The accountability train and unionization train are both chugging forward on today's BradCast. So, that's a good thing! And we've also got a news-packed catch-up episode of the Green News Report following our week off last week. [Audio link to full show is posted below this summary.]

First up, after losing at the U.S. District Court level, Donald Trump had his day before a three-judge panel at the D.C. Circuit Court of Appeals on Tuesday. He is still attempting to block the release of his White House documents related to the attack on the U.S. Capitol which he incited on January 6th in his desperate, last ditch effort to steal the 2020 election. The former President is claiming "executive privilege" to block the release of hundreds of documents, even though he is no longer President or, as the lower court judge declared just weeks ago: "Presidents are not kings and plaintiff is not President". The current President, Joe Biden, has rejected Trump's plea to invoke executive privilege to block the release of the White House records subpoenaed by the bipartisan U.S. House Select Committee investigating the January 6 attack. We detail today's hearing and the arguments made in court on both sides.

Next, in related news, Trump's former Chief of Staff, Mark Meadows, has also been subpoenaed for both documents and testimony by the House Select Committee. Like Steve Bannon before him, Meadows previously ignored those subpoenas, also claiming "executive privilege". But now that Bannon has been indicted on two federal counts of Contempt of Congress for having done so, Meadows appears to be having second thoughts. The Committee now says Meadows is cooperating and plans to sit for a deposition. The question remains as to how much he will actually share with the Committee, which still seems prepared to pull the "Contempt" trigger against him, if necessary.

Also coming up in related accountability news this week: A likely Contempt referral for low-level DoJ Trump lackey Jeffrey Clark, who the disgraced former President almost elevated to Attorney General just prior to January 6th attack, due to his willingness to lie to state legislatures that the DoJ had found fraud in the 2020 election. They didn't. Now, Clark has been refusing fully respond to the Committee's subpoenas and will hopefully pay a price for it in the coming days.

Meanwhile, in some good labor news on Monday, the National Labor Relations Board (NLRB) found in favor of the Retail, Wholesale and Department Store Union (RWDSU)'s complaint that retail giant Amazon unlawfully gamed a unionization vote at its Bessemer, Alabama warehouse earlier this year. The NLRB has now ordered a re-vote for workers this Spring, after they voted against unionization by a 2 to 1 margin following months of pressure, weekly mandatory meetings with anti-union consultants, and all other forms or propaganda from the company during the initial election.

We're joined to discuss the (seemingly) good news from the NLRB by longtime labor historian, author and Distinguished Professor at UC Santa Barbara, NELSON LICHTENSTEIN, who joined us earlier this year to discuss the initial, now nullified unionization vote in Bessemer.

The colorful Lichtenstein explains the history of similar revotes, how frequently they are ordered by the federal labor board and what the odds are of the union winning this time, given the nearly 100 percent turnover in workers at the e-commerce giant's Alabama fulfillment center since the initial vote last March. He also explains that while the NLRB found a number of violations by the company, most of the egregious stuff they did to intimidate workers --- including one-on-one pressure sessions, anti-union propaganda posted in restrooms, offers of $1,000 to quit --- is almost all actually legal under current federal law.

"Once Amazon realized that probably the election would be overturned, they once again began to hold these captive audience meetings," says Lichtenstein. "These are meetings that are called by the company as they lecture to the workers why a union is a bad thing. They're really closer to Maoist re-education camps or Stalinist coercion methods than anything else. That is happening as we speak. Plus, Amazon is also keeping tabs on who the union activists are."

"All this," he argues, "points out that we really need a completely fundamental and radical change in the labor law. And more than just the labor law --- in the whole ethos that surrounds the idea of workers having rights, a voice, and having a union."

As it turns out, there is a new labor law, the Protect the Right to Organize (or PRO) Act, currently pending in Congress. "It would make illegal these captive audience meetings, which are very, very intimidating and authoritarian. It would eliminate that. It would also increase the penalties --- the financial penalties --- on companies for violating the labor law," notes Lichtenstein, the author of some 16 books related to these issues. "Right now, how much does Amazon have to pay for its violation of the labor law, which is creating this new election? Zero. The penalties are utterly trivial."

But the odds for passage of the PRO Act at this time remain long, Lichtenstein concedes. That said, he also notes that both the recently signed bipartisan infrastructure bill and Joe Biden's still-pending Build Back Better social safety net and climate action proposal have quite a few measures that support union labor.

As the "Great Resignation" continues for workers who are finding opportunities with better pay and benefits elsewhere, while the nation tries to move on from the pandemic, Lichtenstein (who recently compared the situation to opportunities for former slaves during the Civil War reconstruction era in a Washington Post op-ed) does suggest a potential way forward for anti-union companies that now face threats of being broken up by Biden's aggressive appointees at federal agencies such as the Federal Trade Commission.

"What needs to happen is this," Lichtenstein advises, "you need to make management come to the conclusion that the lesser evil, the lesser problem in their business model, would be recognizing the union rather than facing the ire of either an aroused public or government action." He tells us that Amazon, Facebook and other Silicon Valley firms are facing a "re-invigoration of anti-trust law in the Biden Administration," which he describes as "actually very pro-labor."

Those companies, he notes, could use some friends, "and an essential ally is labor." Lichtenstein details how such alliances prevented the breakup of big chain stores under anti-trust laws in the 1930s and even at General Motors in the 1950s. "Companies like that said to the labor movement, 'Well, we'll recognize you, if you let us stay big.' And that happened!"

After five years of underestimating Donald Trump, and nearly a full year since he tried to steal the 2020 election, you'd think the media would "get it" by now. But, according to our guest on today's BradCast, the national press is still under-appreciating and under-reporting the very real threat that Trump and his far-right radicalized Republican Party now represent to democracy itself. And maybe that's on purpose. [Audio link to full show follows below this summary.]

But first up, some brighter news. President Biden has now reversed Trump's unprecedented (and likely unlawful) rollback of protected public lands established by his predecessors in three different national monuments. On Friday, Biden restored environmental protections for millions of acres of pristine expanses and sacred tribal lands at Bears Ears and Grand Staircase-Escalante national monuments in Utah, and the Northeast Canyons and Seamounts marine monument off the coast of New England. Deb Haaland, the nation's first native American Interior Secretary, was justifiably emotional about today's return of protection from mining, drilling and other development for millions of acres of sacred lands and architectural treasures. Biden's rollback of Trump's order, however, left in place a small parcel of acreage newly established as protected public lands by the former President at Bears Ears. So that national monument is now even larger than it was before Trump attempted to sell it off to his investors. Add it to the long list of losses for our loser former President.

And here's another. New documents released by the U.S. House Committee on Oversight on Friday reveal that Trump's company concealed losses of more than $70 million on his D.C. hotel during his four years in office, even while a major part of the business at the Trump International Hotel at the old D.C. post office building came from foreign governments, as well as lobbyists and businesses hoping to curry favor with the disgraced President.  All of that, as Trump attempted to portray the project publicly as a stunning success while the Trump Organization had to quietly pump in more than $24 million dollars to it to cover losses, and as Deutsche Bank, according to the Democratic Committee co-chairs, offered "undisclosed preferential treatment" on a $170 million loan for the project that had been personally guaranteed by Trump. The Trump Organization is now desperate to find a buy to unload the loser project, but there are reportedly few takers as the current, inflated asking price.

While the media failed to adequately sound the alarm about a Trump property just blocks from the White House used as a deposit box for unconstitutional payments to the President from foreign governments, businesses, lobbyists and party faithful during his tenure in the White House, are they doing any better in raising what should be an even louder alarm following the past year of Trump attempting to steal a second term while directing supporters to attack the U.S. Capitol itself to block the Constitutional transfer of power on January 6th?

Our guest today, longtime media analyst ERIC BOEHLERT argues the mainstream corporate media appear to have learned next to nothing. More insidiously, he suggests, they are even "purposely" ignoring what he describes in a PressRun newsletter this week as "the clarion calls of democratic doom." That, despite alarm bells and clear signs that American democracy is facing an unprecedented internal threat from the rise of rightwing authoritarianism. "America isn’t guaranteed a happy ending," he writes, "although most of us grew up with the shared assumption that it was."

"There's a failure of imagination, but I feel like it's a purposeful failure of imagination," among the press, he tells us today, citing what he sees as the media's vested interest in the return of Trump as a candidate and even as President in a second term.  "After the election, long before the insurrection, Trump was doing everything in his power, as we now know more and more" to try and overturn --- yes, to steal --- Joe Biden's election victory. "But in November and December of 2020, Politico called it 'bad sportsmanship.'  There was lots of media coverage on he was 'sulking' in the White House. Basically the media's narrative was 'Just give him some time. He's mad. He's upset he lost. No big deal. He's not going to try to steal the election. The Republican Party would never do that,' etc. And we know how that unfolded."

But, nearly one year and an attempted U.S. Capitol insurrection later, the "purposeful failure of imagination" by the press still persists, he charges. Given all of the many signs of increasing political violence and radicalism from the Right and the Republican Party itself, how should the press be appropriately covering and warning about what appears to be going on in and our nation? How could they --- and we --- be doing a better job of adequately sounding the "fire alarm"?

Boehlert explains, and cites by way of one critical example, the media's fear of "taking sides", even when the two sides are no longer Democratic v. Republican parties, but democracy v. authoritarianism.  "'We can't take sides! If the Republican Party is anti-democracy, we can't be PRO-democracy, because that looks like we're opposing them! So we're just going to recede into the sidelines, and we'll give you updates every time they try to demolish our democracy.'"

"It's just this passive frog in the boiling water, the lack of clarity about authoritarianism in this country. This idea that it can't happen here, we are immune to this, we are immune to fascism, we are immune to authoritarianism. Oh sure, in the last ten years, it's happened in Hungary, it's happened in Poland, it's happened in Turkey. Those aren't us," he snarks. "We've been doing this for 270 years. No matter what Trump and the Republican Party hatch, this country is indestructible, this democracy is indestructible --- which is a complete fantasy."

With a long history of fossil fuel disasters up and down the California coastline, another one erupted over the weekend here in Southern California, as we discuss at the top of today's BradCast, along with the latest on the Congressional GOP Caucus threat to tank the U.S. economy by defaulting on trillions of dollars in debt they long ago agreed to incur.

First up, at least 126,000 gallons (approximately 3,000 barrels) of crude spilled into the ocean waters near Huntington Beach, California over the weekend, about 30 minutes south of Los Angeles. The full extent and cause of the damage is currently unknown as we went to air, but it includes a 13-square mile oil slick, dead birds and fish washing ashore, and sensitive ecological preserves along the coastline having been sullied by thick oil and tarballs.

The oil appears to have leaked from some part of a 17.5 mile pipeline which has extended, since the 1980s, from oil drilling and production platforms more than 3 miles offshore, in federal waters overseen by the U.S. Dept. of Interior. The pipeline is one of hundreds running up and down the oil rich CA coastline, where the state has banned new fossil fuel infrastructure, but where, as our guest notes today, the Trump Administration attempted to open up still more dangerous oil production over the past four years. The U.S. Coast Guard is now investigating whether a ship anchor dragging on the ocean floor may have caused the rupture.

We're joined on the program by LAURA DEEHAN, State Director of the non-profit Environment California, for the latest on the state's most recent fossil fuel disaster and what can and should be done about it moving forward.

"We need to get to the bottom of what's happened here," she tells us, adding: "I think our immediate concern is let's protect the wildlife, let's minimize the damage to our beaches and coastline as much as we can right now. But ultimately, of course, we're calling for a permanent end to this activity. Because clearly enough is enough."

Similar disasters have been killing wildlife and covering Southern California beaches in sticky, toxic tarballs for decades. The current spill has now shut down the tourism rich beaches of Huntington Beach, resulted in the cancellation of the third day of an air show on Sunday featuring the Blue Angeles and some 1.5 million spectators, and may similarly affect other beaches in the area from Long Beach to Newport Beach in Orange County in the coming days.

Deehan confirmed that the sensitive, 25-acre Talbert Marsh ecological reserve near Huntington Beach has now been sullied, threatening the lives of dozens of rare and endangered birds and other species. "We clearly need to end our dependence on oil to power our lives as fast as possible. So, we're calling for an end to drilling of the California coast," she explains. "Our coastline is too precious, it's too vulnerable, and we need to prevent anything like this from happening ever again."

So, who is to blame here? The private companies who run the platforms and pipelines (the Elly platform near where the leak occurred is run by a company named Beta Offshore, which is owned by another named Amplify Energy Corp.) Or is the state and/or federal government to blame? It took nearly 24 hours after residents smelled petroleum fumes and reported boats coming into docks with oiled hulls before a response was mounted and the pipeline, eventually, shut down. Dolphins and whales have reportedly been seen swimming through the oil slick ever since.

We discuss all of that and how the Biden Build Back Better agenda, supported by almost the entirety of the Congressional Democratic Caucus, might help to begin making all of these recurring disasters a thing of the past. Eventually. If Dems can overcome a handful of party obstructionists, which largely amount to two Senators, Joe Manchin from West Virginia coal country and Kyrsten Sinema of Arizona.

"When you think about the consequences of NOT ending our dependence on oil, I really think the costs to our society are so much greater," Deehan argues. "We can no longer afford to have these significant negative events, like a massive oil spill off our coast. There are economic impacts from that, too. The coastal communities, the people who want to be able to go surfing, the people who want to visit our Southern California beaches, the tourism industry, the fishing industry. All of these industries are going to lose a lot from this event."

As you might imagine, we'll be keeping our eye on that mess. But, next today, we head back to D.C. for the latest in the GOP's threat to tank the entire U.S. economy --- and the world's with it --- by obstructing Democratic efforts to lift the debt ceiling in order to continue paying off our already existing debt (including $8 trillion in deficit spending approved by Congress during the Trump Administration). The stakes are nothing less than the avoidance of a global fiscal calamity if the U.S. defaults on its debt for the first time in history, as of October 18. President Biden called out Republicans at the White House today for their brinkmanship, asking them to "get out of the way" if they won't help, and arguing that a "meteor is headed to crash into our economy" while the GOP plays "Russian Roulette" with it. Over the weekend, Democratic Senate Majority Whip Dick Durbin of Illinois called out Minority Leader Mitch McConnell for "playing games with a loaded weapon".

Defamation case discovery unearths new details on Trump's attempt to steal the 2020 election; Also: More Trump crime and accountability news...

Of course they knew they were lying at the time. The pathetic thing is, their supporters who they continue to dupe, still believe the lies even today! But just in case anyone needs actual proof of Team Trump's attempt to use a Big Lie to try and steal the 2020 election, new evidence discussed on today's BradCast has been unearthed via the discovery process in one of the many defamation cases now filed against the Trump Campaign and their lawyers, Rudy Giuliani and Sidney Powell. [Audio to full show is posted at the end of this summary.]

According to a report from the New York Times today, a memo written by the Campaign in November, included in a recent motion filed by former Dominion Voting Systems employee Eric Coomer, reveals that even while Trump's attorneys were lying to the public about Dominion having stolen the election (so they could try and steal it themselves) via an insane, evidence-free conspiracy theory involving hacked voting machines, George Soros, China, Cuba, Venezuela and its dead President Hugo Chavez (among others), the Campaign knew it was all nonsense.

None of it stopped their attorney from continuing to try and steal the 2020 election anyway, nor from defaming Dominion (which is suing a bunch of them, along with Fox "News" and other far-right outlets) nor Coomer, its former director of product strategy and security, who they falsely claimed to have been key to Dominion's non-existent strategy to hack the election for Joe Biden. Oh, and the Trumpers also falsely claim that Coomer revealed the whole plot while on a recorded conference call with "antifa", with whom he was supposedly a "member," according to the ridiculous MAGA mob claims....even though there is no such actual organization (and, apparently, no such actual recording. Go figure!)

The Dominion/Venezuela/Hugo Chavez part of the story - which also involves another company named Sequoia, which is suing for defamation as well, and has even LESS to do with any theft of 2020 --- is somewhat our fault. The Powell/Giuliani lies about Venezuela and Chavez and Dominion and Smartmatic were spun from a twisted and bastardized version of my exclusive, investigative reporting from 2008 to 2010. (Reporting that was well-sourced, accurate, independently verifiable, and which happily still stand by.) Thus, we spend some time unpacking the latest revelations in this story for you today, as twisted as it all is.

That story, in turn, helps us kick off a host of fresh accountability-related stories today that are unlikely to end well for any of the Trumpers. Among them...

  • Republican Senators (and Trump lackeys) Lindsey Graham and Mike Lee also didn't buy the bogus fraud narrative that the Trump White House and Campaign were selling, according to Bob Woodward and Robert Costa's new book, Peril. Not that that prevented Graham from tossing in with the criminal conspiracy in Georgia with Trump, Giuliani and others, to try and steal the election in the state. That criminal conspiracy is currently being investigated by Atlanta's Fulton County District Attorney.
  • During a routine scheduling hearing in New York state court, the lawyer for Allen Weisselberg, the Chief Financial Officer at the Trump Organization, who has been indicted along with the company on several felony charges related to an alleged, long-running, tax fraud scheme, described as "sweeping and audacious" by state prosecutors, revealed that new indictments may be coming in the case. Little more was offered as far as who might be indicted and on what basis the attorney made his claims, but there ya go. In the meantime, the judge has pushed the next hearing to July of next year to allow Weisselberg time to review some 6 million pages of documents submitted as evidence in the case, pushing any trial to August or September of 2022 at the earliest. That, of course, presumes Weisselberg, who has worked at the Trump Organization for five decades, doesn't decide to flip on his boss before then to avoid huge fines and years in prison.
  • As to fines (and legal fees) that Trump and/or his businesses may have to cough up, given all of the ongoing legal battles they are defending against, that could become a very big problem for the disgraced former President as well. According to new reporting, occupancy rates are plummeting at Trump's properties, including his headquarters Trump Tower in New York and his tower in Chicago. A $100 million loan for the Fifth Avenue building in NYC has now been placed onto a "debt watch list" by the loan's master servicer, Wells Fargo, due to the quickly falling occupancy rate in the building since the end of last year. And that comes as Trump is reportedly personally on the hook for loans up to $400 million coming due in the next couple of years.
  • And, if you think it's time for us to move on from Trump accountability coverage since he's no longer in officer, well, we've got some bad news for you. We haven't even given up yet on George W. Bush accountability news! Happily, he faced a bit of accountability this weekend for his years of unprosecuted war crimes, courtesy of a U.S. Iraq war vet this past weekend in Los Angeles. We've got the play-by-play.
  • Finally, Desi Doyen joins us for our latest Green News Report, with good news and bad (mostly bad) as the U.N. General Assembly meets this week in New York and much more. Also, remember when the Trump Administration moved the Bureau of Land Management headquarters from D.C. to Grand Junction, Colorado in 2019 to try and pretty much kill the federal agency? Well, that largely worked, with nearly 300 experts, scientists and other employees who chose to resign or retire rather than move their lives across the country for no legitimate reason. Now the Biden Administration's Interior Department is moving the BLM back to D.C.
