Today's BradCast should serve as yet another wake up call for those of us who may need one. [Audio link to full show is posted at end of this summary.]

First up, Washington Post revealed on Friday that Donald Trump, late last year, attempted to order his acting Attorney General to declare that the 2020 election was "corrupt". To his credit, the acting AG refused to, since there was no evidence of systemic fraud that might have reversed Trump's painful loss to Joe Biden. And, to the credit of the acting AG's staff, all of this was documented in real time with contemporaneous hand-written notes --- from that call and similar ones that reportedly took place on a near daily basis --- with the desperate loser President calling with fraudulent information from the Internet about "fraud". Those notes from the DoJ have now helpfully been handed over to Congress, so there will likely be more to come.

Of note, however, was Trump's response when he was told there was no evidence that would "change the outcome of the election." According to the hand-written notes of senior DoJ staff, Trump replied: "Just say the election was corrupt [and] leave the rest to me and the [Republican] Congressmen."

It was enough, for Trump's dishonest purposes, for the DoJ to simply say the election was "corrupt", even though there was no such evidence to support such a claim. It was similar to how, as we learned during his first impeachment, he wanted the President of Ukraine to say they were investigating Joe Biden and his family for corruption, even though they actually weren't. This is how a liar and a con-man and, yes, how a wannabe autocrat works.

But where Trump's pathetic attempt to stay in power failed last time, that may not be the case in the near future, as many respected voices are now warning. Fox "News" may say the Left is a bunch of autocrats and fascists, but that's only because they hope you won't notice that the Republican Right actually is, and becoming more so by the day. Many respected scholars and pundits from both the Left and the not-insane Right, such as David Frum and Steve Schmidt, are trying to warn about exactly that in advance of the 2022 mid-terms. Schmidt, John McCain's former Campaign Manager, asserted in a Twitter thread this past week, for example, that Trump will be the GOP nominee in 2024, adding that "the Pro-Democracy coalition is sleep walking into the ‘22 election and the stakes couldn’t be higher."

U.S. Naval Academy and Air Force Institute of Technology graduate BRYNN TANNEHILL, who served as a longtime naval aviator, with deployments to the Adriatic, Middle East and North Atlantic, says today that she shares a number of Schmidt's concerns. Her recently published book, hoping to call attention to the unprecedented perils the nation is now facing, is called American Fascism: How the GOP is Subverting Democracy. She joins us on today's show for a chilling, if insightful conversation.

As an investigator of shoot-downs in the military, she explains that she decided to approach this topic not unlike the NTSB might investigate a crash scene, examining every single potential factor that could have played a role in the disaster. "My book traces back some of the roots of the modern Republican Party all the way back to slavery and the Civil War," she explains, "to kind of give an historical sense of where this came from. [It] looks holistically at a lot of the different factors, including the media, loss of faith in science, how white evangelicals are different, how the system has been manipulated, the role of wealth inequality," examining "like an NTSB investigation, as many of the driving factors behind where we are today as possible."

But her clarion warning of where we now are is as chilling as her comparison of the Trump-incited failed insurrection at the U.S. Capitol on January 6th with Hitler and the Nazi's failed Beer Hall Putsch of 1923. "What Republicans can take away from [Jan. 6] is that even when there is a naked attempt at a coup, it costs them nothing. If they attempt to steal democracy by simply overturning an election, there's going to be even less consequences. That's our lesson."

Her book documents (and explains) what she describes as the rise of "competitive autocracy" in the U.S. or "managed democracy" as Russian President Vladimir Putin refers to it. "It's a type of government that has emerged since the end of the Cold War. Essentially, you have a democracy, or something close to a democracy, and then one party wins an election and then changes the rules, such that the incumbent party can essentially never be removed from power.  There are still elections. They are still very often 'free' in the sense that anybody can vote, and there's not just one person on the ballot. But the election through various means has been rigged such that the playing field has been so tilted that you can't remove the incumbent party from power."

We are seeing exactly that, as GOP-controlled states are changing the rules of elections right now, not only to make it harder for Democratic-leaning voters to vote next year and in 2024, but to allow them to replace election officials with partisans who can reverse election results no matter how the electorate actually votes. (See, for example, my conversation last week with now-former Morgan County, Georgia Board of Elections member and longtime voting rights champion Helen Butler who was just removed from her seat on the Board by the partisan County Board of Supervisors after 10 years, following the approval of the state's Republican Governor Brian Kemp.)

Citing similar democracies-turned-autocracies, she points to Russia, Hungary, Poland and others countries, noting that once a nation has headed down the path we are now on, historically, none of have been able to reverse course. "Hungary is absolutely a fascist movement," Tannehill points out, following the 2010 election of Victor Orbán, "and they have absolutely ended democracy there. That's a real danger, in the sense that we have a party that regards democracy as a hindrance to their goals, and their goals of establishing a particular kind of country is more important than the democracy itself."

So does the U.S. stand a chance of turning the tide? "The problem is the system is broken," she argues. "it is so easy to thwart solutions, via Congress, the Presidency, the courts, that it's really unlikely that a lot of the necessary solutions could ever happen.  For example, Senators representing only 19% of the American population can block virtually any legislation that they want to in the Senate."

"To an extent," Tannehill tells me today, the Founders, who thought their system of democracy would prevent a wholly unqualified person from being able to become President, "never dreamed that their vision for a country would be so corrupted that you would have legislators who would overturn elections based off of lies. They also never dreamed that the parties would become so powerful that they would pick the electors for the Electoral College.  The Electoral College was meant to prevent people like Trump."

There is much more to today's conversation, including a bit of hope. No, all is not necessarily lost, as grim as all of this sounds. But unless folks begin to appreciate the dangers of this moment in history, things could get very much worse --- and soon --- before they get better...if they ever do.

Finally, following that dark (if enlightening) conversation, some slightly more encouraging news. After Trump's DoJ spent years ignoring the plain text of the rule of law --- as authoritarian administrations do --- in refusing to enforce the federal statute requiring the IRS to share Trump's tax returns with Congress, Biden's DoJ has reversed course. In a memo issued today by the DoJ's Office of Legal Counsel (OLC), the Department has declared that, in fact, the Treasury Dept. must turn over those long-sought documents to the House Ways and Means Committee after their lawful requests beginning in 2019. Better late than never anyway. And it's nice to see an Administration with some apparent actual respect for law and order once again.

On today's BradCast: Senate Dems strike a very big deal and the U.S. Election Assistance Commission gets sued again, this time for rolling back voting system standards after secret, unlawful meetings with the manufacturers they are supposed to be regulating. [Audio link to show is posted below.]

First up, in what is being reported as potentially "transformative" legislation for the country, Senate Democrats on Tuesday night announced they had come to an agreement on a deal that would invest $3.5 trillion into the expansion of Medicare, the Affordable Care Act, child care and a host of other "human infrastructure" priorities, while also addressing climate change with a broad array of clean energy incentives. The blueprint for the agreement still lacks specific legislative language, but was struck after weeks of work in the Senate Budget Committee chaired by Bernie Sanders (I-VT). Democratic Committee members, such as centrist Mark Warner of Virginia, are also said to be on board with the package, which would be paid for by increased taxes on those making more than $400,000 a year and on large corporations. If all Senate Dems agree to the final bill and no more than 4 Democrats defect in the House, the measure could be adopted under Senate Reconciliation rules with a simple majority vote without the need for any Republicans.

Passage of that package, along with adoption of the smaller bipartisan nearly $600 billion proposal recently hashed out among moderate Senators on more traditional infrastructure spending, such as for roads and bridges, would amount to a massive victory for Democrats (presuming Republicans do not renege on their part of the agreement) and, more importantly, for jobs, families the climate and the American people as a whole. It would be the largest such spending package since the New Deal. We walk through some of the reported details of the new reconciliation package and what it may mean for Americans before the 2022 mid-term elections.

And, speaking of elections, earlier this year we reported on the U.S. Election Assistance Commission (EAC)'s secret and unlawful meetings last year with voting system vendors, as discovered by SUSAN GREENHALGH, longtime election integrity advocate and Senior Advisor on Election Security at the non-partisan government watchdog group, Free Speech for People (FSFP). As she revealed at the time, the EAC's meetings, even with vendors, are all supposed to be public, according to the federal Help American Vote Act (HAVA). Her group was forced to sue to make the EAC cough up emails and other records detailing the secret vendor meetings. Most disturbingly, the EAC's Commissioners made alarming changes to newly drafted voting system certification guidelines just after those meetings.

The EAC is the federal agency responsible for creating certification guidelines for the nation's voting and tabulation systems. After a painstaking 5-year process in public consultation with technical advisors and other experts, the final draft of the much-needed and long-awaited Voluntary Voting System Guidelines (VVSG) 2.0 was released last year. It included, among other important elements, a ban on wireless modems in voting and tabulation systems. Cybersecurity experts applauded the provision, after long warning of the dangers of such devices in systems that register, record and tabulate the nation's votes.

After the EAC's secret meetings with voting system vendors last year, however, the agency weakened the new guidelines --- removing, for instance, the ban against wireless modems --- and revealed an amended, watered-down version just days before Commissioners voted for final approval of the new standards. Experts were stunned. Now Greenhalgh's FSFP is suing the EAC again, along with co-plaintiff Philip Stark, an elections expert from UC-Berkeley and a member of the EAC's own Board of Advisors (as well as a recent guest on this program). The complaint [PDF] calls for the EAC to roll back the last minute changes made to the guidelines after they secretly met with the voting system manufacturers.

Greenhalgh joins us to explain all of this latest madness, what it could mean for election security, why the EAC made these changes and continue to roll over for the vendors they are supposed to be regulating, and to discuss the perils of the woeful EAC's under-handed changes at a time when cyberattacks are on the rise and confidence in election results (justifiably or not) is plummeting.

"Rather than being an independent source of information regarding voting systems, the EAC is going to the vendors to ask them the questions and understand how the systems work. And, of course, the vendors aren't going to say, 'Yeah, this is highly insecure, we shouldn't be doing this,'" Greenhalgh explains.

"It's mind blowing to me," Greenhalgh tells me, when I ask if the EAC Commissioners fully understand the security risks involved in allowing the modems that vendors want in their systems (for reasons she also explains.) "You would think they'd want to err on the side of caution, they would want to err on the side of security. And if there was a good reason to allow this, then why not have this process out in the open where they can make the case to the public as to why 'we think this is a secure way to go.'? Instead they did the whole thing behind closed doors, in a super shady manner. Doesn't engender a lot of confidence." 

Finally today, in addition to the Dems' massive new infrastructure proposal announced on Tuesday night, Senate Democrats also unveiled a long-overdue, landmark proposal to finally legalize cannabis at the federal level. That bill, however, will require some Republicans to come aboard for passage, so we'll see how it goes...

Last week, New York prosecutors filed multiple criminal indictments against the Trump Organization and its CFO Allen Weisselberg in response to an alleged "sweeping and audacious" 15-year tax fraud scheme. Today, Donald Trump himself filed a lawsuit against social media companies for banning him after he used his accounts to incite an attack on the U.S. Capitol on January 6th. Today on The BradCast, we discuss both issues and more, including our conversation with a former Asst. U.S. Attorney who is dubious about the legal expert consensus that NY prosecutors plan to file additional charges against other "senior executives" at the Trump Organization. [Audio link to full show is posted below summary.]

First up, Trump's new lawsuits against Facebook, Twitter and YouTube were announced on Wednesday, with the disgraced former President claiming that his First Amendment rights are being violated by the private companies who no longer allow him to use their platforms to lie about last year's election and to incite violence. The First Amendment, however, does not apply to private companies. It applies to the Government. In fact, as one legal expert notes today, "Trump has the First Amendment argument exactly wrong. In fact, Facebook and Twitter themselves have a First Amendment free speech right to determine what speech their platforms project and amplify --- and that right includes excluding speakers who incite violence."

It was next to impossible to find coverage of the lawsuit today which quoted any legal expert unrelated to the suit or the disgraced former President, who supported Trump's legal theory. Even Fox "News" quoted a libertarian lawyer describing the complaint as "asinine".

While it's unclear who is footing the legal bill for Trump's latest legal folly, seemingly meant to further hoax his gullible "conservative" supporters into believing they are all "victims" of political censorship by "radical left" giant social media companies, we're almost certain that Rudy Giuliani will no longer be lending his efforts. A new book by Michael Wolff documents Trump's rage over losing to Joe Biden last year, and claims that he is now unwilling to pay Giuliani for his legal work in criss-crossing the country to claim, without evidence, that the 2020 election was stolen from Trump. That, as Rudy has now had his law license suspended in New York for his false legal claims about the election; is facing a federal investigation for his foreign lobbying work on behalf of Trump; and is named in billion dollar lawsuits by the Dominion Voting System [PDF] company for myriad lies about their products.

But Trump, of course, is facing his own legal problems as well, including the 10 criminal indictments filed against his company last week, along with 15 counts against his longtime Chief Financial Officer, Allen Weisselberg. The indictments, which include charges such as Scheme to Defraud; Conspiracy; Grand Larceny; Criminal Tax Fraud; and Falsifying of Business Records, stem from what prosecutors describe as a tax fraud scheme that includes more than a million dollars in off-the-books compensation for apartments, cars, and school tuition for Weisselberg and others, "orchestrated by the most senior executives” at the Trump Organization from 2005 until this year.

In the wake of last week's charges, many legal experts have argued the indictments suggest more charges will be coming, as part of the ongoing two year investigation by Manhattan District Attorney Cyrus Vance and NY Attorney General Letitia James --- perhaps even for "senior executives" named Trump. Our guest today, however, former Asst. U.S. Attorney RANDALL D. ELIASON of George Washington University Law School, disagrees. At least, he is dubious.

In the days both before and after last week's indictments, Eliason suggested on Twitter that if NY ended up charging Trump's company along with Weisselberg, that would be a signal that there is not, in fact, more charges to come, as many have speculated.

Eliason, an expert in White Collar Criminal Law and a frequent contributor to Washington Post and his own Sidebars Blog, describes the charges against Weisselberg --- who allegedly received more than $1.7 million in untaxed, off-the-books compensation and stiffed city, state and federal governments for at least $900,000 --- as a very "serious case" indeed. He explains why nobody should be fooled by "Attorneys for Weisselberg and the Trump Organization [who] have tried to downplay these as just a 'fringe benefits' case, to make it sound as though it's about the company maybe just failing to report something."

He notes, in particular, prosecutors claims that the company was "keeping two sets of books" to hide their "tax fraud scheme". Eliason says this suggests a "very deliberate" effort to defraud that "makes it pretty hard to claim that it was just a mistake or a misunderstanding about the complicated tax code," as Trump implied during a rally in Sarasota, Florida over the weekend. (That, by way of stark contrast with his boast at a 2016 rally when he declared: "I know more about taxes than human being that God ever created!")

Eliason offers a great deal of insight into what these charges mean and how serious they are. Still, he goes on to argue that, in his opinion, unless prosecutors manage to flip Weisselberg --- which he believes would have already happened if Weisselberg was flippable --- that it is unlikely there will be further charges against others in the case.

"Failing cooperation by Weisselberg," he tells me, "the fact that they included the company [in the indictments] makes me think, if he doesn't flip, that's all we're going to have. Because otherwise you hold off on the company, you isolate Weisselberg, and if you bring cases against other individuals, with or without Weisselberg, that just makes the case against the company stronger. Because the company is only liable vicariously through the actions of its agents. So you don't charge the company now if you think there's more to come."

I challenge Eliason on a number of these points today, in which each of us concede we are reading tea leaves. Of course, he's the expert attorney and I am anything but. Please tune in for this interesting discussion!

The volume of incoming huge news stories these days is getting to be as overwhelming as it was during the Trump years. But it's also a reminder to anyone who has deluded themselves into thinking that the Trump Era is over, it is anything but. We were planning on covering ProPublica's blockbuster bombshell exclusive this week on today's BradCast --- and we still do --- though it has been somewhat eclipsed by last night's New York Times blockbuster bombshell exclusive. We do our best to cover both today. [Audio link to full show follows below this summary.]

First, the remarkable news broken by the Times late on Thursday is that Donald Trump's wildly corrupt Dept. of Justice was a whole lot more corrupt than we have all yet fully appreciated. As it turns out, in an unprecedented move, his DoJ secretly subpoenaed phone, email and text message data of Democratic members of Congress on the House Judiciary Committee. But it wasn't just members that Trump saw as political enemies, including top Judiciary Dem Adam Schiff and Rep. Eric Swalwell. It was also their staff and even their children, one of whom was a minor, according to the Times' blockbuster.

All of that, even as the Trump Administration spent years blocking Congress from lawful subpoenas for testimony and documents from the White House itself and virtually every Executive branch agency, under the false premise that it would violate the Constitution's Separation of Powers, granting co-equal powers to both the Legislative and Executive branches. All the while, the Trump Administration was actually --- literally --- spying on members of the Legislative branch, while claiming (disingenuously) that Congress was overstepping its bounds by issuing lawful, public subpoenas for testimony to members of the Executive branch.

The stunning news comes after a week in which we previously learned that the Trump DoJ also secretly obtained phone, email and text records of journalists at the Washington Post, New York Times and CNN. Democrats claim to be outraged by it all, and vow to investigate. But without real legal consequences, accompanied by sweeping reforms by both Congress and, most immediately, Merrick Garland's Dept. of Justice, the appalling and outrageous and unlawful acts carried out during four years of the Trump Administration will absolutely be carried out again --- and even worse next time --- in the very near future.

Speaking of much-needed, long-overdue action from Congress, the ProPublica bombshell this week revealed that --- based on a "vast cache of IRS information" somehow obtained by the non-profit media outlet on the nation's wealthiest men --- American billionaires have been allowed to avoid almost all federal income taxes for years on their accumulated and still-surging wealth. As the media outlet reports in their jaw-dropping, nearly 6,000 word exclusive this week, "billionaires like Jeff Bezos, Elon Musk and Warren Buffett pay little in income tax compared to their massive wealth — sometimes, even nothing."

Their months-long analysis of the data "demolishes the cornerstone myth of the American tax system: that everyone pays their fair share and the richest Americans pay the most. The IRS records show that the wealthiest can --- perfectly legally --- pay income taxes that are only a tiny fraction of the hundreds of millions, if not billions, their fortunes grow each year."

The raw IRS data show that billionaires like Bezos (the world's wealthiest man), Musk, Buffett and the others often pay zero in federal income taxes. Overall, the nation's top 25 wealthiest --- whose fortunes increased collectively by $401 billion between 2014 and 2018 --- paid a tax rate on that accumulated wealth of just 3.4% on average. That, compared to a median tax rate of 14% paid by regular, middle-class Americans, as the U.S. tax code rewards wealth over labor.

The New York Times explains in its own coverage of ProPublica's scoop, that even as Congress and President Biden bicker over tweaks to marginal tax rates, the ultra-wealthy avoid such trivialities all together. "The ProPublica revelations got to a widely understood issue: that the superrich earn virtually all their wealth from the constantly rising value of their assets, particularly in the stock market, and that the sales of those assets are taxed at a lower rate than ordinary income from a paycheck...But the analysis also revealed a less recognized strategy employed by the superrich: taking huge loans, using their assets as collateral. It allows them to avoid selling their assets and facing taxation, and even to write off some lending costs. In that way, Mr. Bezos and Mr. Buffett were able to show yearly income losses even as their wealth grew by billions of dollars."

Mother Jones' Senior Editor MICHAEL MECHANIC joins us today with a great deal of context and perspective on this long running, if legal, scam, after spending a couple of years hanging out with the ultra rich while researching his newly published book, Jackpot: How the Super-Rich Really Live --- and How Their Wealth Harms Us All.

Mechanic underscores the scam revealed by ProPublica: "As we've seen from the way the tax code works, wealth begets wealth, and we reward capital over wages. If you make a fortune on a stock, you pay a maximum of 20% when you sell that stock. In the meantime, when you hold it, you don't pay any taxes at all --- it's called 'unrealized gains.' What these billionaires have done is they just borrow against that. They never have to sell, so they never even pay the capital gains tax.  Meanwhile, you and I are getting a paycheck. If we made as much as they did, we'd be charged 37%.  So it's 37% versus 20% for assets, but they're not even paying the 20% because they're not selling the assets. They're taking out low-interest loans, paying a few percent, living on that money." And, yes, even as the cost of the interest would be less than they'd have to pay in taxes if they sold assets to live on their own money instead, they actually get to deduct the cost of those loans from their income taxes!

We discuss, among other things, how all of this actually hurts average Americans; how, because of it, trillions of dollars are not available to the government to spend on healthcare, schools, climate change, infrastructure and other public services; what, if anything, can or will be done about it by Congress --- where Republicans (and too many Democrats) seems to be just fine with a system that rewards wealth over work; whether proposals like Elizabeth Warren's wealth tax of .02 cents on every dollar of wealth by those worth more than $50 million could ever be adopted in Congress or is even Constitutional; and how all of this wealth doesn't even get taxed upon death when it's passed from generation to generation, as Mechanic reports at MoJo today.

"There's always been this argument, from the very beginning, that if you tax investors and business people, those people then won't invest, won't create jobs," Mechanic observes. "It's a spurious argument. If you have $100 million and somebody raises the capital gains rate, does that mean you're not going to start a company? You're not going to put it into the stock market? No, of course not. What else are you going to do with your money, put it under your mattress?!"

And, yes, we also discuss his new book (highly lauded by the legendary Bill Moyers!), which Mechanic describes as "not a polemical book. It's a funny, entertaining, and enraging character-driven narrative, in which I basically hang out with super-wealthy people and their minions. I interview researchers, I talk to a woman who trains billionaires' nannies in physical combat, [and] a guy who builds luxury safe rooms. It's a journey of the American wealth fantasy and how it's gone off the rails."

On today's BradCast: Everyone in Trump World is now either flipping on everyone else in Trump World, or appears on their way to doing so. Including Trump himself Fun! Less fun: Democrats in Congress wasting their time in negotiations on Biden's bold Build Back Better agenda with Republicans who are decidedly not negotiating in good faith, as they made clear to everyone once again this week. But first, the flippin' fun part of the show! Just before airtime, CNN reported that Rep. Matt Gaetz' ex-girlfriend is now said to be cooperating with federal investigators believed to be looking into the Republican Congressman from Florida's many alleged payments for sex and illicit sex trafficking of a minor.

And while Gaetz, Donald Trump's number one fan in Congress, is facing a world of trouble (and years in prison), so, of course, is Trump, as it appears to be getting hotter by the hour inside the Trump Organization. This week, we learned that the New York state Attorney General, Letitia James, who had been looking at civil violations of bank and tax fraud laws by Trump and his company, joined the Manhattan District Attorney Cyrus Vance's criminal investigation of many of the same matters.

The next day, we learned that Allen Weisselberg, the long time Chief Financial Officer of the Trump Organization --- beginning all the way back to when Trump's dad Fred was in charge --- is now facing his own criminal tax-related probe by the NY AG's office as well. That, as our guest earlier in the week, former Asst. U.S. Attorney Randall Eliason explained at the time, is a likely precursor to getting him to flip on his boss, the disgraced former President.

And the next day after that, Weisselberg's former daughter-in-law Jennifer --- who has announced that she's been cooperating with prosecutors for some time, after explaining that her former husband Barry (also a Trump employee) was often paid with free rent in expensive luxury apartments and some $500,000 worth of private school tuition for their kids --- believes that her former father-in-law, Allen, will absolutely flip on Trump to save himself.

That revelation came as Trump's own former personal lawyer and fixer, Michael Cohen --- who flipped on Trump long ago, as he earned federal prison time by pleading guilty to participating in a campaign finance hush-money conspiracy "directed" by Trump --- believes that Trump will eventually flip on everyone, including Allen Weisselberg, and even his own kids(!) if necessary, to save himself! "I think Donald Trump is going to flip on all of them, including his children," Cohen told MSNBC, adding: "I really believe that Donald Trump cares for only himself and he realizes that his goose is cooked."

It's all flippin' hilarious, in truth. We'll see if things continue to come crashing down on the former Criminal-in-Chief --- as they sure seem set to do, at this point --- in the coming days and weeks. Fun!

Less fun, unfortunately, is the continuing obstruction campaign being waged by Congressional Republicans, who laid bare their bad faith yet again this week, after spending months negotiating with Democrats on an evenly balanced January 6th Commission, only for GOP leadership in both chambers to then whip their members against it after the bipartisan deal was finally struck in the House Homeland Security Committee.

A similar pageant of bad faith negotiations have been underway for several weeks now with Republicans pretending they are interested in working with Democrats on Biden's $2.25 trillion infrastructure proposal, the American Jobs Plan, and his $1.8 trillion American Families Plan, to support "human infrastructure", such as child care, paid family leave and free daycare and community college.

We've seen this bad movie before. Just look back at the months that Dems spent "negotiating" with Republicans in 2009 and 2010 over the Affordable Care Act, when the GOP failed to offer a single vote in favor of the landmark healthcare law, even after winning all kinds of concessions from Dems to water down the plan.

Now, Democrats are finally saying enough is enough. At least some of them, who, Politico reports, are speaking up and calling for the Jobs Plan and Families Plan to be combined into a megabill and passed in one fell swoop under the Senate's Budget Reconciliation rules allowing passage of almost all of it with a simple majority vote. The only problem: Not all Dems are ready to do so, especially West Virginia's Joe Manchin, who is also not yet onboard with the Dems' sweeping proposal for election and campaign finance reform --- the For the People Act (or H.R.1 in the House and S.1 in the Senate) --- and the filibuster reform that would be required to pass it with just 50 Democratic votes.

Joining us to today to explain how Dems and progressives can possibly move forward through all of these obstacles is ADAM GREEN, co-founder of the Progressive Change Campaign Committee, who told Politico this week that: "The only two scenarios for Democrats are to go big or get nothing."

Green expands on those comments today, arguing that the process of negotiation going on right now is, by and large, meant to convince Manchin, and maybe a few other conservative Democrats, that there is only one real path forward to carry out Biden's truly ambitious progressive agenda.

"I think that there are two genres in working with Republicans," he tells me. "One, that hearkens back to the Obama era, where they really thought that Republicans were potentially willing to deal with them, and wasted a year and quarter negotiating with them before passing Obamacare. It wasted a lot of time that led to a lack of results by the 2010 election. And the lack of results meant low motivation for voters to turnout and vote, or vote Democrat."

"In this case, " Green continues, "I think we have a little bit of a different scenario, where most people understand the game. The game here is there are one or two Senate Democrats with that old mindset --- they genuinely believe Republicans will deal in good faith.  Everybody else is ready to get this done but has to play ball for a couple of months to make abundantly clear that these Republicans don't come in good faith."

Green also cites this week's last minute u-turn on the January 6th Commission as a perfect example, where the GOP had "pretty much of all of their demands met," only to see "Republican leaders coming out against it." That, he says, leads him to feel "hopeful that we're nearing the time when  even the Joe Manchins of the world realize that they did their best, but too bad, it's time to go it alone with Democratic votes and score big for the American people."

But even if Manchin is ultimately willing to agree to pass the infrastructure plans with a simple majority under Senate Reconciliation rules, is there ANY path that would allow for passage of other top Dem priorities like the For the People Act? That bill would almost certainly fail to meet Senate Parliamentarian muster to be passed under the same rules, so would somehow have to overcome a GOP filibuster to be adopted. An optimistic Green believes there is a VERY narrow path to make that happen as well, and he details how progressives in not just West Virginia, but every state, can help push Dems --- and Manchin --- through that narrow path. It includes, among other things, a new "Democracy exception" to Senate filibuster rules. Such an exception, he notes, could also allow D.C. to finally become a state in the bargain. As I said, optimistic!

There is nothing wrong with citizens --- no matter how partisan or misinformed --- demanding to know for themselves that election results have been accurately recorded and reported. That's true even in cases where they have been blatantly lied to by, say, a disgraced, failed President of the United States. But post-election audits must be done in full public view from top to bottom, with all processes and evidence from the election kept within a transparent, well-documented, secure chain-of-custody at every step. Two ongoing post-election audits from the 2020 election are currently underway. One offers an example of exactly how not to do such a probe, the other one is shaping up to be a model for the nation.

Among the stories covered on today's BradCast [Audio link to show follows this summary]...

• Ohio Gov. Mike DeWine's scheme to hold a $1 million lottery each week for the next five weeks for any Buckeye Stater 18 and over who has received at least one COVID vaccine shot, appears to be working. While we've got a few suggestions on how it could have been done more effectively, at least it appears to have slowed and even reversed (for some ages) the state's recent drop-off in the number of folks getting their shots. As it turns out, Ohioans seem to like DeWine's plan to offer federal government-sponsored cash prizes (yes, socialism!) courtesy of the America Rescue Plan in exchange for receiving life-saving inoculation from a deadly disease. More states should consider the same and the federal government oughta just pay people to get their shots! We suspect a crisp $100 bill in exchange for a shot in the arm would do the trick. (By the way, Ohioans need to opt-in for the lottery, at OhioVaxAMillion.com, to be eligible for the prizes!)

• Another direct benefit for Americans from the American Rescue Plan (Biden's emergency pandemic relief and stimulus bill adopted by Democrats while being VOTED DOWN BY EVERY SINGLE REPUBLICAN IN CONGRESS), is the expanded child tax credits which will, beginning in July, send monthly checks of $300 per child under 6, and $250 for kids between 6 and 17, to parents making less than $150,000 over the next year. If Americans liked the Democrats' $1,400 individual payments from the ARP, they may love its expanded child tax credits which start this summer. Experts say the payments are likely to help cut child poverty in half this year. Hopefully, Dems will remember to loudly remind Americans of all parties which party it was that made those payments possible, and which party attempted to prevent them. Democrats are not usually very good at that. And hopefully they'll be able to extend those payments through at least 2025 as Biden has proposed in his American Families Plan --- which Republicans also oppose.

• Then it's back to the clown show "audit" theater in Maricopa County, Arizona, where the county's 2.1 million public ballots from the 2020 Presidential and Senatorial elections last year are being inspected, in secret, by a private company with no experience in elections, voting systems or audits named Cyber Ninjas. Now, it seems, the Ninjas and a number of their allegedly false claims made about the materials turned over to them by the County (as ordered by a state court in response to the Republican-controlled state Senate's mandate) were the final straw for the majority GOP Maricopa County Board of Supervisors and its new Republican County Recorder.

  On Monday, the 5-person Board (4 Rs, 1 D), denounced the audit as a "sham" and a "con," lamenting the "spectacle" that they say "is harming all of us" and turning Arizona into "a laughingstock". The new Republican County Recorder, Steven Richer, now in charge of elections in one of the nation's largest counties, blasted the Ninjas for what he describes as blatantly false claims that election databases were unlawfully deleted and for ensuring attacks on his new staff. The Board also sent a blistering 13-page letter [PDF] to the state Senate's President detailing their anger, frustration and embarrassment, calling for the audit to be ended, while responding to charges they claim to be lies coming out of process. The Maricopa "audit" is now in it's third week in Phoenix, but reportedly nowhere near complete.

• Meanwhile, by way of a critical contrast, another post-election forensic audit is underway in Windham, New Hampshire, led by actual experts in post-election audits and voting systems. Unlike the evidence-free claims of fraud in AZ, there is reason to be alarmed by the results of a state House of Representatives race in the town of 14,000 people. There, on election night last November, in an 8-person race (4 Ds and 4 Rs) for 4 seats in the state House, all four Republican candidates won. According to the computer tabulations, they were the four top vote-getters for those seats, with the Democratic candidate, Kristi St. Laurent, coming in 5th by just 24 votes.

  Last November, after she requested a hand-count of the town's hand-marked paper ballots --- previously tallied only by 20-year old, easily manipulated, oft-failed Diebold optical scanners --- it was discovered that the 4 Republicans actually received about 300 more votes each than the tabulators had reported on Election Night. And St. Laurent, the hand-tally found, actually received 99 fewer votes than initially credited with. So what explains the discrepancy between the computer count and the hand count? That's what the auditors began to investigate last week in one of the most open, professional, well-documented and transparent such processes I've ever seen in my nearly twenty years on this beat.

  This week, the auditors explained --- via the live streaming audio and video coming out of the audit room, their own Twitter feed, as well as in interviews with local media --- their leading working theory that could explain the numbers seen one way (incorrectly) by the computer scanners and another way (correctly) by the hand-counters last November. Their working theory, if it bears out, would explain the disparity between the two separate tallies last November. We explain that theory today. And, no, unlike our disgraced former President's recent false claims about both Arizona and New Hampshire, the reasonable hypothesis does not involve "massive election fraud" with "thousands and thousands" of newly "found" ballots. It involves the scanners misreading folds on mail-in ballots as votes.

  But, of course, most critically, the side-by-side comparison of the clown show "audit" theater in Maricopa, which the public (and even local officials) are not allowed to fully oversee, versus the methodical, transparent, public process being carried out in Windham, should be an illustrative model for all future such probes. In the case of Windham, we are likely to have an answer to the mystery that everyone can agree with when all is said and done in the next few weeks. In Maricopa, I think its safe to say, little is expected to be settled one way or another after this ill-considered exercise is finally finished...if it ever is.

Last month on The BradCast, after Joe Biden signed his $1.9 trillion American Rescue Plan with emergency COVID relief and stimulus for the poor and middle class, we suggested that passage of that bill would likely be seen in history as the beginning of the end of the Reagan Era. Now, it appears, we're hardly the only ones. [Audio link to full show is posted below.]

Since that wildly popular landmark measure was adopted (without a single Republican vote), Biden has proposed a $2.25 trillion infrastructure package called the American Jobs Plan. And, on Wednesday night, he officially introduced his $1.8 trillion American Families Plan proposal for perhaps the nation's largest-ever investment in human infrastructure, including free access to pre-school, two years of community college, subsidies for child care, paid family leave, expanded health care subsidies and child tax credits and much more.

With Reaganesque optimism during his first address to a joint session of Congress, citing a statistic published in a report by one of our guests earlier this year (Chuck Collins of the Institute for Policy Studies) finding that just 650 billionaires in America saw their own net worth increase by a trillion dollars as 20 million Americans lost jobs during the pandemic, the President pounded what could become a final nail in the Reagan Era coffin, declaring: "My fellow Americans, trickle down economics has never worked and it's time to grow the economy from the bottom and the middle out."

We're joined today, on Biden's 100th day as President, by HEATHER DIGBY PARTON of Salon and Hullabaloo, and by 'DRIFTGLASS' of the The Professional Left Podcast, for analysis of his stunningly-well received remarks (even by Republicans) on Wednesday night and his pitch for an extraordinarily bold and long-overdue government investment in the American people.

Says Digby, on how we arrived at this moment: "We've just been reminded that we need government, because look what happened. We had this pandemic and having the freak show that had been sort of entertaining like a horror show for the last four years, it suddenly became pretty clear what the problem was with that. Because when you really need government, it wasn't there. They were completely out to lunch. For a lot of people in this country, they're out their floundering under this trickle-down, rugged individualism. This is what it's like when you're left completely on your own."

Says Driftglass, mocking GOP rhetoric of the past forty years: "If you're not rich, it's your own fault, and the only thing standing in the way of being the best you is this evil government. [But] suddenly, a whole bunch of people absolutely have to have assistance from the government or their going to die, or go broke, or they're going to go out of business.  And the only thing Republicans had to offer was a sneer...So, there's this literally once-in-a-hundred years crisis, where the actual effect of good government is so visible, right now, that you can now make the case credibly that there are other large problems that we have ignored and disinvested in for decades that we need to fix."

Even for longtime, cynical, old-school progressive bloggers like us --- none of whom had supported Biden during last year's primaries --- we are all pleasantly taken aback at his remarkably ambitious plans and expansive proposed agenda. We discuss, dissect and debate all of that, how it should or shouldn't be "paid for", and whether any of it can possibly be adopted into law with the exceedingly narrow majorities Democrats currently hold in Congress on today's special coverage edition of The BradCast...

On today's BradCast: Joe Biden is on a "go big" roll that has stunned even many long time progressives. Another one of them joins us on today's show to sing the praises (mostly) of his $2.25 trillion infrastructure, jobs and climate proposal known as the American Jobs Plan. It will be paid for --- at least in very small part --- by ending long time direct subsidies (yes, government socialism) to the Fossil Fuel Industry. But, even on that, the industry is getting a break that they shouldn't. [Audio link to full show is posted below this summary.]

First up today, however, some noteworthy news headlines...

• The white Brooklyn Center, Minnesota police officer who resigned yesterday after shooting black motorist Daunte Wright during a traffic stop on Sunday, has been charged with second-degree manslaughter after days of protest and unrest. The city's Police Chief, who also resigned on Tuesday, has said that the 26-year veteran officer, Kim Potter, meant to taze the 20-year old Wright, but shot him instead.

• A scathing new Inspector General's report finds that U.S. Capitol Police were instructed by leadership not to use their best crowd-control weapons on January 6th, despite clear intelligence from the FBI and Dept. of Homeland Security warning that "Congress itself is the target" for protests by Donald Trump supporters who were scammed by his false claims that the Presidential election was stolen. In the days before the assault, pro-Trump social media sites included explicit details regarding plans by MAGA Mob extremists to target both the Capitol and members of Congress, including maps of underground tunnels at the Capitol building and threats calling for "violence" and "war". While DHS and the FBI were aware of these threats --- and, therefore, so was Trump --- for reasons that still remain unclear, the Capitol Police were left wildly unprepared for the deadly siege.

• And, in perhaps the most critical news of the day, President Biden announced, in no uncertain terms, his plans to remove all U.S. troops (other than those needed to protect diplomats) from Afghanistan no later than September 11th of this year, the twentieth anniversary of the 9/11 attacks. He explained his reasoning and responded to critics of the move in remarks at the White House today, declaring that "It's time to end the forever war." We share extended excerpts from his address.

Then, we're joined by the great energy and climate journalist DAVID ROBERTS --- formerly of Vox, now publishing his own must-read newsletter called "Volts" --- for insight into Biden's plans to pay for what Roberts characterizes as a remarkably progressive infrastructure, jobs and climate proposal.

Introduced two weeks ago, the American Jobs Plan is to be paid for largely by an increase on the corporate tax rate. But, as Roberts detailed in a recent Volts article, it will also include a repeal of some of the permanent subsidies to the Fossil Fuel industry which they have enjoyed for decades, as written into the tax code. While many progressives are pleased about that, including Roberts, the fact is that those direct subsidies to the industry, as he points out, amount to a very small fraction of the cost of Biden's ambitious plan. Indeed, at some $35 billion for the entire industry, spread out over ten years, it also amounts to a very small amount of the true cost of the "indirectsubsidies" or "externalities" which the public pays for to boost profits for the polluting industry.

The direct subsidies, says Roberts, are "a drop in the bucket" compared to "the total amount of money that would be raised if you went after the indirect subsidies" with a carbon tax that accounts for the true cost of the industry's "products that produce a lot of social harm.  Harm in terms of air pollution that they generate, which then produces health costs, and people miss work. There's the climate damages that they do when they're burned. There's land pollution. There's abandoned oil and gas wells at the end of their life. Those cost a lot of money" to clean up, which the companies rarely, if ever, do.

"The oil and gas industry itself doesn't pay any of those costs. So when your product imposes all these costs and you don't pay them, the public steps in and pays them. Like the kids with asthma who are paying, rather than the fossil fuel companies." Roberts suggests "those externalities, as they're called, have always been the premise for a carbon tax, why we would want to put a tax on carbon so that you can recoup all these damages that the oil and gas industry are not paying for."

Still, setting aside how the package is to be paid for, Roberts concedes that he is "pleasantly surprised" about the "super-big and ambitious" package which includes, as he also details, a whole bunch of cool stuff that has received little coverage, since there is actually so much packed into the sweeping, long-overdue proposal.

How to get it passed, however --- and, specifically approved by "our emperor and benefactor Joe Manchin, long may He reign" --- is another matter, which we discuss in detail today as well.

"Where we are is so ludicrously far away from where we need to be, that it becomes difficult to judge anything in the middle," Roberts argues. "Is this a good big step or is it a grossly inadequate step? Yes. It's both. Everything we're going to do on climate change for the next decades will fit that description. It's going to be big and not big enough."

We then close today with a quick thought or two on a new statement from hundreds of companies and corporate executives in opposition to the GOP attempts to restrict voting rights around the country. We hope to have more time to discuss the matter on tomorrow's BradCast...

If we can look both forward and back at the same time on The BradCast, so can the Biden Administration. (Hint, hint, Merrick Garland.) But the Administration is certainly looking forward today, and not a moment too soon, with the introduction of Joe Biden's $2 trillion American Jobs Act proposal. But first, we look "back" at the continuing disaster left behind by the previous guy's lies about a "stolen" election. Two U.S. Capitol Police officers have now filed a lawsuit against Donald Trump for his incitement of the January 6th insurrection which, according to the complaint, has left both men struggling to cope with long term physical and psychological issues. The suit follows on the heels of two others filed by two different members of Congress, Reps. Bennie Thompson of Mississippi and Eric Swalwell of California.

In somewhat related "looking back" news today, the legal team representing Dominion Voting Systems is reportedly beefing up its team of defamation attorneys after filing $1.3 billion complaints earlier this year against Trump Attorneys Rudy Giuliani and Sidney Powell, MyPillow CEO Mike Lindell and, last Friday, a new $1.6 billion defamation suit against Fox "News". (That one follows on a separate $2.7 billion suit filed against Fox by another voting machine company, Smartmatic, which doesn't even do business in any of the states contested by Trump's MAGA Mob.) All of the Dominion suits allege the voting system company was defamed by evidence-free claims that their software somehow flipped votes from Trump to Biden. The new attorneys said to be joining Dominion's legal team buttress reporting that additional rightwing media outlets, such as NewsmaxTV and One America News, may soon be sued as well. Moreover, the Dominion legal team has suggested in several instances that they have not ruled out a suit against the Big Liar himself.

Then, we finally get to look forward today with the introduction of Biden's sweeping, much-anticipated infrastructure, jobs and climate proposal, now officially named the American Jobs Plan, echoing the name of his wildly popular and progressive $1.9 trillion American Rescue Plan, signed into law this month to speed relief and stimulus to Americans slammed by the COVID pandemic.

The new AJP proposal is a $2 trillion package, promising to create millions of good-paying jobs through massive and long-overdue public works projects to shore up the nation's crumbling roads, bridges, airports, water systems and electrical grid, while investing in efforts to remove lead pipes from homes and lead exposure in hundreds of thousands of schools.

Crucially, it would also invest hundreds of billions in electric vehicle manufacturing and charging stations, cap hundreds of thousands of uncapped fossil fuel wells, while ending fossil fuel industry subsidies and offering billions in renewable energy tax credits. It would also "build back better" by hardening much of our nation's infrastructure to better handle our worsening climate crisis. Much of the package would be paid for by an increase in corporate tax rates that reverse unpaid-for tax cuts by Trump and the GOP in 2017.

That, of course, is a very slim summary of the expansive proposal introduced on Wednesday in Pittsburgh by the President. But, why is it only a $2 trillion package when we had previously been told to expect a $3 or even $4 trillion proposal?

Our guest today, financial journalist, author and Executive Editor of The American Prospect, DAVID DAYEN reports that the proposal is being split into two separate packages. "This is the first half of apparently a two-part sequence," he explains. "This has most of the physical infrastructure investments. I would call this more of a public investment bill, rather than infrastructure bill. But this has the physical investments and then the second half is really the care infrastructure --- the care investments on health care, on paid family leave, on community colleges and things like that."

The plan is likely to change a great deal as it moves toward hopeful passage in Congress. Some Progressive Democrats feel it doesn't currently go far enough to meet the scale of the threat posed by climate change. Some conservative Dems are worried about spending too much money. And, of course, Republicans have no interest in passing any bills proposed by Democratic Presidents, no matter how much it will help their own constituents, even with projects they'd long supported.

"Spending of this type, which is public investment, pays for itself many, many times over," Dayen argues. "It does that just by the virtue of greater efficiency [and] averting risk. When we make all of these climate investments, we then have the opportunity to not have to spend hundreds of billions and trillions of dollars on damages from catastrophic weather events and things like that."

We discuss what it may take to get the broad Democratic caucus in Congress all on the same page, and the likelihood that many elements of the second part of the package may end up being combined with the first, in the event that Chuck Schumer's hopes of additional Budget Reconciliation packages this year (which allow passage with a simple majority vote, rather than needing to overcome a GOP filibuster), are blocked by the Senate Parliamentarian --- or, if Democrats become concerned that items planned for the second package may fall to the wayside if Biden's agenda loses steam on Capitol Hill.

It's a bit of a grab bag on today's BradCast, but one that will hopefully keep you well prepared for your next conversation with any of your still brain-poisoned wingnut friends, family and coworkers.[Audio link to full show is posted below summary.]

Included in our grab bag of coverage today...

• Ohio's Republican Attorney General Dave Yost is suing the Biden Administration because the $350 billion that the Democratic COVID relief bill (the American Rescue Plan) allocates to help all 50 states overcome a revenue cash crunch includes a provision that prevents states from using that free federal money to finance state tax cuts.

• Of course, Ohio could also just refuse to take the $5.5 billion earmarked for them in the federal legislation, which not a single Republican voted for in the U.S. House or Senate, often describing it as a "blue state bailout". But, because we believe in facts around here...As detailed in a new report this week from the financial website WalletHub, Ohio's Republican-majority state government ranks 16th among those most dependent on the federal Government. In fact, the site's latest annual analysis finds that 11 of the top 12 states most dependent on D.C. are all controlled by Republicans, while 12 of the 14 least dependent are run by Democrats. In other words, "blue" state taxpayer dollars continue to be a perpetual "red" state bailout.

• With the election of Joe Biden and two Democratic U.S. Senators in Arizona (the 7th most dependent on federal dollars), the state is finally trending "blue", even as Republicans still hold control of the state legislature and governor's mansion. But turning "purple" is only leading the state Republican Party to lurch farther and farther to the right under the embarrassing --- and now costly --- leadership of AZ GOP Chair Kelli Ward. This week, a state judge ordered the Party to pay $18,000 in costs and attorneys fees to the state's Democratic Secretary of State after a frivolous lawsuit sought to force another post-2020 election audit in Maricopa County (Phoenix). The "bad faith" and "groundless" GOP suit, as the judge noticed in his sanctions order describing the effort as "gaslighting," failed to recognize that the County had already run a post-election hand-counted ballot audit, finding no fraud or inaccuracies in its Dominion Voting System tabulators.

• For good measure, in late January, the Maricopa County Board of Supervisors commissioned another audit, this one examining voting system equipment and source code, searching for malicious software or hardware on the systems used in November, checking for evidence of inappropriate network or Internet connectivity issues and rechecking the accuracy of the tabulation system itself against millions of actual votes cast last year. In all cases, according to the two separate, independent, federally accredited voting system test labs commissioned to carry out the audit, "No Issues" were discovered across the board.

• Despite the clean bill of health from those post-election audits and the failed, evidence-free lawsuits to try and overturn Biden's win in the Grand Canyon State, Republican lawmakers in the state legislature continue to move dozens of voter suppression bills forward in hopes of, at the very least, undercutting the state's very popular mail voting system, as used by 80 percent of voters (Republican and Democratic alike) even before the COVID pandemic. One such measure would both add onerous ID requirements to mail-in ballots and require that absentee ballots be postmarked by the Thursday before Election Day!

• The efforts in Arizona are, of course, being echoed by Republicans in statehouses all across the country of late, with more than 250 voter suppression bills introduced in more than 40 states so far this year. All of which share the hope of making it harder for (certain) voters to cast ballots at all. The GOP has been hard at work at this sort of suppression for some time, though they are doubling and tripling down since the 2020 contest. All of which has echoes for folk singer/song writer MATT SIRCELY, whose new Back of the Line tune harkens back to the voting lines in Ohio in 2004, the lines of protesters marching across the Edmund Pettus Bridge on Bloody Sunday in Selma, Alabama in 1965, and the bread lines of the Great Depression. If Matt thought that thanking me for inspiration on this song would lead us to play it on the show...he is correct!

• Finally, we close with Desi Doyen and our latest Green News Report, as extreme weather slams the North, South and West; as corporate media coverage of climate change fell over a cliff with the COVID pandemic last year; and as a top Texas utility regulator gets fired after being caught on tape helping to rig the system for corporate investors over Lone Star State rate-payers...

If nothing else, the thing to remember from today's BradCast is that not one single Republican in either the House or Senate voted for Joe Biden and the Democrats' remarkably robust, progressive and equitably written American Rescue Plan, the $1.9 trillion COVID rescue and relief package that history may someday regard as the long-overdue end of the four-decade old Reagan Era.

The President signed the sweeping bill on Thursday, which our friend David Dayen at The American Prospect described today as "maybe the largest pure economic uplift bill in U.S. history." GOPers may come to rue the day they didn't vote for it. Especially in 2022 when some of the key provisions --- like lowered health care premiums and monthly checks amounting to up to $3,600 per child, per year --- will expire unless those provisions are made permanent.

We discuss today a number of the less reported pieces built into the ARP, most of which --- unlike previous stimulus and rescue plans over the past several decades --- are crafted to benefit the poor and working class, and actually help lift many of them out of poverty. That is, by contrast, with the Trump/Republican 2017 tax cuts which also cost about $2 trillion, but overwhelmingly benefited corporations and the already wealthy.

All Republicans in both house of Congress voted against a nearly $2 trillion measure meant to largely help the middle class and the poor. Yet all Republicans in both houses of Congress voted in favor of the nearly $2 trillion measure to help the rich and corporations, which were already enjoying record profits at the time. Got it? Please keep that in mind --- and share it with your friends, family, neighbors and co-workers, in case they are lied to about all of this --- when 2022 rolls around.

This bill marks a fundamental progressive change in the way our federal government has been doing business for the past four decades since the so-called Reagan Revolution. And it comes not a moment too soon, as we discuss today.

Today also marks the one year anniversary since the World Health Organization declared the coronavirus to be an official pandemic, when I stated on the program (to the surprise of, at least, Desi Doyen) that America was "shutting down". We share a clip of that somewhat breathtaking historical moment today.

More than 2.5 million have since died around the world, but the U.S., under Donald Trump's horrifically failed leadership, saw more deaths than any other country, with more than half a million lost here and still counting. That, even as we represent only about 5 percent of the world's population.

It is also the 10th anniversary of the earthquake, tsunami and nuclear disaster that struck Japan in 2011. We remember that still-ongoing disaster as well today, and the nearly 16,000 lives that were lost that fateful day.

In somewhat brighter news...As Republican state lawmakers around the country are moving hundreds of bills in more than 40 states to try and disenfranchise voters in a way not seen since the end of Reconstruction, according to a new analysis by Washington Post, it may be Donald Trump's attempted election fraud that could be the biggest news in coming weeks. It appears he may be in even more trouble than it previously appeared in the state of in Georgia!

A new recording of his phone call to the top Georgia state election investigator, made during a post-election audit in Cobb County prior to Christmas last year, was released Wednesday night by the Wall Street Journal. We share the full, gob-smacking conversation, in which our then President is heard buttering up the investigator and telling her, among other things, that "when the right answer comes out, you'll be praised."

The newly released 6-minute recording with the Georgia Secretary of State's chief investigator Frances Watson, can't really be heard in any other way than Trump hoping to encourage her into finding "fraud" where none existed. The recording is now undoubtedly part of the growing body of evidence being examined by Fulton County, Georgia's District Attorney, Fani Willis. The Democratic prosecutor is investigating "the solicitation of election fraud, the making of false statements to state and local governmental bodies, conspiracy, racketeering, violation of oath of office and any involvement in violence or threats related to the election's administration" after the 2020 Presidential election in the Peach State.

Willis has reportedly hired a racketeering and conspiracy expert for her grand jury probe, which could ultimately rope in Trump, his former Chief of Staff Mark Meadows, his attorney Rudy Giuliani and even Sen. Lindsey Graham, who are all known to have tried to encourage state officials to change the results of Georgia's 2020 Presidential election after Trump lost. That alone is a state felony punishable by a year in jail. With added charges for racketeering and conspiracy, those convicted under those state felony statutes could face 20 years in jail!

Finally, Desi Doyen joins us for our latest Green News Report, with more on the 10-year anniversary of the still-ongoing disaster at the Fukushima Daichii nuclear plant and several much brighter and more hopeful pieces of news...

Prepare to be outraged by some gobsmacking and maddening numbers from today's guest on The BradCast. [Audio link to show is posted below summary.]

But first, speaking of startling numbers, statistics from this year's flu season prove that masks and social distancing do indeed help to prevent viral transmission and death. That, of course, is bad news for residents of Texas and Mississippi, where their idiot Governors this week lifted statewide mask mandates and all restrictions on businesses, even as COVID infection rates are on the rise in both states. Both are among the top 10 worst states in the nation in that regard in recent weeks. Mississippi leads the nation, with Texas not far behind. And that was before they ended statewide mandates this week in contradiction of strong advice from health experts.

In Washington, Congressman Eric Swalwell (D-CA), one of the House Impeachment Managers during Donald Trump's second Impeachment Trial, filed suit against the disgraced former President, his son Don Jr., Rudy Giuliani and Rep. Mo Brooks (R-AL) for their roles in inciting the January 6th U.S. Capitol insurrection. Swalwell's civil complaint follows on a similar one filed last month by Mississippi Rep. Bennie Thompson and the NAACP.

At the same time today, the U.S. Senate continued debate over the American Rescue Plan, President Biden's $1. 9 trillion emergency COVID relief and stimulus package after Republican Sen. Ron Johnson of Wisconsin forced an all-night reading of the 628-page measure that was passed by the House late last week. In addition to funds to speed distribution of vaccines, the bill includes $1,400 payments to Americans making less than $75,000, an extension of federal unemployment benefits, hundreds of millions to reopen schools safely, and to supplement lost revenue to hard-hit, cash-strapped states and cities.

As tens of millions of Americans have lost their jobs through no fault of their own, and are both struggling to keep a roof over their heads and put food on the table, the relief can't come soon enough, despite zero votes of support from Republicans in either the House or Senate, so far, for the otherwise wildly popular bill. Johnson described it as a "boondoggle" full of unnecessary spending that would blow out the national deficit, even as it will cost the same amount of money that he and all the other Republicans voted in favor of when they passed Donald Trump's 2017 tax cuts for mostly wealthy Americans and corporations.

But while Senators --- even on the Democratic side --- squabble over whether unemployment payments should be $400 a week and last through August, or $300 a week and last until September, America's 664 billionaires could cover almost the entire cost of the measure from only the money they've made during the last 11 months of the pandemic.

We spoke last Summer with CHUCK COLLINS, Director of the Program on Inequality and the Common Good at the Institute for Policy Studies, where he co-edits Inequality.org, about his "Billionaire Bonanza 2020" report. Today, he joins us again with a maddening update to that report, finding that, as more than half a million Americans died, 73 million lost work, nearly 100,000 business permanently closed, 29 million adults reported their household did not have enough food over the past week and 11 million children didn't eat enough because their household couldn't afford to fully feed them, the 664 billionaires in the U.S. actually gained $1.3 trillion in added wealth since the beginning of the pandemic!

The profits of that handful of mostly white, male billionaires could cover more than two-thirds of the entire $1.9 trillion American Rescue Plan and, "At $4.2 trillion," Collins' updated report reveals, "the total wealth of America's 664 billionaires is also more than two-thirds higher than the $2.4 trillion in total wealth held by the bottom half of the population, 165 million Americans."

Those are just some of the startling numbers from his latest report, highlighting the obscene inequality in the U.S., made even worse by the nearly year-long coronavirus pandemic. Shamefully, all of the numbers are still worse for women and people of color. "The inequalities of income and wealth and the racial wealth divide were the pre-existing conditions as we went into the pandemic," he explains. Collins tell me that "the number of people who have no financial reserves --- zero, or negative financial wealth" is "14% of white households...but double that, 28% of Black households, 26% of Latino households...[and] that was before the pandemic."

"That's why 660 billionaires can have almost twice as much as the bottom half of US households --- because the bottom half doesn't have much!," he reports. So, what to do about it? Will the American Rescue Plan help? How about Sen. Elizabeth Warren's recently refiled "Ultra-Millionaire Tax Act" that would tax two cents of every dollar of wealth above $50 million, generating at least $3 trillion in revenue over ten years in the bargain.

Warren cites Collins' new study in making the case for her new wealth tax proposal. Her proposal is wildly popular among voters of all political stripes, as she pitched a similar version during her Presidential run last year. The fact that it isn't already the law, Collins argues, "is simply a reflection of the power of wealthy interests to block change in our political system. It's not that they're changing the political system --- they're able to stop and thwart and block change. And that's unfortunately what we're up against."

"That's the debate we're watching right now in the Senate," he adds, "where half the members in the Senate, they don't have a program to help America get through these hard times. They just want to block the one that would actually make a difference. Unfortunately, the Republicans have been the 'Party of No' because they don't want government to succeed in making a difference in people's lives, because that would undermine their whole program."

Yes, we've got a lot to discuss today with Collins, whose newest book out this month, The Wealth Hoarders: How Billionaires Spend Millions to Hide Trillions, details "the shadowy Wealth Defense Industry," which he explains today as well. Sen. Bernie Sanders writes that "Chuck's book reveals a blueprint for reversing this obscene inequality so we can take back our democracy and ensure that our government works for everybody --- not just the billionaire class and wealthy campaign contributors"...

There was so much news over the weekend and into Monday that it began to feel a bit like the Trump Era again. Don't worry! It ain't. But it sure felt like it trying to get caught up on today's BradCast. (Or maybe it was barely making it on air in time after we learned the catalytic converter had been stolen from our Prius. Among the stories covered at the top of today's show:

• The U.S. reached the grim milestone of 500,000 confirmed deaths due to COVID-19, the disease which our failed former President had told us would simply "disappear like magic" when the weather warmed last year in Spring. Turns out he was genocidally wrong.

• Speaking of Donald Trump the failure, it looks like he's finally run out of options to prevent his accounting firm, Mazars USA, from turning over subpoenaed tax and other financial documents to Manhattan District Attorney Cyrus Vance, Jr.'s criminal investigation into Trump's hush money payments to Stormy Daniels and into other allegedly fraudulent tax and loan schemes. The U.S. Supreme Court --- yes, even those in the stolen and packed seats filled with Trump appointees --- denied the disgraced former President's final appeal on Monday.

• And, speaking of Trump-related frauds, his buddy Mike Lindell, the CEO of MyPillow, was sued today by Dominion Voting Systems for more than $1.7 billion dollars, in just the latest example of attempted accountability for the suckers who played along with Trump's Big Lie that the 2020 Presidential election was stolen by computerized voting and tabulation systems. Lindell, the wingnut Trump suckup who produced a silly documentary called Absolute Proof (which, as I explain, appears to contain everything but that), has ignored the private voting vendor's prior legal warnings to cease and desist his false claims alleging that Dominion's systems were used to steal the election for Joe Biden. Monday's Dominion suit against Lindell [PDF] is just the latest. The company previously sued Trump attorneys Rudy Giuliani [PDF] and Sidney Powell [PDF] for the same amount in each suit. Another company, Smartmatic --- which has only one contract in the U.S. (here in Los Angeles County, not in any of the battleground states) --- was similarly targeted by Team Trump's Big Lie, as they re-imagined a BRAD BLOG exclusive from 2010 to support their evidence-free claims. They have recently sued Fox "News" [PDF], several of their hosts, as well as Giuliani and Powell for $3.7 billion. We suspect there are still more such suits to come.

Then, as Texas finally begins to thaw out from a massive winter storm that knocked out power and water to millions in the state last week (thanks to the Lone Star State's deregulated system that left it up to private power utilities to decide if they wished to winterize their systems --- they held onto their profits instead, go figure!), it is, once again, the most poor and disenfranchised minority communities who are likely to have the most difficult time recovering. As is too often the case after such disasters, communities of color are likely to pay the biggest price for it.

We're joined today by DR. ROBERT BULLARD, Distinguished Professor at Texas Southern University, author of some 18 books, co-chair of the National Black Environmental Justice Network, and known as the "Father of Environmental Justice". Bullard himself was a victim of last week's power failures in Houston for several days.

"Texas prides itself on being the Lone Star State," he tells me. "But this severe weather event and the power outages and loss of water, has shown us that we are the ALONE Star State. Our energy policy of go it alone, keep the federal government out, doesn't make any sense. And it's never made any sense. We need to re-join the United States [and] rejoin the grid."

"They planned it on the cheap. These [Texas] officials had the nerve, they had the gall to say 'Oh, it's the windmills causing the problem.' In Texas, we have privatized the energy system to the point where people gambled --- they gambled and lost," he says.

Bullard explains the concept of "Environmental Justice" in layman's terms for us, as the need to overcome decades of redlining and poverty that has resulted in a disproportionate impact on minority communities when it comes to pollution, natural disasters and climate change itself. We discuss the "cascading threats that are pushed into certain communities. That's the double whammy, the triple whammy --- what the medical folks call 'co-morbidity', but we call it 'You get hit with everything damn thing!'" He adds: "How these things intersect, it means that these communities are limited when the lights go out, limited in terms of their ability to bounce back. This, for communities that are struggling with a challenge, with a disaster, and the disaster that will unfold when they get these big bills, when the shutoffs come."

On the positive side, however, on the same day that Joe Biden's Attorney General-designate Merrick Garland cited "communities of color and other minorities [who do not have equal justice and] bear the brunt caused by pandemic, pollution and climate change," during his Senate confirmation hearing, Bullard is optimistic. He says he is encouraged by the new Biden Administration's promises to tackle systemic racism and the need for environmental justice.  "These issues were on the ballot in November and we won," Bullard asserts. "We won on policies and platforms that brings justice at the center. Not a footnote, but a headline.  Environmental justice, climate justice, economic justice, racial justice, energy justice, health justice. JUSTICE is the headline"...

Now that Trump is safely out of office, as my guest on today's BradCast argues, Congress needs to "get back in the game" to reform the National Emergencies Act now, so it cannot be so easily abused by yet another President. [Audio link to full show is posted below.]

But, first up today, we pick up on a study we cited on yesterday's show finding that, in 16 developed countries examined over the past 50 years --- from the U.S. to Australia --- tax cuts have had no effect whatsoever on either jobs or Gross Domestic Product. The only thing they have done, however, is make the rich richer and increase economic inequality in countries that institute them.

In that vein, a new piece from the New York Times David Leonhardt reports on economic data finding that the U.S. economy has done better by every measure --- from jobs to GDP to incomes and even stock prices --- under Democratic Presidents than Republicans for the past 90 years. Going all the way back to FDR, the economy has grown at an average annual rate of 4.6 percent under Democrats and just 2.4 percent under Republicans. That means, as Leonhardt notes, that "The average income of Americans would be more than double its current level if the economy had somehow grown at the Democratic rate for all of the past nine decades." But why is that? We discuss. (HINT: It has to do with Dems heeding economic and historic lessons, such as using government resources to invest in flagging economies during recessions, versus the GOP's only apparent economic strategy for both good times and bad --- tax cuts!)

But, with Joe Biden now safely in office and Democrats finally in control of both Houses of Congress, things are, surprisingly enough, working out very well for a change...for now...after just two weeks. Years of Post Traumatic Democrat Syndrome, however, has left us waiting for that to change for the worse at any moment. Nonetheless, before that happens, what other lessons can be learned from the previous, disastrous Administration?

We're joined today by ELIZABETH GOITEIN, co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice. Back in 2018, with a report at the Brennan Center and a disturbing landmark article for The Atlantic on "The Alarming Scope of the President's Emergency Powers", Goitein scared the hell out of a lot of us, when she warned of the dangers of the National Emergencies Act and the extraordinary powers it affords to the White House. The Act --- ironically enough, enacted by Congress, in theory, to rein in Presidential emergency powers --- "unlocks powers contained in more than 100 different provisions of law," as she recently discusses again at Politico.  However, "Since the law’s enactment in 1976, presidents have declared 69 national emergencies; 39 remain in effect today," she explains.

One of those "emergencies," a phony one, was Trump's declaration at the border with Mexico, used to steal money appropriated to the U.S. Military in order to build his wall, after Congress expressly voted against it. Another one might have been a national emergency declaration that we now know --- thanks to some stunning reporting by Axios yesterday --- that Team Trump loons Sidney Powell, Rudy Giuliani and Mike Flynn were encouraging him to declare during an absolutely bonkers (and frightening!) White House meeting in December. They were hoping he'd invoke the act in order to impound Dominion Voting Systems machines and somehow use them to steal the election from Biden.

Goitein argues that after the last four years offered a very clear demonstration of how Presidents can abuse these emergencies powers, now is the time to reform the "under a president who seems more inclined to rescind bogus emergency declarations than issue them." On today's show, she explains how that can responsibly be done by Congress.

"I think there is an understanding that this administration is our chance --- and it's a chance that we must seize - to shore up the guardrails on our democracy. Emergency Powers has been part of that conversation, and I hope and trust that it will continue to be," she tells me. "Many of those laws absolutely need to be revisited and reformed to be made more narrow. There's absolutely no reason why, in a national emergency, the President should be able to take over radio stations. And the fact that by merely declaring a threat of war, the President could potentially even take over the Internet in this country is horrifying."

At the same time, however, new Senate Majority Leader Chuck Schumer is now calling on President Biden to invoke an emergency declaration to take action on our worsening climate crisis, which, as Schumer argues, would allow him to do "many, many things under the emergency powers of the President...that he could do without legislation," in order to get around Republican denialism and intransigence in Congress. Is that a good idea? Is it justifiable? Is it even possible under the National Emergencies Act, reformed or otherwise? Goitein recently responded to some of those questions at WaPo. We discuss them with her today, along with her revelations about some of her worst fears that Trump might have carried out under the existing powers.

Finally, it seems that the loony wingnut MyPillow CEO, Mike Lindell, is having trouble selling both pillows right now and his evidence-free claims that Dominion voting machines were used to steal the election from Trump. We share an hilarious clip of Lindell trying --- and failing miserably --- to make his case, even on the far-right NewsmaxTV, after the voting machine company has issued very serious legal warnings to both Newsmax and Lindell that they intend to sue for defamation if they continue to libel the company. After $1.3 billion lawsuits filed against both Powell [PDF] and Giuliani [PDF], Newsmax appears to be taking that threat very seriously. Lindell? Not so much!...

Neither Joe Biden nor Chuck Schumer nor Nancy Pelosi seem to be falling for the GOP's "conservative" budget concerns, newly rediscovered by the Party now that there's a Dem in the White House.  Also on today's BradCast, the stage gets set for next week's historic second Impeachment Trial of disgraced former President Donald Trump. [Audio link to full show follows summary below.]

A study last December from economists at the London School of Economics and King's College London looked at 18 developed countries over a 50 year period from 1965 to 2015 to find out if tax cuts actually "trickle down" to improve economic outcomes. You'll be "shocked" to hear the results. Tax cuts in the nations examined (including the U.S.), do not improve either GDP or unemployment rates.  They do, however, help the wealthy to become wealthier --- by a lot --- while increasing economic inequality.

That report may have come in useful as President Biden was considering a proposal from 10 Republican Senators at the White House on Monday night to slash his proposed $1.9 trillion COVID relief and stimulus bill down to about $600 billion, or one-third of what Biden and the Dems are proposing. The GOP proposal leaves out a lot of much-needed funding from Biden's proposal for no apparent reason, other than Republicans are pretending to be concerned about spending and deficits again --- a concern they decidedly did not remember to have when they gave away much more with their $2.3 trillion tax cuts mostly to the rich during Donald Trump's Administration.

The good news today is that the White House is moving ahead with their planned $1.9 trillion proposal, and both  Senate Majority Leader Chuck Schumer and House Speaker Nancy Pelosi have queued up the measure to be quickly adopted under Budget Reconciliation procedures which require only a simple majority vote in the Senate. No need to overcome a filibuster with 60 votes.  Now we just have to see if conservative Democratic Sen. Joe Manchin of West Virginia decides to play along. He certainly should, given that his state's own Republican Governor is calling on Biden to "go big" in his COVID relief package.

With things moving encouragingly forward, at least for the moment, with the new President and Dem control of both houses of Congress, we turn back to the disastrous previous President, who helped get us into all of these messes.

To help set the stage, we share an extended excerpt from an hour-long live Instagram video by Rep. Alexandria Ocasio-Cortez (D-NY) on Monday night. She detailed for the first time, her harrowing experience on January 6th, describing how she was forced to hide in the dark behind the bathroom door in her personal office at the Capitol, as the murderous and attempted insurrection by Trump's MAGA Mob was underway. As she makes clear, she had very good reason to fear for her life and is still reeling from the trauma of that day.

Trump's second Impeachment Trial, for "Incitement of Insurrection" at the U.S. Capitol that day, is set to begin next week in the Senate. Both the Democratic House Impeachment Managers and Trump's brand new attorneys (all five of his previous ones left him over the weekend) submitted their pre-trial filings on Tuesday. The 80-page Dem memorandum [PDF] lays out the House's case against Trump, alleging he falsely worked his supporters into an outrage over many months --- even before Election Day, as early as last summer --- with baseless claims of a stolen election. He then "aimed them like a loaded cannon down Pennsylvania Avenue" toward the Capitol on January 6th with instructions to "fight like hell" as a Joint Session of Congress was underway to affirm the 2020 Presidential election results. They offer a graphic, detailed, painstakingly-documented argument for Trump's conviction and a thorough response to the false GOP claim that it is somehow unconstitutional to hold an Impeachment Trial after the impeached officer in question has left office.

"If the Senate does not try President Trump (and convict him) it risks declaring to all future Presidents that there will be no consequences, no accountability, indeed no Congressional response at all if they violate their Oath to ‘preserve, protect and defend the Constitution’ in their final weeks," the House Managers write. "There is no ‘January Exception’ to impeachment or any other provision of the Constitution," they explain, "A president must answer comprehensively for his conduct in office from his first day in office through his last."

For his part, Trump's 14-page response [PDF] is brief and unsurprisingly limp. He cites First Amendment Free Speech rights to support his evidence-free claims that the election was stolen from him and repeatedly claims --- over and over --- that the Senate trial is unconstitutional, since he is no longer in office. There is one point, regarding his personal (if evidence-free) belief that the election was stolen, that should be worth noting when it comes to the difficulty of public oversight and the availability of evidence regarding U.S. election results. Not that he bothered to actually try to get at most of what is available. Beyond that, however, its clear he is hoping that his fellow Republicans in the Senate remain captured, in his thrall and afraid of the wrath of his brain-poisoned supporters.
