So far, so good. Neither Joe Biden nor Chuck Schumer nor Nancy Pelosi seem to be falling for the GOP's "conservative" budget concerns, newly rediscovered by the Party now that there's a Dem in the White House.  Also on today's BradCast, the stage gets set for next week's historic second Impeachment Trial of disgraced former President Donald Trump. [Audio link to full show follows summary below.]

A study last December from economists at the London School of Economics and King's College London looked at 18 developed countries over a 50 year period from 1965 to 2015 to find out if tax cuts actually "trickle down" to improve economic outcomes. You'll be "shocked" to hear the results. Tax cuts in the nations examined (including the U.S.), do not improve either GDP or unemployment rates.  They do, however, help the wealthy to become wealthier --- by a lot --- while increasing economic inequality.

That report may have come in useful as President Biden was considering a proposal from 10 Republican Senators at the White House on Monday night to slash his proposed $1.9 trillion COVID relief and stimulus bill down to about $600 billion, or one-third of what Biden and the Dems are proposing. The GOP proposal leaves out a lot of much-needed funding from Biden's proposal for no apparent reason, other than Republicans are pretending to be concerned about spending and deficits again --- a concern they decidedly did not remember to have when they gave away much more with their $2.3 trillion tax cuts mostly to the rich during Donald Trump's Administration.

The good news today is that the White House is moving ahead with their planned $1.9 trillion proposal, and both  Senate Majority Leader Chuck Schumer and House Speaker Nancy Pelosi have queued up the measure to be quickly adopted under Budget Reconciliation procedures which require only a simple majority vote in the Senate. No need to overcome a filibuster with 60 votes.  Now we just have to see if conservative Democratic Sen. Joe Manchin of West Virginia decides to play along. He certainly should, given that his state's own Republican Governor is calling on Biden to "go big" in his COVID relief package.

With things moving encouragingly forward, at least for the moment, with the new President and Dem control of both houses of Congress, we turn back to the disastrous previous President, who helped get us into all of these messes.

To help set the stage, we share an extended excerpt from an hour-long live Instagram video by Rep. Alexandria Ocasio-Cortez (D-NY) on Monday night. She detailed for the first time, her harrowing experience on January 6th, describing how she was forced to hide in the dark behind the bathroom door in her personal office at the Capitol, as the murderous and attempted insurrection by Trump's MAGA Mob was underway. As she makes clear, she had very good reason to fear for her life and is still reeling from the trauma of that day.

Trump's second Impeachment Trial, for "Incitement of Insurrection" at the U.S. Capitol that day, is set to begin next week in the Senate. Both the Democratic House Impeachment Managers and Trump's brand new attorneys (all five of his previous ones left him over the weekend) submitted their pre-trial filings on Tuesday. The 80-page Dem memorandum [PDF] lays out the House's case against Trump, alleging he falsely worked his supporters into an outrage over many months --- even before Election Day, as early as last summer --- with baseless claims of a stolen election. He then "aimed them like a loaded cannon down Pennsylvania Avenue" toward the Capitol on January 6th with instructions to "fight like hell" as a Joint Session of Congress was underway to affirm the 2020 Presidential election results. They offer a graphic, detailed, painstakingly-documented argument for Trump's conviction and a thorough response to the false GOP claim that it is somehow unconstitutional to hold an Impeachment Trial after the impeached officer in question has left office.

"If the Senate does not try President Trump (and convict him) it risks declaring to all future Presidents that there will be no consequences, no accountability, indeed no Congressional response at all if they violate their Oath to ‘preserve, protect and defend the Constitution’ in their final weeks," the House Managers write. "There is no ‘January Exception’ to impeachment or any other provision of the Constitution," they explain, "A president must answer comprehensively for his conduct in office from his first day in office through his last."

For his part, Trump's 14-page response [PDF] is brief and unsurprisingly limp. He cites First Amendment Free Speech rights to support his evidence-free claims that the election was stolen from him and repeatedly claims --- over and over --- that the Senate trial is unconstitutional, since he is no longer in office. There is one point, regarding his personal (if evidence-free) belief that the election was stolen, that should be worth noting when it comes to the difficulty of public oversight and the availability of evidence regarding U.S. election results. Not that he bothered to actually try to get at most of what is available. Beyond that, however, its clear he is hoping that his fellow Republicans in the Senate remain captured, in his thrall and afraid of the wrath of his brain-poisoned supporters.

Our ongoing parallel coverage on The BradCast of the insane former President and the not-insane current President continues today, as one faces a decision whether to compromise with Republicans on COVID relief, and the other continues to dig his own grave even deeper while facing still more accountability for his disastrous Presidency. But first up, as COVID vaccinations get shut down in the Northeast due to a monster winter storm, anti-vaccination protesters and rightwing Trump-supporting extremist in sunny Los Angeles over the weekend temporarily shut down COVID vaccinations at Dodger Stadium. Because they are jackasses.

Speaking of jackasses, Donald Trump lost all five of his impeachment defense attorneys on Sunday, just days before his historic second impeachment trial is set to begin next week in the U.S. Senate --- this one, for "Incitement of Insurrection" at the U.S. Capitol on January 6th. The five, actually respectable attorneys, quit Team Trump, reportedly, because the former failed President insisted his impeachment defense should include his false claims that the election was stolen from him. The lawyers wanted to stick with the false argument that an Impeachment Trial after a President is out of office is somehow unconstitutional. But, no worries! Trump has reportedly replaced two of those attorneys already, with one who represented now-deceased sex trafficker Jeffrey Epstein and another who, as a state prosecutor in Pennsylvania, refused to file criminal charges against convicted sex predator Bill Cosby. Trump's new attorneys should be a match made in heaven for the disgraced former President and accused sex predator himself.

In the meantime, the accountability continues for Trump's business, as a New York Supreme Court Justice on Friday ordered the Trump Organization to turn over even more documents related to the ongoing civil bank and tax fraud investigation being carried out by the state's Attorney General. That probe is running parallel to a similar criminal investigation by the state prosecutor in Manhattan, into the 45th President's allegedly fraudulent activities. Trump continues to lose in court in virtually every single one of his challenges to both probes.

And, accountability continues at the same time for some of the thousands of those in the MAGA Mob who attended the U.S. Capitol insurrection, even if they didn't (apparently) join those breaking into the building to try and overturn the 2020 election. Just ask Mark Hastings, the CEO of an online bartending supply company who proudly posted his "Stop the Steal!" selfie from outside the Capitol on his Facebook page. Customers are now said to be leaving BarProducts.com in droves. He has since deleted the selfie, for some reason.

But while Trump is facing accountability, as are his supporters who attacked the U.S. Capitol, what of those officials in his Administration who quietly and dutifully served him for years as he separated immigrant children from their parents, helped killed hundreds of thousands by opportunistically treating COVID as a hoax, and incited an attempted insurrection?

Last week, non-partisan government watchdog groups Accountable.us and American Oversight launched a new campaign called CorporateComplicity.org to hold American corporate CEOs to account for hiring former senior Trump Administration officials. Accountable's LIZZY PRICE joins us today to explain the campaign, and the difference between the "cancel culture" Republicans are now whining about --- now that some are finally facing a few consequences for their actions --- and accountability. (Answer: None. Also, the irony of GOPers whining about "cancel culture" after years of boycotts against those with whom they disagreed politically, is laughable. Especially just days after the Arizona GOP voted to "cancel" (censure) their own Republican Governor Doug Ducey, their own former Republican Senator Jeff Flake, and even the late John McCain's wife Cindy for daring to oppose overturning the state's lawful election of Joe Biden last November.)

"There are three real fundamental foundations to this campaign. One, no one is guaranteed a cushy job just because they served in the Administration.  Two, actions have consequences.  And three, staff at any organization reflects their [organization's] values. We're trying to make it very clear to companies that your staff reflect your values. So to hire the architect of these harmful, anti-democratic policies and rhetoric is to be complicit in that, to take that on as your corporate identity," Price explains. "So we want to make that sure corporations really think hard about doing that."

"This isn't about 'cancel culture.'  It's about what kind of behavior and what kind of policies that you reward. Corporations have a part to play in making sure that Trump is not normalized. If these officials are welcomed back into high-profile jobs, it only encourages more bad behavior."

And what does the campaign plan to do, if companies ignore their friendly warning [PDF]? "We're saying, look, if you won't vet your candidates, we will.  And we'll use any tool in our toolbox to make sure the facts are out there," Price tells me.

Finally, we close with calls from listeners ringing in one whether they'd like to see President Biden compromise with Republicans on his proposed $1.9 trillion COVID relief package in order to see it passed with bipartisan support via regular order in the U.S. Senate, instead of by a simple majority vote under the Budget Reconciliation process. On Monday, the new President was meeting with 10 Republican Senators who proposed a $600 billion package on Sunday night --- about a third of the size of Biden's --- offering much less relief for the American people.

So, should Joe and the Dems move ahead with the much-needed package they ran and won on (including $1,400 relief checks for those making $75,000 or less) or a smaller package (with just $1,000 checks for those making $50,000 or less) to keep his promise of reaching out to try and find compromise with Republicans? Callers have a few thoughts on that, and we are with almost all of them...

It's only Day 3 for the Biden Administration, but it feels like Donald Trump has been gone for months. And that feels fantastic. On today's BradCast, we catch up with the new President's flurry of Executive Actions since taking office and the GOP's attempt to continue Senate dysfunction, even with Democrats now (theoretically) in the majority. Also today, some news on Donald Trump's upcoming second Senate Impeachment Trial, as House Speaker Nancy Pelosi announces plans to transmit Trump's latest Article of Impeachment --- for "Incitement of Insurrection" --- to the upper chamber on Monday. And we've got more good news on Trump's crumbling empire, with more banks and law firms having dumped the toxic former President and his company following his incitement of the attempted U.S. Capitol insurrection by MAGA Mobsters on January 6.

We're joined today by progressive financial journalist and author DAVID DAYEN, Executive Editor of The American Prospect and author of its new, daily, FIRST 100 newsletter. Dayen, whose magazine has devoted no small amount of the past year toward detailing a progressive Day One Agenda for the new Democratic President, offers his take on President Biden's first (less-than-half) week in office, the corporate media's curious adjustments in covering a new Administration, and Mitch McConnell's attempt at delaying the full turn over of the Senate to Democrats.

While he remains cautious this early in the Administration, Dayen notes that he has been pleased, so far, with their "unwillingness to get caught up in a Fox News game of worrying about 'optics'" and indications that Biden, to date, is "not going to get sucked into a deficit hawk argument."

After a year covering the COVID crisis for his magazine, Dayen also offers a prescription for how to get both new relief checks and vaccine shots to the American people as quickly as possible while Republicans balk at Biden's critical $1.9 trillion COVID relief proposal and even attempt to stymie a power-sharing deal in the 50/50 Senate unless Dems agree to not do away with the democracy-stifling legislative filibuster.

So far, Dayen observes, Senate Democrats appear unwilling to give up the leverage of potentially doing away with the filibuster. "There's nothing in it" for them, he says, adding "Schumer has been insistent that he's not going to take that deal." There's a bit more good news to end your week for now.

Finally, we close a remarkable and historic week --- the last one to include Donald Trump as President of the United States (was that still this week?!) --- with some prescient thoughts from Jon Stewart, as shared with Steven Colbert just 11 days into the then-nascent but already-exhausting Trump Administration, from January 31, 2017...

On today's BradCast: Now that the new Administration is actually inside the White House, the extent of the unspeakable mess left behind by the previous occupants are only just now beginning to come to light. [Audio link to show follows summary below.]

When it comes to the still-worsening COVID crisis --- just one of the several crises left for President Biden to clean up in the wake of the unprecedented failures of the Trump Administration --- apparently it's all much worse than feared. There was, reportedly, no coordinated effort in place at all to deal with national distribution of vaccines, nor to deal with the difficult task of safely reopening schools and businesses in hopes of reviving the still-worsening economic crisis that Trump and Congressional Republicans also left behind for the new Democratic Administration to clean up as well.

After yet another Democratic President is left to clean up yet another economic disaster following yet another Republican Administration, one might wonder why it is that Americans and many in the media continue to falsely suggest the GOP is the party of fiscal responsibility, when they are clearly the complete opposite. I've got a thought or two today on how that scam continues, year after year after year, despite actual facts to the contrary.

Among the many stories covered on today's program, as the "clean up on aisle 45" gets under way on the first full day of the new Biden Administration...

  • The new, weekly jobless claim numbers from the final week of Trump's Presidency are out today, and they are horrendous. Since the crisis began last March, for the 44th week in a row, they once again are hundreds of thousands of applications higher than the worst-ever week during the Great Recession. (Ya know...the last time a Dem Prez had to save the economy after a Republican Administration destroyed it.);
  • Perhaps you can take some comfort in the fact that at least Trump's own businesses are tanking as well, thanks to his fatally horrific decision to pretend the coronavirus was a hoax and to do nothing about it --- other than to make it far worse than it should have been;
  • Biden's first full day clean-up also included firing a number of wingnut Trumpers who had burrowed in at several Executive Branch agencies. One of them is the top lawyer at the National Labor Relations Board who is decidedly anti-labor!;
  • Meanwhile, in the nether-reaches of the Internet, there is much sadness, confusion and despondency. Adherents of the ridiculous QAnon conspiracy theory --- who believe that Democrats and "deep-staters" are secretly baby-eating, satanic, pedophiles (oh, like they're not!) and that Trump, as a super-genius, had a secret plan to round them all up, arrest them in mass and execute them at the Inauguration, before reclaiming his rightful second term --- are disappointed today for some odd reason and have reportedly "lost all hope". Turns out that, after none of that actually happened, as promised by "Q" for years, the QAnon dupes and stooges are only now beginning to realize they may have been played for suckers all along;
  • Also newly disappointed of late by their former hero, Donald Trump, is the rightwing racist street gang Proud Boys. Following Trump selling them out after the January 6th U.S. Capitol riots, many in the extremist hate-group seem to have decided the former President is a "shill", "extraordinarily weak" and "a total failure". (SAD!);
  • Finally, Desi Doyen joins us for our latest Green News Report with more news on Biden's efforts to clean up and reverse scores of anti-environmental regulations and actions taken by the previous Administration, and on renewed hopes for the revival of real climate action by the U.S. Government...if a few questionable Dems in the Senate play along...

Former Prez issues pardons for corrupt allies at exit; New Prez calls to 'defend truth, defeat lies,' and declares 'we must end this uncivil war'...

Looks like we made it! Joseph Robinette Biden, Jr. was sworn in as the nation's 46th President on Wednesday. Kamala Harris was sworn in as the first female, black and South Asian Vice President. And the nation's worst President and greatest sore-loser ever became a former President at the same time, fleeing D.C. like the coward he is just after dawn. All of which we cover in today's BradCast Inauguration Special. [Audio link to show is posted below summary.]

On his way out the door, Donald Trump unleashed a load of pardons and commutations for his corrupt allies and wealthy friends, abusing the Presidential pardon power in an unprecedented, but hardly surprising, way. We detail just some of the 144 grants of clemency he issued just after midnight, including for Steven Bannon, his former campaign manager and fired White House senior political strategist (who was indicted for defrauding millions of dollars from Trump supporters for a project to build a wall on the U.S. southern border); Elliot Broidy, former RNC fundraiser and Trump Inaugural Treasurer who pleaded guilty to selling his services to lobby Trump on behalf of a foreign billionaire; Paul Erickson, GOP operative and boyfriend of alleged Russian spy Maria Butina; a last second pardon for Albert Pirro, the real-estate developer, GOP fundraiser and convicted felon husband of Fox "News" host and Trump suck-up Jeanine Pirro; and more than 100 others like them. The raft of 11th hour pardons led one good government advocate to wryly charge that "Amazingly, in his final 24 hours in office, Donald Trump found one more way to fail to live up to the ethical standard of Richard Nixon."

Much to our surprise, however, Trump did not pardon his lawyer Rudy Giuliani, any of his children or himself! We would have bet good money he'd have pardoned some or all of them. (Especially himself!) But he apparently didn't.

As if his list of pardoned fraudsters, liars and other assorted and unrepentant criminals wasn't wasn't slimy and sleazy and swampy enough for ya, Trump also issued one last. middle of the night Executive Order to rescind his own 2017 EO that barred Executive Branch officials from lobbying their own agency for five years after leaving office, in addition to a lifetime ban on lobbying for any foreign government. In reversing his much vaunted ethics rule from his first year in office, he made clear yet again that he was only ever pretending for his base of dupes and suckers that he wanted to "drain the swamp" in D.C.

In much less sleazy news, on Day One of the Biden Administration, the new President signed an unprecedented raft of Executive Orders at the White House after his Inauguration, meant to begin to undo some of the most egregious excesses and corruption of the previous Administration. The orders focus generally on four concurrent crises Biden has vowed to immediately begin tackling, including COVID-19, the economy, racial injustice and climate change. Among the EOs planned to be signed on Wednesday, according to AXIOS:

  • Moving to rejoin Paris Climate Agreement
  • Asking the Department of Education to extend student loan relief
  • An executive order to rescind Keystone XL pipeline permit
  • Rejoining the World Health Organization
  • Asking the CDC to "immediately" extend eviction restrictions
  • Reversing Trump's travel ban on several Muslim-majority countries
  • Temporarily halting oil and gas leasing in Arctic National Wildlife Refuge
  • An initiative on advancing racial equity in federal policymaking
  • Overturning Trump order excluding undocumented immigrants from census count
  • But after Trump mercifully fled town early on Wednesday, a remarkably moving and socially distanced Inauguration Ceremony was held at the U.S. Capitol, under extraordinary security precautions following the massive MAGA Mob of violent, rioting insurrectionists who attempted, to little avail, to block Biden's decisive 2020 victory from being formally affirmed by Congress just two weeks ago today.

    We share some key moments from today's ceremony, including Biden's full, crisp, and tremendously on-point Inaugural Address. The new President, among other things, declared that "Democracy has prevailed" and vowed to be a "President for all Americans" while calling for "unity". He pointedly noted: "We must end this uncivil war" and went on to observe that "Recent weeks and months have taught us a painful lesson. There is truth and there are lies, lies told for power and for profit. And each of us has a duty and responsibility, as citizens, as Americans, and especially as leaders who have pledged to honor our Constitution and protect our nation, to defend the truth and defeat the lies."

    Finally, we close with a few thoughts on this wonderful, historic and long overdue day from both Desi and myself, at the end of four (actually five) hellishly long, painful, destructive, difficult and deadly years as the "American Carnage" of the Trump Era hopefully begins to fade as a new day begins...

    It's beginning to feel like the beginning of the end on today's BradCast. And while there remains plenty to be concerned about and lots of work ahead...it's beginning to feel just a little bit better all the same. [Audio link to show is posted below summary.]

    Among the many stories covered on today's show...

    • The world crossed a new, tragic COVID milestone. 2 million dead. That's the equivalent of 10 jumbo passenger jets falling from the sky every day for the past year. In the U.S., with more deaths by far than any other country thanks to Donald Trump's delinquent efforts, and the rate quickly rising, well over 390,000 are now dead --- or 2 jumbo jet crashes every single day for the past year;
    • Joe Biden's Chief of Staff, Ron Klain, predicts we may see as many as 500,000 COVID deaths in the U.S. before the end of next month. Therefore, it is very good to see the President-elect unveil a comprehensive, $1.9 trillion plan to both fight the virus and revive the economy --- and even raise the minimum wage to $15/hour at the same time! Republicans will oppose it, naturally. But almost everything in Biden's plan, save for the minimum wage increase, says The Prospect's David Dayen, can be adopted in the U.S. Senate with a simple majority vote...presuming all Dems are on board;
    • The nation is certainly on board for the Biden Presidency at this point, with Joe's approval rating up since the election and Trump's plummeting to an all-time low on his way out the door, according to a new survey out today from Pew Research;
    • Biden's Inauguration rehearsal has reportedly postponed due to security concerns following last week's Trump-incited Capitol Insurrection, and a warning from U.S. intelligence agencies that his "Domestic Violence Extremist" supporters may be planning more attacks, thanks to Trump's continuing, false, evidence-free claims that the election was stolen;
    • In a court filing, federal prosecutors said that Capitol Insurrectionists hoped to "capture and assassinate elected officials". Late today, they began to walk back that claim;
    • After a Congresswoman and former U.S. Navy pilot Mikie Sherril (D-NJ) charged this week that some insurrectionists were given "reconnaissance" tours of the Capitol by Republican lawmakers the day before last week's deadly riot Rep. Ayanna Pressley (D-MA)'s Chief of Staff reports that all of the panic buttons in the Congresswoman's office were found to have been mysteriously removed prior to assault;

    Then, as moving vans begin hauling the remnants of the Trump Administration away, the outgoing President is reportedly angry and increasingly isolated. (Sad!) But as our long national nightmare will soon come to a close, his legal and financial nightmares may be just beginning. Even that, however, comes with threats to the security of the nation.

    We're joined today by the great HEATHER DIGBY PARTON of Salon and Hullabaloo.  She's been writing about Trump's crumbling corporate empire both before, but especially in the wake of his failed Capitol Insurrection and the security concerns his financial woes pose to the nation. She explains why on today's show.

    We also discuss the fallout from Trump's second historic Impeachment and how the U.S. Senate will proceed with the trial even as Biden takes office and hopes to see his cabinet confirmed and agenda enacted. And then there's the question of what we should expect as the "Ghost of Trumpism" lingers --- and continues to rot --- the soul of the Republican Party after he mercifully leaves office on Wednesday.

    Finally, we close with some good news that got somewhat lost in the stampede of this week's instant Impeachment proceedings. Following a report from the Commerce Department Inspector General, the Census Bureau has now been instructed to abandon Trump's almost-certainly unconstitutional Executive Order scheme to withhold undocumented immigrants from apportionment data to be sent to Congress. Thus ends the Republicans desperate --- and now failed --- attempt to use the Constitutionally-mandated decennial federal Census as a means to shift political power from urban, Democratic-leaning areas of the country, to white, rural Republican districts...at least for another 10 years.

    After a not-nearly-long-enough break, The BradCast is back for the new year, when everything will be entirely better than the old year, right? Well, if the last several days of insanity that we now refer to as "news" is any indication, the answer is: "Not so much!"  It will be impossible to adequately cover all we discussed on today's program in today's summary. But, we'll give you the basics here and hope you tune in for the full story. [Audio link to full show is posted below summary.]

    While we were off, both houses of Congress overrode Donald Trump's ridiculous veto of the "must-pass", $780 billion National Defense Authorization Act to fund the military for another year. But GOP Senate Majority Leader Mitch McConnell was nonetheless successful in preventing Americans from receiving $2,000 pandemic checks, despite best efforts of Democrats, a tiny, uninspiring handful of Republicans, and even Trump himself. That, as the nation clocked an unfathomable 350,000 COVID deaths, which is the equivalent of blowing up about 17 sold-out NBA arenas and killing every single person in every single one of them, or 115 9/11s over the past 10 months in the U.S.

    With that, the new 117th Congress convened for the first time on Sunday, with a narrow majority for Republicans in the Senate (pending Tuesday's two U.S. Senate runoffs in Georgia) and with a narrow majority for Democrats in the House, where they elected Nancy Pelosi as Speaker for another two years.

    Despite all of that pretty big news, it all seemed to pale in comparison to Donald Trump's ongoing electoral death rattle. With concerns about how our unstable President may react as his days in office dwindle, every living former Defense Secretary (10 of them, Republican and Democratic, including the two fired by Trump and even Dick Cheney, who was apparently concerned enough that he reportedly led this effort), published a short, sharp group op-ed, making it crystal clear that any "efforts to involve the U.S. armed forces in resolving election disputes would take us into dangerous, unlawful and unconstitutional territory," and that "civilian and military officials who direct or carry out such measures would be accountable, including potentially facing criminal penalties, for the grave consequences of their actions on our republic."

    Even as that was being published on Saturday, Trump was on the phone for an unhinged hour with the Republican Secretary of State of Georgia, haranguing, threatening and cajoling him to change the state's Presidential election results to award the state's electoral college votes to Trump. We play part of that call, which may have been in violation of both state and federal laws, on today's show. We do not do it justice. The Washington Post has published the full bonkers audio and transcript, including Trump's long-ago debunked fraud claims and repeated false assertions that he won the state by about a half million votes (he lost it by about 12,000) and that he just wants "to find 11,780" votes to "win" the state.

    The news of that madness came on Sunday, as Georgia will have it's last day of voting in two U.S. Senate runoffs to determine partisan control of the Senate for the next two years on Tuesday, and as the new Congress meets in a joint session on Wednesday, January 6th, to affirm (or not) the results of Biden's Electoral College victory over Trump by a seemingly comfortable 306 to 232 margin.

    Over the weekend, however, more than a dozen Republican U.S. Senators led by 2024 hopefuls Josh Hawley of MO and Ted Cruz of TX, announced they intend to challenge the Electoral College results on Wednesday during what is normally a pro forma procedural affair presided over by the President of the Senate (Vice President Mike Pence, in this case).

    And this bring us to crux of where we are and what could happen on Wednesday, as Republicans continue to claim --- through failed lawsuits and other protests --- that the Electoral College Act (ECA) of 1887, which has determined the procedure to be used on Wednesday for about 150 years and 33 Presidential elections without question, is somehow a violation of the Constitution's 12th Amendment.

    If Republicans can figure out how to make this argument on Wednesday --- with Pence potentially holding the reins to help them --- we could find ourselves in a Constitutional quagmire leading to....lord knows what.

    We're joined today to help explain all of this madness by longtime election integrity advocate, election law scholar and democracy activist, PAUL LEHTO. He argues that, despite so many claims to the contrary (by many of the same folks who said that Trump could never become President back in 2016, by the way) there is, in fact, still a "path" for Trump and his Republicans to steal the election from Biden on Wednesday.

    Tune in for the details, but it has to do with how the 12th Amendment says that questions about the validity of Electoral Votes should be dealt with (via a one vote per state vote in the U.S. House), versus how the ECA handles such challenges (with a regular, up or down majority vote in both houses needed to support such a challenge.)

    Why is this even a question at this point? Lehto explains in detail.

    He also cites the lesson that we should learn from all of this madness: "What we should learn is that what you and election integrity activists have talked about now for decades is coming home to roost," Lehto explains. "And that is that a big, big part of this is the inherent uncertainty when votes are purely processed through computers. Nobody really knows --- until there's a hand recount --- what the result is, and partisan people can attach to that uncertainty and that doubt any theory that they wish to in order to keep hope alive."

    "So we need a voting system that leaves no doubt as to that result . And in order to have that you have to have transparency," he says, adding: "Basically, this is all the chickens coming home to roost, in terms of our non-transparent voting system."

    No. The headline wasn't a typo. We seem to have reached the end of a few lines today. I’m NICOLE SANDLER, guest hosting the BradCast one more time in this really miserable year.

    The first line ending is the year 2020. I know it officially ends tomorrow night, but today is the last new, live show of the year. I know I speak for Brad and Desi when I say 'good riddance' to what was probably the worst year of our lives.

    We may be reaching the end of the line in this 244-year-old Democratic Republic. We are witnessing the unraveling of the shaky foundation of this nation as the madman whose power ends in three weeks is getting more desperate and reckless by the day.

    We're at the end of the line for the 116th Congress. It moves into the history archives on Saturday; the 117th Congress will be sworn in on Sunday.

    Donald Trump seems to be embracing a scorched earth policy, deciding to burn the whole place down if his minions won’t break every rule, law and norm to overturn our Democratic election and install him as Supreme Leader. The reason there's still news breaking and the Senate is in session right now is all due to Trump's destructive and dangerous behavior. And no one in the Republican Party is willing to stand up to him to protect our delicate Democracy over his authoritarian ambitions.

    The past four years have been a blur of gaslighting and lies. One of the more reprehensible falsehoods they've pushed is the idea that --- led by Jared Kushner --- they've negotiated Middle East Peace! What was fostered during this time was an unholy alliance between the right wing Israeli Prime Minister Netanyahu (who is under indictment on a number of counts of corruption and worse) with the American dictator-wannabe Trump.

    When the Trump Administration announced the first of their so-called peace agreements --- this one between Israel and the United Arab Emirates --- my first thought was, "when were Israel and the UAE at war?" (They weren't.)

    Over the next few months, they rolled out a few more of these deals...with Bahrain, Sudan and finally, just a few weeks ago, they announced a fourth one... saying "President Donald Trump has brokered a peace agreement between Morocco and Israel."

    This one might have been the most offensive of the four, as the so-called deal legitimizes the Moroccan occupation of the Western Sahara.

    Some years back, I learned about Gush Shalom, the Israeli Peace bloc, led by activist Uri Avnery. I had the honor of interviewing him a few times over the years. His is a fascinating story. Well into his 90s, Avnery passed away a few years ago. But Gush Shalom continues its advocacy for peace and a two-state solution.

    After the so-called peace deal between Morocco and Israel was announced, I received an email from ADAM KELLER, a co-founder with Avnery of Gush Shalom, strongly condemning the deal.

    So I reached out to Mr. Keller to get the side of the Israel story that the corporate mainstream media doesn’t report.

    Mr. Keller has a thick accent, but I took great care to edit the interview to make it as easy to understand as possible. I hope you’ll give it a listen. Their position is not an isolated one. As I told him, just as I have nothing but contempt for the administration currently in power over here, I know that there are many Israelis equally horrified by the Netanyahu regime.

    It's now also apparently the end of the line for Netanyahu's government! We taped that interview two weeks ago. I got another email from Adam on 12/26 that reads...

    "Since we talked, events moved fast in Israeli politics. The Knesset was dissolved and we go to new elections --- the fourth time in the past two years. There is a concrete chance of getting rid of Netanyahu - but a real danger that he will be replaced by Gideon Sa'ar, a politician who is a bit less of a demagogue than Netanyahu but at least as right wing. In American terms, that would be like getting rid of Trump and instead getting George W. Bush...

    Anyway, the next few months are going to be interesting, one way or another..."

    Misery loves company, I suppose.

    And we’re at the end of the 2020 line too, thankfully. I made a concerted decision not to produce a Year in Review show this year because, well, 2020. Enough said.

    But I always look forward to Dave Barry's year-end missive. One of the few good things about living in South Florida is that Dave Barry, Carl Hiaasen and Leonard Pitts are columnists based at the Miami Herald.

    Dave Barry's 2020 Year in Review is too long for me to read in its entirety. But I ended the show with a reading of one pitch-perfect section, the part he calls MARPRIL. Just think back to March and April and you’ll understand...

    And I've now reached the end of this post. Thanks to Brad and Desi for trusting me with their show, and thanks to you, Brad’s readers and listeners, for welcoming me into your ears.

    After the House passed the CASH Act on Monday, which would give $2000 to individuals instead of the $600 in the Covid-19 relief bill just signed by Trump, and then successfully overrode his veto of the must-pass, annual National Defense Authorization Act (NDAA), the action turned to the Senate. I'm NICOLE SANDLER, back today guest hosting the BradCast, making sure we don't fall behind on the end of the year plethora of news, which we knew would be somewhat chaotic due to the madness of Lame Duck Donald (or is that Lame Donald Duck?)

    When we last got together, yesterday, the House was still voting on overriding Trump's NDAA veto, and they did so in a big way. The final vote was 322-87. Many of the 87 "No" votes weren't Republicans afraid of crossing dear leader, but progressives balking at another $740 billion windfall for the military industrial complex. Today, the action moved to the Senate, where Majority Leader 'Moscow' Mitch McConnell did exactly what he's best at: blocking the Democrats' call for an up or down vote on the CASH Act.

    Senators Chuck Schumer, Bernie Sanders, Ed Markey and Chris Murphy all spoke passionately about the need to help out Americans suffering through the worst crisis in our lifetimes. McConnell just grunted out his objection to their motions. The bottom line? McConnell blocked Schumer's request to approved the $2000 checks by unanimous consent. The Senate then adjourned until 3pm tomorrow, making me shake my head in disbelief. He said there would be a quorum call at 5p Eastern Time followed by a vote on overriding the NDAA. Then we learned that McConnell decided to combine Trump's demand for repeal of Section 230 of the Communications Decency Act with legislation to increase the stimulus checks to $2000, effectively poisoning the pill to make it unpassable in the Senate.

    This still doesn't address Bernie Sanders' threat to keep the Senate in DC through the holiday weekend if McConnell doesn't agree to a vote on the CASH Act bill passed by the House Monday night. So, I'll be back on Wednesday, hopefully with some answers.

    One thing this whole episode has reinforced is the fact that the Democratic Party, as an institution, is just not very good at being an effective opponent of the Republicans. I believe there are many contributing factors, including the generational disconnect of Democratic Congressional leadership. But I've also harbored ill will toward the DNC for a long time due to what I view as their inept management of everything they do.

    So one night last week as I was suffering though another bout of insomnia, I happened upon a Twitter thread by DAVID ATKINS. He's a writer (Washington Monthly, The American Prospect among others), and a progressive activist who is also a Democratic Party Regional Director and recently became an elected member of the DNC. The thread was about what he's learned about the DNC's dysfunction since he's been on the inside. It was quite dispiriting, but fascinating. So I invited him on for a conversation about what it would take to turn this party around.

    This interview originally aired on my program, The Nicole Sandler Show, last week. Afterwards, a listener sent me this photo of a letter written by Franklin D. Roosevelt in 1928, detailing his own issues with the DNC and his suggestions about how to run the Party. They sound a lot like what David Atkins was saying when we spoke! FDR knew what he was talking about. He was elected President four years later.

    We made it to the final week of 2020! That's quite an accomplishment, given what transpired this year. Brad & Desi are taking a much-needed year-end break, so it's NICOLE SANDLER guest hosting The BradCast, for the next few days. [Audio link to full show is posted below summary.]

    It used to be that this time of year, especially the week between Christmas and New Years, was what was known as a "slow news" time. We haven't even had a slow news day in the past four years, so why break with tradition now? Since we haven't been here with new programs since December 23, I began today's show with a recap of what happened since.

    Donald Trump had been missing in action since the November 3 election in terms of working on the pressing issues of the day --- a COVID relief bill and the year-end funding bill for the U.S. Government. Together they make up the Consolidation Appropriations Act of 2020 (CAA). And then there was the matter of the National Defense Authorization Act (NDAA) that had been passed but Trump hadn't yet signed.

    When Brad last spoke with you, he reported that Congress, on Monday, passed a $900 billion coronavirus relief package along with the $1.4 trillion omnibus spending bill to keep the government funded through September of 2021, by huge veto-proof margins in both houses. And on Tuesday, Trump awakened from his stupor to call the bill "a disgrace" --- despite it including much of what he himself had asked for --- and demand the payments to individuals be $2000 rather than the $600 his administration had proposed! He had other demands but, as usual, he was confused, conflating things in the COVID relief bill with provisions from his own budget that were contained in the omnibus portion of the bill. But I digress. He threatened to veto the bill or worse, do nothing. In that case, it would just die, with Congress unable to override a pocket veto before the new Congress is seated on January 3, and the entire process to pass the bill must begin again.

    On Wednesday, Trump vetoed the NDAA, ostensibly for two reasons: it would require the military to rename bases that were named after figures from the Confederacy and because it doesn't include a repeal of Section 230 of the Communications Act, which shields internet companies from liability for what is posted on their websites by them or third parties.

    And then he boarded Air Force One, to spend the holidays at his Palm Beach resort Mar-a-Lago.

    To reiterate: while most of the country is suffering, waiting for help to make it through the worst crisis in our lifetimes, Trump was sitting on relief checks, unemployment benefits, an eviction moratorium and rental aid from his Mar-a-lago resort in Palm Beach. At the same time, Vice President Mike Pence is on a skiing vacation in Vail, Colorado, and Treasury Sec. Steven Mnuchin took a private jet down to his vacation home in a Mexican resort near Cabo.

    Christmas Eve and Christmas Day came and went, as did the Saturday midnight deadline when pandemic relief programs lapsed, throwing more than 12 million Americans who relied on them for unemployment insurance and more into an even worse situation than they had been in already.

    Trump finally gave in and signed the CAA on Sunday evening, but additional damage had already been done. As for the master negotiator, he's more like an impetuous child who threw a temper tantrum and then got tired of being locked in his room so he gave up, and got nothing out of it.

    That brings us to today. The House is back in session to vote on two items --- a bill changing the dollar amount of the individual checks to be sent out from $600 to $2000 and to override Trump's NDAA veto. As I am posting today's show, the vote on the $2000 checks has now passed with the 2/3 required under the procedures that were used for consideration, 275-134.

    The House then voted by an even bigger margin to override Trump's NDAA veto. That vote was 322-87! Tomorrow, the Senate returns to vote on these two bills. The question is whether Mitch McConnell will bring the issue of the larger direct COVID relief payments to the floor.

    Senator Bernie Sanders issued a statement demanding a vote: "The House has passed a $2,000 direct payment for working people. It is time for the Senate to act. This week on the Senate floor Mitch McConnell wants to vote to override Trump's veto of the $740 billion defense funding bill and then head home for the New Year. I'm going to object until we get a vote on legislation to provide a $2,000 direct payment to the working class. Let me be clear: If Senator McConnell doesn't agree to an up or down vote to provide the working people of our country a $2,000 direct payment, Congress will not be going home for New Year's Eve. Let's do our job."

    Now that a Democrat will be in power in the White House in a few short weeks, the Republicans in Congress are once again singing their austerity tune. Many are objecting to a $2000 payment saying "we can't afford it" or some similar nonsense. So I'm joined by economist, professor, a leading proponent of Modern Monetary Theory, and author of The Deficit Myth: Modern Monetary Theory and the Birth of the People's Economy STEPHANIE KELTON, who explains that not only can we afford to help people suffering through this crisis, we must!...

    Guest: Heather Digby Parton of Salon and Digby's Hullabaloo...

    Our long national nightmare may be over in about 28 days...but it ain't over yet. Not by a long shot. And, as detailed on today's BradCast, it's becoming more unnerving by the second, with Donald Trump's mental health seemingly devolving rapidly with each and every one. [Audio link to show is posted below.]

    Curiously, corporate media are sounding more and more like The BradCast with each passing day. Among the stories underscoring that point as Trump's days in the White House continue to wane (whether he is able to admit that out-loud or not)...

    • "Trump turns on everyone," reports Jonathan Swan at Axios. "Everyone" now appears to include "Vice President Pence, chief of staff Mark Meadows, White House counsel Pat Cipollone, Secretary of State Pompeo and Senate Majority Leader Mitch McConnell." (With a hat-tip to Lincoln Project, for their video getting inside Trump's head regarding Pence);
    • Pentagon Correspondent Barbara Starr reports anxiety is rising at DoD, with one officer telling her "We don't know what he might do" in these final days. They were particularly alarmed after talk from disgraced and pardoned former National Security Advisor, Lt. General Michael Flynn's call for Trump to invoke Martial Law and order the military to "re-run" the election in some states that Trump lost. The military, according to Starr, wants nothing to do with any of it. We hope her reporting is accurate;
    • Amid all of this, Trump unleashed another wave of Presidential pardons for his friends and the friends of his friends on Tuesday night. This time for 4 war criminals charged with murder for carrying out a massacre of Iraqi civilians while employees for Blackwater, the mercenary company owned by Eric Prince (brother of Trump's Education Secretary, Betsy DeVos); 3 corrupt, felonious Republican former Congressmembers (including the first two members of Congress to endorse him, Chris Collins of NY and Duncan Hunter, Jr. of CA); and 2 Campaign staffers who plead guilty to felonies tied to the Robert Mueller Special Counsel probe into Russian interference during the 2016 election. (And, after getting off air tonight, Trump has issued still more pardons for still more of his friends, including for his former campaign manager Paul Manafort, former campaign advisor Roger Stone, and for Charles Kushner, father of his son-in-law Jared, all convicted of multiple felonies);
    • But wait, there's more. Much more! During an unhinged, pre-taped White House video posted to Twitter last night, Trump threatened to veto the $900 billion COVID relief bill attached to the government's must-pass annual spending bill to avoid shutting down again. The long-overdue emergency relief was finally passed by Congress after eight months of Trump refusing to participate in negotiations. He's now pretending to be upset that stimulus checks to be sent to many Americans will only be $600. Congressional Republicans and White House negotiators insisted it could be more no more than that. But Trump now suggests he may veto the measure unless payments are increased to $2000. Dems, who had been trying to increase the amount of payments for months immediately joined Trump's call. Congressional Republicans (and the two incumbent Republican Senators running in the January 5th runoffs) are apparently furious, confused, and not sure how to fulfill the demands of their Frankenstein's monster;
    • And, just before airtime, Trump vetoed another long-negotiated must-pass bill, the $790 billion Military Authorization spending bill which was enacted last week by veto-proof majorities in both houses of Congress;
    • That's only a taste of what, according to the Washington Post today, has now "plunged" the GOP "into open warfare over President elect Joe Biden's election victory --- with President Trump taunting Senate Majority Leader Mitch McConnell and threatening primary challenges against other Republicans, House lawmakers egging on senators to contest the counting of electoral college votes next month, and senior GOP senators rebuffing that effort as a pointless political exercise";
    • All of which, as the New York Times reports today, has resulted in Trump at the "most unleashed...and...most unpredictable point in his presidency," while he is desperately "focused on the one area in which he is powerless to get what he wants: a way to avoid leaving office as a loser";

    With that nightmarish backdrop, our guest today, HEATHER DIGBY PARTON of Salon and Hullabaloo joins us to explain why Trump's final days are "more frightening than Nixon's" as he "seems to be having a very public nervous breakdown."

    "We knew he wasn't going to act like a normal President and be gracious and have Biden over coffee. I didn't expect that," she tells me. "But this? He's so incredibly afraid of being called a loser that he's turned himself into the greatest sore loser in world history!"

    "He's clearly melting down," she adds. "As far as I am concerned, when you have a President who is melting down, who has this capacity to launch a nuclear war, we're in a very dangerous situation."

    She also has a number of thoughts on where this all goes "beyond Trump," after the (theoretically) inevitable Inauguration of Joe Biden, if we manage to get there. "The rationalization of these people. The brain-poisoning...The absolutely servile Republican Party that has completely abdicated all responsibility," observes Parton. "He is the Republican party. They are part of it, if they choose to be. But there is no Republican Establishment. There's only him."

    This, she cautions, is "Trump's last stand," before adding ominously: "At least, we think it is."

    We've tried to touch base with Parton at many of the landmark moments throughout the nightmarish Trump Presidency (and candidacy --- she was also with us the day he descended the gilded escalator at Trump Tower to announce his run for office in 2015.) So, with all of this madness swirling and our long national nightmare before Christmas continuing, it seems like today was another perfect moment to check in with her for our last interview before standing down for the holidays.     Finally, with the critical U.S. Senate runoffs in Georgia now underway, and control of the U.S. Senate hanging in the balance --- (we also discuss with Parton what the January 5 Election Day in GA could mean for the January 6 affirmation of Biden's Electoral College win in Congress on January 6) --- we close with a new tune from Patty Austin with a very important message for our friends in the Peach State: "Georgia, You're Voting for Me Too!"...
