Please pardon the whiplash on today's BradCast, from our special coverage of the blockbuster J6 hearing in the U.S. House yesterday to coverage of election results in eight states today, and what they both may mean for November. But that's our world right now. [Audio link to full show is posted after this summary below.]

Critical midterm primary elections (and runoffs), and one Special Election for the U.S. House were held on Tuesday in Illinois, Colorado, Oklahoma, Utah, New York, Mississippi, South Carolina and Nebraska.

We've learned of a few reported problems for voters at the poll yesterday in several of those states (IL, MS, UT, NY) which we cover first today. Thankfully, they were fairly limited --- at least so far --- and not terribly egregious.

Then it's on to our curated and wholly incomplete coverage of noteworthy races in a number of those states, some of which may be quite telling regarding November and the so-called "Conventional Wisdom" that Democrats are due for a drubbing. That's what history tells us, of course, about the party in power for midterm elections during the first term of an unpopular President. But, given these exceedingly unconventional times, it'd be a sucker's bet and political malpractice --- for Democrats and democracy itself --- to simply presume history will repeat itself this fall.

Among the many results of note covered today: losses for 2020 election deniers and alleged criminals (like Tina Peters, the indicted County Clerk in Mesa County who lost her GOP primary for Sec. of State bigly, even in her own home county) in CO; losses for corrupt climate change deniers and disgraced former Trump officials (like his scandal-plagued EPA Administrator, Scott Pruitt who came in fifth in a GOP primary for the U.S. Senate) in OK; both wins and losses for loyalist Trumpers and anti-choice zealots in IL and CO (with Dems hoping they'd win their GOP nominations, because they'd be easier to defeat in November); a crushing, if satisfying loss for Rudy Giuliani's son in NY; victories and losses for progressive candidates in several states; And, perhaps most notably today, some telling results from the one D vs. R race on Tuesday, a U.S. House Special Election in NE.

As expected, the Democrat lost that special U.S. House race in NE in an exceedingly Republican district in which the GOP candidate won by 22 points in 2020. But on Tuesday, the Republican won by just over 5 points. More interestingly, in the one Democratic-leaning County in the District held by Republicans since 1964, support for the Democrat spiked from +1 in 2020 to +13 on Tuesday, in the first head-to-head election between the two parties since 'Roe v. Wade' was struck down by the radical rightwing U.S. Supreme Court on Friday. Hopefully, Democrats have taken notice.

There are many mitigating factors that could result in this year's midterms defying history and expert predictions. That doesn't mean they will, but they certainly could, particularly if Democrats figure out how to appropriately activate both their base and those who are furious about SCOTUS stripping away a Constitutionally-protected individual right for the first time in our nation's history.

Initial polling in the wake of Roe's demise find the SCOTUS opinion to be exceedingly unpopular with Democrats, of course, but also with independent voters and even a fairly large chunk of Republicans. We take a look at some of those very interesting tea leaves on today's program and what they could mean for November.

Finally, we close with Desi Doyen and our latest Green News Report, in advance of what is probably very bad news indeed for both the climate and the EPA coming from our corrupt Supreme Court tomorrow! But, for today, we've got news about what sparked New Mexico's largest-ever wildfire; Japan's electric grid facing stress under historic record heat; a new leftist climate hawk President for Colombia; and much more....

With the bipartisan January 6 Committee having postponed today's hearing, we take the opportunity on today's BradCast to spend some time rebutting the disgraced former President's supposed rebuttal to the two damning hearings held to date. But, of course, we've got much more as well, including election results from Tuesday and evidence of both voting system problems and bad faith elected MAGA officials already trying to disenfranchise 2022 voters. Among the stories covered on today's program...

• An error caused by paper jams during ballot scanning on Election Day at the precincts on the state's computer tabulators in Iowa during their June 7 primaries has reportedly resulted in a whole bunch of recounts across the state. Cedar Rapid's KCRG cites an email from the Sec. of State's office which has lead to those recounts, in hopes of reconciling the number of ballots misreported by the scanners as cast with the number of voters who actually signed in to vote.

• Noteworthy election results from four states which held primaries on Tuesday (Maine, Nevada, North Dakota and South Carolina) and one (Texas) which purposely held a low-turnout U.S. Special Election yesterday, instead of at the same time as their regular primaries in March or primary runoffs in May. While we cover a lot of Tuesday's races, and why they matter (or don't), the most disturbing one is likely the Secretary of State's race in Nevada, where a 2020 election denialist by the name of Jim Marchant has apparently won a 38% plurality to become the GOP's nominee to become the critical swing-state's chief election official in advance of the 2024 election.

• The dangers of an election denier like Marchant, who served as one of the state GOP's fake electors in 2020, and who has said he wouldn't have certified Joe Biden's victory over Donald Trump that year had he been SoS at the time, is a stark warning of what lies ahead. But we're already seeing the dangers of brain-poisoned MAGA Mobsters in positions of elected authority. The three-person County Commission in a very right-leaning rural county in New Mexico, is refusing to certify results from their June 7 primary. Even though votes are cast on hand-marked paper ballots across the state, the County Commission unanimously voted against certification of primary results, citing distrust of the County's digital ballot scanners made by Dominion Voting. They have no evidence of fraud, which might otherwise allow a court to order the hand-count they are seeking. They just don't trust the results in the County where Trump won 62% of the vote in 2020. The Republican County Clerk is furious and the Democratic Sec. of State is now suing the County Commission ahead of this Friday's deadline for County certification. Expect much more of this in the months and years ahead. We've long warned about exactly this type of fallout from our irresponsible rush to the use secret vote casting and counting systems made by private vendors and the avenues it opens for opportunists to claim fraud without any evidence of same.

• On Monday night, after the bipartisan U.S. House Select Committee investigating the January 6, 2021 attack on the Capitol and other efforts by Trump to steal the 2020 election, our corrupt former President issued a 12-page rebuttal [PDF] to the Committee's first two hearings. We rebut his dumb rebuttal today. It leans heavily on tired, long-ago debunked nonsense, such as his lead in some swing-states on Election Night "inexplicably" disappearing (after heavily-Republican polling place ballots were quickly tallied before the arduous task of opening and verifying and counting heavily-Democratic vote-by-mail ballots one-by-one) and how thousands attended his rallies, while Biden chose not to hold super-spreader events during the worst pandemic in 100 years. Much of Trump's (ghost-writer's) claims were already debunked during the Committee hearings to date, which he seems to presume that his supporters didn't watch or are too dumb to understand.

  Trump's ghost-writer spends most of the rebuttal ink citing what is laughably described as "indisputable proof" of "Ballot Trafficking" presented in the repeatedly debunked 2000 Mules movie. That's a pretend documentary film created by a long-discredited GOP "election integrity" group named True the Vote and a rightwing activist named Dinesh D'Souza who actually pleaded guilty himself to several federal election fraud crimes before he was later pardoned by Trump.

  As noted, the film has been repeatedly debunked, including by us, several times by now. Months before it was even released, the Georgia Bureau of Investigations (GBI) and FBI concluded the group's claims about cell phone data purporting to reveal evidence of "ballot harvesting" by "mules" of tens or hundreds of thousands of fraudulent ballots cast in drop-boxes, in fact, reveals no crimes at all. A GA state Board of Elections investigation after the movie's release found that supposed "ballot mules" in Atlanta, shown via security camera footage in the film, were just regular voters legally casting their own ballot and those of direct family members. None of the "mules" are ever seen in the film visiting a drop-box or multiple boxes more than once.

  But, perhaps the most stinging rebuttal came from Trump's own Attorney General, Bill Barr this week. During sworn testimony to the J6 Committee, shared by the panel on Monday, Barr laughed out loud at even the mention of the name of the film, before going on to explain how he found it to be "singularly unimpressive," "indefensible," and that it failed to "establish widespread illegal harvesting." That, of course, is a long way from the "indisputable proof" Trump's dumb rebuttal claimed it to be.

• Finally, speaking of the House J6 Committee, Republican Vice Chair Liz Cheney released a video teaser on Tuesday for its next upcoming hearing scheduled for Thursday. This one will focus on the pressure Trump placed on Vice President Mike Pence to help him steal the 2020 election by tossing out valid Electoral College votes on January 6, 2021. Cheney's teaser video includes testimony from one of Trump's top White House attorneys who says he warned outside lawyer John Eastman, who developed the scheme for Pence to toss out the votes, to "get a great f'ing criminal defense lawyer," adding "you're gonna need it."

We've got yet another jam-packed BradCast for ya today, with results of note --- as we have them so far --- from the 7 states which held primaries on Tuesday. Then, we're joined by our guest with some helpful insight on what Democrats and progressives should learn from this year's elections to date and some of his critical concerns about the upcoming hearings by the bipartisan U.S. House Select Committee investigating January 6, 2021 insurrection. First, we fly through an extremely curated selection of results from several key races on Tuesday. Among them...

• IOWA: Retired Navy Admiral Mike Franken upset former U.S. Rep. Abby Finkenauer in the state's Democratic U.S. Senate primary. He will face off against 88-year old, six-term U.S. Senator Chuck Grassley. Also noteworthy in the Hawkeye State: progressive Democratic criminal justice reformer Kimberly Graham won the Democratic primary for prosecutor in Polk County (Des Moines), where she is likely to win this November.
• MISSISSIPPI: Two-term Republican Rep. Michael Guest was forced into a runoff by GOP voters as punishment for having voted in favor of a bipartisan, outside Commission to investigative the January 6th insurrection.
• MONTANA: Donald Trump's disgraced, scandal-plagued, forced-to-resign Interior Secretary Ryan Zinke is locked in a tight race to win his old job back as a U.S. Congressman. The final results of the close race with state Sen. Al Olszewski, which Zinke leads by about 1,000 votes as of airtime, will be held up by a day or two due to a ballot printing error that will require, under state law, that all ballots now be hand-counted.
• NEW JERSEY: While there may have been races of note there, we didn't have time for ANY of them today! Sorry about that, NJ! (I know. Always the bridesmaid...)
• NEW MEXICO: Seasoned TV weather guy Mark Ronchetti won the GOP primary for Governor after promising to increase the state's already record oil production, deriding new standards in state schools for increased instruction on race (in a state that is half Hispanic and has 23 federally recognized Native American tribes and nations), and by slamming his November opponent, Democratic Gov. Michelle Luhan Grisham, for closing in-person schooling during the worst pandemic in 100 years. Also: Progressive Democrat Gabriel Vasquez was victorious in the 2nd Congressional District race to take on GOP Rep. Yvette Herrell in what is seen by Dems as a possible House pickup this November.
• SOUTH DAKOTA: The state's only House Member, Republican Dusty Johnson, easily won his primary despite voting to certify the 2020 election results and in favor of the January 6 Commission. Shamefully, there is no Democrat running for the state's single At Large Congressional seat. Of greater note, a ballot proposition that would have raised the threshold for passage of certain future ballot propositions to 60% was soundly rejected by voters. That proposition was meant to make it harder to pass a ballot proposition this November that would expand Medicaid under ObamaCare to state residents. Similar expansions measures have been adopted by voter initiatives in about 7 other states. GOP lawmakers in SD must really hate their own constituents.
• CALIFORNIA: All statewide office holders are Dems, so there isn't much drama there. But two local contests have received quite a bit of national notice. The Los Angeles Mayoral race will go to a runoff, after Trumpy Republican real estate billionaire turned "Democrat" Rick Caruso failed to clear the 50% bar, despite dropping some $40 million of his own money into the race. He'll face progressive Rep. Karen Bass, previously seen as the favorite to win until Caruso and his money showed up, in the November runoff. But, interestingly, receiving as much or more notice from national corporate news outlets than almost any other race on Tuesday, voters recalled progressive criminal justice reformer, Chesa Boudin, after two and half years as San Francisco's District Attorney. Predictably, national media is (mis)reporting this as a story of "failed progressive policies" that resulted in rampant crime in the city, despite the fact that overall crime decreased during Boudin's tenure.

We're then joined by longtime progressive champion, journalist, and author JOHN NICHOLS of The Nation for analysis of Tuesday's contests --- and those from week's past --- along with his concerns and warnings about the upcoming January 6 hearings in the House.

As to the primaries so far this season, Nichols observes, among other things that while "Republican turnout is very spiked" and Dems "not so spiked", that is "not necessarily a complete disaster" for Democrats. He also notes that "progressives are winning a lot of Democratic primaries" and "in some unexpected and really interesting places".

"Despite what a lot of the pundits will tell you," he argues, means that "the grassroots Democratic voters seem to be sending a very clear signal that they want to go up against these Trump Republicans in this very tough year with clearly defined progressive candidates."

While he offers thoughts on the recall defeat of progressive District Attorney Boudin in San Francisco, Nichols also observes that criminal justice reformers are actually still winning elections in many other places around California and elsewhere. (See, for example, a progressive criminal justice reformer victories in neighboring counties to San Francisco and Kim Reynolds in Des Moines, IA, as mentioned above, as just two such examples.)

Then, it's on to the upcoming January 6 hearings, where Nichols has both advice and concerns, particularly about what the Committee will ultimately offer in their critical recommendations. His greatest concerns seem to center on what Democrats are willing to compromise on in order to find unanimity with the Committee's anti-Trump, but still hard-right Republican Vice Chair Liz Cheney.

Among Nichols' top hopes for the Committee: Recommendations that Congress adopt a resolution that bars insurrectionists like Donald Trump from office, as per Section 3 of the U.S. Constitution's 14th Amendment; and (in what will clearly be a much heavier lift for the Committee's Republicans like Cheney), a call to abolish the Electoral College.

But will the hearings ultimately make any difference to a divided nation, with so many already having hardened their positions on Trump and his attempt to steal the 2020 election? We've got a whole lot to discuss with Nichols today, so I hope you'll tune in!...

I guess I'll have to keep saying it damn near every day on The BradCast between now and November (and probably for the next two years thereafter, at this rate), but anyone who tells you they know what's gonna happen in his year's elections, is just making it up outta whole cloth. Everything is changing every single day and all of it is going to effect what happens next. [Audio link to full show follows below.]

For example, before we get to our guest today, some quick news on the fallout from the stolen and packed U.S. Supreme Court's likely plan to overturn 50 years of freedom for American women's healthcare by overturning the Constitutional right to an abortion established in 1973's Roe v. Wade.

The news has been so alarming to so many that even Sen. Bob Casey (D-PA), a long time "pro-lifer", now says he plans to vote for the Women's Health Protection Act in the Senate this week to codify abortion rights into federal law. At the same time, new polling taken last week, after the leak of Alito's draft majority opinion that would overturn 'Roe', finds both good and suggestively helpful news for Democratic candidates paying attention.

The poll from Yahoo News/YouGov finds, once again, that a large majority of Americans do not want Roe overturned. More importantly, for democracy itself, voters in the survey support a generic Democratic over a generic Republican on their Congressional ballots by a 5-point margin (44% to 39%). But here's where the polling is really enlightening: "[W]hen voters were asked to choose instead between a 'pro-choice Democrat' and a 'pro-life Republican,' GOP support fell to 31% while Democratic support held steady --- more than doubling the gap between the two candidates, to 13 percentage points."

Got that, Dems?

That's just one of too many wildcards between now and November that make any sort of punditry largely useless. Another one? Well, Donald Trump's former Sec. of Defense Mark Esper was on Fox "News" this week confirming to Brett Baier that, yes, given the events of January 6th, 2021 and some other stuff, he believes "Donald Trump was a threat to democracy." Ouch.

Speaking of the January 6 insurrection and threats to American democracy, we're joined once again today by Constitutional law expert JOHN BONIFAZ, President and co-founder of Free Speech for People (FSFP), the non-profit, non-partisan good governance group helping voters to challenge the eligibility for reelection of elected officials who have "engaged insurrection" in violation of the Constitution's "Insurrectionist Disqualification Clause" (14th Amendment, Section 3).

Bonifaz was with us several weeks ago following the sworn testimony of challenged Georgia Republican Rep. Marjorie Taylor Greene, who hedged and/or lied and/or "can't recalled" her way through questioning before an Administrative Law Judge in Atlanta. Greene claimed she couldn't remember whether she suggested that Trump invoke Martial Law (she did), whether she said Nancy Pelosi was "a traitor to the country" (she did, and admitted as much after it was clear that FSFP's attorneys questioning her had the video evidence), or that she even opposed the peaceful transfer of power on January 6th (yup, she did that on video too.)

On Friday, the state Administration Law Judge who oversaw the hearing, Charles Beaudrot, released his decision in the case, recommending that GA's Republican Sec. of State Brad Raffensperger not disqualify Greene from the ballot for lack of evidence from the challengers. But Beaudrot's 19-page decision [PDF] --- and Raffensperger's subsequent rubber stamp [PDF] --- "betrays the fundamental purpose of the Fourteenth Amendment’s Insurrectionist Disqualification Clause and gives a pass to political violence as a tool for disrupting and overturning free and fair elections," said FSFP in response. Bonifaz, today, describes major legal errors that he says must be reversed.

For example, Beaudrot completely ignored the evidence of text messages Greene sent to Trump's then Chief of Staff Mark Meadows on invoking Martial Law and Greene's own video on social media declaring, "you can't allow it to just transfer power peacefully, the way Joe Biden wants, and allow him to become our President."

Beaudrot "treats her as a credible witness," in his decision, charges Bonifaz, with "nothing about her as a witness who is not credible on the stand under oath, saying she couldn't remember, couldn't recall more than 80 times. Then you add that to the fact that days after her testimony, the revelation of the text she sent to Mark Meadows, where she did in fact advocate that Trump impose martial law to stay in power."

On top of that, he explains, the Judge also offers yet another reason to appeal. "The Georgia Supreme Court stated that, under Georgia law, 'The entire burden is placed upon the candidate to affirmatively establish their eligibility for office.' That's what the law is. [But] days before this hearing began, [Beaudrot] shifted the standard --- he reversed the burden of proof, and said it was not going to be on the candidate, it was going to be on challengers, contrary to that Supreme Court ruling."

FSFP is appealing the decision on behalf of the voter challengers they represent in GA's 14th Congressional District to Fulton County (Atlanta) Superior Court. "That's going to be before one judge. If we prevail, I'm sure Greene's attorneys will appeal to the state supreme court." Bonifaz says they plan to make every challenge possible through both the primary and general election, if necessary.

"We are not, on our end, giving up in any way," he vows. "The evidence is overwhelming that Marjorie Taylor-Greene engaged in insurrection, that she's disqualified, and our clients want us to proceed --- the voters in her district who are courageous to stand up on this --- they have been done an injustice by Judge Beaudrot."

The Greene case in GA is not the only challenge to alleged insurrectionist candidates for office. FSFP also challenged the eligibility of Rep. Madison Cawthorn in North Carolina, where a federal Appeals Court judge was seemingly stunned last week by his defense attorney's claim at their hearing that, yes, a 12-year old could run for Congress and nobody in the state could challenge that Constitutional deficiency, that it would be solely up to Congress to determine who is eligible to be seated as a member. A ruling from that 3-judge appellate panel is due soon.

And in Arizona, where the indefatigable FSFP is representing voters challenging the candidacies of Reps. Paul Gosar and Andy Biggs, along with AZ State Rep. Mark Finchem, the Trump-endorsed Republican running for Sec. of State this year, the state Supreme Court on Monday denied the right for voters to challenge candidates at all based on the Insurrection Disqualification Clause. They determined [PDF] that "no private right of action exists under the United States Constitution or Arizona law" to challenge candidates under the 14th Amendment and that "the Constitution reserves the determination of the qualifications of members of Congress exclusively to the U.S. House of Representatives."

Bonifaz disagrees, but concedes the group is out of court options in the state. However, he explains, the Secretary of State has the final word on ballot eligibility. In this case, that would be Democrat Katie Hobbs, who they've asked to disqualify the candidates. While that might otherwise be encouraging news, it should be noted that Hobbs is also on the ballot this year running for Governor. On Friday, U.S. District Court Judge Robert L. Pitman is scheduled to hear oral arguments on Texas' new anti-abortion law, S.B. 8 in the federal government's Emergency Motion for a Temporary Restraining Order or Preliminary Injunction [PDF]. He is likely to rule in favor of the federal government.

If granted, the ruling by Judge Pitman, an Obama appointee, would temporarily prevent enforcement of the new Texas statute banning pre-viability abortions performed on or after 6 weeks of pregnancy, before many women even know they are pregnant. That preliminary injunction would, for now, restore the status quo ante --- the state of the law in Texas prior to Sept. 1, 2021, when S.B. 8 first went into effect.

Unless overturned on appeal, the preliminary injunction would then remain in effect pending a final decision on the legal issues raised by the U.S. Department of Justice (DOJ) in the federal Complaint it filed in United States v. Texas.

The issuance of a temporary injunction by Judge Pitman would not be inconsistent with the U.S. Supreme Court's recent 5-4 rejection of a private medical provider's similar request for an injunction in Whole Woman's Health v. Jackson, the initial federal challenge to the Lone Star State's new law.

As the DOJ argues in its filing, no one, not even Texas, contends that S.B. 8's pre-viability abortion ban --- one that also contains no exception for unwanted pregnancies due to rape or incest --- is Constitutional under existing federal law. To the contrary, even in the first case, Whole Women's Health, the right-wing Supreme Court majority conceded the medical provider plaintiff "raised serious questions regarding the constitutionality of the Texas law at issue".

The core problem which prevented the issuance of an injunction in the initial case arose from "uncertainties" both as to federal court jurisdiction and whether any of the named defendants in that case could lawfully be the subject of a federal court injunction.

Those "uncertainties" arose because S.B. 8 was specifically designed to prevent challenges to its constitutionality in federal courts. The statute was crafted to prevent the Executive Branch of state government from enforcing the 6-week abortion ban. Instead, according to the DOJ's Complaint, S.B. 8 "deputized ordinary citizens to serve as bounty hunters who are statutorily authorized to recover $10,000 per claim from individuals who facilitate a woman's exercise of her constitutional rights."

In Whole Woman's Health, a legal concept known as State sovereign immunity prevented the plaintiff from naming Texas as a defendant. Because the statute prevents enforcement of the Act by members of the state's Executive Branch, the private medical provider was unable to seek an injunction against anyone working for that branch of the Lone Star State. There's legal uncertainty as to whether the State court judge, who was a named defendant in the case, could be enjoined by a federal court. The only potential private "bounty hunter" named in the medical provider's complaint filed an affidavit with the U.S. Supreme Court, asserting he had no present intent to file an S.B. 8 enforcement lawsuit.

The Supreme Court's "shadow docket" majority decision held that those "uncertainties" warranted a denial of the private medical provider's request for injunctive relief in Whole Women's Health. However, that same majority expressly noted their decision "in no way limits other procedurally proper challenges to the Texas law."

Texas cannot assert sovereign immunity when it is directly sued by the federal government in a case that alleges a State enactment violates the sovereignty of the United States. Thus, the DOJ's case, United States v. Texas, is a "procedurally proper" challenge...

We continue to do all that we can on The BradCast to sound the alarm about the perilous state of democracy in the U.S. right now, as Republicans around the country work to pass laws to make it harder for Democrats to vote and to allow Republicans to outright reverse election results if Plan A doesn't work. [Audio link to full show is posted below this summary.]

The heroic Democratic Texas state law makers who walked out of the state's House of Representatives at the end of the legislative session over the weekend to prevent a quorum from passing a sweeping new GOP voter suppression bill, as detailed on yesterday's show, are begging lawmakers in Congress for a "national response" to protect voting rights. They can only hold off the suppression for so long in the Lone Star State, as other GOP-controlled states do the same, as Democrats in Congress are crippled by archaic institutional processes like the filibuster.

The situation has become dangerous enough that 100 academic democracy scholars on Tuesday issued a "Statement of Concern" about Republican "initiatives" around the country which the group describe as "transforming...states into political systems that no longer meet the minimum conditions for free and fair elections," leaving "our entire democracy...now at risk." One of those scholars joins us today to discuss those concerns, what can be done about them, and whether or not the American public and Democrats in Congress truly appreciate the dire state that the usually staid academics are now trying to sounds their own alarm about.

But, first, in some other democracy-related news today, the Federal Elections Commission announced they are fining American Media Inc., parent company of the National Enquirer, $187,500 for its role in the hush-money payments made to Playboy model Karen McDougal before the 2016 election. The payments, like those made to adult film actress Stormy Daniels, were meant to keep the women quiet about sexual affairs each say they had with Donald Trump.

The FEC fine is for the unlawful, unreported "in-kind contribution" to Trump's campaign, meant to "suppress" McDougal's story and "prevent" it from influencing the election, according to the settlement between the FEC and AMI. So, AMI has now been fined and Trump's personal lawyer, Michael Cohen, was sentenced to prison for his part in what both he and the Dept. of Justice described as a "conspiracy" that was "directed" by Trump. So far, however, the disgraced former President who orchestrated the entire scheme has yet to be held accountable for it. The DoJ has until August to do so, before the statute of limitations on Trump's crime runs out.

In other less-criminal democracy news today, New Mexico's Democratic state Rep. Melanie Stansbury won a special election for the U.S. House on Tuesday in a "landslide victory" against her oil and gas industry supporting Republican opponent. The election was to fill the seat vacated by Rep. Deb Haaland, Joe Biden's new Interior Department chief. Republicans were hoping that the margin, even if they lost in a very Democratic-leaning jurisdiction, would be an encouraging bellwether in advance of the 2022 mid-terms. It didn't work out that way. While Biden won NM's 1st Congressional District in 2020 by 23 points and Haaland won her seat that same year by 16 points, Stansbury reportedly trounced Republican Mark Moores on Tuesday by nearly 25 points! If the race was a bellwether, it will be seen as very good one indeed for Democrats today.

Then we're joined by author, columnist and Roosevelt University political scientist DAVID FARIS, a longtime friend of the show and one of the scholars who signed on to that previously mentioned "Statement of Concern" about American democracy, in which the group pleads for action at the federal level to save democracy, including passage of election reform and safeguards such as the John Lewis Voting Rights Advancement Act and the For the People Act.

Our conversation with Faris comes the day after President Biden, in Tulsa on Tuesday, called for "a month of action on Capitol Hill", calling out (if not by name), "two Senators" who are blocking critical election and campaign finance reform by refusing to reform the filibuster to allow passage of the sweeping Democratic bills that the scholars, the Texas lawmakers, and many others across the nation are begging for in advance of 2022. Those two Senators, of course, are West Virginia's Joe Manchin and Arizona's Kyrsten Sinema, Democrats who are still refusing to reform the filibuster to allow passage of the election protection bills.

"My fear is that Democrats are going to lose the House and the Senate next year," Faris tells me, "which in and of itself is not the end of the world. But there's another catastrophe galloping towards us, which is this Republican plot to steal the 2024 election, with a newer, better, more invigorated version of Trump's sloppy plot to do it in 2020. The worst-case scenario here is Democrats lose Congress next year, they lose a bunch of critical governorships in the battleground states, and Secretary of State races [and] we have a very similar result in 2024 --- that is, close outcomes in the tipping point states in the Electoral College. And then Republican legislatures and Governors in Michigan, Wisconsin, Pennsylvania, Arizona, Georgia, who knows where else, simply send Republican electors to Congress instead of whoever was chosen by the voters themselves."

That, he explains, is what Republicans in those states are currently angling for, including with the passage of state laws to make all of it easier. If GOP state lawmakers are elected with a minority of votes thanks to gerrymandering (which would be prevented by the For the People Act), who then select slates of Presidential Electors that a minority of voters voted for, and federal laws to prevent that are blocked by a House and Senate with GOP legislators also elected by a minority of voters to install a President who received a minority of the vote, under laws approved by a U.S. Supreme Court with a GOP majority stolen and packed by both a Senate and President who received a minority of votes, it would be "a world-historical catastrophe for American democracy." Nonetheless, Faris and the others now very much see that as a possibility.

"We've graduated from routine Republican voter suppression and election interference, sort of low-level election theft, to what I think of as a more integrated plot to install their preferred candidate in 2024." It's something that Faris --- and his fellow scholars --- are now "increasingly worried about."

"I do think there is a sense among a majority of the Democratic caucuses in both chambers of Congress that reforms are important," he concedes. "I think that that they know that Republicans are up to no good. What I don't think they understand is that it is an existential problem at this point --- that we may have only one or two elections left before Republicans do so much damage to the institutions of democracy, or they do something so outrageous that it could lead to some kind of violent, or maybe non-violent, crackup of the country, which is what I'm most concerned about."

What, if anything can be done about it? Do Manchin and Sinema really care? Are Joe Biden and the Democrats doing all that they can to change what now appears to be a grim outlook for the chances of real reform? And, if that reform miraculously somehow happens, will it be enough to actually prevent the worst-case scenarios that Faris and his scholarly colleagues are now so alarmed about?

Even if several multi-state legal challenges result in a federal court order directing Postmaster General Louis DeJoy to repair the damage wrought by his allegedly "illegal" sabotage of the U.S. Postal Service's mail delivery capabilities, absent significant additional funds, it's unlikely DeJoy could fully comply with that order.

The facts laid out in one of the recently filed cases and echoed in the others, along with subsequent developments, suggest that DeJoy was, at best, disingenuous when, in an August 18 formal statement [PDF], he claimed he was "suspending" his nationwide mail sorting, labeling and delivery changes until after the Nov. 3 Presidential Election.

The complaint describes how, pursuant to an Equipment Reduction Plan [PDF], Defendants removed, dismantled and/or destroyed 671 high-speed sorting and labeling machines that had a combined hundreds of millions of dollars in value. As a result, the States allege, "some major cities have already had their ability to sort mail reduced by hundreds of thousands of pieces of mail per hour." (Emphasis in original text).

On the same day that DeJoy issued his "suspension" statement, emails were submitted by Kevin Couch, the USPS Director of Maintenance Operations, informing Maintenance Managers that, irrespective of instructions from their plant managers, they must not reconnect or reinstall sorting machines that had previously been disconnected absent approval from USPS HQ.

Last Friday, while testifying before the U.S. Senate, DeJoy made it clear that he has "has no intention" of reinstalling the sorting machines, even as he claimed that election related mail would receive top priority from the Postal Service. Contrary to DeJoy's rosy predictions, however, the USPS's own Service Performance memo reflects a significant drop in overall performance which precipitated a USPS warning to 46 states that their deadlines for Vote-by-Mail ballots "might impede the timely delivery of mail-in ballots, possibly disenfranchising millions of voters"

While there's ample reason for a court to order reinstallation, absent significant additional USPS funding, which Trump opposes, it is doubtful that DeJoy could fully undo the damage even if he were ordered to do so.

VOTERS BEWARE: Do not be lulled into a false sense of security by DeJoy's "suspension" of changes at the USPS until after Election Day, or by his unsupported assurance that USPS can timely process and deliver every ballot. The wiser course, as laid out in our previously related article, is to deposit your mail-in ballots in secure, state-supplied drop-boxes (where available) or at designated drop-off locations. Check your local jurisdictions to learn what options may be available where you live. In some jurisdictions, voters can deposit their mail-in ballots at the polls either during early voting or on Election Day. In some jurisdictions, voters can link to election official websites to track the processing of their own ballots as well...

On today's BradCast: Five arrests and a massive, $61 million criminal bribery scheme allegedly headed up by Ohio's Republican House Speaker in cahoots with GOP lobbyists and dirty energy company payouts help explain, yet again, why we can't have nice things. That's especially true for residents of the Buckeye State who keep electing Republican officials who play them for chumps, take all their money, and make them sick in the bargain. It's also true for Floridians, Georgians, Texans and now Missourians, but we'll get there as well today. [Audio link to show follows below.]

"We're here today to announce the arrest of Larry Householder, the speaker of the House of the state of Ohio and four other defendants for racketeering in relation to what is likely the largest bribery, money laundering scheme every perpetrated against the people of the state of Ohio," announced U.S. Attorney David DeVillers during a news conference in Columbus on Tuesday afternoon. "The conspiracy was to pass and maintain a $1.5 billion bailout in return for $61 million in dark money that was used for various things. One: to line the pockets of defendants. Two: to build a power base for Larry Householder. And three: to further the conspiracy. That is to further the affairs of this Enterprise."

The explosive story is rocking Ohio today, though many should have seen it coming. A year ago, in July of 2019, Vox's longtime energy and climate reporter David Roberts wrote a must-read deep-dive article on the passage of House Bill 6 (HB 6) --- the legislation at the center of this massive con --- describing it at the time as "the most counterproductive and corrupt piece of state energy legislation I can recall in all my time covering this stuff."

The measure forced Ohio's ratepayers to subsidize bailouts of two supposedly failing nuclear plants (the Davis-Besse plant near Oak Harbor and the Perry plant east of Cleveland) owned by FirstEnergy and two failing coal plants owned by the Ohio Valley Electric Corporation (a collective owned by several large utilities), while wiping out previously successful state incentives for renewable energy and efficiency projects that saved the state's ratepayers both money and lives.

"Despite a tsunami of dark money supporting the bill," Roberts reported last year, "HB 6 was overwhelmingly opposed by ratepayer groups, business groups, free market conservative groups, environmental groups, and Ohioans generally. Its only support came from its only beneficiaries: the utilities that own the bailed-out plants, the employees of the bailed-out plants, the communities where the bailed-out plants are located, and possibly President Trump, who doesn't want to see coal plants closing during his reelection campaign."

Well, apparently there were a few more "beneficiaries": Ohio's House Speaker Householder and his political allies inside and out of the state legislature. That "tsunami of dark money", as it turns out, was used to blanket the airwaves with propaganda in support of HB 6 --- describing it misleadingly as a fight for jobs and "clean energy" in a battle between "Big Oil and Ohio" --- by a group calling itself Generation Now. That dark money group, as it turns out, was run by Householder himself with "bags of cash" from the nuke plants' supposedly bankrupt owners, FirstEnergy of Ohio. According to today's criminal complaint [PDF], his "Enterprise" used a series of unregulated passthroughs to move millions and "freely spent the bribe payments to further the Enterprise's political interests and to enrich themselves" with "unlimited" funds that came in to Generation Now from FirstEnergy in payments described by one of the defendants as "Monopoly money."

Despite the wildly unpopular HB 6's narrow passage in the state legislature, Republican Gov. Mike DeWine signed it quickly after passage. He was not indicted today, though he did cancel a scheduled COVID-19 press conference after the announcement, before calling for Householder's resignation.

It's an incredibly sordid story which we report in detail today. It's also one that should remind everyone exactly what they can expect when they put corrupt politicians like this in power who did the bidding of major corporate interests, rather than the public's.

In not entirely unrelated news today, Couy Griffin, the idiot who heads up a group called "Cowboys for Trump", is calling for Americans to take their masks off because they --- as opposed to the coronavirus --- are making everybody sick. And while we'd love to ignore Griffin and the "Cowboys," it turns out he's also an elected Republican official in New Mexico and the same jerk who posted a video back in May which began by announcing that "the only good Democrat is a dead Democrat." And while we'd love to ignore that as well, that video was then retweeted by the President of the United States that month, along with the message "Thank you Cowboys. See you in New Mexico!"

Idiot elected "cowboys" and Presidents of the United States may be one thing we've come to expect by now. But with the coronavirus smashing records in at least 31 states, we'd hoped we'd get better from the Governors who have been left to handle the pandemic after Trump decided he had better things to do, despite some 4 million infected Americans and 144,000 U.S. deaths now from COVID-19 over the past six months.

But our hopes have been dashed. By Florida's very Trumpy Governor Ron DeSantis who's made a jackass of himself over the past month as cases, hospitalizations and deaths skyrocket in his state --- now overwhelming hospitals with at least 50 having run out of ICU beds --- while ordering kids back to in-person classes next month; By Georgia's Trumpy Governor Brian Kemp, who is suing cities in the state for instituting mask mandates as the Peach State also breaks single-day case records and death records; By Texas' Trump-loving Governor Greg Abbot, who wonders where he went wrong in reopening up the state so early, now that hospitals in Houston, Dallas, San Antonio and elsewhere are overwhelmed and calling in refrigrator trucks to serve as overflow morgues to hold all of the extra dead bodies.

But now we now have Missouri's woeful Governor Mike Parson declaring he's just fine with kids in his state becoming infected in the classroom. "These kids have got to get back to school," Parson told a local radio station recently. "They're at the lowest risk possible. And if they do get COVID-19, which they will --- and they will when they go to school --- they're not going to the hospitals. They're not going to have to sit in doctor's offices. They're going to go home and they're going to get over it."

Whether Parson, who replaced the state's previous Republican Governor after he resigned in a sexual coercion, abuse and blackmail scandal, realizes that those kids go home to parents and grandparents who they will infect in turn (not to mention all of the teachers and staff at those schools) is unclear. Hopefully Missourians, however, understand it by now, and will consider replacing Parson this November with state Auditor Nicole Galloway, the Democratic candidate for Governor. Maybe then the good folks of Missouri can begin to have nice things again.
