Committee Issues Short Statement, Slap on Wrist for One of Congress's 'Most Corrupt' Members on Last Day Before Democrats Take Over
But Troubles May Just Be Beginning for Florida Congressman...

Republican U.S. Congressman Tom Feeney of Florida's 24th District has been ordered today by the House Ethics Committee to pay $5,643 for the cost of a "recreational" golf trip to St. Andrews, Scotland, which he had taken with the now-disgraced lobbyist Jack Abramoff in 2003. The bill had been previously paid for by Abramoff, the committee has found.

The slap on the wrist issued today by the U.S. House Ethics Committee on the last day before the change-over to the new Congress was announced in a terse, one paragraph, bare-bones statement posted to the committee's website. AP reported the matter here. Outgoing defeated Congressman Curt Weldon (R-PA) was also found in violation of House rules and has agree to pay back more than $23,000 in inappropriate gifts.

The findings from the Ethics Committee, however, may be just the tip of the iceberg for Feeney as there continues to be a number of other allegations and claims of misconduct, both new and old, which still hang precariously over the Congressman's head.

The claimed cost of Feeney's Scotland trip, $5,643, was apparently supplied to the committee by the Congressman himself in March of 2005 after the many tentacles of the Abramoff corruption scandal were beginning to reveal themselves. Only after the trip had been reported by the media did Feeney take the matter to the Ethics Commission.

Feeney, who has been named for the second year running as one of the "Most Corrupt Members of Congress" by the non-partisan ethics watchdog group the Committee for Responsibility and Ethics in Washington (CREW), had previously claimed that the trip, and several others, were pre-approved by the House Ethics Committee. As well, he had also originally claimed on his disclosure forms for the Scotland trip that it had been paid for by the National Center for Public Policy. The center has denied paying for the trip and Feeney has supplied no evidence that we're aware of that the Ethics Committee had pre-approved his vacation with Abramoff or any of the others.

In a statement released this afternoon, the National Center for Public Policy Research reiterated their denial of having had anything to do with Feeney's travels, despite continue statements from Feeney's office suggesting that they did. "The National Center for Public Policy Research played no role in this trip," the statement reads, "and only learned of its existence from media inquiries two years after it was taken."

No action has yet been taken on the other questionable vacations, one to Korea which was sponsored by he Korea-U.S. Exchange Council (KORUSEC), a registered foreign agent, and another to West Palm Beach, Florida, which Feeney had listed as having been paid for by a lobbying firm, which would also be a violation of House rules.

According to the Orlando Sentinel today, Feeney’s Chief of Staff Jason Roe --- who has had his own conduct questioned --- said of Feeney: "He’s personally and professionally embarrassed and considering it an expensive lesson."

The "lesson" however, was not all that "expensive" by Congressional standards, and certainly not if the $1.3 million that Feeney raised, mostly from corporate PACs, to spend on his recent campaign might be any indication of the funds that the once-exceedingly powerful Florida Republican has quick and easy access to.

"It's like he robbed a bank and was just asked to give back the money," said Naomi Seligman Steiner of CREW in deriding the light treatment given to Feeney by the commission.

The other two congressmen who had gone on junkets to St. Andrews with Abramoff, Tom Delay (R-TX) and Bob Ney (R-OH), have since resigned in the wake of criminal charges and guilty pleas. The cost for former Republican Majority Leader Delay's trip to Scotland with Abramoff was estimated to have been between $70,000 and $100,000. Feeney is the only Congress member of the three still serving in the U.S. House.

He was recently declared the winner by the state of Florida in the U.S. House race for 24th congressional district where Feeney ran one of the dirtiest --- and most expensive --- U.S. House campaigns in the nation against Clint Curtis, a computer programmer turned whistleblower. In early December of 2004, The BRAD BLOG broke the news of Curtis's affidavit alleging that Feeney was involved in a conspiracy to create electronic vote-rigging software when both men worked for the same Oviedo, Florida, software firm, Yang Enterprises, Inc. (YEI), in 2000. At the time, Feeney was employed as YEI's general counsel and registered lobbyist, even while he served as the powerful speaker of Florida's House of Representatives.

Curtis also charged at the time that Feeney had helped cover up a number of other legal violations by the company, including the employment of illegal aliens at YEI who he claimed had had been spying for Communist China. Curtis also alleged YEI was over-billing on state contracts and had been inserting illegal wiretapping modules into software the firm had been contracted to write for NASA and the Florida Dept. of Transportation (FDOT). In the ensuing years, one of YEI's employees, Hai Lin "Henry" Nee, the man Curtis accused of writing the wiretapping modules, pled guilty after being arrested by Federal Authorities in a four year sting in which he admitted sending computer chips used in Hellfire anti-tank missile guidance systems to Communist China. As well, a report issued by the State of Florida's Inspector General's office found that YEI had, in fact, over-billed the state of Florida on contracts and that Nee had indeed been an illegal alien.

Feeney, a good friend of Dr. and Mrs. Yang, the owners of YEI --- who have given thousands of dollars in campaign support to the disgraced congressman over the years --- still keeps his main campaign headquarters in the YEI office building in Oviedo, Florida, to this day. Feeney had previously been caught lying about his association with the Yangs.

Feeney's troubles, however, are likely far from over. As a member of the Republican Leadership in the 109th Congress --- he was a deputy whip --- Feeney has yet to detail what he knew about his Florida colleague Rep. Mark Foley's sexual transgressions with minors. After reports had surfaced that the Leadership had been made aware of the concerns about Foley many years ago, Curtis issued a press release during the campaign calling on Feeney to come clean on what he knew about Foley, when he knew it, and what he did about it. Feeney has stayed mum to this day, refusing to give details about his knowledge in the matter.

Feeney, who has claimed Curtis is both "crazy" and "a liar" has refused to take a polygraph test despite having been challenged publicly by Curtis, and others, to do so. For his part, Curtis successfully passed a lie detector test concerning his charges against Feeney and YEI back in early 2005.

Additionally, Curtis has since filed a challenge in Congress to the election of Feeney, claiming a number of irregularities found in the Diebold electronic voting systems used across several counties in Florida's 24th district. Yesterday, the National Election Data Archive issued an analysis [PDF] of precinct data for the election detailing a number of inexplicable discrepancies in the results as reported by the state of Florida. The non-partisan Election Integrity organization has announced that the discrepancies in the numbers are "consistent with a pattern that would be caused by voter disenfranchisement, vote fraud, or innocent miscount."

When the Congressional challenge was filed in the race between Christine Jennings (D) and Vern Buchanan (R) in the FL-13 race --- where the votes of some 18,000 Florida voters failed to register on ES&S touch-screen voting machines in Sarasota, with a reported margin of just 369 votes between the two candidates --- Feeney declared the Constitutional challenge to be "total political dictatorship." His statement was made to the media, however, before it was publicly known that Feeney's election would as well be challenged in the same Congress under the same Federal Contested Elections Act.

Curtis's challenge, and several others originating in the state of Florida, will reportedly be championed in the House by Congressman Rush Holt (D-NJ), who has long been an advocate for election reform in the U.S. House. We hinted at this last week when Florida's corrupt Rep. Tom Feeney (R-Abramoff) expressed his obnoxious indignation over the democratic (small "d") Congressional election challenge filed by Christine Jennings (D) against Vern Buchanan (R) in the FL-13 U.S. House race. This is the contest in which the perpetually election-challenged state of Florida certified Buchanan as the winner by 369 votes, even though some 18,000 votes seem to have disappeared altogether on Sarasota County's paperless ES&S touch-screen voting machines.

The challenge brought Feeney slithering out from under his rock to charge that Jennings' Constitutional request that Congress not seat Buchanan --- who appears to have "won" only due to failures in Sarasota's voting equipment (which even ES&S's own "expert witness" admitted on the witness stand during a hearing on the election contests filed by both Jennings and voters in Florida) --- amounted to "total political dictatorship."

At least that's what Feeney told the Orlando Sentinel at the time.

What he doesn't seem to have told them is that he too is the object of a similar Constitutional challenge in Congress by his own opponent, Clint Curtis, in the race for U.S. House in Florida's 24th district.

Curtis, who originally exposed Feeney's alleged attempt to create touch-screen vote-rigging software back in 2000 (a story broken by The BRAD BLOG in 2004 and followed in detail ever since), campaigned to unseat Feeney this year for the first time, but was declared the loser. Curtis disagrees.

Warren Stewart at VoteTrustUSA covered both the Curtis and Jennings challenges on the Thursday before XMas weekend, along with a posting of the complaints filed by both candidates (Curtis' complaint here, Jennings's complaint here, both in WORD format) as filed in Congress. We've yet to review either complaint or discuss them with either candidate personally, so we'll refer to Stewart's coverage and the actual complaints for the moment and let you people do some work for a change. ;-)

The Orlando Sentinel, however, picked up on the story of Curtis's challenge on Xmas Eve in a brief post in their "This Just In" section. Here's the full item...

Curtis down, but he's not out --- right?

Clint Curtis, who challenged Rep. Tom Feeney, R-Oviedo, in the general election, lost by nearly 28,000 votes. Or did he? Curtis, a Democrat whose campaign centered on questioning the integrity of the nation's vote-counting system, has filed formal notice of an election challenge with the U.S. House of Representatives.

Among the charges is that official voting results are "wrong, unreliable and not worthy of any election in this country." Why? Mishandling of election laws, malfunctioning voting machines and --- wait for it --- the likelihood that affidavits furnished by Curtis from voters who say they voted for him will add up to more than the totals reflected in the official record.

And Who Knows 'Total Political Dictatorship' Better Than the Corrupt Bully-Boy Feeney?!
(Who Also Has Now Had a Congressional Challenge Filed in His Own Election!)

Tom Feeney (R-Abramoff) is back! And he's not taking any shit from any of those democracy loving pussies!

Now that he's temporarily been sent back to the U.S. House of Representatives --- after having spent more than $1 million in corporate PAC money to achieve an unimpressive victory over Clint Curtis, the computer programmer who spent about $40k on his campaign and has accused Feeney of conspiring to create vote-rigging software in Florida --- Feeney is ready to rumble!

"That is total political dictatorship," Feeney tells the Orlando Sentinel today in regard to the Congressional election challenge filed yesterday by Democrat Christine Jennings in the U.S. House after 18,000 votes disappeared in her recent election in Florida's 13th District, leading to a reported "loss" by 369 votes to Republican Vern Buchanan.

And, if anybody knows anything about "total political dictatorship" it would be Tom Feeney. The man who, as Speaker of the Florida House in 2000, promised to deliver the state's Electoral Votes to George W. Bush no matter what those democracy haters on the U.S. Supreme Court had to say about it!; the man who worked as general counsel and registered lobbyist (even while speaker of the Florida House) for a company that had harbored at least one illegal alien who pled guilty to charges related to sending Hellfire anti-tank missile chips to Communist China; the man who keeps his campaign headquarters in the firm's headquarters building even today!; the man who didn't raise a peep when the Republican controlled U.S. House sent a letter ordering a California judge to dismiss a lawful election contest in San Diego's special U.S. House election last Summer after the House had rushed to swear in apparent-winner Brian Bilbray just 7 days after the election, with thousands of votes still uncounted and a full two weeks before the state would even certify the close and disputed election which was run illegally on compromised, decertified electronic voting machines.

Now --- even after the only expert witness put forward in Florida by ES&S, the voting machine company that makes the touch-screen systems used in FL-13, admitted yesterday on the stand that Jennings would have won the election were it not for problems with the voting equipment --- Feeney is the man sticking his bright red, irony-impaired face out to declare that Democrats would be participating in "total political dictatorship" by exercising their constitutional right to "determine the manner and seating of their members."

"Total political dictatorship" - Nobody knows it better than Tom Feeney.

Oh, and could he also be so angry about this because it turns out that Clint Curtis himself has now filed a Congressional challenge in his race against Feeney? More on that, hopefully, later....




'Constitutional Option' Likely to be Invoked in Fight Over U.S. House Seat According to Paper

From today's St. Petersburg Times...

WASHINGTON — Republican Vern Buchanan may be the official winner in a messy Sarasota-area Congressional race, but Democratic National Committee Chairman Howard Dean says the Democratic-controlled Congress should not seat Buchanan without another election.

“Absolutely not,’’ Dean said in a taped “Political Connections” interview airing Sunday on Bay News 9. “You cannot seat someone if you don’t have an election that’s valid.

“This election is not valid. There are 18,000 people who may have voted and we don’t know what happened to their votes,” he said. “You can bet that if the Republicans were 500 votes short they’d be calling for a new election, and they’d be right.”

On Wednesday, Democrat Christine Jennings said she will ask the U.S. House to take the extreme measure of conducting its own investigation into the election.

In a side note, Rep. Tom Feeney (R-Abramoff), a man who knows a thing or two about both bad elections and bullying people to get his way, is quoted in the story as well:

“I think there would be a huge pushback in terms of the American people,’’ said Rep. Tom Feeney, an Orlando area Republican. “I think that the consequences of that would be severe for the Democratic leadership.”

Feeney, aside from allegedly asking computer programmer turned whistleblower Clint Curtis to create vote-rigging software back in 2000 (which is notorious enough), notoriously also announced, back in 2000 as Speaker of the Florida House, that he would take it upon himself to ensure that Florida's Electors went to George W. Bush no matter what the United States Supreme Court would ultimately decide during the 2000 imbroglio.

Feeney is a bully of the highest reknown. With a fresh election "victory" under his belt (albeit one which his challenger, the whistleblower-turned-candidate Curtis, has questioned) watch for him to crank up his bully-boy-ness as things move forward in this and other related affairs in the new Congress. Watch for The BRAD BLOG to keep calling him on it.

Of course, we've been covering Christine Jennings's (D) refusal to concede and her stand in favor of the voters in the FL-13 fiasco. And though we haven't mentioned it lately, vote-rigging whistleblower Clint Curtis (D), rather than conceding, is convening a group of volunteers to verify the reported "results" of his race against the corrupt Tom Feeney (R) in FL-24.

But several other House candidates, from North Carolina to Ohio (but not New Mexico), are still fighting to assure the voice of the voters is accurately heard...

Legal Resources Being Gathered by National Party to Challenge Close Elections Where Dems Currently Trail

Just off the phone from a DNC insider --- very much in a position to know --- who says the following races are being considered, as of this afternoon, to still be very much in play by the DNC (* = Incumbent, Results shown latest reported by state websites as available):

NC-8: Larry Kissel (D) 60,016 / Robin Hayes (R)* 60,481
CT-2: Joe Courtney (D) 121,321 / Rob Simmons (R)* 121,151
FL-13: Christine Jennings (D) 118,739 / Vern Buchanan (R) 119,116
NM-1: Patricia A. Madrid (D) 103,376 / Heather Wilson (R)* 104,863
OH-15: Mary Jo Kilroy (D) 98,100 / Deborah Pryce (R)* 101,636
OH-2: Victoria Wulson (D) 112,952 / Jean Schmidt (R)* 115,817

The source believes that all of the above races, each of them currently very, very close, are winnable and the feeling is that they "could easily win three of those six."

In each --- except for CT-2, where Courtney is leading --- the Democratic candidate is currently trailing in the reported results as absentee, provisional, and paper ballots are still be canvassed. As well, challenges and recounts are underway in some of those races (we hope to have more detail shortly here on a couple of those races).

(UPDATE: Several readers have written to ask if other races beyond those mentioned above --- such as the U.S. House race in Washington state's 8th Congressional district between Democrat Darcy Burner and Republican Dave Reichert --- are now off the table as far as the DNC is concerned. The races reported above are the only ones named explicitly to us by the DNC sources. However, two different sources there have confirmed that they are largely driven by the folks on the ground in the states, and would urge that noise be made locally --- and loudly enough that higher-ups might hear it at the DNC --- in order to gain more attention from the national party to other such races still of concern.)

The source also adds that the DNC is considering whether or not to ask for contributions from the public to a legal fund to assure they will have the funds needed to provide full legal resources to thoroughly challenge each of those races.

As well, The BRAD BLOG has also learned the DNC is still keeping their eyes on the Colorado Secretary of State race between Ken Gordon (D) and Mike Coffman (R), given the problems revealed in Colorado's disasterous certification procedures for voting machines prior to the election, and their massive meltdowns on Election Day in Denver and elsewhere which caused thousands of voters to be turned away from the polls due to machine malfunction.

AP is reporting today that Coffman's lead is beginning to look insurmountable, though given the fact that Gordon's numbers in Denver alone outpace Coffman's by some 70 to 30 percent, the fact that Denver voters, specifically, were disenfranchised at such an alarming rate due to equipment failure on Election Day, certainly "exemplifies," as the source put it, the need for Election Reform across the country and the importance of Secretary of State races.

The six U.S. House races named above, of course, are just the federal races that the DNC considers "still in play," but there are innumerable local races and initiatives being challenged around the country, as another DNC source told The BRAD BLOG this morning. As well, there are a number of Congressional races where the candidates have, honorably, refused to concede until every vote is counted and accounted for.

Clint Curtis, the vote-rigging whistleblower who ran against Tom Feeney, the man he claims asked him to create vote-rigging software in 2000 (as The BRAD BLOG originally broke back in 2004 and whose story we've been following closely ever since) has issued a press release this morning saying that he will not concede in the race until every vote is accounted for.

"The right to vote and to have that vote counted accurately is the very foundation of our democracy, and I owe it to the voters in my district and the state of Florida to continue to push for accurate, honest elections," Curtis said in the news release. He points out that as a candidate, he "now has the legal standing to pursue an investigation into the anomalies," which he claims were reported during his race.

"I can accept that the citizens across the state of Florida were out of step with the rest of the country," added Curtis, "as long as we know that this election truly reflects their intent." The Florida Secretary of State's website currently shows Feeney leading Curtis 58 to 42 percent.

In California's 50th Congressional district, Francine Busby (D) has still refused to concede in her race against Brian Bilbray (R) in which she reportedly trails 54 to 43 percent. We applaud Busby's refusal to concede given the outrageously bad administration of the election across the entire San Diego County as overseen by Registrar Mikel Haas, one of the country's worst.

A Zogby poll taken on Election Day (and shortly thereafter) shows an unexplained 6 point disparity with the final results as we reported last week.

As reported earlier today, Haas's resignation was called for on Election Night by San Diego County Democratic Party Chair Jess Durfee after voters were disenfranchised across the county when Diebold touch-screen systems failed to work and not enough paper ballots were made available for voters. Many of those voters ended up voting on Spanish language paper ballots after English ballots had run out by 9am on Election Day; others simply gave up and went home or to work without being able to cast a vote at all.

We echo Durfee's call for Haas to step down immediately. San Diegans deserve honest and accurate elections in which the voters may have confidence in the reported results. Haas has, disgracefully, provided none of the above during his irresponsible tenure.

We originally reported that the Democratic candidate was trailing in the reported results in each of the six DNC-named races. In fact, Democratic candidate Joe Courtney in the CT-2 race is currently ahead in the results as reported so far. We've corrected the original misstatement in the article above. Further, AP is now reporting Courtney as the winner after a final canvassing of the ballots.




Says Will Do 'Forensic Reconstruction' to Determine 'If Election is Supported by Actual Voters'

As of midnight EST, MSNBC reported that with 90% of the vote in, Tom Feeney was projected to win FL-24 57%-43%.

As loyal BRAD BLOG readers know, Feeney, one of CREW's 20 Most Corrupt Congressmen, was being challenged for his congressional seat by election fraud whistle-blower Clint Curtis, who alleges Feeney asked software designer Curtis to design vote-rigging software.

Curtis just got off the phone with BRAD BLOG'S Brad Friedman, broadcasting live in the Election Meltdown-apalooza. Curtis says he "apparently lost 57-43%" based on MSNBC results with 90% of the vote in --- but notes that there were "oddities" --- for example in some districts there were more Republican votes than there are registered Republicans. Of course, some Dems or independents could have voted for Feeney, but statistically, that is highly unlikely.

Curtis says "We have a lot of feet we'll be putting on the ground," and he will now do a "forensic reconstruction" to find out "if the actual election is supported by actual voters." Imagine that!

Note that there are STILL no numbers being reported from Seminole County per the FL Sec. State website (as of 12:06 PM EST).

In short, Curtis is not conceding. We say BRAVO! If he lost fair and square, that's fine, we will all accept that. It's the "fair and square" part we are just a bit uncertain of. Who was it who once said "Trust Yet Verify"? Why, it was Ronald Reagan. Wise man occasionally, it turns out. Stay tuned for more news from FL-24. It's likely this story may continue for awhile. And that, friends, is a good thing.

In a cover story interview in the Crawford, Texas Lone Star Iconoclast, Clint Curtis has a few no holds barred thoughts on his race in Florida's 24th Congressional district, on his opponent, the corrupt Rep. Tom Feeney (R-Abramoff), and on his plans to fight back at the retaliation Feeney has levelled against him for blowing the whistle on Feeney's vote-rigging attempts and other alleged malfeasance...

[S]ince I did testify before Congress, and I did contact several of the agencies like the FBI — in retaliating against me rather than just a straight standard campaign, there is a section of [Sarbanes-Oxley] which says that it is a criminal offense to retaliate against a whistleblower who has provided information on a federal crime — espionage.

He has broken that law, so we are actually going to file that with the U.S. Attorney’s office, and hold him accountable for that, too. It might actually get more investigations going, and it’s his turn to start explaining things.

The endorsement from Esquire magazine is short and sweet, and is now added to the list --- along with the Daytona Beach News-Journal's endorsement of publications supporting Clint Curtis over the corrupt Rep. Tom Feeney (R-Abramoff) in Florida's 24th U.S. House Congressional District:

So much for Feeney's discredited attempts to sell the idea that Curtis is "not fit for Congress." Looks like the nation's newspapers and magazines seem to think it's Feeney who's not fit for the post.

And the voters, in yesterday's Zogby poll showing Curtis and Feeney in a "virtual toss-up," would seem to agree. Notable numbers, if only because Curtis has had almost zero money to use in his campaign while Feeney has had more than $1 million.

Once thought to have been a "safe" Republican U.S. House seat in Florida's 24th Congressional district the race to defeat the once-powerful incumbent Rep. Tom Feeney now appears to be up for grabs, according to a new Zogby International poll.

Computer programmer turned vote-rigging whistleblower turned Democratic Congressional candidate Clint Curtis is now in a virtual dead heat with Feeney, despite the sitting Congressman's enormous campaign treasury funded by top-tier GOP funders and corporate PAC money.

Curtis' campaign has, to date, been funded only by individuals across the nation via the Internet. Neither the DNC nor the Democratic Campaign Congressional Committee (DCCC) has contributed funding to Curtis's race, which now appears set to possibly unseat the once powerful Republican House Deputy Whip.

The inequity in funding may all now (hopefully) change as Feeney is seen as leading Curtis by only 2 points in the new poll commissioned by Election Integrity organization VelvetRevolution.us.

The Zogby poll showing the dead heat also reveals that Curtis is leading among likely voters who describe themselves as independent by a full 11 points!

According to the report from Zogby International of 402 likely voters in Florida's 24th district when asked "If the election for Congress were held today and the candidates were Democrat Clint Curtis and Republican Tom Feeney, for whom would you vote?" respondents replied as follows:

Feeney - 45%
Curtis - 43
Other - 2
Not sure - 10

The race for the U.S. House of Representatives in Florida’s 24th District is a virtual toss-up. Incumbent Tom Feeney holds the slimmest of leads over challenger Clint Curtis, 45% to 43%, with one in ten (10%) undecided.

Each candidate leads big among his own party's members, but Curtis leads among independents, 48% to 37%.

The two point difference between Curtis and Feeney is well within the poll's +/- 5% margin of error. As we're currently on the road, and scrambling with a number of breaking stories even while barrelling down the highway towards home, we hope to have more details on the poll after we get the opportunity to review the internals, which look very good indeed for the challenger Curtis.

Feeney (R-Abramoff), the one-time gubernatorial running mate of Jeb Bush and close friend of the Bush family, carved out what was believed to have been an extremely "conservative" 24th Congressional district for himself while Speaker of the Florida House. Ascending to the U.S. House in 2002, Feeney was not even challenged for the seat in 2004, as he was thought to be unbeatable. Many Florida papers have continued to knee-jerk report on the race in those terms despite the lack of any known polling for the contest between Feeney and Curtis until now.

Curtis is the computer programmer and political novice who has alleged (as we originally broke back in December of 2004), that he was asked by Feeney to create electronic vote-rigging software back in 2000 when both men worked together for the Oviedo, Florida, software firm, Yang Enterprises, Inc. (YEI). At the time, Feeney was YEI's general counsel and registered lobbyist even while he was Speaker of the Florida House and even while they had multi-million dollar contracts with the state. Feeney has since been named one of the "Most Corrupt Members of Congress" two years in a row by the D.C. ethics watchdog group Citizens for Responsibility and Ethics in Washington (CREW).

He remains the only sitting U.S. Congressman who went with Jack Abramoff on one of the lobbyist-paid golf trips to St. Andrews, Scotland, who has yet to be indicted.

Feeney has mounted a costly smear campaign attempting to label Curtis as "crazy" and unfit for office in light of the charges. Yet Feeney's campaign, which has included a number of documented lies, unevidenced claims and attacks, and even a controversial mailing which offended voters when it included doctored photos of Curtis and a Hustler magazine cover --- seems to have backfired.

The Daytona Beach News-Journal, which reported on a number of Feeney's ethical lapses over the years, recently endorsed Curtis over Feeney, criticizing the sitting Congressman for "not really talking issues in this campaign" and "choosing to focus largely on denigrating his opponent." Curtis, meanwhile, the paper says, "is an independent thinker" who has "prepared well" for office.

Curtis, once a Republican until his dealings with Feeney soured him on the party, made his allegations concerning Feeney and YEI long ago via sworn affidavit, video-taped testimony to a Congressional panel, and a polygraph test, which he has called on Feeney to take. Feeney has denied Curtis's allegations, many of which have since been documented via state and federal reports as accurate, but has refused to either take a similar polygraph test, or even meet face to face with Curtis.

His story has also been highlighted in a number of documentaries. We recently posted documentary video footage from the film Eternal Vigilance, which tells the basics of Curtis's story through interviews with the whistleblower.

It was one thing when Daytona Beach News Journal endorsed computer programmer turned vote-rigging whistleblower turned congressional candidate Clint Curtis over his Democratic primary opponent (whom Curtis thumped in that race).

It's quite another thing --- a coup, in fact --- that now the News Journal has endorsed Curtis over the powerful sitting U.S. Congressman and former Florida Speaker of the House, the corrupt Tom Feeney (R-Abramoff), in their race for the U.S. House seat in Florida's 24th district.

Feeney, of course, is Jeb Bush's former gubernatorial running mate, the man who promised to deliver Florida's electoral vote to George W. during the 2000 fiasco no matter what the Supremes had to say, the only so-far unindicted Congressman to have gone with Jack Abramoff on a paid golf trip to St. Andrews, Scotland, and the man whom Curtis accused --- via affidavit, video-taped Congressional testimony, and lie-detector test --- of commissioning a vote-rigging software prototype in 2000.

Shamefully, Feeney has done little more than mount a disgraceful smear campaign against Curtis, attempting to paint him as "crazy" and not fit for office. The campaign seems only to have highlighted Feeney's own lack of seriousness as a legislator; one fit more for prison than the U.S. House of Representatives.

The News Journal's complete endorsement of Clint Curtis seems to bear that out, to Feeney's eternal disgrace. Here's a few snippets...

Clint Curtis, a former Republican who switched parties to challenge U.S. Rep. Tom Feeney, R-Oviedo, offers voters in the 24th congressional district a real --- and better --- choice.

An enormous number of superb documentary films that cover the topic of our American electoral meltdown are being released. Last week, I quickly ran a preview item on HBO's Hacking Democracy --- premiering Nov. 2nd on HBO --- which gives a first-hand account of the detective story as it has unravelled over the last three years concerning the many lies of the Diebold corporation. I've now seen the final cut and will have more details on that extraordinary film soon.

In the meantime, I was thrilled recently to get a look at David Earnhardt's breathtaking Eternal Vigilance: The Fight to Save Our Election System documentary, which tells the story of America's crumbling democracy and a few of the citizen patriots across the country who are attempting to save it.

Along with a focus on some of those folks, the film's emphasis is on the impossibilities which seem to have occurred in the tainted 2004 Presidential Election and the likes of which we may look forward to in the weeks and years ahead.

Earnhardt's film draws a great deal from a series of speeches and interviews filmed in April of 2005 during a National Election Reform Conference in Nashville, Tennessee.

I participated as a speaker at several events during that conference, as did computer programmer, whistleblower, and former lifelong Republican Clint Curtis who had, at the time, yet to even dream of running against a very close friend of the Bush clan, the corrupt U.S. House Rep. Tom Feeney (R-Abramoff) --- the very man Curtis has alleged asked him to create a vote-rigging software prototype when they both worked for the same Oviedo, Florida, software firm in 2000.

Curtis left the Republican party after being soured on them vis-a-vis his direct experiences with Feeney.

Earnhardt was kind enough to share with The BRAD BLOG the section of the film which introduces the basics of Curtis' vote-rigging claims about Feeney. It's a beautifully done segment --- and not just because it includes interviews with me as well, but it doesn't hurt! --- which should go a long way towards allowing folks to decide whether Curtis is "crazy" as Feeney's reprehensible smear campaign and website against him is hoping to trick voters into believing now that they've become Congressional opponents.

Hapless, Corrupt Congressman's Sad Attempt at Discrediting Whistleblower Curtis Continues to Backfire...

Poor, poor, corrupt, ethically-challenged, morally bankrupt Tom Feeney (R-Abramoff). Can't even run a smear campaign without getting into trouble, screwing it up and seeing it backfire.

As we reported several weeks ago, the feckless Florida Republican launched a "Crazy Clint Curtis" smear website and blogsite, to attack his whistleblower-turned-congressional opponent with doctored photos and doctored facts.

The Tom Feeney for Congress Campaign's shameful tactics continue to fizzle, apparently, as they have been forced to remove their smear blogsite, which had been set up on blogger.com to attack Curtis. The removal of the site, and the link to it from the main smear-site, comes not a moment too soon: we had planned to run an item on Feeney's latest demonstrable lie, which we had noticed was recently posted on the smear blog. The blog, which had been at CrazyClintCurtisBlog.blogspot.com is now redirected to an innocuous search page, with no trace left behind.

In a blog item Feeney posted on the site --- before he "disappeared" it --- he charged that an article published in Hustler about the mysterious 2003 death of Raymond Lemme "was based on the delusions of Clint Curtis's murder conspiracy theory," or some such nonsense.

As it was "we," Brad Friedman, who actually wrote the article in question [PDF], we can tell you that it was based on nothing of the sort. It was based on the mysterious and still unexplained circumstances surrounding Lemme's death, which the Valdosta, GA police had initially ruled a suicide, but then later reopened the investigation after The BRAD BLOG reported on an affidavit filed by Curtis. Curtis alleged that his former employer YEI had harbored Chinese illegal aliens spying for China (later confirmed), overbilled on state contracts (later confirmed), and that Feeney, who also worked for the firm as lobbyist and attorney --- while simultaneously serving as Speaker of the Florida House --- had requested Curtis to create a software vote-rigging prototype (not yet confirmed, but similarly not disproven.)

Lemme was an investigator from the Florida Inspector General's office, looking into the charges Curtis originally filed with the state of Florida in early 2001. In his sworn affidavit, Curtis says that Lemme told him in June of 2003 that his final report was almost complete, and that he'd found the corruption "went all the way to the top." Two weeks later, Lemme was found dead in Valdosta, Georgia.

Our story on Lemme's death detailed the many contradictions between the official police report and the unearthed photographs of the death scene --- photographs which the police report originally stated were taken at the scene but unavailable, due to a "failure in the camera's flash memory cards."

And now, Feeney has scrubbed the smear blogsite altogether, in what appears to be the latest misstep in the Congressman's bizarre and shameful campaign.

Previous follies in Feeney's smear campaign include (but are not limited to):

  • Using hit song "Crazy", by Gnarls Barkley, without permission on the smear website. Feeney removed it after complaints from the record publisher.
  • Linking to a "How to Make a Tinfoil Hat" website. This prompted the owner to redirect his page --- when clicked from Feeney's smearsite --- to an ethics watchdog webpage detailing Feeney's lobbyist- and foreign agent-funded vacations in violation of Congressional ethics rules. (Feeney is the only, as-yet-unindicted Congressman remaining in the House to have traveled with disgraced lobbyist Jack Abramoff to a posh golf resort in Scotland.) Feeney removed the link a day or two later.
  • Failing to include "Paid for by Tom Feeney" on the smear blogsite. He recently added the disclaimer after a complaint was filed with authorities.
  • Creating a wacky 9/11 Conspiracy Theory concerning Curtis. Disproven by the very evidence Feeney used to make it.
  • A smear campaign mailing featuring doctored photos of Curtis and a Hustler magazine cover, sent by Feeney to more than 100,000 voters. A local mom was angered at having to explain the "smut" campaign literature to her 9 year old son, who picked up the mail. Local news stations covered the misstep.
  • All of this from a man who issued a news release in the early morning hours after Curtis's landslide victory in the Florida primary. Quoth Feeney: "Serious times demand serious leaders and Curtis is not even in the same solar system as the rest of us."

    Really? Which solar system are you in, Mr. Feeney? We're still waiting for your "serious" leadership, or at least a serious campaign on both the issues and allegations.

    For his part, Curtis recently issued a press release calling on Feeney to explain what he knew of Florida colleague Mark Foley's sexual predator issues and when he knew about them. As a GOP Deputy Whip in the U.S. House, Feeney is a part of the Leadership who had been reportedly made aware of Foley's predilections long before the information was publicly revealed.

    So far, Feeney has refused to comment on the record, to our knowledge, concerning the Foley matter.

    He has also refused to take a polygraph test concerning Curtis's allegations and has denied, but not answered to, them. Curtis, who gave an account of the remarkable story in video-taped sworn testimony to a Congressional panel in late 2004, successfully passed such a polygraph on his own in early 2005.

    We'd add: 'And What --- if Anything --- Did he DO About It?!'

    The Clint Curtis campaign for the U.S. House (FL-24) issued a press release late last week asking "What Did Feeney Know About Colleague Mark Foley's Predatory Behavior And When Did He Know It?". (Press release posted in full at the end of this article.)

    It was not without reason that we asked the same question of Rep. Tom Feeney (R-Abramoff) last week at the end of a blog item on the latest misstep in the corrupt Congressman's crazy smear campaign he's running against Curtis. A smear campaign that, we might add, seems to be helping Curtis enormously!

    For evidence of that, see this local Florida news report (includes video) blasting Feeney for sending porn mailings to local moms, and this darn-near accurate feature article in Saturday's Orlando Sentinel calling on Feeney to take a lie-detector test!

    The question of what Feeney knew about Foley, when he knew about it and what he did about it is an appropriate one. Feeney, as Deputy Whip, is a member of the House GOP leadership who had reportedly been informed long ago of the "Foley Problem." Feeney is also a Florida caucus colleague of the now-disgraced child predator and proudly worked with Foley on bills such as the PROTECT Act of 2003 to punish those who would exploit children.

    For background, as briefly as we can give it (regular BRAD BLOG readers may skip this graf) Curtis is running to unseat Feeney this year. Curtis alleged in December of 2004 that Feeney had asked him to create a vote-rigging software prototype to be used for flipping the votes in South Florida when both men worked at Yang Enterprises, Inc. (YEI), an Oviedo, FL, software firm. Curtis was a programmer, and Feeney was their general counsel and registered lobbyist (in addition to his day job as Speaker of the Florida House). As early as 2001, Curtis also alleged that YEI --- where Feeney maintains his campaign headquarters even today --- was harboring communist Chinese spies and overbilling state agencies by hundreds of thousands of dollars. Both of those claims have since been borne out (see this summary of the extraordinary Clint Curtis story); Curtis has also told his story in sworn video-taped testimony before a congressional panel and passed a polygraph test, which Feeney, for his part, still refuses to take.

    Despite Feeney's silly and shameless use of doctored photos and doctored facts on his campaign's smear website and smear blog --- which has only just now been updated to disclose that its "Paid for by Tom Feeney" after an FEC complaint was filed --- and despite Feeney's various misfired attempts to tar Curtis with ridiculous and self-disproving claims, we'll avoid such cheap and childish shots at the Congressman. At least for the time being.

    We will, however, suggest that Mr. Feeney --- who has been mighty quiet about the Foley scandal since it broke --- may want to go on record, sooner rather than later, about exactly what he knew and what he did, or didn't do, about the Foley issue over the past several years.

    While we're at it, was Feeney one of those dozens of folks in Congress who recently received subpeonas on this matter? I'm sure he'll have no trouble telling us whether that answer is either yes or no.

    As we all know, it's not the crime, but the cover-up that gets 'em every time. We're waiting Mr. Feeney. You may wish to make your move before someone else does it for you. Just trying to be helpful here.
