Among the stories covered today that (largely) have nothing to do with felony indictments...

• Hurricane Hilary spins up suddenly off the coast of Mexico and is now gaining strength amid an El Nino. The storm is said to be heading north to make what could be an "exceedingly rare" landfall over the next few days somewhere here in Southern California or along the Baja Peninsula before moving up and into Arizona --- if you believe scientists who are experts in this sort of thing.

• The gerrymandered Republican state legislature in North Carolina on Wednesday overrode vetoes by Democratic Gov. Roy Cooper to enact new laws that are unspeakable cruel to, among others, transgender children. If you are unaware, we explain exactly why these types of laws --- now adopted by 22 GOP-controlled states (though being challenged in court in most of them) --- are so awful and cruel. That is, unless you are a Republican, like those who stole control of the NC legislature, who believe Big Government should intercede between doctors and patients and that so-called "parental rights" should also be overruled by Big Government autocratic fiat.

• Speaking of autocracy, gerrymanders and Big Government Republicans now dictating to small, local government and voters...the morally and ethically broken GOP-controlled state legislature in Texas has recently passed a law to oust the chief election official in Harris County (Houston) --- and only in Harris County --- just months before upcoming municipal elections in the state's largest and most Democratic-leaning County. A state judge this week found the new law in violation of the Lone Star State's constitution. But, just hours later, the state put that ruling on hold by appealing it to the TX Supreme Court (all Republican). The November elections are now just weeks away and, unless something changes quickly, will apparently be run by the Harris County Tax Assessor-Collector who has zero experience running elections and had nothing to do with the months-long planning for the one where early voting is set to begin next month.

• In far more encouraging news about autocracy, gerrymandering and, in this case, democracy, we head to the great state of Wisconsin. On August 1, Justice Janet Protasiewicz became the state Supreme Court's newest member after being elected earlier this year. Her landslide (for Wisconsin) 11-point victory in April means that liberals now hold a majority on the state's High Court for the first time in about 15 years. On August 2, a group of petitioners filed with the state Supremes to not only force new, fair legislative maps for the state's House and Senate for the first time in more than a decade, but also for emergency elections next year for all members of the state Senate, many of whom will not otherwise face reelection until 2026 despite occupying seats that petitioners argue are held only thanks to the GOP's unconstitutional partisan gerrymanders. BRAD BLOG legal analyst Ernie Canning wrote about this challenge to the state's illicit, entrenched legislative majorities this week and the potentially very good news it represents for Badger State voters. Just after airtime today, however, he updated his article with...well, some more good news but also...some troubling news about the gerrymandered GOP's new scheme to undermine democracy, the rule of law, the state constitution and state voters with impeachment proceedings against Protasiewicz in hopes of stealing back the Court to hold onto their entrenched, corrupt state legislative majorities. (See Ernie's UPDATE today on that story for more details.)

• Then, a bit of listener mail in response to my apparently controversial suggestions of late that Donald Trump may very well not be on the general election ballot by November of next year.

• And, finally, Desi Doyen has our latest Green News Report with updates on the horrific fires on Maui and in Canada, but some very encouraging news about President Biden and the Democrats' landmark climate law, signed one year ago this week, which is already resulting in a clean energy manufacturing, construction and jobs boom in the U.S. --- and even overseas!...

For some reason, it seemed like a good moment on today's BradCast to bone up on exactly what "racketeering" or RICO charges are. I have a feeling it may come in handy in the days ahead. [Audio link to full show follows below this summary.]

But, FIRST UP, it's Election Day in Ohio. One single statewide ballot issue, in the middle of August. That's because Republican lawmakers were hoping to undermine a ballot measure set for this November which, if successful, will codify protection for reproductive freedoms into the state Constitution.

For more than 100 years in the Buckeye State, Constitutional Amendments were adopted via the ballot with a simple majority vote. Today's measure, Issue 1, would raise the requirement needed for passage to a 60% super-majority. Of course, the GOP's Issue 1 on the ballot today would require just 50% + 1 for passage.

As we've been reporting, despite the state Republicans' attempt to sneak their anti-democracy Amendment past voters (after, earlier this year, adopting legislation to ban August Special Elections), early voting has been huge. Today's Election Day turnout was reportedly higher than expected as well. Happily, there were, so far, only a few reported problems at the polls. We'll see if that changes and we'll have reported results on this critical measure tomorrow.

THEN, over the weekend, Donald Trump's top attorney on his new indictment by Special Counsel Jack Smith for his many failed attempts to steal the 2020 Presidential election, was all over the news shows offering absurd defenses for his client's crimes. John Laura told Meet the Press, for example, that "a technical violation of the Constitution" isn't actually unlawful.

Congressman Jamie Raskin (D-MD), who happens to be a Constitutional law professor (as well as both the Lead Manager for the U.S. House during Trump's second impeachment for insurrection and a member of the bipartisan House Select Committee investigating it) strongly begged to differ. Critically, he noted in his response to Lauro's remarks, there are people serving years in jail in this country for falsifying one single vote, whereas Trump "tried to steal the entire election."

Thank you, Congressman!

NEXT, we continue to await what is almost certainly going to be Trump's fourth criminal indictment in about as many months. This one will come any day now, likely this week or next, courtesy of Fulton County, Georgia District Attorney Fani Willis in relation to Team Trump's failed attempts to steal the Peach State's election in 2020 from Joe Biden and the state's voters.

Her case, for reasons explained on today's program, could be expansive, including many charges and many conspirators acting in concert with Trump. Exactly who will be charged and what they will be charged with remains unknown.

Among the many questions about Willis' case: Will she invoke the state's "Racketeer Influenced Corrupt Organizations" (or RICO) Act or just simple conspiracy charges? And, oh, by the way, what are the difference between the two, as RICO is best known for use against organized crime by the mafia, etc.?

Luckily, KEITH BARBER, former attorney, former Republican and current Daily Kos contributor on law and Constitutional matters, recently wrote about exactly that and joins us today for a helpful RICO primer and insights into Willis' likely imminent indictments.

Short version of the difference between "conspiracy" and "RICO", as Barber wrote last month: "Conspiracy requires an agreement between the co-conspirators to commit what are usually specific crimes. RICO does not require proving any such agreement. So long as the parties commit the required predicate offenses, as part of the same 'enterprise,' acting 'in furtherance of a common purpose,' RICO can be satisfied."

As Barber tells me today: "The mob boss doesn't necessarily plan anything with the guy who is running the protection racket He may not even know him. But they are both engaged in the same broad criminal enterprise. That's the distinction between RICO and conspiracy. You don't have to show the connections that are shown in the [Jack] Smith indictment of Trump between the co-conspirators. It's sufficient if they engage in a pattern of racketeering activity in furtherance of the same general objective."

If you'd like a more detailed explanation, tune in to today's show, when Barber also offers his thoughts on who is likely to be indicted. "All indications are, all the hints are, that it's going to be a whole lot of people, with a whole lot of charges. It's kind of mind-boggling how many people it could be."

Also discussed: last night's court ruling in columnist E. Jean Carroll's rape and defamation case against Trump and his counter-suit for defamation against Carroll. Short version: Trump's suit was tossed as the judge confirmed that, yes, Trump was found by a jury to have been a rapist according to common vernacular, and Carroll's second civil trial against him (she already won $5 million from him during the last one, now she's suing for at least $10 million) is scheduled to begin early next year and could be a very very short trial given everything that was already established as a fact in the first trial.

Literally minutes before today's BradCast, news broke that the grand jury in D.C. hearing Special Counsel Jack Smith conspiracy case against Donald J. Trump regarding his many failed attempts to steal 2020 Presidential election had handed up a four-count federal indictment against Donald J. Trump. Seconds before airtime, Smith offered a brief statement on the new indictment. We cover both today...on the fly...

As Smith announced (we share his brief remarks in full), Trump was indicted on four federal felonies...

• Count 1: Conspiracy to Defraud the United States [18 USC 371]
• Count 2: Conspiracy to Obstruct an Official Proceeding [18 USC 1512(k)]
• Count 3: Obstruction of, and Attempt to Obstruct, an Official Proceeding [18 USC 1512(c)(2)]
• Count 4: Conspiracy Against Rights [specifically, the right to vote and to have one's vote counted, 18 USC 241]

Six of Defendant Trump's alleged co-conspirators are briefly described in the 45-page indictment [PDF], though not named within it. The co-conspirators appear to be uncharged at this time. Most of their names were pretty simple to identify based on their description in the indictment (see pages 3 and 4). According to Washington Post, which names 5 of the 6 of them, it appears we got them pretty much correct as we read through the early portion of the charges on today's show. WaPo identifies them as...

• Co-Conspirator 1: Trump attorney Rudy Giuliani
• Co-Conspirator 2: Trump attorney John Eastman
• Co-Conspirator 3: Trump attorney Sidney Powell
• Co-Conspirator 4: DoJ Asst. Attorney General Jeffrey Clark
• Co-Conspirator 5: Trump attorney Kenneth Chesebro
• Co-Conspirator 6: A still unidentified "political consultant" whose description matches several potential different Trump henchmen.

Looks like we were correct, at least, on Co-Conspirators 1 through 4. Emptywheel's Marcy Wheeler agrees WaPo's ID of Chesebro as number 5 is "sound". He is described in the indictment as "an attorney who assisted in devising and attempting to implement a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding". We speculate on the show that Co-Conspirator 6 could be Trump's 2020 campaign Director of Election Day Operations Michael Roman, but that's just an on-the-fly guess.

The most central aspect of the charges, at least to my eyes, is that Donald Trump not only attempted to steal the election by lying about it, using dozens of fraudulent claims for months after the November election, but knew that he was lying about every aspect of it.

"The Defendant lost the 2020 presidential election," the indictment reads in its first paragraph...

He lost. He knew it, because he was told by his closest advisors and all the top state and federal officials with whom he conferred. And, yet, he fraudulently claimed otherwise in hopes of defrauding the American people and stealing a Presidential election. He is finally be charged for all of the above.

It's all spelled out, quite readably, in the indictment [PDF] which Smith, in his brief remarks, encouraged "everyone" to "read in full".

We will, no doubt, have more on all of this in the days ahead. In the remaining time on today's show, as salvaged somewhat from our previous planned program...

• The sudden death of New Jersey's Lt. Governor Sheila Oliver, the first statewide black official in the Garden State and a central character in my 2011 blockbuster exclusive on then Gov. Chris Christie's secret address to the Koch Brothers secret political gathering that year in Vale, CO.

• The critical election next Tuesday, August 8, in Ohio, where corrupt, authoritarian Republicans have suddenly called a special election to try and adopt a constitutional amendment that would require 60% approval by voters for all future constitutional amendments placed on the ballot. This measure, however, would still need only 50% to be adopted. The scheme is meant to undermine a citizen's ballot initiative planned for this November that would write protections for reproductive freedoms into the Buckeye State constitution.

We're back live on today's BradCast after a much-needed holiday stand down last week, even as the world registered its hottest day on record...four different times on four consecutive days. Other than that, did we miss anything? [Audio link to full show follows this summary.]

The globe is broiling, but it's also flooding for the same reason. Our climate is in crisis. From the U.S. to Canada to Spain to India and China, just to name a few of the "hot spots" over just the past 24 to 48 hours or so. And, in case your other news sources forgot to tell you, it's all our fault. Or, at least the fault of the fossil fuel industry and the politicians and dupes they've bought off over the decades to hoax you into believing that our climate crisis itself is a hoax. It isn't. And, based on the mind-warping records being shattered across Planet Earth right now --- with little hope of cooling any time soon --- a case can be made that if we haven't hit a few disastrous, point-of-no-return tipping points by now, we are certainly on the verge.

Climate warming greenhouse gas emissions, mostly from the burning of fossil fuels, continue to increase along with smashed heat records. Is it too late to do anything about it?

Longtime climate and energy reporter ANDREW FREEDMAN of Axios joins us today to discuss the mind-blowing records now being shattered by the day, who should be held accountable for it (including those in the media), and if it is or isn't too late for humanity to take action to reverse course

When I ask Freedman if it's hard to wrap his head around all that now seems to be going on in the climate, even after so many years of warning folks that this would be, he tells me, "It is. While my expectations might have been for some of these records, everything everywhere all at once is how it feels right now. It feels that way as a reporter, it feels that way as just a person on Earth."

"The global records weren't something I was expecting to jump out this early in July. The peak is usually later in July," he explains. "It's pretty much a done deal that July will be the hottest July on record, and most likely the hottest month that we've seen since records began." The news he has for the rest of the year, and for next year, isn't much better.

He's got a lot more to say. He's been writing a lot about this of late for some reason.

Then, with an invitation for a "Reverse BradCast" --- where listeners call in to tell me what they think I need to know, and I get to tell them they are wrong about it --- most of our callers today wanted to talk about the climate instead for some reason. And that's probably a very good thing.

As Freedman notes today, citing climate scientist Katharine Hayhoe, "Her appeal to people is to say, 'The most powerful thing that you can do about climate change is to have a conversation with somebody about it.' We need to be talking about it more. All these things actually have an impact. It's not just 'Oh well, we're screwed.' It's hard not to think that way. It's hard for me and other climate reporters. But there are a ton of solutions. The question is are we going fast enough?"

So far, the answer, according to most scientists?: No. We absolutely aren't. That can still change. But only if we keep talking about it to everyone who will listen...and even those who don't want to...

We wrap up our last BradCast before standing down next week with a bunch of disparate stuff, both good and bad, and even a song to help you whistle as you leave the theater before next week's holiday. [Audio link to full show follows below this summary.]

WE DID START THE FIRE: And we're also responsible for the smoke from hundreds of them in Canada, now threatening the health of more than 100 million Americans. We're also responsible for the record, weeks-long deadly, triple-digit heat wave in Texas now spreading north and east and touching off deadly severe storms along with it. Of course, those who watch Fox "News" and the read their deceptive Fox Weather website will never know who's to blame for it all and who is endangering their lives and those of their great grand-kids. But keeping their viewers and readers dumb and disinformed is the whole purpose of the Fox fake news project. Sadly, we all pay the price.

'CEASEFIRE AND NEGOTIATE!': Happily, it seems the 24-hour mutiny in Russia last weekend --- wherein longtime Vladimir Putin-ally, Yevgeny Prigozhin, gave the game away by declaring that their imperialist invasion of Ukraine was built on lies and was never about either "demilitarizing" or "de-Nazifying" Ukraine --- has helped the scales fall from a bunch of Americans' eyes. New polling from Reuters/Ipsos since the Prigozhin's short-lived insurrection finds a nearly 20-point bump since last month in American support for Joe Biden's policy of helping Ukraine defend themselves. That includes majorities in both major parties as well as independents. That's very good news. And, while I'm unlikely to reach many of the duped rightwingers who have fallen hook, line and sinker for Putin (and Trump) propaganda about the conflict, I am hoping that I might still be able to help some of those on the supposed anti-war Left who have fallen for the same propaganda. I'm talking largely about the "ceasefire and negotiate!" crowd. A few words for them today in hopes of helping a least a few of them understand how they have also been played by the same, authoritarian sources as the rightwingers.

'THIS IS NOT A NORMAL COURT': President Biden was right about that today, at least. We knew after all of the surprisingly good rulings of late from our otherwise corrupted, stolen and packed U.S. Supreme Court majority --- on issues of democracy and voting, in particular --- that it was almost certainly too good to last. As the high court's 2022 term comes to a close, they returned to their corrupted form on Thursday by overturning more than 40 years of precedent to bar Affirmative Action policies in college admissions for all private and public colleges and universities (while exempting military academies for some odd reason). Though it's not easy, we try to make sense of the Court's dizzying 237-page ruling [PDF], including multiple concurrences and dissents, as the far-right activists on the bench --- and those that put them there --- get to cross another long-term project off their list today.

SMOKE GETS IN YOUR EYES: And lungs, from the record shattering Canadian wildfires. At least if you live in any of a whole bunch of states in the mid-west or east this week. That, and more climate news, both good and bad, as Desi Doyen joins us for our latest Green News Report.

Nonetheless, most of our stories today are, happily, not horrible. Among the many covered today...

• An obnoxious Fox "News" chyron describing President Joe Biden as a "wannabe dictator" on the day of Donald Trump's federal arraignment on 37 criminal felony counts (and their ham-fisted crocodilian "cover up" thereafter) offers a telling illustration of how the Trump Mind Virus has been implanted into the poisoned brains of his cult followers.

• The faintest of cracks may be emerging in the otherwise seemingly solid GOP support for their disgraced, criminal defendant former President, including an unmistakable plunge of some 15 points for Trump in Ipsos/Reuters polling among Republicans from April to June.

• Rex Huppke's hilarious and brilliantly spot-on "I don't want to live in a country where Trump could be held accountable," further dismantles the absurd claims by those with the Trump Mind Virus that we have a "two-tiered justice system" because Trump is being held accountable for crimes that neither Joe Biden nor Hillary Clinton ever actually committed.

• The attorney for 2016 Russian election interference whistleblower Reality Winner, however, has a few thoughts on our actual two-tiered justice system.

• After stunningly good decisions last week protecting both the Voting Rights Act and Medicaid, the otherwise-corrupted U.S. Supreme Court did it again today, with a 7 to 2 ruling upholding the Indian Child Welfare Act, with Amy Coney Barrett(!) writing the opinion that rejects "all of petitioners' challenges to the statute". Still to come by the end of the month, however: SCOTUS rulings on Affirmative Action in college admissions; the Independent State Legislature theory decision that could wreak utter havoc in the 2024 Presidential election; and whether they will deign to allow Biden to waive up to $20,000 for each federal student loan borrower.

• We've also had some very good news from the lower federal courts as well in recent weeks, including a U.S. District Court judge rejecting Tennessee's Republican Gov. Bill Lee's attempt to stifle free speech by unconstitutionally banning drag shows, and a temporary injunction on portions of Florida's Republican Gov. Ron DeSantis' unspeakably cruel law that places his state's Big Government between doctors and medically necessary treatments for trans children. That, in a state where DeSantis laughably ran for reelection last year with the slogan "Freedom Lives" in Florida.

• Of course, as we've learned since 2016, for GOP American Idiots infected with the Trump Mind Virus, "The Cruelty is the Point". They seem to think it will somehow help them gain or hold power. Illinois' Democratic Gov. J.B. Pritzker, however, in his Commencement Address at Northwestern University this week, has some helpful advice on how to spot an idiot. (Hint: Their cruelty is a dead giveaway.)

• Finally, Desi Doyen joins us for our latest Green News Report, with troubling news for the Summer on both sides of the Canadian border and in Texas. But, there is also a very encouraging landmark trial playing out right now in a Montana courtroom...

On today's BradCast: Yes, some actual, unqualified good and, frankly, surprisingly good news from our otherwise wildly corrupted U.S. Supreme Court on voting rights and racial gerrymandering! [Audio link to full show is posted below this summary.]

Last year, following oral argument at the High Court in Allen v. Milligan, a Voting Rights Act challenge in Alabama, pretty much all Court watchers and voting rights advocates thought that Section 2 of the VRA was in big, big trouble. That, after the Supremes had already gutted Section 5 of the Act in the Shelby County case back in 2013 and have been nibbling away at the rest of the landmark 1965 law ever since.

But on Thursday, Chief Justice John Roberts and Justice Brett Kavanaugh actually joined with the Court's three liberals in a 5 to 4 majority opinion [PDF], upholding a lower court ruling by a three-judge panel --- including two Trump appointees --- which had determined that Alabama must rewrite its redistricted Congressional maps after the 2020 Census to include a second majority Black U.S. House District.

Early last year SCOTUS had used the "shadow docket" to temporarily put the lower court's ruling on hold without a hearing, allowing the 2022 elections to move forward with just one out of AL's seven U.S. House Districts having a Black majority, despite African-Americans comprising some 27% of the state's population. That ruling --- along with tea leaves read from oral argument last year and Roberts' history of working to dismantle the VRA --- led many to believe the Court would permanently allow the state's racial gerrymander to remain in place, effectively overturning the ban on election laws and House maps created with a racially discriminatory intent.

Alabama's GOP gerrymander had been challenged as a violation of both the Constitution and Section 2 of the VRA, after the Supremes' previous gutting of Section 5 of the Act removed the mandate for jurisdictions to demonstrate in advance that new election laws did not discriminate on the basis of race. Challenges under the Act may still be filed under Section 2, but only after the discriminatory voting measure has been enacted.

The Court's actions last year also allowed similar racial gerrymanders in several other states, including Louisiana, Georgia, Texas and elsewhere, resulting in the GOP winning a razor-thin 5-seat majority in the U.S. House in November.

Thursday's stunning decision, according to experts, could net Democrats as many as four or more seats in the House in the 2024 elections, and is likely to affect ongoing legal challenges in as many as 10 states.

Our guest on today's program believes that, "Gerrymandering and redistricting was one of the big reasons why Republicans probably had about a net gain of between 12 and 15 seats [last year] when you look at the various partisan gerrymanders and the various racial gerrymanders that the Court allowed."

We're joined today to discuss all of this, the details of how it happened, and what it appears to mean going by forward by a stunned DAVID DALEY of FairVote, where he is an expert on gerrymandering and author of two different books on the topic.

"I don't even know what to say," Daley explains at the top of our conversation. "I'm so used to delivering the bad news, and all of a sudden I'm a doctor telling you you're going to live forever. This is an unusual role for me."

But, don't worry. Daley is still able to share a number of concerns about several other cases with opinions coming soon from SCOTUS, despite today's unreservedly good news for voters, voting rights, and the future of the not-dead-yet Voting Rights Act!

THEN, with today's excellent news that may well result in Democrats regaining the majority arguably stolen from them by unlawful GOP gerrymanders last November, the current GOP majority in the House is busy eating itself alive. The party's far-right flank has mounted a mutiny on the House floor this week, in rebellion against Republican House Speaker Kevin McCarthy's debt ceiling deal last week with President Biden to avoid the first-ever default of the U.S. Government. And it's all quite hilarious.

FINALLY, Desi Doyen joins us for our latest Green News Report, as the worsening affects of our climate crisis are now choking Americans across much of the east coast and midwest with toxic smoke from hundreds of record, out-of-control, Canadian wildfires blanketing much of the nation. We also cover the Biden EPA's long-overdue upgrades of Jackson, Mississippi's water system and the ecological disaster in the wake of the destruction of a critical dam in Russian-occupied Ukraine.
