On today's BradCast: What's in it for Donald Trump? Seriously. Why does he want to break the government? [Audio link to full show follows this summary.]

I know why Elon Musk wants to dismantle and destroy the federal government piece-by-piece (so his government contracts can't be policed or businesses regulated, etc.) And I understand Trump's need for retribution against his perceived enemies. But why does Trump want to seemingly dismantle damn near every federal agency, from the U.S. Forest Service to USAID and beyond, no matter how ham-handedly? No matter how much it grows (not shrinks) the national debt, no matter how many Americans (including his own voters) it puts out of work, and no matter how much the chaos he is wreaking continues to sink his approval ratings? No matter how much none of his flailing lowers the price of eggs.

It's certainly not in the name of "efficiency" or cutting "waste, fraud and abuse", as the evidence makes plain, no matter how many lies and quickly disproven claims about "million and millions" of dead people receiving Social Security checks or Musk's DOGE Bros claiming to have "saved" at least $55 billion in Government contracts to date. (It's more like $2 billion.) All false claims that both Trump and Musk repeat, only to have to walk them back when proven wrong, time and again.

We discuss a lot of that at the top of the show, along with a bunch of related news headlines from over the weekend, before opening up the phones today to listeners for answers to that simple question: What's in it for Donald Trump? Why does he really want to dismantle the government?

We talk to a lot of callers with a lot of differing explanations (though being controlled by Vladimir Putin seems to be a listener fave...even if it doesn't fully answer all of my questions about Trump's behavior here.)

Perhaps Trump's recently-confirmed Sec. of the Treasury, Scott Bessent, gave away the truth on Fox "News" over the weekend, when he falsely claimed that Trump ran on "reprivatizing the economy". He didn't run on that. Though Project 2025 --- which he pretended to disavow during the campaign --- certainly called for it. Is that his game? Cripple federal government so private corporations can then fill the gap and offer the same services to the American people for a higher price that includes profit to those private corporations?

We can't fight every stupid, idiotic, dangerous or perilous thing during the Trump Era, can we? I know I can't, personally. But I don't speak for everyone else. And one person's stupid or idiotic may be another's dangerous or perilous. An interesting debate over picking battles and who gets to decide which ones should be waged is at the heart of today's BradCast. [Audio link to full show follows this summary.]

FIRST UP... however, speaking of dangerous, Donald Trump lackey and MAGA merchandiser (or "sycophantic suck-up" as Sen. Sheldon Whitehouse accurately described him today), Kash Patel was confirmed for a ten-year term as FBI Director by cowardly, sycophantic suck-up Republicans in the U.S. Senate today. All Democrats voted against him. Just two Republicans (Collins and Murkowski) joined them.

Aside from being wildly unqualified and publishing an "enemies list" of so-called "members of the Executive Branch deep state” that he vows to target, Patel also pleaded the Fifth to avoid implicating himself in crimes during grand jury testimony regarding his role in Trump's theft of thousands of pages of highly classified national security documents; was paid $25,000 by Russian propagandists to appear in an anti-FBI documentary series; appears to have millions of dollars linked to Chinese interests through shell corporations in the Cayman Islands; and, according to whistleblower allegations cited by the Ranking Member of the U.S. Senate Judiciary Committee, appears to have committed perjury during his Senate confirmation hearing.

Other than that, he sounds like the perfect choice for FBI Director! Donald Trump has done it again! Did I mention Patel also publicly vowed, as recently as last December, to "come after" journalists "who lied about American citizens, who helped Joe Biden rig Presidential elections"? (So much for the First Amendment, even if Patel remains a fan of the Fifth.)

THEN... Speaking of the First Amendment and protection of the free press, we recently reported on the Trump White House's attempt to violate the First Amendment by barring the Associated Press from White House events unless and until the 178-year old international media organization agreed to change its Style Guide to refer to the Gulf of Mexico as the "Gulf of America".

On the surface, it seems like a pretty minor fight, given everything else the Constitutional order is up against. But, upon closer examination, it really is fight over basic Constitutional rights. As NYTimes' opinion writer Jamelle Bouie accurately characterized it at Bluesky, "your willingness to accept this gulf of america nonsense is an indication of your willingness to accept much worse things coming from this administration."

Meanwhile, over The Atlantic, Senior Editor Gilad Edelman doesn't have any such concerns, and even appears to be victim-blaming by suggesting the fight is one that "the AP probably should never have picked in the first place."

That brief article by Edelman recently touched off our guest today, longtime media critic, political strategist and writer, JAMISON FOSER, who wonders, in a recent article, who Edelman thinks he is to decide which fights are worth waging in the Trump Era and which are not.

"I think the nature of the situation that we're in," Foser tells me today, "and the breadth and depth of the ways that we are in trouble, and things are stacked against us --- an autocratic movement has control of our entire government, much of the news media, much of the ways that people get information online --- things are really stacked against us."

"We are not in a situation in which there are obvious, clear, easily discernible, winnable fights we can choose. So this idea that people should only choose fights that they can win --- I think people should choose the fights that feel right to them. We should all be doing a little less trying to police what fights other people are choosing to engage in, and more finding a place where we can stand up and pick a fight where we can," he argues.

"We will probably lose it," he concedes, "because we will probably lose most of them. But sometimes in the loss there is some value. In this one [AP's defense of First Amendment freedoms] there is some value. There's value in saying, 'We can't stop Donald Trump from ordering his government to refer to the Gulf of Mexico as the Gulf of America. But we can say we are not going along with that. It is racist, and dumb, and he can't make us say it. There's value in saying that to ourselves, in not giving in to his attempt to control the English language. And there's value in showing our fellow Americans that we are not going along with that."

In AP's case, all they were doing was following the Style Guide they have used for decades. And Edelman still characterized it as a "fight" they "should never have picked."

Today on The BradCast: The last 4 or 5 days since Elon's DOGE Bros have, with the apparent permission of Trump, started taking command and control of computer systems and databases at federal agencies --- including the U.S. Treasury's system which pay out nearly $6 trillion per year --- have been, to say the least, chaotic, disturbing and insane. [Audio link to full show follows this summary.]

As we discussed yesterday, Trump, his co-Prez and their flunkies are unlawfully taking over and disassembling the U.S. Constitutional order and its Administrative State. In response, however, their lawless overreach also seems to be having the effect of coalesce the Opposition in a number of ways...

• Career federal agency insiders and whistleblowers are either pushing back against assaults on their agencies or otherwise informing the public of what is happening inside them;
• Civil lawsuits are being filed by both affected individuals at the agencies and by outside groups attempting to enforce the rule of law, informing the public of what is going on inside those agencies in the bargain.
• Public pressure is being brought to bear on elected officials through phone calls, attendance at protest rallies, etc.
• Democratic elected officials seem to be having a fire lit under them by all of this, and are finally beginning to lead rallies and take other actions in their overdue Opposition roles.

That is not an exhaustive list. For example, the free press, where we still have one, also play a key role in all of the above. In helping to let you know what is actually happening, public perception and opinion can change. From a wildly disinformed electorate last November to, perhaps, a more accurately informed populace as we all move forward and take action on those things, with at least some of the urgency that this historic moment demands

An Opposition is emerging. How effective and sustained it will be remains to be seen. But, I believe the outlines are finally beginning to coalesce. At least, I hope that is the case.

Today, we report some of the stories, connect some of the dots, and share some of the signs of that emerging Opposition, through a number of breaking news items over the past 24 hours or so...

• Trump's dumb new tariffs on China are bouncing back, raising energy prices for Americans.

• Disgraced Gen. Michael Flynn's stunning threat against insiders at CIA, FBI and the Office of the Director of National Intelligence who dare speak up against Trump's wildly unqualified nominees for HHS (RFK Jr.), Director of Nat'l Intelligence (Tulsi Gabbard) and FBI Director (Kash Patel).

• After the Acting FBI Director last week tried to courageously stand up to Trump's personal defense lawyer turned Acting Deputy AG at the DoJ, the Bureau turned over answers to questionnaires from some 5,000 employees who were assigned to work on January 6 cases. The head of the FBI's New York field office vows to defend his agents against the Administration's unlawful purges. The FBI Agents Association advises its members: "Do NOT resign or offer to resign." Lawyers for DoJ prosecutors and FBI agents threaten to sue against "violation of due process rights."

• Sen. Brian Schatz (D-HI) vows to place a "blanket hold" on all of Trump's nominees to the State Dept. until the Administration pulls back its attack on --- and DOGE Bro takeover of --- USAID.

• Trump prepares an Executive Order to shut down the Dept. of Education, even though he can't actually do so without approval by Congress, which he will not receive. Musk's DOGE Bros have reportedly now moved in there as well, and are said to be scheming to cut spending and staff while accessing sensitive computers systems with personal information on millions of students who have received financial aid.

• Federal employee unions and advocates for retired Americans sue to block Musk's DOGE Bro takeover of the U.S. Treasury Department's payment system. And who is it who has gained access to the incredibly sensitive computers that handle payments of some $6 trillion, annually, in Social Security checks, Medicare payments, veterans benefits, tax refunds, federal worker paychecks and almost everything else the U.S. pays for? Apparently, it's a 25-year old employee of Musk's named Marko Elez who has remarkably been allowed to obtain full access and Administrative privileges to the system, to cut off payments, and even rewrite the incredibly sensitive and (previously) highly-guarded code that handles some 95% of spending by the U.S. Department insiders are flabbergasted and speaking to the press about what is going on.

All of these stories, as terrible as they are, actually include positive indications of an overdue Opposition finally beginning to assemble.

With apologies to Rick Wilson, whose weekend social media quip I've stolen for the headline of today's BradCast, I'd say both things are true. We are both overwhelmed and under attack. In a way that the United States has never been under attack before. [Audio link to full show follows below this summary.]

The "attack", of course, is coming from inside the house. In this case, from inside Donald Trump's White House. Or, at least from his extra-Constitutional White House henchmen: Elon Musk and his band of personal employees, none of who have been elected to anything or approved by the U.S. Senate or anything else. And yet, this band of miscreants that call themselves the "Dept. of Government Efficiency" or DOGE, some just literally out of high school, are unlawfully taking over the command and control functions of independent federal agencies in the Executive Branch, including the one that at Treasury that controls the nation's actual checkbook and its payments of more than $6 trillion each year. That system includes checks to federal workers, Social Security and Medicare payments, tax refunds, foreign aid and much much more.

They are doing all of this, apparently, with the lawless President's blessing. It is a Trump-approved attack on the rule of law, our Constitutional order, and, of course (the enemy of all MAGA!) the "Administrative State".

Doing my best today to overcome some local transmitter issues here in L.A. and technical issues inside our flagship local KPFK studios during our live show, I tried to put into stark perspective what appears to be unfolding --- what we know and what we don't, some of the heroes standing up in opposition --- over the past 72 or so unprecedented hours since we last spoke.

Today on The BradCast: The first of what will likely be a series of contentious U.S. Senate advice and consent hearings for key cabinet nominees tapped for the second Trump Administration. Tomorrow seven such hearings are scheduled, most of them overlapping with each other, purposely making public oversight even more difficult. [Audio link to full show follows below this summary.]

Fox "News" weekend host, National Guardsman, accused sexual assaulter, womanizer and public drunkard Pete Hegseth faced a grilling from U.S. Senate Democrats on the Armed Services Committee on Tuesday, even as they were constrained by Republicans who agreed to just one single round of questioning, with just seven minutes for each member. They also refused to share an FBI background report on Hegseth with rank-and-file Committee members.

That, after Hegseth similarly refused to meet directly with any Democratic Senators on the panel in advance of today's hearing, which is usually the custom for such high-profile nominations. Moreover, late on Monday night, the New York Times reported that --- similar to the 2018 report compiled on sexual assault allegations against Justice Brett Kavanaugh during his Senate nomination hearings --- the FBI failed to conduct in-depth interviews with critical witnesses, such as Hegseth's second of three wives, who have made disturbing allegations against him.

The Times observes that Trump's transition team "commissioned the F.B.I. background check on Mr. Hegseth last month after initially floating the idea of hiring private contractors to look into the president-elect's cabinet picks. As the client, presidential transition teams are traditionally able to set the parameters for background checks into cabinet picks, and potentially dictate which witnesses are interviewed and what questions are asked."

Taken together --- as we do on today's show with extended excerpts from today's hearing --- the allegations against the wildly unqualified and ill-considered Hegseth are simply mind-blowing, particularly for such a key role as leader of the Pentagon's three million employees and oversight of its annual $850 billion budget. The Trump nominee has no experience at the Pentagon, much less leading an organization with more than 40 or so employees. And, he's faced allegations of financial mismanagement at both of the veterans non-profits he has overseen, along with a long list of other charges, including rape, that he defiantly (and inaccurately) described at today's hearing as coming from "anonymous sources."

Still, it became clear throughout the hearing that Hegseth would face no resistance whatsoever from any Republican on the panel, including military vet and sexual assault survivor Sen. Joni Ernst of Iowa. Shortly after the hearing, she declared her intention to vote to confirm the 44-year old Trump nominee who has repeatedly asserted that women have no place in military combat roles.

Finally, we've got late updates in the still-raging Los Angeles Fires out here, where officials gained a measure of additional containment of the two major blazes --- in Pacific Palisades near the coast and of the Eaton fire, inland in Altadena and Pasadena --- in recent days. However, the National Weather Service issued yet another "Particularly Dangerous Situation" warning overnight for parts of L.A. as strong Santa Ana winds are expected to kick up again tonight and throughout early Wednesday. As we saw last week, that could result in explosive new fires or the quick expansion of those that are now entering a second week of disaster, destruction and death.

Still trying to make sense of it all on today's BradCast. But at least we've got confirmation today on a few different stories that we've been yelling and screaming about for years now. [Audio link to full show follows below this summary.]

Among our stories today...

• A hand-count of ballots in Ashtabula County, Ohio last week found that two contests on the ballot --- one, a tax levy to fund city schools, the other, to fund a cemetery district --- were actually adopted by voters on November 5th, after previously being reported, inaccurately, as having failed. The hand-count in the contests took place after errors were discovered in the tabulation for all County Issues on the ballot during a hand-count of a fire district levy, which also flipped from NO to YES, thanks to the hand-count.

  Tomorrow, the 2024 Presidential Electors, chosen by the popular vote in each state, will meet in each state capital to cast their vote in the Electoral College. A majority of those votes will be cast for Donald Trump, based on the computer-tallied results in each state. Those results either accurately reflect the intent of the majority of the electorate --- or they do not. Without the publicly-overseen hand-counts that cybersecurity and voting system experts were strongly recommending this year in particular (we think it's a good idea for every election), Americans are unlikely to ever know one way or the other if Trump actually defeated Kamala Harris. At least in Ashtabula they now know that their levy issues were tallied as per voter intent, and the local high school which saw its roof collapse in early December under five and a half feet of snow, will now be able to afford to fix the damage.

• Former FBI informant Alexander Smirnov pleaded guilty on Monday to lying to federal agents about a supposed $10 million in bribes he falsely claimed were paid by Burisma, an energy company in Ukraine, to Joe Biden and his son Hunter. Those lies, which Smirnov said were peddled to him by members of Russian intelligence, were at the center of House Republicans' failed attempt to impeach President Biden, after they and Trump and his other supporters laundered that disinformation from Russian intelligence operatives into the American media and chambers of the U.S. Congress.

• Over the weekend, CNN reported that nearly three dozen of Donald Trump's nominees for his incoming Administration were donors to his campaign or to "outside" groups supporting him. Eight of Trump's nominees to Cabinet positions, so far, donated more than $37 million dollars. That doesn't even include the $277 million dollars spent by Elon Musk to help buy Trump's Presidency and his position of power within it. Musk has been named to head up Trump's so-called "Department of Government Efficiency." Compare that to the seemingly paltry $100,000 in donations to the 2020 Biden Campaign or super PACs supporting him, from a dozen members of Biden's Cabinet. As Sen. Bernie Sanders (I-VT) noted this weekend on Meet the Press, "Never before in American history have so few billionaires, so few people, had so much wealth and so much power. And never before, in American history, have the people on top had so much political power. We can't go around the world saying, 'Oh, well, in Russia, Putin has an oligarchy.' Well, we've got an oligarchy here too!"

• Of course, it's not just those hoping to abuse positions of power in Trump's next Administration. Over the past week, Amazon founder (and Washington Post owner) Jeff Bezos and Facebook CEO Mark Zuckerberg each announced their companies were giving $1 million to Trump's inauguration fund. And over the weekend, ABC News --- owned by the Goliath, $200 billion Disney corporation --- announced they were settling a defamation case filed against them and George Stephanopoulos after the ABC anchors' on-air assertion that Donald Trump "had been found liable for rape" in the lawsuits filed against him by writer E. Jean Carroll, in which juries found Trump liable for some $88 million dollars after guilty verdicts for sexual abuse and defamation. The case they chose to settle would likely easily have been won by ABC for a number of reasons, including the fact that the Judge in Carroll's defamation case against Trump told the jury that the jury in the sexual assault case found Trump was indeed found guilty of what "many people commonly understand the word 'rape'" to mean. Instead of fighting, however, the Disney-owned company bent the knee, agreed to issue an apology, give $15 million to Trump's future Presidential Library fund as a "charitable contribution", and $1 million to his law firm. Why would they do that? Josh Marshall offers an excellent explanation, citing how legacy media outlets like ABC News and Washington Post (along with CNN, NBC, MSNBC and others) amount to a drop in the bucket to the major corporations which own them. While those corporations are willing to sacrifice their money-losing news outfits, they are willing to pay tribute to the "King" to help dissuade him from abusing his power to go after the rest of their multi-billion dollar corporations that are far more vulnerable to abuses of power by a corrupt President.

• Finally, we open the phone lines to listeners on all of the above --- or whatever else is on their minds today --- in what is likely to be our last call-in show of the year. And, for reasons I cannot explain, they were all suspiciously kind today. Hmmm....

Among today's stories of note...

• In the largest single-day act of clemency in modern U.S. history, President Joe Biden commuted the sentences of some 1,500 people today who were released from prison to home confinement during the COVID pandemic. As discussed, he also promised "more steps in the weeks ahead."

• The Dept. of Justice's Inspector General released a long-awaited report [PDF] today on the FBI's preparation for what became Donald Trump's January 6, 2021 attack on the U.S. Capitol. Despite years of false claims by MAGA Republicans, including members of Congress, that undercover FBI employees somehow instigated the attack, the I.G. report finds, among other things, that none were present at the Capitol that day.

• Inflation and, specifically, high prices at the grocery store have been cited by many as the reason for Donald Trump's apparent election victory last month. In fact, he ran on promises of lowering prices at the grocery store "very quickly" throughout the campaign. In September, for example, he declared: "Vote Trump and grocery prices will come tumbling down". In October, he promised to "bring your grocery bill way down." And, in an interview that aired on NBC this past Sunday, he attributed his victory, in part, "on groceries" and said again that "we're going to bring those prices way down." Rarely did anyone in the media throughout the campaign press him on how he would lower the cost of groceries. So it seems voters were misinformed enough to believe him and vote for him. And yet, in an interview with Time before Thanksgiving just published today, Trump admits he has no actual plan to lower prices at the grocery store. "It's hard to bring things down once they're up," he told the magazine. "You know, it's very hard." We'll see how long it takes, if it ever does, for MAGA buyers remorse to set in.

• But you know who did help keep your grocery prices low? The Biden Administration's Federal Trade Commission. Biden's progressive Chair of the FTC, Lina Kahn, led a lawsuit against the proposed 2022 merger of grocery giants Kroger and Albertsons, arguing the $20 billion deal would raise prices for consumers and lower pay for the company's 700,000 union workers. This week, a federal judge agreed with the FTC and blocked the merger, at least for now. In the meantime, Trump's nominee to Chair the FTC, Andrew Ferguson (a former clerk for corrupt Justice Clarence Thomas), vows to abandon Khan's tough standards for mergers between powerful American companies.

• North Carolina Republicans took a beating in statewide races in November, losing the contests for Governor, Lt. Governor, Attorney General, Sec. of State and Superintendent of Public Instruction. They also lost their gerrymandered supermajority in the state legislature. So, while they still have the power to do so in their lame-duck session, Republican lawmakers, passed a massive bill under the guise of disaster relief for Hurricane Helene (which simply shifted already existing funding from one account to another) and used the next several hundred pages of the bill to strip many of the key powers from all of the incoming Democratic statewide officials. The outgoing Democratic Governor vetoed the obvious power grab. But, last week, the GOP-controlled Senate used their supermajority to override the veto and, despite an outpouring of protest from voters at the state capital, the GOP-controlled House did the same last night. Nonetheless, I suspect this fight ain't over.

• Finally, Desi Doyen joins us for our latest Green News Report on, among other things, the wildfire in Malibu, California that led to the emergency evacuation of thousands of residents, including film and TV legend Dick Van Dyke, who turns 99 on Friday. Also, on the effort by environmentalists to add Endangered Species Act protections to the quickly disappearing Monarch Butterfly. As Des mentions at the end of today's show, you can leave a public comment here in favor of the Fish and Wildlife Department's effort to protect the butterflies.

Hey! Happy "Certificate of Ascertainment of Appointment of Electors" Day! I know, it seems like it comes earlier and earlier every election year doesn't it? We take the festive opportunity on today's BradCast to discuss a few related points, including a bunch of new state criminal filed charges in the GOP's 2020 fake Electors plot and whether the convicted felon who is now our incoming President actually won a governing "mandate" (or not) in 2024. FIRST UP... The wildfire we discussed briefly yesterday out here in Malibu, California, amid exceptionally dry and windy conditions, expanded by nearly 40% overnight and was reportedly just 7% contained as of airtime. At least 7,500 structures are threatened and more than 12,000 people are under evacuation orders, including wealthy homeowners and celebrities such as Cher and Dick Van Dkye, students at Pepperdine University, and thousands of middle class and working residents in the community. The area is a geographic haven for such fires for a number of reasons discussed today, all of which has been exacerbated in recent years by our worsening climate crisis.

THEN... FBI Director Christopher Wray, who was appointed by Donald Trump after he fired James Comey for investigating Russia's interference in the 2016 election, has decided to "obey in advance" by announcing he will resign in January when Trump takes office again, three years before the official end of his term. The incoming President has threatened to fire Wray and replace him with loyalist stooge and avowed government weaponizer Kash Patel. Still, there are reasons to be critical of Wray's limp decision to "bow out in advance."

NEXT... Not all law enforcement officials are willing to roll over. In Wisconsin, state prosecutors added 10 felony charges each to three different Donald Trump accomplices who attempted to help him steal the 2020 election. The new criminal charges [PDF] were filed on Tuesday against 2020 Trump attorneys Jim Troupis and Kenneth Chesebro, as well as Trump's 2020 Election Day operations director Mike Roman as part of the failed fake Electors scheme in the state that year. Troupis and Chesebro are said to be the original architects of the plot. Each of the Trump dupes had previously faced just one felony count apiece, with their first court appearance set for Thursday. Now they will each face 11 counts and a potential 6-year prison sentence and/or $10,000 fine for each count if found guilty.

FINALLY... In the early morning hours following the November 5th Election, Donald Trump declared he had won an "unprecedented and powerful mandate." Members of his transition team subsequently claimed a "MAGA Mandate" and "historic mandate for his agenda." But, Trumpian hyperbole aside, did he actually win any such thing?

Now that all states have certified their results and officially declared which slate of Electors will vote in the Electoral College in each state capital on December 17 --- (remember, I told you today was the "Certificate of Ascertainment of Appointment of Electors" Day!) --- the final results, with all votes said to be tallied, reveal that Trump defeated Kamala Harris by less than 1.5 percentage points and that a majority of Americans voted for someone other than him.

That doesn't seem particularly "unprecedented" or "powerful", much less a "mandate".

But what is a mandate anyway? Today, we're joined by JULIA R. AZARI, Professor of Political Science at Marquette University, who happens to have written a book on that very topic, called Delivering the People’s Message: The Changing Politics of the Presidential Mandate.

As Azari warned in a short article posted the day after this year's election, when Trump's margin over Harris appeared to be far larger than it actually turned out to be, "Be wary of anyone claiming an election mandate," given that "talking about mandates flattens public opinion, rather than lifting it up" and "elevates the president above the Constitution and gives him a popular power he was never meant to have." As she explains today, that goes for Republicans and Democrats alike.

"I've been pretty critical of the way that Presidents of both major parties have used that concept," she tells me. "Although I would also note that, in contemporary times, Republicans have been a lot more focused and ideological in their mandate claiming."

Azari argues, essentially, that voters vote for and against many different things in an election, and there is no clear way to establish that they have voted for any one particular policy, much less in an election with one of the narrowest margins in modern history and where the winner of the Electoral College actually received a minority of the popular vote.

When any President-elect declares themselves to be the winner of a mandate --- or when the media echo that claim --- "this gives the President a little bit of extra power, at least in their own minds, that they feel justified in taking," Azari says, "and it enhances that power over that of Congress, rather than thinking of Congress as a co-equal branch."

She also notes: "When that power is in the hands of somebody who isn't really keen on Constitutional constraints, we may see some serious consequences."

We've got much to discuss with Azari on all of those points today. But what about Presidents who actually do win a majority of the popular vote? Do they have justification to claim a governing mandate? How should media report on such claims no matter who makes them? And how have claims of mandates been expanding and changing over the years going all the way back to the first such President to do so, Andrew Jackson in 1832? Among our coverage today...

• Before leaving for our Thanksgiving holiday, we had been covering, in some detail (see here and here for a start), concerns by longtime computer scientists and cybersecurity and voting systems experts about the accuracy of the results of the 2024 Presidential election. The bulk of their concerns center around unprecedented breaches of proprietary voting system software by Trump supporters in several different battleground states after the 2020 election. Systems were unlawfully breached and its software copied and distributed via the Internet to MAGA "Stop the Stealers". The experts have been calling on [PDF] Vice President Harris to seek hand-counts or partial hand-counts in several battleground states to confirm the accuracy of reported results. While we were off last week, another expert rang in. Jacqueline Singh served as the Lead Incident Response and Threat Analyst for the 2020 Biden-Harris Campaign. Last week she penned a brief, open letter to President Biden and Vice President Harris, urging them to seek "a comprehensive forensic audit" of the 2024 results, based on a number of issues that she argues "undermine confidence in the election results." Singh, "the cybersecurity lead" on Biden's 2020 campaign, explains why such an audit would "not only verify the accuracy of the vote count but also identify vulnerabilities that could threaten future elections." That said, I have neither seen nor heard any evidence that the Biden-Harris Administration, the Harris-Walz Campaign, or any other official body is even considering such a post-election audit beyond the few, minimal spot checks run by several states, much less a full or partial hand-count of paper ballots in states won by Biden in 2020 but reportedly lost by Harris in 2024.

• Over the weekend, Donald Trump appointed the fathers-in-law of his two daughters to top positions in his upcoming Administration. Tiffany's billionaire father-in-law Massad Boulos was named as Trump's senior White House advisor on Arab and Middle Eastern Affairs. Trump didn't bother to note his familial relation when making the announcement. The day before, Ivanka's father-in-law, convicted felon Charles Kushner (Jared's dad), was tapped to become the next U.S. Ambassador to France. In 2005, Kushner pleaded guilty to 16 counts of tax evasion; one count of federal witness tampering; and one count of campaign finance violation. His prosecutor, then-US Attorney (later NJ Governor and Trump ally) Chris Christie has described the case as "one of the most loathsome, disgusting crimes" he had ever prosecuted. Tune in to find out why. That said, Trump pardoned Jared's dad and his daughter's father-in-law for all of those crimes before leaving office in 2020.

• Also over the weekend, Trump announced plans to appoint longtime loyalist and MAGA merchandiser Kash Patel as the next FBI Director, even though the current Director, Christopher Wray (also appointed by Trump), still has three years left in his current term. The announcement suggests that Wray will be fired upon Trump taking office, unless he resigns first. FBI Directors serve 10 years in office in order to span Presidential administrations, in order to prevent the position from being politicized. Patel has vowed to weaponize federal law enforcement by bringing retribution against the so-called "deep state" and to prosecute Trump's perceived enemies at the DoJ, FBI and the federal government as a whole. He has also vowed retribution against Trump's perceived political enemies, promising to "go out and find the conspirators, not just in government, but in the media...who lied about American citizens who helped Joe Biden rig Presidential elections." Whatever, dude.

• And with all of that for context by Sunday night, President Biden issued a full pardon for tax and gun charges faced by his son Hunter Biden, despite previously vowing he would not do so. In his statement announcing the pardon, the President explained (correctly) that his son was selectively targeted by a Trump-appointed prosecutor for six years. "No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son --- and that is wrong," Biden explained. "There has been an effort to break Hunter --- who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution. In trying to break Hunter, they’ve tried to break me --- and there’s no reason to believe it will stop here. Enough is enough."

  So, did Joe do the right thing in pardoning Hunter, as many are arguing today? Or did he set a troubling "precedent" for pardoning family members that Trump will subsequently abuse when he returns to the Oval Office, as others have argued? Even as they apparently failed to notice that Trump already did that when he was in office the first time, issuing pardons to his daughter's father-in-law and dozens of other personal cronies.

Today on The BradCast: He hasn't even been sworn in and he's already violating federal law. Surprised? In this case, the law that he's violating is one that he himself signed into law in 2019. [Audio link to full show follows this summary.]

The flood of wholly-unqualified appointments to cabinet level posts and other top appointments, since Donald Trump barely won a plurality (not a majority) of the national popular vote two weeks ago, continues. You're probably well familiar by now with the nominations of alleged child sex trafficker Rep. Matt Gaetz for U.S. Attorney General, the nation's top law enforcement official, and of Fox "News" weekend host Pete Hegseth as Defense Secretary.

Neither have any experience leading huge organizations (or even medium-sized ones) with millions of employees --- or even any experience at all at the organizations they have been tapped by Trump to lead. And Hegseth, who was disqualified from serving in the National Guard during Joe Biden's 2021 inauguration as a potential "insider threat" due to his White Supremacist tattoos, was also revealed over the weekend by Washington Post to have paid off a woman to settle her accusations of sexual assault. He reportedly denies the rape allegation, if not the settlement.

The Trump Transition team claims they knew nothing about any of it when they selected Hegseth to head DoD. That should give you chills. Perhaps that's because the Transition team hired a private firm to vet Trump's nominees, rather than rely on the FBI, as they would be doing, had Trump complied with the bipartisan amendment to the Presidential Transition Act that he himself signed into law during his first term.

The measure also requires Presidential candidates to sign agreements with the White House and General Services Administration by October 1 before an election to begin the transition process with a publicly disclosed ethics policy and a public statement of how the future President plans to avoid conflicts of interest while serving, if elected. It allows for FBI vetting of incoming officials to grant access to classified documents and other material from the previous Administration at the nation's 438 Executive Branch agencies that they will control. Signing the agreement, as required by law, also includes a vow that Transition teams may take no more than $5,000 from any one person for certain transition costs, and that they will publicly disclose the names of those donors, among other things.

Donald Trump has, so far, refused to sign any of those agreements, alarming ethics, national security and legal experts as he begins defying federal law (again) even before taking office for a second term as President.

Joining us to explain the national security and other serious consequences and ramifications of all of this is LISA GRAVES. She is uniquely qualified to discuss these issues, given her service in all three branches of the federal government, as a Former Deputy Asst. Attorney General at the U.S. Justice Dept.; former Chief Counsel for nominations in the U.S. Senate; and former Deputy Chief for the Article III Judges Div. of the U.S. Court system. She now heads up the government watchdog and political research organization, True North Research.

We've got a lot to discuss with Graves today, beginning with what alarms her most about Trump's refusal to sign the Presidential Transition Act agreements. She identifies the avoidance of the FBI background investigation process as a "huge red warning flag."

"He does not want his cabinet appointees to go through the regular clearance process. The FBI background process is a long-standing part of the process," she tells me. It's "designed to help look at whether you have any issues that could made you blackmailable. That's part of it. For people who are seeking access to our most sensitive information, there are additional national security assessments. The investigators are looking at: do you have stability, trustworthiness, reliability, discretion. Do you have good character and judgment, honesty, and unquestionable loyalty to the United States to ensure that people who get positions of trust, with access to our most sensitive information, have unquestioned loyalty to the United States and not a foreign power."

Graves argues that "many" of Trump's nominees "have serious deficits in more than one of those categories." She also tells me that Trump's own "track record would raise serious concerns about his trustworthiness, his reliability, about his fitness for having access to information."

As to Trump's plans to force the U.S. Senate into recess, so that he may avoid the Constitution's mandate for "advice and consent" on top-level appoints, she describes the scheme as "un-American, unconstitutional, and unprecedented."

Was the Trump Campaign really hacked as they've recently claimed? If so, was it actually by Iran, as they also claim? And, If so, isn't that a far greater threat to national security than the corporate media reporting on it seem to understand, so far? Those are just some of the questions asked and answered on today's BradCast. [Audio link to full show follows this summary.]

BUT FIRST... before we get to our guest today with answers to those questions, another tropical storm has spun up very quickly this week in the record hot Atlantic Ocean. Desi Doyen has the latest today on the climate change-fueled Hurricane Ernesto as it blows by Puerto Rico, which is still rebuilding its crippled power grid from previous storms, and heads toward Bermuda.

NEXT... it was primary Election Day on Tuesday in Connecticut, Vermont, Minnesota and Wisconsin with Congressional and state primaries and even some ballot initiatives for good measure. We've got several noteworthy reported results from all four states after what appears to have been a smooth Election Day in all of them, along with a look ahead and what a number of the contests may portend for November.

THEN... You probably saw the headlines over the weekend about someone calling themselves "Robert" approaching Politico, New York Times and Washington Post with what they claimed to be internal Trump Campaign documents, such as vetting documents for GOP Vice Presidential candidate J.D. Vance. You probably also heard that the Trump Campaign is claiming they were hacked by Iran, and that Microsoft, just one day earlier, had issued a security bulletin [PDF] stating that a hacking outfit tied to Iran had "sent a spear-phishing email to a high-ranking official of a presidential campaign from a compromised email account of a former senior advisor." (That "former senior advisor" appears to be federal convict, Republican dirty trickster and longtime Trump buddy, Roger Stone.)

So, are all of those things actually connected, as the Trump Camp is claiming? And, after Donald Trump repeatedly lauded the publication of internal campaign email documents hacked from the Clinton Campaign by Russia in 2016, how hard should we now be laughing at his own 2024 Campaign spokesperson warning: "Any media or news outlet reprinting documents or internal communications are doing the bidding of America's enemies"?

It's difficult not to chuckle at how the worm has turned, but for our guest today, national security journalist MARCY WHEELER of Emptywheel, joining us to explain what is seemingly being missed by the mainstream coverage of the events --- accurate or not --- as noted above.

First, we try and sort out with Wheeler what is actually known versus still speculative, and how much of it could amount to Team Trump conflating events in hopes of playing the victim and/or protecting themselves from the publication of documents said by "Robert" to be marked as "privileged & confidential". It's certainly interesting to compare how the media have treated these internal campaign documents versus Hillary's in 2016.

But the larger concern, as Wheeler reports this week, is that since Trump doesn't seem to firewall his Campaign documents from the legal documents related to the many criminal cases against him, there are very serious concerns that whoever hacked his campaign emails --- if, in fact, they did --- may also have gained access to highly classified information related to those cases, such as the felony charges he is facing in Florida for having stolen highly classified national security information when leaving office in 2021.

"Donald Trump has not firewalled his campaign from his crimes," Wheeler tells me today. "If you were to hack their computer, it would be a gold mine. It would be a gold mine that would make all of us less secure."

"Remember, we know one of the documents charged against Donald Trump [in the stolen documents case] summarizes the 2019 plans against Iran if they attacked us," she warns. Also, there were documents pertaining to what we know about Iran's nuclear program. She says that, if in fact you have hacked email accounts from the law firm that was vetting J.D. Vance, "then you're getting a lot closer to things that go to Trump's stolen documents case. That's one of several reasons where, if the Iranians were successful, as Russia was [in 2016], you could have a snowballing effect on the national security implications here."

"Most normal humans beings firewall these things," Wheeler asserts, while detailing the way Trump's campaign business is known to have been co-mingled with his legal defense funding and more. "Donald Trump has never kept those separate. We know he hasn't kept them separate. Those are the reasons why the fact that Donald Trump may have been hacked raise additional concerns."

And, oh yeah, there is the newly revealed evidence, via the Dept. of Justice, that someone linked to Iran was recently working on an assassination plot against the former President. That, too, as she details today, plays into this initially hilarious and, on second thought, potentially horrifying turn of events...

On today's BradCast, we take up the President's charge to stand "in defense of democracy". [Audio link to full show follows below this summary.]

Among our coverage today...

• During President Biden's solemn, somber and historic prime time Oval Office address to the nation on Wednesday evening (transcript here), to explain his Sunday decision to drop out of the 2024 Presidential race and endorse Vice President Kamala Harris for the top of the ticket, he focused in no small part on the need to defend democracy against wannabe "kings and dictators," while he charged that "the cause of American democracy itself" is now at stake. "We must unite to protect it," he implored. We discuss and continue to join that fight.

• Meanwhile, as the U.S. House on Wednesday voted 417 to 0 to create a special task force to probe what happened during the July 13 assassination attempt on Donald Trump in Pennsylvania, FBI Director Christopher Wray testified on Wednesday that, in fact, nearly two weeks since the shooting, we have no idea "whether or not it's a bullet or shrapnel" that wounded Trump's ear. In fact, to date, no medical expert or law enforcement official has ever offered an official public accounting of what actually happened to the former President that day, even as mainstream corporate media have simply taken the social media claim by Trump, an inveterate liar, that a "bullet...pierced the upper part of my right ear" as fact. Ever since, Trump has exploited the event to claim at his convention, in rally speeches and on social media, that he "took a bullet for democracy."

  As we detail today, however, all available evidence suggests that is simply a lie. The man who, himself, has become the greatest threat to American democracy in modern history is now using the near miss for stolen valor to pretend to be a defender of democracy.

  As Ernie Canning explains at The BRAD BLOG this week, whether Trump "took a bullet" or not, it was not "for democracy," as investigators have reportedly found no evidence to suggest the shooting was politically motivated. And, as TPM's Josh Marshall has been reporting for some time, evidence suggests it was more likely some sort of flying shrapnel that grazed Trump's ear, along with causing similar minor injuries to several local cops who were near the stage that day. In any event, the media's failure to even ask the Trump Campaign about these details --- as one rally goer was actually killed and two others critically wounded that day --- for apparent fear of angering the former President, is "bizarre" and "a total journalistic failure" to the American people and to history. It also, as we note, underscores tyranny expert and author Timothy Snyder's repeated warnings about giving up power to would-be autocrats by "obeying in advance." Much more on all of this on today's show.

• We've got more details today on the DNC's plan to begin a virtual roll-call vote on August 1st next week --- well in advance of their August 19 convention in Chicago --- in order to finalize the party's Presidential and Vice-Presidential nominees no later than August 7th. Why are they doing this? No, it's not to ensure there are no challengers to presumptive nominee Kamala Harris. Rather, it is thanks to a story we've been covering since the beginning of the year about the failure by Republican state lawmakers to change the statutory deadline for submitting certified party nominees for the Buckeye State ballot by August 7th, as they've done for many years, as needed, when Republicans hold their national conventions late in the summer. Yes, state lawmakers, in a late special session, finally changed the statutory deadline. But the new law doesn't take effect until September 1, opening opening up Democrats to a potential legal challenge by Republicans as to whether their nominee can lawfully be on the state's ballot at all this November. Tune in for more details.

• More news "in defense of democracy" out of Ohio this week. A ballot measure for a state constitutional amendment that would create an independent redistricting committee has qualified for the November ballot! If adopted by voters, it could end the state GOP's wildly gerrymandered Congressional and state legislative maps for 2026. Otherwise, Republican Buckeye State politicians will continue to be allowed to choose their own voters, rather than vice versa, until at least 2030.

• And still more good news "in defense of democracy" from the Buckeye State today! A federal judge has struck down part of a sweeping election reform package adopted by Ohio Republicans last year that makes it a felony for disabled voters to allow caregivers, roommates, in-laws or even grandchildren to help them cast their absentee ballot by mail or drop box. The voter suppression law threatened to charge anyone but immediate family members (which apparently doesn't include grandchildren!) with felonies for helping those voters in need to cast their ballot. That, as the CDC finds that people with disabilities make up more than a quarter of the U.S. adult population.

Most of us, including President Joe Biden, who called upon Americans to "reject" political violence, may have been too quick to assume that the attempted assassination of Donald Trump on July 13 was politically motivated.

The FBI, by contrast, concedes that it hasn't identified a motive. That inability continued after an FBI search of the shooter's two cellphones failed to find "any indication of a motive, ideology or political views", CBS reported on July 17.

History reveals that not all high-level assassination attempts are politically motivated...

How many times did the disgraced, twice-impeached, four-time criminally indicted former President tell us he would "absolutely" be taking the oath to testify in his own defense at his 2016 election interference trial in New York? More times than we can count. Each time was a lie, as discussed among other matters on today's BradCast, as closing arguments are set to begin next week, before jury deliberations in the first-ever criminal trial of a U.S. President. Before we get to today's "ketchup" konversation on Trump's first criminal trial, we touch on a few noteworthy results out of primary and special elections in Georgia, Kentucky, Oregon and California on Tuesday, along with problem reports for voters and tabulation out of Georgia, Kentucky and, from last week's primaries, in both Baltimore and Prince George's County, Maryland.

Then, we're joined once again by award-winning columnist HEATHER DIGBY PARTON, of Salon and Hullaballoo, and former attorney and lifelong Republican KEITH BARBER, who now regularly blogs on legal matters as "KeithDB" at the progressive Daily Kos.

On Tuesday, the Defense rested in Donald J. Trump's criminal trial in New York on 34 felony counts related to a hush-money payment made to porn star Stormy Daniels in the weeks before the 2016 election, in a successful effort to help him cheat to win it. The trial has focused on the subsequent, allegedly falsified reimbursements made by Trump during his first year in the White House to his then lawyer/fixer Michael Cohen to cover it all up.

Last week, Cohen finished his testimony as the final witness for the Prosecution. This week, Robert Costello, a cartoonishly thuggish lawyer buddy of both Trump and Rudy Giuliani, took the stand as one of just two witnesses called by the Defense. After a turn last week before the GOP's U.S. House "Weaponization of Justice" Committee, Costello would be the final witness for the Defense, in what turned out to be a wildly failed effort to try and discredit Cohen.

We catch up on all of that today, as we discuss, among other things...

• Justice Juan Merchan's upbraiding of Costello during his obnoxious testimony as the Defense's star witness, turning what might have been a mild win for Trump following cross-examination last week of Cohen, into what both Parton and Barber characterize as a disaster for the Defense. According to Parton, "It was really stupid of them to call him, knowing that the prosecution already knew what he had to say...He was bombastic, he was rude. ... Costello looked like a hired gun."

• To the surprise of absolutely no one, Trump failed to take the witness stand in his own defense after all, following months of promising to do so. It may have been the only smart thing he has done to help his case during the entire trial. As Parton notes, "Trump saw him as a good stand-in for himself," as he was almost certainly testifying at the instance of Trump and against advice of counsel. It went at least as poorly for Costello as it would have gone for the former President turned current Defendant, had he taken the stand.

• Barber details what he sees as "the missing link" in the Prosecution's case and "the biggest weakness" in the Defense's cases; how the jury is likely to view Trump's lack of testifying in his own defense ("The jury will be strongly admonished by the judge to not consider Donald Trump's failure to testify"); and what exactly they will be charged with deciding when they are finally instructed by the judge --- likely beginning next week --- to begin deliberations.

• Parton discusses her biggest concerns about the case, and how the mainstream corporate media has failed, yet again, in its responsibility of accurately reporting on the threat to the nation represented by Trump. Barber casts more blame on his old party, the Republicans.

• And, in a related matter today, we turn to the federal criminal indictment against Trump down in Florida for stealing highly classified national security documents and refusing to return them to the Government. On Wednesday, earlier court documents related to the eventual search warrant executed at Mar-a-Lago, were unsealed, leading Trump to lie about the FBI being "locked and loaded" in an attempt to "assassinate" him during the search...when Trump was in an entirely different state.

With Democrats still wetting themselves over last week's NYT/Siena polling showing Donald Trump beating President Biden a year from now in five of six swing-states, we finally carved out some time on today's BradCast to dig into the matter.

After a few news headlines, it's on to "that polling" that has freaked out so many regarding Biden's odds next year. It has spawned a thousand explanations. But mine, in short, is not unlike Margaret Sullivan's at The Guardian, where she argues that the bottom line is --- whether the polling is accurate or not --- the media are failing to accurately inform the American people. Not about the "horse race", but about Biden's accomplishments in office and the unprecedented dangers of Trump's vow to move the U.S. to become an authoritarian regime if he is allowed back in office.

President Obama's 2012 campaign manager Jim Messina argues today in Politico there is "no need to panic" over the polling numbers, based on his experience presiding over similarly grim numbers for the incumbent Prez back in 2011, when data guru Nate Silver suggested Obama was "toast" a year out from the election (which he ended up winning); New York Times Magazine gave him just a 17% chance of prevailing (apparently he beat those odds); polling by Politico showed Obama tied with Mitt Romney in 10 battleground states (Obama would go on to win 9 of them); and a December 2011 Gallup poll showed Obama losing to Romney across 12 battlegrounds states (he ended up winning 11 of them.)

In short, polling this far out doesn't mean much. But there are still plenty of reasons to be concerned. And plenty of reasons to spend time not on the horse race, but on the FACTS that Americans apparently aren't receiving from their mainstream media outlets. The FACTS of Joe Biden's extraordinary accomplishments in his first term, rivaling LBJ or FDR, and the chilling FACTS of what Donald Trump himself has vowed to do if he is re-elected, rivaling Hitler and Mussolini. (And, no, that is not hyperbole.)

As we discuss today, here is a new poll from Navigator Research revealing how wildly popular Biden's accomplishments are, whether the American people realize he has implemented them or not. And here is a list of 27 "insane things" Trump has promised, in his own words, to do if he wins a second term. And that list was created in September. He has doubled and tripled down on many of them since then.

After discussing much of the above, we open up our phone lines to listeners today, to get their explanations for all of this. Many of whom seem to get it, but a few, sadly, clearly do not. They are still buying the lies being spun by Trump, Republicans and Fox "News", because real news outlets are doing such a lousy job of telling the real story. The actual FACTS.
