On today's BradCast: Maybe now Jack Smith will start investigating the multi-state criminal plot by MAGA conspiracists to breach voting system software? Now that we know the unlawful scheme actually began in Donald Trump's Oval Office, as overseen by Trump himself, back in December of 2020? [Audio link to full show follows below.]

We have been reporting on the unlawful, criminal breaches of sensitive voting and tabulation system software by MAGA rightwingers following the 2020 election for nearly two years at this point. Most notably, we've focused most closely on the incident that occurred in the rural, right-leaning Coffee County, Georgia, where local GOP Board of Election members, County Commissioners and Republican Party officials allowed outsiders organized and funded by Trump lawyer Sidney Powell, to come in to the elections office to make illicit copies of the County's sensitive, proprietary election management software made by Dominion Voting Systems. The software in rural Coffee County also happens to be the exact same software that is used across the entire battleground state, thanks to the insistence of Republican Sec. of State Brad Raffensperger.

We first learned about the Coffee County breach last year, thanks to Marilyn Marks, founder of Coalition for Good Governance, which has a long-running federal lawsuit against the state, seeking to the ban the use of Raffensperger's 100% unverifiable touchscreen voting systems made by Dominion. She received a bizarre phone call --- which we previously aired on this program --- from an Atlanta-area businessman named Scott Hall, essentially confessing to the unlawful breach in Coffee County on January 7, 2021. He thought Marks was a fellow MAGA traveler. She wasn't. She is a non-partisan election integrity advocate. A real one.

Since that breach, which included the participation of folks like Doug Logan of Cyber Ninjas (the clowns who ran that phony audit of the 2020 Presidential election in Phoenix, Arizona in 2021), was revealed, thanks to Marks' ongoing civil lawsuit, Sec. Raffensperger seems to have been working very hard to cover the entire thing up and, according to our guest today, DoJ Special Counsel Jack Smith does not appear to be investigating.

Hopefully, that may have changed as of Friday, when two major media outlets ran scoops based on a new letter [PDF] sent by our guest today, SUSAN GREENHALGH of Free Speech for People, to U.S. Attorney General Merrick Garland, Special Counsel Jack Smith and FBI Director Christopher Wray.

First, CNN reported Friday morning that text messages obtained via Marks' lawsuit revealed two of the software breaching Trump operatives discussed whether to somehow use information gleaned from their unlawful actions to try and prevent the certification of Democratic U.S. Senator Jon Ossoff's January 5th, 2021 U.S. Senate runoff victory over Republican David Purdue, or whether they should "hold it for a bigger moment."

Then, later on Friday, the New York Times ran a report detailing Greenhalgh's discovery that the plot to breach voting system software in several states --- which we already knew had been organized and funded by Powell --- was actually hatched during the infamous "crazy" meeting in the Oval Office on December 18, 2020. That, based on testimony to the House January 6 Committee that Greenhalgh documented from several Trump aides who were in the room where it happened that night. Attendees at the meeting included Powell, Rudy Giuliani, Michael Flynn, former Overstock.com CEO (and plot funder) Patrick Byrne, Chief of Staff Mark Meadows and others. It went on for hours and was presided over by Donald Trump himself.

So, maybe Smith or Garland or Wray will be interested in investigating the multi-state conspiracy plot now?!

Greenhalgh explains that cybersecurity experts are concerned that the stolen software "can be used in disinformation campaigns, which we are already seeing happen. It could be used to fabricate evidence." She notes that "in 2020 when all those [Trump] lawsuits failed, it was because there wasn't any real or credible evidence. But software is mutable. You can play around with it. Could this be used to try and fabricate some false evidence to say, 'Look, this is what we found on some voting machines and look they stole the election?'"

"Most ominously," she warns, the software could be used to "to develop and tailor malware that could be deployed to actually start stealing votes, in the very way that we had people arguing was done in the 2020 election --- but now it's coming from the very same people that actually made those outrageous and baseless claims. Now [they] have the ammunition and basically the keys to the vault that could enable them to do much more nefarious things like actually hack an election."

So, why hasn't this been investigated by the Feds before now, as a response sent by the FBI to Greenhalgh in January [PDF] indicates, claiming the Bureau can only investigate after "a formal request for assistance" by "local authorities"? Why does GA Sec. of State Raffensperger, wrongly viewed as a hero for not stealing the 2020 election for Trump, seem to be working so very hard to cover up what happened in Coffee County? Why have corporate media been so reticent to dig into the story? Why have Greenhalgh and Marks had to do the bulk of the heavy lifting to even get us to this point? Why haven't members of Congress jumped in to demand a proper probe at the federal level? And will a proper federal probe finally happen now that the matter has found its way smack dab into Smith's purview by landing, via the New York Times, in Trump's Oval Office? (All thanks, of course, to the indefatigable work of Susan, Marilyn and their nonprofit organizations!)

"There's a lot more to this story to report," Greenhalgh insists. "As you know, it's still just the tip of the iceberg and there's a lot more information underneath that can still be reported. Greenhalgh's February follow-up letter to the FBI's response [PDF], for example, notes that, contrary to the assertion from R. Joseph Rothrock, Chief of the FBI's Public Corruption and Civil Rights Section, the Georgia State Elections Board says that it has, in fact, "requested assistance from the FBI." That, according to a public statement from its Chair in September of 2022

McCarthy's DOA plan to gut spending on the poor and make his own constituents sick in exchange for not crashing the U.S. economy; Also: Lindell loses a $5 million election fraud bet; Peters still facing jail time...

We've got lots of dupes and lots of dopes on today's BradCast. You'll have to figure out which is which. [Audio link to full show follows this summary.]

Among our stories today...

  • House Speaker Kevin McCarthy has introduced a 320-page proposal [PDF] of cuts to the federal budget that he suggests Republicans must have in exchange for not blowing up the nation's economy for less than a year. The cuts being demanded in order for a vote to raise the nation's borrowing limit to pay for what we've already committed to spending and avoid a first-ever U.S. government default, include taking away food stamps from more than 4 million hungry Americans, and federal health insurance from more than 2 million poor and disabled people. He's also demanding another $130 billion dollars of cuts in social programs for Americans next year alone, though he doesn't say which programs. The White House believes it would most likely include deep cuts to "education, veterans medical care, cancer research, meals on wheels, food safety and law enforcement.” McCarthy's dead-on-arrival debt limit proposal --- if he's even able to get his own party to pass it in the House --- would also increase the deficit (which Republicans pretend to care about) by nearly $200 billion in cuts to IRS enforcement. But that will keep more money in the pockets of corporations and the wealthy, so there's that.
  • Perhaps most disturbingly of all, McCarthy is calling for cuts to much of the $400 billion in climate initiatives to clean the air and fight global warming over the next decade, as adopted by Democrats in last year's Inflation Reduction Act. If I was one of McCarthy's constituents in Bakersfield, California, I'd be particularly pissed off about that, given this year's "State of the Air" report from the American Lung Association, released on the same day as McCarthy's debt ceiling bill. If I lived in Bakersfield, I might wonder why my own Congressman wants to kill me? The new report finds McCarthy's home town at the very top of two of the Lung Association's lists...but not the good ones. Bakersfield is the #1 most polluted city in the nation, as ranked by both short-term and year-round particle pollution. On the other hand, it's only the third worst in the nation when it comes to ozone pollution. Why does Kevin McCarthy want to slash climate programs and further harm his own constituents?!
  • Some of these folks may be both dupes and dopes. Back in 2021, bedding impresario and 2020 election liar Mike Lindell promised to reveal iron-clad evidence that China helped steal the Presidential election from the former guy. Lindell declared he had data, from a whistleblower or something, proving that they had done so, somehow, via the Internet. He offered a $5 million challenge at a three-day "cyber symposium" in South Dakota that year to anyone who could "Prove Mike Wrong" by showing that the data packets he claimed revealed evidence of Chinese interference of the election didn't actually prove as much. Well, some guy, a Trump voter named Robert Zeidman, did exactly that, according to an arbitration panel who was called in after Lindell refused to pay up. The panel found that Zeidman proved the so-called "packet captures" included little more than jibberish and had nothing to do with the 2020 election. Now Lindell has 30 days to pay up, though he says he's going to court instead. It's all quite hilarious, in truth. But it may just be an appetizer for the $1.3 billion defamation suit [PDF] still pending against him by the Dominion Voting Systems company.
  • Of course, Lindell wasn't the only one to screw himself over at that "cyber symposium" in SD. That's where Colorado's former Mesa County Clerk Tina Peters was speaking on stage when sensitive Dominion Voting System software from her own county was leaked to the public over the Internet. Peters was later charged by CO with 7 felonies and 3 misdemeanors related to her alleged scheme to sneak into the secure voting system room in her county with accomplices late at night, as they turned off the security cameras to make unlawful copies of the election tabulation software. Her trial on those state charges comes later this year, but last month Peters was found guilty of obstructing a law enforcement investigation related to one of her accomplices. Last week she was sentenced to 4 months of home detention and 120 hours of community service. The penalties she is likely to face for breaching the County's voting system software is likely to be much much worse if she's found guilty.

Just to be clear, while we're debating whether California's senior Democratic Senator should step down on today's BradCast, the longest-serving U.S. Supreme Court Justice should not only have stepped down long ago, he should have been removed by the force of impeachment long ago as well. [Audio link to full show is posted below this summary.]

It was a very busy and lively show today, covering a bunch of interesting and occasionally related news. Among today's story's...

  • Democracy seems to be out of reach yet again in the Middle Eastern/Sub-Saharan nation of Sudan, as deadly fighting broke out between two military factions in the country's capital and elsewhere over the weekend.
  • A well-known Kremlin opposition figure and critic of Russian President Vladimir Putin's horrific invasion of Ukraine was sentenced to 25-years of hard labor today for daring to speak out against the war last year. 41-year old Vladimir Kara-Murza is just the latest facing a long prison sentence for public opposition to Putin's barbaric, criminal assault on his sovereign neighbor.
  • Last week we explained why Fox "News", if they were smart, would do everything in their power to reach a settlement with Dominion Voting Systems before the trial in the $1.6 billion defamation lawsuit filed by the voting machine vendor against the Republican propaganda outlet began in earnest this week. Jury selection in the trial, in which Dominion has Fox dead to rights for repeatedly, falsely and knowingly lying to viewers that Dominion somehow rigged the 2020 election for Joe Biden, was supposed to begin today. But Delaware Superior Court Judge Eric Davis, without explanation, announced the trial would begin tomorrow instead, leading some to believe Fox may be trying to strike a last minute settlement.
  • On Friday, the U.S. Supreme Court issued a brief, administrative stay on the rulings by far-right, activist U.S. District Judge Mathew Kacsmaryk and the far-right U.S. 5th Circuit Court of Appeals that ban the FDA-approved use of mifepristone, the nation's top abortion medication, in all 50 states. The temporary stay will only remain in place until Wednesday, at which time the full SCOTUS will either keep it in place throughout the appeal to Kacsmaryk's unprecedented, activist ruling --- in which he is attempting to legislate from the bench and overrule the FDA's 23-year old approval of the safe and effective drug --- or they will allow a first-of-its-kind ban to go into effect while the appeal moves forward. Today, we cite a few of the 5th Circuit's huge errors in their recent ruling, as detailed by The BRAD BLOG's Ernie Canning.
  • And, speaking of our corrupted, rightwing federal judiciary, there was yet more jaw-dropping news over the weekend of the unspeakable corruption and seemingly endless lawlessness of Justice Clarence Thomas, the longest-serving current member of the U.S. Supreme Court. We quickly review the full story again today, from Clarence's unlawful failure to disclose his activist wife Ginni's salary from the Heritage Foundation for some 20 years, until called out for it in 2011; to Ginni's apparent "Judicial Insider Trading" on the infamous 2010 Citizens United ruling; to ProPublica's blockbuster exclusive two weeks ago detailing decades of Clarence's unlawfully undisclosed luxury travel courtesy of GOP megadonor Harlan Crow; to last week's second ProPublica jaw-dropper revealing that Crow purchased properties from Thomas, including his mother's house (which she still lives in, rent free!) and which also went unlawfully undisclosed in in his annual disclosure forms; and then this weekend's latest scoop from WaPo finding Clarence hasn't bothered for years to report income from a real estate firm owned by Ginni and her family.
  • Finally, speaking of both the rightwing federal judiciary and people who should arguably resign immediately, California's 89-year old senior Democratic Senator Diane Feinstein has missed about 60 of 80 floor votes in the U.S. Senate this year, as she is sidelined in San Francisco with shingles. There is currently no date for her return to the 51-49 upper chamber. But, even more importantly, her extended absence from the Senate Judiciary Committee has stalled the confirmation process for more than a dozen federal court judges nominated by President Biden. As calls for her resignation began last week, the fading trailblazer has asked to be removed, temporarily, from the powerful Judiciary Committee. Unfortunately, it's not quite as easy as that, as we explain today.

    In the bargain, a debate has surfaced among Congressional Democrats, some of whom are calling for her resignation after decades of service, others describing the push as misogynistic, others defending her during her convalescence, while still others appear to be supporting her at the moment, though their patience is clearly wearing thin.

    We cover all of that today before opening our phones to listeners --- her constituents in Southern California --- for their opinions on whether DiFi should stay or go. We had a lot of really smart and interesting callers today...even if their opinions were ultimately in sync. They believe its time for her to fly...

If you thought you might have heard the end of Clarence Thomas' year's long crime spree as a lifelong Justice on the highest court in the land, think again. More stunning breaking news of his endless corruption on today's BradCast, along with a whole bunch of other newsworthy stuff.

Among that stuff...

  • Democratic state Rep. Justin Pearson was reseated at the Tennessee State House on Thursday, after the Shelby County Commission in Memphis unanimously elected him to be a temporary replacement for himself after he was expelled last week by the out-of-control, racist, gerrymandered GOP majority. Both he and Rep. Justin Jones (who was reseated on Monday after also being elected unanimously to do so by Nashville's Metropolitan Council) were expelled last week after joining a protest at the state Capitol demanding gun safety measures after 3 children and 3 adults were murdered in a mass shooting at a Christian elementary school in Nashville. The white female Democratic legislator who joined the two Justins in the protest was allowed to remain in her seat. We share some of Pearson's remarks after being selected in Memphis to fill his own seat, and after his return to the House today, where Republicans were debating a bill to censor free speech for college students in the state before they tossed out the rules to end all debate and voted for passage of the pro-Big Government, anti-free speech, racist measure.
  • Hey! Texas U.S. Sen. Ted Cruz has a great idea about how to prevent school shootings! Just arm them up with militarized security personnel! "You know, when you go to the bank, and you deposit money in the bank, there are armed police officers at the bank," he declared late last month when announcing his new federal bills to fund armed security guards at the nation's public and private schools. "Why on earth do we protect a stupid deposit more than our children?," he asked on Twitter. And, just days later, you'll never guess what happened at the Old National Bank in Louisville, Kentucky.
  • On the upside, all of this pro-murder, pro-Big Government, anti-free speech, anti-democracy GOP idiocy is being noticed by Americans, it seems. Our guest on yesterday's BradCast, Simon Rosenberg, one of the few who turned out to be right that last year's midterms would not result in a "red wave," draws our attention today to some noteworthy new polling. After their first 100 days, the new U.S. House GOP majority has an abysmal approval rating of negative 24 points overall, and are a jaw-dropping 48 points underwater among independent voters. Rosenberg observed that while he "could write a much longer analysis" of the new survey, "it isn't necessary. These numbers are truly terrible [for Republicans], and they are in serious trouble." We'll see if he turns out to be as right about 2024 as he was about 2022.
  • Speaking of jaw-dropping. Today's exclusive from ProPublica about even more previously unknown corruption of Clarence Thomas may be even more mind-blowing than their exclusive last week revealing that the corrupt U.S. Supreme Court Justice, "accepted luxury travel from [GOP megadonor Harlan] Crow virtually every year for decades, including private jet flights, international cruises on the businessman’s superyacht and regular stays at his private resort in the Adirondacks" while failing to report any of the hundreds of thousands of dollars in gift travel on his financial disclosure forms, as required by law, for all of those years.

    And now today, we learn that Crow directly paid Thomas actual cash money to purchase the Justice's mother's home and several other lots on the same street that were owned by Clarence. His 94-year old mother is still alive, and still appears to live in the house (rent-free?)that Crow purchased before investing some $36,000 in renovations! Because that's just what billionaire real estate tycoons and GOP megadonors do for their closest personal friends who happen to sit on the U.S. Supreme Court.

    All of that, of course, meshes precisely with Clarence's corruption that we reported on way back in 2011, detailing his unlawful failure to list his wife's $120,000 annual salary from the rightwing Heritage Foundation on his annual financial disclosure forms for some 20 years, and the sweet $500,000 in dark money that his wife Ginni's then-new, non-profit political advocacy group received from Crow back in 2009, just after the infamous Citizens United case was heard by her husband at SCOTUS, and just before Clarence and the other Republican Justices released their opinion in 2010, allowing unlimited dark money to political advocacy groups, like Ginni's, to remain undisclosed.

We'll just have to keep saying it on The BradCast: Republicans are pro-murder and anti-democracy. It's just that simple. And we've got too much more evidence of that today. [Audio link to full show follows this summary.]

First up, the fallout continues following Monday's school shooting in Nashville, Tennessee, where three 9-year olds and three adults were killed by an AR-15 wielding shooter at a private Christian elementary school. The U.S. Congressman representing the district where The Covenant School is located is Republican Congressman Andy Ogles.

Last year, Ogles sent out Christmas cards featuring himself, his wife and his children in front of a Christmas tree, proudly posing with their AR-15 style assault rifles. Since the shooting in his district, he has apparently taken down his social media posting of the festive card. A reporter from Sky News confronted him this week to try and learn why he hadn't taken it down previously, after other similar massacres, and why he seems to favor guns and murder over the lives of children and their right to be safe at school.

Jon Stewart, earlier this month, also had a related conversation with a Republican state lawmaker in Oklahoma by the name of Nathan Dahm. The GOP state Senator has authored bills to loosen restrictions on firearms and apparently believes that drag shows that may be seen by children must be banned, because "the government does have a responsibility to protect" them. But, as Stewart points out, Dahm appears to have no similar concerns about protecting kids from being murdered with guns, which is now the leading cause of death for U.S. children and teens.

In a similar vein, Big Government Republicans in Kentucky's legislature today voted to override the veto of Democratic Governor Andy Beshear, to enact a law that will ban health care for trans kids and mandate that doctors begin "detransitioning" children currently on puberty blockers and hormones, despite the alarming rate of suicide by such kids. The bill also bars all discussion of sexual orientation and gender identify in schools for students of any age, as the Nanny State Republican party continues to pretend they favor free speech.

Meanwhile, this is an election year in Virginia, where the entire state legislature comes up for reelection in odd-numbered years and where the commonwealth's 1902 constitutional provision created to prevent black people from voting remains in place. The measure in question allows VA's Governor to decide, on any criteria they may like, whether or not to re-enfranchise former felons.

Under processes enacted first by former Republican Gov. Bob McDonnell and then broadly expanded and automated by subsequent Democratic Governors Terry McCauliffe and Ralph Northam, the voting rights for hundreds of thousands of Virginians were restored. But, since taking office last year, VA's new, so-called "moderate" Republican Gov. Glenn Youngkin has re-enfranchised almost nobody. Moreover, his office has finally informed state lawmakers that he will be using a secret process to personally decide, on a case-by-case basis, who will and won't be allowed to vote.

We're joined today by voting rights, criminalization and justice reporter ALEX BURNESS, staff writer at the progressive Bolts Magazine. He has been reporting on Youngkin's appalling, anti-democracy policy, and how it is harming those who are simply hoping to return to civil society after imprisonment in Virginia.

"We still don't know what the criteria is going to be, but it is clarifying in the sense that the policy is 'I'm going to do whatever I want and, at least for the moment, I'm not going to tell you what that means,'" Burness tells me, adding that the commonwealth's constitution mandates the Governor "literally has the power to make up criteria, based on whether you own a dog or a cat, or anything."

Burness explains why Democrats in the state have yet to pass a constitutional amendment to change this absurd, Jim Crow relic, despite the heartbreaking stories from so many who have served their time and simply want to have their rights as citizens fully restored. "This is one of a million reasons why Virginia's upcoming elections matter. Particularly with what Youngkin has done now, there is some renewed passion by folks to settle this once and for all and not leave it up to the whims of the Governor," says Burness.

The pathetic vote suppression by Youngkin comes on the heels of Minnesota's Democratic Governor signing a law this month to re-enfranchise some 55,000 citizens of voting age who are no longer incarcerated, whether they are on parole or probation or not; New Mexico's Democratic Governor signing a similar law that will restore voting rights to about 11,000 New Mexicans; and a recently advanced measure by Democratic lawmakers in Oregon to allow voting even for those still in prison, akin to the rights afforded to the incarcerated in Maine, Vermont and Washington D.C.

Finally today, more voter suppression is enacted by Arkansas' new Republican Gov. Sarah Huckabee Sanders. Yesterday, we detailed her newly signed law adopted by Republican state lawmakers that will make it much much harder for Democrats to place citizen initiatives on the statewide ballot. (Even though the statute appears to be a violation of the state constitution.) Today, the American Democracy Minute's Brian Beihl details three other new bills recently signed by Huckabee Sanders to make absentee voting much more difficult in the state...

Ya know, if their ideas were popular, Republicans wouldn't have to work so hard to undermine democracy, would they? An example or three of that on today's BradCast.

Among today's many stories...

  • Cowardly Mike Pence's attempt to avoid testifying about Donald Trump's January 6th insurrection to Special Counsel Jack Smith's grand jury is denied by a federal judge.
  • Yet another white Republican in Florida is charged with election fraud. Yet again, he was not arrested at gunpoint on camera and hauled to jail like the people of color who Gov. Ron DeSantis ordered rounded up before last year's election, even though they had no idea they had voted unlawfully. The white Republican voter turned himself in to authorities at his own convenience.
  • Our corrupt, stolen and packed rightwing U.S. Supreme Court majority has declined to review a ruling by the state Supreme Court in Kansas which found that intentionally discriminating against minority voters was just fine, after state Republicans gerrymandered Kansas City by cutting it into two different Congressional districts in order to dilute the power of black voters.
  • In Arkansas, voters have repeatedly made clear through recent rejections of GOP ballot initiatives, that they really really oppose making it more difficult for citizens to put stuff on statewide ballot initiatives and see it adopted by voters. So now, Republicans in the state legislature, giving the finger to voters, have simply passed a new law to make it virtually impossible for Democrats to place measures on the statewide ballot. AR's new democracy-hating Republican Governor, Sarah Huckabee Sanders, happily signed the measure which, on its face, seems to blatantly violate the state's own Constitution. The League of Women Voters of Arkansas and other fans of democracy are now suing to block what the League's President accurately describes as "an attack on direct democracy."
  • The 28-year old shooter in Monday's mass shooting --- the 130th of the year so far --- reportedly purchased SEVEN weapons from five local guns shops in Nashville, Tennessee before using at least two of them to kill three 9-year olds and three adults at a private Christian elementary school. All of that while the assailant was said to have been under a doctor's care for an emotional disorder, according to the Nashville police chief. Seven guns, at least two of them semi-automatic assault weapons, and none of it triggered any red flags to authorities. Nonetheless, Republicans in Congress today, according to media reports, still lack the courage to support any new gun safety laws that might make such massacres less likely or more difficult. They are, as Rep. Ted Lieu (D-CA) correctly noted today, "cowards". AND PLEASE NOTE: This is not a problem with "Congress" or "lawmakers in D.C." The problem is Republicans. Period. They do not want to make it more difficult to murder people, while Democrats do. It's as simple as that. If media outlets are unable to call out Republicans, specifically, for fear of sounding "partisan", they are doing a grave disservice to their readers, viewers, listeners and country.

Uncertainty and necessity of Trump indictment(s); Bragg ponders 'perp walk' protocol; MAGA fears a protest 'trap'; Fox 'News' eating its own...

Looks like Donald Trump was not "ARRESTED ON TUESDAY" as he lied (again) to his easily-duped followers over the weekend. But, just to put this up front on today's BradCast: We reject the notion that indicting the former President in relation to a hush-money payment made to help him win the 2016 Presidential election --- and the payments made while he was in the White House to cover it all up --- is a "minor crime" not worth indicting a former President for. [Audio link to full show follows this summary.]

That point is explained in much more detail on today's program, along with other related stories and important points, as the GOP begins to collapse in on itself...

  • Given that no U.S. President has ever been indicted, nobody knows how (or if) this will work out, and what will happen after Manhattan District Attorney Alvin Bragg in New York (or Fani Willis in Georgia, or Special Counsel Jack Smith at the federal level), actually brings an indictment against Trump. That is, presuming one or more of them actually do, as we also discussed with callers on yesterday's program.
  • A so-called "liberal" at Facebook was critical of our coverage yesterday, even if he doesn't appear to have either listened to it, or even read the item we posted along with it. His critique seems to be that, on this week's 20th Anniversary of George W. Bush's unlawful, accountability-free invasion of Iraq and the war crimes that followed it (as discussed yesterday as well), we shouldn't be wasting time discussing accountability for Donald Trump. He is wrong for a host of reasons...
  • ...Several of which also happen to be discussed in Will Bunch's newsletter at Philly Inquirer today, headlined "U.S. presidents and their crime spree since 1968." Bunch concludes his piece with this on-point observation:

    So let me get this straight: We look the other way when our leaders oversee war crimes or greenlight torture or commit quasi-treason with foreign adversaries because the American presidency is too big to fail, but we're also going to ignore a cut-and-dried lower-level crime because it's too small? I'd argue that charging Trump with violating a law that applies to 333 million other Americans is a first baby step toward undoing 55 years of gross injustice, and it's long overdue. We need to rediscover that it's still illegal even when a president does it.
  • Meanwhile, as GOP House Judiciary Committee Chair Jim Jordan (along with the Republican chairs of the Oversight and Administration Committees) is demanding NY D.A. Bragg come in to testify and turn over all documents from his criminal grand jury probe of Trump --- before any indictment has even been issued --- it seems worth noting that Congressional subpoenas are now optional. Jordan and House Speaker Kevin McCarthy and several other GOP members made that clear last year when they ignored similar requests from the House January 6 Committee and faced no accountability for their Contempt. Nonetheless, they are apparently hoping to weaponize the federal government at this point to prevent elected state law enforcement officials from doing their job of fighting crime.
  • All of that, while Bragg is reportedly considering whether Trump will be forced to carry out the same "perp walk" that all other white collar criminals facing felony crimes in NYC must face, or whether a former President should be given special consideration for some reason.
  • At the same time, in the wake of Trump exhorting supporters to "PROTEST, PROTEST, PROTEST!!!", very few seem to be answering his call so far. That may be because many of them reportedly believe it's all a trap by the Feds! (Marjorie Taylor Greene, however, believes there's no need to protest, because any indictment of Trump only assures he will be re-elected in 2024. Maybe. Though it begs the question as to how other Republicans, like Jordan and Trump himself, can claim that indictments are only being brought to hurt his chances in 2024.)
  • And while all of those rightwingers collapse in on themselves, Fox "News" appears to be doing the same thing. A producer named in Dominion Voting Systems' $1.6 billion defamation suit against the Republican propaganda outlet is now suing Fox, claiming misogyny by Tucker Carlson and his staff and that she and Maria Bartiromo are being sacrificed by the company for their false reporting on fraud in the 2020 Presidential election. She is also charging she was coerced by Fox attorneys into offering misleading testimony in the Dominion lawsuit. As Media Matters' Angelo Carusone told us on this show several weeks ago regarding the damage that Dominion's suit may due to Fox: "It's sort of like a Jenga puzzle. Pulling one block is not going topple it down, but its certainly gonna make it a lot more vulnerable to toppling. The tiniest little breeze will probably knock the rest of it over." --- Well, it's getting pretty windy at Fox "News" these days.
  • Finally, Desi Doyen joins us for our latest Green News Report, including news on the 12th(!) major winter storm now slamming California this season; unprecedented heat records smashed in Argentina; and the latest warning from the U.N. that the window for avoiding catastrophic, irreversible damage to the climate is almost closed, requiring an unprecedented worldwide effort to radically cut fossil fuel emissions before the end of this decade...

I have no idea what this week is going to bring. As noted on today's BradCast, nobody, save for (maybe) the Manhattan District Attorney does. And I suspect even he is largely flying blind about what happens once (and if) Trump is ultimately indicted in New York State. [Audio link to full show is posted below this summary.]

Before we get to discussion about that --- and callers on the same topic --- today is the 20th anniversary of the U.S. invasion of Iraq. As we said at the time, and have been saying for the 20 years since, we were lied into war under false premises by the George W. Bush/Dick Cheney regime. In the bargain, hundreds of thousands of Iraqis were killed and about 5,000 Americans. No weapons of mass destruction were ever found. More disturbingly, no one was ever held accountable for that pointless war and the lies that were told to get us there.

Back in 2003, 66% of Americans supported the invasion, in no small part because opposition voices in the U.S. were largely shut out of the mainstream media conversation. Now, 61% of Americans, according to new polling, think that war was a mistake.

And, because there was never any accountability for the war criminals, guys like Florida Gov. Ron DeSantis are considered to be front-runners to become the next Republican nominee for President of the United States. That, despite the fact that, as Washington Post detailed over the weekend, DeSantis played a key role in torturing detainees with forced-feeding at Guantanamo Bay while he served as a 27-year old Navy lawyer there.

Meanwhile, now playing the part of imperialistic invader and war criminal is Russia and its leader Vladimir Putin, who the International Criminal Court on Friday issued an arrest warrant for, accusing him of abductions of thousands of Ukrainian children since his unlawful invasion just over one year ago.

If you're wondering just how terrible Putin actually is, please do yourself a favor soon and watch last week's Academy Award winning Best Documentary, Navalny (currently available via HBO Max and Amazon Prime). As discussed today, it is jaw-dropping. For a whole bunch of reasons. And, don't worry, it's also uplifting and hilarious at times...even as we see, live and as it happens, the attempted assassination of Russia's incredibly likable opposition leader, Alexei Novalny, and the remarkable moment when he actually tricks one of his own would be assassins into confessing to his attempted murder. All caught live on camera!

Then, we get to the story that I have a feeling we'll be covering for some time on this program: the first criminal indictment of a U.S. President in our nation's history. It may finally happen this week in New York (emphasis on "may"), thanks to Manhattan D.A. Alvin Bragg. He is believed likely to bring charges against Donald Trump related to the hush-money payments the disgraced former President made to porn star Stormy Daniels to cover up a sexual affair. That payoff, carried out at his direction by his then-attorney Michael Cohen, helped Trump win the 2016 Presidential election. Cohen went to jail for it. Trump never did. At least not yet.

Trump is almost certainly not going to be "BE ARRESTED ON TUESDAY", as he claimed in a panicked, weekend, ALL-CAPS statement on his social media site. Tuesday is seen as the earliest time he could possibly be indicted by a Grand Jury in New York. But, even if so, he will not be "ARRESTED" by New York law enforcement officials in Florida, where he now lives.

If Trump finally is indicted on criminal state charges, whether it's this week or next, will he actually go back to New York to turn himself in? Seems unlikely. But, if not, then what? Would NY ask Ron DeSantis' Florida law enforcement to arrest and extradite Fugitive Trump from Mar-a-Lago? Also seems unlikely, even with DeSantis believed almost certain to run for the GOP's 2024 Presidential nomination against Trump. Will Trump's supporters actually "PROTEST, PROTEST, PROTEST!!!" as the cowardly ex-President is begging them?

And why are House Republicans, led by House Judiciary Chair Jim Jordan --- who pretends to support law and order --- now actually weaponizing the federal government to try and undermine Bragg's case?

In fact, nobody knows what is coming next. There is no playbook for what is about to happen --- whether it happens this week, or next, or even in a different state, like Georgia. But it does seem to be a good day to open our phones to listeners on the topic, to talk about it all and get their best guess about what where things go from here.

Much of our politics in the U.S. these days warrants more mockery and less outrage. Some, however, warrants more concern than Americans may yet fully appreciate. We discuss all of the above on today's BradCast. [Audio link to full show is posted below this summary.]

First up, we started the year with many Democrats troubled by what Republicans might do with their Committee "investigations" upon gaining back majority control of the U.S. House. We advised at the time that the promised Committee probes of stuff like Hunter Biden and the so-called "weaponization" of the U.S. Government were more likely than not to backfire on Republicans.

If last week's impressively aggressive response by House Democrats to Chair Jim Jordan's supposed FBI "whistleblowers" is any indication, things are already going quickly South for them. The Dems' 300+ page report [PDF] details the testimony and backgrounds of the first of these "whistleblowers" to be interviewed by the new House Select Subcommittee on the "Weaponization of the U.S. Government." They turn out not to be whistleblowers at all, but paid Donald Trump shills and disgruntled conspiracists who are unable to cite any actual violations of law, according to the Democrats report.

In a similar vein, we strongly recommend mockery as the correct response to Tucker Carlson's silly, cherry-picked segments this week, supposedly based on 40,000 or so hours of U.S. Capitol security camera footage from January 6, 2021, turned over to him by House Speaker Kevin McCarthy. Tucker is hoping to rewrite the history and known facts of Trump's deadly insurrection as little more than "sightseeing" and "mostly peaceful chaos". As it turns out, the U.S. Capitol Police chief, top elected Republicans in the Capitol that day, and, yes, even Fox "News" itself, seem to strongly disagree with Tucker's attempted revision of history.

But, while much of the phony outrage by far-right trolls like Carlson and Jordan deserve more laughter and mockery than outrage or panic from Dems, there is still plenty to be concerned about in our post-Trump politics, according to fascinating findings from researchers based on a nationally representative survey of 1,500 Americans from strong Democrats to independents to strong Republicans.

One of the most alarming findings is that "majorities of every political stripe agree or strongly agree with" the statement that "the only way our country can solve its current problems is by supporting tough leaders who will crack down on those who undermine American values. "

That, of course, sounds somewhat like authoritarianism, though the researchers left concepts like "current problems", "crack[ing] down", and "American values" intentionally vague in their survey for reasons they explain on today's program.

We're joined today by two of the report's four authors, Allegheny College Asst. Professor of Political Science TARAH WILLIAMS and Associate Professor ANDREW BLOESER, Director of the college's Center for Political Participation. Their recent article, summarizing their study's findings, leads with the troubling news of majorities, across all partisan lines, who support "crack[ing] down on those who undermine American values."

"It was fairly remarkable," Williams explains. "We anticipate that those who are answering this as Strong Democrats vs. Strong Republicans may have quite different visions of those folks who undermine American values. But the fact that there is this visible support across the board, we thought was really quite concerning."

The researchers discuss findings on partisan positions regarding things like "bending the rules" or "using rough language" to criticize political rivals or to "get things done," as well as how Americans feel about shutting down news organizations "attempting to undermine American values". Unsurprisingly (if still disturbingly) 72% of self-identified "strong Republicans" either agree or strongly agree with shutting down news organizations. Troubling in another way, a third (33%) of Strong Democrats feel the same way!

As to why some of the terms used in the survey are left intentionally vague, Bloeser explains, "Respondents may have their own ideas about what 'American values' mean to them. The next critical question is, 'What would you do in the service of your values? You believe that you are right, therefore, are you willing to say some groups in society should be, in a very blanket way, criticized, demeaned? Do you think that we should shut down the free press, something that is clearly anti-democratic? Do you think that it's fair for a leader to bend the rules for some groups in society to the detriment of others?' So you might have a variety of different goals that you think are noble in mind, but at the point where you're willing to undermine democracy, you're trading in something pretty significant there."

"Significant proportions of people across the political spectrum, but especially on the political right - Republicans and Strong Republicans --- are willing to say that crackdowns on entire groups, shutting down the free press, and bending the rules for people like them would be acceptable in service of what they think America should be. And that really is the pattern that we want be concerned about."

"It's not a tie," Bloeser is careful to note. "We certainly see it more on the political Right among self-identified Republicans. But the fact that some of those attitudes also exist fairly widely among Democrats should also be a concern. Because when one group starts to see another group as an existential threat, these are the things that can pull apart the fabric of society, and that can really undermine democracy."

Their study, published by Cambridge University Press, is titled "Are Stealth Democrats Really Committed to Democracy?" Williams makes clear that the reference is to small "d" democrats, as opposed to the Democratic Party.

"'Stealth democracy' is a notion that there are some individuals who would prefer a government that they don't really have to see," she tells me. "They don't like high-conflict politics. They think people making compromises is weak or failing to represent values. And they think it's a slog, which, let's be honest, policy-making is. So for those reasons, people who tend to be stealth democrats tend to prefer this expedient process that in a lot of ways looks distinct from what we think about as the necessary machinations of democracy."

As I note in response, "stealth democracy" sounds a whole lot like autocracy to me. Neither Williams nor Bloeser seem to disagree...

Unless raising cost of goods by 30% is considered 'reining-in' inflation...

In addition to "chaos and dysfunction", MAGA Republican extremists, who now exercise dominance over the U.S. House agenda, have also recently advanced a pair of Orwellian-titled bills.

On Wednesday, Rep. Elise Stefanik (R-NY) boasted via Twitter that the "House passed my REIN IN inflation Act today."

There isn't a single word in her short, single-page bill, the "Reduce Exacerbated Inflation Negatively Impacting the Nation Act", which serves to "rein in" what U.C. Berkely Economics Professor and former Labor Secretary Robert Reich described as the principal driving factor for today's inflation: corporate greed. To the contrary, per the Congressional Budget Office, the measure simply mandates that Presidents provide an "estimate" on the potential inflationary impacts of "major" executive orders.

Meanwhile, these same House Republicans aspire to devastate the middle and working classes via their Orwellian-titled "Fair Tax Act" (HR-25), which Reich described as "one of the most regressive proposals in a generation, imposing a 30% federal sales tax on everything Americans buy from gas to food." That tax increase would be piled onto the backs of the bottom 63% of Americans who are currently "living paycheck-to-paycheck," according to a new report.

It would be nothing short of farcical for Republicans to suggest a new, 30% sales tax would be offset by HR-25's elimination of the IRS, the federal income tax (both corporate and personal), FICA (the taxes that fund Medicare and Social Security), and estate taxes (currently applicable only to estates valued over $12.92 million).

At present, the payroll tax rate for low income Americans is 14.1%. As Truthout's Jake Johnson observed, quoting Matt Breunig of the People's Policy Project, the so-called Fair Tax Act would force the poorest Americans to "pay roughly 70% of their income in taxes as the result of the bill's levy on consumption."

Inflation is defined as "a rise in prices, which can be translated as the decline in purchasing power over time." According to Investopedia, the highest rate of inflation ever experienced in the U.S. (29.78%), occurred in 1778. HR-25 would top that 245-year old mark via a 30% increase in the cost of everything we buy.

I hope someone has told Elise Stefanik.

Today on The BradCast: It was a good day for democracy in the U.S. yesterday, in our continuing battle against the rise of autocracy here at home. The news overseas on that same score, however, thanks to Russia's criminal, autocratic leader, remains significantly dicier. [Audio link to full show is posted below this summary.]

FIRST UP TODAY: It was the first big Special Election night of 2023 in the U.S. on Tuesday. As we saw in advance of last year's 2022 midterms --- when Republicans ignored the evidence before their eyes to hoax themselves into believing a "red wave" was coming (which never did) --- Democrats are once again outperforming expectations in Special Elections around the nation.

We've got results, some of them quite stunning, out of marquee races yesterday in New Hampshire for state House, Virginia for the U.S. House, and in Kentucky for State Senate. In each, Democrats radically outperformed both expectations and history, often by 10 or more points.

But, the most critical race of the night may have been the primary election in Wisconsin, where a vacant swing-seat on the state Supreme Court may finally flip the majority to progressives in the upcoming April 4 general election after years of control by rightwingers. Tuesday's open primary featured two progressives and two so-called conservatives, with the top two vote-getters advancing to the general. Progressive Milwaukee County Judge Janet Protasiewicz easily bested the competition with some 46% of the vote. The two rightwingers, former Supreme Court Justice Dan Kelly and Waukesha County Judge Jennifer Dorow, came in a tight second and third place, with 24% and 22% each, respectively, followed by progressive Dane County Judge Everett Mitchell with 7%.

That means Protasiewicz and Kelly, state Democrats' preferred competition, will square off on April 4. Kelly is a radical, rightwing extremist, election denier, marriage equality opponent, and paid RNC consultant who helped organize Donald Trump's fake 2020 electors scheme in the state. He also lost a previous Supreme Court race in the closely divided swing-state by a whopping 10 points in 2020. In a state where Dems now hold almost every statewide executive position, Republicans are forced to cling to majorities in the state legislature thanks to wildly gerrymandered districts. A progressive majority on the bench, therefore, is expected to be critical over the next few years regarding abortion rights, gun safety, gerrymandering and much more, including voting rights in advance of the 2024 Presidential election.

If voters turnout and vote in April as they did last night, Protasiewicz would defeat Kelly by about 7 points. Of course, its Wisconsin, so I'd be careful about counting chickens before counting ballots just over one month from now.

NEXT UP: Russian President Vladimir Putin's nuclear saber rattling continued on Tuesday during his state of the nation speech. The autocrat announced a unilateral suspension of participation in New START, the last remaining arms control treaty between the U.S. and Russia.

There is a great deal to unpack in all of this, including what Obama-era New START was supposed to do; how the U.S., under Donald Trump, also pulled out unilaterally from a different pact (the Reagan/Gorbachev-era Intermediate-Range Nuclear Forces or INF Treaty); what "suspension" of New START actually means; and how the announcement appears to be yet another desperate attempt by Putin to coerce his way into somehow winning a war of aggression that he appears to be losing in Ukraine, as Russia's unlawful invasion sees its one-year anniversary this week.

To help with all of that today, we're joined by longtime nuclear weapons policy analyst STEPHEN SCHWARTZ who formerly served as Executive Director and Publisher of the Bulletin of the Atomic Scientists. They are the groups who control the notorious "Doomsday Clock". Schwartz, who tweets as @AtomicAnalyst, is also the author of Atomic Audit: The Costs and Consequences of U.S. Nuclear Weapons Since 1940.

"There is no provision in the [New START] treaty for 'suspending' the treaty. You're either in it or not," explains Schwartz. "The suspension is, I guess, a wily way for Putin to get what he wants. Which is, I think, frankly, just an extension of what he's been doing over the last year. This is a nuclear threat by another name."

"It's an effort to frighten the public in the United States, NATO, and Ukraine, into letting let him basically blackmail those countries into letting him do whatever he wants with Ukraine. So he's got this bludgeon --- and it's really the only tool that he has right now --- and he's waving it around until his demands are satisfied."

It doesn't appear to be working. President Joe Biden spoke in Poland yesterday, following a surprise appearance with Ukrainian President Volodymyr Zelenskyy in Kyiv on Monday. "We’re seeing again today what the people of Poland and the people all across Europe saw for decades: Appetites of the autocrat cannot be appeased," declared Biden to cheers in Warsaw. "They must be opposed."

While taking Putin seriously, Schwartz also sees a larger principle at stake. "The way I see it, and I'm no big fan of war at all, is if we just listen to Putin and say 'You're right, we can't risk nuclear war so we're going to stand back and let you carve up Ukraine however you want. And, hey, if you want to take Belarus and Moldova, who are we to stop you?,' I think that would be a terrible precedent for the rest of the world. Not only with regard to what Russia might do in the future, but other countries that have nuclear weapons or might want them."

"The Biden Administration and NATO have been very careful. If you look at every time Putin has done one of these things, the United States doesn't dismiss it and doesn't panic. They walk down the middle and I think that is the right approach here. We need to show that nuclear weapons are fundamentally useless, not just for prosecuting a war, but also for blackmail."

"We need to isolate Putin in this regard," argues Schwartz. "Otherwise, the future world that we're going to live in, brought to you by nuclear coercion, is going to be far worse than anything we dealt with during the Cold War."

Among the many related matters Schwartz speaks to today: Russia's violation of the 1994 Budapest Memorandum, in which Ukraine was guaranteed security and sovereignty after the fall of the Soviet Union in exchange for turning over all nuclear weapons to Russia; The Bulletin of the Atomic Scientists' recent move of the Doomsday Clock to "90 Seconds to Midnight," the closest it has ever been to proverbial "Midnight". In the first 43 days of 2023, there were 67 mass shootings. This is America. What, if anything, are we ever gonna do about it? Welcome to today's BradCast. [Audio link to full show follows this summary.]

Among the many stories covered today...

  • Three students were killed, five were in critical condition at Michigan State University's East Lansing campus as we went to air today, following yet another mass shooting massacre on Monday night. "Run, Hide, Fight" was the message texted to students by MSU at 8:31pm, as gun fire broke out. That might as well be the national anthem for a generation of students who grew up in the wake of the demise of the federal Assault Weapons Ban. It was allowed to expire in 2004 by George W. Bush and every terrorist-supporting Congressional Republican who, since then, has refused to renew it. They have chosen to place support for their donors in the deadly gun industry over the lives of tens of thousands of Americans killed by guns each and every year since. Horrifically, some of the students victimized by Monday's shooting at MSU had also lived through another mass shooting at their high school back in 2021.
  • The author of the now-sunsetted 1994 federal Assault Weapons Ban, U.S. Sen. Dianne Feinstein (D-CA), announced today that she will not be seeking reelection next year. The news was not a surprise. Three Democratic House members --- Katie Porter, Adam Schiff and Barbara Lee --- have already announced or made clear their intentions to run for the 89-year old Senator's seat next year. Feinstein's political career was formed, in no small part, out of gun violence after she personally attempted to save the life of Harvey Milk after the assassination of the San Francisco City Supervisor and then-Mayor George Moscone. She was elected to replace Moscone as Mayor and eventually became California's first female Senator. Today we share just one of the petty, ironic, patronizing attacks against her on the floor of the U.S. Senate in 1993 --- by a later-discredited Republican Senator --- during her successful campaign to pass the landmark gun safety legislation.
  • Former South Carolina Governor and Donald Trump's U.N. Ambassador Nikky Haley released a video on Tuesday declaring her intention to run for the 2024 Republican Presidential nomination. In it, she claims, "I don't put up with bullies". But her history as a 2016 Trump critic --- of his lying, support for the KKK and more --- before then choosing to become his U.N. Ambassador and sing his praises for years thereafter, suggests otherwise. That said, Trump, for reasons we explain today, is delighted to have her in the race.
  • A lot of horrible stuff came out of Donald Trump's endless lies about voter fraud and his evidence-free claims that the 2020 Presidential election was stolen from him when, in fact, he was actually trying to steal the election from Joe Biden and the American people. There was his deadly 1/6/21 insurrection at the U.S. Capitol, followed by a host of newly restrictive voting laws adopted by Republican-controlled states, using his false claims of fraud as cover for new means of voter suppression. But, in a (very) few cases, some GOPers have figured out that the computer voting systems and tabulators their party has supported for years, actually make it more difficult, if not impossible, for Americans to oversee the results of their own elections. Last month, a court in rural Cleburne County, Arkansas mandated a change from computer tabulated elections to hand-marked and hand-counted paper ballots. The group who pushed the measure hopes to do the same in the state's 74 other counties. At the same time, the County Clerk in Nye County, Nevada --- which moved last year to a hand-count protocol as a parallel tally to its computer tabulation --- says that the hand-counts by some 200 volunteers in the rural county were ultimately more accurate than the computer tallies. (Just as we've been trying to tell ya for about 20 years now.)
  • Also, some important news was broken by the Washington Post over the weekend. But it was largely buried by the media's over-inflated panic about "balloons". As it turns out, Donald Trump's campaign paid some $600,000 to a research group in late 2020 for a study on that year's election results. Specifically, the firm was tasked to ferret out any possible evidence of fraud in six key swing-states that might have swung the election from Trump to Biden. As one of those familiar with the study explained to WaPo: "They looked at everything: change of addresses, illegal immigrants, ballot harvesting, people voting twice, machines being tampered with, ballots that were sent to vacant addresses that were returned and voted. Literally anything you could think of. Voter turnout anomalies, date of birth anomalies, whether dead people voted. If there was anything under the sun that could be thought of, they looked at it." But the results of the study were never released. Why? Because the well-paid researchers were unable to find any evidence that the election was stolen, fraudulent or even in error in anyway. The results were given to Trump, however, in December of 2020. Nonetheless, days later, on January 6, 2021, he continued his lies anyway, leading directly to the deadly insurrection at the Capitol, for which he has yet to be held to account in any way.
  • Finally, Desi Doyen joins us for our latest Green News Report, with the wildly under-reported news of the chemical train derailment, fire and controlled release of toxic chemicals in East Palestine, Ohio last week; After ExxonMobil declared record profits last year, they have signaled their intent this year to do away with their algae biofuel research scam they've been green-washing their company with for years now; And some seemingly good news for EVs following Sunday's Super Bowl...

The long-awaited GOP-led House hearings are now getting under way in full. And, as we've previously predicted, they ain't going well...for the Republicans. Also on today's BradCast, a few critical (and good news) updates to several stories we've covered in the recent past, as well as some encouraging breaking news on the worsening woes of our failed former President. [Audio link to full show is posted below this summary.]

Among the stories covered on today's show...

  • A few weeks back, longtime Congressional ethics expert Craig Holman of Public Citizen joined us to explain the House GOP's attempt, buried in their new rules package adopted at the beginning of the new session last month, to kill the independent Office of Congressional Ethics. That is the very effective body that runs real investigations into Congressional members' crimes and ethics lapses, by way of contrast with the House Ethics Committee which, as Holman told us at the time, is "literally designed to sweep ethics matters under the rug." The new House rules were cleverly crafted by Republicans to cripple the OCE --- along with any real probes of folks like George Santos or Kevin McCarthy and the several other GOP members who defied Congressional subpoenas last year. But, at the last second this week, House Dem Leader Hakeem Jeffries appears to have saved the day --- and the OCE --- with some very quick work to thwart the GOP scheme to kill this critical agency.
  • In another good news update today to yet another story we've been covering in recent weeks, the long and confusing battle over majority control of the Pennsylvania state House is now all but settled with the election of all three Democrats in three different Special Elections held on Tuesday to fill three vacancies in the chamber. That means that Dems will now have full control of the House in the Keystone State for the first time in over a decade. Critically, they will now be able to thwart the effort by the previously GOP-controlled legislature's plan to adopt a state Constitutional amendment that would declare there is no right to an abortion in the state.
  • And, in still more good news on reproductive freedoms and the importance of elections, last November, Democrats won a trifecta in the great state of Minnesota, as they gained majority control of both chambers in the state legislature and control of the Governor's mansion. They have now begun to move a huge number of long-overdue progressive priorities forward. Last week, they adopted a statute to protect reproductive freedoms in the state --- the first state to do so after last summer's SCOTUS reversal of Roe v. Wade --- and, this week, Gov. Tim Walz signed a measure that mandate MN's move to 100% carbon-free electricity by 2040! (And there is much more to come. Elections matter!)
  • Next, it's on to the ridiculous hearing held on Wednesday in the newly GOP-controlled Oversight Committee in the U.S. House. The long-awaited hearing, featuring a panel of witnesses who formerly worked at Twitter, was meant to examine alleged federal government censorship on the social media site. Specifically, a two-day pause on the broad sharing of a questionable New York Post article in early October 2020 on a laptop purportedly abandoned by Joe Biden's son, Hunter Biden. The hearing did not go well for the Republicans. As it turns out (and as we've told you previously), there is no actual evidence of the FBI or any other government agency, censoring the laptop story --- or any other --- at the social media network, even though Republicans are now pretending that the FBI (Trump's FBI, by the way!) somehow used Twitter to rig the 2020 election for Biden. If all of that sounds ridiculous, it's because it is. We share several clips today from the hearing, which failed to reveal evidence that Biden or the Democrats or the FBI or the "deep state" violated the First Amendment in somehow censoring --- or trying to censor --- Twitter. But, you know who did? Yup, Donald Trump and his White House, as revealed by Democrats and the former Twitter employees who testified at Wednesday's sort of hilariously failed hearing.
  • Also today, Desi Doyen and our latest Green News Report with details on environmental elements of Biden's Tuesday State of the Union address; new evidence of more lies and war profiteering by BP; a foiled neo-Nazi attack on the power grid in Baltimore; and more on that great news about the clean energy mandate (as noted above) out of MN.
  • Finally, some breaking news as today's show wraps up: former Vice President Mike Pence has reportedly been subpoenaed by Jack Smith's federal Special Counsel probe of Donald Trump's attempt to steal the 2020 Presidential election. That, according to ABC News, which broke the story first, suggests "a major escalation of Smith's probe"...
