We pick up on today's BradCast with something that came up at the very end of yesterday's program. [Audio link to full show follows this summary.]

After I raised the question we've been discussing of late, regarding why Donald Trump is seemingly dismantling the U.S. Government from top to bottom, despite the unpopularity of the bulk of his actions, our friend 'Driftglass', one of my guests yesterday, suggested that everything Trump was doing was clearly very popular with Russia and its strongman President Vladimir Putin.

Democratic U.S. Senator Jeff Merkley came at the same the point during a confirmation hearing this week for two Trump nominees in the Senate Foreign Relations Committee. "Is President Trump a Russian asset?," the Oregon Senator asked Deputy Sec. of State nominee Christopher Landau directly, before detailing one thing after another that Trump has done, particularly regarding Ukraine, that would seem to directly benefit Putin.

"What else could a Russian asset actually possibly do that Trump hasn't yet done?," he asked both Landau and Matthew Whitaker, Trump's nominee to be Ambassador to NATO. Tune in for Merkley's full line of questioning and the two nominees' embarrassingly evasive answers.

Relatedly, and amusingly, Elon Musk's AI chatbot called Grok, was asked a similar question this week. The query asked Grok to "use all publicly available information from 1980" through the present to determine: "What is the likelihood from 1-100 that Trump is a Putin compromised asset"?

We share part of the detailed answer, as Musk's AI explains why it estimates "a 75-85% likelihood Trump is a Putin-compromised asset, leaning toward the higher end due to the consistency of his behavior and the depth of historical ties."

Well, that's probably embarrassing for Musk's co-President.

As to Merkley's question about what else a Russian asset could "actually possibly do that Trump hasn't yet done," while Trump's nominees tried to change the subject rather than answer that question, Reuters offers an exclusive today that offers such an answer. The outlet is reporting that Trump is readying plans to revoke legal status for some 240,000 refugees who fled to the U.S. from Ukraine after Russia's invasion of their country. They also cite reporting from CBS News last week that Trump is planning to revoke legal immigrant status for as many as 1.8 million migrants here legally from Cuba, Haiti, Nicaragua, Venezuela and, perhaps most alarmingly, Afghanistan.

Reuters details the case of a former Afghan intelligence officer who served as a CIA asset identifying "High Value Targets" for the U.S. during our long war there. He was granted a two-year parole by the U.S. in January of 2024, on the very strong recommendation of his CIA handler after the Taliban retook Afghanistan. The man, with no criminal record, identified as Rafi, was recently detained by ICE when he showed up for a regular check-in, in advance of an asylum hearing scheduled for next month. When Reuters inquired with ICE as to why they were keeping Rafi in detention, they were told that immigration policies for Afghan refugees who aided Americans were "ended on January 20, 2025," the day Trump was sworn in to office.

If it's not clear by now that Republicans are lying when they claim to support "legal" immigration, they're just against people coming here "illegally", then the stunning story of what the National Republican Congressional Committee (NRCC) tweeted last night about Rep. Adriano Espaillat (D-NY) --- a 40-year American citizen who came to the U.S. lawfully as a child 60 years ago, and delivered the Spanish-language rebuttal to Trump's address to Congress on Tuesday night --- may be an eye-opener for you.

It's one disaster after another on today's BradCast. [Audio link to full show follows this summary.]

Last night, 67 people were killed when an Army Helicopter crashed into an American Airlines jet from Wichita, Kansas as it was coming in for a routine landing at Reagan National Airport in D.C. Everyone in both aircrafts is presumed dead.

Today, even as dozens of bodies were still unrecovered from the icy Potomac River, and before virtually anything was known about the cause of last night's deadly disaster, the President of the United States presented a sick, disgraceful, lie-filled, misinformation-fest, disguised as a White House press briefing. He blamed "diversity" hiring by his two Democratic predecessors for the disaster, while admitting he had no evidence to support his claim, other than his "common sense" and "high level genius." I've got a thing or two to say about all of that on today's program.

While I wouldn't normally have drawn such an inference this soon after such a national tragedy or in just week two of any Presidency, given Donald Trump's appalling comments today, I felt it necessarily to detail that, in his very first week on the job, Trump fired the leadership of the FAA and TSA, as well as the entire membership of an air security and safety commission. He named no acting Director in the meantime at FAA, which had been in the middle of a hiring wave for air traffic controllers --- until Trump ordered a hiring freeze on his second day in office last week. Early reports from the FAA found that the air traffic control tower last night at Reagan National appeared to have been short staffed.

We'll wait for the NTSB's investigation (much less for the recovery of all the bodies) to be complete. But if there is any President to be blamed for what happened last night, the first major air crash in 16 years, it would seem be the "high level genius" currently in office, who thought it appropriate to use racist, sexist, ableist slurs to avoid accountability for his own pathetic, irresponsible actions in the first week of his second shamefully embarrassing Presidency.

THEN... We're joined by JACQUELINE SIMON, Policy Director of the American Federation of Government Employees (AFGE), the nation's largest federal workers union. She's here to discuss the Trump Administration's scammy email sent to some two million federal workers this week --- clearly written by co-President Elon Musk --- offering what many in the media incorrectly described as "buyout" offers this week.

In fact, it's a trap. The emails from the federal Office of Personnel Management --- portending to offer seven months of severance in exchange for workers at scores of federal agencies responding with "RESIGN" in the subject field of an email before February 6 --- were little more than "a barely veiled threat" to federal workers, charges Simon. Sign it now or be fired later. Moreover, she notes, "there's no guarantee whatsoever that anyone would ever see any of that money, because Congress would have to approve it. They don't have the money."

The scheme, Simon tells me, also ignores the legally required process for contract buyouts and severance pay for federal workers, as written into law. But, she observes, "they aren't really worrying the rules. They're not really worrying about the law. And if they are challenged, and if they do have to pay judgments, it's going to be the American people that pay. It's not coming out of Elon Musk's pocket. It's not coming out of Trump's pocket. It's coming out of your pocket and mine."

AFGE and several other public service unions also filed a legal complaint this week against a separate, if related scheme launched by Trump with an Executive Order signed last week. It would, if allowed by the courts, make it easier for him to fire career federal workers without cause which, Simon confirms, he has already begun doing unlawfully anyway.

Well, he did vow retribution against his "enemies". Today on The BradCast, we cover, among other things, Donald Trump's unlawful "Friday Night Massacre" of independent Inspectors General at Executive Branch agencies, his "Monday Massacre" of dozens of prosecutors this afternoon at the Dept. of Justice, and as much of note that happened in between that we find time for, along with speaking to callers on the back end. Among the many stories covered today...

  • Trump calls for ethnic cleansing in the Middle East, telling reporters on Air Force One over the weekend that he would favor "cleaning out" Gaza by sending Palestinians from there to other Middle Eastern countries. All the better to build sea side golf resorts in the strip of land that was previously home to more than two million.
  • In case you didn't notice last week (I wouldn't blame you) Trump, with a stroke of his Executive Order pen, ended anti-discrimination programs across pretty much the entirety of the federal government, as originally (and successfully) instituted via Executive Order by Lyndon B. Johnson back in the Civil Rights era. Calling it "a reversal of 60 years of progress" and "a blatant step backwards," Rep. Hank Johnson (D-GA) said in a statement, charging Trump's order "gives federal government officials and complicit federal contractors a green light to engage in discriminatory practices that exclude minorities and women from employment and contracting opportunities."
  • The laughably unqualified Fox "News" weekend co-host, accused sexual assaulter and public drunkard Pete Hegseth was confirmed as Sec. of Defense by Senate Republicans late on Friday night. All Dems voted against, and there were only 3 Republican defectors (Murkowsky, Collins and McConnell). That resulted in a tie vote which broken in Hegseth's favor by Vice President J.D. Vance. It was only the second time in U.S. history that a Presidential cabinet member faced a tie vote. (The first was Betsy DeVos' nomination for Education Secretary during the first Trump Administration.)
  • South Dakota Governor, puppy killer, and ridiculous liar Kristi Noem was confirmed by the U.S. Senate as Sec. of Homeland Security over the weekend. As DHS chief, she will oversee U.S. Customs and Border Protection (CBP); the Federal Emergency Management Agency (FEMA); the Transportation Security Administration (TSA); U.S. Immigration and Customs Enforcement (ICE); the United States Secret Service (USSS); the U.S. Coast Guard (USCG); and the Cybersecurity and Infrastructure Security Agency (CISA), among others. I'm sure it will go well. All Republicans voted for her. Six Democrats (Fetterman, Kaine, Kim, Peters, Slotkin and Shaheen) shamefully voted in support of this corrupt, inexperienced Trump stooge.
  • On Friday night, news broke that Trump had fired about 17 independent Inspectors General at agencies across the federal government in violation of the law (U.S. Code, Title 5, Section 403(b)) mandating that, while Presidents can fire Inspectors General, they must notify Congress in writing 30 days in advance before doing so, along with "substantive rationale, including detailed and case-specific reasons" for such removals. But, of course, who is going to enforce the law against the lawless Trump?
  • Speaking of which, on Monday, just before airtime, news broke that Trump's interim apparatchiks heading up the Dept. of Justice were sending out firing notices to more than a dozen prosecutors who worked with Special Counsel Jack Smith and those who prosecuted hundreds of January 6 cases.

We were promised there would be "shock and awe" and "rolling thunder" in the first few days of felon Donald Trump's second Presidency. Instead, as one of our guests on The BradCast quips today, what we've got, so far anyway, is more like "drooling thunder." [Audio link to full show follows this summary.]

Before we get to our guests today, some quick news...

  • Just as firefighters have largely gained control of the two largest, still smouldering fires out here in Los Angeles, and residents who still have houses standing are finally returning from long evacuations, a new, very fast moving blaze, dubbed the Hughes Fire, erupted in northern L.A. County, near Castaic, on Wednesday afternoon amid continuing, exceedingly dry and windy conditions.
  • Meanwhile, back in D.C., the Trump Administration is continuing to pretend there is a "national emergency" at the southern border (there isn't) --- despite Donald Trump's false declaration on Monday --- by sending thousands of more U.S. military troops there. They will join others who are doing largely logistical work, such as data entry and vehicle maintenance. But the new deployments may free up ICE agents for promised raids in U.S. cities in coming days.
  • Moreover, after Trump spent the last four years falsely claiming the Dept. of Justice was "weaponized" by the Biden Administration, the new Trump Administration is weaponizing the DoJ to investigate and prosecute local and state officials who are not sufficiently cooperative with upcoming federal round-ups of undocumented migrants.
  • Finally, Trump is rolling back Lyndon B. Johnson's landmark 1965 post-Civil Rights Act Executive Order barring discrimination in federal contracting and other federal programs. In Orwellian language, Trump's new Executive Order claims that programs meant to ensure diversity, equity and inclusion by barring discrimination amount to "discrimination". He has ordered federal anti-discrimination staffers put on immediate leave and all anti-discrimination programs immediately shut down.

Those moves were all largely expected, even if variously obnoxious, offensive and performative. In fact, while we had been told for months that Trump, having learned from experience and having shed all of those loser non-MAGA appointees from his first term, was ready to unleash holy MAGA hell on Day 1. So far, however, most of his poorly-written Executive Orders have either failed to include much "shock" or "awe", much less actionable items. The only real surprise is that he decided to issue pardons and/or clemency to more than 1,500 of his fellow January 6 felons and insurrectionists, including hundreds who violently assaulted law enforcement officials that day.

My guests today, two longtime progressive bloggers, are decidedly unimpressed with what they've seen so far. We're joined today for the first time in the new year by our old friends HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo blog, and DRIFTGLASS, author of his eponymously-named blog and co-host of the weekly Professional Left Podcast.

The Inauguration was "ridiculous," Digby tells me. "The fact that they had these oligarchs sitting behind him --- it's a joke. It's going to be remembered forever. It was the Oligarch Inauguration. That was a stupid mistake." She sees Trump's Executive Orders as "full of holes" and "absolutely unprofessional. All these months that they were supposedly putting this stuff together, it turns out that it's the same old sloppy garbage that they had done in the first term."

Driftglass argues that "nothing that happened during the entire Inauguration was anything but performing for his base," while cautioning: "When things actually hit the ground and hurt people, we should take it seriously. But this was all chaff, smoke and mirrors to make his base happy."

He warns, however, that "the amount of corruption" in this Administration "is going to be epic. The amount of looting, straight up looting, is going to be epic." So epic, in fact, he predicts "that it's going to affect the rest of the world. They're going to be taking everything but the kitchen sink, and it's going to have a direct effect on the economy."

As usual, both have got much more to say and make sense of in this historic moment. They concur that Trump has really stepped in it with his pardons of violent insurrectionists and attempted January 6 cop-killers. Do they feel the same about Joe Biden's last minute pardons for U.S. House January 6 Committee members and preemptive pardons for members of his family? Vance, dared to quote both Trump's own words and Christian scripture to plea with the new President to show mercy to marginalized people like migrants and those in the LGBTQ community.

"That was an act of pure Christian action and bravery in the face of tyranny," Driftglass says. "She really is a resistance hero," asserts Parton. "And I hate to say it, but the minute I heard that speech, the first thought that came to my head, as horrible as it it was: 'I hope they have security for her.' Because I am very worried for the safety of this woman. That is the country we are living in."...

I think we've got a humdinger for ya on today's BradCast. At least if you, like me, are still scratching your head every day as to why --- after all these years and all we now know about the disgraced former President and cognitively declining convicted criminal, and after last week's crushing debate defeat --- about a half of the nation's voters are still supporting this guy. Yes, his supporters are even out here in theoretically "liberal" Southern California, as our callers demonstrate today! [Audio link to full show follows this summary.]

First, we catch up a bit on some of the weekend's news, including the little that is currently known about the second attempted assassination of Donald Trump at one of his golf courses on Sunday; the many lies Trump told about immigration, the economy and wildfires during an appearance out here in Los Angeles on Friday (when he threatened to let the state burn to the ground if California Gov. Gavin Newsom --- who he called "Newscum" --- refused to do Trump's bidding if he becomes President again); and as Trump ignored and exacerbated the number of bomb and terror threats now being made against the residents of Springfield, Ohio.

After nearly a full week of Trump (and his running mate, Ohio Sen. J.D. Vance) making false claims that Haitian immigrants in the town are "illegally" there --- (They aren't. Both President Biden and then President Trump granted them the right to be there under a 1952 law) --- and that they are eating the dog and cat pets of other residents, Trump continues to double-down and make things even more perilous for the folks of Springfield, both old and new.

The Ku Klux Klan and other neo-Nazis have now descended on the town. The state's Republican Governor Mike DeWine has decried the rhetoric and false claims by Trump and Vance as "disgusting". The woman who made the initial Facebook claim, highlighted by Vance, about a neighbor's cat disappearing has admitted she had no first-hand knowledge and says she regrets her post. And the city has had to shut down or lock down city hall, elementary schools, college campuses and hospital facilities over the past week, thanks to Trump supporters threatening political violence.

Despite all of that, Trump had the temerity on Sunday night to blame the "rhetoric" of Biden and Harris for a mentally unstable guy's failed attempt to shoot the former President at one of his Florida golf courses. While both Biden and Harris immediately condemned the thwarted attack, noting "there is no place for political violence in America", Trump charged that it was the President and Vice President's words that that has put HIM In danger. He went so far as to tell Fox "News" that it was "their rhetoric [that is] causing me to be shot at," in the same breath that he charged they "are destroying the country --- from both the inside and out."

So, with all that we know about this guy, how can it be that he is still largely neck and neck with Kamala Harris in pre-election polling just 50 days out from this year's critical election?!

I thought I'd open the phones today specifically to Trump supporters (and, yes, we have them here in Southern California) to answer that question, by inviting them to let us know why they are still on board with him. They don't get a free pass. I challenge them a bit, but let them explain themselves in the bargain.

And, yup, if we can believe the very first caller, "Luther," who says he is from Arkansas, it is for at least one of the very worst reasons you can possibly imagine. You'll decide if he's for real or not. He was rather convincing. But the callers that followed didn't necessarily have much better reasons for their support of this guy.

Anyway, you'll be the judge. And I welcome your comments in response. Give it a listen. I think you'll "enjoy" today's program...

On today's BradCast: After the recent Republican National Convention, LULAC has decided they've had enough. They are coming off the sidelines for the first time in their nearly century-long history to endorse a Presidential ticket. [Audio link to full show follows below.]

Over the past week, Democratic Presidential nominee Kamala Harris, with her "joyful warrior" running mate, MN Gov. Tim Walz, have been barnstorming battleground states with rallies attracting 10,000 or 15,000 people at every stop. Her poll numbers are soaring (the NYT/Sienna poll, which has been very friendly to Donald Trump in recent months, now puts the Harris up by 4 points in each of the Democrats' key, must-win "Blue Wall" states (Michigan, Wisconsin and Pennsylvania) and both major labor unions and civil rights groups are jumping on board the train to endorse the Democratic Presidential ticket.

But, on Friday, the political arm of one such civil rights group, the League of United Latin American Citizens (LULAC), the nation's largest and oldest Latino advocacy group, did something they haven't done in their nearly 100 year history: they endorsed a Presidential ticket. In this case, they are tossing in for the Harris/Walz ticket.

We're joined today by former LULAC President and current Chair of the LULAC Adelante PAC, DOMINGO GARCIA, to explain why the group finally decided, through a unanimous vote, they had to get off the sidelines and get into this fight against the menace posed to the nation --- and specifically to Latinos --- by Donald Trump.

"We saw the rhetoric coming from ex-President Trump saying that he was going to deport 15 million people; he was going to build these mass concentration-deportation camps; he was going to have the Army go door to door and ask people for their papers. These are just bizarro, weirdo ideas," Garcia tells me. "Then we saw the visions of the Republican National Convention, of people [holding signs] saying 'mass deportations'. We were saying, 'Whoa, these guys have gone to the extreme far-right, with almost neo-Nazi Klan mindsets that need to be stopped."

Garcia explains why the group, which was founded after WWI, and considered one of the more conservative civil rights groups, finally learned to believe Trump after his campaigns in 2016 and 2020.

"We take Trump at his word now," says Garcia, noting they didn't believe Trump in 2016 that he was going to separate children from their parents. "And he did! We did not believe him. We did not think there was anybody capable of that kind of cruelty," he explains, recoiling from the sight of two and three-year olds in prison buses. "It was so shocking that that was happening to America. To have a repeat this cycle --- we support securing the border; we support opening up legal immigration and cracking down on illegal immigration --- but doing it in this sort of evil, cruel way, using immigrants for fear-mongering, scapegoating, and as his political pinatas, we said we have to put a stop to that."

Garcia believes that LULAC has the reach to stop Trump, particularly in battleground states like Nevada, Arizona, Michigan, Wisconsin and Pennsylvania, where the Latino populations easily overcome the margins in the Presidential races over the last two cycles.

FINALLY, as Harris/Walz continue to climb in the polls with their hopeful, positive campaign --- in contrast to Trump's dark, dystopian message --- listeners ring in on the addition of Walz to the ticket, and the madness of Trump, who now says that the tens of thousands turning out for Harris/Walz rallies is actually fake and being done by Artificial Intelligence. Yes, he is really claiming that the numbers that the Democratic ticket is drawing for rallies --- and caught on video by thousands of people --- is actually somewhere between zero and 1,000 or so, but for the use of A.I. to hoax the public into believing tens of thousands were there instead. Seriously. That's what he now says...

We are still hanging on for dear life here at The BradCast amid the past four weeks of non-stop political upheavals. But, at least this week, we've got some much more encouraging stuff to hang on to. For now. [Audio link to full show is posted below this summary.]

It remains to be seen how fleeing it all is, but over the past several days, I must say, I have never seen Democrats more united and elated as they have been since Kamala Harris ascended to become their presumptive 2024 Presidential nominee. One has to go back to the nomination of Barack Obama in 2008 for anything even close to the kind of giddy excitement and optimism we've seen since Joe Biden decided to drop out and pass the torch to Harris on Sunday. But, even back in 2008, the party was still smarting and somewhat riven over the outcome of a long and bruising primary cycle between Obama and Hilary Clinton (who wrote a very good op-ed about all of this in the Times yesterday, btw.)

The first polls taken solely after Biden's announcement and endorsement on Sunday are now beginning to trickle out, with a new Reuters/Ipsos survey taken on Monday and Tuesday this week finding Harris now up over Donald Trump nationally by 2 points. That may be a small lead, but it's a 4-point swing as compared to Trump's 2-point lead over Biden last week. Moreover, when RFK, Jr. was included in the question to respondents, Harris' lead grew to 4 points over Trump in the first polling from this outfit that has seen the former President actually losing to a Democrat since May of this year.

Furthermore, as one of our guests notes today, in the week following a party's national convention, we traditionally see a bounce for that party of anywhere from 2 to 4 points. In this one poll, at least, there is not only no bounce, but a loss of support for the GOP candidate following last week's Republican National Convention.

Of course, be sure to mind all of the usual caveats about such polls --- only one poll, margin of error, snapshot in time, national versus state numbers, etc. Nonetheless, the numbers would seem to be encouraging news for Dems after many weeks of the opposite.

To that end, we've got a lot to make sense of from the past several remarkable days, and we're joined by two old friends to help us do so. Today on The BradCast: Imagine if Justice Ketanji Brown Jackson was found to have been flying a Joe Biden "Dark Brandon" flag at her house. Ya think Republicans in Congress might have anything to say about it? Might take any action in response to it? [Audio link to full program follows this summary.]

Among the stories covered on today's program...

  • Republicans in the Ohio state legislature are still blocking Joe Biden from this year's Presidential election ballot in the Buckeye State. Even Republican Governor Mike DeWine is now calling it "ridiculous" and "absurd" and has called a special legislative session for next week to fix the problem that GOP lawmakers have so far refused to. Think they'll finally do it?
  • The corrupt rightwing majority on the packed and stolen U.S. Supreme Court on Thursday, allowed a racial gerrymander in South Carolina to remain in place for the 2024 election. All of the Court's liberal Justices dissented. The 6 to 3 majority opinion was written by Justice Samuel Alito, who appeared more concerned that state lawmakers might be seen as having engaged in "offensive and demeaning" conduct, than he did about the tens of thousands of Black voters in the state whose votes have been shifted to other districts to make it easier for Republican Rep. Nancy Mace to hold on to a seat in the U.S. House. It's not a racial gerrymander, the Court's Republican majority claims, it's a partisan one. And, apparently, that's just fine. (Justice Clarence Thomas went out of his way in a concurring opinion to note that racial gerrymanders are just fine as well.) All of that, after a lower court panel of federal judges found that SC's racial gerrymander amounted to the "bleaching of African American voters."
  • And, speaking of Sam Alito....Now the whole world knows, if they didn't already, that the corrupt, far-right Republican Supreme Court Justice is both a personal supporter of the Trump-incited 2021 insurrection at the U.S. Capitol and a Christian Nationalist. At least based on the two different flags he has been flying over two of his houses, according to more excellent reporting by the New York Times on Wednesday. That, as we await two different major rulings from the High Court regarding accountability for Donald Trump in relation to the insurrection. Neither Alito nor Thomas, whose wife directly participated in the insurrection, have recused themselves from either case. So, what are Democrats in the U.S. Senate going to do about any of it? So far, it doesn't look like they're prepared to do much, at least beyond issuing an occasional "outraged" press release. As discussed in some detail today, that needs to change.
  • One of voting system vendor Smartmatic's several, huge, defamation lawsuits for lies told about the company "rigging" the 2020 election, is against the far-right political propaganda outlet known as Newsmax. Court documents made public this week reveal that Newsmax destroyed evidence --- text messages and emails --- that they were required to retain for the lawsuit.
  • This week, Joe Biden cancelled student loan debt for another 160,000 borrowers, bringing the total number receiving some form of forgiveness up to nearly five million. His Dept. of Education has now approved about $167 billion in loan forgiveness under a number of different programs, following the corrupt SCOTUS ruling that prevented the President's initial effort to forgive up to $20,000 for some 43 million borrowers. Still, $167 billion is nothing to sneeze at. And it's money that can now go instead into the economy instead to purchase homes, cars, etc., which helps everyone. Fox "News", of course --- which had no problem when Trump gave trillions of federal dollars to millionaires, billionaires and wealthy corporations via GOP tax cuts --- seems to have a different opinion about federal government relief for those who actually need it.
  • Finally, Desi Doyen joins us for our latest Green News Report, as deadly, climate changed-fueled extreme weather lashes folks from Mexico to Iowa; Florida's Gov. Ron DeSantis signs a "Don't Say Climate Change" law as the state broils in yet another heat wave; Oakland, California becomes the nation's first school district to move to 100% all-electric school buses; And microplastics are now found everywhere, even inside of us. You'll have a ball finding out where scientists have discovered them most recently. It's nuts!...

We're back on today's BradCast after an unavoidable extended weekend due to a family funeral. We've got a lot to get caught up on today. [Audio link to full show follows this summary.]

Before we get to today's guest, a few quick headlines from over the weekend and through today...

  • Iran's President and Foreign Minister were killed over the weekend in a helicopter crash in foggy conditions in the northern part of the country.
  • The top prosecutor at the International Criminal Court is seeking arrest warrants for Israel's Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, as well as three Hamas leaders for war crimes and crimes against humanity in both Gaza and Israel.
  • A British court has granted WikiLeaks founder Julian Assange the right to appeal his extradition to the U.S. on 17 espionage charges and one for computer misuse related to the publication of classified U.S. documents 15 years ago.
  • The New York Times revealed last week that rightwing Supreme Court Justice Samuel Alito flew an upside down American flag --- a MAGA "stop the steal" symbol --- at his home for several days following the Trump-incited January 6, 2021 insurrection at the U.S. Capitol. Nonetheless, the corrupt Alito has failed to recuse himself from cases involving the 2020 election, including the Court's pending opinion on "Presidential Immunity" which has held up Trump's federal trial for months in his indictment on multiple failed attempts to steal the 2020 election.
  • Rudy Giuliani and 11 others, including Kelli Ward, the former chair of the Arizona Republican Party, were arraigned on Tuesday in Phoenix for their roles in attempting to steal the state's 2020 election for Trump. Giuliani and the others face multiple counts each (nine in Rudy's case) related to conspiracy, forgery and fraud.
  • The Defense rested on Tuesday in Donald Trump's 2016 election interference trial in New York, where he is facing 34 felony charges related to the falsification of documents to hide a hush-money payment to a porn star just before that year's election day. The disgraced former President, who repeatedly vowed that he would testify in his own defense at the criminal trial, did not do so. As expected. Closing arguments are next week.
  • Voters headed to the polls on Tuesday for down-ballot primaries and special elections in Kentucky, Oregon, Georgia and California on Tuesday. We'll have any available noteworthy results and problems reports on tomorrow's BradCast.

Then we're joined by VICTORIA CADOSTIN, researcher and writer at the non-profit watchdog organization DOCUMENTED to explain who is behind the new Trump-aligned extremist group known as "Citizens for Sanity". In a weekend article at The Guardian, Cadostin and her colleague Brendan Fischer break down details from newly obtained filings by the dark money group revealing they spent more more than $90 million dollars in the final few months of 2022 alone on a flood of what have been described as "vile, racist and transphobic" ads designed to disinform, terrify, divide and incite the voting public.

"They were one of the biggest election spenders in the last election cycle," Cadostin explains. "What's really alarming about it is that our records show that Citizens For Sanity is housed at the Conservative Partnership Institute, which has been characterized as the 'nerve center' of the rightwing." She describes the group as the homebase for the Trump Administration in exile, as it's led by former Trump Chief of Staff Mark Meadows as well as one of his former attorneys (and election fraudsters) Cleta Mitchell. It also shares the same leadership with American First Legal, a rightwing extremist lawfare organization headed up by Trump's MAGA anti-immigrant henchman Stephen Miller.

"CPI represents the creation of MAGA political infrastructure," says Cadostin. "These are all folks who are in the MAGA world very deeply, and who have a lot of power in that world, who are pushing out this messaging and pushing out extremism."

The group spent tens of millions of dollars from unknown donors on ads that air heavily in battleground states and swing districts, and even during highly-viewed mainstream events such as the World Series.

The organization uses racist messaging against Blacks and Latino immigrants in its ads, even while it also targets those same communities with different ads in hopes of suppressing their voters. "It's really a targeted effort to stoke racial hostility and suppress the vote however they can for the base that they don't think will vote Republican or conservative," she says. "While at the same time pushing out messaging that will move a conservative base, a white American base, to show up at the polls. It is very sinister, the way they are twisting this, using this information to mobilize one particular base against another."

"These divisive ads and the spreading of misinformation in order to sway folks in swing districts have a real impact outside of just voting," argues Cadostin. "This kind of messaging supports the rise of anti-trans legislation and violence against trans folks, as well as the rise in anti-immigrant sentiment, legislation and violence. Powerful folks are throwing money around to manufacture racial and gendered hostility in the voting population. And it's also further evidence that attacks on equality and democracy are often coming from the exact same place."

What can be done about any of it, since, as disgusting as it all is, it's all largely been legalized by a string of rightwing SCOTUS decisions over the years? We discuss that as well on today's BradCast...

The historic trial for Donald Trump's 2016 election interference indictment continues, but was on a break today in New York. That gives us an opportunity to get caught up with all the action since our previous mid-week "ketchup" episode in the first-ever criminal trial of a former U.S. President. We have much to discuss to that end on today's BradCast, but we first kick it off with some election and voting rights news. [Audio link to full show follows this summary.]

  • Democrats "massively outperformed" pre-election polling yet again on Tuesday, in a Special Election for the U.S. House in New York's 26th Congressional District. Timothy Kennedy was predicted to win the seat by 9 points. He won by 36!!!
  • The Trump-appointee heavy 3rd Circuit Court of Appeals voted to uphold a three-judge panel finding that mail-in ballots with missing or incorrect dates on their outer envelope in Pennsylvania must be tossed out, even though, as both sides agree, that date is used for exactly nothing. If a voter, for example, writes 2023 instead of 2024 on the ballot's outer sleeve this November, it cannot be counted, according to the Court. Democrats disproportionately vote by mail, as compared to Republicans, in the Keystone State. Voting Rights advocates are now deciding whether to take the matter to SCOTUS (good luck with that) or rehear the matter on a different basis at the trial court. Both options offer a perilous path before this year's election in the critical battleground state.
  • In an absolutely twisted ruling, a three-judge federal panel ruled on Tuesday struck down Louisiana's newly-drawn second majority-Black U.S. House district, declaring it to be "an impermissible racial gerrymander". The new House map was approved by the state's GOP-controlled legislature earlier this year after they'd lost their long fight in federal court against adding a second Black voting district in a state which has long had just one (out of six), despite Black voters comprising one-third of the state. The new map with the newly redrawn district was already used to select candidates in the state's primaries last month. As explained today, this is likely to become a real test of the corrupted U.S. Supreme Court's often opportunistically used, so-called "Purcell Principle".

We'll have likely-unsurprising results from today's Super Tuesday elections in 16 states on tomorrow's BradCast, but we've got a few reminders today of the stakes, the challenges ahead and why it all matters. [Audio link to full show follows below this summary.]

Among our stories today...

  • Arizona's former corporatist Democrat turned corporatist independent U.S. Sen. Kyrsten Sinema says she will not run for re-election this November, clearing the way for a 2-person race to fill her U.S. Senate seat this fall. (And, perhaps, with both her and West Virginia's Joe Manchin also not running for re-election this year, a path someday to restoring the gutted Voting Rights Act and much more.)
  • Speaking of the Voting Rights Act, a new study from NYU's Brennan Center of Justice out this week finds that the racial gap between white and black voters has been widening since the U.S. Supreme Court gutted the law's key provision in 2013's Shelby v. Holder, claiming the landmark Act's protections against racially discriminatory voting laws and rules was out of date and no longer needed. While the racial disparity gap has grown everywhere across the country, it has grown twice as much in jurisdictions with a history of racial discrimination at the polls where minority voters were previously protected by the VRA's currently-gutted Section 5 "preclearance" requirement.
  • As if that is not disturbing enough, Republican "voter fraud" fraudster groups, such as the disgraced disinformationists at True the Vote, are ramping up efforts to suppress the vote in advance of this year's general election. According to a new New York Times investigation, a "grassroots" campaign has been quietly challenging the eligibility of thousands of legally registered voters at the County level in a number of swing-states around the country since 2020, removing eligible voters in the bargain and otherwise setting up for post-election challenges to the rolls this November, in the event that Donald Trump loses again.
  • And speaking of the disgraced former President and current 2024 GOP front-runner, his longtime Chief Financial Officer, Allen Weisselberg is headed back to prison after spending about 100 days in Rikers last year related to a years long tax fraud scheme with the Trump Organization. On Monday, the 78-year old pleaded guilty to two counts of perjury after lying on the stand and in depositions with New York state prosecutors regarding his role in the massive, years-long fraud scheme by Trump, his company and his top executives. Trump and the executives, including his two eldest sons and Weisselberg were all found liable in the state's civil fraud case against them. Trump must now pay more than $450 million in penalties. His NY state criminal trial on 34 felony counts related to hush-money payments to help him win the 2016 election begins later this month, as Weisselberg prepares for another five months in the pokey, though he will not be required to testify against Trump under the plea deal.
  • But it's not just rightwingers facing justice this week. On Tuesday, New Jersey's Democratic U.S. Senator Bob Menendez and his wife saw new obstruction charges added to their existing indictments related to allegedly accepting gold bars, cash and a luxury car as bribes in return for favors to several businessmen. Menendez stands accused of using his former position as Chair of the powerful Senate Foreign Relations Committee to help his business associates get multi-millionaire deals with Qatari investment funds and the government of Egypt.
  • Okay, it's just mostly rightwingers. Liberty University, one of the nation's largest so-called "Christian" schools, founded by the late Jerry Falwell, Sr., and subsequently run by his son Jerry Falwell, Jr. (until he was forced out in scandal) has agreed to pay the largest fine ever under the federal Clery Act, requiring that colleges and universities that receive federal funding keep detailed public lists of campus crime statistics. The school must cough up an unprecedented $14 million related to its years-long cover-up of sexual abuse and rape allegations, while fostering a community of fear for women who were often victimized and/or ignored after reporting such incidents to school officials.
  • Finally, Desi Doyen joins us for our latest Green News Report, as record heat and wildfires continue in Texas; California's Sierra Mountains dig out from an intense weekend blizzard with hurricane-force wind gusts; And as the Biden Administration announced billions of dollars for cleaning up and modernizing the nation's ports under the Democrats' Inflation Reduction Act...

Guest: Reformed 'Ultra-MAGA' member Rich Logis on 'Leaving MAGA'; Also: Is this the week the tide finally begins to turn against Trump?...

Today on The BradCast: Escaping MAGA and whether real accountability for the former President's many crimes and civil verdicts might finally begin to bend the curve against him from within his own party and from his own supporters. [Audio link to full show follows this summary.]

On Friday, a nine-member federal jury in New York ordered Donald Trump to pay an additional $83.3 million to writer E. Jean Carroll, who an earlier 9-member jury determined last year that he had sexually assaulted and repeatedly defamed. The original verdict cost him $5 million, but wasn't enough to stop the repeated defamation of Carroll.

All of this comes on the cusp of a completely separate verdict in a state case in NY where the judge has already determined Trump committed massive fraud by falsely inflating his assets to receive more favorable rates on bank loans, insurance and taxes. The State A.G. has asked that the judge now find Trump and his companies and his top executives (including his two eldest sons) liable for at least $370 million. That ruling is likely to come any day now.

A hundred million here, a hundred million there, and, before ya know it, you're talking about real money. Even for a "billionaire" like Trump. But will any of it make a difference to Trump's most ardent supporters? How about the few Republicans left who are neither Never Trumpers nor hardcore MAGA? Will they finally take notice? Might these rulings begin to make a difference in GOP primary polling, as the disgraced former President continues to be the party's front-running nominee for the 2024 Presidential election?

For thoughts on all of that and much more, we're delighted to be joined again today by RICH LOGIS, a former hardcore MAGA member himself who voted for Trump in both 2016 and 2020, before eventually coming to terms with the fact that he had become captive to what is a far-right political cult. (Our first conversation with him, with more details on that, was in October last year.)

Logis now runs PerfectOurUnion.us, devoted to "healing political trauma" and "building diverse, pro-democracy alliances". Today, he offers his insight, as a reformed MAGA member and former Republican pundit, on whether any of the recent verdicts against Trump --- and/or those that are still to come in the four separate criminal felony cases he is facing this year --- might finally begin to turn the tide away from the GOP's cult leader.

We also discuss Logis' thoughts published recently at Salon, on why the MAGA crowd is so gullible to mythologization and race-baiting, and how even Nikki Haley is now tapping into the same bloodstream to capitalize on a party that has long been captured (well before Trump) by racist polarization and "White fright".

Logis is now creating a new organization specifically devoted to "Leaving MAGA" and we begin the important discussion of how to help those captured by MAGA find their way out, and what friends and family members may be able to do to begin helping their loved ones find their way home.

"As someone who was in MAGA for seven years," he tells me, "Most MAGA voters are good people, deep down. But, unfortunately, the relationship between most MAGA Americans and Donald Trump is a very toxic one. While I don't defend ignorance, MAGA Americans have been traumatized by Trump and the rightwing and the Republican Party. They just have a skill set at keeping MAGA Americans desperate and panicked."

But, he insists optimistically, "if someone got into MAGA, they can get out of it." His own catalyst came after coming to terms with the fact that his own Governor, Ron DeSantis, who he had previously supported, was willing to let people die by lying to them about COVID vaccines in 2021.

"If someone who is very pro-MAGA speaks to someone who is very anti-MAGA, I guarantee, if they speak long enough, they're going to find some issues that they have some common ground and agreement on." He cautions, however, that vilification doesn't work. If it did, "everybody would have left at this point."

"It's going to take time," Logis insists. But he believes "there are more out there who are in the nascent stages of remorse. Because ultimately the strength of the numbers in Leaving MAGA will be in how many we can encourage and empower to leave and tell their stories publicly."

Until his new organization is formally unveiled, he asks folks to contact him at his website. This conversation will continue, I hope. Because it must...

As noted on today's BradCast, CBS News' legendary radio and TV broadcaster Charles Osgood has passed away at age 91. Other than that, we've got some arguably much brighter news throughout the bulk of today's program. [Audio link to full show follows this summary.]

Among the many stories covered today...

  • Last night, just after midnight, Nikki Haley won every single vote cast in Dixville Notch, New Hampshire, the first town in the state to vote in the state's first-in-the-nation Primary on Tuesday. They had a 100% turnout. Haley won all 6 votes. Donald Trump won 0. We discuss why that matters (and doesn't). Voters across the entire state are voting today on hand-marked paper ballots. In Dixville Notch --- and about 40% of towns in the state --- ballots are publicly hand-counted by human beings after polls close. The rest of the towns, the larger ones in general, are tallied by 15 or 20-year old computerized optical scanners. Though, due to a write-in campaign for Joe Biden in the state, where there is no officially sanctioned Democratic primary, most of those towns will be hand-counting a lot of ballots as well. We'll have full reported results out of NH --- and why they matter (or don't) --- on tomorrow's show, of course.
  • For years, Republicans have been citing evidence of miscounted votes in Prince William County, Virginia as evidence of massive fraud in the 2020 Presidential race. The state's Republican A.G., after taking office in 2022, even filed criminal charges against the County's Registrar. Recently, however, the charges were unceremoniously dropped. And now we learn that, due to largely understandable tabulation errors, Joe Biden should have received 1,648 more votes than he was credited for, and that Donald Trump was given 2,327 votes that he shouldn't have, in a county that Biden won by more than 60,000 votes --- in a state where the Democrat won the Presidential race by some 450,000 votes. Races for U.S. Senate and U.S. House were also affected by the counting errors, though none of errors would reportedly have changed the results of any contest. We explain the whole mess.
  • We've got quite a bit of good news for you today when it comes to redistricting and rolling back GOP racial and partisan gerrymanders! In North Dakota, a federal judge has ordered new state legislative map after Republicans, following the 2020 Census, cracked two Native American reservations into different districts in order to flip both state House and Senate seats from D to R. It worked in 2022. But now, the judge has ordered not only new maps, but also new elections this fall in the districts found to have been in violation of the Voting Rights Act.
  • Louisiana's new Republican Governor approved a new U.S. House map for the state this week, after the GOP state legislature finally adopted it last week, following a federal court order to draw an additional majority-Black voting district in the state. The Republican-controlled legislature previously had just 1 such district out of its 6 Congressional seats, despite African-Americans accounting for nearly a third of the statewide population. GOP lawmakers only agreed to do so after many appeals, and after realizing that if they didn't draw up their own maps, the court would do it for them. The new map will likely result in an additional Democratic member of Congress from the Bayou State next year.
  • And, in Wisconsin last week, voters filed a motion with the state's newly liberal-leaning Supreme Court seeking a new U.S. House map in time for the 2024 elections. Last month, the state's high court agreed with petitioners that the state GOP's state legislative maps for the Assembly and Senate, in place for more than a decade, were unlawful gerrymanders in violation of state Constitutional requirements. The new motion filed last week asks the same Supreme Court to order a new U.S. House map as well, on the same basis that the Justices determined the state legislative districts were unconstitutional. Petitioners argue that the unconstitutional and politically gerrymandered map resulted in Republicans winning 75% of the state’s Congressional seats despite winning just 50% of the statewide vote in the 2022 election. That year, the closely divided, if Dem-leaning Presidential battleground state also re-elected its Democratic Governor in the same statewide election.
  • Finally today, San Diego was deluged on Monday with a year's worth of rain in a matter of three hours, overwhelming infrastructure in the usually mild Southern California city. But, as discussed in our latest Green News Report today with Desi Doyen, it was just one of dozens of cities across the U.S. in recent weeks where infrastructure has been hammered by climate change-fueled extreme Winter weather. Nearly 100 have been killed in the recent storms in a number of states as of airtime. That, as Big Oil gears up a multi-million ad blitz to hoax Americans into supporting fossil fuel friendly candidates in 2024, as the unstoppable transition to clean, renewable energy is finally underway...

We're back live on today's BradCast after a much-needed holiday break. Thanks to those of you who helped us avoid disaster last week! Now the question is whether we'll be able to avoid disaster in next year's Presidential election where we will have "as stark a choice as the United States has ever faced."

A lot happened while we were off (as usual), but none as critical, as far as I'm concerned, as the mind-blowing ruling issued last week by a three-judge panel of the 8th U.S. Circuit Court of Appeal, upholding an insane lower U.S. District Court Judge's ruling in an Arkansas voting rights case.

The lawsuit, filed by the NAACP, challenges Arkansas' gerrymandered legislative maps which should --- if the rule of law and Constitution mean anything anymore --- include another five Black-majority voting districts before the 2024 elections.

However, last year, a Trump-appointed District Court Judge, while recognizing the merits of the case, found for the first time in U.S. history that individual voters and private organizations like the NAACP and ACLU have no "right to private action" to sue against violations of Section 2 of the landmark Voting Rights Act. The lower court judge found that only the U.S. Attorney General may sue to block racially discriminatory laws under Section 2. And, last week, incredibly enough, that ruling was upheld by the 8th Circuit Court of Appeals panel featuring two Trump judges and one George W. Bush appointed judge.

We're joined today by JONATHAN TOPAZ, Staff Attorney at the ACLU's Voting Rights Project, who worked on the case at both the district and appellate court level. He explains that the District Court ruling "was the first court in the history of the United States to determine that Section 2 lacked a private right of action, which means that private plaintiffs are unable to vindicate their rights under Section 2 of the Voting Rights Act. This, at the time, and is today, is an incredibly radical ruling. We appealed, because it had no basis in the text and structure of the Voting Rights Act, it had no basis in the precedent, and it certainly had no basis in the practice of decades and decades of private plaintiffs bringing suits to vindicate the incredibly important right to vote free of racial discrimination under the Voting Rights Act."

But, as Topaz goes on to explain, it got worse. Last week "a divided panel of the 8th Circuit voted to affirm the District Court's finding. So now these are the only two courts in the history of the United States that have ever made such a finding."

Indeed, the arguably even more "conservative" 5th Circuit Court of Appeal, recently found the opposite, that private plaintiffs do have the right to sue. So, the 8th Circuit Court is an outlier, with what Topaz describes as "a radical opinion on appeal to the voters of Arkansas and voters around the country."

What happens next? What will it mean if it is upheld by SCOTUS? What are the chances of that actually happening? How can it be that neither SCOTUS nor Congress nor dozens and dozens of courts have previously noticed this flaw in the VRA over the past six decades? And, if SCOTUS does find in favor of the 8th Circuit, what will that mean for the hundreds of Section 2 cases previously decided in favor of private plaintiffs? Tune in for answers to all of those questions and many more.

Also today, a bit of what suffices for "good news" out of the Middle East on Monday, as Israel and Hamas agreed to extend their four-day pause in hostilities for another two days to allow for the release of more hostages from Gaza and more Palestinian prisoners from Israeli prisons.

That largely encouraging news, however, is somewhat tempered by events back here in the U.S. over the weekend, where three Palestinian students were shot at close range in otherwise peaceful Burlington, Vermont. The three young men, all 20 years old, were heading to dinner at one of the men's grandmother's house. A suspect was arrested on Sunday. We discuss.

Grim news in Maine, Acapulco and the U.S. House, followed by much better news in Colorado, Georgia, and for union workers of the UAW...

I promise, things get brighter after the first segment of today's BradCast. [Audio link to full show follows below this summary.]

Among our stories, first grim, and then much less so, today...

  • We begin with the horrible news out of Lewiston, Maine, following Wednesday night's mass shootings that have, so far, resulted in 18 dead and another 13 wounded, with several still in critical condition. The state was largely shut down as of airtime, with a broad, statewide manhunt underway for the suspect who is alleged to have had serious mental health issues...but was still able to obtain a deadly, high-powered, military-style assault rifle for his rampage somehow, because...freedom!
  • Similarly grim news out of Acapulco, where a climate change-fueled Hurricane Otis experienced explosive intensification off the Pacific Coast this week, as it spun up from Tropical Storm to a catastrophic Category 5 in just twelve hours time. As of airtime, 27 were confirmed dead in Mexico, with searches underway for more missing as authorities struggle to clear major roads of knee-deep mud and restore power to the battered resort city and nearby villages.
  • All of that, amid what is likely to be the hottest year ever recorded, as Republicans in the U.S. House just elected a long-time climate science denier from the oil and gas state of Louisiana to be House Speaker. Rep. Mike Johnson received more money last year from the fossil fuel industry than any other. Since 2018, the far-right religious zealot has received some $240,000 from the industry. Some of it, as it turns out, came --- unlawfully --- from Russian oligarchs, according to FEC investigators last year.
  • IN BRIGHTER NEWS...A federal judge in Georgia has ordered the state's legislature to reconvene to redraw its Congressional and state legislative maps before 2024, after being found in violation of the Voting Rights Act. The state must now add new Black-majority voting districts to all three of its maps. The judge's 516-page(!) ruling [PDF] issued today, finds the Republican-controlled legislature drew new maps following the 2020 Census which completely ignored the fact that ALL of the state's population growth since 2010 has been among the non-white population. U.S. District Judge Steven Jones has ordered one new Black-majority Congressional district, two new districts in the state Senate, and five for the state House by December 8, or he would have the maps drawn himself.
  • More good news for U.S. Constitution lovers, this time in Colorado, where a state judge ruled on Wednesday that Section 3 of the 14th Amendment, the "Insurrectionist Disqualification Clause", is self-executing. In other words, public officials who have "engaged in insurrection" are simply disqualified from running for public office, even without a federal law detailing precise enforcement of the provision. Donald Trump, whose qualifications for the 2024 Presidential ballot have been challenged in a state lawsuit, argued to the contrary. But he lost. Next week, a hearing will be held to determine if the former President "engaged in insurrection", as per the Constitutional Amendment. Similar challenges to Trump's eligibility for office are also pending in Michigan and Minnesota.
  • And good news for striking autoworkers, as the United Auto Workers union announced on Wednesday night that they reached a tentative agreement with Ford. The new four-year contract, if approved by workers, will boost base pay by at least 25%, increase starting hourly wages to $28/hour and includes a myriad of other benefits sought by the labor union. It is hoped that the agreement will also pressure management for a similar contract at the other two "Big Three" automakers, G.M. and Stellantis, where the UAW also began its walk-outs about six weeks ago. Chalk up yet another in a series of very big wins for organized labor over the past year!
  • Finally, both good news and bad, as usual, with Desi Doyen in our latest Green News Report. She has more on Hurricane Otis; more on our new climate denying U.S. House Speaker; More on Big Oil doubling down before the bottom falls out for the industry; and an encouraging projection from a normally very conservative international body for the beginning of the end of fossil fuels...
