Good news on green energy, even from fascists; Disturbing news on Election Integrity and hand-counting, especially from fascists...

Some good news, some bad news, and the most difficult news of all for talk radio: nuanced news on today's BradCast. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Texas has finally figured out that home solar panels and battery storage can help save the state's brittle, failing electric grid this winter. That's good news for Texas, Tesla and homeowners who can make money selling excess energy back to the grid.
  • There is actually quite a bit of good news for renewable energy according to a new report this week from the International Renewable Energy Agency, as per the New York Times' Ivan Penn today. Top line: As solar and wind production are now cheaper sources for electricity than fossil fuels, renewables now dominate all new electric energy capacity (81% last year) and, if the current trajectory continues, are likely to very soon generate more electricity globally than fossil fuels.
  • Even the Brothers of Italy --- the actually fascist right-wing party which recently won a Parliamentary majority in Italy --- and its far-right leader Giorgia Meloni (soon to become Prime Minister) appear to be more progressive on climate change concerns than the Republican Party in the U.S. It's kind of remarkable really and, yes, a bit nuanced.
  • Speaking of fascists, with early voting now under way in many states for the critical 2022 midterms, so is the voter intimidation and suppression by disinformed rightwingers. MAGA Republicans in Arizona appear to be taking the early lead nationwide when it comes to reported intimidation, as armed and masked vigilantes in tactical gear are now camping out in parking lots near absentee ballot drop boxes because they've been duped into believing they are used for massive voter fraud. While some of the few remaining GOP officials in the state who haven't become brain poisoned are trying to lower the temperature, others, including MAGA Republican Gubernatorial nominee Kari Lake and MAGA State Sen. Kelly Townsend continue to fan the flames with lies about the 2020 election.
  • Meanwhile, however, in defending against Donald Trump's lies about election and voter fraud, Democrats may have backed themselves into a corner when it comes to their own ability to challenge election results themselves. In their ill-considered efforts to force Republicans into answering gotcha questions about whether or not they will accept election results for elections that haven't even happened yet --- which could include outcome determinative problems like voter suppression or problems with voting and tabulation computers --- Dems may have short-circuited their own ability to challenge results that legitimately need challenging. We discuss.
  • At the same time, MAGA rightwingers in several rural (heavily GOP-leaning) Nevada counties are certain that Dominion Voting Systems done them wrong in 2020. So now they're demanding hand-counted paper ballots. While hand-counting is, in fact, the only way to know for certain if computers actually tallied ballots as per voter intent, the NV GOPers who bought into Trump's evidence-free fraud conspiracies are doing it all wrong. One county has even been given permission by the state Supreme Court to begin hand-counting early ballots beginning this week. That is a recipe for all sorts of disaster, including unlawful leaks about early results.

    And here comes more nuance: While we have spent nearly two decades decrying computer-tabulated ballots, we have called not for hand-counting, but for hand-count pilot projects to determine its feasibility in each jurisdiction and to develop simple, efficient and publicly-overseeable protocols to do it safely and transparently at the precinct on Election Night, in front of everyone, before ballots are moved anywhere. (Similar to how it has been successfully been done for many years now by about 40% of the towns in New Hampshire.)

    Ad hoc hand-counting (for example, like the kind that took NV's Esmerelda County more than seven hours to tally 317 ballots after their June primary!) is a disaster in the making and one that is likely to end up discrediting real hand-counting for years to come. I hope I'm wrong.

    In the meantime, there are critical contests in the state this year, including a very tight race between incumbent Democratic U.S. Senator Catherine Cortez Masto and Republican Adam Laxalt. If she is reported to have lost and there are any questions about the results, good luck to the Dems after shortsightedly decrying any and all concerns about elections when they may need to challenge an election themselves.

On today's BradCast, we try to keep up with the damage caused both by Hurricane Ian and by the former President's team of fraudsters. [Audio link to full show follows below this summary.]

We begin with a quick update on the still-unfolding devastation of Ian in Florida. After having crossed back into the Atlantic, the storm has gained strength and hurricane status again. It is now aiming for another landfall, this time in South Carolina on Friday. After that, we check in with an old friend who rode the storm out this week in the Sunshine State.

We're joined today from southeast Florida by NICOLE SANDLER of The Nicole Sandler Show --- and, too-occasionally, of The BradCast, where she is kind enough to serve as our guest host from time to time. Nicole tells us she "got really lucky" this time, as she lives in one of the few areas of Florida which wasn't pummeled by a direct hit from Ian, though she reports it still got very wet and windy even where she is.

Naturally, in addition to the weather, we discussed the politics --- including the climate change politics (or, more aptly, the climate change denialist politics) --- of Florida Republicans like Gov. Ron DeSantis, who famously voted against federal aid for Superstorm Sandy when he first arrived as a freshman Congressman in 2013 "before Donald Trump plucked him from the back-bench of Congress where he wallowed in obscurity." What impact will Ian have on DeSantis' re-election hopes against his Democratic challenger this year, former Gov. Charlie Crist? It's too early to say, she notes, but "at least he's not bad-mouthing the President as he takes the money that President Biden has been so freely offering."

And what of Rep. Val Demings' challenge for Florida's U.S. Senate seat currently occupied by Marco Rubio? There is, of course, much to discuss with our old friend today, including the seven Republican U.S. House Members and one U.S. Senator from Florida who have, collectively, accepted more than a million dollars from fossil fuel industry donors, as they try to block the Securities and Exchange Commission from requiring public companies to reveal the financial risks that our climate crisis now poses to their businesses. DeSantis himself, whose own re-election campaign has taken more than $800,000 from the industry, has even gone so far, according to The Lever today, to "spearhead an initiative to bar his state from considering environmental factors such as climate risks in its investment of billions of dollars of retirement savings of teachers, firefighters, and other government workers."

Will this week's climate change-intensified storm change those politics in any way?

Then, from keeping up with Ian, we try to keep up with the attempts at legal accountability for Donald Trump's merry band of GOP "voter fraud" fraudsters. Among our related stories on that today...

  • The election worker in Michigan who was charged this week with tampering with voting equipment after he was seen inserting a USB drive into an electronic pollbook system at the polls during the state's August primary.
  • Disgraced trump attorney Sidney Powell saw her counter-suit against Dominion Voting Systems tossed by a Trump-appointed federal judge on Wednesday. Dominion is suing Powell in a $1.3 billion defamation suit. The company's complaint is moving forward. Powell's counter-complaint, as of Wednesday, is not.
  • And, a federal judge (in this case, one appointed by Ronald Reagan), ruled that a defamation lawsuit against Fox "News" and its former host Lou Dobbs may move forward to the discovery phase. This week, the judge rejected a motion by Fox and Dobbs to toss the case filed against them by a Venezuelan businessman who Dobbs had accused of executing an "electoral 9/11" in 2020, falsely charging the man was somehow linked to Hezbollah and somehow rigged voting systems from both Smartmatic and Dominion to steal the election from Trump.

Next, Desi Doyen joins us for our latest Green News Report, with more on the widespread damage and records smashed by the climate change-fueled Hurricane Ian; a legislative crash and burn for Sen. Joe Manchin this week; a new criminal probe for CA's largest and most corrupt power utility; and the mysterious breaches of the Russian natural gas pipelines to Germany.

Finally, as if that's all not enough, some breaking news at the end of today's show. The wildly corrupt Trump-appointed judge overseeing the former President's attempt to quash the DoJ's criminal probe investigating thousands of documents he stole from the White House and stored at Mar-a-Lago, issued another insane ruling in Trump's favor. This time, she overruled the Special Master --- the chosen by Trump and appointed by her --- who had ordered Trump's attorneys to offer evidence to back up Trump's claims that documents were planted by the FBI and/or declassified by Trump before he took them from the White House. Judge Aileen Cannon also pushed back the deadline for Special Master Raymond Dearie to complete his work until mid-December, despite Dearie's plan to complete his review of the documents in question by mid-October...

  • Britain's longest reigning monarch, Queen Elizabeth II, is dead at age 96 after her 70-year reign.
  • A new Reuters poll find a large majority of Americans (nearly 60%) regard Trump's MAGA movement as a threat to the nation's democratic foundations. But only about 25% of Republicans agree.
  • Trump's sleazy former advisor, MAGA swami, and convicted federal criminal Steve Bannon is indicted on 6 criminal counts in New York for money laundering, conspiracy and fraud related to siphoning hundreds of thousands of dollars from the nonprofit "We Build the Wall" campaign. The campaign was supposedly created to construct some border wall between the U.S. and Mexico. Bannon and the group's founders promised they wouldn't take a penny. They lied. Bannon was pardoned by Trump on his last day in office for similar charges at the federal level brought by Trump's own Department of Justice.
  • The federal grand jury investigating the January 6, 2021 insurrection at the U.S. Capitol has now reportedly widened its probe to include Trump's scammy Save America PAC. While the political action committee has raised more than $130 million from its duped donors, theoretically to contest the results of the 2020 election, most of the money has gone unspent or, apparently, into the pockets of Trump and his family.
  • The same federal grand jury has also now subpoenaed Trump's 31-year old personal aide, William Russell, who worked with him at the White House and has continued to do so since the disgraced former President left office. He is very close to Trump. He likely knows a lot of stuff.
  • CNN's investigative unit on Wednesday published a detailed, lengthy story on GOP leaders in Wayne County (Detroit), Michigan caught on video tape teaching pollworkers how to break the rules on behalf of Republicans. We share the version of the story from CNN's Drew Griffin which ran last night on the cable net.
  • BREAKING mid-show: Michigan's Supreme Court will allow an initiative on this year's midterm ballot for a state Constitutional amendment that would protect abortion rights in the state. Republican members of the state canvassing board had blocked the proposal --- which had been supported by a record 750,000 signatures --- from the November ballot because, they claimed, there wasn't enough spacing between words on the petition. Seriously. That, after Republicans pretended to believe, following the corrupt Republican U.S. Supreme Court majority overturning Roe v. Wade earlier this summer, that reproductive rights should be decided by the people of the states.

Until (and unless) Democrats can pick up at least two seats in the U.S. Senate this November in order to reform the filibuster --- while retaining their majority in the U.S. House and control of the White House --- the fight for personal freedoms, such as reproductive rights and voting rights, is going to remain a grueling, state-by-state slog. That's where we are right now. But we can change that this November if we ALL turn out and fight like hell to cast our vote. In the meantime, on today's BradCast, we've got some good news in at least some of those state-by-state battles.

Among the many stories covered today...

  • New evidence of the unapologetic corruption of Donald Trump's disgraced former Interior Dept. Secretary Ryan Zinke, who, incredibly enough, is currently the front-runner to win a new U.S. House seat in Montana. Voters in Montana would be wise to reconsider that idea.
  • New evidence of the unspeakable ignorance of former NFL great Herschel Walker, who is now the embarrassing Trump-backed nominee for the U.S. Senate in Georgia, where he is running against Democratic Sen. Raphael Warnock. Despite lying about his past, and offering inane, barely comprehensible comments on the campaign trail, not to mention his latest ridiculous response to the Democrats' landmark new climate bill, investing $370 billion to take on our climate crisis, Walker remains very much in the running to unseat Warnock. Voters in Georgia would be wise to reconsider that idea.
  • Newly triggered abortion bans went into effect in three more states on Thursday, in Idaho, Tennessee and Texas. That brings the number of states where reproductive rights and personal freedoms are now completely banned or severely restricted to 14. Many of those states do not allow exceptions for rape, incest or even the life or health of the mother. As the President of the Center for Reproductive Rights told HuffPost, "Vast swaths of the nation, especially in the South and Midwest, are now abortion deserts that, for many, will be impossible to escape." There was a small bit of good news on this front on Wednesday in federal court, however, regarding Idaho's draconian restrictions, as challenged by the Biden Administration's Dept. of Justice. Voters in all of these states are going to need to show up in unprecedented numbers to make their voices heard in November.
  • There was also some good news on this front following this week's elections in New York and Florida, even beyond the political earthquake of Democratic candidate Pat Ryan's win in a special election for the U.S. House in a NY swing-district that would almost certainly have been won by the Republican candidate prior to the U.S. Supreme Court's corrupt GOP majority overturning Roe v. Wade earlier this summer. In FL, the sole Democrat in the state House to vote in favor of new restrictions on abortion and in favor of the Republicans' "Don't Say Gay" law was booted from his job on Tuesday. Also, a judge in FL's Hillsborough County, who made himself infamous earlier this year by denying an abortion to a 17-year old girl because he didn't think her grades were high enough, was also tossed out of his job. Good work, Florida voters! More like that on November 8, please!
  • And then there's the state-by-state fight for voting rights. Here, we've got several encouraging pieces of news from the court in recent days. Earlier this month, a federal court in Texas rejected a state voter suppression law that would leave those who do not live permanently in the state (for example, those who may attend school there) from being able to register to vote in either that state or their own home state! "The part-time and off-campus college students are undeniably disenfranchised because they are unable to register to vote both where they have moved and where they have moved from," the U.S. District Court Judge wrote when issuing his summary judgment [PDF] in favor of plaintiffs. "The court is likewise unable to discern where college students should register as the Temporary-Relocation Provision [of Senate Bill 1111] is written. And the possible repercussions are not just complete disenfranchisement, but also criminal liability. The Temporary-Relocation Provision does not overcome any degree of constitutional scrutiny," he found in tossing out the provision. Naturally, the state's criminally-indicted Attorney General Ken Paxton is appealing the matter to the rightwing 5th U.S. Circuit Court of Appeals.
  • Late last week, there was good news for voters in North Carolina, as the state's Supreme Court determined that two state Constitutional Amendments --- one to impose Photo ID restrictions on voters, the other to lower taxes --- were unlawfully adopted by a racially gerrymandered state legislature. Some 28 seats in the GOP-majority General Assembly were found by a federal court to have been unlawful racial gerrymanders. But, after that finding and before a new election to correct the gerrymanders, the state Assembly rushed a vote to put the Amendments onto the state ballot. Without the illegal gerrymanders, they likely wouldn't have had enough votes to do so. NC's high court last week ruled, as WRAL summarized, "lawmakers who won their seats through unconstitutional racial gerrymandering cannot then submit constitutional amendments that would permanently disadvantage the same groups discriminated against in the racial gerrymandering process." The state's Republican House Speaker vows to appeal to SCOTUS.
  • And, also late last week, a federal judge determined that Arkansas violated the Voting Rights Act by restricting the number of people who could receive assistance in voting --- such as help in translating an English language ballot --- by any one person. The state law said no single person could help more than six voters. The court found that to be arbitrary and in violation of federal law. "Arkansas has determined that voters should only get the assistor of their choice up to a point," the Judge wrote in his ruling, "but there is no evidence Congress contemplated this numerical restriction on the right.” A similar suit has been filed in Missouri, where state Republicans have limited the number of voters who may be helped by any one person to...one!
  • Finally, before we get to today's Green News Report with Desi Doyen --- in which compelling reason is offered to Virginia voters to vote out their GOP climate change denying Congressman Bob Good --- some breaking news out of California, where regulators have finalized a requirement that will allow only new, zero-emissions vehicles (for example, all-electric vehicles) to be sold in the Golden State as of 2035. Desi explains why that's very good news for both the state and the world. Then, she closes out today's program with our latest GNR, including disturbing news on the worst draught in Europe in at least 500 years; the surprising popularity of climate action among Americans; troubling news about fracking and children's health; and oil giant Saudi Arabia's plan to break into the emerging EV market...

When you thought things couldn't get any more insane (nobody actually thought that, did they?), 79-year old President Biden tests positive for COVID. The White House says he is suffering only "very mild symptoms". We'll hope it stays that way and he gets well soon. Meanwhile, we're still busy trying to save the world on today's BradCast. [Audio link to full show is posted below this summary.]

Tonight, the bipartisan House Select Committee investigating Donald Trump's Jan. 6, 2021 insurrection at the U.S. Capitol and his many other attempts to steal the 2020 Presidential election, holds the last of their summer series of blockbuster public hearings, for now. We'll see if Fox "News" bothers to carry this one, since they didn't last time, choosing to run an ad-free episode of Tucker Carlson's show instead. God forbid their groomed viewers turn away during commercials for even a second and learn any actual news.

But, of course, Fox isn't the only rightwing TV channel lying to their viewers day in and out about these remarkable, historic hearings, the deadly events of January 6, and all of the other ways Trump tried undermine American democracy. A new report finds that Newsmax is duping their viewers even worse than Fox, if that's possible, broadcasting at least 40 false claims about the J6 attack since the Committee's hearings began last month. Among the station's lies peddled repeatedly to their easily-played viewers: There were only a few hundred rioters in the Capitol that day (DoJ pegs the number at around 2,000); They were "unarmed" (except for all of the guns, knives, pepper spray, spears, brass knuckles, baseball bats, etc.); and that Trump ordered the National Guard to the Capitol, but was blocked by Nancy Pelosi (the President, not the Speaker of the House, commands the National Guard.)

In any event, whether Fox or Newsmax carry tonight's hearings and/or lies about them, we'll tell you the truth about them on our own Special Coverage on tomorrow's BradCast.

Today, we discuss the need for the long-overdue expansion of the Supreme Court. New polling finds approval of the Court has plummeted over the past two years. According to Marquette University Law School's poll today, 66% of Americans approved of SCOTUS in September of 2020. That number is now at stunning 38%. Their survey follows Gallup's recent finding (before the overturning of Roe v. Wade) that confidence in the Court is at an all-time historic low since they began asking the question in the 1970s.

Of course, this comes on the heels of Mitch McConnell nuking the Senate filibuster in order to pack the High Court with Donald Trump's three corrupt, extremist Republican nominees, including one of them (Amy Coney Barrett) just eight days before the 2020 election. That, after McConnell had changed the size of the Court for over a year while refusing to seat Barack Obama's nominee to the seat vacated by Justice Antonin Scalia in February of 2016, because, according to Mitch, the vacancy came just too close to a Presidential election, when the voice of the American people deserved to be heard first.

But now, with SCOTUS closing out its term with an unprecedented spate of radical rulings --- rolling back long-held Miranda rights; throwing out states Second Amendment rights to well-regulate the concealed carry of firearms; further eroding the long-standing Constitutional separation of church and state; blocking the Environmental Protection Agency from protecting the environment through the regulation of carbon pollution; and, of course, overturning the privacy rights and reproductive freedoms established 50 years ago by Roe v. Wade --- it sure seems like a re-balancing (and de-corrupting) is in order!

Given the striking down of privacy rights in Roe, Democrats in the House have been scrambling to codify reproductive freedom into federal law, along with bills that guarantee the right to both interracial and same-sex marriage, and even the right to use contraception. That, after the Court struck down the same privacy rights in 'Roe' that are the basis of those other Constitutional rights that Justice Clarence Thomas called for revisiting in his concurrence to the majority opinion overturning Roe.

But while codifying those rights into federal statute is critical (most House Republicans voted against all of them this week!), expanding the Court, to UNpack and UNsteal it, so that it represents the American people once again is even more critical.

On Monday, a group of Democratic lawmakers called for exactly that, touting their Judiciary Act of 2021 [PDF] which would expand the number of seats on the Court from 9 to 13. But that measure, so far, has not yet even received a Committee hearing, much less a vote on the Democratic-controlled House floor. What gives?

We're joined today by SARAH LIPTON-LUBET, Executive Director of the non-profit Take Back the Court organization, to discuss exactly that. Her group was formed in 2018 to warn of the danger then posed to democracy itself by the GOP's stolen Supreme Court, and to call for its expansion as the only strategy to re-balance SCOTUS after its 2016 theft. [We spoke with Aaron Belkin, the group's founder, back in 2020.)

"Republicans already changed the size of the Court for a year while they blockaded Merrick Garland's nomination. So a Republican power grab, that's just a part of reality. Given that, isn't a world where we fight for what's right better than a world where we surrender unilaterally?," Lipton-Lubet posits today, when I ask her about the fear expressed by some Democrats that Republicans will just take similar action the next time they are in control of both chambers of Congress and the White House. "To folks who are worried about what Republicans might do in the future, I have to say I'm really worried about what they've done already, and about what we need to do to fix the harm that they've caused in the here and now. They've stolen the Court. They've overturned Roe. They've undermined our democracy. And expanding the Court is our only shot at rebalancing the system and regaining those rights."

"This is only headed in one direction," she warns. "The ideologues on the Court are only going to get more radical. They're only going to get more unhinged. I think leaders can lead, or they try to play catch-up later after countless people have been irreparably harmed. And that's really the situation we're in."

"Living under the control of this Court --- it's not tenable. It's not sustainable. It's not going to stand," she argues. "Eventually we are going to get there." So, why are the bulk of elected Democrats, including the President, still pulling their punches and dragging their feet on this? We discuss that and much more with Lipton-Lubet today.
