So I get home from work, pick up the paper, and look in the BUSINESS SECTION for some unknown reason, and it hits me, how many people saw this particular decision? I wouldn't have known about it! I mean, they're just blatantly screwing us right to our faces! Then they call it "minimum pricing" to mislead or confuse, and explain how it's not that bad...you can still sue, not really important.

Well, if it's not that important, why go out of your way to overturn a 100 year old law? Do they think we're stupid? GBD - Congress didn't pass the law giving Bush absolute power if we are attacked. As I understand it, there was some kind of procedure already in place for an attack... what happened was that Bush himself quietly changed that procedure. Don't have all the facts but know it wasn't Congress. Can anybody out there clear this up? Congress has enough on their plates without blaming them for something they didn't do.

The Alito and Roberts story has an another aspect.

They both lied to congress about stare decisis, the judicial principle that says follow precedent (existing case law) and overturn existing law only if there is a compelling reason to do so.

They said under oath that they would follow precedent, but we now know they committed perjury because they have abandoned the doctrine of stare decisis in their very first session.

The mistake congressional democrats made was to trust those two neoCons to tell the truth.

I remember marching in demonstrations during that time when Frist was threatening to do away with the filibuster. The neoCons had the votes in the Senate to do it so the dems were hamstrung to some degree.

Of course the supremes will soon get a case challenging the 100 year old precedent set by a judicial activist headnote by a former railroad exec in Santa Clara vs. Southern Pacific that gave us the "corporate personhood" over the years that was never a conclusion of the actual case notes of that case nor based on constitutional law.

The corporatist 5 will rule in favor of using [i]stare decisis[/i] in this case and then will turn around and say, "See, we weren't lying. We will use stare decisis to respect existing long court decisions."

Of course they'll only rule that way when it serves their corporatist agendas!

I still think we should be questioning HARD any history of impropriety that those on this current court have exhibited in the past, so that at least they are served notice that the people and congress won't accept everything that they throw at us without scrutiny. If that means getting them to testify in front of committees where they might be investigated for impeachable crimes themselves, so be it.

They are testing us now to see how much they can get away with later if and when the appeal from this administration comes to them to support claims of executive privilege. If they feel they can get away with it, they will violate the precedent set by the court from Nixon's day that emphatically denied such requests.

We should start with things like looking at Cheney going hunting with Scalia's effect on subsequent decisions by the court regarding cases involving Cheney. We should continue with perhaps investigating WHY the court would choose not to hear Sibel Edmonds' appeals but in the same session hear Anna Nicole Smith's appeal. If Sibel Edmonds can be heard in front of Waxman's committee, perhaps we can build a list of good questions to ask of them to see if they were in fact facilitating a coverup then, and even by just asking those questions, serve notice that if they try to faciliate a coverup by granting this administration executive privilege to hide criminal acts, they could be viewed as participating in the conspiracy that could lead eto their impeachments later as well.

What they DID do (their ACTIONS, not their WORDS), is railroad through a mega-amount of PRO-CORPORATE legislation and ANTI-CITIZEN legislation, including some Democrats like the credit card bill.

What is "conservative" about the 5-4 decision to allow "PRICE FIXING"? That is ANTI-FREE MARKET and ANTI-CONSERVATIVE! Yet, the NYTimes keeps calling them "conservative", why?

If they banned abortion, I'd say, "Yep! That's conservative."

If they pulled out of Iraq, I'd say, "Yep! That's conservative."

If they stopped big govt spying and wiretapping, I'd say, "Yep! That's conservative."

If they lowered federal deficit spending and huge trade deficits with China, I'd say, "Yep! That's conservative."

If they weakened instead of made laws to make the executive branch a dictatorship unaccountable to American citizens, I'd say, "Yep! That's conservative."

THEY ARE DOING THE TOTAL OPPOSITE OF ALL OF THAT!

If they got rid of the secrecy of voting and e-vote machines, I'd say, "Yep! That's conservative."

Everyone has twisted around "conservatism" to be "corporatism". NOT THE SAME THING!

The first way to take these people down, is to start calling them what they are...AND IT'S NOT CONSERVATIVE! It actually hurts the cause of taking them down, because then they can say, "They're trying to take down conservatism". That's REALLY BAD! When they DO take down these criminals, it's going to get the real conservatives very angry, when we read the headlines, "Conservative losing" "Conservatives corrupt" "Conservatives are bad" "Conservatives ruined our country". It's really going to hurt the real conseratives.

Yes most would agree that Rehnquist was a conservative, and one in many cases we didn't care for his decisions much. But Roberts is DEFINITELY a move towards more corporatism on the bench! Do you think that Roberts would have "dissented" the way Rehnquist did in the First National Bank of Boston vs. Belotti case? Hell NO! He'd have lead the charge instead to give corporations unlimited right to give money to political causes.

But with this corporatist court you have even less liklihood of overturning it than the 1978 court case that Rehnquist dissented on.
