D.C. Guard Commander's Senate testimony underscores need for probe...

For more than two months, the FBI has been rounding up and charging hundreds of Trump-incited insurrectionists who, in hopes of preventing the Congressional certification of Joe Biden's Electoral College victory last November, stormed the U.S. Capitol on January 6th.

But a number of key questions remain wholly unanswered following the unprecedented attack on our very system of representative democracy. Central to several of those questions is Donald Trump's own, personal, behind-the-scenes machinations to help instigate the uprising and, perhaps, prevent the deployment of the military to help quell the rebellion he encouraged.

The March 3rd Senate committee testimony of Major General William Walker, Commander of the D.C. National Guard, describing a seemingly inexplicable delay in authorization for his troops to provide relief to the U.S. Capitol under siege, underscores the need to determine whether there is a connection between Trump's post-election November 2020 purge of the top civilian leadership at the Department of Defense (DoD) and the January 6th assault.

The purge at the Pentagon began two days after media outlets called the Presidential Election for Joe Biden, when Trump fired Secretary of Defense Mark Esper. Within days, four senior DoD officials either resigned or were fired and replaced by what CNN characterized as "conspiracy theorists and Trump loyalists." Christopher Miller became the Acting Secretary of Defense. Kash Patel, who had previously worked for the disgraced Rep. Devin Nunes (R-CA) on the House Intelligence Committee, was appointed to serve as Miller's Chief-of-Staff.

While one Pentagon official described the November purge as "scary", "unsettling" and the moves one would expect from a "dictator", CNN noted in its contemporaneous account that "no one at the Pentagon has an understanding as to what the grand plan is."

Walker's testimony before the Senate Rules and Homeland Security Committees earlier this month, together with other publicly known evidence, points to a distinct likelihood that, once it became clear he couldn't rely upon the U.S. military to carry out a coup, Trump's "grand plan" entailed a stand-down of the D.C. National Guard while his "personal army", an incited mob of white supremacists, stormed the Capitol on January 6...

On today's BradCast: On the same day that news broke that Fulton County (Atlanta), Georgia's newly elected prosecutor has opened a criminal investigation into Donald Trump's apparent attempt to steal the 2020 Presidential election in her state, the U.S. House Impeachment Managers began their not-unrelated and rather damning opening argument against the disgraced former President in his historic second U.S. Senate Impeachment Trial. And though it was not necessarily surprising, it was still stunning to see that Fox "News" didn't even bother to carry some of the most disturbing and chilling testimony and video presented on Wednesday. Our special, seat-of-our-pants coverage continues today, as Democrats from the House laid out what certainly came across as a compelling, seemingly air-tight, point-by-point case against Trump. They detailed, through his own repeated tweets and media statements, all the way back to last Summer, how he cultivated and prepared his supporters for his false claim that, if he lost the election, it could only be due to massive election fraud.

While the Article of Impeachment itself, for "Incitement of Insurrection" at the U.S. Capitol on January 6th, focuses largely on that day's deadly attack by his MAGA Mob, Trump had laid the groundwork for the assault for months. The House Managers offered a meticulous presentation of tweets and media statements from the then-President, detailing how he used his various platforms to gin up false outrage about a "stolen election", both before and after the election itself. That, despite a lack of evidence to support his claims and his carefully orchestrated attack on the last day possible to prevent the final certification of Joe Biden's decisive Electoral College victory.

Lead Impeachment Manager Jamie Raskin (MD), describing Trump as "the Inciter-in-Chief," charged that his scheme was "the greatest betrayal of the Presidential Oath in the history of the United States." The entire team of Managers spelled out exactly how Trump "praised, supported and cultivated" the eventual violence that resulted in five deaths that day, including a Capitol Police officer, two officer suicides in the days that followed, and well over 100 serious injuries to police attempting to protect the Capitol and the hundreds of lawmakers inside.

"For months," Rep. Eric Swalwell (CA) explained during his presentation, "Trump assembled the logs and the kindling" to convince his supporters that the election would be rigged, "so if he lost, his supporters would be ready to light the match."  And they were --- especially after Trump "doused the flames with kerosene" once he lost the election and eventually ran out of non-violent option to overturn it.

Unfolding, appropriately enough, like a violent crime prosecution, the Managers detailed how Trump ignored more than 60 court challenges he lost (several of which were at the hands of federal judges he himself had appointed); pressured and threatened election officials in several states to change results in his favor; attacked Senators and members of the House for failing to take action on his behalf; pressured the Dept. of Justice to bring fraudulent fraud cases; and even used his platforms to repeatedly attack his own Vice President Mike Pence for refusing to try and steal the election for him.

By the time his supporters were primed to storm the Capitol on January 6, as previously unseen video and federal charging documents reveal, many in Trump's mob were focused on the assassinations of Pence and House Speaker Nancy Pelosi, among others. Chilling surveillance footage of fleeing lawmakers and courageous, quick-thinking law enforcement officials also reveals how close the insurrectionist mob actually came to being able to do so. It's miraculous that there weren't even more deaths.

Underscoring the entire case, however, is the fact that none of it --- none of the violence, none of the death --- would have occurred, had not Trump incited it and then failed to stop it. All of it. On purpose. Unapologetically, even now.

We're joined today for insight on today's historic proceedings and how Trump's defense team can possibly respond to it, by LISA GRAVES of True North Research. With her experience as a former Deputy Asst. Attorney General at the U.S. Justice Dept., a former Chief Counsel in the U.S. Senate, and a former Deputy Chief for the U.S. Court system, she brings a broad and helpful perspective to all of this.

Among the points discussed today, in addition to her general opinion of the case to date by the House Managers: How this Impeachment Trial differs both from Trump's first one and Bill Clinton's; Whether she would like to see witnesses called during this trial and, if so, who?; How much of this matter should be seen as "Kabuki Theater" given the general belief (true or not) that there are unlikely to be 17 Republican Senators willing to vote for conviction, as needed; Whether this Impeachment Trial helps or hurts the odds of criminal charges being brought against Trump in the future for this matter; And what she might expect from Trump's defense attorneys in response.

"I think it's vital that, under our Constitution, these proceedings take place even if there are members of that body who do not have the courage -- the moral courage --- or the devotion to our Constitution to do the right thing, based on the evidence that's been presented so far, to convict Donald Trump," Graves tells me. "I think there should be accountability for members based on how they vote in this trial. And people should be held to account for whether they are willing to speak up against this unprecedented assault on our democracy, on our legislative branch of government, on the rule of law, and on the very notion of how you determine elections are valid, which is the certification process that every single state engaged in."

"So, I think it's an important thing historically," she argues. "It's important for our Constitution. It's important for the people, regardless of the outcome."

Callers ring in on demands for accountability following last week's deadly, Trump-incited riot at the U.S. Capitol. But timing looms large before Inauguration Day, and as the MAGA Mob gears up for more violence...

We open up the phone lines on today's BradCast for the first time since Donald Trump's deadly attempted coup at the U.S. Capitol last week, to get feedback from callers on whether it makes sense to impeach him again with just about a week and a half left in his term. (For the record, my own opinion is "YES!," and I explain why throughout the course of today's show.) [Audio link to full show is below the summary.]

We start with some of the latest breaking news...

  • Trump's illegally appointed Acting Homeland Security Chief Chad Wolf announced, just before air time, that he is stepping down after being critical of Trump following last week's insurrection that killed at least five people, including a Capitol Police officer. Wolf called the riot "tragic and sickening".
  • The FBI has reportedly notified all 50 states of the possibility of armed attacks on state houses, as Trump's MAGA Mob are continuing to tell each other that Trump will be inaugurated on January 20th (he won't be) and that we should all prepare for a national emergency in which Trump invokes the Insurrection Act and begins "high profile arrests" between now and Inauguration Day. All of that, his minions have convinced themselves, come amid what they describe to each other as "a battle for our republic against elites that are attempting the very coup that they are accusing Trump of doing."
  • Over the weekend, however, House Speaker Nancy Pelosi informed House Dems that if Trump refused to resign, she would hold a vote on a resolution calling for Vice President Mike Pence to invoke the 25th Amendment to remove Trump from power. If that doesn't work (it doesn't appear that it will), a vote on a second Impeachment could be held in the House as early as Wednesday. We share the Article [PDF], formally filed in the House today by Reps. Jamie Raskin (D-MD), Ted Lieu (D-CA), David Cicilline's (D-RI), and Jerry Nadler (D-NY) for "Incitement of Insurrection", on today's program.
  • Over the weekend, both Democrats (like AOC) and Republicans like Sen. Pat Toomey (PA), Lisa Murkowski (AK), Ben Sasse (NE) and Trump ally and former Governor of New Jersey Chris Christie all suggested they might support impeachment and removal of the President. As Christie noted, "If inciting to insurrection" isn't an impeachable offense then "I don't really know what is."
  • Nonetheless, a number of Republicans are suggesting that if either the 25th or impeachment are invoked, it would lead to further violence. As Rep. Kevin Brady (R-TX) pathetically tweeted on Saturday, "Those calling for impeachment or invoking the 25th Amendment in response to President Trump's rhetoric this week are themselves engaging in intemperate and inflammatory language and calling for action that is equally irresponsible and could well incite further violence." --- In other words, if you hold anybody accountable for inciting violence, you are inciting the same people to more violence. So, best to do absolutely nothing, apparently. Very patriotic and courageous, Congressman.
  • On Sunday night, the PGA pulled their planned 2022 Championship from Trump's Bedminster, NJ golf resort, adding to the schadenfreude already most likely being enjoyed by anti-Trumpers since Twitter permanently banned him from the social media platform late on Friday.

As to the timing of how to pull off an impeachment with just days left in Trump's Presidency, it's important to understand --- as we discussed with former federal prosecutor Ben Clements on last Friday's show --- that an official doesn't even have to still be in office to be impeached. There is historical precedent for that. Clements, and others, argue it's important to impeach Trump if only to convict him at trial so that he cannot run for public office ever again.

It should also be noted that the House may vote to impeach this week or next, but wait until after Biden is sworn into office before sending the Articles to the Senate for a trial. That's what some Dems are now calling for. Rep. James Clyburn wants to wait until Biden's first 100 days are over. Others suggest waiting just long enough to allow Biden's cabinet to be sworn in, since all Senate business must stop when a Senate impeachment trial begins. With Chuck Schumer as Majority Leader, after Biden and Vice President-elect Harris are sworn in, a real trial could be held in the Senate, with dozens and dozens of witnesses, unlike the show trial McConnell held to quash the charges Trump was previously impeached for last year.

So, lots to chew over on today's program, and lots of callers ringing in with thoughts on all of the above...

Biden's victory is affirmed by Congress following Trump's attempted MAGA Mob insurrection; Fallout continues, including White House resignations, calls for impeachment, 25th Amendment...

Today's BradCast picks up where yesterday's left off, amid the Trump-instigated attempted insurrection by his MAGA Mob at the nation's Capitol amid the formal affirmation of Joe Biden's Electoral College victory. We continue then with all of the mind-boggling fallout thereafter. [Audio link to full show is posted below this summary.]

Among the stories covered today on today's show...

  • Morning Joe speaks for us, in his response to Wednesday's shameful attempted coup and pathetic response to it by the Capitol Police;
  • So does Joe Biden, who, like Joe Scarborough, notes how differently a white rightwing MAGA Mob was dealt with, versus how things would have played out had those violent rioters who invaded the Capitol building been BLM protesters;
  • Once the Capitol building was cleared of Trump's lawless marauders on Wednesday night --- and four insurrectionists had died in the bargain --- the Electoral College affirmation by Congress that they'd attempted to prevent, picked up once again, with a (very slightly) chastened GOP. We share several outstanding speeches from the Senate floor in the middle of the night/early morning, as delivered by Senators Cory Booker (D-NJ) and Mitt Romney (R-UT). That, before seven Republican U.S. Senators and 138 GOP House Members (68% of the caucus!) voted, unsuccessfully, to nullify millions of votes cast by the voters of Arizona and Pennsylvania;
  • For the record, the seven Republican Senators who voted to nullify the voters in those two states --- even after the attempted coup at their own place of work --- are: Cruz (TX), Hawley (MO), Lummis (WY), Marshall (KS), Scott (FL), Tuberville (AL) and Hyde-Smith (MS). May their names live in eternal infamy and shame;
  • Trump and his Republican Party's shameful, evidence-free attempt to use the Electoral Count Act of 1887 or 12th Amendment to the Constitution in order to steal the 2020 Presidential election has officially failed, as Biden's Electoral College "landslide" was affirmed by Congress at 3:45am on Thursday morning, January 7th. The MAGA Mob riots served no purpose other than to kill several Trump supporters and injure more than a dozen Capitol police. The results of the election were exactly as they were certified by all 50 states weeks ago;
  • Amid the insurrection and while being locked out of his account at both Twitter and Facebook overnight (he has since been allowed to return to Twitter, though Facebook says he will be banned until at least after Inauguration Day), Trump's mood was said to have grown increasingly erratic. His rage reportedly resulted in Mike Pence's Chief of Staff (and Trump's own former Legislative Director) being banned from the White House, and staffers were reportedly instructed by the White House Counsel to stay away from him, lest they find themselves as an accessory to treason under the Sedition Act;
  • About eight staffers have resigned following Wednesday's events, including Trump's former Press Secretary (Stephanie Grisham), his former Acting Chief of Staff (Mick Mulvaney) and his Transportation Secretary Elaine Chao, the only cabinet member, so far, to jump off the sinking ship. Chao also happens to be married to the soon-to-be-former Senate Majority Leader Mitch McConnell, who will presumably be the Republican Minority Leader following the apparent victories by Jon Ossoff and Raphael Warnock on Tuesday in Georgia's U.S. Senate runoffs. None of those who waited until now to resign should be hailed as heroes;
  • By Thursday morning, both incoming presumptive Senate Majority Chuck Schumer and House Speaker Nancy Pelosi had issued statements calling for the 25th Amendment to be invoked by Vice President Pence and Trump's remaining cabinet members to remove him from office immediately. Pelosi correctly describes Trump as having incited "an unpseakable assault on our nation and our people." Short of impeachment, both Democratic leaders say, another impeachment for "willfully inciting violence against the government of the United States"; "gravely endanger[ing] the security of the United States"; and "demonstrat[ing] that he will remain a threat to national security, democracy and the Constitution if allowed to remain in office" remain a possibility, as detailed in Articles now being circulated for consideration by House Democrats;
  • If you're not familiar with how the 25th Amendment would work, should it be invoked (there is also at least one Republican lawmaker calling for it today, describing Trump as "unfit" and "unwell"), here's a quick primer;

As "today" is still ongoing, we'll need to keep the summary of today's BradCast --- and the extraordinary events we find ourselves covering on the fly --- a bit more terse than usual. [Audio link to today's full show follows below.]

Our first draft of history today includes the news that both Democrats Raphael Warnock and Jon Ossoff have reportedly won their U.S. Senate runoff contests in Georgia against incumbent Republican Senators Kelly Loeffler and David Perdue, respectively. With those two stunning, if narrow, victories, Democrats will soon enjoy partisan control of the U.S. Senate under the new Democratic Majority Leader Chuck Schumer, instead of soon-to-be-former Republican Majority Leader Mitch McConnell. Warnock will be the first African-American Senator and Ossoff the first Jewish Senator to represent the Peach State. Ossoff, at 33 years old, will also be the chamber's youngest member.

While that momentous news alone would normally be our top and perhaps only story for the day, it barely makes the top three. As you know by now, after weeks of false, evidence-free claims by the President of the United States that the election was stolen from him, and after an hour of his endlessly repeated, ginned-up rhetoric on same at a so-called "SAVE AMERICA" rally in D.C. this morning --- and after Donald Trump's buffoon, criminal attorney Rudy Giuliani called for "trial by combat" in his own remarks --- the MAGA Mob he summoned to D.C. stormed the U.S. Capitol building.

The rioting came during a joint session of Congress, amid GOP challenges to the formal, usually ceremonial Electoral College affirmation of Joe Biden's decisive November victory. Both chambers of Congress were evacuated as Trump-supporting rioters broke windows and doors to enter the building. Both the House and Senate chambers, as well as lawmaker offices, including House Speaker Nancy Pelosi were violently breached by the anti-American marauders. Vice President Pence, who had been presiding over the Joint Session, was ushered, with several other key lawmakers, to a secure location through underground tunnels beneath the Capitol building. One of the insurrectionists is said to have been shot and killed. Questions remain, lots of them, as to why there was not a larger police presence around the Capitol before this perfectly predictable attempted coup.

But, while we offer a first draft of history on all of the above today, the attempt to overthrow the American government, abetted by the President himself, was hardly the only sign of the long and steady degradation of our Constitutional representative republic by members of the Republican Party. On Tuesday, GOP members of the Pennsylvania Senate refused to seat a duly elected veteran Democratic state Senator on the first day of their new session and used their gerrymandered majority to muscle Democratic Lt. Gov. John Fetterman out of his state Constitutional role as President of the state Senate. We share some of the remarkable audio from that Tuesday coup in the Keystone State, in what I'm calling "The Wisconsinization of Pennsylvania."

Joining us to explain what happened during those extraordinary events in Pennsylvania on Tuesday, the even more extraordinary events that we saw in D.C. on Wednesday --- and both where it all comes from and what it all means going forward --- is the great WILL BUNCH, longtime national columnist for the Philadelphia Inquirer and Philadelphia Daily News.

Finally, as the President of the United States with no more than two weeks left in office only made matters worse with his Twitter statements throughout the riots that he fostered today, we turn for sanity to the President-elect instead. We close today's program with Biden's calming words to a nation in crisis, while the current disgraced President returns to his bunker amid the American Carnage he has wrought...

Today on The BradCast: The last vote of the '2020' election has now been cast with Georgia's two U.S. Senate runoffs now over. The voting part anyway. Now the counting, fighting and complaining begin. [Audio link to full show follows below summary.]

We received mixed reports from on the ground in Georgia today. The state's voting systems manager, Gabriel Sterling, told the Atlanta Journal-Constitution that Election Day in the contests that will determine partisan control of the U.S. Senate went very smoothly on the state's 100% unverifiable touchscreen voting systems made by Dominion and forced on in-person voters in the state for the first time in 2020 by their Republican Sec. of State, Brad Raffensperger. Lines to vote, according to Sterling were short in most places, though as long as 30 minutes at some Atlanta metro area voting stations. Other sources on the ground in the Peach State told us that lines in some places that were longer than for the Presidential general election back in November. Given there were just three races on the ballot (two for U.S. Senator, one for a Public Service Commissioner), there shouldn't have been any lines at all to speak of. Nonetheless, the 'Rube Goldberg' touchscreen computer ballot marking devices and the computerized pollbooks and computerized scanners that are used with them --- instead of a much simpler, verifiable, reliable hand-marked paper ballot system --- always take longer to cast a vote. They also, as usual, created problems for voters in several counties, with misprogrammed access cards and other reported failures. Emergency hand-marked paper ballots were said to have been deployed in some cases, as needed.

We try to read some of the tea leaves from today's reports, as to what it all may mean, while we wait for results that could come tonight....or over the next several days.

We're joined today from on the ground in Georgia by LAUREN WINDSOR, journalist, Executive Director of American Family Voices, producer of the grassroots political web-show, The Undercurrent, and, apparently, "operative", according to a report by the Atlanta Journal-Constitution. Windsor has been in the state for the past month with her producer, bird-dogging incumbent Republican millionaires and Senators Kelly Loeffler and David Perdue, regarding their respective stock market windfalls amid the COVID epidemic. They are running against Rev. Raphael Warnock and Jon Ossoff, respectively.

She's been there as Trump has made a mess out of the runoffs, which he described over the weekend as "illegal", before showing up at a rally in the state, supposedly for Loeffler and Perdue on Monday night, not long after he confused matters further by calling for $2,000 COVID checks for Americans after Republicans (including the two GA incumbents) had insisted on $600 checks.

Windsor has broken a number of stories over that time, including last month when, as AJC documented, Perdue lied to her by claiming he planned to challenge Joe Biden's electoral vote count in the Senate tomorrow --- even though his term ended on January 3 and won't begin again until this year's election is decided and certified. Trump retweeted her tweet reporting Perdue's lie and his campaign then retweeted the President's tweet. There is apparently nobody left in the Republican Party who cares about telling the truth.

Both Perdue and Loeffer, she tells me, are "trying to have it both ways with regards to supporting the Electoral College challenge. Now they're trying to have it both ways with supporting the $2000 relief checks. They're saying, 'We'll tell you that's what we want, but we're actually going to work with McConnell to make sure it won't happen.'"

She shares of number of stories from her adventures over the past month covering both millionaires Perdue ("this guy owns a home within a gated community that's within a gated community.") and Loeffler ("It wasn't exactly a 'rag to riches story' for Kelly Loeffler. It was more of a 'riches to riches' story.) And Windsor also has some thoughts on the failure of Republican hoaxster James O'Keefe --- who she has also been bird-dogging for years now --- to deliver his promised "bombshells" on Democratic "voter fraud" in the 2020 cycle. Windsor also offers her careful prediction for how today's critical contests will ultimately shake out.

Also today, we enjoy a rare bit of speculation on Donald Trump's future, following a curious story out of Scotland Monday reporting that the tiny airport near Trump's failing Turnberry Golf Resort is set to "expect the arrival of a US military Boeing 757 aircraft" on January 19th, the day before Biden is to be inaugurated. Hmmm....

And, speaking of speculation, Politico has a few scoops on what House and Senate Republicans are planning for their challenges at Wednesday's joint session of Congress to the affirmation of Biden's Electoral College votes in at least three states (perhaps as many as six) during their desperate, last-ditch --- most likely futile, definitely sore-loser --- effort to overturn the 2020 Presidential election and/or make a name for themselves as 2024 Presidential contenders and/or ruin their chances all together in the bargain. We shall see. Suffice to say, Wednesday is likely to be a very long day, as we have long been warning.

Finally, Desi Doyen joins us for our first Green News Report of 2021! With a whole bunch of stories we were unable to cover while off last week, including several new parting gifts from the Trump Administration, such as "bomb" trains and more asthma attacks for children, as well as some much better news for humanity and the planet out of Japan...

As recently reported by John Kruzel of The Hill, the attorneys taking part in Donald Trump's dishonest effort to overturn the results of the Nov. 3 Presidential election "face mounting ethics complaints" that could result in sanctions ranging from fines to censure, suspension or even disbarment.

Michigan's Democratic Attorney General Dana Nessel recently explained why she is seeking to have Team Trump attorney Sidney Powell and others subjected to discipline, including disbarment, for professional misconduct in conjunction with continuing frivolous legal efforts to overturn the results of the Nov. 3 Presidential Election...

Every lawyer, in order to become a licensed professional, takes an oath of office in which they swear to uphold the Constitution. Instead, she [Powell] has done nothing but undermine it. There are so many Rules of Professional Conduct. You can't bring frivolous lawsuits that are not based on fact or the law. You can't have fraud, deceit, misrepresentation, things that are prejudicial to justice. You can't knowingly bring evidence that is false, or make misleading claims. She's broken each and every one of these in all of her cases. Just in the Michigan cases alone, she's breached each and every one of these codes of conduct.

Nessel's observations are certainly consistent with Rules 3.1 and 3.3 of the Michigan Rules of Professional Conduct [PDF] which prevent the pursuit of frivolous claims and forbids attorneys from knowingly making false statements of fact or law to any tribunal. "An action is frivolous," Rule 3.1 explains, "if the lawyer is unable to make a good-faith argument on the merits of the action taken, or to support the action taken by a good-faith argument for an extension, modification, or reversal of existing law."

MI's rules are in line with the American Bar Association's Rules of Professional Conduct as well.

Nessel is by no means alone in her critique of the dubious legal tactics being taken by a number of attoneys allied with Trump. In Delaware, a state judge, on his own motion, issued an order "to Show Cause why the permission to practice" pro hac vice (in a specific case), previously extended to out-of-state Georgia Attorney L. Lin Wood, Jr., should be "revoked". The court believes Wood may have "engaged in conduct in other jurisdictions, which, had it occurred [in a Delaware case], would violate the Delaware Lawyers' Rules of Professional Conduct."

There's a growing body of evidence that multiple attorneys have knowingly pursued frivolous claims that in hopes of undergirding Trump's dangerous and baseless conspiracy theories that the election was somehow stolen from him. They've piled up 59 losses in state and federal courts, many entailing outright dismissals by judges who described the pleadings as "without merit". Yet, that didn't stop right-wing groups of attorneys from recently filing 11th hour federal complaints that are not merely meritless but beyond the pale. So much so, that the D.C. and state bar associations might consider imposing the ultimate tool of attorney discipline --- disbarment...

We made it to the final week of 2020! That's quite an accomplishment, given what transpired this year. Brad & Desi are taking a much-needed year-end break, so it's NICOLE SANDLER guest hosting The BradCast, for the next few days. [Audio link to full show is posted below summary.]

It used to be that this time of year, especially the week between Christmas and New Years, was what was known as a "slow news" time. We haven't even had a slow news day in the past four years, so why break with tradition now? Since we haven't been here with new programs since December 23, I began today's show with a recap of what happened since.

Donald Trump had been missing in action since the November 3 election in terms of working on the pressing issues of the day --- a COVID relief bill and the year-end funding bill for the U.S. Government. Together they make up the Consolidation Appropriations Act of 2020 (CAA). And then there was the matter of the National Defense Authorization Act (NDAA) that had been passed but Trump hadn't yet signed.

When Brad last spoke with you, he reported that Congress, on Monday, passed a $900 billion coronavirus relief package along with the $1.4 trillion omnibus spending bill to keep the government funded through September of 2021, by huge veto-proof margins in both houses. And on Tuesday, Trump awakened from his stupor to call the bill "a disgrace" --- despite it including much of what he himself had asked for --- and demand the payments to individuals be $2000 rather than the $600 his administration had proposed! He had other demands but, as usual, he was confused, conflating things in the COVID relief bill with provisions from his own budget that were contained in the omnibus portion of the bill. But I digress. He threatened to veto the bill or worse, do nothing. In that case, it would just die, with Congress unable to override a pocket veto before the new Congress is seated on January 3, and the entire process to pass the bill must begin again.

On Wednesday, Trump vetoed the NDAA, ostensibly for two reasons: it would require the military to rename bases that were named after figures from the Confederacy and because it doesn't include a repeal of Section 230 of the Communications Act, which shields internet companies from liability for what is posted on their websites by them or third parties.

And then he boarded Air Force One, to spend the holidays at his Palm Beach resort Mar-a-Lago.

To reiterate: while most of the country is suffering, waiting for help to make it through the worst crisis in our lifetimes, Trump was sitting on relief checks, unemployment benefits, an eviction moratorium and rental aid from his Mar-a-lago resort in Palm Beach. At the same time, Vice President Mike Pence is on a skiing vacation in Vail, Colorado, and Treasury Sec. Steven Mnuchin took a private jet down to his vacation home in a Mexican resort near Cabo.

Christmas Eve and Christmas Day came and went, as did the Saturday midnight deadline when pandemic relief programs lapsed, throwing more than 12 million Americans who relied on them for unemployment insurance and more into an even worse situation than they had been in already.

Trump finally gave in and signed the CAA on Sunday evening, but additional damage had already been done. As for the master negotiator, he's more like an impetuous child who threw a temper tantrum and then got tired of being locked in his room so he gave up, and got nothing out of it.

That brings us to today. The House is back in session to vote on two items --- a bill changing the dollar amount of the individual checks to be sent out from $600 to $2000 and to override Trump's NDAA veto. As I am posting today's show, the vote on the $2000 checks has now passed with the 2/3 required under the procedures that were used for consideration, 275-134.

The House then voted by an even bigger margin to override Trump's NDAA veto. That vote was 322-87! Tomorrow, the Senate returns to vote on these two bills. The question is whether Mitch McConnell will bring the issue of the larger direct COVID relief payments to the floor.

Senator Bernie Sanders issued a statement demanding a vote: "The House has passed a $2,000 direct payment for working people. It is time for the Senate to act. This week on the Senate floor Mitch McConnell wants to vote to override Trump's veto of the $740 billion defense funding bill and then head home for the New Year. I'm going to object until we get a vote on legislation to provide a $2,000 direct payment to the working class. Let me be clear: If Senator McConnell doesn't agree to an up or down vote to provide the working people of our country a $2,000 direct payment, Congress will not be going home for New Year's Eve. Let's do our job."

Now that a Democrat will be in power in the White House in a few short weeks, the Republicans in Congress are once again singing their austerity tune. Many are objecting to a $2000 payment saying "we can't afford it" or some similar nonsense. So I'm joined by economist, professor, a leading proponent of Modern Monetary Theory, and author of The Deficit Myth: Modern Monetary Theory and the Birth of the People's Economy STEPHANIE KELTON, who explains that not only can we afford to help people suffering through this crisis, we must!...

Our long national nightmare may be over in about 28 days...but it ain't over yet. Not by a long shot. And, as detailed on today's BradCast, it's becoming more unnerving by the second, with Donald Trump's mental health seemingly devolving rapidly with each and every one. [Audio link to show is posted below.]

Curiously, corporate media are sounding more and more like The BradCast with each passing day. Among the stories underscoring that point as Trump's days in the White House continue to wane (whether he is able to admit that out-loud or not)...

  • "Trump turns on everyone," reports Jonathan Swan at Axios. "Everyone" now appears to include "Vice President Pence, chief of staff Mark Meadows, White House counsel Pat Cipollone, Secretary of State Pompeo and Senate Majority Leader Mitch McConnell." (With a hat-tip to Lincoln Project, for their video getting inside Trump's head regarding Pence);
  • Pentagon Correspondent Barbara Starr reports anxiety is rising at DoD, with one officer telling her "We don't know what he might do" in these final days. They were particularly alarmed after talk from disgraced and pardoned former National Security Advisor, Lt. General Michael Flynn's call for Trump to invoke Martial Law and order the military to "re-run" the election in some states that Trump lost. The military, according to Starr, wants nothing to do with any of it. We hope her reporting is accurate;
  • Amid all of this, Trump unleashed another wave of Presidential pardons for his friends and the friends of his friends on Tuesday night. This time for 4 war criminals charged with murder for carrying out a massacre of Iraqi civilians while employees for Blackwater, the mercenary company owned by Eric Prince (brother of Trump's Education Secretary, Betsy DeVos); 3 corrupt, felonious Republican former Congressmembers (including the first two members of Congress to endorse him, Chris Collins of NY and Duncan Hunter, Jr. of CA); and 2 Campaign staffers who plead guilty to felonies tied to the Robert Mueller Special Counsel probe into Russian interference during the 2016 election. (And, after getting off air tonight, Trump has issued still more pardons for still more of his friends, including for his former campaign manager Paul Manafort, former campaign advisor Roger Stone, and for Charles Kushner, father of his son-in-law Jared, all convicted of multiple felonies);
  • But wait, there's more. Much more! During an unhinged, pre-taped White House video posted to Twitter last night, Trump threatened to veto the $900 billion COVID relief bill attached to the government's must-pass annual spending bill to avoid shutting down again. The long-overdue emergency relief was finally passed by Congress after eight months of Trump refusing to participate in negotiations. He's now pretending to be upset that stimulus checks to be sent to many Americans will only be $600. Congressional Republicans and White House negotiators insisted it could be more no more than that. But Trump now suggests he may veto the measure unless payments are increased to $2000. Dems, who had been trying to increase the amount of payments for months immediately joined Trump's call. Congressional Republicans (and the two incumbent Republican Senators running in the January 5th runoffs) are apparently furious, confused, and not sure how to fulfill the demands of their Frankenstein's monster;
  • And, just before airtime, Trump vetoed another long-negotiated must-pass bill, the $790 billion Military Authorization spending bill which was enacted last week by veto-proof majorities in both houses of Congress;
  • That's only a taste of what, according to the Washington Post today, has now "plunged" the GOP "into open warfare over President elect Joe Biden's election victory --- with President Trump taunting Senate Majority Leader Mitch McConnell and threatening primary challenges against other Republicans, House lawmakers egging on senators to contest the counting of electoral college votes next month, and senior GOP senators rebuffing that effort as a pointless political exercise";
  • All of which, as the New York Times reports today, has resulted in Trump at the "most unleashed...and...most unpredictable point in his presidency," while he is desperately "focused on the one area in which he is powerless to get what he wants: a way to avoid leaving office as a loser";

With that nightmarish backdrop, our guest today, HEATHER DIGBY PARTON of Salon and Hullabaloo joins us to explain why Trump's final days are "more frightening than Nixon's" as he "seems to be having a very public nervous breakdown."

"We knew he wasn't going to act like a normal President and be gracious and have Biden over coffee. I didn't expect that," she tells me. "But this? He's so incredibly afraid of being called a loser that he's turned himself into the greatest sore loser in world history!"

"He's clearly melting down," she adds. "As far as I am concerned, when you have a President who is melting down, who has this capacity to launch a nuclear war, we're in a very dangerous situation."

She also has a number of thoughts on where this all goes "beyond Trump," after the (theoretically) inevitable Inauguration of Joe Biden, if we manage to get there. "The rationalization of these people. The brain-poisoning...The absolutely servile Republican Party that has completely abdicated all responsibility," observes Parton. "He is the Republican party. They are part of it, if they choose to be. But there is no Republican Establishment. There's only him."

This, she cautions, is "Trump's last stand," before adding ominously: "At least, we think it is."

We've tried to touch base with Parton at many of the landmark moments throughout the nightmarish Trump Presidency (and candidacy --- she was also with us the day he descended the gilded escalator at Trump Tower to announce his run for office in 2015.) So, with all of this madness swirling and our long national nightmare before Christmas continuing, it seems like today was another perfect moment to check in with her for our last interview before standing down for the holidays. On today's BradCast: We're now just one week from Election Day. But as today's guest underscores, we may be much farther away from knowing who actually won it, given disturbing vulnerabilities that remain in our nation's voting system, beginning --- if not ending --- in the battleground state of Florida. But first, the Trump Administration announced over the weekend, via White House Chief of Staff Mark Meadows, that it is no longer even trying to prevent the spread of COVID-19, with Meadows telling CNN that "we aren't going to control the pandemic." Rather, he said, they'll work on mitigating its effects, eventually, through the development of therapies and vaccines.

That, as the U.S. hit its third peak of infections over the weekend, with new daily records that outpaced those from the June-July peak, which previously outpaced those from the original March-April peak. The pandemic is getting far worse, not better, and it's now being super-spread by the President of the United States himself at maskless rallies around the country. The virus which has now killed almost a quarter of a million Americans in the past six months is also being similarly spread by Vice President Mike Pence at rallies, even after five of his top staffers and advisers, including his Chief of Staff Marc Short, were revealed over the weekend to have tested positive.

On Monday morning, Trump actually tweeted that reporting on COVID numbers should now be outlawed. At the same time, talks on a new emergency relief package for the American people, between the White House and Democrats in the U.S. House, collapsed yet again. And, in response to all of the above, the Dow plummeted 650 points on Monday.

Things are not going well, just one week out from Election Day, even after some 60 million Americans have already cast their vote this year, outpacing all early voting from 2016.

But, if you think Election Day will be the answer to all of our woes --- while I pray you are right --- you may want to hedge that bet. One of my greatest fears about the election, a ransomware attack, appears to already be playing out in one county in the battleground state of Georgia. In Hall County, a ransomware attack has hit the county's elections infrastructure by taking out its voter signature database and a precinct map hosted on its website. If a similar attack were to occur on or before Election Day, in any one of the thousands of counties which now rely on the Internet or networked computers to allow voters to cast a vote at all, we could see absolute chaos. This President, of course, is all to ready to exploit such a case to his advantage with the help of gerrymandered Republican-controlled state legislatures around the country and a compliant (and stolen) U.S. Supreme Court (made even more stolen today by the confirmation of Amy Coney Barrett in the U.S. Senate.)

Down in the critical battleground of Florida, as my guest explains today, voters may never even know if the election is stolen from them. That guest today is the legendary, former 28-year Supervisor of Elections in Leon County (Tallahassee), Florida, ION SANCHO, who was so well-respected by his peers on both the right and left he was appointed to oversee the eventually-aborted year 2000 recount between Al Gore and George W. Bush in the Sunshine State.

On Friday, Sancho sent an urgent letter [PDF] to the Supervisors of Elections in 47 of Florida's 67 counties which use wireless cellular modems to transmit precinct election results to county headquarters after the close of polls on Election Night. The letter warns that those modems --- and the Internet connections to them at the counties' central tabulators --- can be easily hacked "from anywhere in the world." If they are, he explains on today's program, it's very likely that such a hack, changing election results, would never be noticed by election officials.

"The issue is that we’re using equipment that is not secure," Sancho tells me. "To quote Sen. Marco Rubio, 'Many Florida election officials are arrogant over their belief that they can’t be touched, that they are secure.' And this is a state that does not compare the numbers that we generate on those electrical optical scanners to the actual, physical votes on the piece of paper. We’re completely dependent upon those electronic totals on Election Night."

Manual examination of hand-marked paper ballots in Florida, to make sure the reported computer tabulation was correct, is prohibited by state law. Sancho details his concerns about those modems --- which are not federally certified for use in elections --- and how the state's election officials can avoid the threat posed by this very serious vulnerability to the state's election infrastructure. Making matters worse, he notes, "We do not audit the paper ballots to confirm that the election totals are correct. And that’s a huge, huge problem – not just in Florida, but everywhere in the country."

"Most of the election officials were not even aware that their systems were connected [to the Internet], because the vendor [in this case, ES&S, the nation's largest] never told them. You’re almost 100% dependent upon the vendor for the information about your system. So our most public process – our elections process, which is public – really are controlled by private entities."

"The worst-case scenario," with the modems now used in the systems in Florida, "is that a man-in-the-middle attack could actually intercept the totals that are being electronically-transmitted over the Internet, and manipulate them --- not only to the central tabulator, but re-routing back into the actual digital voting machine and altering the results in that device," he warns. "You could have a complete disaster here."

Sancho may be familiar to some listeners from his landmark appearance in HBO's Emmy-nominated 2006 documentary Hacking Democracy, in which he allows an experiment by "white hat" Finnish hacker Harri Hursti. In the film's climactic scene, we see an actual hack of one of Leon County's optical scan systems, as carried out by Hursti in a mock election. The hack flips the results of the election in a way that would never be noticed by elections officials, save for a manual examination of the hand-marked paper ballots cast.

Sancho also offers his concerns today about whether the 2020 Presidential election could become a redux of what played out in Florida in 2000, when a weeks-long battle to determine who would be President of the United States was kicked off on Election Night, after an optical-scan tabulator --- for reasons still unknown to this day --- recorded negative 16,022 votes for Al Gore in Volusia County. The election was ultimately decided in favor of Bush by an "official" margin of just 527 votes, thanks to a right-wing U.S. Supreme Court which stopped Sancho's statewide hand recount from ever being completed...

Before we get to our otherwise previously-scheduled Special Coverage of Wednesday night's Vice Presidential debate, we open today's BradCast with the news that Twitter has suspended TheBradBlog's account for posting a 100% accurate tweet regarding Georgia's new touchscreen voting systems. [Audio link to full show is posted below summary.]

I laid out the entire, maddening story regarding the tweet in question in a BRAD BLOG item today, since I can't post at all right now on Twitter, while they review my "appeal" to their finding that a two week old, demonstrably accurate tweet is in violation of the service's "rules against posting misleading information about voting." As you can imagine, my tweet is well supported, as its based on email from the GA Sec. of State's office sent to all 159 counties regarding an error discovered in the state's new touchscreen voting systems used by every voter at every polling place in the state. The email I cite is from the SoS and was published in a federal court filing (also linked with the tweet!) as part of a long-running lawsuit challenging the use of those machines, which we've reported on here for years now. The lawsuit seeks hand-marked paper ballots for voters at the polling place instead. The full story of what happened with Twitter, including screenshots and links to the federal filing and SoS email is posted here.

Then its on to last night's refreshingly dull and normal(ish) Vice Presidential Debate from Salt Lake City, Utah between Vice President Mike Pence and Democratic Veep nominee Sen. Kamala Harris. We're joined today for analysis and commentary by award-winning opinion journalist HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo, along with author and political scientist DAVID FARIS of Roosevelt University and The Week.

While the debate may have been dull --- save for the fly --- there was much revealed (and much evaded) and much to discuss about it in today's very lively show, including, near the end, whether there will be any more debates at all this year.

I'd say more about today's fun (and, at times, funny) show, but I've got to get back to fighting with Twitter now, apparently. As my rant near the top of today's BradCast makes clear --- there is a now mountain of madness emanating from the White House. All of it now going on at one time, as Donald Trump and the Republican Party become more desperate with each passing day before this year's election. And while the mountain of unfolding nightmarish stories I quickly cover in that rant are all terrible --- some of them horrific, in fact --- none of them matter, for the moment, as much as making sure that everyone is able to vote this safely this year and have their votes counted as cast in the November 3rd election. That is how we will keep ourselves and this republic alive, as this President and his Administration (and their party) appear to have no interest in that. I hope you'll enjoy the rant nonetheless. Before and after today's rant...

  • We kick off our show with the new ad from Republican Voters Against Trump, featuring Olivia Troye, a former top aide to Vice President Mike Pence as his homeland security advisor and his lead staffer on the White House Coronavirus Task Force "from day one". Troye, who left the White House in July, announced today that she is endorsing Joe Biden and explains why in the video ad that excoriates Trump for not wanting to hear about the pandemic back in February "because his biggest concern was that we were in an election year and how was this going to effect his record of success." She goes on to charge that Trump "doesn't care about anyone else but himself" and once described his supporters during a task force meeting as "disgusting people";
  • Then, a bit of testimony from Donald Trump's FBI Director Christopher Wray, in a hearing today before the U.S. House Homeland Security Committee in which the man Trump hired to replace the fired James Comey explains that Russia is currently undertaking "very active efforts...to influence our election in 2020 through what I would call more than malign foreign influence". He testified that the Russian effort underway is meant to denigrate Joe Biden;
  • But, as noted in our rant, ultimately, none of it matters unless American voters can safely vote and have their vote counted as cast. Toward that end, we have several stories of mostly good news for voting rights, beginning with the federal judge in Washington State who issued a nationwide preliminary injunction today to block what he describes as "a politically motivated attack on the efficiency of the Postal Service" before the November election. The injunction was sought in a suit filed by 14 states against the Trump Administration and the U.S. Postal Service. It seeks to block measures implemented by new Postmaster General and major Trump/RNC donor Louis DeJoy which slowed down mail delivery in advance of an election that will see record mail-in voting due to Trump's failure to control the coronavirus pandemic;
  • That is hardly the only effort underway by Trump and his party to make voting by mail more difficult this year. But we've got mostly good news to report today from the Supreme Court in the key battleground state of Pennsylvania. The high court approved the use of absentee ballot drop-boxes and is allowing ballots received by elections officials to be tallied if they arrive as late as three days after Election Day and are postmarked by November 3rd. The setback for Team Trump in the state Court's series of rulings on Thursday also included upholding a state requirement that poll watchers must live in the county where they are poll watching (while that's not optimal in most cases, it may be necessary this year to prevent the GOP from bringing in people to intimidate voters. We explain why that is.)

    In more good Keystone State news for Democrats, the state Supremes also ruled that the Green Party failed to qualify for this year's Presidential ballot. In better news for Trump and the GOP --- though not good news for voting rights advocates --- the Court denied a Democratic request for voters to be notified to come in and cure absentee ballot deficiencies --- such as missing or perceived mismatched signatures or missing secrecy envelopes --- before those ballots are rejected. Hopefully this serves as a warning to voters in PA (and everywhere else!) to follow all the rules for absentee voting carefully before mailing --- or, better yet --- dropping off ballots in person this year, where allowed. A lawsuit challenging some of the same issues has been filed by the Trump Campaign in federal court, where the Trump-appointed judge in charge of that case has put it on hold as the state cases moved forward. We'll see what that federal judge does now.

  • The embarrassing battle over absentee ballot drop-boxes continued today in the longtime battleground state of Ohio, leading the Republican Chief Justice of the state's Supreme Court to excoriate her own party for attacks they leveled against Democratic Franklin County Common Pleas Judge Richard Frye after he found in favor of Democrats earlier this week in the state suit they filed against Republican Secretary of State Frank LaRose. In that case, Frye found that state law allows Counties to deploy as many secure mail-in ballot drop-boxes as they'd like.

    Longtime "conservative stalwart" and Chief Justice Maureen O'Connor issued a blistering rebuke against state Republicans for their response to Frye's finding, calling the GOP's allegations "disgraceful" and "deceitful" and "a blatant and unfounded attack". Nonetheless, even after Frye's finding, LaRose has so far declined to lift his August directive mandating only one drop-box in each of the Buckeye State's 88 counties and has vowed to appeal Frye's ruling. That turns out to be in contradiction of what the Secretary indicated previously, when he told many people --- including a top labor official in the state (via text messages) as well as a federal judge in a parallel federal suit --- that he would be happy to change his order once a Court clarified if it was allowable under state law. But LaRose, apparently, is a liar...or a coward cowed by his own party;

  • In our final War on Voting story for today (yes, there will be many more to come in the days ahead, sadly), South Carolina's Republican Governor signed a law this week that will allow any state voter to vote by absentee ballot this year, no excuse needed, in response to the nation's still-out-of-control COVID-19 pandemic. That's good news. But the legislation adopted this week by the GOP-dominated state legislature failed to include several provisions sought by Democrats, including the use of secure drop-boxes for absentee ballots and the waiving of a requirement for a witness to sign the mail-in ballot. The changes to state election law come as incumbent Republican U.S. Senator and Trump lackey Lindsey Graham is said to be TIED in pre-election polling with Democratic challenger Jaime Harrison in the Palmetto State in what could be a stunning upset this November...if ALL voters in the state are allowed to vote and to see their votes counted as cast;
  • Finally today, in a brief respite from the War Against the War on Voting, Desi Doyen joins us for our latest Green News Report, with some of the ongoing brutal news this week in the war against our ever worsening and deadly climate crisis and those who continue to pretend it doesn't exist...even in a week like this one...

Our 2020 RNC wrap up with Heather Digby Parton and Richard 'RJ' Eskow on the Republicans' viral effort to scare up a second term...

On today's BradCast: Never mind the lawlessness of it all. Personally, I'm still having trouble today getting over the creepy, grotesque scene of thousands jammed shoulder to shoulder together on the White House lawn for Donald Trump's viral super-spreader event in celebration of his acceptance speech to run for a second failed term as President. But maybe that's just me. [Audio link to today's upbeat show after a very grim night follows below.]

We're joined today for our Republican National Convention Week-in-Review by HEATHER DIGBY PARTON, award-winning opinion journalist at Salon and Hullabaloo, and RICHARD "RJ" ESKOW, longtime progressive columnist and host of The Zero Hour show on radio, TV and podcast.

It was a bizarre and stunningly dishonest week from the GOP, to say the least, capped off by the mother of all Lie Fests from the President of the United States himself. His droning, 70-minute long attempt to gaslight the American people by lying about his record and trying to scare the hell out of them about Joe Biden, did not disappoint, at least on the dishonesty scale. We make short work of a few much-needed, monster fact-checks at the top of the show before we get to the central question of the day.

Setting aside the lies and the hypocrisy of breaking countless laws while use the White House ("the People's House") to declare himself the "Law and Order President", did Trump's false, fear-mongering speech, and all the same that came before it this week from every other RNC speaker, accomplish what Republicans and Trump needed them to?

Parton and Eskow (and Desi Doyen and me) all have plenty of thoughts on that question and many others in today's lively round-table at the end of another long convention week and as we prepare for the nightmares to come in the general election season, debate season, and, undoubtedly, the boatload of October Surprises and dirty tricks that lie ahead...
