You're going to get the most, by far, from today's BradCast, by listening to it. This briefest of summaries will not do it justice. Hopefully it suffices if only for a few links to a few of the stories and rulings cited throughout today's program. [Audio link to full show follows below this summary.]

In short (very short), the Trump Administration is losing and losing and losing in court, in case after case after case. And they are not only losing, but being upbraided by judge after judge --- those appointed by both Democrats and Republicans alike --- in one ruling after another now. At least at the lower federal court level. It's just one reason why the Administration is so desperate to get up to the final appeal phase at Donald Trump's corrupted, hand-picked Supreme Court.

The rulings from many of the U.S. District Court judges have been brutal for the Administration, as now coming in day after day. Just one example from yesterday is U.S. District Court Judge Ana C. Reyes' blistering ruling [PDF] in which she took DHS Secretary Kristi Noem to the metaphorical gravel pit over Noem's barely disguised racist rhetoric as part of the Administration's attempt to order the end of legal protected status for more than 350,000 Haitian refugees in this country. (Ya know, like the ones in Springfield, OH who don't eat dogs or cats.)

The good guys aren't winning every motion in every case. And, as noted, the corrupted SCOTUS may have the last word in some of them. But the increasingly dreadful record for the Government in these cases, for the moment, has essentially become the equivalent of legal trench warfare, forcing the Administration to step back or stand down, with the people largely holding off the attempted fascist federal takeover of the United States of America. Or, at least, preventing it from getting appreciably worse.

Russia was supposed to have taken over Ukraine in a week's time after they initially invaded their smaller, weaker sovereign neighbor four years ago this month. Similarly, Trump was supposed to have brought the U.S. to fascist MAGA heel by now. He decidedly has not.

With each loss, of course, in both courts of law and public opinion, he and his Administration grow angrier, more out of control and more dangerous --- but easier still to defeat in the bargain.

As his and his party's approval ratings --- and ability to win elections in even some of the "reddest" parts of the country --- continue to erode, he is now desperately turning to an attempted takeover of American elections themselves.

"The Republicans should say, ‘We want to take over,'" Trump blathered to Dan Bongino, former conspiracy podcaster turned Deputy FBI Director turned conspiracy podcaster again, on Monday. "We should take over the voting, the voting in at least many --- 15 places. The Republicans ought to nationalize the voting."

Trump then went on to completely mischaracterize why former MAGA Mesa County, Colorado Clerk Tina Peters is currently serving nine years in state prison for her criminal efforts related to attempting to defraud the 2020 election while illicitly conspiring to make unlawful copies of sensitive, proprietary voting system software. Despite having issued a pointless pardon for Peters (federal crimes have no effect on convictions under state laws), it's clear Trump knows absolutely nothing about her actual crimes.

But, as to the "nationalize the voting" thing, please know (as I explain in more detail on the show): Presidents have absolutely ZERO power to do any such thing. Elections are run by states and, to some extent, Congress may make laws that states must follow. He has no Constitutional or legislative or super-secret power to nationalize them, much less ordering "Republicans" to do so. It is, at best, a very empty threat. Whether he knows that or not is unclear. And, yes, as discussed, there are things that he can try to do, with the unlawful deployment of ICE forces, for example, to make things more difficult for voters to vote this year. But I suspect any such efforts will end up hurting his party's chances more than they will help.

Tune in for the full argument, of course.

At the same time --- as Saturday Night Live hilariously satirized over the weekend --- more and more Trump supporters are (slowly, but surely!) finding their way back toward sanity, or at least away from Trump. I suggest we find ways to help them safely get there.

On today's BradCast: Our final round-up of the Gerrymandering Wars at year's end, as we head into the critical 2026 election year following a big, disturbing, redistricting ruling by the corrupt Republican SCOTUS majority. Also today, similarly disturbing news regarding our petty President's latest scheme to undermine life-saving climate science. [Audio link to full show follows this summary.]

FIRST UP... News broke last night that Donald Trump has ordered the dismantling of the world-renowned National Center for Atmospheric Research (NCAR) in Boulder, Colorado, due to what the fossil-fueled Administration ridiculously describes as "federal climate alarmism".

NCAR was created by the National Science Foundation in 1960 as an independent executive agency funded by Congress, as global warming caused by the burning of fossil fuels was already becoming an increasing concern. Even one of the few climate scientists known for his climate change skepticism described NCAR today as a "crown jewel" for the study of atmospheric chemistry and physical meteorology.

The climate science community is, as Hill Heat journalist Brad Johnson reports, "in complete shock" about this "insane move" to undermine science and put millions of lives at risk.

But, believe it or not, while shuttering the 65-year old institution will certainly serve the White House's fossil fuel industry masters well enough, the move actually seems to have as much to do with Trump's twisted vendetta against Democratic Colorado Gov. Jared Polis on behalf of brain-poisoned former MAGA County Clerk Tina Peters. She is currently serving 9-years in prison related to breaking into and making unlawful copies of voting system hard drives in a failed attempt to prove fraud during the 2020 election.

Yes. It's all as ridiculous and self-defeating as it sounds. But, that's Trump. Scientists vow to fight the move, even as Trump will likely have to count on his corrupted SCOTUS to allow him to force his will on yet another federal agency created by Congressional mandate to be independent from the Executive Branch.

THEN... As you know by now, afraid of being seen as a loser yet again next year, our corrupt President began ordering Republican-controlled states earlier this year to take the virtually unprecedented step of redistricting U.S. House maps mid-decade in order to try and gerrymander seats held by Democrats out of existence.

The multi-state effort had largely been a wash for the GOP to date, as "blue" states pushed back to try and balance the scales in response. It might have even resulted in a loss for Republicans next year, thanks to a ruling by a three-judge federal panel --- led by a Trump-appointed judge(!) --- after a 9-day hearing of evidence and witnesses, finding that Texas' attempt to gerrymander five Democratic seats in largely majority-minority districts amounted to an unlawful, unconstitutional racial gerrymander.

But, after the briefest of reviews over the Thanksgiving holiday, the corrupt Republican SCOTUS majority issued a terse, unsigned "shadow docket" ruling that allowed the unlawfully gerrymandered Texas map to be used in next year's critical midterms anyway. The 6 to 3 Republican majority said it was just too late and too confusing to use the House maps that used over the past two elections in the Lone Star state.

Citing the "Purcell Principle", another one of the Roberts Court's made-up use-if-and-when-necessary legal doctrines, the majority gave Texas the green light to use its new, unconstitutional, Republican-friendly map next year because the lower court "improperly inserted itself into an active primary campaign, causing much confusion and upsetting the delicate federal-state balance in elections."

Try not to laugh. That "active primary campaign" the lower court "improperly inserted itself into" would be the midterm primaries scheduled for next March in Texas, to determine candidates for the ballot in November of 2026. While few realized it was an "active" campaign at this point, it could have been, as our guest today notes, moved back by the court, if necessary. Though it is hardly necessary, being months away and, until the new ruling, run on a map that voters have been using without a problem since 2022.

All of that, is ridiculous enough. But, as Justice Elana Kagan noted in her dissent on behalf of the Court's three liberals, the majority ruling now offers a clear roadmap for how states may unlawfully gerrymander at will, in a way that will prevent any court from blocking them, as long as they time their legislation just right.

We're joined today by JAY WILLIS, former attorney, now editor-in-chief at the great legal website Balls and Strikes. He explains that the Court's "Purcell Principle", originally invented in 2006 to avoid chaos at the polling place by a court ruling just days before an election, is now being abused to prevent anything that Republican Justices simply don't like.

"The Purcell Principle has gotten stretched to the point of meaninglessness, where anytime the Justices decide that we are too close to an election in a way where changing the rules would hurt Republicans, they just say, 'No, no! Purcell Principle! Can't do that!,'" Willis tells me. "The Court described the Purcell Principle as forbidding changes on the 'eve' before an election. Now, that Principle is almost an entire calendar year in the hands of this court."

"What this rule amounts to," he argues, "is a free pass for Republican officials to conduct elections outside the scope of the law, as long as they basically get the timing right."

"As Kagan points out in her dissent, you don't have to have a law degree to understand that a racially gerrymandered map is illegal and unconstitutional unless the legislature that passes it waits until close to an election," he says, adding, "That can't be how the law works, a law that allows racial gerrymanders to remain in place in an election, as will be the case in Texas in 2026. That's just not a law that functions. That is not a tenable status quo."

Today on The BradCast: Charlie Kirk was a racist, sexist, homophobic, anti-Semitic, Islamophobe. He also did not deserve to be killed for any of it. Prove me wrong, as Kirk liked to say, on either of those points. [Audio link to full show follows this summary.]

I'd have otherwise been happy to move on from the topic at this point, but for the inappropriate lionization of Kirk by, not just the Right, but the mainstream media in the days since his horrific murder in Utah last week, allegedly by a 22-year old man from a religious, Republican family from the state. Kirk no more deserves to be lionized than he deserved to be shot and killed by a longtime firearm aficionado.

It's also difficult to move on given the way the President of the United States and his Administration and his supporters are using Kirk's death --- lying about it --- as a weapon to declare war on their perceived political enemies, on civic democracy and on the Constitution itself.

Donald Trump has now repeatedly blamed "radical left" "scum" for Kirk's murder, despite any evidence yet to support such a claim. Despite being the worst demonizer to ever lead the American government, Trump claims the attack on Kirk is the "tragic consequence of demonizing those with whom you disagree, day after day, year after year, in the most hateful and despicable way possible."

He has now promised to use the federal government to go after those people and organizations that he believes to be organizers and "funders" of the "radical left", which he has repeatedly referred to (again, without evidence) as "fascists", "Marxists", "communists" and "worse". Despite the countless, recent, deadly attacks by Trump supporters against elected Democratic officials --- and despite his own Vice President (Vance) and HHS Secretary (Kennedy), comparing him to Hitler --- Trump insisted on Sunday that "the problem is on the left. It’s not on the right."

Kirk's killing took place, however, on the very same day that a 16-year old boy in Colorado --- who authorities claim to have been "radicalized" by an "extremist network" and obsessed with antisemitism, Nazis and Holocaust denial --- went on a gun rampage through his Evergreen, CO high school (near Columbine) before taking his own life.

Oddly enough, Trump has yet to mention one word about that incident, to my knowledge, even though it sent teenage students to the hospital in critical condition. Nor has he called for those who encouraged and funded and radicalized that shooter to be brought to justice, for some reason.

And, while Kirk is being lauded for championing free speech (he did, hateful as it may have been, at least at his personal appearances), he also organized a nationwide effort to tape and target school teachers and college professors for firing for not using the right kind of speech. With Kirk's death, that effort has now kicked into overdrive, as teachers, random Americans and even members of the media are being fired for merely quoting Kirk's actual, often wildly offensive words on social media.

All of this, I would argue --- the attack on the First Amendment by the Right --- a convenient way for them to avoid their very serious problem with political violence against their perceived enemies on the non-Right and a way to not have to deal with the nation's worsening gun violence epidemic which they, like Kirk before he died, continue to countenance through their words of support and lack of actions.

As Kirk would say, prove me wrong. We opened the phones up in the second part of today's show to allow listeners to do exactly that. How do you think it went?...

Among our coverage...

  • 31-year old, far-right youth activist, influencer and longtime Donald Trump ally Charlie Kirk, founder of Turning Point USA, said back in 2023: "I think it’s worth it to have a cost of, unfortunately, some gun deaths every single year so that we can have the Second Amendment to protect our other God-given rights." Today, Kirk was gunned down while answering a question, ironically enough, about U.S. gun violence during a heavily-attended outdoor speaking event at Utah Valley University. The shooting drew bipartisan condemnation before his death was announced just prior to airtime today. No suspect had yet been taken into custody.
  • Receiving much less attention, three teens were in critical condition in surgery or the emergency room after a shooting at their high school in suburban Denver at around the same time Kirk was shot in UT. The same sheriff's office that initially responded to Colorado's 1999 mass shooting at Columbine High School, which killed 14 students, was reportedly first on the scene today at Evergreen High School west of Denver.
  • Poland reported that as many as 19 Russian drones entered their airspace on Wednesday and were shot down with the help of NATO air command and the Dutch air force which scrambled F-35 fighter jets. A number of the drones were said to have been launched out of Belarus, an authoritarian Russian ally which has has been used to stage attacks on Ukraine since Russia invaded its sovereign neighbor in 2022. Poland, a NATO member, activated Article 4 of the defense pact, to demand consultation with allies. Europe and NATO remain on high alert today, though Russia claims it had attacked the "military-industrial complex of Ukraine" in a "large-scale strike" but that "there were no targets envisioned for destruction on the Polish territory."
  • In somewhat brighter news today, Democratic candidate James Walkinshaw trounced his Republican rival in a U.S. House Special Election in the 11th Congressional District of Virginia on Tuesday by 50 points, 75% to 25%. That's a 16-point swing toward the Dems as compared to last November's Presidential election in the northern Virginia suburbs of D.C. Walkinshaw's seating in Congress and promised signing of the Discharge Petition to force a U.S. House vote on the release of the Epstein Files puts proponents of that measure just one vote away from the necessary 218 signatures needed to trigger a mandatory vote on the House floor. Another U.S. House Special Election to fill another vacant seat in another very Democratic Congressional District in Arizona takes place later this month. The Democratic candidate there, Adelita Grijalva, has also vowed to sign the petition, which has currently has the signatures of all 212 currently seated Democrats and four Republican members.

Finally, we're joined today by author and financial journalist DAVID DAYEN, Executive Editor of The America Prospect, to discuss the coming showdown in Congress to avoid a government shutdown as of October 1. That's when the Continuing Resolution passed in March to keep the government open at the time expires. If Republicans can't come to terms with Democrats on another CR by the end of this month, the government will likely shutdown.

That is a price that more Democrats now seem willing to pay to try and stop --- or, at least slowdown --- Donald Trump's authoritarianism. And it's a moment when Democrats, currently in the minority in both chambers of Congress, actually have some leverage to use.

While all Democrats in the House voted against the Republican CR back in March, Senate Minority Leader Chuck Schumer and a handful of Dems agreed to help Republicans overcome the 60 vote filibuster threshold in in the Senate in exchange for...well, pretty much nothing.

This time, Schumer claims he will not do the same thing. But, is he asking for enough from Republicans in exchange for Democrats' support in keeping the government open this time? Is he willing to let it shut down in order to stop Trump?

There are a lot of things that Democrats could demand, above and beyond a short term fix to prevent health care costs from skyrocketing for the millions of Americans signed up to the Affordable Care Act. That's something, as we discuss, that Republicans should be desperate to do on their own. Democrats could demand that subsidy support for the ACA be made permanent. Schumer could demand that Congress assert its right to block Trump from refusing to spend funds already appropriated by Congress. He could demand the end to Trump's economy crushing tariffs, mass ICE raids, National Guard in U.S. streets and much more. In other words, this is a moment when Dems could demand an end to the Trump Authoritarianism.

But will they? And, if so, and Republicans don't agree to the terms, what then?

"The whole idea that we're going to get a goodie in exchange for participation in the budget is a very old way of doing business in Washington," argues Dayen today. "Business as usual is out the window in Washington. You have someone who is trying to consolidate power entirely into himself. And you have these rare moments where he can be thwarted at some level. And you can't approach that the way you would approach a normal negotiation. I just don't understand how that can be acceptable. You have to deal with the problem at hand, where Donald Trump is acting like a despot, a dictator, and the things that you could negotiate on would have to be things that would prevent dictatorial processes from going forward."

"Shutdown fights like this are teachable moments," he says. "They are ways to get the attention of the public. They are ways to get the public understanding that there is a debate happening in Washington, and this is what that debate is about. If you're the Democratic Party staring down 33% approval ratings, watching what Trump is doing, and seeing your party get less popular in the exchange because you're not doing enough about it, you should want this moment. You should want a way to reset public attention on what is happening. Maybe we'll see some things start to change here in coming days as Democrats start to internalize this, but it's been a bit enervating so far."

Failed scheme echoes Team Trump 2021 breach in GA; Also: WY's new vote suppression; GOP Senate cuts NPR/PBS funding; Dems walk out of Sen. Judiciary vote to make Trump defense lawyer a federal judge...

Yikes. On today's BradCast, Trump's fascistic lawlessness is really taking hold this week in several areas...with a lot of help from his fellow corrupt Republicans. A few GOPers, however, who serve as election officials in Colorado, aren't having it. And we are grateful to them. [Audio link to full show follows this summary.]

Lots of news today, and not much of it encouraging amid America's existential fight against Donald Trump's rising tyranny...

  • Late last night, for the first time since 1999, in a simple majority vote that avoids the filibuster, Senate Republicans approved a Trump-requested package to rescind some $9 billion dollars in federal spending that had been previously approved through the bipartisan appropriations process. About $8 billion was to have been for foreign aid, and more than $1 billion was slashed from the Corporation of Public Broadcasting which helps fund NPR and PBS stations around the country. That is likely to kill a number of public radio and TV stations around the country entirely, particularly in rural areas which heavily rely on CPB support to continuing broadcasting over our public airwaves. After one more vote in the GOP House tonight or tomorrow, the bill heads to the President for his signature.
  • Perhaps in hopes that it will somehow make up for Trump's refusal to release the "Epstein Files" (that he is almost certainly named in, many times), the Dept. of Justice in DC on Wednesday night ordered the firing of a top career federal prosecutor in the Southern District of New York (SDNY). The longtime, very well respected prosecutor is Maurene Comey, prosecutor of the late Jeffrey Epstein's case, as well as his accomplice Ghislaine Maxwell (who is currently serving 20 years for her part in Epstein's child sex trafficking scheme.) Comey --- whose "fear is the tool of the tyrant" statement to colleagues upon leaving is here --- also happens to be the daughter of Trump's imagined enemy, James Comey, the Republican FBI Director fired by Trump during his first term for his refusal to violate the law on Trump's behalf.
  • In the Senate Judiciary Committee on Thursday, Democrats walked out after Republicans prematurely ended debate on the Appeals Court nomination of Emil Bove, one of Trump's criminal defense attorneys who is currently serving as a top DOJ official. Trump has nominated him for a lifetime appointment to the federal bench. Since being tapped for a top job at DOJ, Bove has played a key role in the Department's dismissal of corruption charges against NYC's mayor; headed up weaponized mass revenge firings at the Department; threatened officials who resisted Trump's agenda; and, according to a mountain of on-the-record evidence from a DoJ whistleblower, instructed prosecutors to defy court orders in immigration cases. His nomination is opposed by hundreds of bipartisan prosecutors and judges. So, naturally, Trump wants him to have a lifetime appointment as a federal appeals court judge and Republicans on the Judiciary Committee were happy to approve his nomination today in a 12 to 0 vote after Dems walked out in protest.
  • With unpopular Republicans desperate to hold on to their very narrow majority rule in Congress, so they can continue to abuse it, some are now turning to voter suppression schemes in advance of next year's critical mid-term elections. In Wyoming, where it is already unlawful for non-citizens to vote, its MAGA Sec. of State Chuck Gray is implementing a new requirement for physical proof of citizenship for voting. Voting rights advocates --- some of whom are suing --- argue that the new law is certain to disenfranchise thousands of otherwise eligible voters (particularly women, whose married names may not be reflected on papers such as passports, REAL IDs, birth certifications) in a state which, with the recent help of the federal Immigration and Customs Enforcement (ICE) agency, has been able to uncover exactly ZERO cases of noncitizen voting in the state's most populous county.
  • But the most alarming news this week regarding the Trump White House's assault on voting rights and voters and elections and democracy itself this week, comes out of Colorado. On Thursday the Washington Post reported on what appears to have been a --- so far --- failed scheme to breach sensitive voting systems in 10 counties across the state. The Denver Post subsequently confirmed and added to the report. The clumsy plot appears remarkably similar to the one that resulted in the unlawful copying and theft of proprietary statewide voting and tabulation software by Trump allies in Coffee County, Georgia in early 2021. (We covered that story closely, and helped break some of it, on this show.) In Colorado, however, where Republican County election Clerks say they were contacted last week by someone said to be working for the White House, seeking access to the voting systems by DHS, all of them say they rejected the attempt. No doubt, memories are fresh in the state of former Mesa County Clerk Tina Peters, who is currently serving 9 years in prison related to having breached her own County's voting system hardware and software following the 2020 election. Much more on all of this on today's program.
  • And, finally, as the "Summer of Floods" continues, Desi Doyen joins us for our latest Green News Report on that; a new NASA analysis on the dramatic, climate-fueled increase in extreme weather events; and on the Trump Dept. of Defense decision to cut off access to key satellites used in the forecasting of hurricanes...

We're back for today's BradCast after a week off during which many things happened. Some good. Many more less so. It'll take us about a month to get caught up. So, we better get started. [Audio link to full show follows this summary.]

FIRST... A bit of news from over the weekend and into today...

  • In Colorado on Sunday, in what authorities are describing as a "targeted act of violence", at least 8 people were burned by an attacker in Boulder with a make-shift flamethrower and Molotov cocktail device. The victims were demonstrating in support of the release of hostages held by Hamas in Gaza since the October 2023 attack on Israel. The alleged assailant, quickly taken into custody, was said to have shouted "Free Palestine" and "End Zionists" during the rampage. On Monday, law enforcement officials said he would be charged with federal hate crimes and 16 state charges related to attempted murder.
  • News of Sunday's attack in Boulder came just moments after news reports from Gaza that more than 20 Palestinians had been killed and more than 100 wounded near a food distribution site recently set up by the Israeli government amid desperate conditions in the war torn enclave. The deadly attack, attributed by news reports to the Israeli military, comes amid continuing, if failed, third-party talks between Israel and representatives of Hamas seeking a temporary truce, the return of hostages, and increased distribution of aid among a desperate populace in Gaza.
  • Ukraine on Sunday acknowledged what appears to have been a pretty massive --- and clever --- explosive-laden sneak drone attack deep inside of Russia, reportedly damaging some $7 billion worth of strategic bomber aircraft at several air bases. The Ukrainian-made drones were apparently snuck into the air bases via the roofs of wooden sheds and released by remote control. The Ukrainian offensive comes on the heels of deadly, long-range attacks by Russia, reportedly against both the civilian population and critical infrastructure, deep inside of Ukraine. On-again off-again peace talks continue nonetheless in the more than three-year old war following Russia's full scale assault on its sovereign neighbor in early 2022.
  • Here at home, some encouraging (for the moment) news out of the corrupted rightwing U.S. Supreme Court. On Monday, the Court rejected petitions to hear appeals of two Second Amendment-related rulings upholding state restrictions on semiautomatic assault-style rifles and large-capacity ammo magazines out of Maryland and Rhode Island. The usual far-right suspects --- Thomas, Alito, Gorsuch --- dissented the decision to allow the lower appeals court rulings to stand.

THEN... But speaking of the corrupted, extremist, rightwing activist Supreme Court, two emergency rulings issued on its so-called "shadow docket" last week remind us, yet again, that this Court has little interest in upholding precedent, whether it's decades-old precedent or even their own from just one year ago.

On Friday, in what dissenting Justice Ketanji Brown Jackson referred to as a "plainly botched" ruling by the majority, the Court allowed the Trump Administration to end legal protected status for about half a million migrants in this country from Cuba, Haiti, Nicaragua and Venezuela. The Court does so even as litigation continues in the lower court, challenging the Dept. of Homeland Security's lifting of lawful protected status in the U.S. granted by the Biden Administration. On Thursday, half a million migrants were here perfectly legally. On Friday, they suddenly became subject to Trump's mass deportation goon squad, allowing them to be removed from the country --- even though they may eventually win their case! So much for the irreparable harms that are supposed to be considered amid ongoing litigation in such "emergency" rulings.

That ruling came the day after the Court's rightwingers undercut their very own ruling from just last year that, itself, had overturned decades of Court precedent known as "Chevron deference". In last year's case, the Court majority ruled that judges, not federal agency experts, are better equipped to decide whether various regulations suit the intentions of Congressionally-adopted statutes. The landmark ruling last year overturning Chevron had long been sought by corporations seeking to undermine environmental and other regulations. But on Thursday, after a lower court used its newly gained deference to decide a federal agency's regulations weren't strict enough, the High Court decided the experts at the agency in question should once again be granted deference.

As our guest today, veteran legal journalist CHRIS GEIDNER explained in his Law Dork newsletter late last week, now the Court can pull one lever "when the conservative majority believes an agency has gone too far" but when it believes "a lower court goes too far" it can pull last week's newly invented lever "and explain that the lower court did not provide sufficient deference to the agency." As Geidner tells me today, "It is truly a 'heads I win, tails you lose' situation."

In short, it the activist rightwingers on SCOTUS continue to simply make it up as they go along, overturning any precedent, old or new, in order to achieve their desired political outcome.

Geidner joins us to make sense of all of that; share his thoughts on why last week's Trump nomination of his former defense attorney, Emil Bove, to a U.S. Appeals Court is "a line that cannot be crossed"; and for a summary of the big cases that will be receiving full opinions from SCOTUS this month as their latest term wraps up before July...

A primer on what election fraud actually is (and isn't), and how Team Trump is sowing seeds to steal the election if he loses again this year...

On today's BradCast we're hoping to help you get acclimated to the tsunami of "fraud" claims --- both real and fake, and what they mean and don't --- that are most likely about to come our way over the next few days and weeks...at least if Donald Trump loses to Kamala Harris in 2024 as he did to Joe Biden in 2020. [Audio link to full show follows this summary.]

Pardon us, however, for beginning with a brief victory lap following our L.A. Dodgers' big World Series win last night, and a related sidebar as to what history tells us (or doesn't) about who is going to win the Presidential election based on who won the World Series.

Then, as to the coming "fraud" storm...among the many stories cited along the way today...

  • A Minnesota woman this week was charged with three felony counts of voter fraud after forging her dead mother's signature on an absentee ballot to vote for Donald Trump.
  • Six people were charged over the summer for submitting nearly two dozen fraudulent absentee ballots on behalf of a Republican City Council candidate in New York. How they got away with it and how they got caught. The candidate's 19-year old daughter was among those charged.
  • In the battleground state of Michigan, election officials in August indicted four voters who allegedly voted twice --- first by absentee and then again at the polls --- in the state's Presidential primary earlier this year. Once again, as in all of these cases, they were caught and charged thanks to safe-guards built into the system. Of the more than 11.7 million votes cast in the state over the past several elections, according to Michigan's State Auditor General, 99.99% of ballots cast were NOT from double voters.
  • In Mesa County, Colorado this week, officials announced they blocked an effort in the very Republican-leaning county to cast about a dozen absentee ballots, apparently stolen out of mailboxes in the Vote-by-Mail state. The state's signature-matching procedures uncovered the fraud scheme, though three fraudulent ballots slipped through the system before the crime was discovered. Mesa is the same county where former County Clerk, Tina Peters, was earlier this month sentenced to 9 years in prison on felony charges related to helping her MAGA friends break into the County's voting systems in the middle of the night after the 2020 election to copy proprietary software and distribute it across the Internet to other Trump supporters.
  • Last month we reported on the story out of Arizona where both the RNC and the state Republican Party went to court to argue against the removal of some 98,000 voters from the state voting rolls who, due to a years-old glitch in Maricopa County's voter database, had no record of presenting Proof of Citizenship with their registrations, as required by state law. In that case, Republicans opposed the systematic voter purge that the state's Democratic Sec. of State didn't want to do, but felt he had to under state law. The Republicans correctly argued to the AZ Supreme Court that such purges, within 90-days of an election, were in violation of federal law. They made that argument after the SoS revealed that the majority of the potentially "non-citizen" voters to be removed were registered Republicans.

    Yet, this week, on Wednesday in Virginia, after a U.S. District Court Judge and federal Appeals Court last week blocked an attempt by the state's Republican Governor to purge some 1,600 registered voters under the premise that some might be non-citizens, the corrupted Republican U.S. Supreme Court majority allowed the unlawful systematic purge, ordered by Gov. Glenn Youngkin, to move forward. All three Democratic-appointed SCOTUS Justices dissented. One of the purged Virginians, a U.S. citizen who has lived there her entire life, called it "a very bad October surprise."

All of these stories today help us understand the difference between real and fake fraud claims; the difference between voter fraud and election fraud; how easily most such penny-ante fraud is caught and often prevented before it happens; and how Republicans this year, from Donald Trump on down through his minions and back up through his corrupted SCOTUS, are hoping to use phony or exaggerated fraud claims to help sow the seeds to steal the election, if necessary, as of Tuesday night.

Get ready! Because that is coming --- if Harris is declared the winner.

Finally, Desi Doyen joins us for our latest Green News Report, with horrific "welcome to the future" news out of Spain this week, where extreme drought was followed up with a year's worth of rain and deadly flash flooding this week that swept through one town in a matter of hours, killing more than 150 so far; and some words of warning about Tuesday's election from Sen. Bernie Sanders regarding our climate changed future in the event that Trump is allowed back into the White House in January...

As we go to air on today's BradCast, we're girding for the monster Hurricane Milton's direct impact on Florida's central Gulf Coast over the next several hours, even as millions in that state and five others struggle to recover from devastation following Hurricane Helene less than two weeks ago --- and as all of us prepare for November 5th and whatever may come thereafter. [Audio link to full show follows this summary.]

This week, amid Helene recovery in North Carolina, the state Board of Elections, in a unanimous, bipartisan vote, approved a list of emergency measures for voters in the state's hardest hit counties. Naturally, Trump Republicans on social media are already lying and spreading disinformation about those measures and, of course, Fox "News" is playing along. That said, with the Trump Campaign itself calling for measures to expand access for voters in Republican areas of the state following Helene, it seems like Team Trump is also preparing to have legal (and political) complaints ready to go after the election --- if they lose.

That strategy, however, is not new for them. Even before Helene, the RNC says they are involved in scores of lawsuits across dozens of states. Many of them have been filed by groups like the American First Legal Foundation, founded by far-right Trump adviser Stephen Miller. One such novel suit filed by the group seeks a ruling in Arizona that judges may toss out election results over "failures or irregularities" by local officials. America First Legal is currently seeking such a ruling, however, only in counties where Kamala Harris is believed to be narrowly ahead of Trump.

Similar efforts are also underway by Republicans in other battleground states such as Michigan, Nevada and Pennsylvania, even if they don't think they will actually win the suits. The strategy, according to election law experts, appears to be to have these complaints in place before the election so they can be cited afterward, and used by election officials at the state and federal level to try and overturn results --- only in the event that Trump loses, of course.

At the same time, the Government Accountability Project, a longtime whistleblower support organization, founded in 1977 in the wake of Daniel Ellsberg's release of the Pentagon Papers, has published a new guide meant to support election officials and poll workers who may have legitimate reason to blow the whistle this year, particularly in battle grounds states. The 37-page booklet [PDF], entitled "On the Front Lines of Democracy: A Guide to Speaking Up for Election Officials & Workers," offers specific legal advice for those may have seen something and want to say something about it, but don't know exactly how to do so while protecting themselves in the bargain.

We're joined today by DANA GOLD, GAP's Senior Director of Advocacy & Strategy and the Director of the group's Democracy Protection Initiative, which was formed in advance of the 2020 election, "in anticipation of a highly partisan environment" when they were "very concerned about foreign and insider threat of illegal election interference," she explains today.

"We didn't have a lot of whistleblowers, though," says Gold. "We had a fire extinguisher ready. But, as we know, the 2020 election ended up being actually quite secure, fair and free, and administered safely." That said, as we discuss today, "the threat landscape has changed in 2024."

Gold outlines a number of "primary threats to elections" as identified by research in "this very hyper-partisan environment." She says foreign interference remains a concern, but also "the risk of disinformation being spread widely, which can have the result of suppression, delay, eroding confidence in the election results. And potential insider threats. People who are essentially election deniers who believe that the 2020 election was stolen despite every piece of evidence showing that the election was free and fair."

"This is a really volatile environment and election officials and workers are on the front lines, and may be in the best position to see efforts to suppress the vote. They may see insider threats. There are opportunities for election officials and workers who may see problems, and feel very scared and not clear about how to raise that concern, especially if the threat is their supervisor, someone in a position of power."

Given my own long history of reporting on election whistleblowers over the past two decades --- usually related to voting systems and their vendors --- the question of how to determine who are legitimate whistleblowers in this atmosphere, and who are not (but may even think they are) is a rich topic of discussion. Also, given that heroic whistleblowers like Reality Winner --- a national security official who exposed the fact that Russian intelligence operatives had actually infiltrated voter registration systems in several states before the 2016 election --- ultimately received a five-year prison sentence for having done so, Gold grapples with how to best encourage whistleblowers to come forward, while still protecting their legal and civil rights.

"That's why this is really important for us, in terms of a strategy of trying to disseminate this guide, to make election officials and workers, and any employee, aware of their rights, and their risks and options."

"Document everything," she advises those who may believe they have witnessed an election-related violation of law. "Write it down contemporaneously. Make sure that's secure. Check for allies in their co-workers. Note witnesses. Date things. There are ways to shore up the verification piece, which will be critical to both insulate them and make a difference." She adds, of course (citing Mesa County, Colorado's former MAGA County Clerk, Tina Peters, who just received a nine year prison sentence for tampering with voting systems, even as she uncovered nothing!), "they should not break the law to do so."

"Whistleblowers are such an important piece of democracy itself," Gold asserts. "The information provided by a whistleblower fuels those mechanisms of accountability that are our representative democracy. Very important tools in our collective efforts to ensure free and fair elections." To that end, she tells me, the group provides "legal and strategic support and advocacy, so we can protect them, in this environment particularly."

Tick-tock. Time is running out for all of the Trump scams, as detailed on today's BradCast. Unless, of course, he wins on November 5th --- or has more success stealing the Presidential election this year than he did in 2020. [Audio link to full show follows this summary.]

Among the Trump scams, rackets and accountability for having fallen for them on today's program...

  • You know about many of Donald Trump's legendarily failed rackets from the old days: Trump University, Trump Steaks, Trump Water, Trump Vodka, Trump Casinos, just to name a few. More recently, during the time he's been running for President again, there's been Trump Sneakers, Trump Bibles, Trump Digital Trading Cards, Trump Coins, Trump Cryptocurrency and, introduced just last Friday, "Swiss-made" Trump Watches. He's selling them for $100,000 a pop! Even though, according to experts, they appear to be Chinese-made crap, if they even exist, and appear just as likely to be an open invitation to foreign influence peddling and money laundering. We explain.
  • All of the above enumerated rackets, by the way, are private rackets. Any profits from them do not go to his Presidential Campaign, but straight into Donald Trump's pocket. And so --- according to the new 165-page filing [PDF] by Special Counsel Jack Smith, unsealed by U.S. District Court Judge Tanya Chutkan on Wednesday afternoon --- was Trump's attempt to steal the 2020 election. New evidence in the filing from prosecutors in his 4-count federal indictment in D.C., further details how the disgraced former President and convicted felon was fully aware that he'd lost the election in 2020, but didn't care. He was going to fight to steal it anyway. He also knew he had put Vice President Mike Pence's life in grave danger on January 6th, 2021. His response: "So, what?" And all of that, as prosecutors argue in their brief, was done in Trump's capacity as a private candidate for office. It was not done as part of his official duties as President. Smith's motion is meant to make that case in hopes of preventing the corrupted U.S. Supreme Court from dismissing the case on the basis of their absurd, anti-American, anti-Constitutional, made-up-from-whole-cloth ruling in Trump v. U.S. declaring criminal immunity to sitting Presidents for crimes committed as part of their "official" duties.
  • In Colorado today, a state judge unleashed a brutal, if accurate, take-down of disgraced former Mesa County Clerk, Tina Peters during her sentencing hearing. Once a MAGA superstar, she is now a convicted felon on charges related to a criminal scheme to breach voting system software in her own County, based on false claims that fraud software was implanted in them to flip votes from Trump to Biden in 2020. The judge told Peters today: "I am convinced you would do it all over again if you could. You’re as defiant as any defendant this court has ever seen. You are no hero. You abused your position and you’re a charlatan." He called out her continuing claims of evidence-free fraud as "just more lies. No objective person believes them. No, at the end of the day, you cared about the jets, the podcasts and people fawning over you." He then sentenced her to nine years in prison before she was handcuffed and hauled out of the courtroom to immediately begin serving her time. See ya, Tina! May she be the first of many.

State-by-state analysis serves as warning to rogue election officials...

Non-profit government watchdog, Citizens for Ethics in Washington (CREW) has detailed what they describe as an illegal plot among Trump-supporting county election officials to sabotage the certification of the 2024 election results.

The scheme has been reported elsewhere in recent days, including in an excellent deep dive by Justine Glawe at Rolling Stone, reporting on "nearly 70 pro-Trump election conspiracists currently working as county election officials [in battleground states] who have questioned the validity of elections or delayed or refused to certify results."

In a lengthy and detailed State-by-State Analysis [PDF] released this week, CREW is offering a roadmap of legal remedies in each of eight battleground states that, if followed, they believe can defeat the looming threat posed by such a scheme and ensure timely certification of results in this November's Presidential election...

CO election clerk found 'guilty' for voting software breach; NY judge rules RFK Jr. used 'sham' residence to qualify for ballot; Musk and Trump charged with labor complaint after disastrous Twitter chat...

It was another not good day on The BradCast for entitled rightwingers working hard to undermine our American democracy. [Audio link to full show follows this summary.]

Among our coverage today...

  • Disgraced 2020 election denier, former Mesa, Colorado County Clerk and failed Republican Sec. of State candidate Tina Peters was found guilty by a jury of her peers on Monday for seven crimes related to her 2021 breach, copy and unlawful distribution of Mesa County's proprietary Dominion voting system software that she was elected to protect.

    BACKSTORY: Peters' breach in CO, which set off alarm bells at the time among voting system experts across the country, was one of several similar schemes apparently organized, in part, by former Trump attorney Sidney Powell in a futile effort to prove the 2020 election was stolen from him. Similar breaches were carried out in Georgia, Michigan and Pennsylvania, where some of the breachers are also facing state criminal charges. Deadbeat fellow election denier and reportedly nearly bankrupt MyPillow CEO Mike Lindell, who is being sued for defamation by several voting machine companies, aided and abetted Peters' crimes in various ways after the Mesa County voting software was released while she was on stage at Lindell's silly "cyber-symposium" in South Dakota.

  • Former-Democrat-turned-independent Presidential candidate Robert F. Kennedy, Jr. was found by a New York judge on Monday to have used a "sham" address to establish residency in the state where he doesn't actually live. As a result, after a four-day hearing, he will not be allowed to appear on NY's Presidential ballot. Moreover, the ruling may threaten his eligibility for some of the 19 state ballots where he has already qualified to appear and/or the 20 or so states where he is still hoping to do so.

    BACKSTORY: Back in 2011, we reported on then Utah U.S. Senate candidate Mitt Romney having done damn near the same thing. He had owned mansions in both New Hampshire and California, but, in 2010, he fraudulently registered to vote for a U.S. Senate Special Election in Massachusetts, where he had previously served as Governor, using his son's unfinished basement as his voting address. Nonetheless, despite their pretend opposition to election fraud, the Republican Party would later go on to nominate the fraudster Romney as their Presidential nominee in 2012.

  • Longtime opponents of workers and organized labor unions, Donald Trump and Tesla/Twitter owner Elon Musk, held what the New York Times described as a "two-hour ramble" on Monday night, on Musk's rickety, now largely rightwing social media site. It didn't seem to go well for either of them. It began about 45 minutes late after Musk's streaming audio platform kept failing. (He blamed a cyberattack. Trump blamed China. Evidence and folks who work at Twitter/X suggested there was no cyberattack at all.) But, at some point in the conversation, Trump and Musk began cackling approvingly about the idea of firing workers who threaten to strike or join unions. On Tuesday, the United Auto Workers, who have been encouraging Tesla workers to unionize, filed legal complaints against each man charging violations of the National Labor Relations Act.

    BACKSTORY: The UAW, and almost every other major labor union, has endorsed Kamala Harris in the 2024 election. UAW President Shawn Fain appeared at a rally with Harris and her running-mate Tim Walz in Detroit last week (the one with 15,000 attendees who Trump claims were not there, but were all A.I.) and described Trump as "a scab" who "doesn't know shit about the auto industry and doesn't give a damn about the working class in this country."
