On today's BradCast: We wouldn't blame you if you felt like averting your eyes from the desperate, usually-sad, often-hilarious, chaotic and so far failed attempts by the incompetent Team Trump to somehow try and steal the 2020 election any way they can. Yes, that's still going on. It's our job, however, to keep our eyes on it, and so we do again today, as things continue to fall apart in all new ways with each passing hour for Donald and what's left of his legal team. [Audio link to show follows summary below.]

Today, we cover the ongoing chaos the Trump Campaign is attempting to wreak in at least four different states. So far, only in Georgia has an election official who has buckled to pressure from Trump and fellow Republicans. Of course, he's a Republican himself and is doing a lousy job of it. But, in almost every case, the strategy --- such that there is one --- now seems to be to target the votes of African-Americans to be tossed out.

In Wisconsin today, the Trump Campaign plunked down $3 million to pay for a partial recount in the state. A full count would have cost the cash-strapped campaign $7.9 million. They have asked for counts only in heavily African-American Milwaukee County and Dane County, in a state where Joe Biden currently leads Trump by about 20,000 votes. In requesting the partial count they are doing what Republicans were outraged by in Florida in 2000 in the Bush v. Gore case, when Gore sought recounts only a few counties. The GOP, at the time, succeeded in forcing a statewide recount instead, which they were able to convince the U.S. Supreme court to block entirely. (Extra fun and irony today for those who noticed that Eric Trump complained in 2016 about the Presidential recount that year in the same state because the cost "Could Have Saved at Least 5,000 Children's Lives." He also falsely claimed that Hillary Clinton had anything to do with that recount. In fact, it was sought and paid for by the Green Party's Jill Stein for less money than the Trump Campaign sent to the Badger State today.)

In Pennsylvania, where Biden appears to have won by almost 82,000 votes, Rudy Giuliani made an absolutely hysterical jackass of himself during a federal court hearing on Tuesday. He hasn't argued a case in federal court for 30 years, and boy did it show! Just part of the fun included his opening argument in which he declared the case was about "widespread nationwide voter fraud!," before later admitting under questioning from the U.S. District Court Judge during the same hearing that "this is not a fraud case." That was hardly the only way in which he beclowned himself, especially as he focused on leveling baseless claims against the voting in heavily-minority Philadelphia. But it should also be noted that he declared his evidence-free case "a classic violation of equal protection....This is exactly Bush v. Gore!" That's fun, considering his campaign then violated a basic tenet of that 2000 case with their request for a cherry-picked partial recount in WI today.)

In Michigan on Tuesday night, the two Republicans on the Board of Canvassers in Wayne County refused to certify the November 3rd results due to claims of irregularities in the county's largest city, Detroit. (Seeing a pattern here yet?) The irregularities in question, apparently, regard small inconsistencies between the number of ballots cast and the number of voters signed into the pollbooks in a number of precincts in the county, in a state where Biden appears to have won by almost 160,000 votes. Despite a higher number of inconsistencies during primaries in the County earlier this year --- and a larger percentage of inconsistencies in majority white cities in the same County --- the Republicans on the Board certified the spring primaries without a problem. Their refusal to certify the general election deadlocked the Board at 2 to 2 and prevented certification for a few hours on Tuesday night. Brutal public comments at the Board's hearing and agreement to ask the Democratic Sec. of State for an audit of Wayne County's discrepancies, resulted in certification after all, by a unanimous 4 to 0 vote in a new vote by the Board held just three hours later.

But much of today's show is focused, however, on the absurd clown show that has been underway in Georgia for the past week, where the Republican Sec. of State, Brad Raffensperger, buckled to pressure last week from Trump and fellow Republicans who hold him responsible for the fact that Trump appears to have lost there by about 13,000 votes.

Last week, when Raffensperger announced an unprecedented statewide "audit, recount and a recanvass all at once," we explained on the program how that's not actually possible or even legal. This week, Raffensperger quietly admitted as much, sending out a letter to County Elections Officials [PDF] to notify them that "after evaluating the audit procedures...the original results...tabulated on and after election day, and certified by the county election superintendent, should be the results that your county certifies as the November 2, 2020 General Election Totals."

In short, the so-called "Risk-Limiting Audit" of 100% of the ballots cast in GA's Presidential race was not a "hand recount" as many media outlets have been misreporting it, but a largely meaningless exercise meant to try and appease our cry baby President, as my guest today, JEANNE DUFORT of the Coalition for Good Governance, describes it. Dufort has been on the ground in the state where she has also been a voter plaintiff in some of the Coalition's lawsuits. They are plaintiffs in a long-running federal case seeking to ban the state's use of new, unverifiable touchscreen voting systems made Dominion Voting Systems. (The same lawsuit succeeded in obtaining an order from the federal judge that banned the state's previous, 20-year old, unverifiable touchscreen systems made by Diebold. Despite recommendations from cybersecurity advocates and voting systems experts, Raffensperger chose to move to the new $100+ million touchscreens that are similarly unverifiable.)

Over the past 48 hours, two Republican-leaning counties discovered about 2,700 votes each that had gone either unscanned or unreported to the state previously. Those would have been discovered in the normal course of regular post-election canvassing, and netted about 1,000 votes for Trump overall. That will decrease Biden's final state certified margin from about 14,000 votes to about 13,000 votes. He will still be declared the official winner. After state certification on Friday, Team Trump will then have an opportunity to seek an official "recount" (as opposed to Raffensperger's pretend one) in which, by state law, the ballots will scanned again by the same computers that scanned them the first time. So that is also unlikely to change the final results.

Dufort explains today what she was able to observe over the past week during Raffensperger's "audit"/"recount"/"recanvass" which amounts to little more than Election Integrity Kabuki Theater. But, she tells us, there were still a few lessons to be learned from it all, as elections officials, poll workers and count observers who have been working for weeks amid a deadly pandemic, will now have to prepare very quickly for the two January 5 U.S. Senate runoffs in GA that will determine which party controls the Senate next year. Early voting begins on December 14th, not long after some municipal elections are also held in some counties on December 1st. All while carrying out another "recount" which Trump will almost certainly request after Friday's state certification. After all, there were a lot of --- you-know-whos --- that cast ballots against Trump in the city of Atlanta. That can't stand, right?

"The big thing is this is theater," says Dufort, speaking for herself, not the Coalition. "We've been calling for this [unverifiable Dominion Voting] equipment to be banned in the same way our lawsuit got the last Georgia system banned. So we are not fans of this equipment. But it's really ironic to see the same legislators who forced this $100 million purchase on the state to now be saying, 'Hey let's return it to the vendor! Let's get rid of it! It's a terrible system!', because they didn't get enough for their money. They didn't get a President for their money, and it's not clear they're going to get two Senators for their money. So it's kind of a funny time in Georgia."

Finally, we close with some listener mail that may hit the nail on the head: Trump isn't trying to getto 270 electoral votes. He's trying to take enough votes away from Biden so that he gets less than the required 270, so the election must be thrown to the House where the Constitution allows for minority (Republican) rule to win the day. With Rudy Giuliani now leading Team Trump's efforts, how could the plan fail?!

On today's BradCast: Dozens of top, bi-partisan experts in government, national security and media predicted this moment last Summer, as they gamed out the various scenarios that might occur after Election Day. At the same time today, it's wildly amusing to watch Republicans continue to pick up on so many of our reports on election integrity at The BRAD BLOG over the years and suddenly pretend to be concerned about it, after years of scoffing at such "libtard, sore loser conspiracy theories" regarding the dangers of computerized vote tallies and private voting system vendors in control of our public elections. [Audio link to today's show is posted below summary.]

First up, the experts who predicted this moment. Most of the scenarios that the Transition Integrity Project (TIP) gamed out, they feared, would result in at least some level of violence and a potential Constitutional crisis. Donald Trump is largely proceeding as they'd predicted. But the co-founder of TIP, which organized the exercises to examine what Trump might do in the wake of a Joe Biden victory, tells me today that while "it's like poison into the veins of the body politic...they're not going to be able to get away with actually stealing the election."

Dr. NILS GILMAN is an historian, Vice President of Programs at the Berggruen Institute and TIP co-founder and joins me again on today's show. Earlier this year, in table-top exercises he helped to organize, the TIP group gamed out the various ways that Election 2020 might play out [PDF]. When we spoke with Gilman in August he cautioned that "all signs appeared to be flashing red," as the experts found that all potential scenarios other than a "Biden landslide" could result in "both street-level violence and political impasse".

So, with Trump's continuing unwillingness to concede the election two weeks later; his false claims of massive "voter fraud" in at least half a dozen states failing to include any actual evidence; at least two dozen lawsuits challenging the election being tossed out of court or withdrawn by plaintiffs; along with the Administration's refusal to work with the Biden Transition team, it seemed a good time to check back in with Gilman to see if the current scenario was predicted and, if so, how experts believed it would play out from here.

"We looked at four different scenarios" last summer, Gilman explains. But now, he says, "the world we ended up in was somewhere between the 'Biden landslide' and the 'Biden clear-but-close-victory'. So you see the moves that Trump is trying to do that we anticipated when we ran these exercises last Summer. They are very similar to the ones we saw. He's trying to convince people that there was cheating going on in the election, that there was electoral fraud. He's trying to get state legislatures to potentially consider throwing out the results of the popular vote and instead putting in place a slate of Republican electors even though the people voted for Democratic electors."

"I don't think any of that is going to end up working," says Gilman. "We're not quite in 'Biden landslide' territory, but we're not in a close election either. That's why I don't think Trump is going to be able to pull off what he was probably scheming to do."

While he says "there's a lot of crazy stuff happening in the fever swamps" and, indeed, there was some violence after Trump supporters and counter-protesters clashed over the weekend, Gilman believes that the conditions that would lead to worst of the scenarios examined have yet to materialize. And that's a very good thing. So far. He explains why that is and what is, so far, missing from one of those worst case scenarios examined by his project.

Also today, Republicans --- yes, even Sean Hannity! --- is suddenly very troubled by secret software made by private voting system vendors like Dominion Voting, a company that we've been reporting on (along with all of the other equally shitty vendors) for years. In the past, the folks at Fox "News" like Hannity and now dead Breitbart "News" founder Andrew Breitbart, scoffed at our reporting. Breitbart took particular glee in attacking me personally over my reporting on the now defunct Diebold Elections Systems, Inc. (It seems unlikely that Breitbart "News", with their "reporting" on Dominion today, even realize that the company now owns many of Diebold's assets!)

But, over the past week or two, our traffic here has gone through the roof as the Rightwingers have suddenly become concerned about these issues for some odd reason, after years of dismissing them. Thanks, Rightwingers! (Yes, for example, if you are hearing misleading murmurs from the fever swamps --- including from Hannity and Trump himself --- tying Dominion to Venezuela in order to claim the company secretly stole the election for Biden, it's due to this exclusive BRAD BLOG story that we broke more then 10 year ago! Glad ya'll have finally decided to notice and become alarmed about our reporting! Just wait until you hear what George W. Bush did in Iraq!)

Then, we open up the phone lines to answer some more questions about all of this, including one caller who wonders what's up with what she's been seeing all over YouTube about Venezuela and Dominion?! And another who picked up on part of my conversation with Gilman about whether the Biden Administration intends to hold the criminal Trumpers accountable or whether, like the Obama Administration with the Bushies, they will make the mistake of "looking forward, not back."

"People have to look close at what created the mess we're in now," says our wise caller Kelwin. "Trump is a bed sore on a sick, cancer-ridden political body of the United States. And getting rid of Trump is going to be like fixing a bed sore on a dying body. I like to say that charging and going after these people, that IS looking forward. It's looking at stopping the pattern."

Debunking wingnut 'voter fraud' nonsense while welcoming them to the fight against private voting vendors and inviting them to join our call for hand-marked paper ballots in GA's upcoming U.S. Senate runoffs...

Well, it took long enough --- much longer than media usually wait --- but by Saturday morning, they finally recognized the obvious by calling Pennsylvania, and thus the Presidential election, for Joe Biden. The Right --- from the religious wacko Right to the non-religious wacko Right --- are in the midst of some pretty serious denial about it all, as we share at the top of today's BradCast, along with a few quick headlines, some serious debunkery, an invitation to Republicans to join the election integrity movement, and a bunch of gleeful calls from listeners. [Audio link to show is posted below summary.]

Among the quick headlines today: yet another rally on Wall Street in the wake of Biden's election; good news about a possible COVID vaccine (which Trump had nothing to do with!); Trump fires his Defense Secretary; more top Trump Administration officials test positive for the virus; and Biden's reported plans to issue a quick series of Executive Orders after being sworn in on January 20th to reverse some of the most egregious offenses of the Trump Era.

Then, we pick up today, somewhat, where we left off last week, debunking a number of the many absurd, evidence-free allegations of "voter fraud" being propagated by the deniers and conspiracy theorists on the Right --- from "SharpieGate" to false claims of "dead people" voting in Michigan to false claims (debunked by Fox "News"!) that Republicans were prevented from watching ballot tabulation --- as well as a look at one of the few legitimate concerns that have come to light since last Tuesday's Election Night. Namely, a concern about misreported vote tallies in Antrim County, Michigan, a small, heavily GOP-leaning area in the northern part of the state. According to the Democratic Sec. of State, the problem was due to a failure by Republican county officials to install a late update to their Election Management System software which is used to upload county results to the state at the end of the night. The problem resulted in Joe Biden momentarily appearing to have defeated Donald Trump by a landslide in the County. The error was quickly discovered, corrected and the posted results were properly reversed to reflect Trump's victory there.

But the incident (as well as the apparent losses of both MI and Georgia for the Republicans) has helped fuel a push from the Right toward demonizing Canadian-based Dominion Voting System --- the private voting system vendor in Antrim and other MI counties. While the Trumpers are falsely attacking the company as a tool of Nancy Pelosi and Hillary Clinton (even though Republican lobbyists work for the firm which has donated to Republicans), we're happy to join the critique in as much as no private company should have so much control over what are supposed to be our public elections. A call for an independent investigation and a hand-count of the county's paper ballots would be perfectly appropriate there.

Dominion is also the company which runs Georgia's elections, with a new $100+ million contract to supply 100% unverifiable touchscreen voting systems for in-person voting at the polls across the entire state and scanners for the state's hand-marked paper absentee ballots --- scanners which were found to have skipped counting many votes during the state's June primary.

While Biden appears to have won the state of Georgia by some 12,000 votes as of airtime (and, in Michigan, by about 150,000 votes), I invited Republicans via Twitter over the weekend (in a short threat that has gone mildly viral) to get rid of Dominion's influence over elections all together by joining me in demanding hand-marked paper ballots, publicly hand-counted, for the state's critical upcoming U.S. Senate runoff elections. Those two runoff elections will determine which party controls the upper chamber of Congress for first two years of the Biden presidency.

If the GOPers --- including folks like Eric Trump --- are serious about their concerns that "software from hell!" as Eric called it, made by Dominion somehow stole the election for Biden, they will join those of us in the fight for real Election Integrity in that call. So far, they haven't. But we can still hope.

Finally today, we open the phones for listeners to ring in following this weekend's huge news --- to gloat, to express their joy, their concerns, and much more --- as we begin to see a glimmer of light at the end of our long, if still-ongoing, national nightmare...

On today's BradCast: it's all over but the desperate Donald Trump tantrums. Though don't try and tell our own Desi Doyen that today! [Audio link to show is posted below.]

As the stock market numbers rally on increasingly certain news that Joe Biden will become the next President (despite Trump's lies that the market would crash if the former Veep won), the U.S. coronavirus numbers also continue to skyrocket to all time records (thanks to Trump's disastrous denial and lies there as well.) For today, though, it's the vote count numbers we're again focused on, as Biden will almost certainly be called the unofficial winner in several remaining uncalled states --- including Pennsylvania, Georgia and Nevada --- very soon.

If he takes Pennsylvania alone it's over for Trump. But, as we went to air today, with Biden so far, according to media calls, having won a conservative 253 electoral votes of the 270 he ultimately needs to be declared the President-elect (that 253 total doesn't include Arizona's electors, which both AP and Fox "News" have already called for him), it's now likely that Biden will end up with at least 306 electoral college votes when all is said and done.

At the same time, Trump is filing every unsupported, nonsensical legal lawsuit in every state that his two-bit lawyers can figure out how to spell in hopes that something, anything, will actually help --- or even just turn out to be vaguely true. While the President's supporters in Michigan chant "STOP THE COUNT! STOP THE COUNT!", his equally gullible cult followers in Arizona are busy shouting "COUNT THOSE VOTES! COUNT THOSE VOTES!" That should give you an idea of the ingenously coordinated strategy of Trump and the Republican Party's election law geniuses at this point.

We're joined today by an actual legal professional, University of Kentucky College of Law's election and Constiutional law professor JOSHUA A. DOUGLAS, author of Vote for US: How to Take Back Our Elections and Change the Future of Voting to find out what we must be missing in reviewing Trump's woefully pathetic legal strategy to try and win this election or unring its bell.

"There's not really a coherent legal strategy to speak of. He's throwing as much spaghetti at the wall as he can and seeing what sticks," Douglas confirms. "The real problem I have is we're reporting on these lawsuits as if they have any merit whatsoever. And they don't. I don't think we should even be giving them airtime. Because in my view, the real goal here is to undermine people's faith in the integrity of the election."

"They are making wild allegations of voter fraud, but without having any evidence that it actually occurred. And then they're spreading misinformation on social media about anecdotes that, when you look into them, turn out to be" anything but what they are alleging, he explains.

Nonetheless, we press the good professor for how he would make the case for Trump, were he unfortunate enough to be representing him in this matter, and we discuss the actual looming legal danger awaiting decades of election law precedent at the now packed and stolen U.S. Supreme Court. Will Trump's newest stolen Justice Amy Coney Barrett actually deliver for her President if and when any actionable case on the 2020 election somehow makes its way to SCOTUS? Or will it only be later that she and four other compliant rightwing Justices will decide to undermine the affirmative Right to Vote found in almost every state Constitution?

We discuss all of that and more today, even if none of it seems to help our own Desi Doyen rest any easier about the Presidential election results just yet. (She has very good reason, in the meantime, to be concerned indeed about the results at the Senate and House level.) Nonetheless, we close today with her latest Green News Report with an eye on Hurricane Eta, now aiming for Florida, and what we should expect when it comes to U.S. climate action after the dust settles on the 2020 election...

On the day after what was a harrowing and very very late Election Night for many Democrats, it is now fairly clear, as of today's BradCast, that --- barring some sort of tabulation surprise or failure (they do happen) --- Joe Biden is set to win at least 270 electoral college votes to become the nation's next President. [Audio link to show is posted below.]

This will likely happen even if Biden doesn't end up winning Pennsylvania (or even Georgia or North Carolina) with the many still-untabulated, largely Democratic votes left to count in the state. In Pennsylvania, Wisconsin and Michigan, election officials were barred by gerrymandered, GOP-controlled state legislatures from counting any mail-in ballots until Election Day, so unofficial results on Election Night were much slower coming in. (In Pennsylvania, as we explained with a PA election official last week, it is even worse, because officials in the state are barred from even pre-processing mail-in ballots by opening, verifying them, etc., before Election Day.)

Nonetheless, faced with his likely crushing defeat at the ballot box, Donald Trump did what he does, and precisely what we warned you, very specifically in recent weeks, that he would do. He attempted to gaslight the American people via his Twitter account and a 2:30am "news conference" with supporters at the White House, where he tried to super-spread the lie that counting legally cast ballots after Election Day was somehow "a fraud on our nation" and a "sad" attempt by Democrats to "STEAL the election" from him. After falsely declaring victory, he vowed that "we are going to the Supreme Court" to, presumably, try to stop the counting of votes, though it remains unclear whether he has any cause of action whatsoever to try and do that.

Trump's late-night lie and threat fest did not go over well. Even Republicans of all stripes condemned the remarks --- from Chris Wallace of Fox "News" to Trump's debate prep ally Chris Christie to the RNC's top election attorney Ben Ginsberg --- all of whom declared Trump's announced plans to stop the counting of lawfully cast votes to be shameful, anti-democratic and counter-productive to his case, not to mention an embarrassment to the nation. We share a number of those responses on today's show.

In short, Trump's desperate scheme is unlikely to work, barring evidence of some sort of actual fraud or mistabulation. Before media outlets called both Wisconsin and Michigan for Biden today, Team Trump vowed to seek a "recount" in Wisconsin, and announced plans to file suit in those states and Pennsylvania in hopes of stopping perfectly legal on-going vote tallies. In an effort to recreate the magic of 2000's infamous "Brooks Brothers Riot" in Florida, Trump supporters in Detroit on Wednesday attempted, unsuccessfully, to storm the counting room.

That is by way of contrast with Biden's own late-night statement to supporters on Tuesday night, noting that "it's not my place or Donald Trump's place to declare the winner of this election. It's the voters' place," and that "every vote must be counted." He vowed that "nobody is going to take our democracy away from us, not now, not ever."

We shall see. But it is looking very good for Democrats today, at least on the Presidential level as of air time today. As to their hopes of winning back a much-needed majority in the U.S. Senate, that hope appears dim at this hour, if still a long-shot possibility. Combined with the reported loss, so far, of five Democratic seats in the U.S. House and the results on several ballot initiatives across the nation, it was certainly a confusing verdict from the American people --- presuming the reported, unverified and unofficial results to date prove to be accurate.

What to make of all of this? We are joined today by our old friend and Wisconsin favorite son, progressive journalist JOHN NICHOLS of The Nation and Madison's Capitol Times. As usual, Nichols has helpful insight into all of this, both for progressives and establishment Democrats, as well as a unique perspective from a state which barely went to Donald Trump in 2016 for the first time in decades, and which now appears to have flipped back to Democrats by a similarly small margin. His body of knowledge also comes from a longtime progressive state that took a very similar right turn over the past couple of decades as the nation now appears to have taken, with the rise (and fall) of former Gov. Scott Walker.

"I like the fact that the people [Trump] attacked the most, the people he threatened to send federal forces in to squash their protests and minimize their outcry --- they pushed back against him," Nichols says, noting his optimism after last night. "I see something very positive in that. I would even dare say there was something delicious, or at least appealing in the poetic justice of it." On the other hand, he tells me, noting the "blunt reality" of the situation, "Democrats shouldn't be overly enthusiastic about a situation where, it appears, the prospect they have taken the Presidency without a Senate. Because, I've argued throughout this year, that if Joe Biden is elected President with Mitch McConnell still in charge of the Senate, Joe Biden begins his Presidency as a lame-duck."

All sorts of reasons for Dems to feel good about Biden and re-taking the Senate...Along with plenty of reasons to remain concerned about both...

There are all sorts of reasons for Democrats to be feeling pretty good about their chances this year. But there are almost as many good reasons to remain very cautious. We discuss a lot of each on today's BradCast! [Audio link to show follow below.]

Among the good news/bad news today...

  • Former Republican National Committee chair Michael Steele joins a ton of former GOP officials, Governors, lawmakers, military officials and others to endorse Joe Biden for President, after the RNC has "bent the arc of the party towards the baser motives of one man, who is neither a Republican nor a conservative";
  • USA Today's Editorial Board, which has never endorsed any Presidential nominee, does the same. Their reasons are many, including Trump's "shambolic response to the coronavirus pandemic [which has] inflated a national death toll that is equivalent to the crashes of more than 1,000 Boeing-737 jetliners";
  • Florida joined several other battleground states on Monday when it "shattered its opening day record for in-person Early Voting," after also more than doubling its absentee vote-by-mail numbers from the same time frame in 2016. That certainly seems like good news for Democrats, but is it really? Is it due to enthusiasm? If so, for Biden or Trump? Or is it just fear of COVID? Or concerns about slow-downs by the U.S. Postal Service? We discuss a number of the key caveats to these widely reported numbers and one anectodal suggestion that likely voter models this year could ultimately be "all shot to hell";
  • The gobsmacking 3rd quarter fundraising numbers for Democratic Senate candidates in key races this year appears to be undeniably encouraging news for those hoping to see the Party regain a Senate majority. We offer some reason to deny the encouragement nonetheless;
  • On yesterday's program we reported on the disturbing news from a 3-judge panel of Republican appointees on the Michigan Court of Appeals who overturned a lower state court judge's ruling in the key battleground state that mail-in ballots postmarked by November 2nd (the day before Election Day) would be counted if they arrived up to two weeks after Election Day. Not long after we got off air Monday, a 4 - 4 decision by the Republicans' stolen U.S. Supreme Court upheld a ruling by Pennsylvania's Supreme Court, allowing for the counting of mail-in ballots that arrive up to three days after Election Day. Most Dems saw that as very good news. And it is --- at least for the very short and narrow term. The intrusion by four SCOTUS Justice's, however, into a state court ruling on a state constitutional matter, regarding that state's constitutional "right to vote" is actually quite foreboding news. And it's about to be made much worse with the addition of Amy Coney Barrett on the high court. We explain.
  • Finally, Desi Doyen joins us for another good news/bad news edition of our Green News Report, with bad news about the continuing record wildfires in the West and some very good news about renewable electricity...

On today's BradCast: You thought your work was done after you vote? Think again! [Audio link to show is posted in full below summary.]

But, first up, a quick rundown of today's disturbing headlines to serve as a reminder that the only thing that matters between now and November 3rd is the general election now already under way, in which more than 26 million have already voted. Have you? We've got some useful tips on how to maximize the chances of your ballot being counted as cast in this pandemic year.

Then, a 3-judge panel of Republican appointees to the Michigan state Court of Appeals has overruled a lower court judge who had extended the deadline for mail-in ballots to arrive in the key battleground state, given U.S. Postal Service slowdowns. The lower court judge had previously determined that ballots postmarked by November 2 (the day before Election Day ) should still be counted if they were received by election officials up to two weeks after Election Day. The 3-judge panel, however, overturned that ruling and says that ballots must now arrive by Election Day. That's disturbing, given that some 6,400 ballots were tossed for arriving late after the state's August primary, in a state that is said to have elected Donald Trump by fewer about 11,000 votes in 2016.

Meanwhile, after technical problems with the voting systems caused hours-long lines for voters in parts of Georgia and Texas last week during their first days of Early Voting, the website for the Supervisor of Elections in Orange County, Florida --- yes, another key battleground state --- was not available today during the first day of Early Voting in the Sunshine State. The SOE's office blames a private vendor for incorrectly renewing the office's website domain.

With all of the problems expected in this election --- even more than we usually see (and that is saying a lot!) --- public oversight of the election, before, during and after Election Day, will be critical this year. To that end, we're joined today by EMILY LEVY, longtime election protection advocate and now founder of Scrutineers.org, a nonpartisan online community of people working to protect US elections.

Levy details how you can get involved with the group and help oversee our election processes from many different angles in your own community. The courts, clearly, cannot be counted on to protect our votes and, as the best elections officials in the nation will tell you, elections officials are not to be trusted! Only public oversight by the citizenry can guarantee a fair election.

Levy explains a number of the groups ongoing projects, including a (free!) Zoom training session this Friday for their "Poll Tapes Project", detailing how citizens can photograph and/or video tape the voting system results tapes that are printed out at the end of the night at polling places when they close. Reviews of those tapes are often helpful in discovering anomalies in the results eventually reported by county headquarters or the state.

She also discusses the group's "Candidate Caution Letter" campaign, requesting that candidates do not concede their races until all votes are tabulated and confirmed to have been done so accurately; an effort to train poll workers to keep an eye out for certain concerns that regular poll worker training generally does not cover; and how to be a polling place election monitor on Election Day and an observer at county headquarters as votes are being tallied and/or examined during post-election "audits" (at least in the very few jurisdictions that do any sort of post-election spot check of ballots to make sure that tabulation computers were counting accurately.)

Scrutineers is "a place where people can learn about the issues starting from scratch, if that's their beginning place, or get more advanced help if they've been working on these issues for awhile, and talk to each other, coordinate with each other to set up projects in their local communities, find the resources they need and ask questions of people who have been doing this work for a long time," Levy tells me.

"There's quite a wide variety of things to choose from," she says, including things that can be done from home. "Everybody can do something, and I hope that everybody will."

While campaigning and GOTV (Get Out the Vote) work that many people do "kind of ends on Election Night, that's when a lot of the activities that we're training people to do begin," Levy notes. "We're really hoping to see a huge influx of those dedicated people who want to make sure that everyone gets to vote, [are then able to] turn that dedication into making sure all those votes they worked so hard to get actually get counted accurately!"

Today's BradCast in a nutshell: Elected officials lie, corporate media misinforms, people die. We try again to combat all of the above today. Wish us luck. [Audio link to today's show follow below.]

First up today, Desi Doyen joins us for the latest on the deadly, devastating, climate changed-fueled wildfire infernos wreaking havoc up and down the West Coast and on the new record hurricanes that are heading our way at the same time. With more than 3 million acres now burned, hundreds of structures destroyed in California alone, and at least 35 dead from the record blazes so far, Donald Trump went to the state on Monday and told fire officials not to worry. "It'll start getting cooler. You just watch," the President told California state Natural Resources Agency Secretary Wade Crowfoot, who was urging him to not ignore science and "recognize the changing climate and what it means to our forests." Trump's response: "Well, I don't think science knows, actually."

So, don't worry! Just as Trump repeatedly promised COVID would "just go away," (more than 190,000 Americans have been killed by it since he pulled that phony promise out of his ass), apparently the same is true for our climate crisis! Of course, our corporate media have made it much easier for Trump to misinform the nation with his lies because the corporate media have done --- and are still doing --- an horrendous job of educating the electorate about the real reasons the western fires have become so horrific and why we are now up to "V" in the named storms so far this year, with a month and half still to go in the storm season and two and a half months remaining in the wildfire season.

The media have been similarly disastrous in their education of the electorate when it comes to our woeful election system. Sadly, too many top government officials --- Democratic and Republican ones alike --- share in that blame, as we're reminded in our guest today, JENNY COHN's new short #RemoveTheModems video, warning voters about the modems that are present in voting and tabulation systems in key states --- including battlegrounds Florida, Michigan and Wisconsin --- making our entire electoral system vulnerable to hackers.

Citing the comments from officials back in 2016 falsely telling America that our voting and tabulation systems are "never connected to the Internet" (they are), so can't be hacked (they can), Cohn tells me: "I'm very worried that we're going to be gaslit again in 2020. If the electronic totals somehow favor Trump, we're going to be told to pack up and go home there's nothing to see here, he just won, 'he's a legitimate president', period."

That year, even after Democrats promised "hundreds of attorneys" on the ground to assure a legitimate election (exactly as Joe Biden's campaign did again today), the DNC and Clinton Campaign refused to demand the hand-count of ballots in the three key states (MI, WI and PA) which barely flipped to the Republican candidate for the first time in decades. That, despite the fact that had an average of just two votes been recorded for Clinton instead of Trump in each precinct in those states that year, she, not he, would have won.

"What really concerns me is the blind spot that the Democratic Party seems to have for the electronic component of potential for cheating," says Cohn. She believes, however, that at least Clinton has learned her lesson. Based on a conversation she says she had with the 2016 Democratic candidate recently, Cohen tells me: "I do believe that Hillary Clinton understands it now, and I think she understands the importance of the Democrats not boxing themselves into a corner, where they will look like hypocrites if they need to file an election challenge based on the electronic totals, or any other aspect of the election."

Whether Clinton has enough power to convince the Biden Campaign and the rest of the Party of that, Cohn suggests, is a separate question.

Cohn, an attorney, election security advocate and Twitter activist, is calling for the modems cited in her video to be removed from the systems in states which use them before the November election. As journalist Kim Zetter reported last year, many of the election officials in those states don't even realize when their private election vendor has hooked their systems up to the Internet --- some of them she reports researchers discovered, are on the net all year around!

"I have no doubt that what the Trump team wants to do is win the electronic vote on Election Day, and then try to run out the clock or do something else with the [absentee ballot] signature match, so that we don't get all of them counted," she tells Cohn argues. "Or, if it goes to a recount, it gets shut down prematurely," she says, noting correctly that Vote-by-Mail ballots are also "sent to that electronic management system too."

Cohn also discusses some of her worst fears about this year's elections (and I share some of mine, several of which are similar, especially regarding electronic pollbooks which often have no paper backup) before we take a few phone calls from listeners on the topic, with Election Day now just 50 days away. "It's going to be ugly, no matter what the official result is," she says, noting: "My biggest concern --- the overarching concern that I think we both share --- is that there won't be any transparency about the results, and therefore we'll never really know."

Foreign and domestic election interference continues. So does our effort to help you make sense of what's actually going on...

We've got a lot to get to on today's BradCast, as voters in Massachusetts go to the polls today with a couple of very interesting primary races (results tomorrow!), and as the rest of us are now counting the days (63 of them), until general Election Day, with both hope and trepidation. Among the mountains o' stuff covered on today's program...

  • After years of our reporting on the very successful, perhaps irreversible, decades-long effort by the Right to brainwash its followers, we open today with a few thoughts about a similar, if not quite as successful (though it's getting closer), effort to brainwash those on the Left. That effort to brainwash the Left, like the scheme on the Right, is also carried out by folks on the Right or those who support them. (And yes, that means we have a few words today about the still-misreported facts regarding the Hillary/Bernie race from 2016);
  • We have more evidence of attempts to manipulate the Left in today's announcement from Facebook that, based on a tip from the FBI, the social media outlet has shut down several fake accounts created to support a Russia-related propaganda scheme targeting the Left in hopes of undermining Joe Biden and Kamala Harris. The operation reportedly included a phony media outlet calling itself "Peace Data", in hopes of appealing to progressives in advance of this year's election;
  • Information of that sort, as we discuss, is --- or should be --- useful to voters. Nonetheless, with just over two months until Election Day, with Donald Trump's top intelligence officers having recently warned that Russia is taking active measures, once again, to undermine the Presidential election in support of Trump, his recently-appointed Director of National Intelligence John Ratcliffe notified Congress over the weekend that he will no longer offer in-person briefings to lawmakers regarding foreign attempts to interfere in the election. The claim, offered by Trump himself without facts to back it up, is that members of Congress were illegally leaking certain information from the intelligence community, and that the information leaked was also "wrong". No evidence was given to support that charge, and while Trump claimed the decision to end intelligence briefings to Congress was made by him and Ratcliffe, evidence suggests that it was, instead, a directive from Trump himself. For some reason;
  • Speaking of the November 3rd election, the dirty tricks are now underway, as revealed by a new robocall to some Democratic-leaning Michigan voters falsely warning that signing up to vote by mail will result in voters contact information being added to a database for tracking down arrest warrants, credit card debt collection and "mandatory vaccines". None of that is true. Though you should expect much more of it in the weeks ahead;
  • Also in Michigan, the state's Democratic Secretary of State Jocelyn Benson, recently won a court case filed by rightwingers attempting to prevent her from sending absentee ballot applications to all of the state's 7.7 million voters. The ruling --- in a state which Trump is said to have won by just over 11,000 votes in 2016 --- comes in the wake of his misfired threat to withhold federal funding from Michigan in a tweet in which he falsely claimed the "rogue Secretary of State" was planning to send out actual ballots (as opposed to applications) to all voters;
  • And while Trump and his minions have been suing in state after state in (usually failed) efforts to make voting more difficult during the global pandemic that he failed to control --- even attempting to block the use of secure absentee ballot drop-boxes in key battleground states like Pennsylvania --- another newly elected Democratic Sec. of State, Jena Griswold in Colorado, announced today that her state will offer "at least 368 mail ballot drop boxes for the General Election, an increase of 49% since I was elected in 2018!";
  • Also today, a somewhat bizarre comment from a reader/listener in response to our coverage yesterday of L.A. County's disastrous, unverifiable new touchscreen voting system, in which the commenters offers several odd allegations amid of my nearly 20 years of critical coverage of e-voting and asks "whose side are you on?";

Multi-State legal challenges expose illegality, but it may be too late to fully repair damage even if Trump's Postmaster General is ordered to do so...

Even if several multi-state legal challenges result in a federal court order directing Postmaster General Louis DeJoy to repair the damage wrought by his allegedly "illegal" sabotage of the U.S. Postal Service's mail delivery capabilities, absent significant additional funds, it's unlikely DeJoy could fully comply with that order.

The facts laid out in one of the recently filed cases and echoed in the others, along with subsequent developments, suggest that DeJoy was, at best, disingenuous when, in an August 18 formal statement [PDF], he claimed he was "suspending" his nationwide mail sorting, labeling and delivery changes until after the Nov. 3 Presidential Election.

The complaint describes how, pursuant to an Equipment Reduction Plan [PDF], Defendants removed, dismantled and/or destroyed 671 high-speed sorting and labeling machines that had a combined hundreds of millions of dollars in value. As a result, the States allege, "some major cities have already had their ability to sort mail reduced by hundreds of thousands of pieces of mail per hour." (Emphasis in original text).

On the same day that DeJoy issued his "suspension" statement, emails were submitted by Kevin Couch, the USPS Director of Maintenance Operations, informing Maintenance Managers that, irrespective of instructions from their plant managers, they must not reconnect or reinstall sorting machines that had previously been disconnected absent approval from USPS HQ.

Last Friday, while testifying before the U.S. Senate, DeJoy made it clear that he has "has no intention" of reinstalling the sorting machines, even as he claimed that election related mail would receive top priority from the Postal Service. Contrary to DeJoy's rosy predictions, however, the USPS's own Service Performance memo reflects a significant drop in overall performance which precipitated a USPS warning to 46 states that their deadlines for Vote-by-Mail ballots "might impede the timely delivery of mail-in ballots, possibly disenfranchising millions of voters"

While there's ample reason for a court to order reinstallation, absent significant additional USPS funding, which Trump opposes, it is doubtful that DeJoy could fully undo the damage even if he were ordered to do so.

VOTERS BEWARE: Do not be lulled into a false sense of security by DeJoy's "suspension" of changes at the USPS until after Election Day, or by his unsupported assurance that USPS can timely process and deliver every ballot. The wiser course, as laid out in our previously related article, is to deposit your mail-in ballots in secure, state-supplied drop-boxes (where available) or at designated drop-off locations. Check your local jurisdictions to learn what options may be available where you live. In some jurisdictions, voters can deposit their mail-in ballots at the polls either during early voting or on Election Day. In some jurisdictions, voters can link to election official websites to track the processing of their own ballots as well...

On today's BradCast: It was a big day for progressives on Tuesday in a number of state primaries held in Missouri, Michigan, Arizona, Washington state and Kansas. [Audio link to show is posted below summary.]

Surprisingly, among the biggest victories for progressives, believe it or not, came in the otherwise "red" state of Missouri, where voters adopted a statewide ballot measure to finally expand Medicaid under the Affordable Care Act (Obamacare) to more than 200,000 residents. The state's GOP-majority legislature had immorally blocked that expansion of health care to the Show-Me state's neediest residents for the past decade. MO now becomes the 6th GOP-controlled state to expand Medicaid via voter referendum.

But that was hardly the only big win for progressives in my old home state on Tuesday, as longtime progressive Ferguson and Black Lives Matter activist Cori Bush defeated 10-term U.S. Congressman William Lacy Clay for the Democratic nomination. Clay, with his father before him, had controlled the state's 1st Congressional District seat since 1969! With her apparent win on Tuesday in a very Democratic district that reaches from the City of St. Louis out through the sprawling St. Louis County, Bush --- a single mother of two children --- is now all but certain to become the first African-American woman sent to the U.S. House from Missouri.

We're joined today by HOWIE KLEIN, founder of the longtime progressive blog "Down with Tyranny!" and co-founder of the BlueAmericaPAC, which raises money to support progressive Democratic candidates for Congress. Klein walks us through both wins and losses for progressives from all five states on Tuesday, and what they are likely to mean going forward, with still more statewide primaries to go in the weeks ahead of our critical general elections on November 3rd.

He explains, among many other things, why Bush, who lost to Clay (who Klein describes as "corrupt") by 20 points in 2018, appears to have been victorious on Tuesday, when the Medicaid expansion measure also won. "The reason that this won was because of a huge turnout in St. Louis County and St. Louis City," he tells me. "One of the reasons why that turnout was so big was because of Cori Bush being on the ballot. Now, you could also say that one of the reasons that she won was because the turnout for expanding Medicaid was so big. Both are true. By her putting up such a vigorous campaign, campaigning on expanding health care, that's where the votes came from."

"That it was her second time running and she had the name recognition," was also a major factor, he says. "I can't emphasize that enough. It's very, very tough --- not impossible --- but very tough to win a primary the first time you go up against an entrenched incumbent. Because Cori was strong, a powerful woman who wasn't going to give up after being defeated by a lot the first time, she already had name recognition. She was able to build on that to win the second time. I think that's the most important aspect of her winning." He adds that he believes she'll become the fifth member of "The Squad" in Congress, along with NY's Rep. Alexandria Ocasio-Cortez, MN's Rep. Ilhan Omar, MA's Rep. Ayanna Pressley and MI's Rep. Rashida Tlaib, who also appears to have easily won her re-nomination on Tuesday. "She's going to get to Congress," says Klein. "She's gonna kick ass."

We also discuss much more today, including what the predictable loss of disgraced former Kansas Secretary of State and GOP "voter fraud" fraudster Kris Kobach in that state's GOP U.S. Senate Primary means to Democrats hopes of retaking the majority in the upper chamber next year and how the Republican and Democratic party's are each changing amid the Trump Era.

Also today, 88-year old disgraced GOP felon and former Maricopa County, AZ Sheriff Joe Arpaio may still be in the running for his old job, even after being convicted of contempt of court and corruptly pardoned by Donald Trump; Indicted GOP Congressman Steve Watkins of Kansas, who was recently charged with three felony counts related to voter fraud (almost the exact same crimes Trump committed himself in Florida), loses his Republican primary in the state; and Iowa's Republican Gov. Kim Reynolds does the right thing for a change in signing an Executive Order to end the permanent loss of voting rights for (most) former felons in the Hawkeye State, after the Republican-controlled state Senate blocked a more permanent state Constitutional measure and as other states seek to further expand the franchise for felons both in and out of prison around the country.

Finally, it was announced today that Joe Biden would not be traveling to Milwaukee to give his party's nomination acceptance speech, due to the COVID crisis, at the their virtual convention, and Trump announced he was considering giving his own acceptance speech (unlawfully?) from the White House...

It was some weeks ago that we warned listeners to "buckle up" for what was to come over the next several month in the lead up to Election Day (and for whatever nightmares are likely to come thereafter).   • Breaking at top of show - Trump cancels plans for Republican National Convention in Jacksonville, Florida due to out-of-control coronavirus surge in the Sunshine State. That, after previously moving the convention from Charlotte, North Carolina because the state's Democratic Governor wouldn't allow a maskless deathtrap convention;
  • Federal Judge orders former Trump lawyer Michael Cohen to be released from prison, citing "retaliation" by the federal government after he was removed from home detention and locked back up for refusing to sign a document vowing he wouldn't write a book or speak to the media about Trump. Cohen had previously been furloughed from prison and placed into home detention after one year of his three year sentence for lying to Congress to protect Donald Trump and participating in a hush-money conspiracy "directed" by the President, according to both him and federal prosecutors. Trump remains uncharged and at large despite running the conspiracy Cohen was imprisoned for in paying off porn star Stormy Daniels and model Karen McDougal to keep quiet before the 2016 election sexual affairs with Trump. The judge excoriated the DoJ and Bureau of Prisons for violating Cohen's First Amendment right to free speech;
  • Trump sycophant and Florida Governor Ron DeSantis finally begins to wobble on his demand that schools in the state reopen next month for five days a week in-person classes, despite explosion of coronavirus cases. Tells Fox "News" that parents should have the "option" of sending kids to class, but offers no such "option" to teachers, whose union is now suing DeSantis;
  • Republicans are in disarray in Congress and at the White House after denying (for months) the need for additional emergency economic relief amid the pandemic. That, as expanded unemployment benefits --- one of the few actions taken by Congress that has successfully helped to avoid a complete economic collapse over the past 6 months --- are set to run out at week's end;
  • Breaking mid-show - New Fox "News" poll finds Joe Biden leading Trump, beyond the margin of error, in the key battleground states of Michigan (by 9 points) , Minnesota (by 13 points) and Pennsylvania (by 11 points);
  • Portland, Oregon Mayor Ted Wheeler was among those tear-gassed by Donald Trump's federal stormtroopers on Wednesday night. The Mayor, whose local police force had previously tear-gassed protesters who have been gathering nightly for more than a month following the death of George Floyd in Minneapolis, now claims to be rethinking his own tactics while decrying "flat out urban warfare, being brought on the people of this country by the President of the United States";
  • In response to the violence being perpetrated by Trump's federal goon squad, John McCain's former Campaign Manager and longtime Republican campaign consultant Steve Schmidt unleashes a Twitter thread calling for Congressional investigations, cites Trump's use of the military against phony threats by "caravans" at the U.S. southern border before the 2018 election, and compares Trump's tactics, applauded by rightwing media, to those of Hitler's Nazi brownshirts;
  • Finally, a delightfully light-hearted Green News Report with Desi Doyen! Sort of. Other than a story about cow farts and Burger King, we also highlight the stunning arrest this week of Ohio's Republican House Speaker Larry Householder, nabbed as the ringleader of a $61 million conspiracy to funnel a $150 billion bailout to utility company FirstEnergy to prop up two failing nuclear plants and two aging, hyper-polluting coal plants at the expense of the state's rate-payers and renewable energy and efficiency initiatives in the Buckeye State. In a quick follow-up today, the company's stock price has plunged following the federal arrests this week, but questions remain about the company's own complicity in the scheme and the involvement of Ohio Governor Mike DeWine in last year's passage of HB6, the controversial boondoggle of a bill that resulted in Householder lining his pockets with millions in dark money from FirstEnergy and other utility company interests.

Hopefully your seatbelt is still on and will remain locked and in place until the chaos comes to a complete and full stop...if it ever does...

SCOTUS blocks 1.4M potential new voters in FL; Tough choice for TX voters diagnosed with COVID; Absentee ballots returned to Dallas voters; MI court blocks counting of tens of thousands of mail-in ballots...

I'm calling them Democracy Wars today. But I could just as easy call them Infinity Wars --- as the fight by so many for the right to vote and the fight by others to prevent them from voting at all --- never seems to end. But the name Infinity War may already be otherwise spoken for. [Audio link to full show follows below.]

Among the many stories covered on today's BradCast...

  • A couple in Ohio sends their kids to summer camp, with masks and social distancing in an area of the country with a very low infection rate. Days later, predictably, COVID breaks out at camp, kids and counselors get sick, everyone becomes terrified, overwhelmed and is quarantining. Just a preview of what you will begin to see when/if schools are ordered to prematurely reopen for in-person classes as soon as next month, as Trump and his Republicans are pushing for;
  • In Texas, Republicans recently went all the way to the U.S. Supreme Court to make sure only voters over 65 or those actively infected with COVID can vote by absentee ballot (with a doctor's order). Last Tuesday, the Lone Star state held its primary runoffs, but 68,0000 Texans were diagnosed with the virus after the deadline for registering to vote absentee and before the actual election. How many of them were then forced to endanger everyone else at the polling place or lose their right to vote? One couple's story of the difficult choices they were forced to make after recently contracting the virus after the deadline, and the nightmares they confronted in order to try and safely cast a vote (or not) under the state's absurdly restrictive absentee ballot laws;
  • The U.S. Supreme Court blocks a compromise today by a U.S. District Court judge in Florida that would have allowed as many as 1.4 million former felons to register to vote this year, after the state's Republican Governor and legislature passed a law to undermine the state constitutional amendment, adopted statewide in 2018 by an overwhelming 65 to 35 percent of the vote, to allow exactly what the GOP is now blocking. Hundreds of thousands will not be able to vote in the state's August primary, thanks to the stolen Republican majority at SCOTUS. That voter suppression may continue in the Sunshine State even through November's critical Presidential Election unless the new Republican majority on the 11th U.S. Circuit Court of Appeals works very quickly. But why would they? Expect much more of this between now and November. And it's a good time to familiarize yourself with the absurd, so-called "Purcell Principle", if you haven't already;
  • A three judge panel on a state court in Michigan, by a vote of 2 to 1 this week, has ruled that absentee ballots which arrive after the close of polls may not be counted. That, after voters expanded absentee voting via a statewide Constructional ballot measure in 2018 that allowed for voters to vote by mail during the 40 days prior to an election. If not overturned by the state Supreme Court, the ruling --- which seems wildly wrong on the law --- could result in tens of thousands of votes, cast and postmarked by Election Day, not being counted in November, in a state which Trump is said to have won by just over 10,000 votes in 2016. (That's especially troubling given this week's directive from Donald Trump's new Postmaster General to all USPS postal workers to slow mail delivery down, please!);
  • And then, quickly back to Texas, where absentee voters, prior to Tuesday's Primary Runoff Election Day, were mysteriously receiving their voted and mailed ballots back in the mail, for reasons still unknown;
  • Finally, Desi Doyen joins us for our latest Green News Report, as Joe Biden announces a major progressive proposal to fight climate change and create millions of jobs, while Donald Trump rolls back yet another landmark environmental law.

On today's BradCast: More bad news on the spread of the coronavirus and more bad news for Donald Trump --- though at least the latter is potentially very good news for America! [Audio link to full show is posted below summary.]

Vice President Mike Pence continues to beclown himself on behalf of Donald Trump, writing in the Wall Street Journal yesterday that "We are winning the fight against the invisible enemy" and that the Administration's response to the coronavirus is "a cause for celebration". That, as the U.S. has now seen over 2,000,000 infections and the COVID-19 death toll in our nation is at least as high as 119,000...and climbing.

On the same day Pence's op-ed was published, there was a record spike in cases was seen in at least six states on Tuesday, including Arizona, Florida, Oklahoma (ready for Trump's campaign rally on Saturday?), Oregon, Texas and Nevada. The Republican Governors of most of those states are either in denial or simply lying to their constituents about the deadly impacts of the virus in their states, suggesting that it's due to increased testing, while ignoring the record surge in the percentages of positive tests (Florida, Oklahoma) and hospitalizations (Texas, Arizona, Oklahoma). Oregon has a Democratic Governor, but their outbreak appears tied to 200 cases from a crowded Pentecostal church service held in late May, in violation of state restrictions. The other states all appear to have reopened for business far too early, as their Governor's downplayed the risk of the virus and the need for simple safety measures.

Democratic and Republican Mayors of the six largest cities in Texas have written an open letter begging Governor Abbott to allow them to mandate masking in their cities, pleading with him to "restore the ability for local authorities to enforce the wearing of face coverings in public venues where physical distancing cannot be practiced." Infectious disease epidemiologists (such as the University of Arizona's Dr. Purnima Mahdivanan, who we interviewed on yesterday's show) argue masking is one of the easiest, cheapest and most important ways to help stem the spread of the coronavirus. Abbott, however, is disallowing local municipalities to do so, even as he is blaming the increased infections on residents under 30 who, he says, are not wearing masks.

And yet, "we are winning," argues Pence, as he prepares to join Trump for his campaign rally in Tulsa, Oklahoma on Saturday after new cases rose in the state by some 68% over the past week. In all, at least 17 states saw a rise in new cases over the past week, giving new meaning to Trump's May 2016 remarks at a rally in Billings, Montana, when he said: "We’re going to win so much, you’re going to be so sick winning!"

In the meantime, while Americans are sick and getting sicker, Donald Trump appears to be badly losing, not winning, in a number of key battleground states across the country. New state polling finds him losing to Joe Biden by double-digits in both two new polls in several new polls in Michigan and Florida (where his 22% advantage in 2016 over Hillary Clinton among voters 65 years of age and older has plummeted some 31% since(!), resulting in a 9 point lead for Biden among that group in the Sunshine State.) Formerly "red" Arizona now also appears to be falling into the Biden column, with the latest poll finding the former Veep up by about 4 points. Even Georgia and Iowa, both traditionally solid Republican states are now polled as toss-ups, with Biden up by 2 in GA and Trump up by just 1 in IA. We dig into some of the details from those polls.

That said, Trump has come back from bad poll numbers before. Our guest today, Roosevelt University political scientist DAVID FARIS, however, tempts the gods by arguing in his latest column at The Week that "This time is different for Trump". Why does he believe that? He joins us to explain --- and to take a few challenges from me on that point...

* If 'Greatness' means record unemployment and tens of thousands of unnecessarily dead Americans..

Remember waaay back on Monday when we warned you to take the news from biotech company Moderna about their self-proclaimed early success in tests of a coronavirus vaccine with a huge grain of salt? The announcement that spiked their stock price some 50% in one single day and resulted in a 900 point rally for the Dow? Well, the market is still enjoying its irrational exuberance, but Moderna's stock price is largely back to where it was before Monday's "science by press release". Not to be a party pooper before the Memorial Day weekend, but that seems an apt analog, somehow, for much of what we cover/warn about on today's BradCast. [Audio link to full show is at bottom of summary.]

Donald Trump and his Republican henchmen in Congress are running into a problem. Pretending the coronavirus crisis away only goes so far. Sure, you can announce that you have "reopened" for business, but that doesn't mean anybody will show up. Even with all 50 states now relaxing various restrictions, demand remains low and, therefore, unemployment remains high and is still getting higher each week.

New numbers from the U.S. Dept. of Labor report that 2.4 million Americans filed new unemployment claims last week. It is the ninth week in a row of new claims higher than 2 million --- some weeks were larger than 6 million --- even though the all-time weekly record, prior to COVID-19, was less than one million. Even during the 2008 Great Recession, initial claims for unemployment insurance never topped one million. The good news is the number of new filers has been decreasing in recent weeks. The bad news is that almost all of those people, nearly 40 million of them, remain out of work. For now, however, they have been able to rely on expanded benefits enacted by Congress that offer an additional $600 a week through the end of July. The program was designed to, yes, keep people at home in order to slow the spread of coronavirus.

Those payments have, by and large, prevented the U.S. economy from tanking entirely. And now, Republicans in Congress are insisting that they will not extend those benefits, as they join Trump in trying to convince themselves and the nation that the crisis is over. It isn't. Not by a long shot. Ending that expansion of unemployment right now in hopes of forcing workers back to their jobs --- where they may well get sick and die, just as had been happening before the shutdowns --- in hopes of restarting the economy, is likely to kill the economy entirely, according to economists, anyway. But what do they know? We discuss.

In lieu of an actual plan --- versus a Jedi Mind Trick --- to prevent a new rise in infections and deaths, Trump and his GOP pals seem prepared to hide the statistics and otherwise distract us with things like a new, wholly (and statutorily) unqualified Director of National Intelligence! Gutting a long-standing arms control deal with Russia! And trying to blame Obama for all sorts of imaginary scandals in hopes of harming presumptive Democratic Presidential nominee Joe Biden.

It shouldn't work. But, given our gullible corporate media, who knows? Satirist Randy Rainbow, however, has a new musical take on it all for us today.

While Republicans on Fox "News" are instructing their "patriotic" American cult members to get out there and get back to work, their star anchors continue to do so from the safety of their own home studios, where Fox Corp has directed them to remain for at least another month. YOU are supposed to die for the economy and the President's reelection! Not THEM!

And the irrational exuberant premature reopenings could well make a huge difference in the ultimate COVID-19 death toll, if a new study about the timing of the initial lockdowns from Columbia University disease modelers tells us anything. They find that a heart-breaking 36,000 fewer Americans would have died if the country had implemented stay-at-home restrictions just one week earlier in March. Moreover, the researchers found, had shutdowns occurred on March 1 the vast majority (83%) of deaths would have been avoided. Each single day that Trump and Governors around the country ignored or refused too take the crisis seriously resulted in the unnecessary loss of thousands of American lives.Depending on how quickly and/or irresponsibly states now lift restrictions, many more thousands of lives could be lost. Given the way a number of GOP-run states are now attempting to hide or censor infection and death rates, the cost could ultimately become unspeakable.

Another new study from the University of Wisconsin and Ball State University offers a real life example of all of this. The analysis found that last month's primary election in Wisconsin --- when the state's rightwing Supreme Court blocked attempts by Democratic Gov. Tony Evers to postpone the election or switch it to an all Vote-by-Mail election --- resulted in a "statistically and economically significant association between in-person voting and the spread of COVID-19 two to three weeks after the election." They found that WI counties "with higher levels of in-person voting per polling location led to increases in the weekly positive rate of COVID-19 tests. Furthermore, counties with higher absentee voting participation had lower rates of detecting COVID-19 two to three weeks after the election."

Yes, these decisions matter. Lives hang in the balance. No matter the Jedi Mind Trick Trump was hoping to pull off when he recently declared: "We're opening up; the states are opening up. It's a transition to greatness!" Perhaps "greatness" is now just another word for mass murder.
