Data-Mining Gone Wild...

The Washington Post reports that the United States and the European Union signed an agreement this week detailing the amount of private information the U.S. can obtain on EU citizens traveling to and from the United States, what kinds of information can be gathered, and for how long the data may be stored.

Privacy advocates in the U.S. and the E.U. immediately questioned the agreement's sweeping expansion of data mining of travelers’ private information, including such data fields as medical history, religious affiliation, trade union membership, sexual orientation, and sexual partners.

According to WaPo:

Peter Hustinx, the E.U.'s privacy supervisor, expressed "grave concern" over the plan, which he said is "without legal precedent." He wrote to E.U. officials on June 27, "I have serious doubts whether the outcome of these negotiations will be fully compatible with European fundamental rights."

U.S. Homeland Security Secretary Michael Chertoff praised the pact as an "essential screening tool for detecting potentially dangerous transatlantic travelers." If available at the time of the Sept. 11, 2001, attacks, Chertoff said, such information would have, "within a matter of moments, helped to identify many of the 19 hijackers by linking their methods of payment, phone numbers and seat assignments."

Paul Rosenzweig, Homeland Security’s deputy assistant secretary for policy, explained that the broad categories of information gathered are due to U.S. authorities' fears of risks they haven't yet imagined. Rosenzweig justified the unusual data fields if, for example, U.S. officials learned of an alert about passengers who request wheelchairs hiding bombs in leg casts.

Iraq’s national government is refusing to take possession of thousands of American-financed reconstruction projects, forcing the United States either to hand them over to local Iraqis, who often lack the proper training and resources to keep the projects running, or commit new money to an effort that has already consumed billions of taxpayer dollars.

And as if that's not bad enough, there's this:

The United States often promotes the number of rebuilding projects, like power plants and hospitals, that have been completed in Iraq, citing them as signs of progress in a nation otherwise fraught with violence and political stalemate. But closer examination by the inspector general’s office, headed by Stuart W. Bowen Jr., has found that a number of individual projects are crumbling, abandoned or otherwise inoperative only months after the United States declared that they had been successfully completed.

Going on air in 4 minutes...But still on line on media conference call w/ CA SoS Debra Bowen concerning her landmark independent "Top-to-Bottom Review" of all voting systems in the state.

I'll have more on the air tonight (see link above), but she has just said "The independent teams of analysts were able to bypass both physical and software security measures in every system tested."

The reports are not yet posted, but should be any moment right here.

As mentioned, more throughout tonight's Peter B. Collins Show which I'm currently Guest Hosting...

UPDATE BY JOHN GIDEON: None of the voting systems tested were found to meet federal mandates for disabled voter accessibility. This may present a problem for the state as they will not be able to allow those systems to be used for accessibility unless the vendors can find solutions for their shortcomings.

Believes A Degree Of Respectfulness Needed To Choose A President
Also Says He Did Not Watch Democratic YouTube Debate

This two-minute video of Mitt Romney on C-SPAN today represents much that is wrong with his candidacy. He gives lame answers to easy questions like claiming to be unable to participate in a Republican YouTube debate as "September is a tough month" because "it is the end of a quarter." Thus, he must fundraise rather than answer questions from possibly the most egalitarian media outlet on the planet that comprises mainly the nation's youth trying to do their civic duty by participating in the political process. His message is clearly that it is all about the money and not the people.

Romney then seems to imply that he wouldn't participate in a YouTube debate anyway, because the format was not (cough) respectful enough. Laughable on its face coming from a member of the party of the Swiftboat, Southern Strategy, and Voter Caging, Romney adds to the foolishness by admitting that he never even watched the recent Democratic CNN/YouTube debate but for a couple of excerpts. Finally, after first being too busy and then claiming that the format was not proper, he kinda sorta backtracks and says he would not rule out doing a more respectful YouTube debate in the future.

UPDATE:

And a bit later in the day, now speaking in a townhall meeting in Iowa, Romney slammed YouTube again. This time he asked his audience if they watched the debate before saying, "No, I didn't think so. You were peeling carrots or, you know, something else critical at that time...and, ah, just like me, I was doing something else. But you saw the excerpts, and perhaps on YouTube, you saw one of the presidential candidates on the left talk about what he'd do in his first year in office."

ADDENDUM FROM BRAD: Can there be any better indictment of the Mainstream Corporate Media than Romney and the others chickening out from appearing at the YouTube debate? These GOP Presidential Candidates (both Guilliani and Tancredo have also stated they are not likely to take part) would rather answer questions from Wolf Blitzer or Brit Hume et al. They know what those questions will be, and how to answer them. God forbid actual human beings should ask them something they aren't prepared for. "Give me Brian Williams!," says Romney. How pathetic.

Today I had to write two ledes for DVN. The California “Top-To-Bottom” Review reports were supposed to be released at Noon Pac. It got to be 3PM Pac. and everyone was still waiting for the reports to be released. Note: The California reports came out too late for any comments here.

So without those reports to discuss let me talk about four reports from New York that have national implications. There are presently two reports hosted at VotersUnite that discuss how the voting machine vendors who are trying to do business in New York state are not fit to do business according to state law. The other two reports discuss the cost of actually holding elections on optical-scan machines and with paper ballots. It does not have to be expensive and is certainly cheaper in the long-run when compared to using Direct Recording Electronic voting machines. ...

Tomorrow is a big day for the state of California and the rest of the nation. The Secretary of State will be releasing the reports from their “Top-To-Bottom Review” of voting systems used in the state. These reports will give the results of the code review, “red team” hack test, document review, and accessibility review. On Monday morning the Secretary of State will give the “Teams” an opportunity to officially present their reports and the vendors a chance to comment. The public will then be given an opportunity to speak their piece. One week later the Secretary will announce her decisions with respect to any actions to be taken. Her options appear to be to decertify the systems, decertify the systems and recertify them with new requirements for use, or do nothing....

Vote Caging Schemes, Plans to Challenge Voters Part of High-Level Bush/Cheney 'Voter Fraud Strategy'...

Bad news for the RNC. New emails reveal their "Voter Fraud Strategy Conference Call" just prior to the 2004 Presidential elections, with plans to use Vote Caging lists to challenge voters in swings states from OH to PA to FL to NM. The effort seems to have been spearheaded by Tim Griffin.

Truthout gets the scoop and the collections of emails, as based on a report from PBS's NOW to air tomorrow night. Here's the skinny...

Previously undisclosed documents detail how Republican operatives, with the knowledge of several White House officials, engaged in an illegal, racially-motivated effort to suppress tens of thousands of votes during the 2004 presidential campaign in a state where George W. Bush was trailing his Democratic challenger, Senator John Kerry.

The documents also contain details describing how Bush-Cheney 2004 campaign officials, and at least one individual who worked for White House political adviser Karl Rove, planned to stop minorities residing in Cuyahoga County from voting on election day.

The efforts to purge voters from registration rolls was spearheaded by Tim Griffin, a former Republican National Committee opposition researcher. Griffin recently resigned from his post as interim US attorney for Little Rock Arkansas. His predecessor, Bud Cummins, was forced out to make way for Griffin.

Another set of documents, 43 pages of emails, provided to Truthout by the PBS news program "NOW," contains blueprints for a massive effort undertaken by RNC operatives in 2004, to challenge the eligibility of voters expected to support Democratic presidential candidate John Kerry in states such as Nevada, New Mexico, Florida and Pennsylvania.

One email, dated September 30, 2004, and sent to a dozen or so staffers on the Bush-Cheney campaign and the RNC, under the subject line "voter fraud strategy conference call," describes how campaign staffers planned to challenge the veracity of votes in a handful of battleground states in the event of a Democratic victory.

Furthermore, the emails show the Bush-Cheney campaign and RNC staffers compiled voter-challenge lists that targeted probable Democratic voters in at least five states: New Mexico, Ohio, Florida, Nevada and Pennsylvania. Voting rights lawyers have made allegations of so called "vote caging," against Republicans previously. These emails provide more evidence. One Republican operative involved in the planning wrote "we can do this in NV, FL, PA and NM because we have a list to run against the Absentee Ballot requests, and should."

Truthout has a bevy of emails that I haven't been able to review, but we'll have the producer of tomorrow's NOW story on the Peter B. Collins Show tomorrow (which I'm still Guest Hosting through the end of the week) to discuss this story.

And yes, Bush/Cheney '04 Inc's national general counsel, who would later go on to create the phony "grassroots" GOP front-group, American Center for Voting Rights (ACVR), was right there in the thick of it all...

The Hill reports that Senate Judiciary Chairman Patrick Leahy (D-VT) has issued a subpoena to White House adviser Karl Rove, the next step in the escalation of the standoff between the White House and Democrats over their attempts to assert congressional oversight and investigation over the executive branch. Scott Jennings, a White House aide, was also subpoenaed.

The latest subpoenas come on the heels of the contentious Senate Judiciary Committee hearing on Tuesday, in which Attorney General Alberto Gonzales was openly derided by both Democrats and Republicans on the committee for his perceived misleading testimony; several members of the committee alleged the testimony borders on perjury and today asked the U.S. Solicitor General to appoint a Special Prosecutor.

Comparing current Bush White House tactics to the embattled Nixon Administration, Leahy said:

The evidence shows that senior White House political operatives were focused on the political impact of federal prosecutions and whether federal prosecutors were doing enough to bring partisan voter fraud and corruption cases,” Leahy said. “It is obvious that the reasons given for the firings of these prosecutors were contrived as part of a cover-up and that the stonewalling by the White House is part and parcel of that same effort...

Not since the darkest days of the Nixon administration have we seen efforts to corrupt federal law enforcement for partisan political gain and such efforts to avoid accountability...

I am left to ask what the White House is so intent on hiding that it cannot even identify the documents, the dates, the authors and recipients that they claim are privileged.

Rove and Jennings have one week to appear before the committee to testify under oath.

Independent Reports to Be Released Friday, Public Comment Hearing in Sacramento on Monday, SoS Bowen's Final Certification Decisions on Aug. 3...

Following up on yesterday's report on the latest machinations surrounding the release of CA Secretary of State Debra Bowen's unprecedented "Top-to-Bottom Review" --- including independent hack testing and source code analysis --- of electronic voting systems. The BRAD BLOG has received a few more details on official release dates and timing, including a public hearing in Sacramento next Monday, from the SOS's office [emphasis ours]:

-- The independent reports will be finalized and posted to our website this Friday, July 27. These will include all the teams' findings in the four areas of the voting systems review, without opinions about what the state and counties should do.

-- A public hearing will be held in Sacramento beginning at 10:00 a.m. Monday, July 30. It will begin with the two principal investigators presenting an overview of their findings, followed by vendor responses and then a general public comment period.

-- Secretary Bowen's decisions on system certifications will come August 3, after her thorough review of the findings and public input.

We're in Texas, but hoping those within driving, walking, running distance from Sacramento will show up to the Capitol to give their thoughts on the findings on Monday, as we expect the voting machine vendors to be there in droves, and they may need a reminder that they do not own these elections. The citizens do.

We're also still waiting to hear back from Steve Weir, the Registrar-Clerk of Contra Costa County and President of the California Assoc. of Clerks and Election Officers (CACEO), for details on his published comments indicating that CA registrars may choose to ignore Bowen's findings. The CACEO has blasted Bowen's review of voting systems previously.

Not sure what Weir's legal theory is for such an action, which seems to fly in the face of both the law and the will of the people --- Bowen was elected precisely on her promises to take the actions she's currently taking after both her predecessor in CA and federal agencies had failed completely to properly test these voting systems before certifying them --- but we'll let you know what we learn. We've invited Weir to appear on the Peter B. Collins Show, which we continue to Guest Host through the end of this week. We'd love to hear from him, of course. Stay tuned...

UPDATE 7/27/07 2:40pm PT: Still waiting for the release of the reports, which I'm told by the SOS will be "any moment". When it's released, it should be right here.

It appears that the Senate will go the way of the House and move any requirement for a voter verified paper audit trail to at least 2010. Reports on testimony given to the Senate Rules Committee today are that there was a lot of “kissing a**” and hand wringing.

Election officials in Montgomery Co., Ohio, had a grand idea. They decided to solve their problem recruiting poll workers by allowing companies and groups to wear their logos on shirts while they work the polls. For example, “Mom and Pop’s” burgers could man a poll site and the poll workers could all wear their uniforms while they helped voters. This was a bad idea made worse when people began to complain that one of the groups who would be manning the polls would be wearing their “Dayton Right To Life” T-shirts and, according to the head of the group, “We will be there to answer life questions.” This came up originally in a story from Utah. This is a bad idea that needs to stop. We can do something about it by getting involved and volunteering to work on elections on election day.
