Business Sections Confirms our 'Inside Source' at Diebold
Compares Troubled Company Again to Enron...

In a story about Diebold, Inc. continuing trouble the Cleveland Plain Dealer's business section reports that the Ohio-based company "lost almost a fifth of its share value last week." (Trading of DBD continues flat again today with shares off some .50% on the day.)

As well as comparing the company's restructuring to the failed strategies at Enron, reporter Alison Grant picked up on BRAD BLOG's Exclusive story of the Insider we refer to as DIEB-THROAT:

The news about troubles at Diebold also hit online opinion sites where voting-rights groups long have criticized what they say are security problems in Diebold's voting equipment.

U.S. Newswire carried a release saying that a whistle-blower, "Dieb-Throat," was spilling the beans on practices at the company.

The insider, when contacted by a reporter, described a company groping to get its voting-equipment business stabilized after a series of equipment malfunctions and sales setbacks.

"We have no response to that kind of nonsense," [Diebold spokesman Mike] Jacobsen said.

Diebold shares closed Friday at $36.15, down 18.5 percent from Tuesday's close.

Apparently, Diebold has no response to all sorts of "nonsense." Like a branch of the U.S. Dept. of Homeland Security sending out a Cyber Alert Bulletin prior to last year's November Election warning that Diebold's central vote tabulator was open to any malicious user who might wish to change the results of an election. Diebold failed, apparently, to offer a security upgrade even after that Alert was issued, and to this day acknowledges it as no more than an "unproven allegation."

Failure to respond to such "nonsense" seems to be costing the company dearly. And more trouble, our so-far very reliable inside sources tell The BRAD BLOG, is soon on its way...

Debra LoGuercio, editor of the Winters Express in California, takes a look at our DIEB-THROAT stories in her latest column for McNaughton Newspapers. She closes with this graf:

If someone can refute the Dieb-Throat story and www.bradblog.com posts, please do. Because if they're true, our votes and elections are meaningless. Which means the very foundation of American democracy is meaningless. Which means our country as we know it is dead.

We're glad LoGuercio has noticed, and that more and more such folks are beginning to take notice of what we've been yelling and screaming about since at least November 3, 2004 here at The BRAD BLOG

We also join her call for refutation of the points made by DIEB-THROAT in our stories covering just some of the information that the still-anonymous source has shared with us. Those stories, if you haven't caught them yet, are respectively here, here and here. You can reach LoGuercio at this email address, and you can reach us at this one should you have any information or evidence that in any way questions the validity of our reporting or the information we've presented so far from DIEB-THROAT.

So far, that hasn't been done. As well, we are told that more coverage of our reporting from other media outlets (larger ones) is likely on the way.

Today, Diebold Inc's stock price stayed largely flat (gaining about .61%), closing at $36.15.

Last February, when we launched our "Divestiture for Democracy" campaign at VelvetRevolution.us shares of Diebold, Inc. (DBD) stock were more than $53/share. The value of the company's stock has fallen more than 30% since we began our campaign, plunging some 20% in the last week alone since our first DIEB-THROAT story.

The DV4D Campaign put America's Voting Machine Companies on notice. We let them know we expected them to do the right thing for this country and introduce transparency, security and accountability into the electronic election systems which they were foisting on a misinformed electorate.

We hope that the other major American Voting Machine companies are taking note of what is happening right now at Diebold, and before they get too excited about trouble at their competition, we hope they all understand our promise (The BRAD BLOG is a co-founder of VR) to do anything and everything legally and within our power to hold the anti-American owners and management of all of those companies accountable for putting our democracy at grave risk through their careless and unpatriotic business practices.

Democracy is not for sale. At least it shouldn't be. And we intend to continue to do something about it. Wherever and whenever possible.

We didn't set out to write a fundraising article for VelvetRevolution, but now that we've written it, we realize, this is as good a time as any to ask for your support of VR, so that we can keep up such work to help take our great country back from the cretins and bad guys that have --- and continue to --- hijack it from the good citizens of this country.

Disputes Voting Machine Company's Explanations for Lowered Forecasts, Compares Company to Enron...
Points to Mismanagement, Failed Voting Equipment, Homeland Security Warnings and CEO O'Dell's $3m Salary as More Likely Causes

Our still-anonymous Diebold Insider --- who we call DIEB-THROAT --- has some thoughts on Wednesday's sudden and stunning 15.5% one-day plunge in Diebold, Inc. share prices as reported earlier today by The BRAD BLOG.

"What a difference a few months makes," DIEB-THROAT wrote after the market close on Wednesday. "Back in July, Diebold told investors during its conference call the election revenues were sound and expected to grow." Yes, DIEB-THROAT was on that conference call. "Now all of a sudden Diebold's [CEO Walden] O'Dell tells investors of $10 million in lower revenues from election systems alone. Perhaps what Diebold isn't talking about is the $500,000 a month in legal fees they were spending in California, or the current rash of problems with touch screen systems that freeze up when votes are cast. Using Hurricane Katrina is a poor excuse for bad products - the last time this kind of deception occurred it was called Enron."

The blistering comments about Hurricane Katrina were in regard to Diebold's press release early Wednesday morning attributing much of their lowered forecasts for 3rd quarter and full-year earnings to the hurricane. The "freeze up" on Diebold's touch-screen voting machines has long plagued the North Canton, Ohio-based company, and a recent massive test of the equipment by California's Republican Sec. of State Bruce McPhereson confirmed that a full 20% of Diebold's machines either froze up or had printer jams.

When The BRAD BLOG spoke last week with Diebold spokesperson, David Bear about the California tests, Bear repeated several times times that "there were a total of 10 printer-jams after 11,000 votes were cast." When asked several times about similar statistics concerning the number of screen freeze-ups, Bear was unable to give us any information or numbers whatsoever.

The Tri-Valley Herald, however, had some numbers in their report on the massive California tests:

[W]hen Diebold representatives trucked in 96 brand-new TSx machines, and local elections officials voted on them July 20 in a San Joaquin County warehouse, nearly twice as many machines froze or crashed as had paper jams.
...
In all, 19 machines had 21 screen freezes or system crashes, producing a blue screen and messages about an illegal operation or a fatal exception error. A Diebold technician had to restart the machine for voting to resume. Ten machines had a total of 11 printer jams. Almost a third of all machines in the mock election had one problem or another.

Those tests, the largest of their kind, led to Sec. McPhereson's banning of the Diebold TSx touch-screen voting machines in the State of California, the largest voting "market" in the country.

Amongst other problems the company blamed on the hurricane in this morning's release, they claimed, "the impact of Hurricane Katrina is negatively affecting scheduled election systems deliveries in the Gulf region, resulting in approximately $10 million in lower elections systems revenue during the quarter."

As well, O'Dell himself is quoted in the release as suggesting "operational inefficiencies" as one of the factors contributing to lowered earnings expectations:

"I am extremely disappointed with our lack of progress in correcting our operational inefficiencies, and I am personally committed to taking immediate action to improve our effectiveness in these areas," said Walden W. O'Dell, Diebold chairman and chief executive officer.

However, O'Dell --- who took over today as President and Chief Operational Officer for Eric C. Evans who announced his resignation this morning --- didn't mention if correcting "operational inefficiencies" would include any changes to the $3,058,650 paycheck that O'Dell himself took from the company in 2004.

As well, DIEB-THROAT believes there's more bad news ahead for Diebold stockholders, pointing to the failure of stock prices to bounce back quickly today after the early morning plummet. "Typically the stock would bounce back after such a dip. This is a sure sign of a troubled company," says the source who continues to request anonymity based on a continuing sensitive relationship with the company.

More trouble in the days and weeks ahead was also predicted by DIEB-THROAT, who feels the trouble isn't as much the weather, as it is a poorly run company.

"If Hurricane Katrina was at fault this stock should go through the floor when Hurricane Rita hits. The fact of the matter is Diebold is mismanaged and unethical. The revolving door in top management we've seen in the last few months is perhaps the sprint for cover. After all who wants to be around when the feds pull back the curtain on the Homeland Security issue," said DIEB-THROAT in regard to the Cyber Alert issued last year, prior to November's election, by the U.S. Computer Emergency Readiness Team (US-CERT) --- an arm of the U.S. Dept. of Homeland Security --- as reported in a BRAD BLOG Exclusive late last week.

That "Cyber Security Bulletin", little-noticed by the media, and apparently wholly ignored by Diebold when it was originally posted in late August of 2004 is still available on the US-CERT website. It warns of an "undocumented backdoor" in Diebold's GEM Central Tabulator software used with its electronic voting machine systems. The security vulnerability could allow a local or remote user to modify vote tallies stored in the system according to the warning and corroborated by several different sources.

"This backdoor means that one malicious person can change the outcome of any Diebold election," DIEB-THROAT said in our previous article. "Diebold's election system," the source added, "is one of the greatest threats our democracy has ever known."

Odds 'n' Ends and the Net Reaction...

There's been quite a hullaballoo both here and elsewhere since I posted my exclusive interview with DIEB-THROAT last Thursday pointing to the Cyber Alert from the arm of the U.S. Dept. of Homeland Security which warned about Diebold's hackable machines prior to last November's election. That's good. Without noise and vigilance from the citizenry, the story of what has happened and continues to happen to our Electoral System in this country will be drowned out by those who have an interest in the system remaining as is...and real democracy in America will drown along with it.

It is up to you to make sure that something is done now about what DIEB-THROAT described as "one of the greatest threats democracy has ever known." Here's a link you can use right away to alert your Congressional Representatives (both Dem and Rep!) about the problem, and ask them to support at least one piece of legislation --- Rep. Rush Holt's HR 550 --- that attempts to deal with at least some of the problems in the current disastrous system. Holt's bill has over 100 co-sponsors now, including some Republicans as we understand, and thus it has the best chance of seeing the light of day in Congress at this time. It's worth supporting.

Several Mainstream Media organizations have contacted me since publishing Thursday's story to get more info and/or interviews with DIEB-THROAT. I've done everything I can to accommodate them, and hopefully we'll be seeing more on this story soon. Then again, I was also contacted by many MSM'ers after I broke the amazing Clint Curtis story, and we're still waiting for those exposes to appear in the MSM. So we'll see what happens. Don't wait for them! Make noise yourself right now!

Amongst the notable noise out there on the net was this coverage by Mako Yamakura at the Detroit News and Free Press weblog site. Yamakura does a fine job of explaining --- in laymen's terms --- the significance of the US-CERT Cyber Alert discussed in my original article.

Over at BlackBoxVoting.org where the backdoor vulnerability to Diebold's central tabulation software was originally discovered more than a year ago, there is a thread discussing our article, its ramifications and a great deal of additional information along with both kudos and critiques for yours truly. To be frank, I was a bit surprised there wasn't more appreciation for the story originally over there, since it provided independent corroboration to so much of what they've been trying to get folks to pay attention to for so long. Nonethess, I'm glad that folks are talking about it.

A few of the notable links found via BBV's thread would include:

  • Internal email purported to be from a Diebold support tech in 2001 asking about the security flaw in the GEMS tabulation software. And the lead technician who then acknowledges the problem in detail in return.
  • Rep. Dennis Kucinich's webpage quoting from the Diebold Employee manual, encouraging them to lie about ballot integrity issues in Diebold's election system. (Along with more links, to more internal emails).
  • Oh, and for the technically minded, you can download Diebold's GEMS Central Tabulator software right here and use the step-by-step instructions to hack it yourself!
  • I'm also reminded that you can watch Howard Dean hack the Diebold GEMS Central Tabulator in 90 seconds in a video clip from CNBC's Topic A with Tina Brown where Dean guest-hosted with BBV's Bev Harris as his guest.

    That demonstration is also used in the short Special Edition of the Votergate documentary film still in production by our friend Russ Michaels. If you haven't seen this version of his film, released to the net prior to last November's Election, you're in for an eye-opener! Go watch it!

    Lastly, for those folks who are just now waking up to unaccountable, unverifiable, untransparent privatization of America's elections by Diebold (the Halliburton of the Voting World) and others, I would recommend you:

  • a) Watch this video reminder of last November's Illegitimate Election as compiled in part by BRAD BLOG's own David Edwards.
  • And b) read the remarkable story of Clint Curtis about which I've been reporting since last December. Curtis, a Republican, claims to have been asked by Congressman Tom Feeney (R-FL) to create a Vote-Rigging Software Prototype in 2000. He has signed a sworn affidavit, given sworn Congressional testimony, and passed a polygraph test about all of that since then. Tom Feeney, notably, has not.

    DIEB-THROAT : 'Diebold System One of Greatest Threats Democracy Has Ever Known'
    Identifies U.S. Homeland Security 'Cyber Alert' Prior to '04 Election Warning Votes Can be 'Modified Remotely' via 'Undocumented Backdoor' in Central Tabulator Software!

    In exclusive stunning admissions to The BRAD BLOG some 11 months after the 2004 Presidential Election, a "Diebold Insider" is now finally speaking out for the first time about the alarming security flaws within Diebold, Inc's electronic voting systems, software and machinery. The source is acknowledging that the company's "upper management" --- as well as "top government officials" --- were keenly aware of the "undocumented backdoor" in Diebold's main "GEM Central Tabulator" software well prior to the 2004 election. A branch of the Federal Government even posted a security warning on the Internet.

    Pointing to a little-noticed "Cyber Security Alert" issued by the United States Computer Emergency Readiness Team (US-CERT), a division of the U.S. Department of Homeland Security, the source inside Diebold --- who "for the time being" is requesting anonymity due to a continuing sensitive relationship with the company --- is charging that Diebold's technicians, including at least one of its lead programmers, knew about the security flaw and that the company instructed them to keep quiet about it.

    "Diebold threatened violators with immediate dismissal," the insider, who we'll call DIEB-THROAT, explained recently to The BRAD BLOG via email. "In 2005, after one newly hired member of Diebold's technical staff pointed out the security flaw, he was criticized and isolated."

    In phone interviews, DIEB-THROAT confirmed that the matters were well known within the company, but that a "culture of fear" had been developed to assure that employees, including technicians, vendors and programmers kept those issues to themselves.

    The "Cyber Security Alert" from US-CERT was issued in late August of 2004 and is still available online via the US-CERT website. The alert warns that "A vulnerability exists due to an undocumented backdoor account, which could [sic: allow] a local or remote authenticated malicious user [sic: to] modify votes."

    The alert, assessed to be of "MEDIUM" risk on the US-CERT security bulletin, goes on to add that there is "No workaround or patch available at time of publishing."

    "Diebold's upper management was aware of access to the voter file defect before the 2004 election - but did nothing to correct it," the source explained.

    A "MEDIUM" risk vulnerability cyber alert is described on the US-CERT site as: "one that will allow an intruder immediate access to a system with less than privileged access. Such vulnerability will allow the intruder the opportunity to continue the attempt to gain privileged access. This request, according to Curtis, took place in October 2000 during a meeting at Yang Enterprises, Inc. (YEI), a computer consulting firm in Oviedo, Florida.

    Court Order Delivered at Dramatic Board of Elections Meeting as Eaton Supporters Rally
    ALSO: A Republican Board Member Admits Fundraising Work Done on BoE Property

    Hocking County, Ohio's recount whistleblower, Sherole Eaton --- who was recently fired without explanation in the wake of having reported on a voting company employee tampering with the hard-drive of a central tabulating computer and offering "cheat-sheets" prior to the recount of the November 2004 Presidential Election --- received some support yesterday from both a Court Order and several dozen backers at a dramatic Board of Elections meeting.

    Attorney Cliff Arnebeck, one of the attorneys who filed a case in Ohio to have the November Election results set aside due to evidence of fraud, served County Board of Elections officials with a court order mandating Eaton not be replaced until further court orders are issued.

    "Yesterday was the first of what I hope are many victories for Sherole," Karla VanBibber told us via Email earlier today. VanBibber, who is Sherole's niece attended the meeting, and described the moment when Arnebeck arrived with the court order: "The expressions on the board members faces when given the court injunction was priceless."

    VanBibber also gave us her take on the reactions from the Board Members in the face of questions from supporters about Eaton's dismissal, which she says is illegal under Ohio law. "Their sputtering and faultering and lying was unbelievable," she said. "It's amazing how the arrogance we see in the Bush administrations has filtered down to the local level as it has."

    Apparently, they won't be giving up the fight for Eaton, who is recovering from recent brain surgery, but attended the hearing "in apparently good spirits and seemingly good health - full of energy and zeal and very appreciative of the support," according to Evan Davis's detailed account of the meeting at Ray Beckerman's blog.

    Said VanBibber, "We knocked them down a few notches yesterday, we won't give up until they're on their knees and Sherole has her job back."

    Eaton's firing, and her dramatic appearance at another recent Board of Election hearing, just two days surgery, was covered in this previous BRAD BLOG report.

    Hocking County's Logan Daily News also had a report today on yesterday's meeting. "[Sherole] was so happy this morning when she received her paper," VanBibber said, "she came over and was so excited and for the first time in awhile was optomistic."

    (Bang, Bang Maxwell's Silver Hammer Came Down Upon His Head!)

    Every now and again we're pleasantly reminded that there are still good folks out there littered amongst the debris that is the American Corporate Media 2005. Or as Murrow presciently predicted, the "vast wasteland".

    We found one of those good folks in Carol Towarnicky of the Philadelphia Daily News (she'll be a guest on this weekend's BRAD SHOW who blasted the MSM for ignoring the Gannon/Guckert scandal. This week, it's kudos to Scott Maxwell of the Orlando Sentinel for his piece yesterday on your friend and ours, Congressman Tom Feeney (R-FL).

    You didn't think we forgot about you...did ya, Tom?

    It looks like Tom is up to his enchanting old tricks this week as he tries to disentangle himself from the scandals that he's in nearly as deep as Tom DeLay --- he just doesn't happen to be the House Majority Leader (yet), so you may not have heard. (You will in the future...no worries).

    Maxwell tears old Tom (Feeney, that is) a new one in his column, headlined "So sorry --- it's the media's fault" from yesterday:

    Feeney's chief of staff recently penned an apology to North Carolina's Rotterman and Associates, a consulting and lobbying firm that Feeney's office once listed as having paid for one of his many free trips. (Feeney now says that the influential consultants didn't pay for his trip to West Palm Beach. An influential conservative group did.)

    In the letter to Karen Rotterman, Chief of Staff Jason Roe wrote: "I cannot tell you how sorry I am that you were mentioned in the story. As you know, the current environment in Washington is such that reporters are in such a frenzy to write anything about Members' of Congress travel that anything not done absolutely correctly seems newsworthy to them."

    The things that Feeney didn't do absolutely correctly were:

    Take a $5,600 trip to Scotland, which included golfing at the Royal & Ancient Golf Club at St. Andrews that Feeney has said was paid for by another lobbyist, which would violate ethics rules.

    Mistakenly report that lobbyists (the Rottermans) paid for another trip, which would have been another violation.

    Still, Roe believes this is all much ado about nothing. "All this is, is media hysteria," he said. "The media think people care about this. They don't."

    We wish the media would become "hysterical"! They look fairly sound asleep on most of this to us. What with Runaway Brides and all to worry with.

    Maxwell closes smartly with this:

    Still, the public scrutiny likely will continue. And to add insult to Feeney's terrible-horrible-no-good-very-bad week, Feeney got bumped off a show on Fox News last weekend for another media hot topic: the runaway bride.

    Sounds like somebody needs a vacation.

    ...And the Tribune Syndicate's Bob Koehler does it again!

    So while we're on a roll...it seems that Clint Curtis' name and story (even briefly) are popping up in papers all around the country, and even around the world. Good folks (no doubt fine BRAD BLOG readers and patriots all!) seem to be contacting their local papers with letters to the editor to discuss the Election 2004 debacle, and tossing in the relevance of Curtis' story along with it! (See this page for more on Curtis if you need...and if so, where in the hell have you been for the last six months!?! ;-)

    So while we spend some hours working on some important things today, please feel free to take the time to jot a letter or two to your local papers. As we hope you've realized, "6 or 7" letters can make a difference.

    Some recent examples... Chicago's Northwest Herald in a letter headlined "Election thieves":

    Then, there is the complicated story of Florida computer programmer Clint Curtis, who recently passed a lie-detector test on his claim that he was asked by Rep. Tom Feeney, R-Fla., a Bush family friend, to design an undetectable program for flipping touch-screen votes, which he did.

    From Nashville's City Paper, in a letter headlined "The most important issue":

    Clint Curtis, the Republican whistle-blower who has testified that he was asked by (a current Republican Congressman) Tom Feeney ? who has denied it ? to write a program to hack a vote computer, came and demonstrated to us how it could be done. Curtis also announced that he had passed a lie-detector test about his allegation.

    Then in the Ireland's Irish Times last Saturday earlier this week, they ran an article (paid subscription required) which included the following:

    The arguments have been given a boost by a story in the St Petersburg Times in Florida, which is sceptical of conspiracy claims, but details charges by Clint Curtis, a 46-year-old computer programmer, that he was asked by a Republican Congressman, Tom Feeney, to come up with an undetectable system to fix elections.

    Feeney denied the charge saying: " . . . and I didn't lead the purple Martian invasion of Earth either". But Curtis passed a lie detector test, and the blogs are lighting up again.

    And finally, our new friend, Robert Koehler of the Tribune Syndicate, follows up his courageous and frank "Silent Scream of Numbers" piece --- the first that we know of from the "mainstream" to out and out charge that "Election 2004 was stolen" --- with another triumphant home run in his latest column. Titled, "Democracy's Abu Ghraib" the piece asks "If they can disable an election, what's coming next?" Just one of the many worthwhile money quotes:

    I never doubted, even after moving to Chicago in the mid-'70s, with the old Daley Machine (?vote early and vote often?) still huffing and wheezing, that elections mattered and could alter the balance of power. I never felt disenfranchised. Now that certainty is gone, replaced by dread.

    Read on. Then write on! The march of the "6 or 7" must continue and will prevail! Keep making noise!

    And More Questions are Raised about Whether Your Vote is Being Counted!

    Must be something afoot...Now it's Madison, Wisconsin's The Capital Times jumping into the Clint Curtis fray as a part of their online Daily Briefing item headlined "Is Your Vote Being Counted?":

    In Florida, a computer programmer named Clint Curtis has made the allegation he was directed to add code to a vote counting program to cause votes to switch from one candidate to another. Here's a link to the story. I'm not making any statement here as to whether his allegations are true or false because the investigation is ongoing. The question is whether this could be true, or if we have controls in place to prevent this. I don't see anything that would prevent this from happening, particularly since voting companies refuse to provide their source code under the guise of "trade secrets".

    The article also hits much of what BRAD BLOG readers have known about for months concerning the evils of the likes of Diebold and ES&S, etc. And granted, they may not be the Miami Herald (who also discussed Clint Curtis earlier today), but hey, the word is getting out! And better late than never! Democracy may be saved after all!

    Condemns E-Voting, Outlines a Litany of What Went Wrong in 2004 Election Fiasco!

    The drumbeat of the pro-democracy movement in America (who could have ever imagined there'd be a need for one in this country?!) seems to be growing louder as more and more Mainstream Media folks get into the game!

    Following on the heels of yesterday's Miami Herald piece about Miami-Dade's possible return to paper ballots, Herald columnist, Robert Steinback jumps in with a damning condemnation of Electronic Voting today pointing out that, "Nothing is more important, for the world's pre-eminent democracy, than assuring the sanctity of each vote."

    Steinbeck goes on to say:

    Worst of all, computer voting machines deny critics, reporters, attorneys general and historians the chance to recheck results --- which undermines the confidence any citizen can have in what are billed as free and fair elections.

    Indeed. Clearly there are still a few in the MSM who get it. It may just take them a while to figure it out.

    Moreover, Steinbeck --- for the first time that we know of --- mentions the Clint Curtis / Tom Feeney vote-rigging scandal in the pages of The Herald, along with a litany of reasons for returning to paper ballots [emphasis added]:

    Paper ballots can be forged or lost, for example, but attempting to swing elections using such methods almost surely requires a team of conspirators, and likely would leave a trail of evidence. With computerized voting machines, a hacked line of code can instantly alter thousands of votes.

    We may never find out what Walden O'Dell, CEO of touch-screen voting machine manufacturer Diebold Inc., meant when he told Republicans in a 2003 fund-raising letter that he was ``committed to helping Ohio deliver its electoral votes to the president [Bush] next year.''

    We may never learn the truth behind the affidavit of computer programmer Clinton Curtis alleging then-Florida Rep. Tom Feeney --- now a U.S. congressman --- asked the software company for which he worked in 2000 to design an undetectable computer program for flipping touch-screen machine votes.

    We may never know for sure if Nov. 2 exit polls that projected John Kerry winning several states he ultimately lost were themselves biased --- or whether they were accurate, exposing tampered election results. The victors, after all, never question the score --- or the scoring.

    And tomorrow, The BRAD BLOG has learned, syndicated Tribune Columnist, Robert Koehler will also go on record about the pitfalls of E-Voting, a condemnation of what went wrong in 2004, and some terrific coverage about those of us who are out there trying to fight the good fight to save our endangered democracy...even while the rest of the MSM continues to yawn.

    Perhaps things are changing, however. We'll see. But at The BRAD BLOG, hope always springs eternal. And so we press on...

    The title for this item comes from Lucy Morgan's own Jan 8th article in the St. Petersburg Times headlined "Aside from being wrong, AP had Jeb story right" wherein the Pulitzer Prize winner and SP Times Tallahassee Bureau Chief takes the AP to task for getting a single and small point wrong in a story on Jeb Bush's entourage. Also for being less than willing to cop to it.

    Small point or not, we appreciate Morgan's attention to detail, accuracy and potentially misleading information...At least in stories written by others. If only she held herself to the same strict standards.

    In her own now-ironic words of just three months ago...

    Sometimes it's hard to set the record straight.

    That's because it's hard for some people to admit mistakes.
    ...
    In this world of journalism, seems to me we are getting awfully thin of skin when we cannot admit we made a mistake.

    We all make them.

    Indeed. It remains to be seen how thick Ms. Morgan's skin truly is. Though a full read of the article from which we quoted above might come as a stunning surprise to those who read our full piece yesterday on Morgan's reportorial transgressions on her blown Clint Curtis scoop.

    Perhaps, as she mentioned while snipping at us on the phone (see the previous article) she really does have "two heads" after all. One for pondering the sins of others, and one for ignoring her own.

    As well, a BRAD BLOG reader just sent us a link to the SP Times "Standard of Accuracy" page which lists a few interesting thoughts and adds that one should contact Paul Tash, Editor and president at (727) 892-2231 or Timespresident@sptimes.com with any concerns.     BRAD BLOG Responds With Evidence to the Unfortunate Article in The St. Petersburg Times by the Pulitzer Prize Winning Lucy Morgan
    An Object Lesson in the Failures of Today's American Mainstream Media

    For months supporters and critics alike have been requesting that Clint Curtis take a polygraph test to help shore up (or debunk) the veracity of his explosive sworn allegations that then-Florida State Senator (and Speaker of the House) Tom Feeney, now a U.S. Congressman from Florida's 24th District, asked Curtis to create an electronic vote-rigging software prototype back in 2000 when Curtis worked at Yang Enterprises Inc. (YEI) where Feeney was also the corporate counsel and registered lobbyist in his "non-conflicting" day job while working as Florida's Speaker of the House.

    Curtis has now taken --- and passed --- the much requested lie-detector test as discussed here Saturday and as broken in a one-sided, unbalanced and unfortunate story by Lucy Morgan, the Pulitzer Prize winning investigative Tallahassee Bureau Chief for The St. Petersburg Times.

    While Morgan was handed this rather hot and exclusive scoop over a month ago, just after Curtis took and passed the test on March 3rd, her investigative work since then on this admittedly complicated and very broad case --- stretching back through at least four years of public and private paper trails --- resulted in an astonishingly amateurish piece which serves as a fine piece of pro-Feeney propoganda, a smackdown of the courageous and so-far verified claims of Clint Curtis and --- finally, though less importantly --- a slap in the face to the hard work we've toiled at here for over five months.

    Her article, inappropriately and condescendingly headlined "Blogs spin tale of computers, conspiracies" is loaded with countless points of misleading information, crucial omissions and out and out inaccuracies.

    Given our (apparently overly generous) offer to fact-check and/or advise and/or supply Morgan with any and all of the copious documentation and public records and hard evidence we've amassed over our past six months of reporting on this matter coupled with Morgan's impressive credentials and experience, we were somewhat stunned to read the fruits of her efforts on Saturday when the story finally appeared in The SP Times.

    As we are still somewhat at a disadvantage by being on the road for the moment (still in Nashville at the National Election Reform Conference), we'll have to do our best to speak to Morgan's many unfortunate errors and lack of apparent journalistic standards without access to our complete file of evidence. Nonetheless, we'll do our best to point out what we would have pointed out to Morgan had she bothered to run any of this by us before going to press.

    Given also that she found it necessary to include us in the story for inexplicable reasons --- other than perhaps to try and discredit the entire affair as a "conspiracy theory" of some sort --- it seems as though it would have been appropriate to check many of these facts with us and/or at least give us the opportunity to comment on several of the unsupported charges she makes in her piece.

    But alas, that seems to be the way of the Mainstream Media these days; Belittle and discredit the stories that they should have been reporting in the first place by suggesting that a story presented on a web log couldn't possibly hold the veracity of something reported by the MSM.

    On that note, we'll simply mention that after over six months of investigating and reporting on the Clint Curtis story, we've not once had to issue a notable retraction or correction to any of our work. Whereas one single article from Morgan includes enough misinformation for an entire column's worth of retractions, corrections and clarifications.

    We had hoped to extend the courtesy to Morgan that she didn't feel necessary to extend to either Curtis or us in order to give her the opportunity to explain herself and her many omissions, misleads and apparent lack of both "balance" and fact-checking in her story.

    Morgan's response to our invitation to comment today: "I have no interest in commenting on your story, you can publish that I have two heads if you want."

    We have no interest in publishing that Morgan has two heads, since that would be misleading and untruthful as far as we can tell. We do have an interest in publishing facts however, in a fair way, while correcting those who seem to display a problem in doing so themselves.

    So to that end, let's take a look at a few of the most egregious distortions, errors, misleads and omissions in Morgan's unfortunate article...

    Story Broken in Florida's St. Petersburg Times by Pulitzer Prize Winning Reporter!
    Still Manages to Mangle, Misrepresent and Omit Several Key Elements of the Story!

    (NOTE: Blogged by Brad on the road from the National Election Reform Conference in Nashville)

    After many months and many requests and many challenges from both critics and Mainstream Media types, The St. Petersburg Times is reporting --- and The BRAD BLOG can confirm --- that Clint Curtis took a polygraph test on March 3rd...and passed!

    The lie-detector test, administered to Curtis by Tim Robinson, the retired chief polygraph operator for the Florida Department of Law Enforcement, found that the Florida whistleblowing software designer who has charged in a sworn affidavit that he was asked by U.S. Rep. Tom Feeney (R-FL) to create an electronic vote-rigging software prototype in 2000, was indeed found to be truthful in all of his responses!

    Curtis' allegations in early December of 2004 when Curtis filed a sworn affidavit which was then followed up several weeks later with sworn testimony under oath to members of the U.S. House Judiciary Committee. (Video of that testimony is here.)

    The article which breaks the news of Curtis' polygraph test was written by Pulitzer Prize winning investigative reporter and Times Tallahassee Bureau Chief, Lucy Morgan.

    Despite her impressive credentials, the month-long exclusive access to Curtis' test-results that Morgan was given, and the full cooperation of The BRAD BLOG along with our months of reporting and materials acquired during our continuing investigation, she still managed to publish a number of errors and more than a few key omissions.

    As well, in the name of "balance" (the phoney-baloney concept invented by charlatans to give themselves a chance they don't deserve), Morgan manages to use several derisive quotes from Feeney, but not a single quote from Curtis.

    Granted, the story of this entire sordid affair is a broad one, stretching back at least 4 years with a miles-long paper trail to accompany it. Still, we'd expect a bit more responsibility from a Pulitzer Prize winner. Especially one who has had so much time to work on the story, gather information for it, and enjoy full and unfettered access for interviews with all of the key participants in the story.

    We knew there was trouble afoot from the first beat as the story was headlined "Blogs Spin Tale of Conspiracy, Computers". Which prompts us to wonder what headline The Times might have used when covering Woodward and Bernstein's series of Watergate articles in 1972: "Washington Post Spins Tale of Conspiracy, Cover-up"?

    We're currently at the National Election Reform Conference in Nashville (where folks have been incredibly supportive, including Election Reform All-Stars such as Green Party Candidate David Cobb and Free Press writer/editor and attorney Bob Fritrakis, and the delightful Congresswoman Cynthia McKinney! All have had nothing but tremendous things to say about BRAD BLOG and VELVET REVOLUTION --- and on video tape at that!)Though it makes it difficult for now to respond in full to the errors and omissions in Morgan's story. Or even to get her responses to them.

    We will do so --- with an update --- at the first available opportunity. Given what's going on out here, it may be a day or so...we'll see...

    One week after the November 2004 election, we blogged an item we called "Why It Matters: The World is Watching". The piece covered the way in which Russia's Pravda wondered aloud, "Did Bush fix the election"?

    Just over two weeks later, Ukraine's own fixed election, and the Bush administration's infuriatingly hypocritical outrage brought more condemnation from Pravda, this time as they chastised the American administration for having the gall to question anyone else's election after our own --- which was even more askew than Ukraine's. Our item headlined "Home to Roost - or, Democracies That Live in Glass Houses" covered the continuing degradation in esteem from our once-promising Russian ally.

    And today, it's The Moscow Times who joins the World's America Hating Party in a damning article suggesting the game is over and the forces of Democracy in the previously-Free World have lost.

    Unlike their compatriots in the American Media, The Times covers the Clint Curtis story in their article by way of referencing much of what The BRAD BLOG has reported on that sorry affair. They've even beaten the American Media at reporting on the latest Baker Commission Blue-Ribbon "Election Reform" fix which America can now look forward to --- even if they're not paying attention --- unless something is done about it.

    The rest of the world recognizes news, and what it may mean for this country and the world. Even if the American Media does not.

    Though that may change a bit over the next few days as a major American Newspaper may indeed be jumping into the Clint Curtis fray. We'll do our best to keep you abreast of those developements even as we're otherwise occupado down here in Nashville...Stay Tuned...
