearly all abortions starting at fertilization, which would make it the nation's strictest abortion law. It would also, in turn, make certain forms of birth control --- like IUDs, The Bill, Plan B, which don't necessarily prevent fertilization, but prevent implantation of a fertilized egg --- a form of "abortion" or, in Oklahoma, a homicide. More Republican-controlled states are likely to follow suit, despite the vast majority of Americans who support abortion rights. Please keep all of this in mind in November.
  • And, speaking of this November, polling last month from the Harvard Youth Poll suggests --- contrary to "conventional wisdom" --- that young voters are very eager to vote this year. The number who say they are "definitely" voting in the 2022 election is almost identical to the number who said same before the 2018 "blue wave" election. That could be good news for Democrats. Again, please ignore "conventional wisdom" in these decidedly unconventional times.
  • And, speaking of young people, even in deep "red" Wyoming, they don't dig attacks on LGBTQ+ people --- yes, even trans people --- as the state's U.S. Senator Cynthia Lummis found out the embarrassing way during a commencement address she gave over the weekend at the University of Wyoming. It took a while, but now she "apologizes" if she offended anyone with her remarks that were broadly booed during the speech at the school once attended by Matthew Shepard, the young gay man who was brutally beaten and left to die on a fence nearly 25 years ago. He became one of the namesakes of the landmark Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.
  • And, speaking of civil rights for all --- and of keeping Big Government and the GOP's stolen and packed Supreme Court out of our bedrooms and doctor's offices --- support for abortion rights has reached a record high in a new NBC News poll following the leak of SCOTUS' draft opinion overturning Roe v. Wade and its 50 years of protection for reproductive rights. The poll also finds support for same-sex marriage (perhaps next on the chopping block after Roe's Constitutionally established right to privacy is killed) at an all time high, while approval for the High Court is at an all time, 30-year low in this particular poll.

We've got an amazing --- and chilling --- story for you on today's BradCast, about what has turned into a wave of proprietary voting system software theft in several key swing-states since Trump pretended the election was stolen in 2020. But the most disturbing part is that many of these thefts having been carried out by or with the help of actual elected GOP election officials in several states! And there is one in particular, in Georgia, which has just come to light which we focus on today, because our quick-thinking guest actually recorded a damning phone call she received from someone who claims to have been a part of that scheme. [Audio link to full show is posted below this summary.]

Before we get there today, however, we've got a very (too) quick round-up of results from Tuesday's primary elections in North Carolina, Kentucky, Oregon, Idaho and Pennsylvania, and some news on several of them that you may not have heard elsewhere. Among the most noteworthy of those races...

  • The loss of North Carolina's insurrectionist U.S. House Rep. Madison Cawthorn in his GOP primary, and what will now happen to the federal court case regarding Free Speech for People's challenge to his eligibility to run at all under the U.S. Constitution's "Insurrectionist Disqualification Clause." We've been covering that story closely in recent months and we've got comment today from the group's President on what may happen now in the federal case.
  • News on several apparent wins by progressive candidates for the U.S. House in PA and OR, including one that is set to result in the defeat of an incumbent establishment-backed Democratic Congressman and the other likely headed to a recount.
  • The good news for Democrats in the contest for PA Governor, as far-right Trump-endorsed insurrectionist wingnut state Sen. Doug Mastriano won the GOP nomination to run against state A.G. Josh Shapiro. Suffice to say for now, Republicans are not happy about their nominee.
  • And the critical race to fill the U.S. Senate seat being vacated by Republican Pat Toomey, where progressive Lt. Gov. John Fetterman easily won the Democratic contest and the battle for the Republican nomination is likely headed to a recount between Trump-endorsed celebrity TV doctor Mehmet Oz and pretty-much-just-as-Trumpy former hedge-fund CEO Dave McCormack. Both are now waiting on late arriving mail-in ballots to be tallied in the exceedingly close race, even though Republicans in 2020 argued that late arriving mail-in ballots in the Keystone State were all illegal and should have been tossed out. Not anymore, apparently. (And we wonder how long it'll be before they notice yesterday's BradCast rounding up several Republican-leaning counties where voters were turned away for hours after polls opened, thanks to voting system failures.)

THEN, it's on to the remarkable story of GOP election insiders in critical swing-states such as Michigan, Colorado, Ohio and Georgia, who, following the 2020 election, conspired with a cabal of election denying Team Trumpers to breach secure facilities in elections offices. They made illegal image copies of hard drives from key voting system computers containing sensitive, proprietary software and voter databases in at least 8 counties across the country...for some reason.

Part of this story is newly revealed evidence about one such a case in Coffee County, Georgia, which includes a damning recorded phone call received by our guest today, MARILYN MARKS of the Coalition for Good Governance. The caller admits to an elaborate scheme to copy and analyze hard drive data from the county that Trump is said to have won by about 40 points. He also told Marks that he hacked into her legislative filings in her long-running lawsuit against the state, which seeks to replace Georgia's unverifiable touchscreen voting systems with simple, verifiable hand-marked paper ballots.

You'll need to tune in for the full details on this story. It's broad and, at times, complicated. And, yes, we share some of the disturbing audio from that phone call to Marks from an Atlanta bail bondsman by the name of Scott Hall who brags about chartering a jet to Coffee County with a group that "scanned all the equipment, imaged all the hard drives and scanned every single ballot" with "the entire elections committee there" who, he claims on the call, said "we give you the permission. Go for it."

We pull together a bunch of threads from a bunch of investigative news sources (as well as some of our own reporting) on all of this, on the broad scheme carried out by some of Trump's top "Stop the Steal" compatriots and the almost inconceivable lack of apparent investigation --- or worse, cover-up --- by GA's Sec. of State Brad Raffensperger regarding the still mysterious incident in Coffee County.

Among the questions discussed with Marks: What the hell is going on here? Is it a violation of state and/or federal law to make discreet imaged copies of this software? Why was Team Trump doing it in the first place? Is Sec. Raffensperger's office investigating what happened in Coffee County, GA or not (they are offering conflicting statements, including in Marks' legal case challenging the use of the state's Dominion touchscreens)? What kind of threat does all of this pose to elections around the county in 2022 and 2024 in Georgia (their midterm primaries are next week) and in the many other states which use the very same software --- now stolen by these people --- to run their elections?

"Certainly they were violating state and federal laws," Marks tells me. "The difficult part of this is It puts virtually all states that are using the Dominion system --- without doing thorough audits and [using] hand-marked paper ballots --- it puts all of these at risk."

"If what Scott Hall and other have said happened truly happened, then there are people who have unauthorized copies of software off the server and off of all of the components," she explains. "These people can now craft and test malware and how to exploit the vulnerabilities in an election."

Marks believes the initial effort was meant "to try to find evidence or perhaps even fabricate evidence," regarding the 2020 election. But it has since gone far beyond that.

Raffensperger, she says, is offering "nothing but stonewalling" and "is telling different things to different people." She notes there is "no record of opening an investigation" in Coffee. That, as the Secretary's second-in-command, Gabe Sterling, seemed to suggest in a recent court deposition that there WAS an investigation of the server in Coffee, that it was actually quietly seized by the state, but that he "can't remember" the findings from the inquiry.

"There are many mysteries to unfold here. We don't know who has been in the system and how far any malware may have spread if it were implanted." She warns the Secretary's office and state Elections Board "want to hide their heads in the sand despite" the mounds of recent investigative reporting (as linked above) on what is going on here.

"The system has been breached," Marks cautions chillingly, before explaining what must be done now to safeguard our elections --- including from insider election officials who have now put our entire democracy at very serious risk. Even hand-marked paper ballots, she notes, are still tabulated by these same computer systems.

"Remember, the remedy we are seeking [in our suit] is not simply hand-marked paper ballots but hand-marked paper ballots with very thorough audits. IF we get the audits, yeah, there can be hacking but any outcome-changing hack will be detected and can be corrected," Marks argues. "While you can't get rid of the risk, you can remedy that risk."

It's the excruciatingly long final week of the year. Brad and Desi are on vacation. I'm NICOLE SANDLER, holding down the fort and guest hosting The BradCast for a few days. [Audio link to full show is posted below this summary.]

I have a busy show for you today. But I start today's companion post with a bit of a retraction from the CDC which just arrived in my inbox. I honestly don’t know whether to laugh or cry, as it showed up just as I put the finishing touches on today's show.

Our first guest today is JOHN M BARRY, a professor at Tulane and author of a number of books. The one we're concerned with today is The Great Influenza: The Story of the Deadliest Pandemic in History. Barry literally wrote the book on the closest approximation of what we're living through right now. So I wanted to check in with him to ask how the 1918 Spanish Flu finally ended, and to ask if we might be on the same track with the arrival and potential predominance of the Omicron variant. And, frankly, it appeared that I may have hit on something.

At least until five minutes ago, when I received this alert. "CDC significantly cuts estimate of omicron's prevalence in US," reads the headline at The Hill. So I kept reading...

According to agency data, omicron accounted for about 59% of all US infections as of Dec 15. Previously, the CDC said the omicron variant comprised 73% of all cases for the week ending Dec 18. But that number has now been revised to 22.5% of all cases. And the Delta variant still accounts for about 41%...and to make matters even worse, the US is now averaging more than 206,000 cases a day and climbing, according to the CDC.

I guess that just means the situation is even more dire than we thought.

Also today, I reached back into late 2020 for our second interview, but there’s a method to my madness. In October of 2020, NY Times columnist NICHOLAS KRISTOF and his wife, Sheryl WuDunn, produced a film to go along with the book they released the previous year with the same title, Tightrope: Americans Reaching for Hope.

In it, Kristof takes a hard look into poverty in America, the wealthiest nation on the planet. He takes us back to his hometown of Yamhill, Oregon, where people are really struggling.

Perhaps it was the journey of making the film and writing the book that convinced Kristof to make a major life change. This year, he quit the NY Times, moved back to Oregon and launched his campaign to run for Governor. It appears to me that he's doing it for all the correct reasons. Guest: Author, gerrymandering expert David Daley of Fair Vote; Also: Hope springs eternal for Freedom to Vote in the U.S. Senate; And GOP bathtub climate change physics in Virginia...

On today's BradCast, I share an idea that I've thought long and hard about, struggled with and, frankly, never thought I'd have, much less recommend, as this idea is essentially counter to everything I have long fought for as a democracy advocate. But, as they say, desperate times...and all that. [Audio link to full show follows this summary below.]

Next Wednesday, Senate Majority Chuck Schumer has told Democrats, he plans to bring up the Freedom to Vote Act for a cloture vote, which --- if successful --- would then allow the Senate to proceed to debate on the bill that is critical right now for the survival of American democracy itself. Even if passed, Freedom to Vote won't save everything, of course, but it will help. Big time. The Joe Manchin-approved "compromise" version of the For the People Act (which has already been passed by the House) would, among a boatload of other long-overdue things, institute automatic voter registration and minimum requirements for Absentee and Early Voting in all 50 states; adopt rules that would limit the most disenfranchising Photo ID restriction laws; require hand-marked paper ballots for all voters(!); and prevent extreme partisan gerrymandering among other much needed stuff that would benefit all voters and democracy itself --- if not necessarily the Republican Party, as they see it, while they continue to lie about the bill in order to place party above both country and democracy.

Next week's cloture vote on the measure is likely to be supported by all 50 members of the Democratic caucus in the Senate. But it is unlikely to be allowed up for debate in the minoritarian Senate because, unless Manchin and any other Democratic obstructionists agree to reform the filibuster to allow democracy saving legislation to pass with a simple majority, it won't receive the 60 votes needed to overcome a Republican obstructionist filibuster. That, as GOP-controlled states across the country continue to adopt measures making it harder for (certain) voters to vote and easier for Republicans to cheat by overturning election results they don't like by partisan fiat.

In 2010, the GOP's so-called "REDMAP" program succeeded with Republicans taking over state legislatures in order to draw extreme partisan gerrymanders following that year's decennial census to assure themselves majorities in both statehouses and Congressional delegations for the ensuing decade, even when receiving a minority of the vote. Now that the 2020 census has been completed --- and the GOP's stolen and packed U.S. Supreme Court has determined that federal courts may not intercede to block partisan gerrymanders in any way --- those same Republican state legislatures are in the process of drawing even more extreme gerrymanders for partisan advantage over the next decade. Experts say that "red" states are now in the process of redistricting in such a way that even if the nation voted exactly as it did in 2020, Republicans would end up taking control of the U.S. House --- even with millions of fewer votes than Democrats receive for their elected members of Congress.

That is just part of the near future that all Americans can look forward to if the Republicans and Democrats like Manchin and Kyrsten Sinema in the Senate prevent passage of the Freedom to Vote Act along with its federal restrictions on extreme partisan gerrymanders.

While I hate the idea, all one has to do is take a look at what the Texas legislature (and others like it) are currently up to and planning this year to realize that it's time --- at least if Freedom to Vote is not adopted --- for Democratically-controlled states to answer the GOP assault on democracy by instituting their own extreme partisan gerrymanders in response.

As noted, I hate that idea. It is, at least on the surface, counter to the small "d" democratic ideals that I have always fought for. But, at this point, with the American democratic experiment now teetering toward unstoppable authoritarianism, unilateral disarmament by Democrats seems more like a suicide pact. Yes, for Democrats, but, much more importantly, for democracy itself.

I suspect not everyone will agree with me here, including my guest today. I'm joined by the man who actually wrote the book on partisan gerrymanders, DAVID DALEY of FairVote.org. His book on the GOP's REDMAP assault on democracy is called Ratfucked: The True Story Behind the Secret Plan to Steal America's Democracy. His more recent follow-up, out this year, is Unrigged: How Americans Are Battle Back to Save Democracy.

Daley details the horrors to come from the GOP's extreme gerrymandering plans that we will see in the next few weeks and months, describing them as "really bleak for the Democrats on the redistricting front". For example, he explains, "if you look at the 2020 election, Democratic candidates for the U.S. House won 4.7 million more votes than Republican candidates, but that only turned into a 5 seat majority. Republicans, simply by redistricting in Texas, Georgia, North Carolina and Florida alone --- before you even get to the handful of other states where they can pick up individual seats --- could probably get at least twice the number that they need to flip the House simply by gerrymandering those states."

But, even as he argues in favor of "Constitutional hardball" from Democrats, he does not agree with me that Dems should participate in the same sort of behavior in response when it comes to redistricting this year, describing it as "rearranging deck chairs on the Titanic." He explains why, and we debate the issue on today's program.

Today's BradCast, by and large, serves as another fine example of why we fight, and what we fight for. [Audio link to today's full show is posted at the end of this summary.]

Among our stories today...

  • We've got an update following yesterday's lively interview with John Brakey, the longtime, progressive Election Integrity and audit expert who has been serving as an observer and advisor at the Maricopa County, Arizona 2020 election "audit", alongside the state's Republican former Sec. of State Ken Bennett. Bennett was tapped by the GOP state Senate in April to serve as its liaison to the ill-considered clown show "audit" they hired the inexperienced, partisan, conspiracy theorist company named Cyber Ninjas to carry out. Last week, Bennet was shamefully locked out of the building after he'd shared information from the third count of the County's ballots with experienced outside experts who seem to confirm that the Ninjas' original ballot tally was wrong. In fact, they suggest that the original County count was accurate (as expected, by all by the Trump MAGA mob). As of yesterday's show, Brakey had confirmed that Bennett was resigning his post after the dust up. But shortly after we got off air, Brakey reports, Bennett met with Senate President Karen Fann and, essentially, unresigned. We explain what happened and what may happen next, as even Republican members of the state Senate are now describing the effort as "botched" and turning hard against both the Ninjas for their incompetency and Fann for her folly in having hired them.
  • Despite the obvious failure of the Ninja's disastrous pretend "audit" in Arizona, Republicans across the country are noticing the millions of dollars raised by the grifters running that spectacle, and have decided they'd like some of that sweet sweet "audit" theater in their own home states. But on Wednesday, the U.S. Dept. of Justice issued new guidance documents, warning that they intend to enforce federal laws that may be violated by such exercises.
  • In separate, but related guidance on Wednesday, the DoJ also also made clear they intend to enforce federal voting rights laws against states enacting new voter suppression measures, as GOP-controlled legislatures are now doing all over the country. That, even as recent rulings by the GOP's stolen and packed SCOTUS has made such enforcement much more difficult, in lieu of new federal laws needed to protect the franchise.

    To that end, the House Oversight and Reform Committee on Thursday held a hearing on, among other things, the Texas state legislature's attempt to adopt such a bill. Texas Democrats left the state two weeks ago to prevent the quorum needed to pass such a bill during the ongoing special session called by Gov. Greg Abbott to do just that. And today, 82-year old state Rep. Senfronia Thompson --- the longest serving woman and African-American woman in Texas history, now in her 25th term --- offered moving testimony about her and her family's personal experiences with Jim Crow voter suppression laws in the Lone Star State. We share some of her must-listen remarks in response to GOP Congressmembers at the hearing who downplayed the difficulty of minority voters to exercise their right to vote.

  • With COVID surging again, thanks to the Delta variant and those who have refused to get life-saving vaccinations, President Biden announced new initiatives at the White House today, following impassioned remarks to encourage Americans to get their shots. "This is an American tragedy," he said. "People are dying --- and will die --- who don't have to die. If you're out there unvaccinated, you don't have to die," the President pleaded before detailing the new incentives. Among them: Paying the unvaxxed $100 to get their shots; Expanding federal reimbursement for employers and employees to take time off to get both themselves and their families inoculated; and a new requirement for federal workers and contractors to either get vaccinated or face regular testing and other restrictions.
