For the second time in two weeks, the entire U.S. press has let itself be scooped by Rupert Murdoch's London Sunday Times on a dynamite story of criminal activities by corrupt U.S. officials promoting nuclear proliferation. But there is a worse journalistic sin than being scooped, and that is participating in a cover-up of information that demands urgent attention from the public, the U.S. Congress and the courts.

For the last two weeks --- one could say, for years --- the major American media have been guilty of ignoring entirely the allegations of the courageous and highly credible source Sibel Edmonds, quoted in the London Times on January 6, 2008 in a front-page story that was front-page news in much of the rest of the world but was not reported in a single American newspaper or network. It is up to readers to demand that this culpable silent treatment end.

Just as important, there must be pressure by the public on Congressional committee chairpersons, in particular Representative Henry Waxman and Senator Patrick Leahy. Both have been sitting for years on classified, sworn testimony by Edmonds --- as she revealed in the Times' new story on Sunday --- along with documentation, in their possession, confirming parts of her account. Pressure must be brought for them to hold public hearings to investigate her accusations of widespread criminal activities, over several administrations, that endanger national security. They should call for open testimony under oath by Edmonds --- as she has urged for five years --- and by other FBI officials she has named to them, as cited anonymously in the first Times' story.

And this is the time for those who have so far creditably leaked to the Times of London to come forward, accepting personal risks, to offer their testimony --- and new documents --- both to the Congress and to the American press. I would say to them: Don't do what I did and waste months of precious time trying to get Congressional committees to act as they should in the absence of journalistic pressure. Do your best to inform the American public directly, first, through the major American media.

But perhaps today the alternative media and the international press are a necessary precursor even to that. It shouldn't be true, but if it is, it's a measure of how far the New York Times and Washington Post have fallen from their responsibilities to the public, to their profession and to American democracy, since I gave them the Pentagon Papers in 1971. They printed them then. Would they today?

Existence of FBI Case Number, Described in Anonymous Letter Obtained by The BRAD BLOG, Corroborated by Paper

London's Sunday Times has just published a follow-up to their explosive front-pager from two weeks ago which described allegations by former FBI translator turned whistleblower Sibel Edmonds.

Though there has been worldwide coverage of the recent blockbuster in the Rupert Murdoch-owned British paper, the U.S. media have remained entirely mum, a point which has drawn great consternation from both Edmonds and the 70's-era "Pentagon Papers" Daniel Ellsberg, whom The BRAD BLOG has spoken to this evening, following the release of tonight's extraordinary new Times piece.

The paper now reports that they are able to corroborate an apparent FBI cover-up of documents detailing an investigation of the theft and sale of nuclear secrets to agents working for Turkey and Israel, who in turn shared the secrets with Pakistan, who in turn may have shared those secrets with Iran, North Korea, Libya, and possibly even al-Qaeda.

As The BRAD BLOG reported along with the Times two weeks ago, the operation also includes allegations that high-ranking U.S. officials --- such as Marc Grossman, a former U.S. Ambassador to Turkey, who served as the #3 official in the State Department under Colin Powell and Richard Armitage from 2001 to 2005 --- were involved in the sale of those secrets and may have accepted pay-offs from agents in the black market network in the bargain.

The Times article tonight was originally published under the headline "FBI 'covers up' file exposing theft of nuclear secrets," according to Google News.

Though that header has already been changed to "FBI denies file exposing nuclear secrets theft."

The Times' article refers to an FBI case number (203A-WF-210023) referenced in an anonymous letter sent to The Liberty Coalition, a DC-based transpartisan civil and human rights watchdog organization. A subsequent Freedom of Information Act (FOIA) request, asking for information referring to that case number, resulted in a denial from the FBI that such a case exists.

The letter describes, among other things, allegations that Grossman had warned officials at the Turkish embassy in DC of the existence of a CIA counter-proliferation operation using a "CIA cover company" by the name of "Brewster Jennings." That company was a front used by covert CIA operative Valerie Plame Wilson, who was later outed by White House officials in the now-infamous CIA Leak case.

The BRAD BLOG had obtained a copy of the anonymous letter some weeks ago, along with the FBI's denial of the existence of related information via the FOIA request. We've been in touch with the Sunday Times over the past week, as this story has been developing.

We have yet to publish the letter in full, however, as we have been unable to independently corroborate a number of allegations made in the letter.

The Times, however, reports that they've "obtained a document signed by an FBI official showing the existence of the file" referred to in the anonymous letter.

We've also just spoken to Edmonds, who has been under an unprecedented 5-year-long gag order by the U.S. Department of Justice. The DoJ has threatened Edmonds with prosecution under the so-called "State Secrets Privilege." The threat of prison has kept her from speaking publicly about details related to the case, which she claims to have heard while translating wiretaps for the FBI in 2001 and 2002. She has spent many years encouraging members of Congress to hold hearings and a public investigation into the case. Despite public support from senators such as Patrick Leahy (D-VT) and Chuck Grassley (R-IA), and a promise for investigations from members of Rep. Henry Waxman's (D-CA) office, who have been briefed on the details, no such investigation has been carried out to date.

Edmonds denied being the source for the anonymous letter, telling The BRAD BLOG "absolutely not," when we asked her directly if she was its author...

Could Set Stage for Christmas Pardon

USA Today:

Lewis "Scooter" Libby is dropping the appeal of his criminal conviction in the CIA leak case, his lawyer tells the Associated Press.

"We remain firmly convinced of Mr. Libby's innocence," attorney Theodore Wells tells the wire service. "However, the realities were, that after five years of government service by Mr. Libby and several years of defending against this case, the burden on Mr. Libby and his young family of continuing to pursue his complete vindication are too great to ask them to bear."

President Bush commuted Libby's 30-month prison sentence in July after a jury convicted him of lying to federal agents. They were investigating the source of leaks that identified an undercover CIA officer who was married to a former diplomat who had criticized the invasion of Iraq.

At her daily briefing today, White House spokesperson Dana Perino refused to speculate whether Scooter Libby would be pardoned over the upcoming holidays.

The White House is blocking efforts by special prosecutor Patrick Fitzgerald to present evidence he collected in the CIA Leak investigation to the House Oversight and Government Reform Committee, according to the committee's chairman, Henry Waxman (D-CA).

Prompted by Scott McClellan's statement last month asserting that top White House officials, including George Bush and Dick Cheney, were complicit in an effort to deceive the public about the leak, Rep. Waxman has written to Attorney General Michael Mukasey urging him to convince Bush to release the evidence.

In his letter, Rep. Waxman points to a precedent from the Clinton administration:

"[There] is direct precedent for the production of these records to the Committee. During the Clinton Administration, the Justice Department provided the Committee with dozens of FBI 302 reports of interviews with White House officials. No White House official — including the President and the Vice President — was exempted from the production. Among the White House officials whose FBI 302 reports were provided to the Committee were President Clinton, Vice President Gore [and 10 other top White House officials, including current and former chiefs of staff].

Of particular interest are Fitzgerald's notes from his interviews at the White House. If either Bush or Cheney gave statements that contradict McClellan's, a new investigation would likely be triggered. Lying to federal prosecutors is a felony.

The 'Diebold Whistleblower' Sees His Charges Reduced to a Misdemeanor, But Unlike Republicans Who Have Committed Far More Serious Crimes, Heller Continues to Pay

I am no longer a felon.

In brief, I became known to some as the "Diebold Whistleblower" when, in January of 2004, I stole and exposed legal documents [PDF] proving that Diebold Election Systems, Inc. was using and planned to continue using illegal, uncertified software in their California voting machines. (By the way, Diebold recently changed its name to Premier Election Solutions, but don't let that fool you; it's still the same bunch of idiots.) Details about my case can be found here and here [PDF].

The documents I stole were covered under attorney-client privilege, so my theft was a serious crime. In February of 2006 I was charged with three felonies. On November 20, 2006, I plead guilty to one felony count of unauthorized access to a computer, and in exchange for my guilty plea and a restitution payment of $10,000 to the law firm from which I stole the documents, the law firm promised they wouldn't bring a civil suit against me, and I was put on felony probation instead of being sent to jail. The term of probation was to be at least one year, and as much as three years.

Now, one year after my guilty plea, because I've stayed out of trouble and because I'm a first offender, the judge has reduced my felony to a misdemeanor. Sometime in 2008, my lawyers will petition the court to have my misdemeanor expunged.

The bad part is that the most troublesome aspect of my probation is still in force. Before I can accept a job at which I would use a computer networked to one or more other computers (basically any job for which I'd be qualified), any potential employer must write to the judge in my case, tell him that they know about my conviction and that they still want to hire me, and then we have to wait until the judge responds with a "yes" or a "no" before I can accept the job and start work (and then only if the judge says "yes"). So as you can see, employers will be falling all over themselves to hire me.

Yeah, right.

Meanwhile, my wife (an actor, filmmaker and writer) certainly hasn't lost her sense of humor. She had been calling me Felonious Punk, but now that I'm no longer a felon, she's switched to Mister Meanor. Ain't it great being married to a comedy writer?

To be clear, breaking attorney-client privilege is a very serious crime, and I accept responsibility for what I did. I'm still being punished for it, and so far the punishment has cost my wife and me over $210,000 - and counting. $210,000 is an enormous amount of money to us. My wife and I have paid and are continuing to pay a very high price for my crime.

But, as we're not Republicans, we might have expected that.

Which got me thinking about other crimes in America that have recently been committed or alleged, and what's happened to those involved. Among the first of many, Lewis "Scooter" Libby comes to mind...

Says Covert Agent Valerie Plame Wilson Should Have Been Outed Because She Contributed to Al Gore...

In 1999, former Pres. George Bush famously said, "I have nothing but contempt and anger for those who betray the trust by exposing the name of our sources. They are, in my view, the most insidious of traitors."

John Gibson, the Fox "News" anchor, takes an opposite view. He says he wants to "give a medal" to the Bush officials who deliberately jeopardized a top-secret, well-established CIA program that tracked the sales of weapons of mass destruction in black markets worldwide.

Why would a rightwinger like Gibby want to pin a medal on these traitors? Because the traitors are Republicans --- a cabal led by Dick Cheney and that included Karl Rove and Scooter Libby --- while the covert agent in charge of the CIA's top secret WMD tracking program, Valerie Plame Wilson, made a campaign donation to Al Gore in 1999.

(Ed Note: It is our understanding that she and her husband, former Ambassador Joe Wilson, also contributed to George W. Bush's campaign at the time as well.)

In her 20 years as a spy for the United States, Agent Wilson worked for a front business, an oil industry consulting firm called Brewster Jennings and Associates. She frequently traveled overseas where she developed a network of secret "assets" --- foreign nationals who provided her with inside knowledge on the movement of chemical, biological and even nuclear weapons and materials in the worldwide terrorist black market.

The CIA will not say, of course, how many of these foreign assets were compromised, killed, wounded or kidnapped and tortured as a result of Cheney's treasonous conspiracy to forfeit them by exposing Agent Wilson's covert identity.

And only time will tell how many weapons of mass destruction were transported undetected because Agent Wilson's network was forfeited --- and whether one or more of these weapons will be used to attack the United States.

But none of that matters to Republicans like John Gibson and his cohorts at Fox "News" and in the Bush White House, whose patriotism is as fake as the made-in-China American flags pinned to their lapels. Gibson's remarkable statement advocating giving a medal to Rove, Cheney and Libby --- the "most insidious of traitors" who betrayed vital national secrets --- exposes him for what he is: an ideologue who puts his party ahead of his country even at the risk of national security.

Says Bush Didn't Know He Was Lying When He Told Scotty Rove Was Not Involved

Yesterday we reported that in an excerpt from his upcoming book on his years as Bush's press spokesman, Scott McClellan wrote that, in 2003, when he exonerated Scooter Libby and Karl Rove of any involvement in the leak of the secret identity of CIA agent Valerie Plame Wilson, he had unknowingly lied. "And five of the highest ranking officials in the administration were involved in my doing so: Rove, Libby, the vice president, the President's chief of staff, and the president himself."

Today, predictably, McClellan's publisher is trying neuturalize McClellan's claim that Bush was in on the conspiracy to deceive:

Peter Osnos of PublicAffairs, told MSNBC that Mr. McClellan "did not intend to suggest Bush lied to him" about two senior aides’ roles in leaking the identity of Valerie Plame Wilson, a C.I.A. operative, to the conservative columnist Robert Novak and others in 2003.

Right. Except that is precisely what he wrote in the excerpt. Here's how Osnos squares the circle:

"[Bush] told him something that wasn’t true," Osnos told Bloomberg News, "but the president didn’t know it wasn’t true," And: "The president told him what he thought to be the case."

In New Book, Former White House Spokeshole Blames Lies about Plame Leakers on Bush, Cheney, Rove, Libby and Card...

The title of former Bush flak Scott McClellan's new book, "What Happened" brings to mind the title of O.J. Simpson's recent allegedly fictional memoir, "If I Did It."

Perhaps it's because both books seek to exonerate their authors from much deserved guilty verdicts --- both in the court of public opinion and in courts of law, certainly in O.J.'s case, and maybe even for Scotty too.

Here's an excerpt from Scotty's book:

The most powerful leader in the world had called upon me to speak on his behalf and help restore credibility he lost amid the failure to find weapons of mass destruction in Iraq. So I stood at the White house briefing room podium in front of the glare of the klieg lights for the better part of two weeks and publicly exonerated two of the senior-most aides in the White House: Karl Rove and Scooter Libby.

There was one problem. It was not true.

I had unknowingly passed along false information. And five of the highest ranking officials in the administration were involved in my doing so: Rove, Libby, the vice President, the President's chief of staff, and the president himself.

And this was not just run of the mill political spin. Rove, Libby, Ari Fleischer and others, including Colin Powell's righthand man Richard Armitage, leaked the secret identity of a CIA agent whose specialty was tracking WMD. And they did it at the behest of the vice president who eagerly jeopardized state secrets for the tawdriest of purposes: to do political damage to the agent's husband, Joe Wilson, because he had dared to expose a lie told by the president in his 2003 State of the Union speech about Iraq seeking uranium from Niger.

The CIA, of course, can't reveal how many illegal weapons were successfully transported into the Middle East or how many foreigners acting as U.S. agents were permanently sidelined --- or captured or killed --- as a result the treasonous act of outing Agent Plame by George Bush, Dick Cheney and their henchmen.

Only Armitage has expressed regret about the leak.

Scott McClellan shredded his credibility for Bush, Cheney and the rest. Surely he can't expect anyone to believe he is telling the truth now when he claims he was misled by these same people. He is either the most gullible person to walk the planet, or he thinks the rest of us are fools.

Yes, she was covert until being outed by the White House.

Yes, she was monitoring nuclear weapons and other WMD going into and coming out of Iraq and Iran, as RAW STORY's Larisa Alexandrovna correctly and originally and exclusively reported in February of 2006.

Yes, her outing led to a still-classified CIA damage assessment and "serious" consequences" to other members of her CIA intelligence network.

No, despite Bush's promise, no one has ever been held accountable for leaking her identity in the first such outing of a covert CIA operative by agents of the U.S. Government itself.

No, Bush "is not a man of his word," as Valerie Plame Wilson told 60 Minutes tonight in her first broadcast network interview. Here's the video in two parts...

Some of what Plame is still not allowed to say, including details about "being taken hostage and subjected to torture for two days," is covered by her former CIA colleague, Larry Johnson, right here...

And in another posting today, Johnson gives us some details from Plame's new book, Fair Game: My Life as a Spy, My Betrayal by the White House, in which it's disclosed that "In 2004 the FBI received intelligence that Al Qaeda hit teams were en route to the United States to kill Dick Cheney, Karl Rove, and Valerie Plame."

So what did the White House do about it? Johnson tells us...

When the White House learned of these threats they sprung into action. They beefed up Secret Service protection for Vice President Cheney and provided security protection to Karl Rove. But they declined to do anything for Valerie. That was a CIA problem.

Valerie contacted the office of Security at CIA and requested assistance. They told her too fucking bad and to go pound sand. They did not use those exact words, but they told her she was on her own.

Amazing.

It was a big day on Thursday in the national capital, with several flaming surges hitting the news at once – the Washington Post hooking up with the MSM campaign to put “Hillary” over the top before the magic deadline of October 15 (more on that later, elsewhere); Rep. Henry Waxman and the House Government Reform and Oversight Committee holding a powerful hearing on Iraqi corruption; the blocking of Hans von Spakovsky's nomination to the FEC; and discussion of a proposed federal shield law for journalists (full text of bill here), which was reported out of the Senate Judiciary Committee today to the full Senate.

While I was able to sit in for hearings on two of the items above, space and time regrettably being constraints, I'll cover only the proposed shield law for the moment. Right up top, I have to say that I have qualms about it. A real leak, by a whistleblower exposing a crime or some danger to the public, is one thing. But protecting journalists from exposing a politically motivated ‘source’ trying to plant misinformation is another. This bill, as it was debated in committee and written about in papers yesterday, might equally protect both, if it protects either...

July 20 (Bloomberg) --- Patrick Fitzgerald won the convictions of four Osama bin Laden associates in May 2001. In March, he got Lewis "Scooter" Libby. Last week, he nailed Conrad Black.

Fitzgerald, 46, isn't saying what he'll do next in his career. Friends and colleagues say he probably will remain a prosecutor rather than join a law firm. One colleague says Fitzgerald's destiny may include the top law-enforcement job in the country: U.S. attorney general.

"I think he would make a spectacular attorney general," said former Deputy U.S. Attorney General James Comey

WASHINGTON --- A federal judge on Thursday dismissed former CIA operative Valerie Plame's lawsuit against members of the Bush administration in the CIA leak scandal.
...
U.S. District Judge John D. Bates dismissed the case on jurisdictional grounds and said he would not express an opinion on the constitutional arguments. Bates dismissed the case against all defendants: Cheney, White House political adviser Karl Rove and former White House aide I. Lewis "Scooter" Libby.

UPDATE: RAW STORY has a bit more and a link to the judge's ruling, which said, "The court ruled it lacked jurisdiction over Plame's case because she has not exhausted administrative remedies under the Federal Tort Claims Act, which is the 'proper, and exclusive, avenue for relief on such a claim.'"

In a statement to RAW from CREW's Melanie Sloane, representing the Wilsons, she said they intend to appeal the decision to a higher court. "We disagree with the court's holding and intend to pursue this case vigorously to protect all Americans from vindictive government officials who abuse their power for their own political ends," she said. We'll try to get Sloane or Joe Wilson on for tonight's Peter B. Collins show for more reaction if possible.

Fred Fielding, Counsel to Richard M. Nixon and George W. Bush, Greenlights Probation

These are interesting times. A short update on the most recent legal motions in the Libby case:

As we know, in a Grant of Executive Clemency on July 2, George W. Bush commuted all prison terms for I. Lewis ‘Scooter’ Libby. The grant states that it leaves “intact and in effect the two-year term of supervised release, with all its conditions, and all other components of the sentence.”

What with Libby not having served any time, Judge Walton, the trial judge in the Libby case, ordered input from prosecution and defense on the question of whether there could be any “release” – and consequently any “supervised release,” i.e. probation.

First response came from Fred Fielding, Esq., now Counsel to the President. Fielding was the man who helped Nixon negotiate the shoals of the Watergate investigation --- speaking of no jail time --- concluding with Nixon’s resignation followed in short order by a presidential pardon even without a conviction – and, according to Nixon and then-President Gerald Ford, without even a request for a pardon. One sees why Fielding would be welcome aboard the current White House.

Looking into the combination high-level and shadowy backstory of Marc Rich, pardoned unpardonably by former President Clinton on the latter’s last day of office, will throw further light on the longterm Libby-Cheney relationship.

While this little item below went rapidly down the memory hole, back in early 2001 (very early) the incoming Bush administration made little noise (very little, very quickly ceased) about revoking Rich’s pardon. No public emphasis by the administration that Libby, the new chief of staff for Cheney and Special Assistant to Bush, had recently been Marc Rich's attorney for twelve years.
