Dr. Marble is not arrested, he received a simple citation and his lawyers are with him.

In fact, the EBAY auction continues to sell his DVD collection. The only reason Marble's first EBAY listing was removed is not a free speech issue, but the fact that it used the 'F' word repeatedly and was against the terms of service for viewers.
