   The neoCon talking points mythology is desperation.

   And how little the MSM talking heads know about "that part of the world" where they seek to blame state officials for the New Orleans flood due to levee breakage.

   I decided I would post some laws, concerning that area, which the federal congress passed. Guess why congress and not the state legislative bodies passed those laws …. wow could it be because of exclusive federal jurisdiction on such matters? Wow golly you mean the mayor of New Orleans is not to blame for the levee failure?

   In general, Title 33 of the United States Code, deals with navigable waters within the boundaries of the United States and Territories.

   There is a lot of power in this federal matter. Notice what congress said about the Louisiana Purchase:

   "All the navigable rivers and waters in the former Territories of Orleans and Louisiana shall be and forever remain public highways" (Title 33, Section 10, US Code, bold and italics added).

   Wow, that seems like a lot of federal power to tell the people "from that part of the world" what they can do with "their" rivers and waters.

   Notice what these federal folk told the State of Alabama:

   "The Tennessee, Coosa, Cahawba, and Black Warrior Rivers, within the State of Alabama, shall be forever free from toll for all property belonging to the United States, and for all persons in their service, and for all citizens of the United States, except as to such tolls as may be allowed by Act of Congress." (Title 33, Section 8, US Code, bold and italics added).

   Wow how can the feds tell Alabama what to do with "their" rivers?

   Well, it is because of exclusive federal jurisdiction ("who has the say"). Notice the clear words to that effect:

   "In connection with the exercise of jurisdiction over the rivers of the Nation through the construction of works of improvement, for navigation or flood control …" (Title 33, 701-1, emphasis added).

   Yep, the Corp of Engineers are the ones doing the levees to control flooding (well, as long as they are given the money).

   So why are the neoCons now saying that the only thing the states get is the blame?

   Because they do not know whereof the speak. The law of flood control jurisdiction is:

   The words ”flood control” as used in section 701a of this title, shall be construed to include channel and major drainage improvements and flood prevention improvements for protection from groundwater-induced damages, and Federal investigations and improvements of rivers and other waterways for flood control and allied purposes shall be under the jurisdiction of and shall be prosecuted by the Department of the Army under the direction of the Secretary of the Army and supervision of the Chief of Engineers" (Title 33, Section 701a-1, bold and italics added).

   The Army Corp of Engineers absolutely and without doubt understand that it is they who do the levees and not the states.

   Their website says:

   "In cities near waterways, floodwalls, levees and diversion channels all work to keep storm water out of homes, schools and businesses". (link here).

   So do not believe the thieving, lying, and corrupt federal politicians led by KKKarl Rove (CIA agent outer boy) who would love to deceive and shift blame to local city and state officials.
