Considering Riverside County, CA, was the first in the nation to purchase Sequoia Voting Systems' malfunctioning, unsecure touch-screen voting machines for county-wide use in 2000, and that the county's Board of Supervisors were once the most ardent supporters of the company --- one of the Supes even going so far as to foolishly bet "1000 to 1" that the system couldn't be hacked --- the latest news from Riverside, no doubt, comes as a very bitter pill for the failing voting machine company.

And better still, the county now has a golden opportunity to restore its reputation by leading the nation in bringing accountability to the real villains in this regrettable saga.

"Riverside Co. Pulls Plug on Electronic Voting" read the headline of one of the local news reports after Tuesday's Board of Supervisors meeting where they wisely voted against throwing good money after bad.

The Board refused to authorize $500,000 for uncertified Sequoia optical scan voting machines, as recommended by the county's Sequoia-lovin' Registrar of Voters Barbara Dunmore, in order to replace their recently decertified Sequoia touch-screen systems which had previously been purchased (twice!) for some $27 million.

"I will not vote for another dime to go to Sequoia," said Supervisor Roy Wilson, finally catching on, according to the report from KESQ....

Early voting is taking place in Shelby Co, Tennessee but the Memphis mayor wants the voting to stop and he seems to have convinced the city attorney that he is correct. The issue is that the county’s Diebold TSx voting machines seem to be flipping votes and numerous calls from voters to the mayor (a candidate) have convinced him that there is a problem. The city attorney actually went to one of the early voting sites and verified that touching just inside the lines separating the candidates would cast a vote to the name just above or below the voter's selection of choice. Amazingly the Shelby County Election Board chair had this to say, “…..we're comfortable with the fact that we tested those machines and there is nothing wrong with the way the machines are recording the votes. Apparently it's an issue of public education. If people press in the wrong area they're going to get the wrong result.” She also said that voters have a chance to correct their vote on the screen before they submit it. That’s the screen with the small writing that you didn’t do any voter education about? Is it any wonder that today’s “Enemy of Democracy” award goes to Myra Stiles for blaming the voter instead of the machines for the machines failures.

First some business. I thought it was readily apparent that comments that I write and post in this lead ‘graf’ are comments and opinions on what has happened during the day or what may be happening in the future. What I write here is not news. Apparently a handful of readers failed to recognize that fact.

Now on to my comments. What is going on in New Jersey? The legislature passed a law in 2005 that any voting system used in the state would have to provide a voter verified paper audit trail. The state elections people were given until January 2008 to make that happen. There were no printers developed for the state’s full-face DREs so they had to be built and tested. The state chose to take that avenue rather than go with a state-wide change to optical scan and the state waited until the last minute and now is asking for extensions from the legislature and the court. This is a parallel to HR-811 which will require an as yet undeveloped printer for DREs and probably four years to develop that printer. This is Holt’s home state. They didn’t change systems. Why should anyone believe that his legislation, that does not ban DREs, would cause any state to change systems to get rid of their DREs?

Congratulations to Florida's U.S. Rep. Tom Feeney (24th District) for being named one of Congress's "Most Corrupt Members" for the third consecutive year! The latest round of notables was posted today by the watchdogs at Citizens for Responsibility and Ethics in Washington (CREW).

Attaboy, Tom!

And all while staying out of jail --- so far --- for improprieties associated with disgraced GOP über lobbyist Jack Abramoff; being disgraced Tom Delay's #1 supporter in Congress; well-documented allegations of vote-rigging in 2000; all even while continuing to protect your enduring friendship with Communist China-associated, illegal-immigrant employing spies, business partners, and benefactors!

No easy feat, that! Especially since just staying alive while hanging around you has gotten so difficult for so many over the years!

'In this book, it says five million votes were supressed. Didn't you want to be President?' Asks 21-Year-Old Prior to be Dragged Off by Security

Fortunately, it happened at a John Kerry event. So we'll likely hear a whole lot about this incident. Had it happened at a Republican event, Fox "News" and the rest of the news channels that receive their assignments from them would have made this a one-day story at best.

The blurry-ish video version of the incident seen at right shows the entire statement and questions asked by University of Florida student Andrew Meyer. He was waving the recently released paperback version of investigative journalist Greg Palast's Armed Madhouse and recommended the book to Kerry before asking him about his early concession to the 2004 Presidential Election.

"He says you won the 2004 Election, isn't that amazing?" proclaimed Meyer, referring to Palast's claims in the book. The 21-year-old student continued on to speak about "multiple reports of disenfranchisement of black voters in Florida and Ohio on the day of the election" and "electronic voting machines in Volusia County, Florida, that counted backwards."

"So amidst all of these reports of phony, bogus stuff going on, how could you concede the election on the day?" he asked as security guards surrounded him. "How could you concede the 2004 election on the day? In this book, it says there were five million votes that were suppressed. Didn't you want to be President?!"

Kerry is heard earlier in Meyer's statement acknowledging that he has the book and that he's "already read it." Though we've seen the incident now on all of the cable news channels, several times, we've not seen any of them show the actual statement and questions being asked by Meyer.

Debra Bowen Says 'Sleepovers Don't Comply With Security Requirements...It's Really Simple'
Reply to BRAD BLOG Question During Conference Call Monday, Most Direct, Definitive Statement on the Controversial Practice Since She's Taken Office...

She's hinted as much previously, and her new security requirements issued in the wake of her landmark "Top-to-Bottom Review" of e-voting systems would seem to preclude them, but CA Secretary of State, Debra Bowen has now given her most direct comment to date on the matter of voting machine "sleepovers".

"Sleepovers don't comply with the security requirements," Bowen said in response to a question we submitted on the matter during a conference call with the Secretary sponsored by the Courage Campaign.

"It's really simple," she added, after a pause following her immediate, direct reply to the question.

She went on to explain how unauthorized access to a single machine, by a single person, could allow an entire county's election to be flipped, putting everyone's election at risk.

The matter of voting machine "sleepovers" --- the practice of sending pre-programmed, election-ready voting systems home with pollworkers, often days and weeks prior to elections, for deliver to polls on Election Day --- first became a controversy last year after The BRAD BLOG exposed the issue as it occurred during San Diego's special election to replace disgraced Republican U.S. House Rep. Randy "Duke" Cunningham. Our exhaustive coverage (see: Busby/Bilbray category) of the resulting scandal, continued throughout some 100 articles here.

The special election in San Diego was the first federal contest to have taken place after several analysis of Diebold's e-voting system found that the systems utilized undisclosed software code prohibited by federal standards. The particular type of code is banned at the federal level since it can be exploited to flip an election undetectably.

Subsequent studies at Princeton University and elsewhere revealed that inappropriate access by a single person, to a single machine, could virally affect every other machine used across the same county.

The revelations made the notion of voting machine "sleepovers" all the more stunning to those of us who recognized the remarkable threat the practice posed to the security of our elections...

HR-811/Microsoft-811 may be going to the floor for a vote sometime this week. Maybe not. Does it all really matter though? The bill will almost definitely get a majority of the votes, though it may be closer than some have thought. Then what? Then comes the Senate. The 811-clone, Sen Nelson’s bill, is still just sitting in a holding pattern and S-1487, Senator Feinstein’s destructive bill, is waiting on hearings before it is finalized, if it gets that far. Then what? It seems with the Senate, bills don’t get voted out of committee without having at least 60 votes. That’s to ensure they are filibuster-proof. A source in the Senate Admin Committee (Feinstein’s committee) has said that the minority has already said that no election-related legislation will go to the floor this session. Can deals be made? Sure. Anything can happen. I’m just not holding my breath. Today was supposed to be the court hearing in New Jersey to decide what actions would need to be taken regarding vvpat printers. As of press time there have been no reports from New Jersey....

What is It About Florida Republicans and Sex With Children?

Unbelievable...

DETROIT --- A U.S. Justice Department official has been arrested on suspicion of traveling to Detroit over the weekend to have sex with a minor.

John David R. Atchison, 53, an assistant U.S. attorney from the northern district of Florida, was arraigned in U.S. District Court in Detroit Monday afternoon.

An undercover officer posed as a mother offering her child to Atchison for sex, according to police.

Prosecutors said Atchison flew from Pensacola, Fla., to Detroit on Sunday intending to have sex with the 5-year-old girl.
...
The undercover detective asked how Atchison can be certain of no injury. He responded, "Just gotta go slow and very easy. I've done it plenty," according to detectives.

Atchison, a member of the Florida bar association since 1984, lives in Gulf Breeze, Fla., near Pensacola.

He is president of the Gulf Breeze Sports Association, a youth athletics organization.

He described himself online as a family man.

UPDATE 10/6/07: On his second attempt, Atchison succeeded in killing himself in federal prison. Details on that, and our inference on his being a Republican right here...

Rep. Hinchey 'Deeply Disappointed,' Calls Unwillingness to Debate Issue a 'Shame'

Citing "recent developments outside Washington that bolster critics who say DRE [usually, touch-screen voting] systems are too insecure and unreliable for use in elections," AlterNet's Steve Rosenfeld surveys the political landscape in regard to Rush Holt's impending time-bomb of an Election Reform Bill, known as HR 811.

The controversial bill that refuses to die is again said to be headed back to House Rules Committee this week, where a rule concerning whether or not amendments will be allowed to the bill when/if it reaches the House Floor will be set.

Rosenfeld reports Speaker Nancy Pelosi's office is being dodgy about whether or not Rep. Susan Davis's (C-CA) amendment to restrict the use of Direct Recording Electronic (DRE) touch-screen systems will be allowed for debate. "I don't have an answer for you," a spokesperson told him, "I have no way of knowing. This is a comprehensive bill. This is a process that is moving."

Last week, Davis said, in a statement sent to The BRAD BLOG, that "we are still ignoring the 800 pound gorilla in the room," in regard to Congress's fear of discussing whether or not to allow the use of DRE systems which are now being banned by states across the country.

Her amendment was followed by an editorial from the New York Times charging that "electronic voting has been an abysmal failure," and calling for a "provision banning the use of touch-screen voting machines" to be added to Holt's bill. They add that such a provision should be in place in time for the 2008 election, though Davis's amendment, as currently written, only calls for a restriction to one DRE per polling place, by 2012.

Majority Leader Steny Hoyer has been a supporter of HR 811 since a secret "compromise" version, recently brokered behind closed doors by out-of-touch DRE-supporters, People for the American Way (PFAW), and Holt was agreed upon several weeks ago.

Pelosi has remained largely mum concerning her position on the bill, which does not require paper ballots, despite the blatant lie that Holt offered Rosenfeld in a report some weeks ago after CA SoS Debra Bowen's independent study at University of California found "severe vulnerabilities" in DRE voting systems. Such vulnerabilities, her study found, would not be safe-guarded against use of the paper trails that the Holt/Hoyer/PFAW compromise bill mandates.

Congressman Maurice Hinchey (D-NY), now a co-sponsor of Davis's amendment --- along with Barbara Lee from California --- and a previous critic of the Holt Bill, is now critical of the Democratic leadership. He seems to indicate, in comments given to Rosenfeld, that Davis's amendment will not be allowed for consideration:

"The potential for manipulation of national elections with the use of touch-screen machines is much too serious for this Congress to allow their continued use --- let alone to encourage additional states to convert to DREs," he said. "Regrettably, the Democratic leadership was still unwilling to allow the Davis amendment to be considered before the full House."

"That's a shame, because this is an important issue about which many voters are justifiably concerned," he said. "I'm deeply disappointed that we won't even have the opportunity to have an open debate about the merit of these very dangerous touch-screen devices."

Quoting an industry watcher who straight out proclaims "The DRE is dead," Rosenfeld reviews a number of national and media developments that support that assessment.

Apparently, that message hasn't gotten through to Holt and the tone-deaf, out of touch Democratic Leadership on the Hill, however.

"While these events and trends are unfolding," Rosenfeld astutely sums up, "in Washington the House Democratic leadership has been accommodating interest groups that want to see continued use of the very voting systems that are being discredited across the country."

County Clerk Has 'Faith' in Her Sequoia Voting System, Plans to Continue Voting Machine 'Sleepovers' in 2008...

I'll withhold most of my personal thoughts here for the moment, since Gail Pellerin, County Clerk for Santa Cruz County, CA, has agreed to come back to continue this discussion on the Peter B. Collins Show this Friday. For the moment then, I'll just let you listen and offer your own thoughts on this conversation from last Friday's show.

Pellerin and I appeared on PBC's radio show to discuss issues of Election Integrity, CA SoS Debra Bowen's "Top-to-Bottom Review" and the Sequoia Voting System that Pellerin uses in Santa Cruz, the hometown of former CA SoS Bruce McPherson.

She is on the public record as having said last July at the public hearing in Sacramento for Bowen's TTB Review: "I can guarantee that every eligible vote is counted accurately," about which, you can imagine, I challenged her on the show. As well, in the interview (complete audio below) she commits to sending her voting systems home yet again on "sleepovers" with poll workers in next year's elections. I also had a thing or two to say to say about that, as you may have guessed. Suffice to say, it was a lively interview.

Pellerin --- presumably a Democrat, as she once worked in the CA state assembly for then-Speaker Willie Brown --- was scheduled only for the first half-hour of the show, but fortunately called back for the final segment to answer some of the questions that I didn't have time to ask her about when she was on the air. I greatly appreciate her willingness to do so and to stand up to the fire.

Do You? (And Any Help In Paying For It Is Much Appreciated)

Finally catching my breath, and beginning to get back up to speed here at home after three months on the road. Given that I'd hoped to find a few much needed days off over the summer --- and largely failed, but for a few days snuck in here and there --- it seemed a worthy effort at reviewing some of what we were able to do here, even while on the road.

All of this by way of reminding folks that my work here at The BRAD BLOG is supported almost solely by the generosity of you readers. We sell a few ads occasionally, but it is your donations that give me a shot at paying my bills on time(ish) and covering the various expenses here. The rest I try to cover by an occasional freelance article where I can get one, and otherwise I continue to pray to the democracy gods that I'll be able to pay for food, rent, gas, and credit card bills. Somehow.

It seems to be about time that I explain the loose rules that I use in selecting what goes into DVN and what stays out. First, though I have a position with regard to legislation I am very careful to not let my position cloud my decision as to whether an article on legislation is posted or not. I have posted just as many articles that are pro-legislation as I have that are anti-some aspects of that legislation. I will not post what is very apparently misinformation no matter on which side of the issue the article falls. I know the subscribers of DVN come from all sides of the issue so I try to cater to them all. I post news articles and blogs that I get from searches of the net. I don’t post articles that are older than a few days. I don’t post LTTEs. I don’t post data bases or .pdfs that are not posted somewhere. Ultimately the disclaimer at the bottom of the list of articles says it all.

Bush's Contention of '36 Nations in Iraq' Last Week Mirrors Cheney Lie in '04 Veep Debate
Incident Led to Infamous BRAD BLOG Exposé on Pre-Election White House Website Scrubbing...

During last Wednesday's televised address from the Oval Office, George W. Bush said, "We thank the 36 nations who have troops on the ground in Iraq."

As it turns out, you'll be stunned to learn that his number was a lie. But it wouldn't be the first time the Administration has lied about who is, and isn't, a part of the so-called "Multinational Coalition" in Iraq, as The BRAD BLOG reported exclusively as far back as October of 2004, prior to the Presidential Election.

Concerning Bush's "36 nations" mentioned last week, Spencer Ackerman reports, in an exclusive over at TPM, that the number is fudged at best, and just another unsupportable, outright lie by the administration at worst. The White House's fuzzy math used to comprise the "36 nations" with "troops on the ground in Iraq" apparently includes several nations which "aren't in Iraq in any capacity anymore," according to Ackerman.

The number also includes Canada's one soldier who had been serving at the United Nations Assistance Mission in Iraq (UNAMI), who has since been withdrawn; New Zealand's single troop (yes, like Canada, just one!) commitment to UNAMI; Tonga's now-withdrawn force; a single press aide from Iceland; and an unknown number from Hungary which may, or may not, have anybody still in Iraq at all as part of a tiny NATO contingent.

Bush's prepared statement lie on national television last week, however, simply continues the pattern set years ago, prior to the 2004 Presidential Election, by Dick Cheney, as The BRAD BLOG exposed in a series of reports back then in what would become our first breakthrough story to be picked up by both national and international media alike...
