This week in Dubai, the U.N.'s Climate Secretary declared "the beginning of the end" of the fossil fuel era. Also this week, in a D.C. federal courtroom, Rudy Giuliani's attorney warned a jury that awarding a penalty of tens of millions of dollars against his client "would be the end of Mr. Giuliani". Both sound good to us on today's BradCast.

Among our many stories covered today...

• The last minute, final agreement between 200 world nations at the COP28 U.N. climate conference hosted by the United Arab Emirates this week, calls for a "transition" away from fossil fuels. It wasn't the call for either a "phase out" or even "phase down" that many had sought. But it was a first. Including the first time in 28 years of such annual conferences that the words "fossil fuels" even appeared in the final unanimous joint statement issued by the parties. What does it all mean? It's both good and bad. We delve into some of the details with Desi Doyen today.

• As the world was working toward moving beyond deadly fossil fuels, the disgraced, twice-impeached Donald Trump was campaigning in Iowa by lying to his supporters that gas now costs as much as $8/gallon, only cost $1.87 when he was President (during the pandemic in which nobody traveled and he helped nearly a million Americans die --- though he didn't mention any of that) and vowing to renege on the U.S. pledge at COP28 to give $3 billion to the joint "Green Climate Fund" to help poorer countries leapfrog fossil fuels and transition straight to clean, renewable energy. He even vowed that he would claw it back if he was elected next year.

• As to Donald Trump's legal woes, the D.C. Circuit Court of Appeals is now moving at "lightning speed" [PDF] to hear (and almost certainly reject) the twice-impeached former President's appeal on "absolute immunity" from the rule of law, in which he claims that he had the right to break any law he wanted while serving as President of the United States. On Wednesday, in a separate case related to defamation claims by writer E. Jean Carrol (who a court previously found Trump liable for sexually abusing), the 2nd Circuit Court of Appeals rejected [PDF] a similar immunity claim. In yet another courtroom in Manhattan this week, testimony ended in Trump's New York State fraud trial, in which he and his companies and his two eldest sons have already been found guilty. The only question is on the penalties they will face. They are likely to be substantial, to say the least. The judge's ruling will likely come early in the new year.

• In a different D.C. courtroom, Georgia election worker Ruby Freeman testified on Wednesday in the defamation damages trial against one of Trump's sleazebag attorneys, Rudy Giuliani who, along with Trump, repeatedly lied about her and her daughter Shay Moss committing fraud while serving as election workers in Fulton County, Georgia in 2000 in the middle of a pandemic. Both Freeman and Moss were viciously targeted by Trump's supporters after the lies were told about them, and Freeman offered heartbreaking and harrowing testimony on Wednesday about the horrific threats she received from Trump's supporters and how their lives were turned upside-down in the bargain. Giuliani's attorney, Joseph Sibley, didn't even try to cross-examine Freeman. And, in his closing statement, reportedly agreed that the disgraced former NYC Mayor's behavior was appalling. His appeal to the jury was that Rudy is old, and they should try to remember that, decades ago following the 9/11 attacks, Giuliani wasn't as appalling. The jury may be more likely to remember last Monday, after the first day of trial this week, when Rudy repeated his pathetic false claims about the two women in front of cameras on the courthouse steps.

  Just like Trump on Monday in his NY fraud trial, after vowing to take the stand, Rudy didn't. Both cowards and liars.

  The U.S. District Court Judge overseeing the federal case has already determined Giuliani defamed the two women. The only question is how much Freeman and Moss will be awarded by a jury for their pain and suffering (they are seeking as much as $43 million) and for additional punitive damages. If it will "be the end of Mr. Giuliani," as his attorney warned, it won't come soon enough. But it's unlikely to be the end. He still faces criminal charges [PDF] in GA for attempting to steal the 2020 election there; billion dollar defamation lawsuits from Smartmatic and Dominion Voting Systems; and a grotesque sexual assault suit by his longtime personal assistant, among other legal woes.

• A listener in Amsterdam writes in this week to correct us on a small, but important, error we offered this week regarding last month's shocking electoral victory in The Netherlands' parliament for the far-right political party of anti-immigrant extremist Geert Wilders.

A whole lot of climate related political news converges on today's BradCast. [Audio link to full show follows below this summary.]

You'll not be shocked to learn that Donald Trump is still lying to his followers about climate change, clean renewable energy and electrification. No, as he lied during a recent rally in Texas, California didn't experience "blackouts all over the place this summer". We had zero, in fact, thanks to renewable energy and battery storage, and haven't had one since 2020.

Sadly, however, Trump is hardly the only Republican politician willing to hoax his own supporters on behalf of the deadly fossil fuel industry which funds so much of the party. At last week's GOP Presidential Primary Debate in Miami --- of all places --- none of the candidates even mentioned climate and, shamefully, neither did the NBC News moderators, who failed to ask a single question about the most existential crisis facing our planet. In Miami!

But the facts about the climate crisis, caused largely by the burning of coal, oil and natural gas, continue to flood in, along with our rising and warming seas, whether any particularly party remains in denial or not. On Tuesday, the U.S. Government released its Fifth National Climate Assessment, a 37-chapter, 2,200-page report which includes an interactive atlas that allows users to zoom down to the county level across a nation where warming is far outpacing the global average.

Climate related disasters are touching every corner of the country, and --- in addition to lives lost --- it's costing an extraordinary amount of money. Last year alone cost U.S. tax payers $178 billion in damage from climate-fueled storms, wildfires and droughts, etc. The new report, as terrifying as it may be, is also hopeful, as it details how it is still not too late to implement already existing tools to mitigate at least the worst of the dangers still to come.

And, on Tuesday, the world may have received a big boost toward that goal, with an announcement by the U.S. and China, in advance of President Biden's meeting today with President Xi Jinping, that the two nations have agreed to jointly ramp up the use of wind, solar and other renewable energy in hopes of displacing fossil fuels in the near future. That's a big deal, as both countries agreed to "pursue efforts to triple renewable energy capacity globally by 2030."

But how do we overcome GOP fossil-fuel funded intransigence (and lies) which have made China very wary that any agreement struck now with the U.S. may not be honored if Democrats are displaced from the White House in the future?

That remains a challenge. But there may be a glimmer of hope for the GOP, as a recent op-ed at The Hill details "The global climate solution Republicans have been looking for". What is that solution? A bill recently introduced by three Senate Republicans --- Bill Cassidy (LA), Lindsey Graham (SC), and Roger Wicker (MS) --- called the Foreign Pollution Fee Act of 2023.

What would it do? It would impose a fee on imports of certain carbon-intensive products manufactured in nations without the same kind of environmental regulations that make similar products more expensive to produce in the U.S. Several weeks ago, the European Union announced a similar tax that puts a fair price on carbon emitted during production of goods that are imported into the EU. They call theirs a Carbon Border Adjustment Mechanism.

Its sounds kind of geeky, but only because it is. It would, however, according to my guests today, both help to lower emissions around the world and bring overseas jobs back to the U.S.

We're joined today by MATTHEW LEE, author of the aforementioned opinion piece at The Hill and a Federal Policy Specialist at the non-profit Evangelical Environmental Network (EEN). We're also happy to be joined by REV. DR. JESSICA MOERMAN, President and CEO of EEN, which has long carried out the mission of educating and mobilizing evangelical Christians to reclaim the Biblical mandate of caring for creation and working toward a healthy, stable climate.

Lee explains the Republicans' policy proposal, how it would work, and what it hopes to accomplish. Moerman, who, as it turns out, is also (helpfully) a Ph.D. in Earth and Atmospheric Sciences, also offers her insights into this week's alarming Climate Assessment Report. She was at the White House on Tuesday when the report was released, and when Biden announced $6 billion in new investments to help mitigate the worst of the climate challenges we are all facing.

"For many decades, our country has had higher environmental standards than other countries," Lee tells me today. "American products are among the cleanest in the world. The problem is that because our companies are held to higher standards, there's an incentive for companies to offshore their factories and take advantage of looser regulations abroad in order to increase profits. This is a problem that a carbon border adjustment or foreign pollution fee, or whatever you want to call it, addresses. If companies have an incentive to offshore their factories to take advantage of looser regulations abroad, let's just charge them a fee when they want to import their products back to the U.S."

"Fossil fuel pollution killed 8 million people around the world --- that accounts for 1 in 5 deaths --- in 2018," Lee says. "If there's any way that we can use our policies to incentivize foreign governments to do better in protecting the health and lives of their citizens and children everywhere, that's something that we should get behind. That's something that Republicans would totally get behind, evangelicals, and anyone who really cares for the health and lives of people around the world."

For her part, Moerman assures me this Republican proposal has no poison pills we might otherwise expect from a "Republican climate bill". "I understand your skepticism," she says. "As we are looking at policy options, we always look at, first, does it defend life? Does it make sure that it's defending the health and livelihoods of all people? Does it protect the environment or, as we see it, God's Creation? And, also, does it support those family-sustaining careers in the clean economy? This one checks all of those boxes."

In speaking about evangelical community's move to the political right in recent decades, Moerman contends "we are seeing a real shift in our community. As evangelicals, we are people who take the Bible seriously. That means we also have to take seriously our biblical mandate to care for God's Creation." She explains that progress is being made in her community "whenever we talk about it in this framing. Take climate out of the partisan political space, the culture war space, and really root it in scripture, in our faith of following through on our values of honoring God, by taking that stewardship mandate seriously. And also loving our neighbor by ensuring that they have that healthy environment and safe climate to thrive in."

Will it work? Will Republicans in Congress take hold of that mandate when, as Moerman notes, "20% of deaths [across the world] can be attributed to fossil fuel pollution"? She says the U.S. steel, aluminum and even oil and gas industry is supporting the bill, "so that should make Republicans pay attention."

We'll see. I remain skeptical, but hopeful. Lee says that Wicker has taken his name off the measure, so we'll see if that is a bad omen. But, we've got to do something, at this point, and we need to do it fast. At least if "God's Creation" might have a chance of surviving our ever-worsening climate nightmares...

Among our stories, first grim, and then much less so, today...

• We begin with the horrible news out of Lewiston, Maine, following Wednesday night's mass shootings that have, so far, resulted in 18 dead and another 13 wounded, with several still in critical condition. The state was largely shut down as of airtime, with a broad, statewide manhunt underway for the suspect who is alleged to have had serious mental health issues...but was still able to obtain a deadly, high-powered, military-style assault rifle for his rampage somehow, because...freedom!

• Similarly grim news out of Acapulco, where a climate change-fueled Hurricane Otis experienced explosive intensification off the Pacific Coast this week, as it spun up from Tropical Storm to a catastrophic Category 5 in just twelve hours time. As of airtime, 27 were confirmed dead in Mexico, with searches underway for more missing as authorities struggle to clear major roads of knee-deep mud and restore power to the battered resort city and nearby villages.

• All of that, amid what is likely to be the hottest year ever recorded, as Republicans in the U.S. House just elected a long-time climate science denier from the oil and gas state of Louisiana to be House Speaker. Rep. Mike Johnson received more money last year from the fossil fuel industry than any other. Since 2018, the far-right religious zealot has received some $240,000 from the industry. Some of it, as it turns out, came --- unlawfully --- from Russian oligarchs, according to FEC investigators last year.

• IN BRIGHTER NEWS...A federal judge in Georgia has ordered the state's legislature to reconvene to redraw its Congressional and state legislative maps before 2024, after being found in violation of the Voting Rights Act. The state must now add new Black-majority voting districts to all three of its maps. The judge's 516-page(!) ruling [PDF] issued today, finds the Republican-controlled legislature drew new maps following the 2020 Census which completely ignored the fact that ALL of the state's population growth since 2010 has been among the non-white population. U.S. District Judge Steven Jones has ordered one new Black-majority Congressional district, two new districts in the state Senate, and five for the state House by December 8, or he would have the maps drawn himself.

• More good news for U.S. Constitution lovers, this time in Colorado, where a state judge ruled on Wednesday that Section 3 of the 14th Amendment, the "Insurrectionist Disqualification Clause", is self-executing. In other words, public officials who have "engaged in insurrection" are simply disqualified from running for public office, even without a federal law detailing precise enforcement of the provision. Donald Trump, whose qualifications for the 2024 Presidential ballot have been challenged in a state lawsuit, argued to the contrary. But he lost. Next week, a hearing will be held to determine if the former President "engaged in insurrection", as per the Constitutional Amendment. Similar challenges to Trump's eligibility for office are also pending in Michigan and Minnesota.

• And good news for striking autoworkers, as the United Auto Workers union announced on Wednesday night that they reached a tentative agreement with Ford. The new four-year contract, if approved by workers, will boost base pay by at least 25%, increase starting hourly wages to $28/hour and includes a myriad of other benefits sought by the labor union. It is hoped that the agreement will also pressure management for a similar contract at the other two "Big Three" automakers, G.M. and Stellantis, where the UAW also began its walk-outs about six weeks ago. Chalk up yet another in a series of very big wins for organized labor over the past year!

Former Trump attorney Sidney Powell pleaded guilty in Fulton County, Georgia today. She was the second of 19 co-defendants to do so in District Attorney Fani Willis' sprawling racketeering indictment [PDF] against Donald Trump and his alleged co-conspirators who tried, but failed, to steal the 2020 Presidential election in the Peach State.

Powell is, perhaps, most notorious for her so-called "Kraken" lawsuits filed after 2020, which she promised would expose evidence of massive Democratic fraud in several states. Her suits includes no such evidence and were all quickly dismissed. Her claims, for example, that dead Venezuelan President Hugo Chavez was somehow involved in stealing the election with voting machines --- in which Powell bastardized and misused some of my own accurate exclusive reporting on Dominion Voting Systems circa 2010 --- all turned out to be false.

But, as our guest today helped reveal earlier this year, Powell also organized and paid for a scheme to breach proprietary statewide voting system software in Coffee County, unlawfully make copies of it and distribute it across the Internet to sources still unknown. She was indicted by Willis on 7 felony counts related to that plot and, today, pleaded guilty to 6 misdemeanor charges that would keep her out of jail and on probation for 6 years, with the requirement that she cooperate fully with prosecutors and testify truthfully against her 17 remaining co-defendants still facing felony charges. Scott Hall, an Atlanta bail bondsman who initially confessed to the plot in Coffee County during a recorded phone call to frequent BradCast guest Marilyn Marks, as first aired on this program, pleaded guilty earlier this month and is also cooperating with prosecutors as part of his plea deal.

We're joined today for both a bit of a victory lap and a very serious warning by SUSAN GREENHALGH, longtime election integrity expert and Senior Advisor on Election Security at the non-partisan Free Speech for People. With Marks, whose Coalition for Good Governance has a long-running lawsuit against GA Sec. of State Brad Raffensperger, seeking to replace the state's touchscreen voting machines with hand-marked paper ballots, Greenhalgh helped reveal that the plot to breach the voting systems in GA was actually part of a broader, multi-state conspiracy hatched during an infamous December 18, 2020 meeting with Trump in the Oval Office. In addition to Powell, co-defendant Rudy Giuliani, disgraced former National Security Advisor Michael Flynn and others on Team MAGA were there that night, hoping that Trump would issue an Executive Order for the military to seize the nation's voting machines. Instead, they settled on the Coffee County scheme and others like it in several other states.

"We know that [Powell's] been involved in voting system software breaches in other states, like in Michigan," Greenhalgh explains today. "But Sidney hasn't been charged there. It's important to keep in mind that this was a networked, coordinated, multi-pronged plan to get access to voting systems in multiple states that she was a part of, and she really shouldn't escape responsibility for her role in those alleged criminal activities in other states."

Greenhalgh recently co-wrote a piece at Slate, calling on the U.S. Justice Department to launch a probe into the multi-state scheme which, she explains today, still poses a very serious threat to the 2024 elections. "Suppose there was a plutonium laboratory that had a robbery, and your local police prosecuted the thieves and the people that let them in. You wouldn't expect them to stop there. You'd expect the feds to go out and find out who got the plutonium and what was the plan to do with it. That's the kind of investigation that we need right now."

For today, at least, the guilty plea by Powell was good news. Marks called it "eminently important...for raising public awareness of the seriousness of the offense that puts Georgia’s 2024 elections at risk because Powell’s team released Georgia’s software into the wild."

As we've discussed with Marks on the program many times, however, Raffensperger has taken no action and has arguably helped cover up the Coffee County breach from the jump. "While Georgia’s Secretary of State has turned a blind eye and declined to either investigate or mitigate this massive security failure," Marks said in a statement today, "at least DA Willis is holding some of the ring leaders accountable in ways that will certainly expose other actors’ wrongdoing in this unlawful attempt to subvert the 2020 election."

For her part, Greenhalgh says today that, though she "was surprised at how lenient the deal is", she is hoping that Powell's guilty plea is "really going to bring the goods" on the multi-state plot and, of course, the involvement of higher-ups in the food chain like Trump and Giuliani.

Greenhalgh encourages listeners to contact their members of Congress to insist they take action on the ongoing threats posed to our voting systems by the breaches in Coffee County and elsewhere before 2024.

Given the mind-blowing and ongoing dysfunction in the GOP-run U.S. House right now, however, amid the Republican Party's continuing inability to choose a Speaker --- as we also discuss on today's show --- it's unlikely that there will be any kind of hearings or anything else there for quite some time.
