Multi-State legal challenges expose illegality, but it may be too late to fully repair damage even if Trump's Postmaster General is ordered to do so...

Even if several multi-state legal challenges result in a federal court order directing Postmaster General Louis DeJoy to repair the damage wrought by his allegedly "illegal" sabotage of the U.S. Postal Service's mail delivery capabilities, absent significant additional funds, it's unlikely DeJoy could fully comply with that order.

The facts laid out in one of the recently filed cases and echoed in the others, along with subsequent developments, suggest that DeJoy was, at best, disingenuous when, in an August 18 formal statement [PDF], he claimed he was "suspending" his nationwide mail sorting, labeling and delivery changes until after the Nov. 3 Presidential Election.

The complaint describes how, pursuant to an Equipment Reduction Plan [PDF], Defendants removed, dismantled and/or destroyed 671 high-speed sorting and labeling machines that had a combined hundreds of millions of dollars in value. As a result, the States allege, "some major cities have already had their ability to sort mail reduced by hundreds of thousands of pieces of mail per hour." (Emphasis in original text).

On the same day that DeJoy issued his "suspension" statement, emails were submitted by Kevin Couch, the USPS Director of Maintenance Operations, informing Maintenance Managers that, irrespective of instructions from their plant managers, they must not reconnect or reinstall sorting machines that had previously been disconnected absent approval from USPS HQ.

Last Friday, while testifying before the U.S. Senate, DeJoy made it clear that he has "has no intention" of reinstalling the sorting machines, even as he claimed that election related mail would receive top priority from the Postal Service. Contrary to DeJoy's rosy predictions, however, the USPS's own Service Performance memo reflects a significant drop in overall performance which precipitated a USPS warning to 46 states that their deadlines for Vote-by-Mail ballots "might impede the timely delivery of mail-in ballots, possibly disenfranchising millions of voters"

While there's ample reason for a court to order reinstallation, absent significant additional USPS funding, which Trump opposes, it is doubtful that DeJoy could fully undo the damage even if he were ordered to do so.

VOTERS BEWARE: Do not be lulled into a false sense of security by DeJoy's "suspension" of changes at the USPS until after Election Day, or by his unsupported assurance that USPS can timely process and deliver every ballot. The wiser course, as laid out in our previously related article, is to deposit your mail-in ballots in secure, state-supplied drop-boxes (where available) or at designated drop-off locations. Check your local jurisdictions to learn what options may be available where you live. In some jurisdictions, voters can deposit their mail-in ballots at the polls either during early voting or on Election Day. In some jurisdictions, voters can link to election official websites to track the processing of their own ballots as well...

How states, counties and YOU must help defend our 'last firewall'...

This will not be easy. It never is. But, this year, we are facing obstacles to voting that we have never seen before. Not only from the unprecedented COVID-19 crisis, which is already difficult enough, but from those who hope to exploit the pandemic along with their access to the levers of power to make voting --- by some --- as difficult as possible. It is now up to all of us to overcome those obstacles.

President Trump is, by no means, the first right-wing Republican to recognize that he can't win if voters turn out in large numbers.

"I don't want everybody to vote," Paul Weyrich, the GOP's notorious godfather of right-wing voter suppression infamously quipped during a 1980 address to a group of evangelical Christian ministers. "In fact, our leverage in the elections goes up as the voting populace goes down," he added, after denigrating those who seek "good government" through maximum, informed voter participation, as people who suffer from "goo goo syndrome".

(The soaring pandemic death toll and an unprecedented 32.9% annualized second quarterly plunge in the GDP, serve as testament to what happens when We the People allow those opposed to "good government" to be placed in charge of our political economy.)

Trump's repeated attempts to suppress voter turnout are by no means novel --- as amply demonstrated during our two-part coverage (here and here) of the 2011 U.S. Senate hearings concerning a spike in GOP-engineered, state voter suppression laws. During those hearings nearly a decade ago, civil rights litigator Judith Browne Dianis described that spike as "the largest legislative effort to roll back voting rights since the post-Reconstruction era."

What makes our current circumstance both novel and extraordinarily dangerous is that an authoritarian-wannabe Donald Trump is the first Republican President who has been positioned to weaponize a pandemic by forcing voters to choose between exercising their fundamental right to vote and the risk of contracting a deadly virus. Instead of simply relying upon state voter suppression laws, Trump has aspired to engage in wholesale suppression on a national scale. Operating through a major GOP/Trump donor-turned-Postmaster General Louis DeJoy, Trump seeks to actively sabotage the social distancing protection that Vote-by-Mail (VBM) affords by creating delays in U.S. Postal Service (USPS) deliveries.

Last Friday, during a must-listen-to segment of The BradCast, Mark Dimondstein, President of the American Postal Workers Union (APWU), confirmed that mail slow-downs were "happening across the country" at a time in which the USPS was already in "crisis mode" as a result of the dangers posed by COVID-19. In his view, the Post Office is now at the "epicenter" of the 2020 battle over "voting rights", noting that "without Vote-by-Mail people aren't going to be able to vote."

Thus, in addition to fending off "dubious" Republican legal challenges to mail-in voting expansion, democracy's defenders --- which, in this case, includes We the People --- must now double our own efforts to navigate Trump's sabotage of mail delivery. This, at a time when election officials in states that have not previously engaged in near-universal VBM must upgrade their electoral infrastructure in order to accommodate and tabulate an unprecedented volume of hand-marked paper VBM ballots.

But there are proactive steps that jurisdictions --- and, yes, you! --- can take to maximize the odds that your ballot is tallied this year...

Donald Trump is putting George Orwell to shame. A Republican U.S. Congressman is caught on tape committing election fraud. And our Green News Report may have finally jumped the shark --- or at least the news we report in it today has. All on today's BradCast. [Audio link to show is posted below.]

I've said many times on the show that Donald Trump and the Republicans can't simply lie this one away. Or vote it away. Or simply ignore it. The hard numbers of Americans dying --- at least 75,000 already --- can't merely be wished away, as Trump has successfully been able to do with so many of his crimes, misdemeanors, appalling failures as President and other scandals. But maybe I was wrong. Maybe they can actually pretend it all away. In fact, that is now what they are trying to do.

In Arizona, some two dozen experts at two top universities who had been compiling the state's most robust public modeling for COVID-19 were told by the head of the state's Department of Health Services to stop their work immediately, according to an email obtained by Phoenix' ABC affiliates and reported by the Arizona Republic on Wednesday. They will also no longer have access to special data sets the team had employed in their work. The order came as AZ's Republican Governor Doug Ducey was lifting coronavirus restrictions across the state, and after the experts from Arizona State University and the University of Arizona produced five different potential models for reopening the state, with only one scenario that did not show a dramatic increase in cases. That one allowed for businesses to reopen at the end of May. But Ducey wants them open now, so his Health Department has shut down the state's best information in favor of models they claim are coming from FEMA and the CDC --- moels that have no been released publicly.

Back in D.C., the President of the United States is now reportedly questioning the coronavirus death toll numbers, believing them to be lower than reported, according to AXIOS, when, in fact, it is almost universally agreed among experts that the most widely reported numbers from Johns Hopkins University are likely vastly lower than the actual death toll, since most states have only reported those who have died after testing positive for COVID. Tens of thousands of more Americans have died over the past several months almost certainly from the virus, but they are not currently included in those figures. Nonetheless, Trump and other senior aides are now planning to publicly question the death toll as being falsely inflated, while the tragic numbers continue to blow away Trump's repeated lies since January about expected U.S. deaths from the pandemic. Yes, he's preparing to simply pretend it all away, as he did with the death toll for Hurricane Maria in Puerto Rico and as Republicans have done for years regarding the science of climate change.

At the same time, as AP revealed today, the Administration is also preventing the release of a 17-page CDC guidance report meant to help local churches, restaurants, schools, summer camps, transit systems and other business reopen safely, with one CDC source telling AP they were told the guidance "would never see the light of day." After the publication of the report by the AP documenting the Administration's attempt to bury it, the New York Times reports the White House "rejected the recommendations over concerns that they were overly prescriptive, infringed on religious rights and risked further damaging an economy that Mr. Trump was banking on to recover quickly." In other words, Trump believes he can revive the economy quickly to improve his re-election chances, no matter how many Americans are unnecessarily killed in service to that cause.

And, speaking of elections, the Denver Post published a remarkable story on Wednesday night, along with an audio recording revealing Colorado U.S. Congressman and state Republican Party Chair Ken Buck ordering another GOP party official to falsify election results on an affidavit in order to place a Republican candidate for state Senate on Colorado's upcoming primary ballot.

The Republican official, Eli Bremer, GOP chair of state Senate District 10, is heard on the call refusing to do so without consulting with an attorney first. He asserts that he was being asked by Buck to commit a crime in signing a false affidavit to certify that at a local candidate received the 30% support necessary to be placed on the ballot when, in fact, he received only 24% in a recent vote.

A state District Court judge ruled on Monday that Bremer would have, in fact, been in violation of state law had he signed the affidavit as ordered by Buck. The state Republican Party appealed the ruling to the Colorado Supreme Court which declined to hear the case, leaving the lower court's ruling in place. Buck, a Tea Party right-winger and former District Attorney, claims the initial vote was flawed. He has yet to resign his post as Colorado GOP Chair or U.S. Congressman. He should step down from both. Had any Democrat been caught on tape doing anything even close to what Buck is heard doing in the recording, they would already be gone. We'll hope the Colorado state Bar Association, at the very least, sees fit to take away Buck's license to practice law after being caught on tape repeatedly ordering someone else to violate it.

Finally, even with what may be our most ridiculously apocalyptic Green News Report ever today, we have to tack on one more sign of the end of the world, as a potentially historic snowstorm is now forecast to dump as much as one foot this weekend in parts of the Northeast and New England --- in MAY! That story seems an apt intro today for Desi Doyen and our latest Green News Report today, in which it all falls apart --- including terrible climate crisis news and, yes, Murder Hornets! --- suggesting that, in fact, we may finally have reached 'Peak GNR'.

On today's BradCast: The chaos continues...along with our efforts to try and bring common sense to the madness. [Audio link to today's show is posted below.]

Rates of COVID-19 infections are still getting worse, not better, in much of the country, particularly in rural areas and states not currently under statewide stay-at-home orders. At the same time, the President of the United States is citing those very areas as places that should be viewed as a model for ending stay-at-home restrictions as soon as the end of the month or earlier.

Georgia's Republican Gov. Brian Kemp, on Monday afternoon, announced plans to do exactly that, with theaters and restaurant set to be opened back up in the Peach State as soon as this coming Monday. According to medical experts, however, opening up the country without much more testing and contact tracing in place is a recipe for disaster, even as there appear to be no such plan in place, and testing remains vanishingly rare in much of the nation.

Meanwhile, the results of the first major antibody test in the nation on Friday, revealed that hundreds of thousands if not millions of more people may have actually contracted the virus without even realizing it. Nonetheless, Rightwingers, egged on by Fox "News" and Donald Trump and funded by the same Rightwing outfits that fomented the so-called "Tea Party" protests against Barack Obama years ago, have now been protesting against state closures in recent days around the country --- largely in states controlled by Democratic Governors. On Sunday, front-line healthworkers in Denver were forced to clash with protesters who told them, as the nurses stood up to the protesters cars in their masks and scrubs: "Go to China if you want communism!"

Amid all of this, we are somehow supposed to hold safe and inclusive elections this year, with more than 20 states set to hold primary elections in coming weeks (Ohio will hold its previously postponed primary next Tuesday) and all 50 set to hold the critical Presidential general election on November 3rd. Many Democrats and voting rights advocates are calling for Vote-by-Mail ballots to be sent to all registered voters without restrictions. Many Republicans around the country are going to extraordinary measures to make it harder, not easier, to vote during the pandemic.

In New Mexico last week, the state's Supreme Court rejected the proposal by all 27 County Election Directors and NM's Secretary of State to send absentee ballots to all registered voters. Republicans opposed the plan and the court split the difference by mandating that absentee ballot applications be sent to all registered voters instead.

SmartElections.us, a "non-partisan project dedicated to elevating the issue of election reform to an urgent national priority," recently released an open letter signed by more than 50 election integrity groups and voting rights advocates calling on restrictions to be included with any federal funding that may be offered to states to help them manage elections amid the pandemic. While some of the larger voting rights groups across the country are calling for as much as 4 or 5 billion dollars to be allocated by Congress to the states, Smart Elections' co-founder LULU FRIESDAT joins us today to remind us --- as does the group's letter to Congressional lawmakers --- about the disastrous consequences of the last time Congress appropriated nearly $4 billion for "upgrading" elections

That was the Help America Vote Act (HAVA) of 2002, which allowed private electronic voting system vendors to swoop in and essentially privatize our public elections with voting systems that were vulnerable to manipulation and prone to failure. The group's open letter produced by Friesdat and the other election experts, calls for specific restrictions to be placed on the use of any federal funding sent to states and counties to help them move to more accessible absentee ballot-based elections this year, including requirements that allow for voters to be notified and cure ballots rejected by officials (for any of various reasons) and to make the request for absentee ballots easier for voters. At the same time, it also calls for restrictions that prevent the process from being opened up to potential fraud. In other words, they are calling for sensible processes that allow more access for voters without procedures that allow for easy voter fraud or that hand over hundreds of millions to private companies to further bar public oversight of elections.

The letter is a common sense reaction to the chaos that is currently underway...even if common sense and measured responses are not normally what one expects from talk radio and cable news in the middle of highly-partisan election made even more chaotic due to a deadly global pandemic.

Finally, today, we open the phones to listeners --- many of whom in our Southern California listening area, have been following stay-at-home orders as long or longer than most in the rest of the country --- to see how they're doing, and if they agree that it's time to open the country back up for business....no matter how many Americans will end up being unnecessarily killed in the bargain...

On today's BradCast, we catch up with a grab bag of stuff, most of which doesn't have to do with Donald Trump's idiocy --- you're welcome --- but a lot of which has to do with what Americans need to do about him! [Audio link to full show is posted below.]

Among the many stories covered on today's program...

  • The front page of the New York Times now, officially, looks like a pre-2016 parody of what the Times might look like if Donald Trump were ever elected President;
  • Denmark still doesn't want to sell Greenland to the US. Why, after all, would its citizens want to give up "universal health care, free higher education, five weeks of annual paid vacation and 12 months of paid parental leave, subsidized childcare and more"? But the Premier of Greenland is, however, interested in buying the U.S.!;
  • Two-term WA state Governor Jay Inslee, the climate change candidate, drops out of the 2020 Presidential race, but accomplished quite a bit and will now run for a third term as WA Governor;
  • Former CO Governor John Hickenlooper, who dropped out of the Presidential contest a week or so ago, announces his run for U.S. Senate to take on vulnerable Republican Sen. Cory Gardner in an already very crowded field of Dems vying for the nomination. (But, ahem....hint, hint, O'Rourke, Castro and Bullock!);
  • And, on the Republican side of the aisle, "reformed" Tea Party Republican and former one-term House Rep. Joe Walsh appears set to announce plans to primary Trump from the right next year. If his recent, blistering NYTimes op-ed is any indication, in which he eviscerates Trump for, well, just about everything, he would be a welcome participant along with already-declared former MA Gov. Bill Weld and a few other potential GOP challengers that may be coming soon;
  • In more disturbing and much-less noticed news, 22 Texas towns have been simultaneously crippled by coordinated ransomware attacks that have shut down all computerized city services. The hackers are demanding some $2.5 million to restore services to the unidentified towns which may all have used the same private contractor for municipal IT services. The attack-via-contractor is reminiscent of the 2016 spearphishing attack on voter registration services vendor VR Systems as described in Robert Mueller's Special Counsel report. That attack appears to have resulted in penetration of voter registration databases in several Florida counties in 2016, and perhaps other states (such as North Carolina) serviced by the same private vendor.

    But, sadly, none of this has prevented states and counties around the country from moving swiftly to fully-computerized voting and tabulation systems, as well as computerized electronic pollbooks (all frequently serviced by a small group of private contractors) as we move toward the critical 2020 elections. If those any of those thousands of jurisdictions whose poling places now rely on such automated systems on Election Day --- often without paper backup for ballots or pollbooks --- were to be similarly crippled by a ransomware attack on or before Election Day, the result would be unimaginable chaos next year. But how likely is that, really? Why worry?;

  • Some voters in Georgia are, in fact, very worried, and justifiably so, about the state's newly certified, 100% unverifiable touchscreen voting systems now planned for first-time use in 2020. As we reported on the show a few days ago, those voters have invoked a little-known provision in GA's election code to demand a reexamination of the new systems which the state certified just weeks ago. The multipartisan voters charge Republican Sec. of State Brad Raffensberger violated state requirements in his initial certification, and failed to do any security testing at all. The Sec. of State's office now says the petitioners, who prefer state voters use verifiable hand-marked paper ballots systems, simply disagree with the "policy preferences" of the Georgia General Assembly and must pay the costs for the second examination themselves;
  • In similar-ish news here in Los Angeles County --- the nation's largest voting jurisdiction, which is also planning to move to new, 100% unverifiable computer touchscreen Ballot Marking Devices for the 2020 election --- the county's Registrar-Recorder/County Clerk Dean Logan is refusing to answer questions by voters on Twitter as to whether they will be allowed to vote on hand-marked paper ballots at the polling place this year. That has been a mandate by the CA Sec. of State for many years.

    Also, Logan has similarly failed to respond for several days to a generous offer by legendary Finnish cybsersecurity and voting systems expert Harri Hursti to examine the county's new, never-before-used-in-any-election BMD systems for security concerns. Hursti, the first to have hacked a Diebold voting system over a decade ago, runs the now-infamous annual Voting Village event at the DefCon hackers convention in Las Vegas --- where, year after year after year, enormous vulnerabilities are discovered in every voting system put before the attendees. Despite Hursti's offer, Logan has not responded to it via Twitter.

    Why has the previously communicative Logan gone so mum? He has been very outspoken on Twitter in the past, and still seems to have no problem citing L.A. Times stories about his new system there. (Perhaps because those stories shamefully fail to mention any of the many security and verifiability concerns about them, as cited by cybersecurity and voting systems experts.) Why is Logan, a long time, usually quite responsive and responsible election official no longer answering questions from his voters and media about such a huge sea-change in voting for some five million L.A. County voters?;

There was a little something for everyone, it seems, in Tuesday's primary elections in Vermont, Connecticut, Minnesota and Wisconsin. We cover as much of it as we can on today's BradCast, as voters in all but 10 states have now selected their candidates for the crucial 2018 midterms. [Audio link to show follows below.]

There were a lot of "firsts" and reasons for Democrats to be optimistic about November, based on the reported results today, and some of that optimism comes from races that Donald Trump believes he is happy about today, as his party moves farther and farther to the right to become the Party of Trump. It should also be noted that many of the Democratic winners on Tuesday were both progressive and political newcomers.

Among the many noteworthy contests on Tuesday covered on today's show, we now have the first transgender person to become a major party nominee for Governor (Christine Hallquist in VT); the first African-American woman to likely represent New England in the U.S. House (former teen mother turned "Teacher of the Year", Jahana Hayes in CT); the first Somali-American refugee who will likely become one of two of the first Muslim women to be elected to Congress (Ilhan Omar in MN); a stunning upset in Minnesota's Republican gubernatorial primary (front-runner and former two-term Gov. Tim Pawlenty was crushed by Trump-endorsed Jeff Johnson); and there were some encouraging Democratic wins in Wisconsin and victories over moderate GOPers by fully Trumped-up Republicans in several races.

We're joined today by native Wisconsinite and longtime progressive journalist JOHN NICHOLS of The Nation and of Madison, WI's Capitol Times for analysis and insight on all of the above, as WI's controversial, union-busting, two-term Republican Gov. Scott Walker faces his greatest political challenge this November against Tuesday's Democratic nominee, state school superintendent Tony Evers, and as the Democrats' face a tough fight to flip retiring House Speaker Paul Ryan's seat from "red" to "blue" with the Bernie Sanders-endorsed iron-worker and union organizer turned first time politician, Randy Bryce.

We cover a LOT of ground on today's show (including the late domestic abuse allegations against MN Rep. Keith Ellison, who easily won his Democratic primary in the state's Attorney General's race), so it's best I just let you listen rather than try to summarize Nichols' keen insights on Tuesday's races and more.

Guest: Journalist, documentarian Lulu Friesdat...

After a quick report on Saturday's primary elections in Hawaii (moderate Democrats did well, more progressive candidates less so), we head straight out to Las Vegas for today's BradCast, where the 26th annual hackers convention, DEF CON, held its 2nd annual Vote Hacking Village. [Audio link to show follows below.]

After every voting system on display at last year's event was hacked within minutes by conference attendees, organizers tried to make it a bit more difficult this year. They made unverifiable electronic voting systems, optical-scan paper ballot tabulators and electronic pollbooks from a number of companies --- almost all of which will be in wide use across the country once again for this November's crucial midterms --- available for investigation and penetration. Once again, the hackers in attendance made short order of pretty much all of them.

Stunning vulnerabilities [PDF] were discovered, including some that officials have known about (and ignored or tried to keep secret for years) while others were revealed for the first time. Things like Chinese pop song files were found on one system used in actual elections recently, along with a host of other disturbing findings, which we summarize today.

Other disturbing findings regard the ES&S m650, an optical scanner used to tabulate paper absentee ballots in more than half of the country. Hackers discovered several severe vulnerabilities (some of which have been known for more than a decade, and others which election officials hoped to withhold from the public), including the ease with which the machine's entire operating system can be overwritten by inserting a zipdrive with a file named "update" before powering it on. Also, electronic pollbooks were found to be corruptible in seconds and found to store unencrypted administrative passwords --- in plain text format! --- on their removable memory cards (one of which was simply "password".)

There was also a mock election run on the systems still used in states like Georgia. In that election, a candidate not even on the ballot ending up winning. In another case which officials should take note of, a ballot cast via email was intercepted and changed. "The selection of the candidate was changed so that when it was received it was different from what was sent," the organizers note. "This is a big deal for the real world because we already allow for email balloting, in special cases for Americans living overseas [such as active military]. This is allowed in 30 states plus DC."

Moreover, the Voting Village organizers also offered replicas of swing-state Sec. of State website available to some 50 children from ages 6 to 17. You'll be shocked to learn that most were able to hack the mock SoS websites in some fashion, including changing candidates names and parties, and tampering with reported elections results to show, for example, 12 billion votes cast. The fastest exploit of a Sec. of State replica site (Florida's) was by an 11-year old who did it in 10 minutes!

We're joined today to discuss all of this by Emmy-award winning journalist and documentarian LULU FRIESDAT whose video from last year's DEF CON Voting Village went viral (several times) since then, and who was on hand to document this past weekend's conference once again. She details the extraordinary "sea change" since last year's event, as many elections officials and U.S. Intelligence Community representatives were on hand for this year's festivities.

"What's really great about this year's Def Con is that we are starting to see a collaboration and communication between three groups that really have been working more as silos previously, and that is election officials, security experts, and hackers," Friesdat reports. "It was very deliberate on the part of the organizers, Jake Braun, Harri Hursti and Matt Blaze, to really try to bring those three groups together... Because we're not going to make progress on this issue unless these three groups start communicating with each other."

"We don't have a one-size-fits-all solution for this. Every county is going to have to have some different solutions. What we have are principles. And I think the principles remain the same. The principles are yes, every voter who can mark a ballot by hand, needs to mark a ballot by hand. And security experts across the board are really starting to say that, openly publicly."

"There is a sea change happening. You really could feel it. This year, there was an entire panel of election officials, whereas last year almost none of them actually came," Friesdat tells me, adding cautiously: "There are thousands of election officials all over the country who are still dragging their feet. You look at states like Georgia, and they are doing everything they can to stay in basically an unauthenticated election protocol. So it is a wide spectrum."

Among the noteworthy accounts from Friesdat, we discuss California Sec. of State Alex Padilla's call for more federal funding for election systems (meaning, more money for more computers) and Colorado Elections Manager Dwight Shellman who, though a fan of electronic tabulation, calls for routine post-election audits everywhere (which almost no states do at all.)

We also discuss the remarks at the conference by DHS Asst. Secretary for Cybersecurity and Communications Jeanette Manfra, who admitted last summer during U.S. Senate Hearings that the agency never found evidence that votes were changed in the 2016 Presidential election, in no small part, because nobody ever bothered to look! DHS never carried out any forensic investigations of voting systems, nor even bothered to count ballots to make sure they were accurately tabulated by counting computers in the election, despite the ongoing warnings by the Intelligence Community of Russian cyberattacks and interference. "Could it be done?," Friesdat asks rhetorically, "The answer, over and over and over again, is yes, it could be done. Election results could be manipulated. And is it difficult? No. It is a piece of cake."

While this year's DEF CON Voting Village was another huge leap forward in bringing concerns about all of these systems to the public, it appears we have a long way to go until American figures out the solution. I'd suggest that solution is public oversight of tabulation of hand-marked paper ballots (Not computers, but people! I call it "Democracy's Gold Standard".) But, hey, computers --- all of which are obviously wildly hackable --- could work too, right?

Or, The 'Conservative' Con Continues as the World Burns...

It's remarkable that Democrats --- and the mainstream corporate media --- have allowed Republicans to get away with claiming to be "conservatives" who support states rights, small government and local control for so many years. As it turns out, the exact opposite is usually true. That becomes abundantly clear whenever and wherever the GOP takes the reins of government power. We've got several examples of that, once again, on today's BradCast. [Audio link to show is posted below.]

As global climate change continues to shatter heat records across the country and planet, the death toll continues to rise along with temperatures and more intense, unexpected (if long-predicted) extreme weather. On Tuesday, at least 74 were killed in sudden wildfires in Greece. That toll, which is expected to rise, comes on the heels of hundreds killed by recent record rain, flooding and accompanying landslides in Japan, and at least 77 dead amid all-time record heat there over the past week alone.

Heat records are being shattered every day of late here in the U.S. as well, including in Phoenix where it topped out at a record 115 degrees on Monday, and where airplanes were grounded for several days last summer thanks to record warmth. This year, however, with the help of Trump's FAA, American Airlines has come up with a way to avoid being grounded despite new record temps. They've just raised the maximum temps under which their planes are allowed to take off! What could go wrong?

At the same time, the Trump Administration is now challenging the state of California's right to set their own fuel efficiency standards for cars, despite an agreement with the Obama Administration that had, with the approval of automakers, established a uniform nationwide standard. The state's right to set its own environmental standards at all --- as established over nearly 50 years under the federal Clean Air Act --- will now, reportedly, be revoked by Trump's EPA who, apparently, have no use for states rights (at least when that's inconvenient to GOP corporate funders.) Let the law suits begin continue.

Similarly, so-called "conservatives" in Texas are attempting to use Big Government state law to preempt efforts by local governments and voters in Austin, San Antonio and Dallas, who hope to establish their own rules for paid sick-leave. Some 40% of Texas workers, according to a recent study, are currently prevented from taking a paid day off when either they or their children get sick. The state's Big Government-loving Governor Greg Abbott and Attorney General Ken Paxton (facing his own securities fraud indictments) oppose the city measures, just as they have in the past when voters in local jurisdictions have attempted to ban fracking, raise minimum wage requirements or even ban plastic bags.

There is, however, a solution. We can all try --- try, at least --- to vote the liars and hypocrites out of office this November. In Nevada, for example, voters are now said to be on the verge of potentially electing the first female majority state legislature in our nation's history. To pull it off, however, and to flip local, state and Congressional seats from "red" to "blue" this year, voters will have to turn out and actually be allowed to cast a vote.

A new study from the Brennan Center for Justice suggests that may be more difficult than many currently appreciate. Their analysis finds that voters are being purged from the rolls at a record pace, particularly in jurisdictions with a history of racial discrimination, where such procedures previously required federal preclearance under the Voting Rights Act (until the GOP majority on the U.S. Supreme Court gutted the landmark 1965 law in 2013.)

So, with just over 100 days remaining until this year's crucial midterm elections, please CHECK YOUR VOTER REGISTRATION to make sure you are still properly registered! Don't wait until its too late!

But, we close today with at least a bit of encouraging news. Despite the stolen GOP majority on the U.S. Supreme Court recently blocking lower federal court rulings finding U.S. House and state legislative seats had been unlawfully gerrymandered by partisans in several states, a number of statewide measures to end partisan gerrymandering will most likely be on the ballot this November. Unless, that is, so-called "conservative" Republicans block the so-far wildly successful, bi-partisan grassroots initiatives in states like Michigan, Missouri, Colorado and Utah...
