We've been hearing a lot of references to the GOP as a "death cult" of late. And while it sounds, at first, like little more than a partisan smear by Democrats, it's not. Just ask this longtime Republican. The description actually seems to be more and more apt with each passing day, as today's BradCast helps to make all too clear. Among the many Death Cult GOP stories in evidence on today's program...

• In March, a woman and mother of two in Texas took to Facebook to offer a rant on the global coronavirus pandemic as little more than a "media driven" hoax meant for "overthrowing Trump". She warned readers to "Wake up!!! This is what the beginning of socialism looks like," adding "You don't need hand sanitizer, toilet paper, and Lysol. You need common sense, a sense of direction, faith, a will to fight, and of course guns!" She died from COVID-19 just a few weeks later in April.

• And just a few weeks after that, even as bodies continue to pile up in Texas, with it's coronavirus peak predicted to be still two weeks away, the state's Republican Gov. Greg Abbott announced on a Friday his plan to open the state back up for business. Among his plans for doing so: state parks will be opened on Monday and large venues such as restaurants and movie theaters could be re-opened as early as April 27.

• Abbott's announcement follows a record 4,591 American deaths formally attributed to COVID-19 in a single 24 hour period, as the official death toll climbed above 33,000 as of Friday morning.

• Even as the body count grows and Trump has backed off his claim of "total authority" to order Governors to end stay-at-home orders just a day earlier, leaving the decision to Governors instead, the President of the United States took to Twitter to seemingly call for violent overthrows of three states with Democratic Governors. "LIBERATE MINNESOTA," he tweeted. And later, "LIBERATE MICHIGAN". Followed by "LIBERATE VIRGINIA," adding "And save your great 2nd Amendment. It is under siege!"

• Yes. It's a death cult. But if you had any question about that, we review his EPA's latest rollback of environmental regulations, including today's which guts an Obama-era rule to curb the emissions of mercury and other toxins. It is just the latest rule overturned by the Trump Administration, following his recent reversal of vehicle mileage standards and the toxic emissions that would have been curbed with them and this week's decision to ignore the EPA's own scientists calling for the tightening of National Ambient Air Quality Standards for particulate pollution (soot) which might help lessen some 50,000 deaths per year. Each of those regulations save tens of thousands of American lives annually. But they are now quickly being overturned one after the next to not only help a few of his corporate campaign contributors, but also to avoid the Congressional Review Act which allows Congress to reverse regulations passed in the final six months of a President's term with a simple majority vote.

• Not enough GOP Death Cultism for ya? Then we turn to elections once again, where Republicans continue to draw the battle-lines for 2020 with new efforts to force voters to choose between risking their lives to vote in person during a pandemic or losing their right to vote altogether. That, versus attempts by Democrats to make voting easier and safer for all. Yesterday we highlighted the fight in Texas where its Republican Attorney General has threatened criminal prosecution against those who advise voters to seek absentee ballots for fear of the coronavirus. Today's example comes out of Kentucky, where the GOP legislature has voted to override the veto of Democratic Gov. Andy Beshear in order to force the enactment of disenfranchising Photo ID voting restrictions this November. Good luck to Kentucky voters who lack an ID in getting one. All of the state's driver's license offices are closed across the state due to the COVID crisis. Darn the luck, am I right GOPers? No worries, with Kentucky Sen. Mitch McConnell on the ballot this year, locked in a potentially close fight with his likely challenger Amy McGrath, I'm sure everything will work out just fine.

• And, yes, if all of this idiotic death and mayhem sounds like a terrible movie that couldn't get greenlighted in Hollywood, it's because it is...

On today's BradCast: It was another big night for Joe Biden, as he appears to have been the clear winner in 4 of the 6 states (Michigan, Washington, Missouri, Mississippi, Idaho and North Dakota) which held Democratic Presidential primaries on Tuesday. But Bernie Sanders said on Wednesday that he is not out of the running just yet. [Audio link to show is posted below.]

In the meantime, the fallout from the coronavirus --- now officially a global pandemic according to the World Health Organization with more than 1,000 cases in the U.S. --- continues to have a growing affect on nearly every aspect of life in the U.S. and around the globe. Aside from school closures, town lock-downs, industries directing employees to work at home, cancellations of large festivals, conventions and now sporting events, including the NCAA's March Madness tournaments set to be played without spectators in the arena, the Dow took another tumble today, falling more than 1,400 points and ending the 11-year bull market begun under Obama in 2009.

We discuss all of that today, and the bumbling Trump Administration's egregious failures in managing the worsening epidemic, before breaking down the reported results from Tuesday's 6 primary states, where voters appear to have chosen Biden in MI, MO, MS and ID, while preferring Sanders in ND and maybe WA, where the Vermont Senator currently leads by a hair as Vote-by-Mail ballots continue to be tallied.

Once again, voters on Tuesday were forced to shamefully wait in hours-long lines to cast their ballots in locations in both Michigan and North Dakota, even as many voters on social media persist in forwarding unsupported charges that the DNC is somehow behind the numerous failures of local and state officials to run efficient, reliable, and publicly overseeable elections.

We share extended excerpts from Biden's remarks following his victories on Tuesday night, offered to a nearly empty hall in Philadelphia were coronavirus concerns resulted in only media and campaign staffers in attendance. And we also share Sanders' remarks from Vermont today, vowing to stay in the race at least through Sunday night's scheduled debate, the first head-to-head forum between the last two Democratic candidates still standing.

We are then joined by the great progressive journalist JOHN NICHOLS of The Nation to try and make some sense of this remarkable moment in history and the surprising state of play in the increasingly bizarre 2020 election. He argues that Sunday's one-on-one between the two candidates is likely to be "the most consequential debate of 2020," adding that he "suspect[s] it will matter more than the fall debates between Trump and whoever is nominated at this point, presumably Biden."

Citing Sanders' remarks on Wednesday, Nichols believes Sanders "left himself an exit ramp, and left Biden an entry ramp. Because he essentially told Biden what Biden's got to do" in order to win support from Sanders' movement. "I genuinely think that Sanders is proposing a debate where, if Joe Biden really steps up, he's going to narrow the lane for Bernie Sanders --- which is already narrow. If Joe Biden steps up, he's got a lot of opportunities here as an entry lane into the fall campaign [to]bring the movement on board and this will sort out."

Whether Biden seizes that moment, however, remains to be seen. His subdued and even Presidential remarks from Philadelphia on Tuesday certainly suggest he is capable of it. But we'll see. "Is he the right candidate?," Nichols asks rhetorically. "If you can't build your movement, your coalition, and you can only do it by kind of forcing people to make choices rather than inspiring or exciting people, then that's a problematic situation."

Among the other oddities and ironies of this moment, Nichols observes in his column today that while voters in MI, MO and MS voted for Biden on Tuesday, exit polls reveal that they actually support Sanders' central campaign proposal for single-payer Medicare for All by huge numbers in all three states. What explains that irony? Nichols offers his thoughts on that and much more on the state of the race in very dark times during our conversation today...

Six more states are voting today (Michigan, Washington, Missouri, Mississippi, Idaho, North Dakota). We'll have results tomorrow, as we're still trying to figure out who actually won and lost, in some cases, last week on Super Tuesday, particularly in Texas and California. Nonetheless, today, like last week, has already revealed more problems with electronic pollbooks that resulted in voters leaving without voting, and there is more likely trouble on the horizon in several states set to vote in the next several weeks. Among the stories covered on today's BradCast...

• A fire at Venezuela's National Electoral Council warehouse over the weekend has resulted in the destruction of 50,000 touchscreen voting machines and 582 computers. We swear we didn't do it! The unverifiable voting machines in question have been used during questionable past elections and are made by Venezuelan-based Smartmatic...the same company with a dodgy background of failed elections who also made the new touchscreen voting systems which failed so disastrously in Los Angeles County on Super Tuesday last week. But, again, we didn't do it!;

• Closer to home, voters today in St. Louis County --- Missouri's most populous --- were turned away from the polls for an hour or so this morning from at least 50 of the county's 400 polling places. Though St. Louis has finally moved to hand-marked paper ballots, they are using a print-on-demand system that uses electronic pollbooks (yes, more computers) to instruct the printers which ballot should be printed. Those e-pollbooks, apparently, were failing this morning until the company that makes them issued an update. In the meantime, there is also a manual print mode that pollworkers could have used to print ballots for voters when the e-pollbooks weren't working, but many appear to have not known that or just panicked and forgot. Also, in MO, Kansas City's African-American Mayor was turned away from the polls after his name was not found on the voting rolls. Later in the day, they figured out why;

• Both Bernie Sanders and Joe Biden cancelled campaign rallies set for Ohio today (where early voting has already begun for next week's primaries in the Buckeye State), due to coronavirus concerns, in what may foreshadow still more trouble for this year's elections, including how to include enough hand-sanitizer for polling places, especially those which use touchscreens. (People can usually bring their own pens to polling places that use hand-marked paper ballots.) We may end up seeing Vote-by-Mail elections for the entire country this November if the virus continues to spread, despite the steady leadership of stable genius Donald Trump;

• Some good news for voters (finally!) out of Georgia today, as the state has reached a settlement with the Democratic party in federal court that requires voters be immediately notified about absentee ballots that are rejected by county officials due to perceived signature mismatch or some other infirmity, allowing them time to come in and cure the problem so their votes may still be counted;

• But there is also less good news out of Georgia, where last week's "good news story out of Georgia" was the fact that Athens-Clarke County's Board of Elections had voted to ditch the new, state-mandated unverifiable touchscreen voting systems for hand-marked paper ballots instead. The Board found that the touchscreens on the new Dominion ImageCast ballot marking devices (BMDs) were so large and bright that they violate voters constitutionally-mandated right to a secret ballot, as others could see how they were voting from 30 feet across the room, according to a related lawsuit filed in a separate GA county. But now, GA's Republican Secretary of State Brad Raffensperger has called an emergency hearing in Athens, charging that the County's Board is violating state law by not using the new, unverifiable voting systems. Now why would he want do that?;

• Meanwhile, in Texas, ballot scans stored on 44 thumb-drives from the new Ballot Marking Device systems used for the first time during last week's Super Tuesday primaries in Dallas County apparently were not included in previously reported results. As many as 7,000 ballots could be missing from the current results. The County's Election Director was required to get permission from a court to "recount" the computer-marked ballots scanned in the county to include those previously left out of the count. A Dallas court, on Tuesday, gave permission to do so, but the order is limited to a computer-scan of the computer-marked paper ballots that were previously not included in last week's results;

But first, with the end of the Public Comment period for certification of Los Angeles County's $300,000,000 boondoggle of a new, 100% unverifiable touchscreen voting system coming to a close next Monday, Jan 20th (Martin Luther King Day holiday!) at 5pm PT, it's great to see Libby Denkmann's comprehensive piece at LAist, on the potential nightmares for L.A. voters in the making. Her piece is headlined "LA's New Voting System Is Still Uncertified. Why Election Security Experts Are Worried". She picks up on many of the points we highlighted when we broke the story earlier in the week of more than 40 violations of California Voting System Standards discovered by the independent testing team hired by the CA Sec. of State during the certification process.

We also follow up on Denkmann's scoop from earlier in the week, regarding the Beverly Hills City Council's recent vote to explore a lawsuit against Los Angeles County because the new, unverifiable touchscreen voting system forces voters to notice a "MORE" button if they wish to see more than the first four candidates listed on the ballot in any particular race. That button is right next to the "NEXT" button that would take voters to the next race without seeing all of the candidates in the current race. A listener writes in with a couple of solutions to that huge design flaw on these incredibly expensive "electric pens" that L.A. is investing in, instead of a much cheaper, much more secure and reliable, overseeable HAND-MARKED paper ballot system.

Then, with many in the pundit class helpfully informing us that candidates like Bernie Sanders and Elizabeth Warren are just too progressive to be elected in the 2020 general election (many of these same pundits also told us Donald Trump could never be elected, by the way), we take an evidence-based look at those claims.

The question, however, begins with dismantling the notion that pack journalism and "conventional wisdom" on such matters should be trusted. For example, conventional wisdom tells us that members of the active-duty military will be big supporters of Trump's again this year. Actual evidence, such as the annual opinion poll of active-duty subscribers to Military Times, reveals a very different set of data than that presented by much of the media. That poll, taken at the end of last year, finds that half of respondents view Trump unfavorably, with 45% viewing him "VERY unfavorably". His overall ratings have dropped dramatically since the military publication's first annual poll in 2016. Moreover a plurality back impeachment for their Commander-in-Chief! (And today's Washington Post story on Trump railing at his Generals as "a bunch of dopes and babies" probably won't help him much either.)

In fact, as we discuss with our guest, historian, author and election fraud investigator RICHARD HAYES PHILLIPS, nobody really knows anything. At least when it comes to the paid pundits substituting their opinions for actual facts. Phillips published a fact-based analysis of the questions regarding Sanders electability at The BRAD BLOG on Friday, based on known raw numbers from the 2016 primary (with a particular eye on the "Blue Wall" states of WI, MN, PA, MI, IA and OH) and what can be gleaned from opinion polls today.

While avoiding punditry and predictions, Phillips' findings --- at least based on what we know at this time --- suggest that Sanders is, indeed, electable. Whether he would still be by the time Republicans got finished with him, or whether he is more electable than someone like Joe Biden or Elizabeth Warren, remains unknown no matter what the TV talking heads tell you. "Take your pick," he tells me when I ask whether his analysis today will hold up even after Trump and the GOP media turn their fire on Sanders if we wins the Democratic nomination. "Which three words do you want to hear Donald Trump say over and over again in the same sentence 10,000 times? Do you want to hear 'Biden Ukraine corrupt'? Do you want to hear 'Bernie crazy socialist'? Do you want to hear 'Pocahontas crazy socialist'? I don't even want to think about what he would say about Pete Buttigieg. I'm not going to go there."

Noting that his work "is based upon numbers and not opinions," he suggests voters should vote for who they like in the primary and forget about "electability", before adding his key takeaway: "The lesson to this is that the most important thing that Democrats can do is to unite behind the winner and not split the opposition. Trump's best scenario is a 3rd party candidate on the Left siphoning enough votes from whoever wins the Democratic nomination to throw the election to Trump."

Phillips argues: "My advice is that Democrats should not be afraid of a spirited primary contest between two or more viable candidates. What they need to do, as recent polling data also reveal, is united behind the ultimate winner. You can't just take your ball and go home and mope because your candidate didn't get the nomination. That's what Trump wants you to do."

It is certainly true that Republicans will say anything, do anything, to win the general election against whichever Democratic candidate ends up winning the nomination. We close with one amazingly audacious recent clip from House Minority Leader Kevin McCarthy (R-CA) on Fox "News" that underscores precisely that point...

"They wanted substantive change and were willing to burn it all down to get it." These words, from a neighbor in the rural north country of New York, describe the thinking of some who voted for Donald Trump. Some of these same voters had supported Bernie Sanders in the 2016 primary (more on that below).

Four years later, some have suggested we should shy away from Sanders, on the grounds that he cannot beat Trump. Election statistics, however, as well as current polling, reveal that he would, in fact, be a viable candidate. This is not the same thing as saying he will win. But, based on actual existing hard numbers that we can examine, he is certainly not "unelectable" as some critics have charged.

Bernie Sanders, having run for President in 2016, is the only Democratic candidate with a recent track record in presidential politics that can be used as a yardstick, unlike several of the other current front-runners such as Elizabeth Warren or Pete Buttigieg. So, let's look at what the raw numbers tell us about Sanders' electability against Trump, bearing in mind that this all could change when full-throated attacks are unleashed against him, as they inevitably will be against whoever wins the Democratic nomination...

On today's BradCast: Elections officials seem to be panicking around the country, and for good reason. But their concerns may be coming a bit late...perhaps a decade or so too late, as virtually every aspect of our "public" elections in the U.S. --- from ballot programming to registration to voting to vote tabulation to election results reporting --- has now been allowed to have become largely taken over by private vendors and contractors, with little or no oversight from either state or federal officials. [Audio link to today's full show is posted at end of article.]

An exclusive analysis last month by AP found that virtually all voting systems currently in use in the nation's 10,000 separate voting jurisdictions in all 50 states run on software --- Windows 7 or earlier --- that will no longer be supported by Microsoft with regular security updates and patches as of January. That includes systems certified by the U.S. Elections Assistance Commission (EAC) from the nation's largest private elections vendors as recently as this year. Those newly certified systems still use Windows 7, which was released a decade ago in 2009.

Of course, the EAC's certification process --- for the few states which choose to follow federal voluntary (yes, voluntary) guidelines --- has been laughable for years. It focuses on usability and functionality, not security. Most systems in the U.S., if they are EAC certified at all, were tested to guidelines published by the EAC in 2005.

At a summit this week of elections officials and vendors, hastily convened by the EAC in Maryland in response to the disturbing AP analysis, officials complained about the lack of federal support and standards, and that financially strapped and technologically challenged elections divisions at both the state and local level are realizing only now that they are being asked "to take part in what is national security" with little or no help from the federal government. One official at the EAC confab reportedly complained: "We are talking about local communities having trouble funding roads and water bills, and now we want them to take part in defense against foreign and state actors."

Of course, it is not only nation-states like Russia that pose a threat to the security of America's vulnerable, computerized and privatized public elections, so do regular old Americans, as the recent hack by a woman in Seattle of more than 100 million customer records at Capitol One proved, along with the vulnerabilities in brand new voting and registration systems discovered by hackers in a few hours at the DefCon Voting Village convention last weekend in Las Vegas.

All of this comes on the heels of Thursday's federal court ruling finding Georgia's voting systems to be so "unsecure, unreliable, grossly outdated....seriously flawed and vulnerable to failure, breach, contamination and attack" that the judge declared the systems (which are similar to ones used in several other states) a violation of voters' Constitutional right to have their votes counted as cast.

But all of that might ultimately be small potatoes in light of longtime cybersecurity journalist and author KIM ZETTER's recent exclusive at VICE's Motherboard, finding that "Critical U.S. Election Systems Have Been Left Exposed Online Despite Official Denials". Zetter, one of the only journalists in the nation who has been covering these matters as long or longer than we have at this point, joins us on today's program to explain her jaw-dropping article which begins this way: "For years, U.S. election officials and voting machine vendors have insisted that critical election systems are never connected to the internet and therefore can't be hacked. But a group of election security experts have found what they believe to be nearly three dozen backend election systems in 10 states connected to the internet over the last year, including some in critical swing states. These include systems in nine Wisconsin counties, in four Michigan counties, and in seven Florida counties --- all states that are perennial battlegrounds in presidential elections. Some of the systems have been online for a year and possibly longer."

In many cases, she tells me, the elections officials seemed to have no idea that their systems were connected to the Internet by their vendors. As for the vendors' part --- in this case, the nation's largest, ES&S --- Zetter explains their bizarre claim that voting and backend tabulation and reporting systems connected around the clock for years at a time aren't really connected to the Internet at all --- and, even if they are, they are perfectly secure. Zetter and the data researchers found otherwise.

The systems found vulnerable on the net, she details, would allow a malicious actor to change unofficial election night results, official results, and the public reporting of the results themselves. Moreover, she explains, access to the exposed backend portions of these systems over the Internet could also result in malware being transferred to voting machines themselves. And all of this was discovered by a small team of researchers with little or no funding. No nation-state required, she confirms.

"If it was just a box on the Internet that was receiving the votes transmitted [on Election Night from the precinct] that would be a security problem in itself, not only because you could potentially alter those votes. They are unofficial results on Election Night --- and the officials results are taken from the actual memory cards in the voting machines. But if you can alter the unofficial results, that's going to create a lot of mistrust in the final outcome if they don't match," she says.

"But even if you don't alter those votes, that communication over the phone between the voting machine in the field and that backend server that's on the Internet creates a channel for infecting those voting machines. So, someone who could actually install that malware on that system on the Internet can design it in such a way that it downloads to the voting machines when they connect to that system. So the attackers can alter that voting machine in preparation for a future election."

"But that's not the only problem," she continues. "If that was the only thing that was on the Internet, that would be a concern in itself. What was remarkable is that ES&S acknowledged to me that they don't just put an empty box on there to receive the votes. Also connected to that Internet connection is the backend system for tabulating both the unofficial results on Election Night, and those official results that are later taken from the memory card."

"And the Election Management System is also connected. The Election Management System is used to do a lot of functions in elections. Among them is the actual programming of these voting machines before each election. So, if you don't get to the machines through that little receptacle that's connected to the Internet, you can get to that backend Election Management System and put in malicious code that then gets transferred directly to the voting machines before the next election."

But, of course, other than that, why worry, right? Well, Zetter has much more to say on that as well, including about Republican Senate Majority Leader Mitch McConnell's continuing efforts to block any and all election security measures in the Senate that might help shore up at least some of these concerns, including bills already passed by the House that would mandate hand-marked paper ballots for all voters. Even that, at this point, wouldn't fully protect against attacks on computer optical-scanners currently used in all 50 states to tabulate those ballots with little or no post-election audits to make sure they did so accurately...

On today's BradCast: Special coverage of Night One of the second 2020 Democratic Presidential debate. This one was broadcast from the Fox Theater in Detroit and hosted by CNN. [Audio link to show is posted below.]

Featured on the first night's debate stage were VT Sen. Bernie Sanders; MA Sen. Elizabeth Warren; South Bend, IN Mayor Pete Buttigieg; MN Senator Amy Klobuchar; former MD Rep. John Delaney; OH Rep. Tim Ryan; former CO Gov. John Hickenlooper; former TX Rep. Beto O'Rourke; MT Gov. Steve Bullock (in his first Dem Debate appearance) and author/spiritual guru Marianne Williamson.

The lively and often substantive debate was, nonetheless, frequently truncated by CNN moderators, who seemed to work hard to force confrontation between the candidates, while framing many of the evening's debate topics as if they were Republican talking points and otherwise trying to highlight the divide between the progressive and conservative wings of the party. Among the many issues raised during the two and a half hour debate on Tuesday night were healthcare (a nearly 25 minute discussion, highlighting the party's many different and often controversial approaches to achieving universal coverage, from 'Medicare-for-All' to the Public Option, and their effects on private insurance), immigration, gun safety legislation (and the corporate forces that prevent it and many of the other issues discussed), the climate crisis, issues regarding race, the economy, the cost of college and student loans, foreign policy and nuclear weapons, and --- one of many Rightwing memes that CNN seemed to be pushing throughout the evening: whether the Democratic Party has moved too far to the Left.

We're joined today for discussion on as many of the above matters as we can fit in --- as well as some thoughts on what was not covered --- by journalist, former CNN producer and healthcare reform expert JACKIE SCHECHNER and Roosevelt University political scientist and contributor at The Week, DAVID FARIS, author of the recently published book, It's Time to Fight Dirty: How Democrats Can Build a Lasting Majority in American Politics.

Each offer smart analysis and insight on the substantive policy issues raised last night, as well as both the political and media aspects of night one of the latest two night Democratic debate, some six months before voting is set to begin next February at the Iowa Caucuses...

After our two-day Special Coverage of the first 2020 Democratic Presidential Debate last week (Night ONE here, Night TWO here), we begin on today's BradCast to get caught up with some of the important news that we were unable to adequately focus on last week. (Even it may take a few days to get fully caught up, if ever!) [Audio link to show is posted below.]

First up today, we're joined for one last time this SCOTUS term by MARK JOSEPH STERN, the great legal reporter at Slate who has helped us make sense of the Court's most recent term under its stolen Republican majority, including many of the oral arguments since last Fall in a bunch of important cases and all of the subsequent rulings handed down in the past several weeks. The last of those rulings were, perhaps, the most consequential, and both came smack dab in the middle of Nights ONE and TWO of the Dem debate last week.

Today, Stern details the Court's horrendous (if not unexpected) 5 to 4 partisan ruling finding partisan gerrymandering to be perfectly Constitutional, despite all of the lower federal courts which have found otherwise. That, even though the practice, taken to new computer-precision extremes by the Republican Party following the 2010 Census, has bastardized the notion of fair representation at both the state legislative and Congressional levels. (eg. See North Carolina, which largely votes 50/50 for U.S. House members over the past decade, but has been represented in the House by just 3 Democrats and 10 Republicans over all of those years!) Stern describes the majority ruling, penned by Chief Justice John Roberts, as a "crushing defeat for voting rights" and a "fiasco for democracy". He explains how the rightwing majority ruling debunks the Chief Justice's own claim that he is the Court's "most aggressive defender of the First Amendment" in that extreme partisan gerrymandering blatantly robs voters of their First Amendment rights by punishing Americans for their partisan leaning, stripping them of the ability to be fairly represented.

"Partisan gerrymandering is uniquely evil and difficult to fix," Stern argues, "because it attacks the foundations of democracy. It entrenches a certain political party's power almost indefinitely, and creates a map that will hold even if the state votes against that party." Now, says Stern, the legal battle to rollback rigged election maps moves to the state court level instead, since SCOTUS has now determined that federal courts have no say in the matter (even though they long ago found racial gerrymanders, if not partisan ones, to be a violation of the Constitution.) "That's why this is the 'nightmare' scenario," he tells me. "Because if the legislature can't fix it --- and why would it fix it, they love what they've done --- you really have to rely on the courts to step in and fix it. And now Chief Justice Roberts has said that the federal courts are not going to hear these claims, that they're shut out forever. That leaves few avenues for relief for voters in these states."

We also get Stern's thoughts --- and callers who ring in on the topic as well today --- on whether Democrats, in states which they control after the 2020 Census should similarly use extreme partisan gerrymandering tactics to balance the scales by keeping Republicans out of power in such states, given that the High Court has granted its blessing for such tactics.

And, speaking of the Census, the other major ruling dropped last Thursday by SCOTUS was on whether or not the Trump Administration may add a question on citizenship to the 2020 Census. In that case, Roberts joined with the Court's liberals to reject the government's claim that they were simply hoping to add the question at the request of the Dept. of Justice in order to better enforce the Voting Rights Act. That transparently false claim was rejected by Roberts who wrote that it "appears to have been contrived".

In fact, it was, as several lower courts have ruled, even before the evidence from the hard drive of a recently deceased GOP gerrymandering expert revealed the entire charade was specifically meant to decrease the response rate by Hispanic and other immigrant communities in order to shift federal funding and voting power to Republicans and non-Hispanic whites. So, that decision was the good news. The not-as-good-news is that Roberts also left the door open for the Administration to try again with a less pretextual reason for adding the question, if they can come up with one. Or, as Stern sums up Roberts' directive in four words today: "Lie better next time." Whether the Trump Administration can do so before the deadline to send the Census to the printer (which, the Admin previously argued in court was a hard deadline of July 1, but now says "well, maybe October would be fine?") remains to be seen.

Next we open up the phone lines to listeners on last week's Democratic debate in Miami. Who do listeners feel did better than expected? Who did worse? The first polling is out today from CNN following last week's debate, finding a pretty huge shift among the Dem and Dem-leaning electorate. The survey finds Senators Kamala Harris and Elizabeth Warren are up 9 and 8 points respectively, while Joe Biden has fallen 10 points since the last CNN poll. That places Harris, Warren and Sen. Bernie Sanders (whose support dropped a few points) all now within just over 5 points from the former Vice President and perceived "front runner" for the Democratic nomination. That pretty seismic shift all comes after just one single debate...with about 11 more to come in the months ahead...

On today's BradCast, we've got quite a bit of hard news, though we have to start off with a brief personal note. [Audio link to today's show follows below.]

Among the stories covered today...

• My much-beloved hometown hockey team, the St. Louis Blues, are now Stanley Cup Champions for the first time in the franchise's storied if oft-frustrating 52-year history! After going from last place in the NHL in January to win the Cup in Game 7 in Boston, it seems only fair I'm allowed a short, if long-overdue, victory lap on today's program --- along with a bumper music tribute to the team I grew up with throughout today's show. (And no, Blues fans, it's probably not the music you expect!);

• In somewhat more substantive, if less pleasant, matters (kicked off by a Daily Kos BradCast commenter who deserves credit for an appropriate invocation of the word "paracosm" today), life in the Conway household must be getting more bizarre by the day. On Thursday, the Trump-appointed head of the federal government watchdog Office of Special Counsel (not to be confused with Robert Mueller's Special Counsel's Office) recommended that Kellyanne Conway, one of Donald Trump's top advisers and apologists, be fired for "repeated violations" of the Hatch Act. The federal law bars federal officials from using their official offices for political purposes, yet Kellyanne repeatedly used hers to bash Democrats running for office while promoting Donald Trump and other Republicans. Scoffing at the watchdog's recommendation, of course, the corrupt White House is all but certain to ignore the multiple violations of federal law by one of its top officials;

• Meanwhile, at the other end of Chez Conway, Kellyanne's husband, longtime Republican attorney and activist George took to the pages of Washington Post to file a scorching op-ed with Barack Obama's former Acting Solicitor General Neal Katyal, slamming Trump's latest legal appeal in the President's attempt to block Congressional subpoenas for financial documents from his accounting firm Mazars. Conway and Katyal deride the President's claims that Congress is Constitutionally barred from investigating criminal matters, and that only the Executive Branch may do so. "The idea that only the president can investigate the president is an argument for autocrats, not Americans," the pair write, arguing that Trump's legal argument seems to invite an official impeachment proceeding by Congress. "Every principle behind the rule of law requires the commencement of a process now to make this president a former one," they conclude, in what must make for some very chilly dinner conversation at the Conway household;

• In not-at-all unrelated news, Michigan Rep. Justin Amash, the only sitting Republican member of Congress to call for impeachment proceedings against Trump, continues to maintain is not planning a run for President on the Libertarian ticket, though he said he has not "ruled anything out". He also lobbed back a pretty impressive response to an attempted Twitter shot by Donald Trump, Jr. (Of course, given the information-starved Trump supporters, it may be one they don't even understand.) Earlier this week, Amash officially resigned from the hard-right "House Freedom Caucus" (formerly known as the "Tea Party Caucus") which he had co-founded, having split with the group whose members have now become amongst the most virulent defenders and apologists for Trump in Congress. He also voted yesterday with Democrats in the House Oversight Committee to hold Attorney General Bill Barr and Commerce Sec. Wilbur Ross in contempt for defying a subpoena to turn over documents related to false Administration claims regarding the addition of a question about citizenship on the 2020 Census;

• Of course, the reason Amash is currently the only sitting GOPer to call for Trump's impeachment is because he may be the only Republican in the House who actually bothered to read the Mueller Report, which details multiple instances of criminal obstruction by the President for Congress to consider for impeachment proceedings. This past week has brought some remarkably original excuses from GOP House members as to why they are willing to overlook and excuse multiple, well-documented federal crimes by the President, who Mueller found to have committed some of the very same unlawful actions for which articles of impeachment were brought against both Presidents Richard Nixon and Bill Clinton. For example, Ohio Rep. Steve Chabot, who as a member of the Judiciary Committee in 1998 voted for impeachment against Clinton, now says Donald Trump never swore on a bible, so there's nothing to impeach him for. Georgia Rep. Rob Woodall fell all over himself with some remarkable, false and contradictory statements while trying to explain why he proudly refuses to even read Mueller's report at all! But while Republican members of Congress might be excused --- under the world's most generous interpretation possible --- for being clueless when it comes to the Rule of Law, no such generosity can possibly excuse the jaw-dropping response to the Mueller Report's findings from the state of Louisiana's chief law enforcement officer, Republican Attorney General Jeff Landry;

• Finally today, stunning news out of Michigan, where the state's recently appointed Solicitor General, tapped earlier this year by newly-elected Democratic Attorney General Dana Nessel, announced that state prosecutors were dropping all criminal charges against eight people indicted in the Flint lead poisoning water crisis and starting the probe over from scratch after an expansive new body of evidence was reviewed. Prosecutors say they may recharge some of the previously indicted individuals, but that new evidence reveals former Republican Attorney General Bill Schuette's three-year investigation failed to properly examine large swaths of material evidence, some of which is said to be tied to former Republican Gov. Rick Snyder. We try to make some sense of that news as we close out today's show...and musical tribute to my favorite underdog hometown team...

Someone needs to let the President of the United States know that Memorial Day is, at least in theory, a somber remembrance for the nation's war dead. It might have been nice if that someone had done so before Trump showed up in Japan over the weekend --- for talks with that nation's Prime Minister --- and wished U.S. troops stationed with our ally and former WWII foe a "Happy Memorial Day!" It certainly wasn't a happy one around many parts of the U.S. for a number of reasons. But, once again, we try to find the bright spots where we can.

Among the swarm of stories covered on today's BradCast [Audio link posted below summary]...

• The record swarm of tornado swarms continued on Memorial Day, with some 53 twisters touching down in eight different states on the same day. A man in Ohio was killed when a car flew into his living room and at least 130 were reportedly injured in the Buckeye State, where power was knocked out to more than 5 million residents as of Tuesday morning. "Catastrophic" destruction was seen across many states after Monday marked a record-tying 11th straight day with at least eight tornadoes in the U.S. according to NOAA. Whether media outlets connected the virtually unprecedented storms (and month of flooding in the Midwest and Central U.S. that preceded it) to our worsening climate crisis is another matter entirely;

• Speaking of Ohio, at least before the storms, a KKK rally on Saturday brought out 9 Klansmen and between 500 and 600 counter-protesters. At least the folks in Dayton got that one right, if not some of their responses to emergency interruptions during their favorite TV programs as tornadoes swept through the state on Monday;

• And, speaking of getting it wrong, there is the far-right evangelist Franklin Graham, son of the late, respected minister Billy Graham. Franklin, a Trump supporter who has attacked Indiana Mayor and 2020 hopeful Pete Buttigieg for being both gay and a practicing Christian at the same time, used his tax-exempt religious pulpit to call for "Christian leaders" to declare a "day of prayer" next Sunday for Donald Trump, who, Franklin says, has been "attacked" by his "enemies" more than "any President in the history of this nation". President Abraham Lincoln dissents;

• As the loony right rises, or tries to, we move out west to Fresno, California, which, as we reportedly exclusively back in 2013, single-handedly blocked an attempted statewide "recount" of Prop 37, a state ballot initiative that would have required the labeling of GMO foods. The wingnuttery in Fresno continued over the weekend, as its minor league baseball franchise, the Fresno Grizzlies, "celebrated" Memorial Day with a video tribute that featured a speech by Ronald Reagan and a montage of Americas "enemies" that included Kim Jong Un, Fidel Castro and....wait for it....New York's Democratic freshman Rep. Alexandria Ocasio-Cortez. The team eventually apologized to AOC --- hours after their initial apology for the video itself --- though they never bothered to mention that, among other "enemies" shown in the 3 and a half minute video played at the ballpark, anti-fascism and anti-KKK marchers were also singled out. 'Happy' Memorial Day!;

• In voting news over the long weekend....the U.S. Supreme Court on Friday put on hold two different earlier rulings from lower federal appeals courts finding that Republicans in both Ohio and Michigan had unconstitutionally gerrymandered their Congressional maps for the past decade. The high court's action was issued without comment as we await their pending decisions on two similar cases the Justices heard earlier this year regarding unlawful partisan gerrymanders in North Carolina and Maryland. That may be a bad omen for those two cases. But, for now, the SCOTUS order blocks the lower court orders to draw new, fair Congressional maps for 2020 in Ohio by June 14 and in Michigan (where new state legislative districts were also ordered) by August 1;

• There was better news, for a change, in the state of Texas of all places. The state's legislative session ended on Monday without confirmation of the nomination of Gov. Greg Abbott's Secretary of State David Whitley, thanks to all Senate Democrats refusing to support him. Whitley was forced to resign without the confirmation, which was withheld after the unqualified former travel aid to Abbott had falsely announced in January that 100,000 non-citizens were registered to vote in Texas, with 58,000 of them having illegally cast votes since 1996. As it turns out, most of those voters had become naturalized citizens over that period. But that didn't prevent Whitley from instructing the state's County Clerks to purge voters in 30 days unless they could prove their citizenship or from referring the case to the TX Attorney General who promptly ordered criminal investigations for his own part in the attempted purge. The state was sued by three different voting rights groups and a number of naturalized citizens. They were forced to settle by changing voter roll purge rules for the future and paying some $450,000 to plaintiffs for their legal costs and fees;

• Finally today, with at least 24 candidates vying for the 2020 Democratic presidential nomination and debates set to begin next month, voters have been sizing up how the hopefuls might take on Donald Trump next year (presuming he's the GOP nominee) if they win the nod. Last week, during a Washington Post forum, South Bend, IN Mayor Buttigieg, who was deployed to Afghanistan in the Naval Reserves, cited Trump's draft dodging due to a claimed "disability" during the Vietnam War. When asked about his comments over the weekend on ABC's This Week, rather than backing off of them, Buttigieg doubled-down, revealing a) Trump was, indeed, a draft dodger who now pretends to revere the military, but who was willing to let someone else take his place in Vietnam and b) Mayor Pete is not afraid to stand up, at least rhetorically, to the bully who has become the President of the United States, even after some in the media attempted (as they do) to try and call him out for it...

It's hardly breaking news at this point, but the GOP and its politicians now represent little more than a complete culture of corruption from top (Donald Trump) to bottom (find a state, pick an elected Republican). Among the tiny sampling of new stories covered on today's BradCast which bear that out. [Audio link to full show is posted below]...

• The EPA's Office of Inspector General finds that disgraced former EPA chief Scott Pruitt owes tax-payers at least $124,000 for improper first-class flights and fancy hotels from during just 10 months of his reign before he was ultimately forced to resign. That, among nearly $1 million misappropriated for unnecessary, improperly approved security personnel and staff travel. The agency says it has no intention of asking Pruitt, who is now working for coal companies, to repay the money, of course;

• But, since a fish rots from the head down, it's only appropriate to note that Donald Trump, on Wednesday evening, pardoned his billionaire pal and business partner, Conrad Black, who spent three years in jail on fraud and obstruction of justice charges after bilking millions from investors in his media company. But, he then said nice things about Trump in 2015 and has since written a book that fawns over the President titled Donald J. Trump: A President Like No Other. So, he's now officially pardoned by the President! Trump also pardoned Patrick Nolan, a former GOP leader of the California state assembly yesterday. Nolan was convicted on federal racketeering charges, but he recently criticized the Mueller investigation on behalf of the American Conservative Union, where he now works, so he gets a pardon too!;

• The Republican Culture of Corruption hardly ends in D.C., however. On Tuesday, Georgia's newly elected Insurance Commissioner Jim Beck was indicted on 38 felony counts of mail fraud, wire fraud, and money laundering. Before reportedly being elected on Georgia's 100 percent unverifiable voting systems last November, Beck allegedly used a fraudulent scheme to embezzle money from a state-run insurance association he ran through several private companies he ran and then to the Georgia Christian Coalition. He has refused to resign but, on Thursday, the state's new (and similarly corrupt) Republican Governor Brian Kemp "suspended" him, whatever that means, while Beck fights the 38-count federal indictment;

• In Michigan on Wednesday, state Rep. Larry Inman was indicted on charges of attempted extortion, soliciting a bribe and lying to the FBI. (Trump better have plenty of ink in his pardon pen!) According to text messages included in the indictment, the GOP super-genius texted a union rep for contributions in exchange for his and his colleagues votes against a measure that would repeal a law requiring union wages, along with the text message: "We never had this discussion";

• But, of course, there are dirty Dems as well. But Republicans are so corrupt these days, they are even letting THEM off the hook...for some odd reason. A high-profile law firm in Boston was found by Federal Elections Commission staff investigators to have unlawfully reimbursed its attorneys for campaign contributions to Democrats to the tune of more than a million dollars in donations. The FEC lawyers recommended a further investigation to the FEC Commissioners, but they voted 2 to 2 on party lines to end the case without any further probe. You'll be shocked to learn the 2 Republicans on the Commission voted AGAINST the further probe, while the Democrat and Independent appointees both voted in favor of it. FEC Chair Commissioner Ellen Weintraub, the lone Democratic appointee, told the Boston Globe: "In every case, it doesn't matter whether Democrats or Republicans are subject of the complaint, the Democrats want to enforce the law and the Republicans don't. It's an ideological opposition to enforcing the law." That sounds about right. It's a Republican Culture of Corruption;

• Next, a bit of a follow-up to our interview yesterday with 30-year Leon County, Florida Election Supervisor Ion Sancho, after news broke this week that the election systems of two Florida counties were said to have been penetrated by Russian Intelligence prior to the 2016 Presidential election, according to the FBI. The Bureau is currently forbidding state officials, and now members of Congress, from informing the public about which counties those are and if, in fact, there are more of them. Florida's U.S. House delegation is hopping mad about it all, as was Sancho yesterday. It should also be noted here that Florida's Republican Sen. Marco Rubio was told about much of this last year, as a member of the Senate Intelligence Committee, but said nothing even as his fellow Senator from Florida, Democrat Bill Nelson, also then an Intel Committee member, was excoriated before last year's election for noting publicly that Russia had penetrated the Sunshine State's electoral system. He was right. But Rubio said nothing as Nelson was portrayed as an insane old conspiracist. In the bargain, Nelson ended up narrowly losing (according to FL's unverified results) to Rick Scott, the state's then Republican Governor;

• All of this mess, at least, has resulted in at least a few Republican and Democratic officials suddenly becoming alarmed about the dangers posed by vulnerable computerized voter registration and tabulation systems that cannot be overseen by the public to assure they have not been manipulated by hackers and have reported election results as per the voters' intent. George W. Bush's former cybersecurity czar Richard Clarke appeared on yesterday's Last Word with Lawrence O'Donnell to make that case, and to warn about the dangers of electoral manipulation from foreign sources that awaits in 2020. A little. Whether they have any clue regarding what to do about it is a separate matter all together. So, we'll keep shouting;

We've got a lot of news and notes of concern --- both good and bad --- about the 2020 elections on today's BradCast. [Audio link posted below.]

Among the many stories covered today...

• Former Vice-President Joe Biden finally announces that he's getting into the crowded 2020 race for the Democratic Presidential nomination. His "stirring" announcement video takes on Donald Trump directly, in a way that other candidates have largely avoided to date. Whether that will be a winning strategy, of course, remains to be seen for the man many consider to be a front-runner at this early point in the contest;

• Hillary Clinton pens a worthy op-ed in the Washington Post, with her personal recommendations on how to best take on the question of whether Trump should be impeached in the wake of damning findings of criminality by the President in Robert Mueller's Special Counsel report, as well as how best to work to protect the 2020 election from interference --- at least from foreign sources;

• George Conway, the conservative attorney husband of White House senior adviser/Trump apologist Kellyanne Conway, once again wins Twitter by citing Clinton's oped to slam both the President and, by extension, his own dissembling wife. He also cites another article detailing yet another new international embarrassment courtesy of Trump, to help his new, apt moniker for the President, #DerangedDonald, trend on Twitter;

• Big news out of Michigan breaking today as a three-judge federal court panel finds district maps created by GOP state legislators in 2011 to be unconstitutional partisan gerrymanders. The court has now ordered the state to redraw as many as 34 state legislative and Congressional districts and even hold a number of special state Senate elections under the new maps in 2020, rather than in 2022 as previously scheduled. Though a decade or so late, it's still very good news for Michigan voters, though Republicans plan to appeal in hopes of stalling until the U.S. Supreme Court comes down with their verdict on two other cases of similar partisan gerrymanders in North Carolina and Maryland this June;

• The New York Times publishes a very disturbing --- if not surprising in the least --- exposé revealing that recently-fired DHS Secretary Kirstjen Nielsen was rebuffed, time and again, by Donald Trump and other senior White House officials, in her efforts to convene cabinet level meetings on a strategy to protect the 2020 election from cyber-manipulation by Russia and other foreign sources. The exceedingly insecure Trump, according to the report, sees any such efforts to harden defenses against the threat of cyber-intrusions by Russia as a way of casting doubt on the legitimacy of his 2016 victory...for some reason;

• Finally, Desi Doyen joins us for the latest Green News Report, as the second monster cyclone in a month bears down on Mozambique (the one just weeks ago killed a thousand people and has resulted in an extraordinary humanitarian crisis --- this new one could be even worse), along with other troubling climate change news from around the globe as well as some encouraging news here at home as Los Angeles Mayor Eric Garcetti announces plans for the city's very own Green New Deal...
