Voter turnout was light in many parts of the country yesterday. Ironically enough, that's the good news.

Alternet ran a preview of voter suppression issues of concern in yesterday's elections across the country. Sure enough, the author, Steve Rosenfeld, wrote in during the early evening to let us know there were problems concerning Photo ID issues popping up in pockets around the country, and that he'd have more soon. Our own Alan Breslauer touched base as well with several reports he'd been getting from around the country.

John Gideon's "Daily Voting News" yesterday pointed to some of those issues that had been reported in the media as of yesterday afternoon around the country. GOP voter suppression, through specious claims of Democratic "voter fraud" and the invented "need," therefore, for disenfranchising photo ID laws and challenges at the polls, is at the top of the Republican strategy for '08. Naturally, it was taken out for a test spin yesterday.

(Speaking of spin, don't miss wingnut Mychal Massie's despicable retread diatribe --- including the mandatory quotes from GOP "voter fraud" fraudster, John Fund, who wrote the book on it, literally --- in the wingnut WorldNetDaily. His tragically misguided piece, headlined "Vote fraud: Democrats' meal ticket" gives you just about all you need to know. Read it once, save yourself a thousand or so near-identical reads between now and November 2008. But we digress...)

The other major prong of voter disenfranchisment is, of course, the machine issue. Problems in that area, in particular, tend to reveal themselves in the days after elections. Early on election day such problems are frequently downplayed in the media, who tend to turn to Election Officials for information despite the inherent conflict of interest such officials have in hoping to portray their elections as "successful."

In the early hours, then, hints of such breakdowns are reported as little more than computer "glitches" "hiccups" "snafus" and "snags" (though "kinks" makes it debut today, see below) until later on, when the true extent of the voting system failures --- and that's what they are, not "kinks" --- become known.

With that in mind, here are just a few of those e-voting glitches, hiccups, snafus, snags, and yes, kinks, from around the country so far yesterday, as culled from Gideon's DVN last night...

Letter from Sec. of State, Obtained by The BRAD BLOG, Says America's Largest E-Voting Vendor Failed - Yet Again - To Deliver Required Materials to State Testing Board
Company Previously Decertified After Lawsuit Found Little or No Testing Performed by State in 2006...

Once again, the country's largest voting machine vendor, Election Systems & Software, Inc. (ES&S), has failed in yet another state certification process, The BRAD BLOG has learned.

In a letter faxed to the company yesterday, Colorado's Secretary of State Mike Coffman informed the Omaha, Nebraska, company that the state has suspended the certification process of ES&S's voting systems due to a failure to provide required documentation and other materials needed to complete testing. That, after several previous deadline extensions had been granted.

"[T]here is a history of coordination issues with your company," Coffman wrote to ES&S's Vice President of Certification, Steve Pearson, in the two-page letter, before detailing a litany of problems they've had with the company throughout the testing period.

"Those issues include the following: changing project managers multiple times since April, providing incorrect programming of required databases for testing, providing incorrect ballots for testing, failing to provide required documentation of Federal testing, and test failures requiring extensive machine servicing," wrote Coffman.

The testing of Colorado's systems comes after all of the state's voting systems were decertified by a state judge just prior to last year's November election. In the 2006 lawsuit, brought by legal e-voting watchdog VoterAction.org on behalf of several Colorado voters, the judge found that the state's certification process amounted to little more than opening the box, checking for manuals, turning the system on and off and stamping it as good-to-go.

As the finding in the lawsuit came just prior to the November general election, the state's e-voting systems were allowed for use one more time before all such systems were automatically decertified, to allow the testing process to begin again afterwards --- legitimately this time.

Since then, all of the companies whose systems are being tested in the state have delayed in turning over needed materials, prompting speculation from e-voting critics that, with elections pending, they may be purposely delaying the process in hopes of running out the clock.

But similar failures by ES&S to cooperate with state officials around the country have now become legion.

The latest mess in Colorado echoes closely similar problems with the company as seen in other states over the last year. Just a brief sampling of some of those extraordinary failures include...

We've emerged safely from the woods after three glorious days off the grid up at 10,200 feet. No net. No cell. No bears. No mountain lions. Though we did have a few close encounters with a bald eagle and some moose (even if we avoided being trampled by the two who stampeded through our campsite at dawn one morning.)

Starting slowly this morning and catching up on some of the bear stories you guys posted in the the Open Thread I left on my way out the door. Thanks for those. Was only able to read a few of them before we set out, but CharlieL's amusing story provided a good laugh or two around the campfire.

From the real mountains to the mountain of email that has come in while we were gone, it may take some time to get cranked back up to full speed. So for the moment, here's a look at what I've been looking at over the past few days...

More photos later, perhaps, unless I learn I'm needed elsewhere after discovering what's really going on out here.

Oh, and btw, you folks in San Diego were in our hearts and on our minds even in the wilds over the past few days!

Will Other Elections Officials Across Country Have Decency to Do Same?

In what ought to be the first of a wave of resignations by Elections Officials across the country who have utterly failed the very voters they are supposed to be serving, one of three commissioners of the Denver Board of Elections has resigned today in the wake of the city's e-voting meltdown last Tuesday. He has apparently shown a measure of grace and responsibility far too rare in most Elections Officials...

Denver Clerk and Recorder Wayne Vaden resigned today amid chaos in the Denver Election Commission which he oversees.

Citing his belief "that accountability is the underpinning of honorable public service," Vaden said he was resigning from a "personal disappointment over my efforts" with the commission.

The resignation came exactly one week after a disastrous election in which absentee and provisional ballots still haven't been counted. Computer glitches caused voters to wait in line up to three hours. Many complained they were unable to wait that long and thus were unable to vote.

[Denver Mayor John] Hickenlooper acknowledged Vaden's frustrations, adding that Vaden's acceptance of responsibility without blaming others "is a reflection of his strong character and commitment to Denver."

Vaden, as clerk, was one of three election commissioners overseeing the voting process for Denver's 350,000 registered voters. The two other commissioners, Sandy Adams and Susan Rogers, are elected.

Of course, apparently the Washington Post --- who editorialized on Sunday that "the system worked" --- doesn't read the Denver Post, so they don't know about Denver's "disastrous election." Or they simply don't care.

We've come to expect such failures from the country's national media, but the larger question now remains: will other failed Election Administrators have the decency to do what Mr. Vaden did?...

Legal Resources Being Gathered by National Party to Challenge Close Elections Where Dems Currently Trail
Other Candidates, Citing Concerns About Voting Machine Failures, Also Refusing to Concede Until All Votes Can Be Verified...

Just off the phone from a DNC insider --- very much in a position to know --- who says the following races are being considered, as of this afternoon, to still be very much in play by the DNC (* = Incumbent, Results shown latest reported by state websites as available):

NC-8: Larry Kissel (D) 60,016 / Robin Hayes (R)* 60,481
CT-2: Joe Courtney (D) 121,321 / Rob Simmons (R)* 121,151
FL-13: Christine Jennings (D) 118,739 / Vern Buchanan (R) 119,116
NM-1: Patricia A. Madrid (D) 103,376 / Heather Wilson (R)* 104,863
OH-15: Mary Jo Kilroy (D) 98,100 / Deborah Pryce (R)* 101,636
OH-2: Victoria Wulson (D) 112,952 / Jean Schmidt (R)* 115,817

The source believes that all of the above races, each of them currently very, very close, are winnable and the feeling is that they "could easily win three of those six."

In each --- except for CT-2, where Courtney is leading --- the Democratic candidate is currently trailing in the reported results as absentee, provisional, and paper ballots are still be canvassed. As well, challenges and recounts are underway in some of those races (we hope to have more detail shortly here on a couple of those races).

(UPDATE: Several readers have written to ask if other races beyond those mentioned above --- such as the U.S. House race in Washington state's 8th Congressional district between Democrat Darcy Burner and Republican Dave Reichert --- are now off the table as far as the DNC is concerned. The races reported above are the only ones named explicitly to us by the DNC sources. However, two different sources there have confirmed that they are largely driven by the folks on the ground in the states, and would urge that noise be made locally --- and loudly enough that higher-ups might hear it at the DNC --- in order to gain more attention from the national party to other such races still of concern.)

The source also adds that the DNC is considering whether or not to ask for contributions from the public to a legal fund to assure they will have the funds needed to provide full legal resources to thoroughly challenge each of those races.

As well, The BRAD BLOG has also learned the DNC is still keeping their eyes on the Colorado Secretary of State race between Ken Gordon (D) and Mike Coffman (R), given the problems revealed in Colorado's disasterous certification procedures for voting machines prior to the election, and their massive meltdowns on Election Day in Denver and elsewhere which caused thousands of voters to be turned away from the polls due to machine malfunction.

AP is reporting today that Coffman's lead is beginning to look insurmountable, though given the fact that Gordon's numbers in Denver alone outpace Coffman's by some 70 to 30 percent, the fact that Denver voters, specifically, were disenfranchised at such an alarming rate due to equipment failure on Election Day, certainly "exemplifies," as the source put it, the need for Election Reform across the country and the importance of Secretary of State races.

The six U.S. House races named above, of course, are just the federal races that the DNC considers "still in play," but there are innumerable local races and initiatives being challenged around the country, as another DNC source told The BRAD BLOG this morning. As well, there are a number of Congressional races where the candidates have, honorably, refused to concede until every vote is counted and accounted for.

Clint Curtis, the vote-rigging whistleblower who ran against Tom Feeney, the man he claims asked him to create vote-rigging software in 2000 (as The BRAD BLOG originally broke back in 2004 and whose story we've been following closely ever since) has issued a press release this morning saying that he will not concede in the race until every vote is accounted for.

"The right to vote and to have that vote counted accurately is the very foundation of our democracy, and I owe it to the voters in my district and the state of Florida to continue to push for accurate, honest elections," Curtis said in the news release. He points out that as a candidate, he "now has the legal standing to pursue an investigation into the anomalies," which he claims were reported during his race.

"I can accept that the citizens across the state of Florida were out of step with the rest of the country," added Curtis, "as long as we know that this election truly reflects their intent." The Florida Secretary of State's website currently shows Feeney leading Curtis 58 to 42 percent.

In California's 50th Congressional district, Francine Busby (D) has still refused to concede in her race against Brian Bilbray (R) in which she reportedly trails 54 to 43 percent. We applaud Busby's refusal to concede given the outrageously bad administration of the election across the entire San Diego County as overseen by Registrar Mikel Haas, one of the country's worst.

A Zogby poll taken on Election Day (and shortly thereafter) shows an unexplained 6 point disparity with the final results as we reported last week.

As reported earlier today, Haas's resignation was called for on Election Night by San Diego County Democratic Party Chair Jess Durfee after voters were disenfranchised across the county when Diebold touch-screen systems failed to work and not enough paper ballots were made available for voters. Many of those voters ended up voting on Spanish language paper ballots after English ballots had run out by 9am on Election Day; others simply gave up and went home or to work without being able to cast a vote at all.

We echo Durfee's call for Haas to step down immediately. San Diegans deserve honest and accurate elections in which the voters may have confidence in the reported results. Haas has, disgracefully, provided none of the above during his irresponsible tenure.

We originally reported that the Democratic candidate was trailing in the reported results in each of the six DNC-named races. In fact, Democratic candidate Joe Courtney in the CT-2 race is currently ahead in the results as reported so far. We've corrected the original misstatement in the article above. Further, AP is now reporting Courtney as the winner after a final canvassing of the ballots.

Democratic party leaders are planning to seek a two-hour extension for voting in Denver, due to massive computer problems which have created long lines, and kept many from casting their vote.

The problems began right at 7 a.m. as computer problems at the voter-check in stations bogged down, creating a bottleneck in the first hour of voting as a rush to the polls overloaded the system.
...
At Denver Botanic Gardens, more than 200 voters backed up in a line that stretched out of the gates and down the block more than half way to 11th Avenue.

"We will not get to vote today," said a frustrated Lauren Brockman as he left the Botanic Gardens.

He lined up at 6:45 a.m. hoping to beat the rush, only to stand in line for close to an hour before leaving.

But an hour wait was short, compared to some.

An absolute mess on the ground.

In Ohio, Cuyahoga County's attempts to change the way poll workers are trained in light of their Primary Election Day disaster seem clear, from the startling USA Today coverage, to be a disaster in the making in and of themselves. Read it, and be amazed at the unbelievably complex gyrations now required to address the 300+ recommendations made to the county after their Primary Day meltdown. It's amazing. "Election Cliffhanger: Will it all Work?"

In Maryland, the Republican governor warns of a "crisis in the wake of Diebold revelations."

In Colorado, Sequoia has fucked up the Absentee Ballots so that 30,000 of them must be re-copied by hand by pollworkers.

UPDATE: By John Gideon 4:15PM: Today the county announced that they had awoken from their day dream of duplicating 30,000 ballots. They have decided to do the smart thing and just set up another machine to count the incorrect ballots.

I'm on the road, and haven't been able to follow closely for the last 12 or 24, so there is much more out there that is not covered here (keep an eye on John Gideon's 'Daily Voting News' each day for all the frightening stuff and the utter mess that we simply can't cover in detail), but clearly the links above are just the tippy-top of the tip of the iceberg.

More VoterAction.org lawsuits and complaints are now being filed to stop the use and/or purchase of electronic voting systems around the country. On Wednesday, two more. One in California, another in Wisconsin.

In Alameda County, CA a suit was filed to stop of the use of Sequoia Voting Systems touch-screen DRE's, alleging the county "has not performed independent, expert security vulnerability testing on its new Sequoia voting equipment. The group claims such testing was a prerequisite stipulated by county supervisors before the county would issue payment for the system." ...

In Monday's "Democracy at Risk" segment Kitty discusses the ruling from the judge in Colorado (as broken originally by The BRAD BLOG last Friday) against the state's "abysmal" voting machine certification process. Of course, the Secretary of State is trying to make it a partisan political issue.

Says Dobbs in yesterday's report: "[M]any state governments across the country are finally awakening to the threat that electronic voting machines pose to our upcoming midterm elections --- and our democracy."

Says Pilgrim: "[A] judge found the secretary of state's office had violated the law, saying there were no minimum standards. It failed to meet its statutory requirements for testing. It failed to adopt rules and failed to adequately test the machines...In many cases, the state simply allowed the manufacturers to vouch for the safety of the machines."

Says the plaintiff's attorney in CO: "The deficiencies in the testing was an utter lack of competence, and an utter lack any scientific method, and utter lack of any recordkeeping."

Says the Secretary of State: "Colorado voters should not be concerned about the security of the November election...I ask voters to ignore the political rhetoric by a few seeking to destroy that confidence in the election."

Plaintiff Rep Says Machines to be Allowed in November, With New Security Measures, But Must Be Recertified From Scratch Thereafter
[UPDATED Now to include CNN's Initial Coverage, Official VoterAction.org Statement, Trial Testimony and Depositions from the case.]

I just received a phone call from Holly Jacobson of VoterAction.org, the group that has supported voter lawsuits attempting to decertify e-voting machines in Colorado, California, Arizona, Pennsylvania and elsewhere.

She called us from Colorado just after leaving the courtroom, where the case in that state against the use and purchase of e-voting systems made by Diebold, ES&S, Sequoia and Hart InterCivic was being heard yesterday. She called and said: "We won!"

That call came moments after I'd received a report that CNN's Lou Dobbs had reported an hour or so ago that they had lost the case...

Man Appointed by SoS to Certify Voting Machines for State Has No Computer Science College Education, Failed to Test Machines for Hackability or Much Else
Colorado Democratic Party Calls on Voters to Vote by Absentee Ballot, Citizens Group Calls for Investigation of SoS

It's incredible (or is it at this point?) but the lawsuit filed by several Colorado voters to ban touch-screen voting machines manufactured by Diebold, ES&S, Hart InterCivic and Sequoia in the state has revealed that the state's appointed "expert" --- responsible for certifying voting systems --- has no actual college training in computer science and failed to do any actual testing of the systems before certifying them!

As reported in an excellent article from Rocky Mountain News news this morning...

[Democratic candidate for Sec. of State, Sen. Ken] Gordon and the Democratic Party were alarmed by a deposition in the case released this week, in which the secretary of state's staffer in charge of testing the machines says he did only 15 minutes of security checks. The staffer, John Gardner Jr., also said he had no college training in computer science, causing Gordon and others to question whether he was qualified for the job. Gardner also had been information technology chief for the El Paso County clerk, which runs elections there.

The plaintiff's attorneys say Gardner's security checks on the four systems did not include attempts at hacking. Instead, Gardner merely checked whether the manufacturers included security documentation.

"Of course" Gardner should have tried hacking, [plaintiff attorney Paul] Hultin said. "Isn't that the idea of a test?"

The issue was also covered quickly in a Denver Post article last night:

...the Secretary of State's office certified a kind of voting machine for Jefferson and Mesa Counties that does not meet state requirements.

The information comes from the deposition of John Gardner - the man appointed by [Colorado Sec. of State] Gigi Dennis as an expert and charged with certifying the machines.

But Gardner testified he is not an expert in the areas required by state law. He also admitted that the Secretary of State's office was under pressure to certify the voting machines because counties had already purchased them.

Complaint Seeks to Stop Use of Electronic Voting Systems Made by Diebold, Sequoia, ES&S and Hart InterCivic
Broadest State Filing Against Voting Machines Yet Filed, Follows Similar Suits in California, Arizona, New Mexico

In a complaint said to be the broadest yet filed to halt the rise of the electronic voting machines, a non-partisan group of voters have announced they are filing suit today in Colorado to stop the purchase and use of Direct Recording Electronic ("DRE" or touch-screen) voting machines in the state, The BRAD BLOG can now reveal.

The suit, being filed today in Denver District Court and modeled after similar actions filed previously in California, Arizona and New Mexico, calls for an immediate halt to the use of touch-screen machines made by all four of the major electronic voting machine vendors currentlly doing business in Colorado.

The group, advised and organized by VoterAction.org contends that voting machines made by Diebold, Sequoia Voting Systems, Election Systems and Software Inc. (ES&S) and Hart InterCivic "have a well-documented history of problems with security, reliability, verifiability, and disability access."

According to a press release issued this morning (posted in full below) by the Denver law firm of Wheeler Trigg Kennedy LLP the machines "are easily hacked and compromised, and have a history of operational problems which have disrupted elections across the country."

Defendants named in the suit include Colorado Secretary of State Gigi Dennis and the Boards of county commissioners in 9 different CO counties.

"The Secretary of State's Office has failed to issue rules setting minimum standards for security of these systems. The election rules permit the DRE manufacturers to simply tell the State that their machines are secure," said Wheller Trigg Kennedy attorney Paul Hultin in the release. "Worse, the Secretary is not following the law. No certification reports required by law have been prepared even though these systems have been certified for months and counties are preparing to use these dubious systems in the upcoming election," he says.

"Some of the security risks with these machines are so high that it is unconscionable that their manufacturers, who have known of the problems for years, have not taken the necessary steps to correct them," says Univesity of Iowa computer science Professor Dr. Doug Jones, who is one of several experts who will be offering testimony in the case.

"The Help America Vote Act is being turned on its head, weakening the integrity of our elections in the rush to purchase untrustworthy DRE computerized voting systems," said Lowell Finley, Co-counsel for the Colorado voter plaintiffs, election law expert, and Co-director of Voter Action, according to the release. "The sanctity of our elections is too important to turn over to private corporations which operate without accountability. There are better and more secure options available, such as optical scan-paper balloting."
