• New Zealand bans military-style assault weapons less than one week after a white supremacist terrorist massacred 50 worshiping Muslims at two mosques in Christchurch. That was easy. Must be nice to not be enthralled to decades of NRA propaganda and the tens of millions of dollars they are allowed to use to bribe politicians in the U.S., where even a Congressional vote on background checks has been verboten by Republicans;

• Record flooding continues to swamp the upper Midwest, as the National Weather Service warns the catastrophic floods will be moving south and inundating states as water makes it way toward the Mississippi Delta where some areas have already been fighting with rising waters since last month;

• All of that before we even get to the spring rainy season, about which the National Oceanic and Atmospheric Administration (NOAA) warned on Thursday could bring widespread "unprecedented flooding" to most of the nation amid climate change-accelerated storms;

• But there is much better news out of a court in Wisconsin where a state judge today blocked the GOP-controlled state legislature's unprecedented lame duck power-grab passed during an "extraordinary session" called last December to take power from the incoming Democratic Governor and Attorney General following the defeat of Republican Gov. Scott Walker by state voters in November. The judge ruled the session itself, called by just eight Republicans in the state House and Senate, unconstituionally declared and therefore, the three sweeping power-grab bills and last-minute confirmation of 82 Walker appointees before Democratic Gov. Tony Evers and Attorney General Josh Kaul could take over, are all now struck down. The victory for state voters and democracy lovers also means the Badger State may now withdraw from a multi-state lawsuit joined by the previous GOP administration challenging the Constitutionality of the Affordable Care Act ("ObamaCare"). GOPers in the state legislature have promised to appeal the ruling;

• The Commandant of the U.S. Marine Corps issued blistering memos this week warning that Donald Trump's deployment of troops to the U.S.-Mexico border and his "emergency" declaration has undermined troop readiness, national security and placed the well-being of the Corps at an "unacceptable risk". Gen. Robert Neller charges, according to the documents obtained and published today by the L.A. Times, that "unplanned/unbudgeted" deployment to the border last year and the shift of funding to border security efforts has resulted in cancellation of military exercises across the globe and has compromised "combat readiness and solvency". The unusually strong comments, according to military experts, critically cite the delay of urgent repairs needed at bases damaged by hurricanes last year in North Carolina and Georgia, with the new hurricane season just months away for "Marines, Sailors, and civilians working in compromised structures". All of that as Trump touted his support for the military on Wednesday night at a plant in Lima, Ohio which manufacturers tanks that the Pentagon has said they neither need nor want;

• All of this also follows on Trump's announcement last month that he is pulling the U.S. out of the 30-year old Intermediate-Range Nuclear Forces (INF) Treaty struck between Reagan and Gorbachev in 1987, leading to the destruction of thousands of nuclear-tipped missiles on both sides after the landmark Cold War era pact was signed. Russia has said they will now follow Trump's lead in abandoning the treaty and, according to Pentagon officials, the U.S. is now preparing flight tests this summer for two types of non-INF compliant missiles that would have been long-banned under the treaty. Let the arms race begin again!;

• Finally, Desi Doyen joins us for the latest Green News Report on the staggering cost to date of the deadly flooding in the upper Midwest, the toxic chemical inferno this week in Houston, Trump's new EPA chief blowing off concerns of global warming, 2020 Dems demanding action on same, and a very encouraging ruling on oil and gas drilling in Wyoming from a federal judge who has ordered that the government reconsider its environmental assessment of drilling on public lands to account for the cumulative threat of fossil fueled climate change due to man-made greenhouse gas emissions...

On today's BradCast, we're experiencing a sense of deja vu from this very same fight the last time Congress allocated hundreds of millions for new electronic voting systems in the U.S. [Audio link to show is posted below.]

A serious "design flaw" in a previously certified computer voting system is finally acknowledged on Friday by New York State's top election official, after several different warnings on the matter were issued in recent months by computer security and voting systems experts at Princeton and Georgia Tech.

The vulnerability has resulted in Douglas Kellner, the co-chair of the NYS Board of Elections, calling for a reexamination of the ImageCast Evolution (ICE) computer Ballot Marking Device (BMD), which both prints ballot selection on a paper and then scans that ballot to record results after it, theoretically, has already been verified by the voter. "After you mark your ballot, after you review your ballot, the voting machine can print more votes on it!," [emphasis in original], Princeton's computer science professor Andrew Appel warned about the Dominion ImageCast Evolution system in October of last year.

Kellner cites that "ballot stuffing attack" vector first identified by Appel and then confirmed by Georgia Tech's former Dean of computing at Georgia Tech and director of its Information Security Center, professor RICHARD DEMILLO who joins us on today's show to explain the vulnerabilities. The very same design flaw appears to be present in systems currently in use or set for use before 2020 in parts of Kansas, Texas, Pennsylvania, Delaware and elsewhere, as jurisdictions scramble to spend federal dollars to "upgrade" their voting systems to new equipment in advance of the next, crucial Presidential election.

A similar system made by ES&S, currently being pushed for use across the entire state of Georgia by Republicans, vendors and elections officials, also appears to have the same flaw and even one that Appel describes as a disturbing "Permission to Cheat" feature (first observed by Election Integrity advocate Jenny Cohn in Kansas last September) that allows the machine to submit a ballot to the scanner without the voter ever verifying what the computer has printed on it. That, DeMillo explains today, allows ballots to be marked and printed by the computer and then scanned without any examination by the voter at all. Both "design flaws" make any post-election hand audit of those ballots "meaningless" [PDF] .

As Kellner explains in his letter to fellow Elections Board members in NY --- effectively decertifying the systems, for now, thanks to Dominion's failure to document these vulnerabilities before certification --- "If it was possible for the machine to add a voting mark to the ballot without verification by the voter, the audit is not meaningful because it cannot confirm that the ballot was counted in the manner intended by the voter."

"What they have is a single device that marks the ballot and scans the ballot. Just because of the way that they've designed this thing, there's a single path that the paper ballot travels --- under the print heads, and over scanning heads," DeMillo tells me. "What I think is a real issue is the design flaw that makes it possible to have the paper ballot printed out, verified by the reader, and then scanned, but in that scanning process, travel a second time undetected through the print heads. The voter could have chosen to vote for no one. But the machine could decide well, we really like the Democratic candidate for Public Service Commissioner, so we're just going to add that to every ten blank Public Service Commissioner choices that we see."

DeMillo breaks down what all of this means for New York and other states now using or set to use these systems, and how the vendor in question, Dominion, has responded [PDF] by attempting to marginalize the concerns and dismiss critics like DeMillo and Appel as "security maximalists."

DeMillo has been joining other cybersecurity experts in issuing similar warnings [PDF] to officials in his home-state of Georgia, where lawmakers are in the midst of rushing to approve at least $150 million for the purchase of similar devices from ES&S for use across the entire state before 2020 --- and not just for disabled voters who may require such a system to vote independently, but for all voters in the precincts. That, despite the systems appearing to have similar "design flaws" to those which have now served to effectively decertify the Dominion systems in NY.

All of this, of course, is of a piece with the warnings we've been loudly issuing for years at The BRAD BLOG and on The BradCast about the use of this type of unverifiable computer-marked "paper ballot" voting systems, rather than verifiable HAND-MARKED paper ballots.

Also on today's program: Donald Trump publishes his Fiscal Year 2020 budget proposal, including hundreds of billion in cuts to domestic programs such as Medicaid and Medicare (which he vowed, while a candidate in 2016, to protect), as well as to the Environmental Protection Agency and other federal agencies. At the same time, the proposal includes record increases in defense spending and $8.6 billion more for his southern border wall (which Mexico is still not paying for). The result, if the aspirational proposal were to be adopted by Congress, would ensure annual budget deficits of at least $1 trillion over the next four years. That, on the heels of the Trump/GOP's $1.5 trillion tax cut for the wealthy and corporations which has ballooned the deficit and national debt to go with it.

And, finally today, after WA Governor Jay Inslee entered the Democratic President Primary last week race based largely on his decades of raising the alarm about climate change, we share a few recently unearthed clips from Inslee's fellow Presidential hopeful Sen. Bernie Sanders warning about "the greenhouse effect" and the dangers of a warming climate as long ago as 1989 on C-SPAN and in 1987 with a class of middle-school children while then still serving as Mayor of Burlington, Vermont.

On today's BradCast, after some quick news on the House Democrats' much-needed omnibus election and ethics reform bill (HR1) to expand voting rights and on elected South Dakota Republicans now working to restrict voting in the state, it's on to our main story today. [Audio link to complete show is posted below.]

"Someone has to explain, if our economy is doing so great, how come everyone is broke?," Bill Maher asked during a recent segment of HBO's Real Time in the middle of Trump's 35-day federal government shutdown over December and January. "To me, the real lesson of this government shutdown," he argued, "is that we found out that federal workers, quintessential middle-class jobs, can't afford to miss one paycheck!" He's right. Remarkable stories made their way into the media during the shutdown, about struggling furloughed federal workers, some of whom had been working for the same agencies for decades, forgoing medical care, at risk of losing their homes or being forced to use free food pantries after missing one single pay day.

The U.S. has been slashing taxes, largely for the wealthy and corporations, for decades now as middle-class wages have remained stagnant and poverty continues to grow in the richest nation on earth. That, even as the rich get obscenely richer and Americans are told we simply can't afford our existing social safety nets and government programs, much less expansions of them to include Medicare for All, a Green New Deal or free college tuition --- even though they are all wildly popular ideas. As Ernie Canning recently summarized: "81% of the electorate support a Green New Deal. 70% of all Americans --- including 52% of Republicans and 84% of Democrats --- support Medicare for All. Some 75% of Americans support tuition free college. 82% of Americans want the federal government to negotiate lower prescription drug prices. 59% support the Ocasio-Cortez proposal to raise the top marginal tax rate to 70%."

So, did the month long federal government shutdown teach us anything about how close most Americans are to the brink? Did our elected officials (ahem, Republicans) actually notice or care? This past week, U.S. Senate Majority Leader Mitch McConnell (KY) and GOP Senators Chuck Grassley (IA) and John Thune (SD) introduced the "Death Tax Repeal Act of 2019" to do away all together with estate taxes for the very wealthy, even though, as our guest today points out in a recent Common Dreams column, the current estate tax applies to fewer than two dozen people in those three Senators' states combined. Racial inequality means that economic inequality is even worse for those who aren't white, begging the question as to why it is described as "economic anxiety" when white people are feeling squeezed, but dismissed as poverty and laziness from everyone else.

We're joined to discuss all of this today by author CHUCK COLLINS, an expert on U.S. inequality and the racial wealth divide at the Institute for Policy Studies. He is also co-editor of Inequality.org and a contributing columnist at many outlets.

Collins discusses how the inequality gaps have become so wide in the U.S.; why so many continue to support candidates for elected office who work against the economic interests of the poor and working class; how attitudes about race exacerbate the problem; and how we may finally be "heading into a re-alignment" with a new crop of progressive elected officials and a potential awakening of the American people after being conned for last 40 years.

"I think a lot of people were surprised about the percentage of people who live in poverty, and who live paycheck to paycheck," he tells me about lessons learned during the shutdown. "I think it was eye-opening and even empathy-producing. I think people silently suffer the economic insecurities that they experience and this was another shared moment where a lot of people were saying, 'Yeah, I don't have any savings, I have no cushion, I have to go to the food bank and I'm a median income worker.' So I think it opened a lot of eyes, and potentially some hearts and minds, as well."

"Forty years of stagnant wages has certainly hit a lot of white households," Collins explains. "There is a lot of rising insecurity, certainly coming out of the economic meltdown a decade ago. A lot of white families experienced a sort of shock and vulnerability and, I would say, kind of keeps us from being able to see the parallel experience of everyone else, and the fact that the racial inequalities are even deeper, and even more insecure. 37% of African-American households --- zero or negative wealth. 33% of Latino households --- underwater. So, yes, a lot of white people are feeling the pain, but a lot of people of all colors and all races are feeling that insecurity and pain."

"Why wouldn't we want to have a minimal safety net?," he asks rhetorically, in response to my questions about whether so many popular policy ideas to help close the inequality gaps and lift the poor and middle-class may finally being getting a foothold. "Why wouldn't we want to have a system of higher education that allows young people to go to college and graduate without tens of thousands of dollars in debt? It worked for the post-World War II generation. It worked for millions of people who got debt-free college and launched their lives and careers. Have we forgotten that entirely? There's a certain amnesia at work, as well --- that public investments and public support have made it possible for lots of people to move forward in their lives and have good lives. And we shouldn't forget that when it comes to the next generation."

"I think we're heading into a kind of realignment," Collins adds optimistically, underscoring some of his recent articles on the trillions in revenue that could be raised through Elizabeth Warren's proposal to tax the ultra-wealthy and Bernie Sanders' plan to increase not decrease the estate taxes on inheritances over $1 billion. "I think most people understand that these inequalities and insecurities are a dead end. They also are getting tired of hearing billionaires telling us what to do and how the economy should be organized, realizing that this corrosive corruption and concentration of wealth at the top is bad."

Finally, we close today's show with some must-listen conversation from the World Economic Forum in Davos, Switzerland, where two members of a panel on income inequality (historian Rutger Bregman and Oxfam International's Winnie Byanyima) take on the millionaires and billionaires in attendance for their unwillingness to face "the real issue of tax avoidance and the rich not paying their fair share." They also take on an outraged challenge from an audience member (former CFO of Yahoo, Ken Goldman) which only seems to underscore the need to raise taxes on the wealthy in order to lift up the needy and struggling workers around the globe...

That, even as much (but not all) of our independently verifiable, evidence-based news coverage was marginalized or dismissed by many in the corporate media years earlier. We discuss just a few of those stories today --- too numerous to detail here --- as we look both back and forward on this latest milestone. • Donald Trump's federal government shutdown nears the end of it's fifth record week, as he folded like one of his own cheap and poorly tailored suits on Wednesday night in his standoff with U.S. House Speaker Nancy Pelosi on delivering his State of the Union next week.

• At the same time, federal aviation unions issued a dire warning about the ongoing effects and potential critical dangers of the shutdown.

• We share a heartbreaking story about a 10-year old girl who suffered a broken wrist in stoic silence for a week, because she was frightened to tell her father, a Dept. of Homeland Security employee forced to work without pay.

• Billionaire crypt-keeper and Commerce Dept. Secretary Wilbur Ross took to the airwaves to, essentially, call 800,000 federal workers whiners for needing to use food banks to feed their families, when they could just go out and get a bank loan instead to cover costs until the federal government reopens.

• In the U.S. Senate, Mitch McConnell finally allowed votes on measures to reopen the government, one from Rs and one from Ds. Both failed to get the 60 votes needed to overcome filibuster, though the D version --- which did not include funding for Trump's border wall --- received more votes than the R version in the GOP-majority Senate.

• And Trump's former attorney Michael Cohen learned that he may have to appear before both House and Senate Committees next month, despite threats to his family by the President of the United States.

• Finally. Desi brings us the latest Green News Report, with more bad news about the shutdown and Greenland's melting ice shelf, but some encouraging news on a huge majority of Americans who now appreciate the threat of climate change and on the amazing teen climate activist taking on the corporate powers and millionaire/billionaires at Davos this week...

When, in 2015, former President Jimmy Carter told talk show host Thom Hartmann that the United States had become "an oligarchy with unlimited political bribery", he did so in relation to the impact of the U.S. Supreme Court's infamous 2010 decision in Citizens United --- a decision that removed virtually all restraints on corporate campaign donations. This, the 39th President asserted, has produced "a complete subversion of our political system".

"Complete" but not irreversible.

While sometimes difficult to notice amidst our Trumpian nightmare, the U.S. is, nonetheless, in the midst of what 2016 Presidential candidate Bernie Sanders described as a "political revolution" that strives to diminish the grip of corporate wealth at the polls via grassroots-funded progressive candidates who refuse to accept corporate money. Progressive activists and candidates have been succeeding by utilizing every inexpensive means of communication available to ordinary citizens that does not entail the inordinate expense of political advertising via the corporate-owned mainstream media. It is a task that has been most effectively taken on by a younger generation of adept, tech savvy activists and candidates.

While overcoming the power of corporately-powered political propaganda during the 2018 midterm election, a newly elected class of young progressives recently entered the U.S. House of Representatives only to be confronted with a second obstacle: the insidious reach of corporate lobbyists…

The effects of the federal government's partial shutdown, now in its third week, continue to worsen, even as the effects of last year's 'blue wave' election continue to make things much better for Americans across the country. Among the stories covered on today's BradCast [audio link is posted below]...

• The shutdown is causing "a mess" for potentially tens of thousands of American families who live in properties subsidized by the Dept. of Housing and Urban Development. They may soon face rent increases or eviction due to HUD's failure to renew thousands of contracts before and during the agency's closure;

• Vice President Mike Pence made the media rounds in advance of Trump's Tuesday night prime-time Oval Office remarks (which TV networks didn't allow for Obama), in hopes of drumming up support for the Administration's false claim there is a national security crisis on the border which may precipitate a Presidential declaration of a "national emergency". Pence offered a number of false claims in the bargain, which even some GOPers were scoffing at today;

• With Trump having boxed himself into this protracted shutdown mess, a "national emergency" declaration may be his only face-saving way out of it. It would likely result in Republicans allowing a vote in the Senate for reopening the government, even as the declaration would face court challenges over its legality and, essentially, do little more than steal tax-payer money from national defense as U.S. troops are tasked with building Trump's southern border wall;

• The U.S. Supreme Court has decided to hear two partisan gerrymandering cases this session (from Maryland and North Carolina), which may not be good news following the retirement of Justice Anthony Kennedy;

• But, in better news from SCOTUS today, the Court rejected a plea from Virginia Republicans to delay a lower-court mandated remapping of districts for its House of Delegates in advance of this November's off-year legislative elections in the state. Twelve of those districts were previously found by the lower court to be unconstitutional racial gerrymanders;

• Meanwhile, last year's midterm 'blue wave' is already yielding dividends for the nation. In Maine, the nation's dumbest now-thankfully-former Governor Paul LePage certified what he declared to be a "stolen election" for the U.S. House on his way out the door, and the state's new Democratic Governor Janet Mills signed legislation on her first day on the job that will finally give access to healthcare to some 70,000 Mainers under the Affordable Care Act (Obamacare) Medicaid Expansion that had been blocked for some eight years by the former Republican Governor;

• And, in further good news following last year's midterms, Florida's Amendment 4, adopted by nearly 65 percent of voters in November, kicked in on Tuesday to allow as many as 1.4 million former felons the right to vote in a state that is notorious for its close elections. Despite claims by some Republicans that "implementing language" may need to be enacted, County Supervisors of Elections began allowing registrations under the new Amendment for most former felons who have served their time. The result could be a sea change for the state in 2020, not to mention for the rest of the nation where Florida's electoral votes are key to Presidential elections;

• Finally, Desi Doyen joins us for the first Green News Report of 2019, where last year's 'blue wave' is also being positively felt on the environmental front at both the state and federal level, even as Trump's shutdown is trashing national parks and blocking important scientific research...

On today's BradCast, I'm with you one more time, then Brad and Desi are back! I'm visiting from In Deep with Angie Coiro, sharing the airwaves and streams with the BradCast.

A troop of Dems led by Nancy Pelosi made a promising presentation on HR-1. Right now the sweeping proposal to reform elections, campaign funding and oversight is nothing but a proposal. Republicans will certainly work against many of its provisions, including its voting rights measures efforts to stem the flow of politicians to lobbying corps. Even so, some of the rhetoric today from the likes of Elijah Cummings and John Lewis was genuinely moving and full of real passion. I've brought you long chunks of it.

Likewise, Sen. Chuck Schumer spoke frankly and with few punches pulled addressing the shutdown, which is cruising into Day 15.

I spend a lot of well-deserved time today on this essay by Elizabeth Goitein, co-director of the Liberty and National Security Program at the Brennan Center for Justice. Now that Trump is throwing around not-so-veiled threats about declaring a national emergency and his willingness to keep the shutdown in effect for "years", it's good to know exactly what he can get away with. Hint: a lot.

No big surprises as the new Congress moves in - not in either house. New Speaker Nancy Pelosi said all the right things - about bipartisanship, diversity, women, the border, health care, standing strong. Nice, listenable, good applause lines, and she seemed genuinely welcoming and warm to the kids she brought up to the podium to celebrate. Sorry for the cliché, but of course only time will tell if she can get anywhere with the House divided.

With those kids in mind (what dreams do they have? Will we see any of them come back to the floor as leaders?) I check in with HANNAH EHRLICH of Lee and Low publishing house. It's been a very busy news weekend (as usual these days), so we try to catch up with at least some of it, along with calls from listeners on today's BradCast. But, more importantly, we're already busy trying to save the next election from disaster, thanks to a move by folks on the right and left to make election results virtually impossible to be overseen and verified. [Audio link to today's show is posted below.]

States and counties all across the country are finally beginning to move to new "upgraded" voting systems. In many cases, however --- in both Republican and Democratic-leaning jurisdictions alike --- officials are now disastrously preparing to move to touchscreen computer Ballot Marking Devices (BMDs) which are even less verifiable, in many cases, than systems currently in use!

In Georgia, a commission impaneled by Republican Brian Kemp, champion vote suppressor as former Sec. of State and now Governor-elect, is deciding whether to move from the state's 100% unverifiable Diebold touchscreen Direct Recording Electronic (DRE) voting machines to similarly 100% unverifiable touchscreen BMDs made by ES&S before the next election. Here in Los Angeles County, the nation's largest voting jurisdiction, the Registrar-Recorder/County Clerk has already announced plans to move to such an unverifiable system before the 2020 Presidential election, while (incorrectly) claiming that it produces a "verifiable paper ballot". BMD systems do not.

Proponents argue that touchscreen BMDs, which print out a computer-marked and barcoded "paper ballot" summary card of the voters vote, produce a "verifiable" record of the cast ballot. But, as Professor RICHARD DEMILLO of Georgia Tech and Verified Voting explains today, based on his recently published study, many voters (about half) do not bother to verify their computer-printed ballot summary cards before casting them to be tallied by a separate computer scanner. Of those who do, the study finds, they only glance at them for an average of 3.9 seconds before depositing them into the scanner (and that was during an election with some 18 races on the ballot!)

"Half of them don't look at the ballots at all," DeMillo tells me. "Those that do, give it by and large a cursory reading that wouldn't allow them to check it in any meaningful way."

Moreover, DeMillo's study finds, based on observation and testing at polling places earlier this year, most voters are unable to accurately verify --- just seconds after leaving the polling place --- whether an unvoted list of the races they just voted in accurately represents the races on the ballot they just cast! DeMillo --- a longtime computer security expert who formerly served as Hewlett-Packard's chief technology officer --- argues, the only way to ensure that ballots actually reflect the will of the voter is to use HAND-MARKED paper ballots, whether they are counted by hand or optical-scan systems.

"These are all problems we've created for ourselves" with some help from the private voting system vendors, he argues. "The only reason we're having this discussion is that someone decided that having an expensive pen to mark a ballot is more important than the transparency of the election process itself. As soon as you get rid of the Ballot Marking Devices, the universe goes back to normal, mathematics works out, we can conduct auditable elections in a much more verifiable way."

When I ask this longtime computer technologist and cryptography expert the best, most verifiable way to cast ballots, he answes directly: "Hand-marked paper ballots." His answer echoes that of longtime Livermore National Lab computer scientist and voting systems expert Dr. David Jefferson, who argued the same point during my interview with him in October.

Also today: What the federal court's questionable ruling in Texas on Friday finding the Affordable Care Act (Obamacare) unconstitutional, does (and doesn't) mean for all of us in 2019. The federal HealthCare.gov exchange's open enrollment period for 2019 ended over the weekend, but several states which run their own Obamacare markets, such as CA, CT, D.C., NY, MA, MN and RI, continue open enrollment through January.

Then, a thought or two from our own Desi Doyen on the long-overdue weekend announcement of the resignation of Trump's corrupt Interior Department Secretary Ryan Zinke.

On today's BradCast: Trump appears now to be in very big trouble. So do Republicans in North Carolina's 9th Congressional District. But President Obama's Affordable Care Act soldiers on, even as signups are down as the open enrollment period for 2019 on the federal HealthCare.gov exchange quietly nears its close on Saturday, December 15th.

On Wednesday, Donald Trump's former personal lawyer and 'fixer' Michael Cohen was sentenced to three years in prison and some $2 million in fines after cooperating with federal prosecutors following guilty pleas to several felonies in August. Special Counsel Robert Mueller's team noted that Cohen has been helpful in their probe of Trump's still-unexplained relationship with Russia, but it was the charges brought by federal prosecutors against Cohen in New York's Southern District related to hush-money payoffs to women with whom Trump was said to have had sexual affairs that most immediately appears to cook Trump's goose.

Both Cohen and the federal government now allege that Trump, in the waning days of the 2016 campaign, "directed" a conspiracy to pay off the women in order to buy their silence in an illicit scheme to "influence the election". Those payoffs of $130,000 to porn actress Stormy Daniels and $150,000 to Playboy model Karen McDougal (via National Enquirer publisher AMI) are considered illegal campaign contributions.

Also on Wednesday, prosecutors announced a non-prosecution agreement with AMI, run by longtime Trump pal David Pecker, in exchange for their cooperation in the case. As discussed on today's show, Trump now appears to be in very VERY big trouble, at this point. If the man who helped make the payoffs at Trump's "direction" --- who had also cooperated with investigators --- received three years in prison for his crimes, imagine what may happen to the man who actually directed the conspiracy.

While there are still a number of potential escape hatches such as the Presidential pardon power for Trump, his associates, his family members and his businesses, a new interview with incoming New York state Attorney General-elect Letitia James suggests she has that base covered as well. James says she intends to "use every area of the law to investigate President Trump and his business transactions and that of his family as well" at the state level, including "anyone" in his circle who may have violated state law. Trump's businesses and campaign are based in New York. James tells NBC she intends to bring state charges in an attempt to ensure Trump, his associates, his family and his various organizations are unable to evade accountability with Presidential pardons at the federal level.

In North Carolina, meanwhile, fresh revelations continue to emerge regarding the 9th Congressional District election which is at the center of an ongoing GOP absentee ballot election fraud scandal. New details in that matter today include the state Republican Party's admission that a new election will most likely be needed, following news this week that Early Voting results in Bladen County were reportedly leaked, illegally, in advance of the November 6th election.

Moreover, a new affidavit from a Republican now charges that McCrae Dowless, the GOP contractor hired by Republican Mark Harris to run his absentee ballot campaign in Bladen, where the fraud scheme appears centered, told him that he (unlawfully) had as many as 800 absentee ballots in his possession prior to the election. What came of those ballots we don't yet know, but Harris is said to have defeated Democrat Dan McCready by just 905 votes in the 9th District last month. At this point, I see no way that a new election in the district can be avoided, other than simply naming McCready the winner.

Also today, we're joined by ALICE OLLSTEIN, formerly of Talking Points Memo, now a congressional reporter at Politico, to discuss the nearly 10 percent drop off in signups this year for the Affordable Care Act (ObamaCare), as the federal open enrollment period comes to a close this weekend. "It's not high prices that are deterring people," Ollstein argues, citing a key piece of data to back that up, before explaining the several different reasons why signups are down this year so far, and how that may affect the future stability of the federal exchanges.

With Democrats set to take the majority in the U.S. House in January, Ollstein also details their dilemma in how to best defend against a federal lawsuit brought by several Republican-controlled states (and now supported by the Trump Administration) hoping to kill the landmark ACA and its vital protections for those with preexisting conditions...

On today's BradCast: The GOP's utter contempt for democracy and voters is now on full display in several states where things did not go well for the party during the November midterms, and nowhere more so than Wisconsin. [Audio link to show follows below.]

In states where Democratic candidates did well in last month's midterms, leading to a loss of control by Republican lawmakers, there is now a desperate and brazen scramble in lame duck legislative sessions to pass laws in hopes of robbing power from incoming Democrats before they can be seated. In Michigan, for example, where Dems won statewide races for Governor and Secretary of State and voters overwhelmingly adopted ballot initiatives to expand voting rights, GOPers are jamming through last-minute legislation to prevent the Election Day registration that voters had adopted.

In North Carolina, the Republican-controlled state legislature is ramming through a Photo ID restriction law before they lose their Super-Majority to override Democratic Governor Roy Cooper's vetoes. That action is particularly hypocritical as the state is in the midst of a massive absentee ballot election fraud scandal, apparently perpetrated by a GOP contractor and former felon hired by Republican Mark Harris in his race against Democrat Dan McCready for the U.S. House seat in the state's 9th district. Republicans claim that Photo ID voting restrictions at the polling place are necessary to prevent fraud --- of which there is little or none by voters --- even while calling for Harris to be certified by the state despite clear evidence of serious absentee ballot fraud on behalf of the Republican candidate. We've got more new details on that ongoing probe today, which has prevented Harris' reported win --- by just 905 votes out of more than 280,000 tallied --- from being certified by the state Board of Elections.

But it is Wisconsin today where the GOP is attempting perhaps the most audacious power grab in the nation this year. As Republican Gov. Scott Walker was voted out in November in favor of Democrat Tony Evers, the GOP is attempting to usurp the powers of the incoming Governor, along with Democratic Attorney General-elect Josh Kaul, on a litany of issues before they can be sworn in. The new provisions, never mentioned by Republicans during the campaign, were introduced suddenly in a massive 144-page bill unveiled late last Friday night in a special legislative lame duck session called before Walker is finally out.

Despite Democrats having won every statewide contest on the ballot in Wisconsin's 2018 midterms, Republicans were able to retain control of the wildly gerrymandered State Assembly. They received just 45 percent of the vote overall, but will nonetheless control 63 of 99 seats in the Assembly. This week, they are using that ill-gotten legislative muscle to swipe the incoming Governor and AG's powers. They hope to block the Democrats' campaign promises to expand healthcare and ease suppressive voting restrictions (which arguably resulted in enough voter disenfranchisement to narrowly give the state to Donald Trump in 2016). Republicans are also attempting to restrict early voting in 2020 in hopes of avoiding losses similar to those suffered by GOPers in 2018. The unprecedented Republican power grab has led to protests at the state capital in Madison this week of the type not seen since shortly after Walker took power in 2011 and immediately worked with the Republican legislature to strip collective bargaining rights from public union members.

We're joined today by OneWisconsinNow's ANALIESE EICHER --- a plaintiff in the 2016 federal case which struck down the WI GOP's previous attempt to curtail early voting --- to detail the outrageous and unprecedented #WIGOPPowerGrab being strong-armed through the state legislature tonight.

"What we're seeing here is the obliteration of the separation of powers," Eicher tells me. "We know that when Republicans don't like the results, they seek to change the rules and to change how things operate. With Democrats sweeping six statewide elections here in Wisconsin, the only option for the Republicans to maintain what they thought was their really, really great unilateral control of the State of Wisconsin is to make changes."

"We're seeing everything from limiting local governments' abilities to do work on their roads, limiting their abilities to pay a prevailing wage, changing the makeup and composition of boards and commissions in Wisconsin, so that the legislature has equal or more power than the Governor in regards to appointments. We're seeing change's to people's abilities to get healthcare and receive benefits," she says.

"We're seeing changes to the Attorney General's office, as to whether the Attorney General can leave a lawsuit or join a lawsuit," she explains, referring to Kaul's vow to remove WI from the federal lawsuit by several GOP-controlled states challenging the Constitutionality of ObamaCare and its protections for people with pre-existing conditions. "This extraordinary session bill severely limits his ability to essentially do what he campaigned on, and what people voted for him to do."

As one Democrat noted during hearings today in Madison, the action being taken by the legislature "will invalidate the results of the will of the people and shows direct contempt for the voters". But, of course, that is the whole idea, since Republicans now clearly hate democracy. Eicher argues Republicans "want to stay in power, no matter what the cost" and suggests "voters are not responding well to what's happening in this extraordinary session." She believes they will pay a price for this in 2020.

On today's BradCast: Even as final results are still being determined from this year's midterms, the Democratic Caucus in the U.S. House prepared for its new majority with leadership votes on Wednesday, including on Rep. Nancy Pelosi's bid to retake her previous role as Speaker of the House. Also, three weeks after the November 6th election and Tuesday's runoff for the U.S. Senate in Mississippi, more Houses races are called and one race, believed to have been won by a Republican, offers a new mystery in the state of North Carolina. In MS, Republican Sen. Cindy Hyde-Smith reportedly won Tuesday's runoff against Democrat Mike Espy, as expected, but by a far narrower margin than previously expected in the deep "red" state, after she made a number of disturbing, racialized comments throughout the campaign. Trump won the state by 18 points in 2016. Hyde-Smith won by eight points. A ten-point shift towards Democrats. Nonetheless, the GOP win in MS results in an overall pickup of 2 seats for Republicans in the U.S. Senate this January.

The U.S. House, however, is a very different story. Today, AP finally called the still-undecided contest in New York's 22nd Congressional District for Democrat Anthony Brindisi over incumbent (and very Trumpy) Republican Rep. Claudia Tenney. The Dem flip comes in another "red" district where Trump had won in 2016 by 16 points. That brings the Democratic Party's pickups to 39 among AP's "called" races, with one more contest leaning Dem in California and another leaning GOP in New York state.

But, in North Carolina, where all 13 U.S. House races were expected to be certified by a routine vote of the State Election Board on Tuesday, a Democratic member refused to do so, citing "unfortunate activities" in one part of the state's 9th Congressional District, where Republican Mark Harris is said to have defeated Democrat Dan McCready by just 905 votes. After a two-hour session behind closed doors, the Board finally voted unanimously to certify all but the 9th District race for now. We've got a number of details on what may be behind this wildly unusual and still-unfolding mystery, which seems to center on Bladen County, in the eastern part of the district.

"I’m very familiar with the unfortunate activities that have happened in my part of the state," Democratic SBE vice-chair Joshua Malcolm announced during the meeting before the Board went into closed session. "And I am not going to turn a blind eye to what took place to the best of my understanding, which has been ongoing for a number of years, and which has been repeatedly referred to the United States attorney and the district attorneys to clean up. Those things have not taken place."

We'll keep an eye on that one. But, with Democrats now likely to end up with at least a 40 member majority in the U.S. House after having officially won by the overall largest popular vote margin in history for any party, the battle over party leadership and direction played out today with a vote by the Democratic Caucus in favor of Nancy Pelosi to be their nominee for the next U.S. House Speaker. She reportedly received 32 votes against her, however, which would be more than enough to block her return to Speaker when the full House votes in January.

I'm joined today by progressive journalist, author and activist NORMAN SOLOMON of RootsAction.org to discuss the challenge to Pelosi --- largely by less progressive members of her own party --- and how progressives will need to pressure the Democratic Congressional leadership from the bottom up when they take control in January. Solomon, who helped pen both a Democratic "autopsy" after the disastrous 2016 election, and a follow-up to it just before the November midterms, explains today how both newly elected Democrats and the voters who put them there will need to step up over the next two years to support wildly popular progressive reforms on everything from the minimum wage to healthcare and tax policy, if mistakes made by Democrats (with some of the same leadership) in years past is to be avoided.

"It's all about constituent power," says Solomon. "At RootsAction.org we are dedicated to mobilizing to make sure that more and more progressive constituents make their senators and representatives fully aware that they are being watched closely, and there are such things as primary challenges."

He argues that "the party has changed partly" over these past two years, though "not profoundly." Where it has changed, where Dems have rejected unpopular corporatist establishment positions, "its been because of a lot of these on-the-ground progressives".

Still, Solomon warns against complacency. "When they get Democrats in charge, there's more of a tendency among a lot of progressives to think, 'Well, the worst is over. The emergency is gone.' In fact, whether it's climate change, or perpetual war, or the rich continuing to get richer, these problems are festering. Yes, worse under Republicans, but for us to sit back in any way and not continue to organize and pressure is to leave Congress to its natural setting. It's sort of 'The Call of the Corporate Wild' that they're immersed in," he tells me. "The only way to counter that is that we have to mobilize no matter who is in power, to fight back against Wall Street."

On today's BradCast: Nobody said it was going to be easy. But the fight to vote in next Tuesday's crucial midterms continues, and beyond the House and Senate, there may be some very good news for Democrats in dozens of currently GOP-controlled states. [Audio link to show follows below.]

But first up: More trouble at the polls today reported out of Texas, where voter intimidation is said to be higher than seen in decades; In Georgia, where voters are still trying to overcome suppression in absentee Vote-by-Mail voting in DeKalb County (suburbs east of Atlanta) and with failing, unverifiable voting machines at all polling places across the state; And in Illinois, where voters are also reportedly encountering failures on DuPage County's similarly unverifiable touchscreen voting systems in the Chicago suburbs.

Meanwhile, there's been a fair amount of coverage of high profile gubernatorial races with Democratic takeover chances in Florida and Georgia (where Oprah is now lending a hand), and in a number of the similarly tight U.S. Senate races that will determine partisan control of the upper chamber in Congress for the next two years. But there has been far less national coverage of several other gubernatorial contests around the country where Democrats are also in very close "Toss Up" contests to take control of dozens of executive mansions.

These races are crucial not only between now and the next Presidential Election, but could well determine control of the U.S. House over the next decade. That's right. The way voters vote on Tuesday, November 6, 2018, may well help determine who is in charge of the U.S. House beginning in 2022, once redistricting takes place around the country following the 2020 Census --- and then for another ten years thereafter!

While Dems hope to win a majority in the House next week, control of Governorships by Democrats in a number of key swing states could help add anywhere from 15 to 30 more winnable seats in the U.S. House over the next decade, according to experts.

Political reporter DYLAN SCOTT of Vox.com joins us to detail which states will be most important to that decennial reapportionment and why state Governors are so crucial to the process.

"Republicans won a lot of governor seats in 2010," he explains. "That gave them a lot of control over redistricting in 2011. And even though in 2012, 2014 and 2016, the Democrats actually won more votes for their House candidates across the country, the maps were drawn as such that Republicans were still able to hold a majority for all of the last decade. I think the stakes should be pretty clear to people after what we've seen with GOP control across the country over the last ten years," Scott argues. But are they? We discuss.

Also, Scott breaks down what appears to be a host of very good opportunities for Democrats in more than a dozen states beyond Florida and Georgia, currently controlled by GOP Governors, including Michigan, Wisconsin, Ohio, Iowa, Kansas, New Mexico, Maine, Alaska and even South Dakota! We cover a lot of ground on this today --- along with the politics and polling involved --- and much of it should be very encouraging for Democrats.

On today's BradCast: Some encouraging election news. More disturbing news about the Republican's "sham" rush rob to ram through another GOP activist onto the U.S. Supreme Court before they could lose their slim majority in the U.S. Senate. And the re-emergence of Barack Obama before the November midterms. [Audio link to show follows below.]

First up today, noteworthy reported results from Thursday's midterm primary elections in Delaware and some largely good election news elsewhere.

In Florida on Friday, a federal judge ordered 32 counties sued by a number of voting rights and Latino advocacy groups to immediately publish election materials in Spanish, in addition to English, in compliance with the Voting Rights Act. As we discussed with Demos' Senior Counsel Stuart Naifeh on a program last week, the groups had sued after the counties failed to comply with the VRA, despite some 50,000 U.S. citizens who were dislocated from Puerto Rico after Hurricane Maria having trouble re-registering and voting in the Sunshine State's "English only" counties. The judge's ruling, suffice to say, suggests he was VERY unhappy with the defendants in the case.

In Kansas, a Republican candidate for the state's House of Representatives has been arrested on election fraud charges. Notably, the Sec. of State Kris Kobach, a longtime GOP "voter fraud" fraudster and now the state's Republican nominee for Governor, had no comment on the arrest after having failed to bring the charges himself, despite convincing the state legislature to give him prosecutorial powers (the only SoS in the nation with such powers) and despite having made claims of a massive "voter fraud" epidemic central to his role as the state's chief election official.

Then, the week-long circus at the U.S. Senate Judiciary Committee's confirmation hearings for Donald Trump's U.S. Supreme Court nominee, former Republican activist turned D.C. Court of Appeals Judge Brett Kavanaugh, wrapped up on Friday, with still more late disclosure's about Kavanaugh's record while serving as an operative in the George W. Bush Whitehouse. The disclosures come from documents from during that period which Republicans had attempted to keep "confidential" from the American public.

Salon's political reporter AMANDA MARCOTTE, who's been reporting on the proceedings, joins us to discuss what we've learned --- and haven't --- about Kavanaugh and the Democrats' surprisingly united and aggressive attempt to block his confirmation. "The Senate Democrats came at this in a way that I don't think I've ever seen them do anything of this sort before. They had an organized strategy, and they executed it pretty well," she explains.

We focus specifically today on Kavanaugh's "threat to women's health and safety" with his disingenuous and misleading statements to the Committee (and to potential swing voting Republican Sens. Susan Collins and Lisa Murkowski) about Roe v. Wade's Constitutional right to an abortion as "settled law". Several lines of questioning from Sen. Kamala Harris (D-CA) this week, as well as so-called "committee confidential" documents released by Sen. Cory Booker (D-NJ) --- at threat of Senate expulsion --- underscore the con that both Republicans and the activist Judge Kavanaugh are attempting to pull off on the American public.

"If you were a space alien and you just dropped in to watch these hearings, you would get the impression that the Republicans think of Brett Kavanaugh as a liberal lion. All they do is talk about how anti-racist he is, how pro-equality. The cases that he's ruled on that they've highlighted were the three or four extremely rare ones where he sided with working people or oppressed people or people trying to get healthcare. The tiny minority of his cases. They barely go a minute without talking about how much he loves women, and he's practically a feminist," Marcotte says. "It's been kind of surreal, because obviously they don't believe a word of it, because if they actually thought he was any of the things they were presenting him as, they wouldn't have nominated him."

She charges Kavanaugh has been trying to "imply that he's going to uphold Roe", though "he clearly has no intention of doing it. That's why the leaked emails were such a big deal...These hearings should be understood as an elaborate theater to give Susan Collins and Lisa Murkowski cover while they vote, to claim that they're pro-choice while voting to overturn to Roe v. Wade."

We also take a few minutes to discuss Marcotte's recently published book, Troll Nation: How the Right Became Trump-Worshiping Monsters Set on Rat-F*cking Liberals, America, and Truth Itself --- not that she has particularly strong opinions on such things.

Finally, after another tough week --- almost a year and a half of them, in fact --- former President Barack Obama reemerged on Friday with a speech at the University of Illinois that unloaded on Trump as, among other things, "a symptom, not the cause" of our current woes. More importantly, he offered some advice and inspiration regarding the necessity of voting in this November's midterms and elections beyond them.
