And here I thought dealing with one President in a single hour on The BradCast was tough. Now we've got the previous one on trial after his second impeachment and a new one unveiling an ambitious new agenda to begin cleaning up the other guy's horrific mess, particularly on climate today...and not a moment too soon! First up today, the Department of Homeland Security issues a new warning about ongoing threats of violence by domestic, home-grown terrorists in the U.S., many of whom have been radicalized by Donald Trump's many lies about the 2020 election having been stolen.
Then, It's been only three weeks since Trump encouraged his MAGA Mob to march down Pennsylvania Avenue and "fight like hell" to prevent the formal counting of Electoral College votes by the U.S. Congress. The attempted insurrectionists violently broke into the U.S. Capitol, called for the hanging of the Vice President, succeeded in shutting down the tally for several hours and sent lawmakers fleeing for their lives into secured locations. Five people were killed, including a Capitol Police officer, in the ensuing violence. One week later, then President Trump was impeached by the U.S. House for a second time, this time for "Incitement of Insurrection", though the Senate's then Majority Leader Mitch McConnell refused to convene a trial. One week after that, Joe Biden was successfully sworn in as President. And today, just three weeks to the day since the Trump-incited mob's murderous attack on the Capitol, with Democrats now officially in the Senate majority, Trump's second Impeachment Trial has officially begun.
While the arguments in the trial will not be presented in full for another two weeks, Republican Senator and pretend Constitutionalist Rand Paul forced a vote on Tuesday, just after Senators were sworn in as "impartial jurors", to try and dismiss the entire matter by falsely claiming that an Impeachment trial after a President is out of office is "unconstitutional". (Though he repeatedly argued that "private citizens" cannot be impeached and that "If the accused is no longer President - where is the constitutional power to impeach him?")
Joining us today to answer to the clearly false and almost-certainly disingenuous argument proffered by Paul --- and, incredibly, supported by 45 of the Senate's 50 Republicans who voted in favor of his resolution on Tuesday -- is Constitutional law expert RON FEIN of the non-partisan government accountability group Free Speech for People. Fein, with John Bonifaz and Ben Clements, authored the 2018 book, The Constitution Demands It: The Case for the Impeachment of Donald Trump.
"The obvious flaw," in Paul's argument, Fein explains, is that Trump WAS impeached while he was President, and then McConnell stalled the process of the Senate trial by refusing to allow it to be held until Trump was already out of office." But on the broader issue, as he tells us, impeachment trials may absolutely be held after an official is out of office. "Congress has done it before and explicitly considered that exact question."
"If their argument was allowed to go forth, then what it would say is that any President can do whatever they want in the last couple of weeks of their term, because by the time they would get impeached, and by the time the Senate could convene for a trial, they'd be out of office already," he persuasively argues. "Disqualification from future office is an important remedy and penalty for impeachment. It is important to have that hanging over the head of a President even in their last couple of weeks in office."
We also discuss whether the votes of 45 GOP Senators --- including McConnell, who just last week conceded that Trump "provoked" the riot at the Capitol --- to dismiss the trial, signals that it will be impossible to win over the 17 Republicans needed to win the two-thirds vote necessary for a conviction; whether a vote can be held to prevent Trump from holding future office even without conviction; whether a second failure to win a conviction in a second impeachment would redound to Trump's benefit; and whether a resolution to censure the disgraced former President would serve as any kind of deterrent for similar behavior in the future (by Trump or other future Presidents), in the event that he is not convicted once again.
Fein also rings in with his thoughts in response to the GOP's stolen and packed U.S. Supreme Court which, on Monday, dismissed two cases regarding Trump's alleged violation of the Constitution's Emoluments Clause as "moot" since he is no longer in office and why it took so long for the cases to even reach the high court. We also discuss whether Fein believes that Trump actually did pardon himself, but is keeping that pardon a secret, somehow, until he's actually charged with a federal crime.
Finally, in far less maddening news, it was "Climate Day" in Joe Biden's new White House on Wednesday! And the new President unveiled an historically ambitious climate agenda that will, among many other things, if successful, result in carbon emissions-free power, nationally, by 2035. Declaring that "we can't wait any longer" to address our worsening climate crisis, Biden detailed his new Executive Orders and Directives to "supercharge" the United States' efforts to combat global warming by pausing new oil and gas leases on federal lands, ending fossil fuel industry subsidies, and creating millions of new jobs in the electric car market and renewable energy industry, and by capping and closing old, unused mines and wells across the nation. His new Climate Envoy, former Sec. of State John Kerry and new White House National Climate Advisor, former EPA Administrator Gina McCarthy, also responded to media questions (naturally framed by rightwing talking points) during a White House briefing. We share some of their remarks, and the entirety of Biden's historic announcement during today's very busy BradCast...

On today's BradCast: The effort by Donald Trump and Republicans to steal the Presidential election with false allegations of "voter fraud" didn't work. But that tsunami of disinformation is now being used to advance new restrictions on voting in the states as the GOP obstruction gets underway in the new Democratically-controlled U.S. Senate.
First today, there is quite a bit of news out of both the White House and the Senate. Among those stories covered today...
Biden's nominee for Sec. of State, Anthony Blinken, was confirmed in the Senate. His nominee for Treasury Secretary, Janet Yellen, the first woman in that role, was sworn in today by the nation's first female Vice President.
Mitch McConnell caved in his demand that Chuck Schumer and the Democrats promise to not do away with the wildly undemocratic legislative filibuster before he would agree to a new power-sharing agreement in the nation's wildly undemocratic upper chamber of Congress
The historic second impeachment of Donald Trump, on charges of "Incitement of Insurrection" for the deadly, January 6th U.S. Capitol riot, formally began with Senators sworn in on Tuesday as "impartial" jurors and a vote by 45 Senate Republicans to toss out the whole matter entirely.
And, before this one slips completely down the memory hole...Charges filed by the Justice Department against several military veterans who took part in the attempted insurrection at the Capitol that killed five people, include allegations that dozens of the former military insurrectionists pre-planned their coordinated attack, had hoped to arrest lawmakers, and appear to have had disturbing help from at least one, still-unidentified Congressional insider who gave the seditionists real-time help during the attack to locate lawmakers who had been shuttled into secured locations below the Capitol.
Daley writes this week at Boston Globe about the latest effort by GOP state legislators to exploit Trump's absurdly false claims about "voter fraud" in the 2020 election in order to implement new restrictions on voting at the state level and new ways to game the electoral college vote. Among the states we discuss where Republicans are right now citing false fraud claims in order to game the systems: Wisconsin, Michigan, New Hampshire, Georgia, Minnesota and Texas. These efforts are very real, and may well work, even in states which currently have Democratic Governors.
We also discuss the ridiculously undemocratic Senate, where Democratic Senators represent tens of millions of more voters than Republicans but, due to "the original gerrymander" as Daley describes it, are barely able to win 50 percent of the seats. "The US Senate is weighted so viciously towards small states in a way that the founders, if they saw it now, they would be truly horrified," he tells me.
"You've got a 50/50 body and yet, those 50 Democratic Senators are representing about 41.5 MILLION MORE PEOPLE. When you add into that the small-state bias of the Electoral College, when you add into that the advantage that that bias has given Republicans in selecting Supreme Court Justices --- five of these nine Justices on the Supreme Court selected by a President that lost the popular vote --- when you factor in the advantages that Republicans have with gerrymandering and geography --- all the way down from the US House to the state legislative level --- we are looking at an epidemic of Republican minority rule in this country."
And then there's the need to get rid of the undemocratic filibuster in the already wildly undemocratic Senate if Democrats hope, as they are now promising, to quickly accomplish "big, bold things" done. One of those "big, bold things," as we discuss, is HR-1, the "For the People Act." It's an enormously ambitious and much-needed bill that includes a ton of long-overdue reforms for voting and fair elections; ending dominance of big money and dark money in politics; and re-enforcing disclosure and ethics rules for members of Congress. But, as long as the filibuster remains in place, it will be next to impossible to see that, or any of the other much-needed reforms get through Congress. Constituents of Democratic Senators Kyrsten Sinema in Arizona and Joe Manchin in West Virginia may wish to mention that to them. Repeatedly.

So, yeah, I'm a bit grumpy on today's BradCast. When you listen, you'll get an idea why. [Audio link to full show is posted below.]
For one, I'm actually forced to defend a voting machine company. That could be a first in my nearly two decades of investigative reporting on Election Integrity and the woeful private voting system vendors who have been allowed to take over our public elections with their crappy, over-priced, often-unverifiable, easily-manipulated hardware and software. In this case, however, the claims made against one such company --- based on a twisted, bastardized re-imagining of my otherwise accurate and independently verifiable deep-dive reporting from more than a decade ago --- by sore-loser Donald Trump's dishonest attorneys and media stooges, need to be pushed back against, lest they further Trump's goal of undermining the United States' Constitutional republican democracy entirely.
Lawsuits may be coming in this case, warns Smartmatic's CEO, after the firm has been falsely blamed for stealing the election for Joe Biden in states where they do not even do business. (Their only contract in the U.S. is here in Los Angeles County. But that hasn't stopped Team Trump and the MAGA Mob from conflating them with a completely separate company, a competitor named Dominion Voting Systems, which has also been falsely blamed for stealing the election in jurisdictions where they do no business either.)
The bullshit, evidence-free claims of fraud continue from the deranged President and his pathetic team of desperate sycophants nonetheless. The latest nonsense comes via a so-called "forensic audit" by a so-called "military intelligence" outfit named Allied Security Operations Groups (or ASOG) which clearly knows nothing about voting systems or even election law. At least if you believe actual independent voting system and cybersecurity experts who examined their absurd, evidence-free allegations of "ELECTION FRAUD!"
Republicans in Congress clearly do not believe such experts, as GOP Senator Ron Johnson of Wisconsin held a ridiculous hearing on phony 2020 election fraud conspiracy claims in the U.S. Senate Government Affairs Committee today, no matter the lack of evidence for any such fraud. That, as more than 300,000 Americans --- more than the number of those killed during combat in all of World War II --- have now died from COVID-19 over the past nine months. Johnson and the rest of his caucus continue to largely ignore the deadly scourge while Americans are out of work by the tens of millions and about to be tossed from their homes amid the worst pandemic in a century. Both myself --- and Sen. Tom Carper (D-DE) --- have a word or two about all of that shamefulness as well today.
Meanwhile, actualvoter fraud criminal Donald Trump, is coming under legal scrutiny again for the fact that he is unlawfully registered to vote in Florida at a non-legal voting domicile (Mar-a-Lago, a commercial club, as Trump agreed back in 1993 when the town of Palm Beach allowed him to convert the once-private residence into a business). He went on to unlawfully vote twice this past year --- one by mail and one in-person --- using that non-legal "residence" as his voting address. All three acts are felonies by the President of the United States under state law in Florida, though its corrupt Governor Ron DeSantis, a Trump sycophant himself, doesn't appear to give a damn. Laws --- including election laws --- apparently do not apply to Republicans, especially if they happen to be sore-loser Presidents offering bullshit claims about election fraud in hopes of bringing down American democracy. But, as the neighbors to Mar-a-Lago are now warning, Trump will not be welcome to take residence, lawfully or otherwise, after his Presidency mercifully ends in historic failure next month.

First up today, Desi Doyen joins us for the latest on the deadly, devastating, climate changed-fueled wildfire infernos wreaking havoc up and down the West Coast and on the new record hurricanes that are heading our way at the same time. With more than 3 million acres now burned, hundreds of structures destroyed in California alone, and at least 35 dead from the record blazes so far, Donald Trump went to the state on Monday and told fire officials not to worry. "It'll start getting cooler. You just watch," the President told California state Natural Resources Agency Secretary Wade Crowfoot, who was urging him to not ignore science and "recognize the changing climate and what it means to our forests." Trump's response: "Well, I don't think science knows, actually."
So, don't worry! Just as Trump repeatedly promised COVID would "just go away," (more than 190,000 Americans have been killed by it since he pulled that phony promise out of his ass), apparently the same is true for our climate crisis! Of course, our corporate media have made it much easier for Trump to misinform the nation with his lies because the corporate media have done --- and are still doing --- an horrendous job of educating the electorate about the real reasons the western fires have become so horrific and why we are now up to "V" in the named storms so far this year, with a month and half still to go in the storm season and two and a half months remaining in the wildfire season.
The media have been similarly disastrous in their education of the electorate when it comes to our woeful election system. Sadly, too many top government officials --- Democratic and Republican ones alike --- share in that blame, as we're reminded in our guest today, JENNY COHN's new short #RemoveTheModems video, warning voters about the modems that are present in voting and tabulation systems in key states --- including battlegrounds Florida, Michigan and Wisconsin --- making our entire electoral system vulnerable to hackers.
Citing the comments from officials back in 2016 falsely telling America that our voting and tabulation systems are "never connected to the Internet" (they are), so can't be hacked (they can), Cohn tells me: "I'm very worried that we're going to be gaslit again in 2020. If the electronic totals somehow favor Trump, we're going to be told to pack up and go home there's nothing to see here, he just won, 'he's a legitimate president', period."
That year, even after Democrats promised "hundreds of attorneys" on the ground to assure a legitimate election (exactly as Joe Biden's campaign did again today), the DNC and Clinton Campaign refused to demand the hand-count of ballots in the three key states (MI, WI and PA) which barely flipped to the Republican candidate for the first time in decades. That, despite the fact that had an average of just two votes been recorded for Clinton instead of Trump in each precinct in those states that year, she, not he, would have won.
"What really concerns me is the blind spot that the Democratic Party seems to have for the electronic component of potential for cheating," says Cohn. She believes, however, that at least Clinton has learned her lesson. Based on a conversation she says she had with the 2016 Democratic candidate recently, Cohen tells me: "I do believe that Hillary Clinton understands it now, and I think she understands the importance of the Democrats not boxing themselves into a corner, where they will look like hypocrites if they need to file an election challenge based on the electronic totals, or any other aspect of the election."
Whether Clinton has enough power to convince the Biden Campaign and the rest of the Party of that, Cohn suggests, is a separate question.
Cohn, an attorney, election security advocate and Twitter activist, is calling for the modems cited in her video to be removed from the systems in states which use them before the November election. As journalist Kim Zetter reported last year, many of the election officials in those states don't even realize when their private election vendor has hooked their systems up to the Internet --- some of them she reports researchers discovered, are on the net all year around!
"I have no doubt that what the Trump team wants to do is win the electronic vote on Election Day, and then try to run out the clock or do something else with the [absentee ballot] signature match, so that we don't get all of them counted," she tells Cohn argues. "Or, if it goes to a recount, it gets shut down prematurely," she says, noting correctly that Vote-by-Mail ballots are also "sent to that electronic management system too."
Cohn also discusses some of her worst fears about this year's elections (and I share some of mine, several of which are similar, especially regarding electronic pollbooks which often have no paper backup) before we take a few phone calls from listeners on the topic, with Election Day now just 50 days away. "It's going to be ugly, no matter what the official result is," she says, noting: "My biggest concern --- the overarching concern that I think we both share --- is that there won't be any transparency about the results, and therefore we'll never really know."

After years of our reporting on the very successful, perhaps irreversible, decades-long effort by the Right to brainwash its followers, we open today with a few thoughts about a similar, if not quite as successful (though it's getting closer), effort to brainwash those on the Left. That effort to brainwash the Left, like the scheme on the Right, is also carried out by folks on the Right or those who support them. (And yes, that means we have a few words today about the still-misreported facts regarding the Hillary/Bernie race from 2016);
We have more evidence of attempts to manipulate the Left in today's announcement from Facebook that, based on a tip from the FBI, the social media outlet has shut down several fake accounts created to support a Russia-related propaganda scheme targeting the Left in hopes of undermining Joe Biden and Kamala Harris. The operation reportedly included a phony media outlet calling itself "Peace Data", in hopes of appealing to progressives in advance of this year's election;
Information of that sort, as we discuss, is --- or should be --- useful to voters. Nonetheless, with just over two months until Election Day, with Donald Trump's top intelligence officers having recently warned that Russia is taking active measures, once again, to undermine the Presidential election in support of Trump, his recently-appointed Director of National Intelligence John Ratcliffe notified Congress over the weekend that he will no longer offer in-person briefings to lawmakers regarding foreign attempts to interfere in the election. The claim, offered by Trump himself without facts to back it up, is that members of Congress were illegally leaking certain information from the intelligence community, and that the information leaked was also "wrong". No evidence was given to support that charge, and while Trump claimed the decision to end intelligence briefings to Congress was made by him and Ratcliffe, evidence suggests that it was, instead, a directive from Trump himself. For some reason;
Speaking of the November 3rd election, the dirty tricks are now underway, as revealed by a new robocall to some Democratic-leaning Michigan voters falsely warning that signing up to vote by mail will result in voters contact information being added to a database for tracking down arrest warrants, credit card debt collection and "mandatory vaccines". None of that is true. Though you should expect much more of it in the weeks ahead;
Also in Michigan, the state's Democratic Secretary of State Jocelyn Benson, recently won a court case filed by rightwingers attempting to prevent her from sending absentee ballot applications to all of the state's 7.7 million voters. The ruling --- in a state which Trump is said to have won by just over 11,000 votes in 2016 --- comes in the wake of his misfired threat to withhold federal funding from Michigan in a tweet in which he falsely claimed the "rogue Secretary of State" was planning to send out actual ballots (as opposed to applications) to all voters;
And while Trump and his minions have been suing in state after state in (usually failed) efforts to make voting more difficult during the global pandemic that he failed to control --- even attempting to block the use of secure absentee ballot drop-boxes in key battleground states like Pennsylvania --- another newly elected Democratic Sec. of State, Jena Griswold in Colorado, announced today that her state will offer "at least 368 mail ballot drop boxes for the General Election, an increase of 49% since I was elected in 2018!";

Trump fired the State Department Inspector General on Friday night. It was the fourth independent executive agency watchdog that Trump has axed over the past six weeks as he continues to dismantle all governmental oversight of the Executive Branch and what is virtually the last firewall against corruption by the most corrupt Administration in the history of the nation. In this case, the firing seems to have been carried out unlawfully by the President at the request of Sec. of State Mike Pompeo who is under investigation by the IG for forcing agency personnel to run personal errands for him and his wife, as well as for his part in funneling some $8 billion in arms sales to Saudi Arabia under the guise of Trump's phony "Emergency Declaration". The sales are in contradiction to a bipartisan vote by Congress last year, specifically denying the appropriation;
Former Republican Rep. Justin Amash of Michigan decided over the weekend that he will not run for President on the Libertarian Party ticket after all;
In Missouri, under pressure from an ACLU lawsuit, the GOP-dominated state legislature passed a law on Friday allowing all registered voters to vote with an absentee ballot if they so choose. That's good. However, those who are not either ill or at "high risk of serious complications from COVID-19" must still have their ballot verified by a Notary Public before it may be sent or counted. So, yeah, voters will still be forced to put themselves at risk in order to vote in the Show-Me state this November;
And in Long Island, New York, anti-lockdown protesters threatened a journalist reporting on their protests by running at him without masks on. "No," one of the jackasses is seen saying as he charges the reporter, "I got hydroxychloroquine! I'm fine!";

On October 24, 1998, a group of activists from across the United States gathered in Washington DC to protest the Ken Starr investigation into Bill Clinton in the first rally ever organized on the Internet.
Darrell Hampton's umbrella group "We the People" was generally outraged at Starr's excesses; White House staffer Bob Weiner railed against Ken Starr for subpoenaing him for eating ice cream with a fellow Democrat; the fledgling group "Censure and MoveOn" (later to become MoveOn.org) was featured; and my "Truth in America Project" focused on the biased media promoting the investigation, media which had recently gained its dominance from the 1996 Telecommunications Act.
We all understood the long drawn out Grand Jury investigation of Bill Clinton had found no crimes, and so Starr et al manufactured a perjury trap to have an excuse to impeach the President. As I said on the Ellipse in front of the White House, "Is it okay for a big government attorney to work with a private civil lawyer to see if they can figure out a way to get a man to lie about his sex life so they can prosecute him for it?"
But what was just coming to light, and what has had a lasting damaging legacy, is the effect of the 1996 Telecommunications Act on our political landscape.
Brief history: When radio and television were first invented, broadcast pioneers and government officials recognized that radio had the potential to entertain and inform, but when used improperly, also to brainwash a population. So Congress passed the 1934 Communications Act, which limited any one owner in the United States to owning just 9 stations nationwide: 3 AM radio stations, 3 FM radio stations, 3 TV stations. The thinking was that by having multiple local owners, no one person could dominate the (publicly owned) airwaves with political rhetoric.
"They wanted substantive change and were willing to burn it all down to get it." These words, from a neighbor in the rural north country of New York, describe the thinking of some who voted for Donald Trump. Some of these same voters had supported Bernie Sanders in the 2016 primary (more on that below).
Four years later, some have suggested we should shy away from Sanders, on the grounds that he cannot beat Trump. Election statistics, however, as well as current polling, reveal that he would, in fact, be a viable candidate. This is not the same thing as saying he will win. But, based on actual existing hard numbers that we can examine, he is certainly not "unelectable" as some critics have charged.
Bernie Sanders, having run for President in 2016, is the only Democratic candidate with a recent track record in presidential politics that can be used as a yardstick, unlike several of the other current front-runners such as Elizabeth Warren or Pete Buttigieg. So, let's look at what the raw numbers tell us about Sanders' electability against Trump, bearing in mind that this all could change when full-throated attacks are unleashed against him, as they inevitably will be against whoever wins the Democratic nomination...
On today's BradCast: Once again, our plans for Special Coverage of the latest Democratic Presidential Debate is somewhat truncated today to make room for our Special Coverage of impeachment and the new, wildly disturbing evidence released on Tuesday night to go with it. We're joined today by guests HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo and fellow longtime progressive blogger "DRIFTGLASS" (otherwise known as @Mr_Electrico on Twitter, or "Bill" to a few friends), co-host of the Professional Left Podcast, which celebrates its 10th anniversary this week.
We start with coverage of House Speaker Nancy Pelosi's decision to finally transmit the two Articles of Impeachment against Donald John Trump, as approved by the House last year, over to the Senate for just the third Presidential impeachment trial in U.S. history. With the articles, on Wednesday, she also announced the selection of seven House members who will serve as prosecutors (known as House Managers) for the trial. They include House Intelligence Committee Chair Adam Schiff, House Judiciary Committee Chair Jerrold Nadler, and Reps. Hakeem Jeffries of NY, Sylvia Garcia of TX, Val Demings of FL, Jason Crow of CO and Zoe Lofgren of CA.
Moreover, we discuss the troubling new documentary evidence released late on Tuesday by the House Judiciary Committee from the phone of Lev Parnas, an associate of Trump's personal lawyer Rudy Giuliani. That material, among other things, reveals a bizarre and creepy 2019 text message thread between Parnas and Republican Connecticut Congressional candidate and Trump superfan, Robert H. Hyde, detailing what appears to be Hyde's surveillance of movements of then U.S. Ambassador to Ukraine Marie Yovanovitch.
The texts suggest the now-ousted Yovanovitch, who was eventually recalled for her own safety on the next available flight out of the country, may have been targeted, given the content of the conversation, including remarks such as "They are willing to help if we/you would like a price." Ambassador Yovanovitch, an anti-corruption warrior, was described by Trump in his phone conversation with Ukraine's President as "bad news", claiming "she's going to go through some things."
As if all of that is not enough for one show, we then move on to coverage and analysis of Tuesday night's debate in Des Moines, Iowa, the final Democratic Presidential debate before voting begins in earnest for the 2020 nominating cycle with the Iowa Caucuses on February 3rd. Digby and Driftglass offer insight on all of the candidates who qualified for the debate --- Joe Biden, Bernie Sanders, Elizabeth Warren, Pete Buttigieg, Amy Klobuchar and Tom Steyer --- and a number of topics discussed on Tuesday night, including the bubbling feud between Sanders and Warren, the many and shifting Democratic positions on the Military/Industrial Complex and our forever wars in the Middle East.
We also discuss the failures of the debate moderators from CNN and the Des Moines Register, the problem with culling down the field to just 6 candidates before a single vote has even been cast, and whether Tuesday's debate has shifted the fortunes of any of the front-runners before voting finally gets under way next month....

On today's BradCast: There is one neat, simple trick that Democrats and opponents of Donald Trump can do to make sure that he is no more than a one-term President this November. But they may need to start thinking about it right now. JIM WILLIAMS, Issue Polling Specialist at Public Policy Polling, joins us to explain what that one thing is, as based on recent survey data collected by his firm in Arizona and Iowa. [Audio link to show is posted below.]
Also today, a report by Washington Post reveals that the Department of Justice investigation of Hillary Clinton and the Clinton Foundation that Trump demanded after becoming President has yielded...nothing. No criminal charges or anything close to it will reportedly be brought after a review begun by Trump's former Attorney General Jeff Sessions in 2017, as assigned to Utah U.S. Attorney John Huber, quietly wrapped up months ago. Even the matter regarding Uranium One, a Canadian company in which a Russian firm was allowed to purchase a controlling stake, reveals no wrongdoing, no bribes paid to the Clinton Foundation while she served as Secretary of State. No nothing.
In short, between this probe and a recent report by the State Department's Inspector General finding, after a three-year probe, no criminal wrongdoing in Clinton's use of a private email server, it turns out that all of the nonsense that Trump exploited to lead "LOCK HER UP!" chants and his calls for throwing her in jail during his 2016 rallies (and beyond) was entirely B.S. Or, to put it another way, it was all a witch hunt hoax. Who knew? Oh, yeah, we told you as much long ago.
All of that, even as the disgraced, now-impeached President has seen his own "charitable" foundation ordered shut down by a New York Court, which found a "pattern of illegality" in is fraudulent operations, ordering Trump to pay millions in penalties, and as the Dept. of Justice investigation into alleged Russian interference in the 2016 election has resulted in 199 criminal counts against 37 people and entities, seven of whom have pleaded guilty (many of whom were top officials in the Trump Campaign and Trump Administration], with six (so far) sentenced to prison and as many as 10 counts of obstruction of justice by Trump himself.
The phony "LOCK HER UP!" campaign which arguably resulted in Trump's Presidency was not only made possible, but actually enabled --- shamefully --- by corporate mainstream media which legitimized what was otherwise clearly little more than a bogus, orchestrated hit campaign by Trump and his Rightwing media machine in 2016. We have a word or two to say about all of that on today's program, even as Trump is currently using the same playbook to falsely discredit Joe Biden (and, undoubtedly, whoever else may win the Democratic nomination this year.)
For some slightly more encouraging news today, we turn to North Carolina, where a federal judge has, once again, shut down the state Republican legislature's latest scheme to enact Photo ID voting restrictions in 2020, finding it an attempt at discriminatory voter suppression. The ruling comes after a different federal judge had found the state GOP's previous scheme to restrict voting (by certain voters) in the very closely divided swing-state to have been written specifically to "target African-Americans with almost surgical precision."
But with all of that, the Iowa Caucuses are just weeks away now, followed by the New Hampshire primary and many others shortly thereafter. And while polls suggest there is no clear front-runner for the nomination, did we mention PPP's Williams is here to explain what the firm's data show to be an almost certain way to defeat Donald Trump once and for all this November, no matter who Dems choose as their nominee?...

On today's BradCast, while "all" is anything but "well", it may at least be a bit better than it was 24 hours ago at this time --- at least if the backing away from the likelihood of an apocalyptic military confrontation in the Middle East serves as any gauge. Shortly after air time on Tuesday, Iran launched a 22 ballistic missile fusillade at two Iraqi military bases housing thousands of U.S. troops in response to Donald Trump's assassination late last week of revered Iranian General Qassem Soleimani. And shortly after that, a Ukrainian Airliner made by Boeing fell from the sky and crashed after take off from Tehran's airport, killing everyone on board. While it's still early and unclear what exactly caused the disaster, some experts believe the plane could have been attacked either accidentally or on purpose. We discuss.
As to the Iranian attack on U.S. troops, thankfully there were no casualties, either American or Iraqi, as Iran announced there would be no more military reappraisals for Soleimani's killing, so long as America does not attack the nation again. What turned out to be a largely symbolic revenge attack for domestic consumption by Iran appears to have been an act of mercy to help deescalate a military confrontation touched off late last week by Trump that many feared had been spiraling out of control since the targeted drone strike against Soleimani.
After declaring "All is well!" on Twitter Tuesday evening, amidst the missile assault and deadly airliner crash, Trump offered mercifully brief remarks at the White House on Wednesday morning, flanked by the Vice President and top cabinet members and military officials, to suggest he was taking the off-ramp offered him by the grown-ups in Iran. In between several blatant lies told about the anti-nuclear pact struck with Iran and other leading nations during the Obama Administration and on other related matters, Trump promised new economic sanctions against Iran, but said the nation "appears to be standing down", that Iran and the US should "work together" against their mutual enemy of ISIS, and that the United States is ready to embrace peace."
Whether any of that turns out to be true, given a President of the United States who lies as easily as he breathes, is anyone's guess. But it may allow many of us to breathe a bit easier for the moment, at least until Trump's next unnecessary self-inflicted crisis.
We're joined today by former Deputy Asst. Secretary of StateMICHAEL FUCHS, to try and help clear up much of the confusion and anxiety of the last 12 hours since Iran's attack and the six days since Trump's assassination of Soleimani. Among the questions discussed with Fuchs...
Was Iran's missile attack, in fact, an "act of mercy"?;
Should we take any comfort from Trump's response today?;
Will there be additional responses from Iran (including cyberattacks) against the U.S.?;
Why were there no grown-ups in either the State or Defense Departments to warn Trump off of his wildly ill-considered murder of Iran's second most powerful official?;
What can and should be done to keep a President from being able to do something as irresponsible and dangerous like this in the future?;
Haven't both Republicans and Democrats in Congress ceded far too much of their Constitutional war-making authority to Presidents of both parties in recent years?;
What can Congress do to prevent this President and future ones from acting so dangerously?;
While the deal with Iran to block their path to a nuclear weapon had been a success (Trump's demonstrable lies about it not withstanding), until he unilaterally pulled the U.S. from the deal, wouldn't Iran be within their rights, and indeed wise, to now pursue a nuclear weapon, given the behavior of the U.S.?;
With Iranian and Iraqi leaders both demanding that U.S. troops leave the region, and Trump pretending for years that he wants the same, wouldn't this be a great time to find common ground and finally pull out of our many decades-long disastrous adventures in the Middle East once and for all?;
Can U.S. diplomacy actually rise in the Trump Administration with his widly hawkish Sec. of State Mike Pompeo?;
Fuchs, a former senior State Department official turned Senior Fellow at the Center for American Progress and Guardian columnist, gamely offers insightful answers to all of those questions and many others at the (hopeful) end of another series of exhausting, unnerving and confusing days during the horrific Trump Presidency.
"It is entirely possible that Iran might respond more to this most recent series of events. They might use cyberattacks, they might use their proxies throughout the region, which is a little bit hands-off, allows them a little bit of plausible deniability in their mind to attack US interests," Fuchs tells me. "But even if there is no immediate other response from Iran, we are still in this very dangerous and precarious moment where tensions between the two countries are incredibly high. And neither side seems, frankly, to have the ability nor the interest, at the moment at least, to finding a sustainable solution to these tensions. So for the moment, we want to hope for a very quick de-escalation, but the bigger problem is still very much there."
Finally, with the ability to breathe just a bit easier (at least for now) for the first time since the turn of the New Year, we turn to some quick coverage of some stories we've had to put off during Trump's latest world-threatening tantrum, beginning with the fact that two-thirds of Puerto Rico has been without power, and hundreds of thousands without clean water, since a major (and unusual) earthquake on Tuesday took out the U.S. island's largest power plant...

Sometimes, when faced with an insidious canard, it isn't enough to either expose the true source of a conspiracy theory or the absence of any facts to support it. In order to thoroughly demolish it, one can identify a reductio ad absurdum --- "a form of argument in which a proposition is disproven by following its implications to absurd conclusions".
It is indeed important that, throughout the recent public impeachment hearings, House Intelligence Committee Chairman Adam Schiff (D-CA) referred to allegations that CrowdStrike and the Ukrainians hacked the Democratic National Committee (DNC) server in 2016 as a "debunked" conspiracy theory and that none of the State Department and National Security Counsel (NSC) officials who testified during the impeachment hearings could identify any evidence that would support that "debunked" theory. It is also important that, in her opening statement, Dr. Fiona Hill, Trump's own former NSC Senior Director of Russian and European Affairs, proclaimed that Russian intelligence agencies were the source of that "fictional" canard.
While there is ample evidence to support the conclusions offered by Dr. Hill and Chairman Schiff, one can deliver the coup de grâce to the baseless but insidious theory that Ukraine and CrowdStrike hacked the DNC by asking "why" they would do that?...
